The Consent Agenda is a technique designed to expedite handling
of routine and miscellaneous official business of the City
council. The entire agenda may be adopted by the Council in
one motion. The motion for adoption is non -debatable and must
receive unanimous approval. By request of any individual
Councilmember, an item can be removed from the Consent Agenda
and placed upon the Regular Agenda for debate.

As you recall, the City 1:.•t:l a h-raring t" rezone the property noted
above from R-3 tc, R-2 on May 14, 1984 at. 7:45 p.m, At that time, the
Administrator stated that the church was entering into a purchase
agreement to sell the property known as the church triangle. On Juno
5, 1984 the City received a copy of the purchase agreement signed by
Church Upon the Rock and Kinder Care Child Center.
RGCONMENDATION: I recommend that you table the second reading of the
rezoning end finitely and forward the documents to the Planning

RESOLUTION ADOPTING THE 1985 BUDGET CALENDAR
WHEREAS, the City Charter prescribes the requirements
for a Budget Calendar under 7.04; and
WHEREAS, the City Staff has reviewed the requirements of
that section - 7.04 and determined the following:

RESOLUTION ENDORSING THE CONSTRUCTION OF A MEMORIAL
IN HONOR OF PLAYGROUND, INC. AT LAKESIDE PARK
TO BE CONSTRUCTED BY KRAUS-HARTIG VFW POST 6587
WHEREAS, Playground, Inc, were the initial founders and
developers of Lakeside Park; and
WHEREAS, Playground, Inc, was comprised of dedicated com-
munity residents within the Cities of Mounds View and Spring Lake
Park; and
WHEREAS, the Playground, Inc, has formally deeded the
Lakeside Park over to the Cities of Mounds View and Spring Lake
Park; and
WHEREAS, Playground, Inc. is no longer functioning as the
manager and coordinator of the Lakeside Park facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Mounds View strongly endorses the concept of estab-
lishing a memorial for Playground, Inc. and the Lakeside Park
Commission to honor the years of invaluable service they provided
to their community; and
BE IT FURTHER RESOLVED that Kraus-Hartig VFW Post 6587 is
proposing to construct a memorial honoring the years of service
provided by Playground, Inc. and the Lakeside Park Commission;
and
BE IT FURTHER RESOLVED that the City Council of the City
of Mounds View heartily endorses the concept of developing the
memorial for Playground, Inc.; and
BE IT FURTHER RESOLVED that the City of Mounds View and
is willing to provide any administrative and management assis-
tance necessary in seeing this project through to its completion.

RE: Part-time summer help
Staff would like to request that Mr. Don Matanowski and Mr. Nick
Barbato be retained for their fourth consecutive year as part-
time park maintenance employees. Staff would recommend that Mr.
Matanowski receive an hourly rate of $5.75 and Mr. Barbato would
receive $5.25 per hour. Both of these young men are seniors in
college and have been with our department for the past four years
and are extremely good employees and quite familiar with our
entire City operation. We currently have $6,160 for part-time
employees and the proposed pay rate would keep us within the bud-
geted amount.
Nick would be starting June 11, 1984 and Don commenced his em-
ployment with the City on May 22, 1984. Once again, staff will
be on hand to review this issue at Monday Evening's meeting.

RECOMMENDATION: To authorize staff to hire Don Matanowski at the
rate of $5.75 per hour effective May 22, 1984 and Nick Barbato at

Clerk/Administrator Pauley explained that Tycoon is
the company of Wil Harris who ran his boxing operation
out of BelRae last year. Based on past good exper-
ience, he recommended approval without hesitation.
He concluded that they are strictly private.
Director Thatcher stated that there was an addition
to Item M under General Contractors: Kraus -Anderson
Construction Co. (renewal).

Attorney Meyers asked if information had been received
from staff to justify this particular rezoning _
under the comprehensive plan. Mayor McCarty replied
that the Planning Commission wants this rezoning to
take place and that their recommendation is contained
in a memo written by Staff to Council dated March 28,
1984, entitled Controversial Rezoning; this plus the
comprehensive plan justify approval.
Mayor McCarty asked Attorney Meyers if there would be
diminution of assessed valuation and diminution as a
result of revenues. Attorney Meyers replied that there
would be no automatic diminution of value and that it
generally has to be determined on a case -by -case basis.

