Clerk/Administrator Pauley stated that while Mr. 9. Considen
Anderson has no written contract with the City, of Memo om
there is a letter in his personnel file from the Park Director
City Administrator when he was hired, indicating Anderson Re -

f � attend, the 1983 National Recreation and Park
.,ssociation Park Planning and Maintenance School,
appears to be far more valuable to the City than the
NRPA.
Mayor McCarty stated that conferences for department
heads were cut to reduce expenses, and he felt this
should be budgeted in the Park and Rec area. Clerk/
Administrator Pauley replied that it is in the general
fund budget, in the Park and Rec category.
Motion/Second: Hankuer/Linke to approve the request
of Park Director Anderson to attend the first year
of the two year program of the NRPA Park Planning
and Maintenance School, to be budgeted out of the 1983
conference budget, Account No. 4362, in lieu of his
budgeted conference.

lution No. 1635, approving the preliminary plat
for the Cross of Glory Lutheran Church, and waive
the reading.

Dennis Kowalik, 5464 Adams, apologized for being late
with his questions, but asked for a clarification of
what was being done.
Director Johnson explained that the Church has re-
quested a lot combination of five lots into two,
to be able to sell an existing educational building
located at the south end of the property. He added
that his understanding is that they plan to come
before the City soon with plans for a building to
house educational facilities. He stated that
the home would be sold as a single family home.

Herman Growe asked what the plans are for the empty land
by the Church, and questioned whether a day care center
was planned. 0
A representative from the Church stated that they plan
to expand to the north and slightly to the east, and
that it would be added to the present building.
Director Johnson added that a day care home, licensed
for up to ten children, could be allowed but he was
not aware of one being planned at the time.
Clerk/Administrator Pauley explained that Acting Chief 10. 2nd Quarter
Smith had a family emergency and was not able to be 1983 Departme

Mayor McCarty questioned item 5, to review developer 11. Consideration

City, and that it was necessary to estimate the number
of hours for the remainder of the year. 0
Councilmember Linke pointed out that the hours listed
on the July 25 memo have not changed from what was listed
on the June 29 memo. He also pointed out a difference
in the maximum hours listed for the MSA 1983 resurfacing
project, being 122 on one memo, and 112 on the other.
Director Johnson replied that the hours have not changed
as those project have been at a standstill since the end
of June. He explained that it appears to be a typographical
error in the difference of hours• and that he didn't have
his back-up paperwork with him, but he believed that 122
hours was the correct figure.
Couhcilmember Linke questioned the 30-40 hours to prepare
plans and specs for the 1983 MSA resurfacing program,
since Technician Kampel had been authorized overtime to
work on them. Director Johnson replied Mr. Kampel's time
is for drafting work, and that he will be working with
him and directing him on the project.
Councilmember Linke expressed concern with getting locked
into the maximum number of hours listed. Director Johnson
replied that the contract states them as "up to". Is

Ile stated that all other pertinent permits were taken

He added that the fill from that lot was being placed
on 2411 Laport Drive, 9 loads to date, which also
involves a wetland. Ile stated that it should not
impact the wetland due to the separation of the street
and other improved right-of-way. He added that the
fill was dumped without a permit.
Clerk/Administrator Pauley noted that it has been
questioned whether the Rice Creek Watershed District
should be involved.

issue a cease and desist order and instruct the
property owner at 2411 Laport Drive that he may be
required to remove the fill, and to file a filling
permit application with the City of Mounds View,
and the appropriate application with the Rice Creek
Watershed District.

Attorney Meyers advised that the City has commenced 13. Report of

the procedure that will be followed. Ile stated he
anticipates their defense will be that it is a valid
occupation. He added that no court date has been
set and that they will be doing some prelimii+ary work
to get all the facts together.
Attorney Meyers reported that the open meeting
has been amended by statute to provide that a City
must provide an agenda or copies of material that
they will be considering at special meetings:
Attorney Meyers reported on the law regarding conveyance
of state lands to public bodies, such as the surplus
land owned by the Highway Department. Ile also reported
he is suggesting possibly zoning some property in the
City as recreational.

(ayor McCarty asked what options were open for the City
0 `a fund a golf course. Clerk/Administrator Pauley
replied there could be a general obligation bond, tax
increment bond, or seek outside donations. Ile added
that a possibility would be that when a developer does
work in the City, negotiate with him that he help in
developing certain property, in lieu of a park dedication.
Attorney Meyers added that a revenue bond would be another
possibility, but that it would be expensive.
Director Johnson reported he is getting information from
neighboring cities. Clerk/Administrator Pauley added
that Staff would encourage pursuit of ideas, such as
jogging trails, snowmobiling, cross country skiing, as
well as golf.
Mayor McCarty asked that Staff get together information
on the success of surrounding communities courses. It
was also noted that the possibility of a golf course
is in the discussion sta3e only, at this time.
Councilmember Blanchard reported she had attended the
Planning Commission agenda session, and they were
-very concerned about the status of Chapter 40.
Director Johnson explained that the Council and Planning
Commission had held a joint meeting and referred
questions back to Staff, and that he and Attorney Meyers
would be getting together to work on it, but that it
was not a high priority item. Councilmember Blanchard
replied that the Planning Commission would like to see
it moved 'nigher up on the priority list, as it is a
very important tool for them to use.
Mayor Mcrarty stated that they should address the in-
compatibilities between the zoning map and current
zoning. There was discussion among the Council and
Staff on the procedure to be followed to make them
compatible.
Mayor McCarty asked that Staff get something together
for the Council to work on. Clerk/Administrator Pauley
replied that a time table would be prepared by the next
agenda session.
Councilmember Blanchard expressed concern with the
condition of the hole in the road at Groveland Road
and Highway 10, Director Johnson explained that none
of the surface restoration work has been done to date,
id that the City is working to get the developer
,oing. He added that he understands the developer plans
on putting the home in the Parade of Homes, scheduled
for early August, so feels the work will be completed
by then.

