CONSENT AGENDA

The Consent Aqenda is a technique designed to expedite handlinq of
routine and miscellaneous official business of the City Council.
The entire Aqenda may be adopted by the Council in one motion. The
motion for adoption is non -debatable and must recpivr unanimous
approval. By request of any individual Councilmember, any item can
be removed from the Consent Aqenda and placed upon the Reqular Agenda
for debate.

The Mounds View City Council was called to order 1. Call to Order
by Mayor McCarty at 7:30 PM on December 12, 1983.
MEMBERS PRESENT: Councilmembers Doty, Linke, 2. Roll Call

Jim Gabel and Jerry Blanchard, of the Mounds View
Lions Club, presented the City and Police Chief
Ramacher with a check for $300 for the purchase
of camera equipment for the Police Department.
Chief Ramacher thanked the Lions for the donation.
Chief Ramacher asked for Council authorization to
advertise for bids for new squad cars.
Councilmember Linke recommended checking with Ramsey
County as they buy in quantity and the City could
get a considerable savings if they bought their cars
at the same time.
Chief Ramacher stated that in the future, he would
check with them but there is a time problem in getting
the cars now, and they would like to order them as
soon as possible.

Mayor McCarty stated that it was his understanding
that at the time the original application came in,
it was not clear that a kitchen was included.
Councilmember Hankner pointed out that on the copy
of the building application, it states clearly that
two kitchens are not allowed.
Technician Kampel explained that the original build-
ing permit was taken out by the contractor, and that
Mrs. Chaika did not see it, and there was no indi-
cation that a kitchen was planned. He stated the
City first found out about the kitchen when Building
Inspector Rose went to the home and observed the
construction and spoke to the contractor. Technician
Kampel added that when he had first spoken to Mrs.
Chaika approximately a year and a half ago, she gave
no indication that a second kitchen was planned.

Mayor McCarty stated he had spoken with the Chairman
of the Planning Commission and that there are some
issues before the Planning Commission at this time
that require changes to Chapter 40 as soon as possible.
He stated, however, that Roberts Rules allows only
two amendments to any ordinance, and that in reviewing
the proposed ordinance, he came up with over 48 changes
to be made. He reviewed some of those changes with
the Council and questioned how some of the criteria
was established.

Mayor McCarty reviewed several sections he felt
required changes. He stated the Planning Commission
did a tremendous job in working on the ordinance, but
ran into a very difficult situation in incorporating
the changes. He asked that one amendment be included,
to maintain the 85 foot minimum lot width at this time,
until they have more time to study it.
Commissioner Quick explained that the Planning Commission
used the Red Oak property as an example when making
that change, and determined it could possibly make the
difference of one lot.
Councilmember Hankner stated she would feel more
comfortable waiting to approve the ordinance, until
all the Council members had had an opportunity to
review the suggested changes, and then make the
necessary changes, before approving the ordinance.
Director Johnson explained the timetable was a self-
imposed one, and that the new ordinance will
definitely help the Planning Commission, and that
they need the text before starting on the public
hearings on the map revisions.
It was agreed that the Council would meet with the
Planning Commission on December 21, at 7 PM, to go
over the ordinance.

Director Johnson reported the ground resevoir had
been inspected the previous week and found to be in
excellent condition, and they are in the process of
sanitizing it and putting it back into service.
Director Johnson reported a split shift will be
worked for rink maintenance, from December 13 to
February 3, and that the personnel involved had been
notified.

public hearing held by the Anoka County Delegation
regarding a site for the race track, and that the
Delegation had voted unanimously to accept it as a
possiblc site.
Councilmember Blanchard reported that Planning
Commissioner Josey Warren had been appointed to the
Metropolitan HRA Advisory Committee.
Mayor McCarty stated he would like to wait until
the first of the year to work on the Master Plan
for the Anoka County airport.