Director Thatcher reviewed discussions with the state
on the signal light at County Road J and Trunk Highway
10. He stated that after the state had proposed a
second modification to the intersection and he told
them they would have to pay, they decided to stay with
the first modification. lie noted that it will all be
covered by MSA funds.

versial issues surrounding these two rezonings, it was

for an indefinite period of time and authorize the

City Planner and with the affected property owners
as soon as possible.

Mayor McCarty indicated that he was contacted by a
resident who has a tree on the easement and wants to
find out why the cable company is trimming off tree
tops when they are running the cable 3' below those
tops.
Clerk/Administrator Pauley replied that he would take
the name and address of the resident and refer the
complaint to Group W and the City's Cable Conmission
who, in the past, have shown to be respondent and
prompt in handling previous complaints.
Mayor McCarty asked that the '1CCL, who approached the
City earlier on requested space for a lifemobile at
vestibule parking for the festival in the parks, be
contacted on what the criteria will be this year.
Attorney Meyers' opinion was that the Festivities
Commission should develop criteria for use of public

and anticipated a lesser strain on the water and
sewer system. He indicated that they are proposing
a 2-phase development: (1) dedication of right-of-
way for connecting street, and; (2) construction of
Raymond, median cut, and any other utilities that
may have to be built along the way. He then reviewed
the berming plans that were presented as a third phase.
Mayor McCarty asked what effect the berming would
have for adjacent property owners.
The engineer explained that they would view basically
evergreens offset with shrubs. He added that the
berminq was planned so that a person 61 tall standing
on a first floor would not be able to see the roof
of a 16' warehouse. He pointed out that other
factors that might lessen the impact is the sound-
proofing as a result of the slope, the setback
requirement for each building, the location of the
truck doors on the south side of the buildings, the
types of buildings (office warehouse, wholesalers,
etc.) and the fact that the City has its own code
for landscaping around buildings.
Mayor McCarty asked whether there would be access
to Raymond at the culdesac. The engineer replied
that there would be no access except for emergency
vehicles and that the berming was planned in accord-
ance. He added that access from Highway 10 would
remain and would be somewhat restricted.
Mayor McCarty then asked what the setback would be
from surrounding homes. The engineer replied that Is
it would be in excess of 1001.

Jeanette Kilduff, 2213 Co. Rd. H-2, asked about a
petition she heard was submitted opposing the re-
zoning. Clerk/Administrator Pauley confirmed that
there was one filed by 14 property owners and signed
by residents and dependents.
Peg Mountin, Chairman of the Planning Commission,
reviewed Planning Commission discussions regarding
the rezoning. She indicated that concerns in the
past revolved around the through street and apart-
ment type dwellings that were originally proposed
under the high residential use and that other con-
cerns include the noise level, light intensity and
heavy industrial use. She stated that the Planning
Commission felt that bermina: was an excellent barrier
and constituted an adequate buffer. She pointed out
that residents are protected from high intensity
lighting under the zoning ordinance and felt that
heavy industrial would not be able to meet standards
imposed for conditional use permits. Her opinion
was that the I-1 was a good alternative and that
the birming was sufficient to protect abutting
properties.
Mayor McCarty asked if anyone was present who signed
the petition so that they could substantiate some
/~specific concerns that the Council could address.
Jeanette Kilduff, 2213 Co. Rd. I1-2, stated that
there was a previous concern that residents would
be billed for storm sewer. Mayor McCarty replied
that residents will not be assessed for this if the
property develops.

