Adjournment r r.� 7'So MEMO TO: Steve Thatcher & City Council FROM: Building Inspector DATE: July 5, 1984 SUBJECT: Red Oak Estates #3 Just a brief note and clarification about the history of the Red Oak Estates #3 Plat and the townhome development. History The Red Oak Estates #3 Plat was approved by the City Council on 7-8-74. The approval however only allowed the construction of the first six units and remainder of the permits would not be issued until the drainage facilities and ditch were improved. The facilities and ditch were never improved by the developer. Lastly only the first six units were allowed to be built. It is unclear at this time based on the information I have found whether not the drainage improvements were actually made and that the Conditional Use Permit was granted for the remaining 66 units. Legal Action was taken against the City in 74-75 from residents regarding the City's action of allowing the townhomes. The court upheld the City's zoning action of allowing the townhomes to be constructed. Today Existing code today allows townhomes in R-3 Zoned district with a Conditional Use Permit. The following are considerations regarding them: Gale/Yost You received a feasibility study earlier this year regarding this project but did not c nduct a hearing. A hearing is technically necessary before ordering plans and specifications on the project. Please note at this time existing staff intends to prepare the, plans and specifications for the project if time allows. If not, staff will request approval for the use of the consultant. Pinecrest Addition On January 31, 1984, the City received a petition for improvements from the managing partner of Pinecrest Properties. Due td the ,— complexity of the project and a need for additional access along Highway 10, the City's efforts today, besides the rezoning, was to assist the owners in obtaining a median cross -over permit from the Minnesota Department of Transportation. Now that Mn/DOT approval has been granted, the project with non -access to County Road H-2 (except emergency) is feasible. Please note the resolution includes accepting the petition of which you previously received in a memo from Don Pauley on approximately February 1, 1984. Lastly, please note the staff has recommended use of Short -Elliott - Hendrickson, Inc, to prepare the plans and specifications due to the size of the project and our limited time now due to the M.S.A. project. A contract would be formalized and approved by the City Attorney prior to start of the work. Necker Stucco RESOLUTION NO. 1756 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION ESTABLISHING A GENERAL FUND CASH FLOW RESERVE WHEREAS, the City's auditors have, in their management report dated December 31, 1983, recommended that the City maintain an adequate level of fund balance in the General Fund in order to provide for the financial strength and integrity of the City; and WHEREAS, the Council recognizes that an adequate level of fund balance is necessary to provide for cash flow requirements; NOW, THEREFORE, BE IT RESOLVED as a matter of policy, the cash flow reserve of the General Fund shall, as far as practicable, be maintained at an amount which equals one-half of the General Fund's property tax levy and anticipated state aids in a given year; i BE IT FURTHER RESOLVED by the Council that $387,000 of the fund balance of the General Fund is designated as a reserve for cash flow; BE IT FURTHER RESOLVED, that the Council shall annually review, the amount of the cash flow reserve as part of the budget preparation process. Mayor (SEAL) Clerk -Administrator , RESOLUTION NO. 1757 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION ESTABLISHING A GENERAL FUND FOR COMPENSATED ABSENCES PAYABLE WHEREAS, the City's auditors have, in their management report dated December 31, 1983, recommended that the City maintain an adequate level of fund balance in the General Fundin order to provide for the financial strength and integrity of the City; and WHEREAS, the Council recognizes that an adequate level of fund balance is necessary to provide for compensated absences payable; NOW, THEREFORE, BE IT RESOLVED by the Council that $57;851 of the fund balance of the General Fund be designated as a reserve for compensated absenses payable; BE IT FURTHER RESOLVED that, as a matter of policy, the reserve for compensated absences payable of the General Fund shall, as far as is practicable, be maintained at an amount which equals the compensated absences payable of the General Fund contained in the annual financial statements; BE IT FURTHER RESOLVED that, the Council shall annually review the adequacy of the amount of the reserve for compensated absences payable as part of the budget preparation process. ATTEST: Mayor (SEAL) Clerk -Administrator RESOLUTION NO. 1758 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION ESTABLISHING A GENERAL FUND RESERVE FOR CONTINGENCY WHEREAS, the City's auditors have, in their management report dated December 31, 1983, recommended that the City maintain an adequate level of fund balance in the General Fund in order to provide for the financial strength and integrity of the City; and WHEREAS, the Council recognizes that an adequate level of fund balance is necessary to provide for unforseen circumstances and emergencies; , NOW, THEREFORE, BE IT RESOLVED by the Council that $52,000 of the fund balance of the General Fund is designated as'a reserve for contingencies; BE IT FURTHER RESOLVED, that the Council shall annually review the adequacy of the amount of the reserve for contingencies as part of the budget preparation process. Mayor Clerk -Administrator RESOLUTION NO. 1759 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION AUTORIZING A TRANSFER OF FUNDS FROM THE PARK IMPROVEMENT FUND TO THE SILVER LAKE PARK FUND AND AUTHORIZING