Clerk/Administrator Pauley explained the problem that
had occurred with vandalism to Clio water shut-off valve,
and that the work should be done before the water and
sewer approval is given, lie stated he would contact
the developer and have him put some fill in temporarily.
Councilmember Hankner had no report.
Councilmember Linke reported he had attended the
Ramsey County League picnic on July 20, and toured
five regional parks. He stated their next meeting
would be with the Metro Waste Control Commission,
a change in agenda from the Watershed.
Councilmember Linke reported that he had ridden with
three patrol officers on July 16, and felt they did
a very good job.
Mayor McCarty read a portion of the June 20 minutes
of the Metropolitan Airport Commission.
Motion/Second: McCarty/Blanchard ghat the Council
direct Sta to send a letter of protest to the
Metropolitan Airport Commission, carbon copy to
the Met Council, that the proposed instrument
landing system at a minor use airport is not allowed
by law and that the City protests this proposal.

Councilmember Linke reported he had met the new
rep from the Met Council and invited her to contact
Clerk/Administrator Pauley to set up a meeting
between her and the Council.
Mayor McCarty asked Clerk/Administrator Pauley to
notify the Fire Department that the Council wishes
to have a work session with the Fire Chief, along
with officials from Spring Lake Park and Blaine,
and get involved immediately on the proposed 1984
Fire Department budget. He added that the appro-
priate section of his contract could be noted.
Clerk/Administrator Pauley reviewed the memo from 15. Report of
Finance Director Brager, dated July 25, regarding Administrator
certification of delinquent utility bills.
Mayor McCarty stated he would like to be informed
of who was involved, before the hearing, such as
if there were specific problems with the elderly,
or so forth. Clerk/Administrator Pauley replied
they have all been advised, through each piece of
correspondence sent, to contact the City and let
them know of any circumstances in which assistance
could be provided.. He added the Council will be

Comprehensive Storm Water M;ulagement Plan determines that said
device is necessary.
The Completion of the Comprehensive Storm Water Management Flan
for Mounds View is a high priority i!:em and is scheduled for
completion by laic 198:1. IL is Lite City Cuuncll's position that
current Ciry ordinanres regulate wetland, floodplain and storm
water discharges to eliminate increased tlow or nutrient dis-
charges into the exisiLng systems.
Ilopefully, this Letter will allow approval of permit No.83-56 for
Tony poppelaars.

RESOLU'1'IUN OF APPRECIATION TO BARB MCCLUSKEY
WHEREAS, Barb McCluskey has resigned her position on the
Mounds View Festivities Commission after many years of service;
and
WHEREAS, Barb MCCluskey has shown a devoted service to
the success of the "Festival in the Park" celebration; and
WHEREAS, Barb McCluskey has served in an ex-officio
capacity for one year; and
WHEREAS, Barb McCluskey has won the respect and gratitude
of all those who have had the privilege of working with her on
the Festivities Commission.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Mounds View on behalf of the residents of the City of
Mounds View express its heartfelt appreciation to Barb McCluskey
for her dediction and devoted work on the Mounds View Festivities
Commission and wishes her happiness as she begins a new life.

RESOLUTION OF APPRLCIATION TO SIIIRLFY MUNHOLAND
WHEREAS, Shirley Munholand has resigned her position on
the Mounds View Festivities Commission after six years of
service; and
WHEREAS, Shirley Munholand has served the Festivities
Commission as Chairperson for the past two years; and
WHEREAS, Shirley Munholand has given the Festivities
Commission many hours of devoted work and service; and
WHEREAS, Shirley Munholand has shown a devoted service
demonstrated in the success of the "Festival in the Park"
celebration; and
WHEREAS, Shirley Munholand has won the respect and
gratitude of all those who have had the privilege of working with
her on the Festivities Commission.
NOW, THEREFORE, HL IT RESOLVED that the City Council of

�-' of Mounds View expresses its heartfelt appreciation to Shirley
Munholand for her dedication and devoted work on the Mounds View
Festivities Commission.

RE: SATELLITE INDUSTRIES BILL
A memo from Park and Recreation Director Anderson outlines the history
of the Satellite Industries bill for damage to portable warming houses.
The total amount of their bill is $3,073.57. Insurance settlements in
the amount of $318.74 have been received from our insurance company.
This leaves a balance of $2,754.83 payable from City funds. Mr. Anderson
proposes that this amount be paid from Account 100-360-4356 Park Depart-
ment, Satellites. That is a correct codeing of the Invoice. Since
this payment can not be forseen during the budget process I see no other
alternative but to make a transfer from Contingency to that account.
RECOMMENDATION: Council authorize the transfer of $2,754.83 from
Contingency to Account 100-360-4356 Park Department, Satellites to
cover the amount of the Satellite Industries bill.

Enclosed .is a copy of an invoice to satellite Industries in
the amount of $3,073.57. As you are aware, we have been
attempting to resolve the issue of payment to Satellite
Industries for damage to portable trailer buildings during
the winter of 1981-82, for the past: year. Unfortunately, it
has been a long slow process and the results are not totally
to staff's satisfaction.
The total actual payment charged to the City will be
$2,654.83 as we received $318.74 from the City's insurance
company. The difficulty we had in collecting monies on the
insured buildings was twofold; the first being that the
insurance policy that the City carried on each of the
buildings had a $250.00 deductible for each building and in
addition it was $250.00 deductible per occurrence and it was
the insurance company's position that the vandalism and/or
damage.took place over an extended period of time or
numerous occasions rather than one separate incident.
Although staff has authorized payment of the $2,654.83 to
Satellite, we do not have money budgeted in the 1983 budget
and it will show up as a deficit in our 1983 account or the
money would need to be taken from contingency or some other
funding source of which I currently am not aware. Please
advise me as to how you would like me to broach this issue
at the City Council if necessary or the with the City
Finance Director.

dragging on for No past yoar between insurance companies,
our city and your firm. I apologize for this delay but must
share with you my difficulty in approving this expenditure
as I feel the labor and repair bills as provided do not
adequately reflect the damage that actually occurred to the
building. As you are aware, both the invoices and repairs
were made after the fact without any approval of either the
city's insurance agency or the City of Mounds View which
makes it difficult to review Lho situation after the fact.
I apologize Cur the length of time in resolving this issue,
and it certainly has been a lesson Chat I personally and the
City of Mounds View will remember.