SUBJECT: 5468 ADAMS STREET PUBLIC HEARING
The public hearing scheduled for December 27, 1983 at 7:40 p.m.
for the rezoning of property at 5468 Adams Street must be delayed
until such time as the second reading of the Zoning Code has
been conducted. This is due to the fact that the Planning
Commission recommended the rezoning to R-2 based upon new Zoning
Code language.
The applicants intend to use the property at 5468 Adamst Street
as a group day care. At present, group day care facilities are
allowed by conditional use permit in an R-3 District. The Planning
Commission objected to recommending a rezoning of this property
to R-3 but instead, citing the need for group day care facilities
in this City, recommended the Zoning Code be changed to allow
group day care facilities by conditional use permit in an R-2
District.
Staff had envisioned that the second reading of the Zoning Code
Ordinance would have taken place on December 12, 1983. Staff
recommends that the holding of the public hearing and possible
first reading of an ordinance to rezone the property to R-2 be
held after the second reading of the Zoning Code Ordinance has
taken place. The schedule for this item would then be:
December 27 - Second reading of Zoning Code Ordinance
December 27 - Set rezoning public hearing for January 9
January 3 - Council reviews rezoning application at
Agenda session
January 9 - Public hearing and first reading of

Attached please find, for second reading, Ordinance No. 348
which rezones the Dynamic Designer property from R-3 to R-4.
The first reading of. the ordinance was held on September 12,
1983 and the second reading was being delayed until such time
as a new legal description, which combines the two lots into
one, was submitted. Registered Land Survey No. 388 has been
filed and recorded with the County which combines the prop-
erty into one.

The Council of the City of Mounds View does hereby ordain:
SECTION I. 41.12 Pursuant to Chapter 40.23, the Official
Mounds View zoning map is hereby amended to reflect the following
rezoning:
Subdivision 1.
Registered Land Survey No. 388 is rezoned from R-3 to R-4.
This ordinance shall take effect thirty days after the date
of its publication..

This letter amends the contract for Professional
Services dated December 2, 1982 between the City
of Mounds View and John C. Johnson. This amendment
provides for the following.
1. Extension of the completion date for the
Storm (later Management Study to February
1934 with no increase to project manhours.
2. Professional So-, as authorized by
the City for various projects to insure
continuity as new Director of Public
Works assumes duties in 1984 at $22.50 per hour.

RESOLUTION AMENDING MODEL HOME CONDITIONAL USE PERMIT
FOR MARVIN N. ANDERSON CONSTRUCTION COMPANY
WHEREAS, on January 11, 1982, Marvin II. Anderson Construc-
tion Company was'granted a conditional use permit for the operation
of a model home at 7501 Silver Lake Road; and
WHEREAS, this model home has now been sold to a private
individual; and
WHEREAS, Marvin H. Anderson Construction Company has now
requested that a new conditional use permit be approved for a
home which is presently under construction at 2750 [lodges Lane;
and
WHEREAS, the Planning Commission, at their December 7,
1983 meeting, reviewed this request and found no negative impact
in the use of the building at 2750 Hodges Lane as a model home;
and
WHEREAS, adequate on -street parking is available at and
near this site;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City
Council hereby amends the conditional use permit granted on
Ja,ivary 11, 1903 to allow the operation of a model home at 2750
Hodges Lane instead of at 7501 Silver Lake Road.

RESOLUTION APPOINTING DIRECTOR AND ALTERNATE
TO THE SUBURBAN RATE AUTHORITY FOR 1984
WHEREAS, the Mounds View City Council has approved
Resolution No. 1167 authorizing membership in the Suburban Rate
Authority; and
WHEREAS, the appropriate documents for said membership
have been submitted and accepted by the Suburban Rate Authority;
and
WHEREAS, it is necessary for the Mounds View City Council
to appoint a Director and Alternate to represent the City of
Mounds View on the Suburban Rate Authority Board of Directors.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Mounds View appoints the Mayor and Clerk -Administrator
as the Director and Alternate, respectively, on the Board of
Directors of the Suburban Rate Authority for 1984.