SUBJECT: TELEPHONE SYSTEM
During the past two years I have been discussing with various
suppliers on an intermittent basis the possibility of the City
of Mounds View purchasing or leasing with option to purchase
a more advanced telephone system than is currently being used
by the City at a rental rate of approximately $275 per month
from Northwestern Bell. I recently received a proposal from
First Tel, a subsidiary of U.S. West which would provide for
a significant update in the City's current equipment at a cost
equal to or less than presently being paid for rental of our
present system for an eighty-four month period with option to
buy at the end of the eighty-four month time frame. In order to
obtain a new telephone system it would be necessary for the City
to obtain proposals from various suppliers in the Metropolitan
Area.
I would request Council authorization to prepare a Request for
., Proposal outlining a desire on the part of the City of Mounds
View to obtain a telephone system meeting currently available
technology with a lease purchase agreement of eighty-four
months. The purpose for doing so would be to determine whether
or not the City can update our existing equipment at a cost
equal to or less than presently being paid for the rental of
equipment. As it has been my position in the past that the
City should update their equipment if it does not cost us any-
more than our current expenses, I would strongly request Council
authorization to prepare and mail out a Request for Proposal as
outlined above. The bids and type of equipment being proposed
would be submitted to you for your final approval once they are
received.
RECOMMENDATION: Authorize Clerk -Administrator to prepare and
distribute a Request for Proposal for the lease/purchase of a
telephone system for the City of Mounds View.

submitting to you a summary of the program with conclusions &

b. Target the balance of the Cored meters in Zones III and
IV. This was completed in 1982. Also target those Corad
meters in Zones I and II installed in 1973 and 1974.

c. Target the Neptune tri-seal meters in Zones III and IV

The 1983 budget according to the 1982 meter service report, had
$4,800.00 for labor and $1450.00 for parts. $3,072.00 was spent
on labor and $6,718.40 was spent on parts, cleaning material and
new meters.
Staff has reviewed the program, made the following conclusions
and makes the following recommendations:

5. At the beginning of the program, it was the philosophy of the
City that we were losing money as a result of inaccurate
water meter readings. Since the program started, the City
tested 15 meters where the error was greater than the allow-
able +1 1/2 which required the property owner to reimburse
the City. The total collected by the City for readings in
error was $63.48. This is compared to a total of 136 meters
tested where the error was greater than the allowable -3%
which required reimbursement from the City to the property
owner. The total reimbursed to individual property owners
was $1,410.2,7. Thus the net loss as a result of inaccurate
meter occurredaalags was result$of346.79. No increase in revenues
meter replacements.
,Recommendations
1. The 1984 program, if one is to be undertaken, would be to:
a. Respond to normal complaints of leaking meters, inaccu-
rate readings etc.
b. Respond to complaints of low water pressure as time s
material availability allow. The city's water crew or an
independent contractor could clean and/or replace service
lines. The cleaning should only be directed toward pro-
perties with a problem caused by build-up in their
service lines where their water volume at the meter is
less than some established standard. It should be noted
that the possibility does exist for damage to the service
line which could possibly create a liability for the
City. Should Council direct staff to investigate this
matter, consultation with the City Attorney will be
undertaken.

SUBJECT: PETITION FOR FENCE ON THE SOUTH SIDE OF THE PUBLIC
WALKWAY BETWEEN EDGEWOOD DRIVE AND BONA ROAD NORTH
OF COUNTY ROAD H
As you know, the City received a petition on the subject walkway. I understand that the
City has agreed to install a fence on the south side of the walkway to solve some of the
problems. This memo is presented to outline the estimated costs.
Attached please find a copy of a letter to Don Pauley from Maria French who lives at 5101
Edgewood Drive, Mounds View, Minnesota, 55112 and a proposal from Fenc-co, Inc., 711
Winnetka Avenue North, Golden Valley, Minnesota, 55427. His cost is $1,484.00 and the
completion time is 3 weeks from Notice to Proceed. The quoted fence is 280 feet of 4 foot
high cedar cross -buck fencing. Please refer to the sketch on the proposal for an
illustration. The style of fence is the same as the one requested by Ms. French.
I tried to secure quotes from local fence companies. However, Crown of Minnesota, Inc.
indicated they are not bidding fence now because of a backlog due to the St. Anthony
storm. Midwest Fence indicated that a fence of this style could be installed for
approximately $8.00 per lineal foot. He also indicated that he was very busy and did not
have time to look at the site.
Another option is to have City crews install the fence. The cost of materials from Spring
Lake Lumber, including nails, delivery, and tax, is $845.00 (the cost of delivery is only
$25.00 and is included). The cost of materials from Knox Lumber, including nails,
delivery fee of $25.00, and tax is $783.00. If the City purchases the materials from
Spring Lake Lumber or Knox Lumber each board in the cross pattern must be cut at an
angle (please refer to the sketch where 1 indicated the necessary cute). The City can
install holes for the redwood fence posts by using the drill truck. The Fenc-co, Inc.
estimate minus the material cost is $701.00. This is the maximum amount of labor costs
the City can allocate to the fence. The maximum amount of time is estimated as follows:
3 men X 2 days/man X 8 hours/day X $15.00/hour - $720.00
Therefore, the City can only afford to have 3 men work a maximum of 2 days on the
project. I have talked to the Public Works Department about installing the fence. There
is no one in the department besides myself and Steve Rose who has experience with
fencing. Therefore, I would have to spend time supervising. However, the work could be
scheduled for the week of August 6, 1984.
RECOMMENDATION: Prior to analyzing the costs in detail, my impression was to have the
Public Works Department install the fence. However, in light of the fact the Public Works
Department is not experienced in fencing and the quote is not out of line, I recommend
awarding the project to Fenc-co, Inc. of Golden Valley, secure additional quotes, or
secure additional quotes on another style of fence such as chain link.