RE: Salary increase for Deanna Mortenson
The Mounds View Parks and Recreation Department has been
fortunate to have the services of Ms. Deanna Mortenson
through the summer C.M.T.A, program for the past three
summers. Deanna is a full-time student at Anoka Ramsey
Community College majoring in nursing and works as a
clerical assistant in our department during the summer
months. tier salary has been totally paid for through Lhe
summer C.E.T.A. program and she is currently being
reimbursed at the rate of $3.35/hour.
She has done an excellent job for our department and without
her assistance we would not be able to accomplish many of
the tasks that we do during the busy summer period. Staff
would recommend that Deanna receive a subsidy to be paid for
by the City to her salary of $3.35 of $.65/hour making her
hourly rate $4.00/hour. The additional $.65/hour could be
budgeted out of the part-time program account i00-350-4304
which currently has a balance of $4,228,95. Staff envisions
there will be approximately $500.00 - $1,000.00 balance by
year-end which would easily accommodate and handle the
salary increase for Ms. Mortenson.
Staff would further recommend that the salary increase be
retroactive to June 15, 1983 which is the date she started.
Total cost to tl:e City for the $.65/hour increase for Ms.
Mortenson would be $332,80 based on her 64 days of
employment at 8 hours per day. Staff strongly feels that her
qualifications and abilities more than justify the salary
increase to $4.00/hour.
RECOMMENDATION: Staff recommends that Deanna Mortenson's
salary be increased to $4.00 per hour with $3.35 to be paid
for from the summer. C.E.T.A. program and $.65 to be paid for
out of general fund account: no. 100-350-4304 retroactive to
Wednesday, June 15, 1983,

RE: Lakeside Park
Attached is a copy of a quick claim deed for Lakeside Park
located on Spring Lake in the Cities of Spring Lake Park and
Mounds View. As you are aware, staff has been working with
the city attorney, Mr. Jeff Carson, from the City of Spring
Lake Park during the past year to have the property at
Spring Lake deeded to the Cities of Mounds View and Spring
Lake Park for the purpose of operating a park and
playground. To that end, City Councilmember Doty was
involved in a meeting approximately two weeks ago with Mr.
John Ness, Jr. and Robert Halseth who were president and
past secretary of Playground, Inc. who have authorized the
transfer of property from Playground, Inc. to the Cities of
Mounds View and Spring Lake Park.

We feel that by drafting this quick claim deed, we will be
able to clear up the past title and insure that the park
remains a park for future generations.
RECOMMENDATION: For the City of Mounds View to acknowledge
and accept the quick claim deed for Lakeside Park and
formally make note of it in the City Council minutes for
recordkeeping purposes.

SUBJECT: KNOLLWOOD GREEN CONDITIONAL. USE PERMIT REQUEST
At the August 3, 1983 Planning Commission meeting, the Planning
Commission adopted Resolution No. 92-83 recommending approval of a
conditional use permll to uepraiv model units in one of the Knollwood
Green condominium units. Atlavhvd please find the staff report,
Planning Commission Resolution No. 92-83, (minutes of the August 3,
1983 Planning Commission meeting were not yet available), in addition
to Resolution No. 1640, for your review and possible adoption.
Per Section 40.23, Subdivision A0 0), the City Council has the option
to set and hold a public hearing on this conditional use permit. If
you choose to do so, the public hearing would be set at this upcoming
meeting (August 8, 1983) with the public hearing on August 22nd.
The developer was not aware that conditional use permit approval was
required to operate model homes. He is intending on showing the
building during the upcoming Parade of Homes which starts this Sunday,
August 7th. Staff has preliminarily approved the request by Ilumpal
Construction to start using the building as a model on Sunday, August
7 for the Parade of Home event with the understanding stated to the
applicant that if the Council does not approve Resolution No. 1640,
use of the building as a model would have to be discontinued. In
addition, should the Council place additional conditions on the
conditional use permit, staff wil relay the conditions to the
applicant. The developer also asks that the Council approve this
request without a public hearing which would possibly delay the use of
the building as a model for two weeks.

WHEREAS, Uumpnl Construction Company desires to operate model
units on the first flour ul the huilding located at 2900-2914 Highway
10; and
WHEREAS, model units require a conditional use permit in R-3
zoning districts; and
WHEREAS, the Planning Commission reviewed this conditional use
permit request at their August 3, 1983 meeting and recommended
approval by adopting Resolution No. 92-83;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City
Council hereby approves a conditional use permit to Humpal Construc-
tion Company to operate model units on the first floor of the condo-
minium building located in the Knollwood Green Development at
2900-2914 Highway 10;
^ BE IT FURTHER RESOLVED that the following conditions shall
apply to Lhis conditional use permit:
1) When all remaining living units of the Knollwood Green
Development (28 units) have been sold, this conditional
use permit would expire.
2) The right turn lane into the project area be installed
prior to August 31, 1983 to provide safe access into the
project area.
3) Employees of the development use either the garages or
the area under active cunstnictlon to park their
vehicles.
4) Barricades be installed separating the active construction
area from the rest of the development.

As you are probably aware, the Parade of Homes starts this weekend.
Since development agreements for both Knollwood Green and Silver Lake
Woods require City Council approval of occupancy/temporary occupancy
permits for 8 unit buidings, approval for the model home usage is
necessary. The units involved will be completed and safe for
occupancy by August 5, 1983.
RECOMMENDATION: Staff recommends approval for temporary occupancy
permits for 2900-2914 Highway 10 and 2566-2580 Mounds View Drive.