RE: AUTOMATIC GARAGE DOORS
For some time the overhead garage doors in the Police Station had been
deteriorating. At present the North door has a We in it and the South
door is beginning to wear badly.
Both doors are masonite fiberboard with insulation between the interior
and exterior panels.
A budget request of $1,500. was approved for replacement of these doors
with a newer steel product. The budgeted amount would include corrugated
steel panels with insulation, new tracks and hardware.
We received two bids on the project: $1,520.00

RE: Tractor purchase
Staff opened up formal bids on Wednesday, December 21 at 10:30
a.m. for the purchase of one 1984 4-wheel drive tractor. The
tractor will be replacing the City's 1963 International model
2544 3000 loader and be used in all aspects of the Public works
Department. There were three bids that were received which would
be broken down as follows:
1. White Bear Lake Mitsubishi
One Mitsubishi model MT750 Stallion diesel 38 HP tractor in-
cluding cab and two stage snow blower with 72" rear mount
mower.............................................$17,600
One Mitsubishi Model MT300 Bison equipped with cab, snow-
blower, and 72" mowing deck ......................$13,625
2. Kortuem's Sales/Service Rental Inc.
One 1984 John Deere 1.050, 4-wheel drive, 37 HP tractor with
cab less trade-in for the International including the front
mounted two stage mower and 72" mid -mount mower ... $15,102
3. Kromer Company
One 1984 Yanmar 336 diesel tractor, 4-wheel drive with turf
tires, Cozy cab, 72 mowing deck and 63" front mounted snow
blower for a total of............................$15,604
Based on the three bid proposals that were received, staff would
recommend that the bid be awarded to Kortuem's Sales and Service
Rental, Inc. with the low bid of $15,102 for the 1984 John Deere
1050, 4-wheel drive tractor.

Staff has contacted a number of references for the John Deere
1050 and the tractor has proven to be in extromely reliable ma-
chine and should more than meet our current public works needs.
As you are aware, we have $16,500 budgeted for the purchase of
this tractor and staff would like the City Council to consider
purchasing the one additional option of a front-end loader for
the tractor, model #75 with a ballast box at a cost of $1,825.99.
With the purchase of this tractor, we would he $428.52 over the

is with the trade-in of the International loader, we will be
losing our 60" bucket and secondly, the bid price of $1,825.99 is
approximately $1,000 below the cost of the comparable front-end
loader. I spoke with City Administrator Pauley on this issue,
and he indicated that we are able to go 10% over the budgeted
revenue sharing amount and would ask that the City Council
consider this additional purchase as proposed.
Staff will be on hand to review the recommendations at Monday
evening's Council meeting.
RECOMMENDATION: To purchase one 1984 John Deere 4-wheel drive •
tractor with Cozy cab and John Deere 666 front mounted two stage
snow blower and John Deere 72" mid -mount mower and John Deere 75
loader with ballast box at a total cost of 516,928.52 with the
monies to be appropriated out of the City's revenue sharing
account.

Staff has submitted another proposal and received initial funding
for one additional HEED Grant person. The individual that we
would like to have employed under the HEED Grant, is Ms. Le Ann
Linder, as a wellness coordinator or lifestyle/health and fitness
coordinator. As I'm sure you noticed in the January/February
Newsletter, we have been working with the City of New Brighton in
developing a lifestyle/health and fitness program with the objec-
tive of building a community of healthy, active people. Part of
that program will include wellness education and activity class
activities that will help motivate individuals to make healthier
lifestyle choices.
Ms. Linder has a background in health and physical education from
the University of Minnesota and Bemidji State University. Her
past experience includes: An instructor at St. Olaf College for
three years, and head women's coach of tennis and volleyball.

PUBLIC WORKS/COMMUNITY DEVELOPMENT DIRECTOR SELECTION UPDATE
In response to our recent advertisement for the position of
Director of Public Works/Community Development in metro and
non -metro issues of the Minneapolis Star and Tribune and St.
Paul Dispatch or Pioneer Press the City received 16 applications,
two of which did not meet the minimal qualifications outlined
in our job advertisement. The selection committee made up of
myself, City Council members Sue Hankner and Jerry Linke,
Maplewood Director of Public Works Ted Haider, and Hastings
City Administrator Gary Brown reviewed these applications and
identified five individuals which the committee will be inter-
viewing on January 4 and 5.
It is hoped that these interviews will result in the identification
of one individual who will be recommended to the City Council
for hiring.
COMPARABLE WORTH AND CAFETERIAL PLAN CONFERENCE
On December 15, I attended a Comparable Worth and Cafeterial
Conference sponsored by the Metropolitan Area Management
Assuciatton and Labor Relations ,I,r,-.ociates. The conference
dealt with two of the more pressing issues being faced by employers
in the personnel area.
The first issue related to the matter of comparable worth which
basically requires that comparable wages be paid for jobs that
are determined to be substantially equal inthe areas of skill,
work effort and responsibility and prohibits sexually based wage
discrimination. Based on the information I received at this
conference, I feel it would be safe to say that the City of
Mounds View has made significant strides in the last three
years to insure that comparable wages are being paid, however,
it will be necessary that in 9184 we update all position
descriptions and review our classification to maintain equality
within our system.
The second issues discussed at this conference, cafeteria plan,
relates to the ability of employers to provide benefit packages
that would allow the employees to select the type of benefits
they wish to receive thus allowing them to pay for additional
benefits with before tax wages rather than after tax wages thus
resulting in the employee having a chance at updating a larger
net wage. Staff will be investigating this matter in greater
u detail with an eye towards proposing that the City consider such
a program for our employees.

