Motion Carried Josey Warren, 8044 Greenwood read a prepared state- 4. Residents Be- ment, regarding the Festival in the Park and the quests and Council 's position that they will accept no more Comments from losses on the Festival. She recommended that the the Floor Council make an effort to fill the vacancies on the Commission with businesspeople from the City, who would have a better understanding of the finances involved, and thus save the taxpayers from having to subsidize the Festival. Mayor McCarty replied that the Festival Commission and it's chairman have worked very hard. He added they will take Ms. Warren's recommendation under advisement when filling the vacancies. Mayor McCarty closed the regular meeting and opened the public hearing at 7:40 PM. Director Johnson advised he had sent a memo to the 5. Public Hearing Council on December 8, answering the questions Knollwood Greei they had raised earlier. Condominium Proposal '4r. Herr reviewed his proposed development, stating wit would be 32 two and three bedroom condominium units, which would be owner occupied and share common space. He asked for Council consideration Mounds View City Council December 13,•1982 Regular Meeting Page Two , -------------------------------------------------------------------------- of reducing the number of covered parking spaces, and explained they had had a study done, which showed the average owner would be a single, career person, and there did not seem to be a need to have two garages per unit. Ile also asked the Council where they would like the handicapped spaces, as this was not a handicapped project and they had no idea where they might be most needed. Mr. Herr also explained that in a condominium development, there is a home owners association, with very specific laws and guidelines to follow, to monitor themselves. Hr. Herr presented sketches of the proposed development. Doug Dindorf, 2901 Oakwood Drive, asked what assurance there is against the developer putting up another building at a later date, and how the limited access road will remain for limited access. Mr. Herr replied that the common area will be owned by the 32 home owners and cannot be taken back, and becomes part of the plat. He added the utility easement will be provided to the City. Clerk/Administrator Pauley added the City will have stipulations in the development agreement regarding the emergency access, easements, and so forth. Mr. Dindorf still expressed skeptism with the residents using the emergency road to get in and out of their property. Attorney Meyers explained that if the proposal is approved, a conditional use permit will be issued, which will stipulate conditions, and that a development bond will be posted during construction. He pointed out also that there will be an easement on the property for the benefit of the City, which could also be recorded with the Registar of Deeds at the County. Jan Schultz, 7807 Spring Lake Park Road, stated she had presented a petition in 1979 to take an easement from the developer and from her, and some neighbors, to put in a road and allow them to develop the backs of their lots. Attorney Meyers replied the City is addressing the access to the road, not the street easement. Director Johnson pointed out the easement on the sketch and gave it's dimensions. Jerry Linke pointed out that the common area is also to be a holding pond, which the City will have control over, and which could not be built on. Dave Long, 7749 Knollwood Drive, asked if the City was using the updated Comprehensive Plan, and if so, if this,proposal was medium density. Director Johnson replied yes, and explain 1e plan and how it relates to the area in question 0 • Mounds View City Council December 13, 1982 Regular Meeting Page Three -------------------------------------------------------------------------- Mr. Herr explained he will be submitting a landscap- ing plan that is acceptable to the City, as well as meet the approval of the FHA. Mayor McCarty closed the public hearing and reopened the regular meeting at 8:15 PM. Motion/Second: Hodges/McCarty to approve the Condi- tiona Use ermit for the Wayne Herr Knollwood Green condominium proposal, with the requirements of the Mounds View Planning Commission Resolution No. 56-82, including completion of Oakwood to emergency access, and entering into a development agreement with the City. Councilmember Doty - aye Councilmember Hodges - aye Councilmember Forslund - aye Councilmember Blanchard - aye Mayor McCarty - aye Motion Carried Councilmember Doty noted the property owner to the east has property which joins the back of the garages and questioned the access rights into the area. Director Johnson explained the property owner to the ,,---,east could develop the same type of project, but there would not be room to develop a public road between the two parcels. Mayor McCarty questioned the figures provided in the CED study regarding the fire flow of the water. Jim DeBenedet, engineer for the project, explained the figures provided in the report are all on the con- servative side and that there would be