Fall, the residents on the South side of the public walkway
between Edgewood Drive and Bona Road got together and selected the
style of fence that we would like the City to build along the
walkway.
The fence is a four -foot cedar crossbuck with railings top and
bottom and 4 x 4 square posts. We saw the design at Knox Lumber
off of Rice Street in St. Paul, but I believe the fence materials
could be purchased less expensively in our own area.
You also mentioned that the City would prefer to place rock
beneath the fence to eliminate the need for trimming. Neither the
Millers nor we have any problem with this, but we would prefer
that you use Bryan red rock since that is what both of us use in
our landscape designs.
Don, I want to take this opportunity to thank both you and the
City Council for your help in solving the problem we faced with
the walkway. I hope the funds will be appropriated as soon as
possible so that construction of the fence can begin.

Director Thatcher stated that there was an addition
to Item M under General Contractors: Kraus -Anderson
Construction Co. (renewal).

Attorney Meyers asked if information had been received
from staff to justify this particular rezoning
under the comprehensive plan. Mayor McCarty replied
that the Planning Commission wants this rezoning to
take place and that their recommendation is contained
in a memo written by Staff to Council dated March 281
1984, entitled Controversial Rezoning; this plus the
comprehensive plan justify approval.
Mayor McCarty asked Attorney Meyers if there would be
diminution of asseesed valuation and diminution as a
result of revenues, Attorney Meyers replied that there
would be no automatic diminution of value and that it
generally has to be determined on r ^ase-by-case basis.

Director Thatcher reviewed discussions with the state
on the signal light at County Road J and Trunk Highway
10. He stated that after the state had proposed a
second modification to the intersection and he told
them they would have to pay, they decided to stay with
the first modification. Iie noted that it will all be
covered by MSA funds.

Mayor McCarty stated that it had been discovered that
there was a defect in the notice procedures for the
next two public hearings on the agenda and therefore
the Council would not be able to hold the hearings as
planned. He further stated that, because of the contro-
versial issues surrounding these two rezonings, it was
suggested that further meetings with the Planning Commission.

Mayor McCarty indicated that he was contacted by a
resident who has a tree on the easement and wants to
find out why the cable company is trimming off tree
tops when they are running the cable 3' below those
tops.
Clerk/Administrator Pauley replied that he would takc
the name and address of the resident and refer the
complaint to Group W and the City's Cable Commission
who, in the past, have shown to be respondent and
prompt in handling previous complaints.
Mayor McCarty asked that the MCCL, who approached the
City earlier on requested space for a lifemobile at
vestibule parking for the festival in the parks, be
contacted on what the criteria will be this year.
Attorney Meyers' opinion was that the Festivities
Commission should develop criteria for use of public
property that would apply to any activity from any
group.
Motion: McCarty to direct that the Council request the
Festivities Commission to set forth the standards and
guidelines for festivities at the festival in the parks. Motion Failed

Councilmember Blanchard stated that the Commission
bylaws set down criteria and that they have been
abiding by this.
' Councilmember Hankner added that, after they have
finished planning all activities, they plan on up-
dating standards and guidelines, so it will be done.

