CONSENT AGENDA
November 22, 1982
The Consent Agenda is a technique designed to expedite handling of
routine and miscellaneous official business of the City Council.
The entire Agenda may be adopted by the Council in one motion. The
motion for adoption is non -debatable and must receive unanimous
approval. By request of any individual Councilmember, any item can
be removed from the Consent Agenda and placed upon the Regular Agenda
for debate.

RESOLUTION NO. 1516
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION ACCEPTING THE FINDINGS OF THE
INFILTRATION/INFLOW ANALYSIS AS CONDUCTED
BY TKDA AND ASSOCIATES
WHEREAS, as part of the Combined Sewer Overflow Study
conducted by the Metropolitan Waste Control Commission, an
Infiltration/Inflow Assessment was performed for the City of
Mounds View; and
WHEREAS, Mounds View was determined to have "potentially
moderate" Infiltration/Inflow; and
WHEREAS, based upon this "potentially moderate" ranking, it
was recommended that a more detailed Infiltration/Inflow Study be
performed; and
WHEREAS, the City contracted with TKDA and Associates to
conduct this more detailed study; and
' — WHEREAS, the results of this study estimated that the total
base waste water flow for the sanitary sewer system was 294 million
gallons per year; and
WHEREAS, the total annual Infiltration/Inflow for an average
year, as estimated by TKDA and Associates, is approximately 122 to
132 million gallons; and
WHEREAS, based upon current figures, the cost to the City of
Mounds View to transport and treat the present Infiltration/Inflow
is approximately $91,000.00 annually; and
WHEREAS, based upon U.S. Environmental Protection Agency
criteria, no excessive infiltration or inflow is present; and
WHEREAS, as a result of the study, the report indicates that
there is no need to further study the sanitary sewer system or
portion thereof;
NOW, THEREFORE, BE IT RESOLVED that the City of Mounds View
concurs and accepts the findings of the Inflow/Infiltration Report
prepared by TKDA dated October, 1982;
BE IT FURTHER RESOLVED that the Mounds View City Council
directs its City -staff to continue monitoring selected portions of
the sanitary sewer system with its own personnel and equipment and
also to submit necessary materials and data for final grant payment.

STATE OF MINNESOTA
RESOLUTION OF APPRECIATION TO KEN BRESKE
WHEREAS, Ken Breske has resigned his position on the
Mounds View Planning Commission after two years of service; and
WHEREAS, Ken Breske has shown a sincere interest in the
welfare of the citizens of Mounds View during his tenure on the
Mounds View Planning Commission; and,:,
WHEREAS, Ken Breske has won the respect and gratitude of
all those who have had the privilege of working with him on the
Planning Commission and other areas of community development;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Mounds View on behalf of the residents of the City of
Mounds View, expresses its heartfelt appreciation to Ken Breske °
for his dedicated and selfless work on the Mounds View Planning
Commission.

SUBJECT: TYSON DISTRIBUTION WAREHOUSE AND TRUCKING CENTER
D & A DEVELOPMENT CO.
DEVELOPMENT AGREEMENT NO. 81-50
The above named project is now complete pursuant to the require-
ments of Development Agreement No. 81-50. The City approved a
temporary occupancy a number of months ago and the remaining work
left at that time has been completed.
Operation of the center has not caused complaints since meetings
were held with the abutting residents in September, 1982, at which
time operation policies were revised. Staff would recommend
approval of Resolution No. 1514 approving completion of the project
and release of the securities.

RESOLUTION NO. 1514
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
APPROVAL OF THE COMPLETION OF DEVELOPMENT
AGREEMENT NO. 81-50 WITH D & A DEVELOPMENT CO.
WHEREAS, D & A Development Co. was required by Development
Agreement No, 81-50 to provide a security in the amount of
$102,123.00; and
WHEREAS, the security is required to insure that the
development is in accordance with the requirements as outlined
in Development Agreement No. 81-50; and
WIIEREAS, all conditions and requirements pursuant to
Development Agreement No. 81-50 have been completed and fulfilled;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City I
Council approves the completion of the conditions and requirements
in Development Agreement No. 81-50 and authorizes the release of
the security for $102,123.00 and the issuance of a Final Occupancy
for the Tyson Distribution Warehouse and Trucking Center located
C at 4825 Mustang Circle;
BE IT FURTHER RESOLVED that the Mounds View City Council
authorizes a refund of the unused portion of the administrative
fees submitted.