more than ample flow for the development. Director Johnson also stated he had reviewed Mr. DeBenedet's proposal and finds that it meets all the requirements, and explained the standards that are used. There was considerable discussion among the developer, the Council and members of the audience of the possi- bility of residents of the development trying to use the emergency access road to travel in and out, to avoid the traffic and turn -around on Highway 10. It was also questioned how large vehicles would maneuver in the parking lot. Mr. Herr explained that drivers of large trucks would know to back their rigs in and other vehicles shouldn't present a problem in turn- ing around. Mayor McCarty questioned if Mr. Herr was willing to meet all the requirements of the Fire Department for the construction and maintenance of the emergency access road out to Oakwood, and bear the cost. Mr. Herr replied he is willing to build an unimproved road to meet the requirements of the Fire Department. Mayor McCarty stated it would be a condition of Mounds View City Council December Up 1982 Regular Meeting Page Four ----------------------------------------------------- --------- -------- the development agreement. Mayor McCarty stated the City has been addressing this project for three years, and the developer has complied with the requirements of, the City, and the Comprehen- sive Plan, the Planning Commission has addressed it, and the Council has addressed it. He stated that after reviewing it at length, they have done the best they could with what they have. Attorney Meyers stated there is no relevence if an employee has an interest in another liquor establish- ment. In response to questioning, Mr. Loosen stated he has an employee code, with guidelines for his employees to follow, which he has used at other of his establish- ments and found to be very well received. Mayor McCarty questioned if the City can require compliance of the memo in question as part of the license. Attorney Meyers replied that it should constitute part of the file, and that the Council has other concerns. Attorney Meyers advised Mr. Loosen will have to be the owner before a license can be issued. Mr. Loosen replied they will be closing on January 3, 1983. Mayor McCarty requested formal approval from the Council to represent the Council in testimony at the Met Council noise guidelines hearing. Report of Action Alert to the Council, which was received from Administrator the League of Minnesota Cities, regarding the budget that was just passed, and reviewed the impact the budget cuts will have on the City and it's employees. Clerk/Administrator Pauley reported that unless there is a heavy snowfall in December, the snow plowing budget will come in as budgeted for. Clerk/Administrator Pauley asked authorization to purchase a Christmas tree for City Hall, using pop fund looney. The Council gave their approval. Clerk/Administrator Pauley reported he had met with representatives of the MAC, along with the admini- strators from neighboring cities, and updated the Council on what was discussed. Motion/Second: McCarty/Doty to direct staff to i eta .etter'with the Metropolitan Council, opposing A95, approving of the FAA request for a RS1L system cn the end of Rnnwav 35, as it does not conform with the short and long range pians for the airport, as outlined by MAC. 5 ayes 0 nays Motion Carried Clerk/Administrator Pauley updated the Council on MAC's and the FAA's position on changing the flight pattern for the airport. Earlier this year, the Festivities Commission received a letter from the council, I believe, in which it was stated that the council would accept no more Festival losses. As you are no doubt aware by now, the 1082 Festival lost more than $1,100.00. The reason I bring this to your attention is that beginning next week, the council will begin reviewing applications for citizens who wish to sit on this and on the other advisory commissions. I would like to see a concerted effort on the part of the Mayor and the council - members to appoint businesspeople of our community, people who :till not allow a net loss on the Festival and people who are "break-even" oriented. I ask that the Mayor and new council xake this a priority item so that the taxpayers are not again called upon to sebisidize the Festival. RESOLUTION NO. 1531 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION OUTLINING THE POLICIES REGARDING THE USE OF VOLUNTEERS FOR WINTER FLOODING OF SKATING RINK FACILITIES WHEREAS, the Mounds View City Council is responsible for the health, welfare and safety of all Mounds View residents; and WHEREAS, the Mounds View City Council would like to pro- vide the greatest amount of service as possible to Mounds View residents at the most economical dollar; and WHEREAS, Mounds View residents have indicated a willingness to volunteer their services to maintain the winter ice skating rink facilities; and WHEREAS, the Mounds View City Council desires to establish a policy for using volunteers with the winter skating program. NOW, THEREFORE, DE IT RESOLVED that the City Council of the City of Mounds View hereby adopts the following policies re- lating to the use of volunteers for winter flooding: 1. All volunteer help must receive training through the city public works department, through the water department on the use and care of city equipment to include the following: a. Proper care and drainage of city hydrants. b. Proper procedure for draining and storing flooding hose. c. Proper use of city equipment including hydrant wrenches, city buildings and hose adaptors. d. Proper flooding techniques to insure that not too much water is placed on the ice or that flooding is only occurring during the proper weather conditions. 