SUBJECT: MILLER INDUSTRIAL PARK FINAL PLAT
Mr. Miller has requested an extension to the deadline for Final Plat
submission. The deadline as exlained in my memo of July 28, 1983 is
either August 9 or August II, 1983. Chapter 42.05, Subdivision 3(1)
allows the Council to extend the deadline "fur good cause". Chapter
42.05, Subdivision 3(h) lists factors to be considered In granting an
extension to the final plat deadline.
In order to approve the final plat the follnwing items will have to be
submitted and approved:
1. Engineering proposals pertaining to:
a) Water Supply
b) Sewerage Disposal
c) Storm Drainage (Chapter 49A)
d) Street Plans and Profiles
e) Other Utilities
2. Approval by other public entities having jurisdiction such as:
a) Noun
b) Ramsey County
c) Rice Creek Watershed District
3. Final plat map containing all the items listed in 42.08.
4. Wetland Alteration Permit.
5. Floodplain modification which, depending on wetland
alterations, may require a conditional use permit.
To date, the applicant has submitted a wetland alteration application
and a final plat map which will need revision. The preliminary plat
illustrated the proposed sewer, water, storm sewer and street
improvements. These preliminary plans are not judged sufficient to
grant final plat approval.
It would appear that items I, 2, 3, and 5 listed above are dependent
upon wetland alteration activites, therefore, a determination of the
amount of wetland alteration necessary or the amount that will be
allowed needs to be made prior to preparation of the required detailed
exhibits and agency approvals.
RECOMMENDATION: The City Council can either:
a) Grant a time extension "for good cause";
b) Approve the final plat with a whole series of contingencies;
c) Determine the preliminary plat is void due to failure to
complete the Code requirements in the allotted time frame.

SUBJECT: PILL AND WETLANDS ALTERATION PERMIT FOR PAUL JOHNSON
Mr. Paul Johnson has applied to the City for a fill and wetlands
alteration permit for the fill which was deposited on his property
located at• 2411 Laport Drive. As you will recall, this item was
discussed by myself at• the last• Council Agenda Meeting and
Mr. Paul Johnson was requested to apply for a fill and wetlands
alteration permit since the fill deposited is located within the
100' buffer zone of a wetland. Mr. Paul Johnson intends on filling
depressions in his yard with this fill, then seeding the area north-
west of his home.
He has stated that he will not be changing any of the grade on this
section of his lot with the additional fill. In addition,
Mr. Johnson is intending on using the fill deposited on the east
side of his iot to raise the ground elevation approximately one foot
for a proposed driveway and garage. (See attached sketch.)
Attached please find Resolution No. 1642 which approves both a fill
^, and wetlands alteration permit for this application. Staff recommends
these permits be approved since the fill deposited, even though
`-' located within the 100 foot• wetland buffer zone, will not be changing
the existing contours of the site and will not affect the wetland
located across Edgewood Drive from this property.
Staff also recommends that the City Council waive the requirements
of the applicant to submit• the drawings and exhibits necessary to
process the wetlands alteration permit.
STAFF RECOMMENDATION: Adopt Resolution No. 1642.

RE: City Vehicle Status
As you are aware, the City of Mounds View has received a
PRAB Grant from the Department of Hconumic Security in the
amount of $33,286.00. The grant program commenced on
Wednesday, July 20, 1983 and since that date has been very
actively developing a trail system at Silver View Park. One
of the major problems that has arisen is transportation of
equipment• and materials from the maintenance garage to
Silver View Park as well as the young people from their work
headquarters at Woodcrest Park. A temporary solution has
been developed by having one of the young people drive their
personal vehicle on a day to day basis. This has worked
fairly effectively but staff is concerned that some
potential problems could develop such as truck breakdown,
liability and other cost related concerns. To that end,
staff has developed a memorandum of understanding between
Ms. Thompson and the City which spells out more clearly what
the expectations and liability agreements would be between
the City and the use of her vehicle. Staff has attached a
copy of that memorandum for your review and consideration.
The second option that the City has is to purchase a one ton
dump truck as originally budgeted out of the 1983 revenue
sharing account. Staff has attached a formal bid proposal
from Iten Chevrolet which currently has a 1983 one ton dump
truck in stock that could become available immediately
should the City Council desire to go in that direction. As
can be seen in the enclosed formal bid, the cost of the one
ton dump truck is $12,993.00 and the City has $15,000.00
budgeted out of the revenue sharing account. Staff had
intended on going to a formal bid process in the next weeks
to reevaluate the purchase of a one ton dump truck as the
original request was tabled in December, 1982 due to the
state's financial crisis.
Staff is requesting from the City Council as to how we
should pursue this issue as to whether or not it would be
worth acquiring the one ton dump truck to meet our immediate
needs or enter into an agreement with Ms. Thompson for the
use of her vehicle for the remainder of the PRAD Grant.
Staff will be on hand Monday evening to discuss any issues
you may have on this issue and may be contacted at ext. #Al
should you have any further questions or require additional
information.
RECOMMENDATION: To provide staff with direction as to the
purchase of a one ton dump truck as proposed from from Iten
Chevrolet or direct staff to enter into an agreement as
attached with Mary Jo 'Thompson for the use of her personal
vehicle.

MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF MOUNDS VIEW AND MARY JO THOMPSON
FOR USE' OF IIER PERSONAL VEHICLE
The following memorandum of understanding is hereby
entered into on the Rth day of August 1983 between the City
of Mounds View and Mary Jo Thompson to utilize her personal
vehicle in accordance with the 1983 P.R.A.D. Grant. The
tollowing paints are hereby agreed to and understood between
the two parties, commencing Wednesday, July 20 through
Wednesday September 21, 1983:
1. That Lhe City hereby recognizes lhu need to utilize Ms.
Thompson's personal vehicle on an as needed basis
for transporting equipment, tools and hauling of
materials during the length of the 1983 P.R.A.D.
Grant.
2. That Mary Jo Thompson will provide insurance for her
personal vehicle that will be in full effect for the
then week period.
3. That Mary Jo Thompson will provide the vehicle in good
running condition if at all possible to be utilized on
/ a daily basis.
4. That Ms. 'Thompson will assume any liability regarding
vehicle maintenance and repair for her personal vehicle
which may occur during its usage in accordance with the
1983 P.R.A.D. Grant.
5. That Ms. Thompson will be the only person responsible
for driving the vehicle during the scheduled work hours.
In return for the aforementioned agreements with Ms.
Thompson, the City of Mounds View hereby agrees to the
following:
1. Provide reimbursement for all actual usage on a
weekly basis for gas and other related automobile
lubricants.
2. In addition, the City of Mounds View hereby agrees to
pay Mary Jo Thompson $25.00 per week for the use of her
vehicle commencing Wednesday, July 20, 1983 through
Wednesday, September 21, 1983.
3. In addition, Ms. Thompson agrees to not hold the City
liable for any injuries or liabilities that may occur
through the use of her vehicle on the job site.

To date, the owners/contract purchasers of 7900 Edgewood Drive have
not complied with the work order issued on June 22, 1983. The work
order required that repair be made within 30 days. A subsequent fire
occured after the work order was issued which also added additional
work necessary.
To proceed with condemnation procedures, specific Council direction
should be given to the City Attorney authorizing him to expend his
time and resources in order for him to file the necessary doucments
with the Clerk of Court.

SUBJECT: FAIRCHILD AVENUE RIGIIT-OF-WAY
Attached please find a copy of Resolution No. 1469 adopted by the
Mounds View City Council on August 9, 1982, regarding the vacation
of a portion of the Fairchild Avenue right-of-way between Laport
Drive and Ardan Avenue. You will note under Provision 2 that the
resolution provided that within one year following the date of
the adoption of the resolution the Council would consider the
paving, curb and gutter, storm drainage, watermain, and sanitary
sewer systems for the portion of Fairchild Avenue cul-de-sac lying
north of Laport Drive.
Pursuant to the provisions of this resolution, I am placing this
item before you for your consideration and direction to staff as
to your desires with respect to this matter.
During the past year no action has been taken by any of the involved
parties who objected to the initial vacation as it was their desire
to subdivide their large lots and any vacation would prohibit such
action on their part. Also, as you will recall, we have received
several objections from residents in the area with respect to the
maintenance of that area by the property owner and the use of
the remaining portion of right-of-way by children as a BMX track.
Staff would request Council direction in this matter should you
desire to pursue this issue at this time.

COUNTY OF RAMSEY
eN STATE OF MiNNESOTA
RESOLUTION VACATING FAIRCHILD AVENUE RIGHT-OF-WAY
BETWEEN LAPORT DRIVE AND ARDAN AVENUE
WHEREAS, the City has existing 30 feet of street
right-of-way; named Fairchild Avenue, between Laport Drive and
Ardan Avenue; and
WHEREAS, the City has received a petition from the
required number of property owners to vacate this portion of
right-of-way; and
WHEREAS, there are presently large subdividable parcels
of land which abut this existing 30 feet of right-of-way; and
WHEREAS, the City Council has determined that future
access be available to these subdividable lots; and
WHEREAS, access to these parcels can occur from existing
Laport Drive via a cul-de-sac type roadway; and
WHEREAS, the City has doomed that 60 feet is the minimum
street right-of-way width; and
WHEREAS, the City Council chooses to provide the owners
of the subdividable parcels reasonable time to convey the
necessary easements and installation of streets and utilities
for the cul-de-sac;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
City Council approves the vacation of the north 210 feet of the
existing 30 feet• of right-of-way, legal description as follows:
The north 210 feet of that portion of street right-
of-way westerly of Lot 6, Block 2, Degardner Addition
and also west of Lot 5, Block 1, Mid -States Estates,
all in Section 6, Township 30, Range 23 in the City
of Mounds View, Ramsey County
with the following conditions:
1) The west portion of the right-of-way ("area to be
dedicated" on attached map) be dedicated at the
present time for future street purposes.

RE: Aquatics Coordinator Position
Attached is a proposal that has been submitted by Maureen Thielan
who staff is actively considering for the position of aquatics
coordinator at the Lakeside Park Beach and Edgewood Community
Center pool. At this time, we are still in a negotiation stage
with Ms. Thielan and the Mounds View USSA Swim Club regarding the
possible coordination of a full-time aquatics coordinator between
the two agencies. Staff would like to bring the City Council up
to date on the potential hiring of the aquatics coordinator on
Monday evening with no formal action envisioned until the Monda/,
August, 22, 1983 regular City Council meeting.
To that end, I have also included a copy of Ms. Thielan's
application, a copy of the proposed job description, and a copy
of the joint powers agreement with the school district. Prior tc
our meeting on Monday evening at the agenda session, staff will
be speaking to the Cities of Spring Lake Park and the school
district to once again solicit their input regarding the position
so that we might be able to provide you with better background as
to how the position is evolving.

SUBJECT: ORDINANCE NOS. 233 AND 334
Attached please find Ordinance Nos. 333 (amending Chapter 42, "The
Planning Commission") and 334 (amending Chapter 43, "Mobile Homes").
These two ordinances were reviewed by the City Council at the
February 7, 1983 Agenda Session but were never placed on a regular
meeting agenda for a first reading.
Prior to the Agenda Session, the Planning Commission recommended
these amendments by adopting resolution Nos. 71-83 and 72-83.
Copies of these two resolutions are also attached for your review.
The amendments to Chapter 43, "Mobile Homes" (Ordinance No. 334)
relate to language proposed to regulate the placement of manufactured
homes within the City of Mounds View. Language was added whereby
manufactured homes are prohibited in Mounds View except as allowed
under recently adopted language included in Chapter 40.06, Subdivi-
sion F. 40.06, Subdivision F, regulates the size of structures
placed on R-1 lots among other items.
Ordinance No. 333 are revisions to the Chapter entitled, "The
Planning Commission", as recommend by the Planning Commission.
Attorney Meyers has reviewed the ordinances and has no objection
to them.
These items are placed on this agenda session agenda for discussion
and possible first reading on August 22nd. Should you have any