THE CLOSING OF THE SILVER VIEW PARK FUND WHEREAS, the Silver View Park Fund was established to account for state and federal grants used to partially finance the acquisition of lands and the development of those lands as Silver View Park; and WHEREAS, the lands have been acquired and developed as Silver View Park, state and federal grant funds have been received, the state and federal granting agencies have given . their final acceptance of the project, and there remains a deficit of $2,634.15 in the fund; NOW, THEREFORE, BE IT RESOLVED, by the Council that $2,634.15 be transferred from the Park Improvement Fund to the Silver View Park Fund and that the Silver View Park Fund be closed. Mayor Clerk -Administrator RESOLUTION NO. 1760 CITY OF MOUNDS VIEW 7 COUNTY OF RAMSEY STATE OF MINNESOTA WHEREAS, the City's auditor's have indicated, in a Special Assessment Debt Service Study dated December 31, 1982, that the 1981 Improvement Bone Debt Service Fund may experience temporary cash deficits from 1985-1991 as a result of a mismatch between scheduled special assessment collections and debt service payments; and WHEREAS, these temporary cash deficits are estimated to total $231,700; and WHEREAS, the prepayments of special assessments levied to retire the bonds may eliminate these anticipated cash deficits; and WHEREAS, the Council desires to provide a means by which scheduleda debt service payments of the 1981 Improvement Bonds• Fund may be assured should sufficient prepayments of special assessments not be received to eliminate anticipated cash deficits; NOW, THEREFORE, BE IT RESOLVED by the Council that it is the intent of the C^until to use funds of the Silver Lake Woods Construction Fund to make a loan or loans to the Improvement Bonds of 1981 Fund in order that the Fund may be able to make scheduled debt service payments if it, in fact, experiences temporary cash deficits; BE IT FURTHER RESOLVED, that the Council shall annually review, the amount of the reserve for debt service as part of the budget preparation process; BE IT FURTHER RESOLVED, by the Council that $176,000 of the fund balance of the Silver Lake Woods Construction Fund be designated as a Reserve for Debt Service. ATTEST: Mayor ••z (SEAL) Clerk -Administrator s6:4 I' rF I RESOLUTION NO. 1763 r CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION REQUESTING PLACEMENT OF 4 WAY STOP INTERSECTIONS ON LONG LAKE ROAD BY RAMSEY COUNTY WHEREAS, a petition was received by the City of Mounds View on June 21, 1984 from residents on Long Lake Road between Sherwood and Ardan Avenues requesting a placement of traffic controls along this section of Long Lake Road; and WHEREAS, the residents cited concerns for the safety of their children in view of the speed of traffic traveling along this section of Long Lake Road and the lack of traffic controls from Highway 10 to County Road J; and WHEREAS, the Police Chief Ramacher has recommended that the most efficient method for controlling the speed of traffic along this section of roadway would be to place 4 way stops at the intersections of Long Lake Road and Sherwood and Long Lake Roads and Hillview; and WHEREAS, it has been the determination of the Mounds View City Council that it is their desire to obtain installation of these traffic controls by Ramsey County due to the fact that Long Lake Road is a County Road; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View that the Ramsey Conty Board of Commissioners is requested to authorize the installation of 4 way stop interections at the intersections of Long Lake Road and Hillview Road and Long Lake Road and Sherwood Road in the interests of public safety and welfare. Mayor Clerk -Administrator �' ORDINANCE NO. 379 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE AMENDING THE MUNICIPAL CODE OF MOUNDS VIEW BY AMENDING CHAPTER 100, ENTITLED "INTOXICATING LIQUORS" The Council of the City of Mounds View does hereby ordain: SECTION I. Chapter 100.01, Definitions, is amended by adding the following: Subdivision 7. Food. Food, as the term is used here shall mean a menu consisting of not ess than three separate an istinct entrees, complete with vegetable, salad, rolls or bread, and a selection of beverages.' SECTION II. Chapter 100.02, Subdivision 1, License Required, is amended as follows: �\ Subdivision 1. License Required. No person, except wholesalers or manufacturers to the extent authorized under State license shall directly or indirectly deal in, sell, or keep for sale any intoxicating liquor without first having received a license to do so as provided ',: in this Chapter. Licenses shall be of fo# five kinds: "on -sale", "off -sale", "club", "Sunday sale", and "on -sale wine" licenses. SECTION III. Chapter 100.02, Subdivision 4, Sunday sales, is amended as follows: Subdivision 4. Sunday sales. sSpecialal on -sale licenses for the sa e o intoxicating liquor on Sunday separate from a regular "on -sale" to -hotels, restaurants or -clubs as defined in Section 100.01, Subdivision 1 in which have facilities for serving not less than 30 guests at one time. SECTION IV. Chapter 100.05, Subdivision 3, Commissioner / of Public Safety, is amended as follows: Subdivision �/ 4. Commissioner of Public Safety. The Clerk -Administrator shall within 10 days after the issuance of any "on -sale" license under 100.05 this Chapter, submit to the Commissioner of Public Safety the full name and address of each person granted a license, the Trade Name, the effective license date, and the date of the expiration of the license. He shall also submit to the Commissioner of Public Safety any change of address, transfer, cancelation, revocation of "on -sale" or "off -sale" license by the Council during that license period. SECTION V. Chapter 100.05 is amended by adding the following new Subdivision 3, Hearing: Subdivision 3. Hearing.