2. That a responsible adult sign out the city equipment and they would in turn assume responsibility for any loss, stolen or damaged equipment due to negligence. And, furthermore, that the responsible adult may be charged a fee for any missing or damaged equipment. 3. That volunteer flooding will coincide with existing city skating schedules so that proper ice will be available during the Scheduled 1.1111C `J• 4. Since the volunteer help will not detract or deter from the city's union personnel from receiving overtime pay when it is applicable. 5. Of these three cars the Malibu is the backup squad, thelother two cars are assigned to daily use. We did not feel at the time of delivery that the Fairmont met specifications; the transmission was too small and the vehicle did not have a full -body frame. Because of the split frame the wheels do not hold an alignment;:due to body twisting. The Officers do not have confidence in the car because of the possibility of an accident and resulting injuries due to the lack of a full -body frame. The 1981 Ford Fairmont developed steering problems, which will cost approximetely $500. The City's maintenance department will take the parts from another Fairmont, owned by the City, to make necessary repairs, however, it is unknown how long this type of repair will last. I would like to suggest that the Council consider opening bids once again for a new squad car, to be purchased as soon as possible. This would permit us to release the Fairmont and keep the two Chevrolets. Subdivision 1. Findings of Fact. (a) The public interest necessitates sound land use development as land is a limited and irreplaceable resource and the land within the municipality is a resource to be developed in a manner which will result in minimum damage to the quality of life and to property and threat to health and reductions of private and public economic loss caused by drainage problems. (b) The existing drainage system in Mounds View in general adequately meets the needs of the City. However, the storm drainage system will not in the future provide adequate or proper drainage in those areas of the City subject to substantial residential, commercial or indus- trial development unless the large increase in storm water runoff that is known to result from such development is properly controlled and regulated. The consequence of not restricting such increase in runoff would be to sub- ject a major portion of the lands of the City to high water tables, drainage problems, storm water flooding by heavy rains, inadequate drainage facilities, causing erosion, damage to property disruption of residential, commercial and governmental services, unsanitary conditions and inter- ruption of transportation, all of which would be deteri- mental to the health, safety, welfare and property of • affected residents of the City. Subdivision 2. Purposes. (a) To reduce or eliminate storm water and drainage damages and minimize storm water runoff through land development management measures stressing storm water retention and/or detention. (b) To guide and control new development of lands within the City in ways that will be consistent with the zoning laws and Comprehensive Development Plan in force at the time of the development, consistent with the requirements of Rice Creek Watershed District, Municipal Code, Minn. State Statutes, and other regulatory agencies and consistent with sound economic policies as such policies affect property 0 owners and the proponents of new developments; and to require proponents of new developments to adopt sound develop- ment plans and proposals that will forward the productive use of their property and will cause no economic burden both as to storm waters or drainage, on the owners of abutting or adjoining properties, or affected properties, or on the property owners of the City at large. 49A.02 General Provisions. Subdivision 1. Applicability. The requiremrnt� adopted hciciu shall apply to all development proposals that are subject to the provisions of Chapter 59.07 of the Municipal Code. 0 3 Subdivision 2. Required Facilities. The City may, at its sole discretion, require storm sewers, retention and/or detention basins or any other type of drainage improvements that• are required for any development proposal. Subdivision 3. Performance Guarantee. Whenever privately owned and maintained drainage improvements shall be required for a development by the City, the developer shall provide a seven year maintenance/performance guarantee to assure proper maintenance and operation of such improvements. In such cases, the developer shall also hold the City harmless for any defects in design, construction or operation. Subdivision 4. Financial Responsibility. Drainage facility improvements required for any development proposal shall be the financial responsibility of the developer. 