The Council of the City of Mounds View does hereby ordain:
SECTION I. Chapter 32.05, Subdivision A, is hereby amended
to read as 'allows:

adopt bylaws for its governance and for the transaction of its
business. The bylaws shall be reviewed on an annual basis at the
first regular meeting in February. A recording secretary, who may

Subdivision 1. Removal From Office. An appointed member of the
Commission may be removed from office for just cause and on written
charges by at least four/fifths vote of the entire City Council, but

attendance at Planning Commission meetings as provided in the bylaws
adopted by the Planning Commission. It shall be the duty of the
Chairman of the Commission to notify the City Council promptly of any

original appointment.

except as provided for in this Chapter or Chapter 40 of the Municipal
Code.
SECTION III. Chapter 43.02, Locations, (3), is hereby amended
to read as follows:
(3) No person shall park or occupy any mobile home or manufac-
tured home which is situated outside of an approved mobile home park
except that as allowed in Chapter 90 of the Municipal Code. The
parking and storage of no more than one (1) mobile home in an accessory
private garage building or in a rear yard in any district is permitted
providing that no living quarters shall be maintained, nor any business
practiced in said mobile home.

RE: Truck rental usage
As per the Council direction, staff is no longer utilizing one of
the perscnal vehicles with our summer PRAD Grant. We have
resolved the immediate short range issue by borrowing a vehicle
from the City of New Brighton and using the City Forester's truck
in the Public Works iepartment which freed up the old sewer truck
for the PRAD Grant. We'll be able to utilize the New Brighton
vehicle for two weeks at which time the summer C.E.T.A. program
will draw to a close on August 26 and at that time we will have
the old sewer truck available for the remaining month.
In addition, staff has sent out hid specifications for the
purchase of a one ton dump truck with bid opening date set for
Wednesday, August 17, 1983 and we will be providing a
recommendation regarding the purchase of a one ton dump truck at
the August 22, 1983 City Council meeting. It should be noted
that staff will still be providing you detailed background as to
how the entire City fleet is being utilized by which department,
which staff people are assigned to which vehicle, mileage usage
and other pertinent data as per the Council's direction. At this
time we have resolved our immediate problem by utilizing a
vehicle from the City of New Brighton.

On Item D, Mayor McCarty questioned how the damage
estimates were determined for the vandalism done to
the warming houses. Park Director Anderson replied
that Police reports had been filed in February 1982,
and claims filed with the insurance company, and
Satellite Industries was informed of the situation.
He added the City did not hear back from Satellite
until August 1982, and that they had gone ahead
and repaired the buildings and billed the City, at
which time the City submitted the billing to the
insurance company, which paid $318.74 of the
$3,073.57 bill. He explained that the insurance
company determined the acts of vandalism had
occurred over a period of time, and thus each had a
separate deductible, and they also felt that some
of the items were considered regular wear and tear,
which they would not cover.
Councilmember Doty asked if any of the vandals had
been caught. Park Director Anderson replied that
there had not been enough evidence to charge anyone
with, and that one attendant had admitted to his
part in it, and the money he had paid to the City
had gone into the appropriate account.
Mayor McCarty reviewed Park Director Anderson's memo
of July 22 to Satellite Industries, stating that he
felt the labor and repair bills provided did not
adequately reflect the damage that actually occurred,
and that the invoices and repairs were made after the
fact, without approval of either the City or the city's
insurance agency, and asked Attorney Meyers if the
City had any recourse.
Attorney Meyers replied that the matter could be
argued, but he was not certain what factual basis
could be used in the dispute.
Motion/Second: McCarty/Doty to tables Item D and
direct Staff to negotiate with Satellite Industries,
offering a settlement of 60% of that which has been
requested.

Satellite had carried insurance on the buildings.
Park Director Anderson replied that the City had been
required to have a special rider taken on the build-
ings.
On Item E, Mayor McCarty questioned if the raise

blem in transporting equipment and employees. Park
Director Ancerson replied that with so many summer
employees working for the City through grant programs,
they have found it to work best to have everyone
report to Woodcrest Park first thing in the morning,
for their assignments and to dispense equipment, and
from there they are being transported to where they
are to work for the day, and since there is not an
extra City vehicle available to transport them, one
of the workers has been driving her own personal
•ehicle, using it to transport the other workers
and equipment and so forth.

parked while someone was mowing a lawn, and stated that
the situation should be clarified, and that some type
of motor pool operation should be set up.

Administrator Pauley replied that mileage is kept
track of as the vehicles are filled up, but Chat

Park Director Anderson asked if there was an esta-
blished policy regarding the disposal of surplus
equipment in the City, as he had been contacted by
a City employee, wishing to purchase a surplus
generator.
Attorney Meyers advised that the Council must first
declare the equipment as surplus. Clerk/Administra-
tor Pauley added that after the Council has declared
it as surplus, the City would go out and get the
best price and present it to the Council.