Robert Duetel, Chairman of the Energy Commission, 19. Report of
commented that he had a report to give. He stated Energy Co,' s
that the Commission met on May 19, 1984. They set
a number of goals and established programs and
activities. He stated that items will be brought
to the Council at a later date for specific action
and that he would be reporting regularly.

The engineer from Short-Elliott-Flendrickson
reviewed existing and proposed zoning. He explained
that the proposed development would generate less
traffic over commercial and light industrial mixes
and anticipated a lesser strain on the water and
sewer system. Ile indicated that they are proposing
a 2-phase development: (1) dedication of right-of-
way for connecting street, and; (2) construction of
Raymond, median cut, and any other utilities that
may have to be built along the way. He then reviewed
the berming plans that were presented as a third phase.
?Mayor McCarty asked what effect the berming would
have for adjacent property owners.
The engineer explained that they would view basically
evergreens• offset with shrubs. He added that the
berming was planned so that a person 6' tall standing
on a first floor would not be able to see the roof
of a 16, warehouse. He pointed out that other
factors that might lessen the impact is the sound-
proofing as a result of the slope, the setback
requirement for each building, the location of the
truck doors on the south side of the buildings, the
types of buildings (office warehouse, wholesalers,
etc.) and the fact that the City has its own code
for landscaping around buildings.
Mayor McCarty asked whether there would be access
to Raymond at the culdesac. The engineer replied
that there would be no access except for emergency
vehicles and that the berming was planned in accord-
ance. He added that access from Highway 10 would
remain and would be somewhat restricted.
Mayor McCarty then asked what the setback would be
from surrounding homes. The engineer replied that �-
it would be in excess of 1001.

Jeanette Kilduff, 2213 Co. Rd. H-2, asked about a
^ petition she heard was submitted opposing the re-
zoning. Clerk/Administrator Pauley confirmed that
there was one filed by 14 property owners and signed
by residents and dependents.
Peg Mountin, Chairman of the Planning Commission,
reviewed Planning Commission discussions regarding
the rezoning. She indicated that concerns in the
past revolved around the through street and apart-
ment type dwellings that were originally proposed
under the high residential use and that other con-
cerns include the noise level, light intensity and
heavy industrial use. She stated that the Planning
Commission felt that bermina was an excellent barrier
and constituted an adequateT buffer. She pointed out
that residents are protected from high intensity
lighting under the zoning ordinance and felt that
heavy industrial would not be able to meet standards
imposed for conditional use permits. Her opinion
was that the I-1 was a good alternative and that
the birming was sufficient to protect abutting
properties.
Mayor 6IcCarty asked if anyone was present who signed
the petition so that they could substantiate some
specific concerns that the Council could address.
Jeanette Kilduff, 2213 Co. Rd. H-2, stated that
there was a previous concern that residents would
be billed for storm sewer. Mayor McCarty replied
that residents will not be assessed for storm sewers
installed within the development of Pinecrest properties.

the regular meeting at 9:06 p.m.

Clerk/Administrator Pauley reported that one of the 24. Report of
City's two Toro Groundsmasters threw a rod and the Administrator
engine was totaled so Staff was required to replace
the engine. As a result, he suggested rebudgeting
of a new machine to 1985.
Mayor McCarty indicated that he was concerned about
the difference in cost in delaying purchase of a new
machine to next year. He asked Clerk/Administrator
Pauley to look into contingency or other funds to
get whatever is needed for a new machine.
Clerk/Administrator PaL.ey reported that after dis-
cussions last week of contract negotiations, he made
an offer to the Police Union but was advised that
the offer was rejected. Ile stated that he is tenta-
tively scheduled to meet with them again this week and
has taken the position that he is willing to discuss �0'
any other options they present so long as the total
package does not increase.