Mounds View, and 12-year old student at High View Junior High
School, placed first in the Grand Prize International Figure
Skating Competition in Czechoslovakia; and

Club, represented the United States in the junior ladies division
where there were 24 competitors from 19 countries. West Germany
finished second; East Germany third; and Russia fourth; and

Dear Mayor and Council:
As you are well aware, the Metropolitan Surface Water Management Act, commonly
called Chapter 509, requires that a water management plan be prepared in all the
counties of the Twin Cities Metropolitan Area. In our area, the. Rice Creek
Watershed District is the responsible agency for preparing the management plan.
The law requires the development of a surface water management plan to achieve
the following objectives.
- To reduce, to the greatest possible extent, public capital expenditures
necessary to control excessive volumes and rates of run-off;
- To improve water quality;
- To prevent flooding and erosion from surface flows;
- To promote groundwater recharge; and
- To protect and enhance fish and wildlife habitat and water recreation
facilities.
We can all agre(,. that these are laudable goals. if these goals are Lo he
implemented, we must all work together as closely as possible to insure that
our plan does not just "sit on the shelf" but becomes truly a functional part of
water resources management within the Rice Creek Watershed District. To make
sure the plan is technically sound and meets local policy objectives we have
decided to set up two advisory committees:
1) The Technical Advisory Committee, and
2) The Citizen's 509 Task Force..

The duties of the Technical Advisory Committee are to:
1) Assist the District in the acquisition of data for various inventories,
including hydrologic, physical environment and land use;
2) Provide technical input;
3) Review and comment on planning activities.
It is our current plan that membership of the Technical Advisory Committee will
he drawn from city staffs such as the City Engineer or City Planner. We would
like your community to appoint one member to the Technical Advisory Committee
and advise the District by February 1, N84, it is anticipated that this
individual would he required to meet with other members of the committee
once monthly during normal working hours.
The Citizen's 509 Task Force will have the following duties:
1) Provide input on community concerns;
2) Provide a communication link between locally elected officials and the
Watershed District;
3) Assist the District in development of objectives and policies.
We would like your city to appoint two members to the Task Force. One member
should be an elected official and the second a concerned citizen. It is
anticipated that the Task Force will meet monthly. We request that Task Force
members he appointed by March 1, 1984 and the District he so advised.
It is incumbent upon all of us to work closely to ensure the success of the
surface water management planning for our area, This can only he done through
the participation of all communities including elected officials, concerned
citizens and technical professionals. I am looking forward to working with the
members of the Advisory Committee and the Task Force in the preparation of this
most important water resources management planning effort.

end of these individuals' original term of office being for
a period of three years.

SUBJECT: CROSS OP GLORY LUTHERAN CHURCH
Attached please find materials relating to the Cross of Glory
Lutheran Church educational building rezoning request. The
Planning Commission, in Resolution No. 98-83, has recommended
approval to the rezoning of the property in question from R-1 to
R-2. This rezoning is being made in conjupction with new zoning
code' language which would allow, by conditional use permit,
group day care facilities in an R-2 district. The conditional
use permit for a group day care facility will be handled under a
separate application once the rezoning issue has been taken care
of.
The Planning Commission, in recommending approval, saw no negative
impact in an R-2 use on this property noting its proximity to the
church property and to the commercial establishments northwest of
this lot. The Planning Commission concluded that the most intense
use allowed on an'R-2 lot (one duplex home) would have no pegative
impact on neighboring R-1 properties and would create a good
transition between, the single family property and the church.

public hearing on this rezoning has been scheduled for January 9,
1984.