Mr. Miller stated they are requesting to file a final
plat, and at the last agenda meeting, Staff had
indicated they would like more time to consider the
wetlands alteration. He stated that he has no
objection to any additional time that they would
like.
Councilmember Hankner stated that there are a number
of differences in completing the process, and that both
Staff and the Planning Commission have requested policy
statements. She presented the Council with a suggested
timetable to be established for completion of the
process for the Miller plat. She also stated that the
Council has discussed the extension process and what
they want to look at during that period, to insure
conformance with the ordinance, make sure the preli-
minary plat meets the wetland reclassification, that
they give Staff the necessary time for their review,
and resolve the drainage issues.
Attorney Meyers reported that the input the Council
has received points out two areas to work on, to
amend the inventory of the wetlands, as the ordinance
does provide for it, which would require a public
hearing and a 4/5 vote of the Council. It would
also involve an ordinance, which would involve a
'wa`ting time. He stated that he felt six months
aas more than adequate to handle it.
Attorney Meyers also advised that once the wetlands
have been redefined on the parcels, they would have
to look at the plans as submitted by the developer
to see if they will fit within the redefined wetland.
He stated that the Council had extended consideration
of the preliminary plat on April 11, and the Council
should now respond to the developers request and
extend the time limit for approval of the preliminary
plat .

for six months, until January 4, 1984, and to refer
the matter to Staff for their reports, a reclassifi-
cation of the wetlands and the ability of the
preliminary plat to conform to the wetlands designa-
tion, if amended, plus other criteria that must be
followed with the wetlands ordinance, within 60 days.
Also, prior to the expiration of the 60 day time frame,
Staff will submit to the Council for their approval,
a checklist to weigh the requirements of the ordinance
against the proposal, such as whether the proposal
omplies with the ordinance and reasons why a does

ments necessary for final plat and development
agreement approvals within 45 days of conceptual
approval of the wetlands alteration permit. The
Council authorizes Staff to submit proposals for an
expert in the field to determine the validity of
the develdpers proposal in reference to the wetlands
boundry lines.

Mr. Miller replied that it is important to get
conceptual approval of the wetlands alteration

, Mr. Mi.iier stated that the Ramsey Soils and water Conserva-
tion District has indicated there are errors in the S �
map used for the wetland map, and that they will be
happy to resolve those issues. It was pointed out
in an August 5 letter from Mr. Malkerson that the 4�
site might be reclassified.
Mr, Miller stated he was comfortable with the dates
which had been established.
It was noted that the Council granted the extension
on the basis of the applicant's attorney's recommen-
dation and the request of the applicant, per their
letter of August 5, 1.983.

Clerk/Administrator Pauley reported the Council

Mayor McCarty stated he was not certain how to
handle a borderline situation, which he felt this
was. Councilmember Linke read from Chapter 48.06,
Sub. 4 (C), which stated that it gives the Council
leeway,
Attorney Meyers advised that if this is an exemption
it would have to fall within a minor development,
single family residential. He added if the Council
grants this request, they will be beginning to esta-
blish criteria to be used in the future.
Councilmember Linke pointed out that the contour of
the lot will not be changed, just holes filled.

the contract, after receiving Council approval.
Clerk/Administrator Pauley stated that Staff would
recommend that Gilbertson not be used.
Mayor McCarty recommended continuing in the same

job done, Attorney Meyers replied that he will
send a letter, telling them to get the job done.

Councilmember Doty questioned the status of the City's 15. Reports
water supply. Clerk/Administrator Pauley replied Council
that all the equipment is being put back into opera-
ting order, and the City is able to keep up with the
present demand, and Staff is keeping a close watch
on the situation.
Councilmember Linke reported the Ramsey County League
of Local Governments will be meeting on August 17,
and the topic of the evening will be the Metropolitan
Waste Control Commission.
Councilmember Linke reported the Festivities Commission
had met August 3 and went over their reorganization,
which they are well into.
Councilmember Linke reported the Park and Rec Department
held a picnic on August 2 for the volunteer coaches,
and presented each coach with a jacket, in appreciation
for the work they did.
Councilmember Hankner reported she had spent an after-
noon with Fire Chief Fagerstrom and toured the Fire
Department facilities, and found it very interesting
and a learning experience.
Councilmember Blanchard reported she had not attended
the August 3 Planning Commission and had no report.
Mayor McCarty had no report.
Clerk/Administrator Pauley presented the Council
with a list of people that may be going on the tax
certification list.
Mayor McCarty expressed concern that there may be
some senior citizens on the list, who are too proud
to come to the City for help. Clerk/Administrator
Pauley replied that Staff is familiar with all but
five of the people on the list, and many had signed
promisary notes and then not followed through. He
added the City has made every attempt to try and
collect the delinquent bills and to help people
make arrangements for payment.

to attend, the 1983 National Recreation and Park
Association Park Planning and Maintenance School,
appears to be far more valuable to the City than the
NRPA.
Mayor McCarty stated that conferences for department
heads were cut to reduce expenses in 1902. Also, lie felt
this should be budyetcd in Park, 360, instead of the
Recreation, 350, account. Clerk/Administrator Pauley replied
that it is in the general fund budget, in the Park and Rec category.

to be able to sell an existing educational building

that his understanding is that they plan to come
before the City soon with plans for a building to
house educational facilities. He stated that
the home would be sold as a single family home.

Councilmember Linke asked, as per the agenda meeting, if
Director Johnson was guaranteeing completion of the
project by December 31, 1983, within the hours specified.
Director Johnson replied that he is estimating the work
will be completed by the number of hours specified, and
he would come back to the Council if it appears additional
hours would be required.
Councilmember Linke stated he would like an assurance that
the items will be finished by the end of the year, and he
wants to make sure the additional 481 hours will see to
that. lie also stated that he would like to see the hours
set to be used as specified. Director Johnson replied
that he is pledging sufficient time to the City to
complete the projects.
Mayor Mcrarty clarified that the Council's stand is that
Director Johnson is guaranteeing to complete the projects
in the number of hours specified, and that if the Council
pulls him off a project to work on something else,
additional time would be allowed.
Attorney Meyers stated that the clause regarding termi-
nation by just cause would cover the situation if the
work was not completed, and the Council could terminate
the contract. He added that both parties should keep
the other aware of progress and if time is getting

Director Johnson reported he had received a letter 12. Report of
from MnDOT, requesting the City's presence at a Director of
meeting on August 15, in Mankato, to explain the Public Works/
balance in the municipal aid account. He stated Community Dvlp
that he plans to attend, with documentation.
Director Johnson reported he has been in contact with
representatives from the Highway Department, regarding
Highway 10, and that a public hearing will be scheduled
for this Pall, and they hope to have an environmental
impact study approved by the end of the year. He
added they would be meeting with Staff sometime in
August to update them, prior to the public hearing.