SUBJECT: SIX MONTH REVIEW OF DEPARTMENT SECRETARY
Staff has recently completed a formal review of Mrs. Sharie Linke
who has completed her six month probationary period with our
department and would like to highly recommend her status be updated
to a pernndnenL employee for SuccesSfuily completing her probationary
period. During the past six months staff has completed two formal
review processes with Mrs. Linke and has ranked her as meeting the
responsibilities in each of the job qualifications and ranked her
exceptional in two areas.
Staff would further recommend that her salary be increased the
5% or 27C per hour as outlined in the memo dated April 21, 1982,
which would increase her current salary from the existing $5.40
per hour to $5.67 per hour. With the proposed salary increase
Mrs. Linke's salary would compare to $5.83 for the Public Works
Department Secretary, $7.03 per hour for the Administrative Secretary,
and the $6.05 per hour for the Police Department Secretary. It
should further be noted that staff also will be supporting a salary
® increase for 1983 which would be a cost of living increase that
would be above and beyond the proposed 58 or full-time rate of
$5.67 per hour.

RESOLUTION NO. 1513
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING THE APPOINTMENT OF SHARON LINRE
AS A FULL TIME CITY EMPLOYEE
WHEREAS, the Mounds View City Code, Chapter 6.04 defines
a full time employee who is one who has successfully completed
the required probationary period and who was employed on a
schedule of at least 40 hours per week; and
WHEREAS, Sharon Linke has successfully completed hete
six month probation period; and
WHEREAS, it was agreed by the City Council to raise
the hourly rate of Sharon Linke from $5.40 to $5.67 per hour
after a successful probationary period.
NOW, THEREFORE, DE IT RESOLVED that the City Council of
the City of Mounds View does hereby appoint Sharon Linke as
a full time City employee and directs the Finance Director to
increase the hourly rate of the Secretary to the Parks, Recreation
and Forestry Department by 27 cents per hour, effective November
10, 1982.

RESOLUTION NO. 1517
CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION AUTHORIZING THE REPLACEMENT OF A NUMBER
OF WATER METERS AND ESTABLISHING A POLICY FOR WATER
METERS FOUND TO HAVE INACCURATE READINGS
WHEREAS, the City has begun a water meter maintenance
program and has tested and serviced 260 meters; and
WHEREAS, it has been found that over 85% of Corad brand
meters tested have readings of more than minus three percent (38)
in error;
BE IT RESOLVED that the replacement of approximately one
hundred (100) Corad water meters presently in service is hereby
authorized,the funds for the purchase of said water meters to
come from the Water Fund.
BE IT FURTHER RESOLVED that the following shall apply
whenever water meters are tested under the City's meter maintenance
program or otherwise requested to be tested by the City and also
whenever requested to be tested by a water user pursuant to
Chapter 70.17 (3) of the Municipal Code:
1) If a meter tests within a range of minus three percent
(38) to plus one and one half percent (1h8) of an
actual calibrated flow it shall be considered accurate.
2) If a meter does not test within the range listed in (1)
above it shall be considered inaccurate.
3) A meter considered to be inaccurate pursuant to (2)
above shall be repaired or replaced at the City's option.
4) A meter considered to be inaccurate pursuant to (2)
above shall be assumed to have been inaccurate from
the date it was removed for testing to the beginninq
of the then current calendar plus the two
previous calendar quarters.
5) A billing adjustment shall be calculated using the
rate that the meter was found, by testing, to be
inaccurate and also using the water rate(s) in effect
for the quarters the meter was assumed to be inaccurate.
The billing adjustment shall be prorated on the basis
of the amount of time the current water user has resided
' at the service address during the period the water meter
was assumed to be inaccurate.

The Council of the City of Mounds View does hereby ordain:
SECTION 1. Chapter 40.02, Subdivision B(50) is hereby amended to
read as follows:
(50) Home Occupation. Any occupation which is clearly
secon arm y to the main use of the premises as a
dwelling and does not change the character thereof.
(40.10, Subdivision C(3).)
SECTION II. Chapter 40.10. R-1 Single Family Residential District
is hereby amended to read as follows:
Subdivision C.
(3) Horne Occupations. The regulation of home occupations
within residential structures is intended to .insure
that the occupational use is clearly accessory or
secondary to the principal dwelling use and that com-
patability with surrounding residential uses is
e maintained. No home occupation shall be allowed which:
(a) Involves employees other than persons residing
on the premises;
(b) involves alteration or construction features
not customarily found in dwellings;
(c) has an exterior display or sign in excess of
one (1) square foot. Such sign, for identifi-
cation purposes only, shall be located on
either the principal structure or garage. Any
sign existing prior to December 29, 1972, shall
not be enlarged but may be continued at the
size and location upon such date except as here-
inafter specified, or subsequently amended.
Any sign erected after December 29, 1972, but
prior to the adoption of this Code shall come
into compliance with this section of the Code by
April 1, 1983;
(d) involves exterior storage of equipment or.
materials;

and the use of gambling devices, as hereinafter defined, is hereby
declared illegal unless the permit hereinafter provided for is first
obtained and all requirements hereinafter specified are fully
complied with.