PLANNING CONSIDERATIONS
1. Potential buyers of the educational building are proposing to
locate a day care/group nursery at this location. Members of
the church congregation (the church presently owns the
educational building) are requesting a rezoning of the property
to R-3, which would allow a day care/group nursery by
conditional use permit. Should the rezoning [. granted, sale of
the property may occur with the new owners coming before the
city for the conditional use permit.
2. The lot exceeds the minimum width and square footage
requirements for R-3, medium density residential property.
Minimums are:
Lot Width - 100 Feet
Lot Size - 12,500 Square Feet
3. The existing zoning of the property is R-1, Single Family
Residential. An R••3, medium density zone would require a
rezoning and an amendment to the Comprehensive Plan which shows
low density residential. No zoning changes are being proposed
for the immediate area as a result of the comprehensive
rezonings presently being undertaken by the Planning Commission,

play area. If rezoning is approved, the parking arrangement
will be reviewed when the conditional use permit for the day
care facility is applied for.

WHEREAS, Cross of Glory Lutheran Church, owners of a
detached structure located at 5468 Adams Street, have submitted an
application to rezone this property from R-1, Single Family
Residential to R-21 Single and Two Family Residential to allow the
future use of the property as a day care facility; and
WHEREAS, the Planning Commission, as part of the overall
review of the Zoning Code which is presently before the City
Council for approval, is recommending that day care/group nursery
facilities be an allowed use by conditional use permit in an R-2

The Burger King Corporation has filed for an access permit (for
one curb cut access) onto County Road I. The County is in the
process of reviewing the application which has gone through all
departments with the exception of "environmental". The County had
some question concerning drainage, specifically the capacity of
the pipes used for drainage. once this question has been
answered, the County will process the permit. At this time the
County sees no problem with the one curb cut access. No attempt
has been made to obtain a permit for the possible second curb cut
access.
Attached please find a timetable for review of this proposal.
Note that staff has scheduled two agenda sessions for which this
proposal would be discussed (January 3 and 16). This timetable
will be adjusted should the Council need less or more time for
reviewal.
The Rice Creek Watershed District, at their December 28, 1983
Board Meeting approved the Burger King Plan. No written permit
was available to include in your packet at the time this memo was
distributed.
Mr. Bill Ranek of the Burger King Corporation and Mr. Jim Benshoof
Traffic Engineer for Benshoof and Associates, will be present at
your January 3, 1904 meeting to present the project to the City
Council.

Note: Staff has requested that the IppliC,ant submit, as part Of
this application, a traffic study noting the impact of the proposed
development on traffic in the general area. The traffic study has
not been completed in time for review at the November. 16th meeting.
The purpose of the placement of this item on the November 16, 1983,
agenda is to inform the Planning Commission of this application and
to receive initial input into this proposal. A preliminary traffic
study should be available for discussion at the workshop meeting on
November 16th. The final traffic study is scheduled to be submitted
in time to continue discussion at your regular meeting in December
at which time a recommendation could he given or delayed depending
upon the status of the review process.
PLANNING CONSIDERATIONS
1. The existing zoning of the proprer.ty is I-1, Industrial. The
property may be officially rezoned to B-2 as part of the
Comprehensive rezoning currently underway by the time review of
this application is at the official rezoning stage. The
rezoning being requested at the present time is I-1 to B-3.
This may change from (I-1 to B-3) to (B-2 to B-3) at such time
as the Comprehensive rezoning is completed. The Council has
approved a rezoning to B-2, but an ordinance to rezone has not
officially been drafted and approved. •
MINOR SUBDIVISION
1. A minor subdivision of one lot into 2 is being requested for
this development. Existina Code does not list minimums for lot
sizes or frontages for commercial property, therefore, the two
lots are in conformance with Zoning Code requirements.
To provide better access to the property (access/traffic will be
covered when the traffic study is made available), staff
questioned the location of the proposed subdivision line. At
present, the only useable access to the property is from County
Road I. A repositioning of the subdivision line out to Mounds
View Drive thereby providing access to and from this development
site would have been preferable and still should be pursued.
The property seller, Kraus -Anderson, was not receptive to
selling additional property to Burger King to allow access out
to Mounds View Drive.
CONDITIONAL USE PERMIT
1. A convenience food establishment is a permitted use in a B-3,
Highway Business District by conditional use permit. All items •
listed under Section 40.17, Subdivision D(1) seem to have been
met with the exception of item F. The access and traffic of
this area will be discussed and reviewed at a later time when
professional information is available. Should the Commission