Director Johnson reported it has come to Staff's atten-
tion that the work being done at 8134 Jackson Drive,
•, ool and hot tub installation does involve the
wetland, and would require a wetland alteration permit.
lie stated that all other pertinent permits were taken
out.
Ile added that the fill from that lot was being placed
on 2411 Laport Drive, 9 loads to date, which also
involves a wetland. He stated that it should not
impact the wetland due to the separation of the street
and other improved right-of-way, He added that the
fill was dumped without a permit.
Clerk/Administrator Pauley noted that it has been
questioned whether the Rice Creek Watershed District
should be involved.
Motion/Second: McCarty/Linke to have Director Johnson
issue a cease and desist order and instruct the
property owner at 2411 Laport Drive that he may be
required to remove the fill, and to file a filling
permit application with the City of Mounds View,
and the appropriate application with the Rice Creek
Watershed District.

Attorney Meyers advised that the City has commenced 13. Report of
action against the owner of the radiator repair shop Attorney
on Highway 10. He reviewed the charges made, and
the procedure that will be followed. He stated he
anticipates their defense will be that it is a valid
occupation, He added that no court date has been
set and that they will be doing some preliminary work
to get all the facts together.
Attorney Meyers reported that the open meeting Li,
has been amended by statute to provide that a City
must provide an agenda or copies of material that
they will be considering at special meetings:
Attorney Meyers reported on the law regarding conveyance
of state lands to public bodies, such as the surplus
land owned by the Highway Department. He also reported
he is suggesting possibly zoning some property in the
City as recreational,

Mayor McCarty asked what options were open for the City
,to fund a golf course. Cleric/Administrator Pauley
replied there could be a general obligation bond, tax
increl,cent bond, or seek outside donations. Ile added
that a possibility would be that when a developer does
work in the City, negotiate with him that he help in
developing; certain property, in lieu of n park dedication.
Attorney Meyers added that a revenue bond would be another
possibility, but that it would be expensive.
Director Johnson reported he is getting information from
neighboring; cities. Clerk/Administrator Pauley added
that Staff would encourage pursuit of ideas, such as
jogging trails, snowmobiling, cross country skiing, as
well as golf.
Mayor McCarty asked that Staff get together information
on the success of surrounding communities courses. It
was also noted that the possibility of a golf course
is in the discussion stage only, at this time.
Councilmember Blanchard reported she had attended th,. 14. Reports of
Planning Commission agenda session, and they were Councilmeacbers
very concerned about the status of Chapter 40.
Director Johnson explained that the Council and Planning
Commission had held a joint meeting and referred
questions back to Staff-, and that he and Attorney Meyers
would be getting together to work on it, but that it
was not a high priority item. Councilmember Blanchard
replied that the Planning Commission would like to see
it moved 'higher up on the priority list, as it is a
very important tool for them to use.
Mayor Mcrarty stated that they should address the in-
compatibilities between the zoning map and current
zoning. There was discussion among the Council and
Staff on the procedure to be followed to make them
compatible.
Mayor McCarty asked that Staff get something together
for the Council to work on. Clerk/Administrator Pauley
replied that a time table would be prepared by the next
agenda session.
Councilmember Blanchard expressed concern with the
condition of the hole in the road at Groveland Road
and Highway 10. Director Johnson explained that none
of the surface restoration work has been done to date,
and that the City is working to get the developer
going. He added that he und-rstands the developer plans
on putting the home in the Parade of Homes, scheduled
for early August, so feels the work will be completed
by then.

Cl( :,,/Administrator Pauley explained the problem that
had occurred with vandalism to the water shut-off valve,
and that the work should be done before the water and
sewer approval is given. He stated he would contact
the developer and have him put some fill in temporarily.
Councilmember Ilankner had no report.
Councilmember Linke reported he had attended the
kamsey County League picnic on July 20, and toured
five regional parks. Ile stated their next meeting
would be with the Metro Waste Control Commission,
a change in agenda from the Watershed.
Councilmember Linke reported that he had ridden with
three patrol officers on July 16, and felt they did
a very good job.
Mayor McCarty read a portion of the June 20 minutes
of the Metropolitan Airport Commission.
Motion/Second: McCarty/Blanchard that the Council
direct to send a letter of protest to the
Metropolitan Airport Commission, carbon copy to
the Met Council, that the proposed instrument
landing system at a minor use airport is not allowed
by law and that the City protests this proposal.

rep from the Met Council and invited her to contact
Clerk/Administrator Pauley to set up a meeting
between her and the Council.
Mayor McCarty asked Clerk/Administrator Pauley to
notify the Fire Department that the Council wishes
to have a work session with the Fire Chief, along
with officials from Spring Lake Park and Blaine,
and get involved immediately on the proposed 1984
Fire Department budget. He added that the appro-
priate section of his contract could be noted.
Clerk/Administrator Pauley reviewed the memo from 15. Report of
Finance Director Brager, dated July 25, regarding
Administrator
certification of delinquent utility bills.
Mayor McCarty stated he would like to be informed
of who was involved, before the hearing, such as
if there were specific problems with the elderly,
or so forth. Clerk/Administ :tor Pauley replied
they have all been advised, through each piece of
correspondence sent, to contact the City and let
them know of any circumstances in which assistance

getting a list of delinquent accounts, before the
letter is sent out.
Motion/Second: Hankner/linko to set a hearing for
7-44PM oi�ptcmber 19, 1983 for the purpose of con-
sidering and determining those delinquent utility
bills that should be certified to Ramsey County for
collection with property taxes.

Anderson is on vacation this week, as he had requested
earlier, and that while City Hall will be short of
department heads, with both Finance Director Brager
and Clerk/Administrator Pauley being gone on Tuesday,
Wednesday and Thursday, Staff will know where to reach
them at all times. He added he has directed Acting
Police Chief Smith to handle all administrative matters
in his absence.