49A.03 Design Standards. Storm sewer systems required for any development shall be constructed to at least a five year frequency storm design, retention basins shall be constructed to retain at least a hundred year storm while allowing at a maximum, the amount of runoff from the property that will occur in its undeveloped state resulting from a five year storm. 49A.04 Definitions. Subdivision 1. Five, Fifty and One Hundred Year Storm. It shall be as determined by U.S. Weather Bureau Technical Paper Nos..40 and 49 and shall be the 24 hour rainfall event with a probabil- ity of reoccurrence of once in five, fifty or one hundred years. Subdivision 2. Retention Basin. It shall be an area designated to store the surface water drainage from the adjoining drainage basin with no outlet to downstream areas. subdivision 3. Detention Basin. It shall be an area designated to restrict and temporarily store surface water drainage from the adjoining drainage basin. i 49A.05 Responsibility. Neither the issuance of a permit nor compliance with the condi- tions thereof, nor with the provisions of this Chapter, shall relieve any person from any responsibility otherwise imposed by law for damages to persons or property; nor shall the issuance of any permit hereunder serve to impose any liability on the municipality or its officers or employees for injury or damage to person or property. A permit issued pursuant to this Chapter shall not relieve the permittee of the responsibility of complying with any other requirements estab- lished by law, regulation or ordinance. 49A.06 penalty. Any person who violates the provision of this Chapter shall be �) guilty of a misdemeanor. Each day during which said violation exists is a separate offense. Any violation of this Chapter is a public nuisance and may be enjoined by civil action. Costs of any civil enforcement shall be assessed against the party so enjoined. Any person who, in violation of this Chaoter, alters, changes, or modifies any surface water drainage facilities shall restore such facili- ties to their original condition within the time limit set by the Council. 49A.00 Severability. If any part of this Chapter is held to be unconstitutional or otherwise illegal, the remainder of this Chapter shall be deemed and held to be valid and remain in force and effect as if such portion had not been included herein. If this Chapter or any provision herein is held to be inappli- cable to any person, property or work, such holding shall not affect 5 the applicability hereof to any other person's property or work. 49A.00 Variance and Appeals. i Subdivision 1. Processing of Application. An application for variances or appeals shall be processed according to the procedures specified in Chapter 40 of. the Municipal Code. Subdivision 2. Restrictions on Granting Variances. No variance may be granted which would allow any use that is prohibited in the zoning district in which the property is located or which would: (a) Result in incompatible land uses or which would be detrimental to the protection of surface and ground water supplies. (b) Increase the financial burdens imposed on the community through increasing floods and overflow of water onto land areas within this City or onto land areas adjacent to Rice Creek. (c) Be not in keeping with land use plans and planning objec- tives for the City or which would increase or cause danger to life or property. Subdivision 4. Required Supporting Data. No permit or variance shall be issued unless the applicant, in support of his application, shall submit engineering data, surveys, site plans and other information as the City may require in order to determine the effects of such development on the affected land and water area. These aids are shared premium taxes received from insurers writing auto liability policies in the State. The only transactions recorded in the fund are the receipt of the aid check and subsequent transfer to the General Fund. State Statutes prescribe the aids be used for police retirement which is paid in the General Fund. Our auditor's have proposed elimination of the Fund and direct receipt of the aids into the General Fund. I have discussed this with the City Attorney and he states that he can not find a require- ment in the legislation pertaining to these aids that requires a special fund be established. I agree with our auditors that this fund be eliminated and aids received be receipted directly into the General Fund. Elimination of this fund would simplify our accounting for the aid and reduce extra work associated with the maintenance of a separate fund. I request Council consider eliminating this chapter of the Municipal Code.