r'1 approve of the "idea" of a convenience food establishment at
this location, which would require a conditional use permit,
staff recommends the Commission review new language proposed in
the Zoning Code (new Section 40.25, Subd. C) as it relates to
this proposed development, specifically criteria and conditions
for conditional use permits,
CODE APPEAL
1. Existing Zoning Codo requirements for off-street parking for
convenience food establishments is at least 1 space for each
15 square feet of gross floor area but not less than 15 spaces.
Using this requirement, the Burger King facility proposed would
require 147 spaces. This number greatly exceeds what typical
Burger King restaurants require for parking. Attached is a
listing (Exhibit 4) which shows the number of parking spaces at
various Burger King Restaurants in the metropolitan area.
In the new Zoning Code text, the Commission is recommending the
parking requirement for restaurants 140.07, Subd. H(20)) be used
for convenience food establishments [40.07, Subd, H(14)). Using
these requirements, 39 spaces would be required. This is much
more in line with what is actually needed (based upon other
Burger King Restaurants) for fast food establishments. 43
parking spaces are proposed with this application. 10 foot by
20 foot parking spaces are being proposed.
Note that the Planning Commission will be convening as the Board
of Adjustment and Appeals for the appeal mentioned.
SETBACKS
1. The building meets minimum setback requirements for B-3 zones.
The parking area also meets minimum setback requirements.
UTILITY SERVICES
1. Sewer and water services are available on Mounds View Drive
north of County Road I. Note the 20 foot utility easement
proposed to allow hook-up to the utility services.
S'TORMWATER (CHAPTER 49A)
1. This site is part of the Silver Lake Woods Development Project.
The pond which was constructed was designed to meet Ordinance
No. 49A (formally Resolution No. 983) requirements for
properties within Silver Lake Woods project area. Therefore,
on -site storage of water is not required for this application.

2. Stormwater is directed via a swale and culvert system to the
storm sewer pipe located on the northeast corner of Mounds View
Drive on County Road I.
3. The City Engineer is in the process of reviewing the site
drainage plan to determine if it is to be acceptable.

Uenshoof will once again be present at the meeting tc further

Approval of this development: proposal will require an amendment
to the original P.U.D. which was approved for the Silver Lake
Woods Development. The original P.U.D. proposed an office
building at this location with a U-2 zoning classification. This
propnsal is not in conformance with what was originally

the P.U.D. and zoning which was approved under the original
Silver. Lake Woods development. The original Silver Lake Woods
develuplrettt provides for a 20,000 square foot office building
located on the parcel in question. The Burger King proposal
is for a fast service food facility with another development such
as a day care center or a convenience store on the remainder of the
parcel. It should be noted that the only item being presented for
consideration at this time is the Burger King site with the balance
of the property in' the quadrant located north of County Road I and
east of Mounds View Drive being left vacant for future development.
In June of 1901 the City Council passed Resolution No. 1319 which
addressed the zonings for all the parcels within the Silver Lake
Woods area. 'Phis was based on the intent of the developer to
construct an office facility on the site, a portion of which is
being proposed for the Burger King development. The original P.U.D
envisioned a family restaurant of approximately 6,500 square feet.
The proposed Burger King development would provide a fast service
restaurant facility of 2,435 square feet. The Burger King proposal
will require a change in the zoning for the parcel from B-2 to B-3.
It should be noted that the original rezoning Resolution No. 1319
has never been implemented tiu:ouglt specific rezoning and ordinance
revisions. 'these rezoning ordinance actions are being implemented
in the current zoning map update process. This leaves the question