107:06 107.07 Permit Fees. The application shall be submitted
together with the permit fees established by resolution of the City
Council for all dates of operation of proposed "bingo" games for a
period of one year to the Clerk -Administrator for presentation to
the Council.
107:07 107.08 Information Required. The application shall
state the date or dates and the hours thereof for which permission
to play the game is requested, and the applicant association shall
not conduct said game at any other time than the hours and date
or dates specified in the application.
107.08 107.09 Council Action. After presentation of the
application and the fees as herein provided, the Council shall,
in its discretion, either grant or deny the same. 0

on the same premises or for a longer period than four consecutive

SUBJECT: SHOREVIEW DISPOSAL SITE
As you know, a parcel of property owned by the University of
Minnesota directly northeast and across 3511 from the City of
Mounds View and the City of Shoreview had been identified by
Ramsey County as a demolition debris disposal site. This
identification was in compliance with State law which required
that the counties in the Metropolitan Area identify sites for
hazardous waste disposal and processing areas.
An earlier discussion with Mayor McCarty revealed that it was
possible that the identification of this site had been modified
in such a way that it would be used for hazardous waste processing,
storage or transfer. A telephone conversation with Mr. Gary Dixon,
City Manager of Shoreview, on this date revealed that the Waste
Management Board has preliminarily identified the Shoreview site
as a hazardous waste transfer site. Mr. Dixon has indicated that
the City of Shoreview has taken the position that they will do
everything possible to prevent the actual designation of this site
as a hazardous waste transfer site from occurring and that the
University of Minnesota has also stated its opposition to this
preliminary identification by the Waste Management Board.
Mr. Dixon has indicated that the City of Shoreview would greatly
' appreciate any signs of sunport from the City of. Mounds View in
this matter, therefore, staff would request Council authorization
to send letters to the University of Minnesota and to the City of
Shoreview indicating our support of their position opposing the
identification of the Shoreview site as a hazardous waste transfer
site by the State of Minnesota Waste Management Board.

FOR 7656 AND 7660 WOODLAWN DRIVE
Attached is a copy of a letter from Dynamic Designers requesting a
building permit. This request is the result of a meeting held
October 28, 1982, between Jim Cepress, Art Fretag, Dick Meyers and
myself. The applicants are of the opinion all, or nearly all, the
information required by the City for approval has been submitted as
part of the previous application. Since this is the first official
request for action under Chapter 48, staff is requesting guidance
from the City Council as to desired process to be followed. It
appears that the following items will need to be determined:
1) Amount of administrative fees.
2) Degree of wetland alteration that may be permitted.
3) Review process (e.g., should applications be referred to
Planning Commission and/or Wetlands Committee?).
4) Authorize staff and John Johnson to expend time and
resources on review.
5) Will applicant be allowed to build all four units and
garages or will the plan have to be modified.
It is suggested that the Council may wish to schedule this item for
discussion at the next Agenda meeting or Wetland Committee meeting.

cated at 7656 and 7660 Woodlawn Drive. These lots are zoned for 4-plex. It is
our intent to develop these lots and this is our letter of application to begin
the building permit process.

It is my understanding that any construction on the lots in question would fall
under the prdvisions of Chapter 48, wetland Zoning Ordinance.
This project was initiated in 1979. Since that time, we have amassed much informa-
tion as requested by the Mounds View staff and City Council. All information was
directed to Development Proposal, Case No.43-79 and is probably in your files by
that number.
In that case folder, you should find the following information:

RE: 1982 One Ton Dump Truck Bid Opening
During the past month, staff has been involved in the preparation,
review and compilation of bid proposals for the purchase of a
one ton dump truck to be used in the park maintenance division.
As you are aware, bid specifications were prepared in the middle
of October and forwarded to sixty-four truck and car dealerships
to solicit their specific proposals. The bid opening was held
on November 10, 1982 at which time nine formal bid proposals were
received and read aloud. The bids for the purchase of a new one
ton dump truck ranged from a low of $10,227.00 from Rosedale
Chevrolet to a high bid price of $12,396.00. In addition to the
nine bid proposals staff received for the purchase of a new
vehicle, bid proposals were also received for the possible purchase
of a used dump truck.
Of the two used vehicles, one of them has been sold which makes it
no longer available, and the second vehicle is a 1; ton dump truck
available through Trail Dodge, Inc. Staff has reviewed the 1979
dump truck at Trail Dodge has found it to be extremely well equipped
with a number of options that could potentially be useful to the
city maintenance department including a Meyer E28 single auger/single
spinner sander and four-wheel drive. The vehicle has a number of
options in addition to those pluses listed that the city would not
necessarily be interested in including an AM/FM stereo radio, Michelin
tires, bucket seats, dual electric horns, electric tachometer, conven-
ience package, etc. The current asking price for the used vehicle
is $15,000.00 which Trail Dodge upon further discussion stated that
they would be willing to negotiate to no lower than $13,000.00.
Based on staff's review of both new and used proposals, staff would
recommend that the city purchase the one ton dump truck as outlined
in the enclosed specifications from Drookdale Ford for the low bid
price of $10,709.00. It should be noted that Rosedale Chevrolet
has withdrawn its initially low bid of $10,227.00 due to a mathematical
error. Staff contacted city attorney Mark Carney and he indicated that
it is not in the city's best interest to attempt to hold Rosedale
Chevrolet to their low bid of $10,227.00 and we received a letter from
Rosedale Chevrolet formally requesting that their bid proposal not
be considered due to the mathematical error.
In addition to recommending the purchase of the new dump truck from
Brookdale Ford for $10,709.00, staff would further recommend that
bid option number one which is for the purchase of a Venturo CT2003 Crane
for a low bid price of. $1,045.00 also be purchased. The Crane would
be used for a multitude of purposes including lifting of engines from
lift stations, rngincs from cit ehicles, large sewer pipes and a
myriad of other noses. The (:cane would be mounted on the rear
- 2 -
of the dump truck with a flush type mount and would have the capabilities
of lifting 2000 lbs.
In addition, staff would recommend that the City Council consider ti�
purchase of the heavy-duty plow as proposed by Brookdale Ford at a
cost of $1,344.00 should the Council desire to have a second vehicle
available for snow plowing. We currently only have one vehicle within
the city with a plow which is the 3/4 ton four-wheel drive truck and
staff Feels Lhat the potential capabilities of using the one ton
dump truck as a back up plow as well as possibly having two vehicles
to do local plowing would be an excellent asset to the city's fleet
at a cost of $1,344.00, It should be noted that at this time we are
able to accomplish the city's plowing needs with the 3/4 ton four-wheel
drive truck but feel that the addition of the second plow Vehicle would
increase our efficiency and productivity.
We currently have $15,000.00 allocated for a one ton dump truck and
the total bid price should the Council decide to purchase both bid
options would total $13,098.00 or approximately $2,000.00 under the
current budgeted price. It should be further noted that staff has
renegotiated the box contract with Brookdale Ford and they will be
including a 3/16" smooth steel deck on the box rather than the initially
bid 1�" pine wood floor, at no additional charge.

RE: Golden Gloves Boxing Program
The Mounds View Golden Gloves Boxing Program has been extremely
successful during its past three months of operation with over
fifty-six young men currently participating in the program on
Monday, Tuesday and Thursday evenings at Edgewood Community
Center. The program is currently coordinated completely with
volunteer leadership with two club directors, Mr. John Holmes,
a Mounds View resident living in the Townsedge Trailer Park and
Manny Bartolo coordinating the program on their own time.
As you are aware, the City Council has already granted a six-month
trial approval program for the Golden Gloves Boxing Program and
(luring .its initial six weeks it appears Lo be extremely well re-
ceived by the youth in the Mounds View community. John Holmes has
made an initial contact with the Irondale High School Student Council
and school administration and has set up a sparring exhibition to
be sponsored by the student council at Irondale on December 16, 1982.
The major reason for offering such a program is to raise additional
monies for the Golden Gloves Program as no fees are charged for
the program beyond the $12.50 medical insurance program, to enter
the program. Any monies that might be raised through the sparring
exhibition on December 16 would be used for the Golden Gloves Box-
ing Program to purchase additional equipment, for school rental and
hopefully the eventual purchase of a temporary boxing ring.
In order to conduct a sparring exhibition in Minnesota, an application
for a franchise must be submitted through the State of Minnesota to
their Athletic Association to insure that all rules and regulations
governing boxing in the State will be abided by. I have included
a copy of the State of Minnesota official application, as can be
noted, is extremely simple which needs to be accompanied by a $25.00
check which Mr. Holmes and Mr. Bartolo have indicated they will pay
out of their own pockets. In addition to the enclosed application,
I have included a copy of the signed waiver and hold harmless agree-
ment whlcn was signed by nuL uiily Julia fiolmes but also Roger Founy
the Executive Director of the State Golden Gloves boxing program as
well as a copy of the year-end program for Golden Gloves boxing
program and a copy of the physician's report which is required for
all to fill out before participating in a Golden Gloves boxing
match.