SUBJECT': BURGER KING APPLICATION AND FIRE SPRINKLER SYSTEM
Mr, Bill Ranek of Burger King recently called me regarding the
requiremont of sprinkling their building being proposed at this
time, Adopted building codes which include Appendix E do not
require sprinkling of the building as proposed. Recent visitation
of the new Burger King no Highway 65 (just south of Highway 10)
proved to show that the facility was sprinkled and basically
identical to the one proposed in Mounds View. In discussion with
Fire Chief Fagor.nirom, it is our recommendation that the proposed
building he sprinkled, It is unclear as to how Spring Lake Park
required the sprinkling in their building other than they must
have requonted it: and the applicant agreed. Spring Take Park's
nodes are no different than Mounds View's.
Therefore, I would suggest that you request the representative to
agree to install a sprinkler system as part of the approval
procenn. The reasoning you could use would be the restaurant's
unn of paper and plastic containers and their use of wood decor in
tho construction of the building.
Reprosontatives are aware of the possibility you may require a
sprinkling system.

by selling it to an individual, if he should come
back to them later with complaints.
There was' considerable discussion regarding the merits
of selling to an individual, and realizing a $1,000
additional payment for the used tractor.
Attorney'Meyers recommended asking Kortuem's if they
are willing to up their trade-in offer to $3,500.

Qommission as 1984 is the last year of his 3 year term.
Mayor McCarty explained that his feeling is that
as long as a commission member wishes to remain
on a Commission, he will reappoint them, as long
as they have been doing a responsible job. r

Rose had met with Robert Balch, who is working
with Bill Beim on the Piaecrest Properties, and
it appears they are getting ready to move on the

Mayor McCarty stated that it was his understanding
that at the time the original application came in,
it was nor rlaar that a kitchen was included.
Councilmember Hankner pointed out that on the copy
of the building application, it states clearly that
txo kitchens are not allowed.
Technician Kampel explained that the original build-
ing permit was taken out by the contractor, and that
Mrs. Chaika did not see it, and there was no indi-
cation that a kitchen was planned. He stated the
City first found out about the kitchen when Building
Inspector Rose went to the home and observed the
construction and spoke to the contractor. Technician
Kampel added that when he had first spoken to Mrs.
Chaika approximately a year and a half ago, she gave
no indication that a second kitchen was planned.
Clerk/Administrator Pauley explained that dependent
upon the application being made, different degrees
of drawings are given.
Director Johnson showed the Council the sketch that

Councilmember Hankner stated she did not feel the
City was responsible, as they have followed the
procedure as set forth.
Mayor McCarty stated he felt Mrs. Chaika may have
been a victim of circumstance, and had coimnunica-
tion problems with her contractor, but he stated
that if the Council had approved the request, it
would be a violation of the code. He did recommend
waiving the fees Mrs. Chaika had paid for the
rezoning.
Motion/Second: McCarty/Doty to waive the refund
the rezoning fees paid by Mrs. Chaika for the
Planning Commission hearing.

particular contractor that there were problems, and
keep it in mind when it is time for him to renew

Director Johnson presented an amendment to 40.04
Sub D(2), regarding the positioning of solar
devices, and stated Staff recommends it be
added to the ordinance language.
Mayor McCarty stated he had spoken with the Chairman
of the Planning Commission and that there are some
issues before the Planning Commission at this time
that require changes to Chapter 40 as soon as possible.
He stated, however, that Roberts Rules allows only
two amendments to any ordinance, and that in reviewing
the proposed ordinance, he came up with over 48 changes
to be made. He reviewed some of those changes with
the Council and questioned how some of the criteria
was established,
Director Johnson explained that areas were in the code
originally and were not changed in the review, and he
believed some of the areas may have been drafted in
1974.

Mayor McCarty reviewed several sections he felt '
required changes. Ile stated the Planning Commission
did a tremendous job in working on she ordinance, but
ran into .a very difficult situation in incorporating
the changes. He asked that one amendment be included,
to maintain the 85 foot minimum lot width at this time,
until they have more time to study it.
Commissioner Quick explained that the Planning Commission
used the Red Oak property as an example when making
that change, and determined it could possibly make the
difference of one lot.
Councilmember Hankner stated she would feel more
comfortable waiting to approve the ordinance, until
all the Council members had had an opportunity to
review the suggested changes, and then make the
necessary changes, before approving the ordinance.
Director Johnson explained the timetable was a self-
imposed one, and that the new ordinance will
definitely help the Planning Commission, and that
they need the text before starting on the public
hearings on the map revisions,
It was agreed that the Council would meet with the —�
Planning Commission on December 21, at 7 PM, to go
over the ordinance.
