Call to Order Mayor McCarty at 7:37 PM on July 9, 1984, The Pledge of Allegiance was said, MEMBERS PRESENT: Councilmembers Blanchard, Doty, an erii�Tcr,, Lind Mayor McCarty. ALSO PRESENT: City Attorney Meyers and Clerk/ KE-1-nistrattoor Pauley. Motion/Second: Doty/Blanchard to approve the June minutes as corrected. 5 ayes 0 nays Jim Miller requested the Council grant a 90 day extension for the time limit for submitting the final plat on his property, He explained they have been working continuously on the project, but in meeting with Staff and the Council on several items, there are still some unresolved issued, such as the wetlands issue, He stated they were given a 90 day extension on April 9, and are requesting this second extension to get everything together. He also noted that Staff has advised him they are looking at proposed revisions to the wetlands ordinance. Mayor McCarty questioned what granting another extension would do to the integrity of the ordinance if they extend the time frame. Attorney Meyers advised it is not so much a legal question as it is a political one, He stated the Council could grant an extension if they feel there is a good reason for one, or if the applicant -� can prove the delay was caused by circumstances beyond his control, 2. Page Two --------------------------------------------------------------------- Motion Second: McCarty/Blanchard to grant a 90 day extena on to the Miller Industrial Plat, for sub- mission of the final plat, based upon pending proposed changes to the wetlands ordinance. 5 ayes 0 nays Susan Snoke, 5272 Sunnyside Road, asked if the City would consider putting up signs on property that is up for rezoning, as Fridley and New Brighton do, to help make the residents aware that something is being considered for rezoning. Motion Second: ;;::.:rt;/Blanchard to direct Staff to post proposed rezoning notices on City property in the future. 5 ayes 0 nays There was discussion on the motion before the vote was taken. Attorney Meyers advised that the City had done that at one time, marry years ago. Councilmember Linke questioned where the funds would come from to pay for the signs. Councilmember Hankner stated she felt the issue should be researched first, and then a motion made, once the cost was known, and the source of the funds. Councilmember Doty stated the funds could come from the contingency fund. Mayor McCarty closed the regular meeting and opened the first public hearing at 7:50 PM. Clerk/Administrator Pauley advised this was a continued hearing from the one that was held in May. He reported the Planning Commission had held an informational meeting with the residents, and has made the recommendation to the Council that the area in question not be rezoned but left as is. He added that Harstad and Todd had appearad at City Hall and applied for a building permit for 6 unit townhouses, but they were advised that building permits would not be issued at this time, as fees could not be calculated, and they must go through a development review with the Planning Commission and City Council, as well as the land in question being involved with the wetland ordinance and floodplain ordinance. Staff also advised Mr. Harstad that he would have to file an application with the City for a conditional use permit, as well as wetlands and floodplain permits. Motion Carried Motion Carried 6A. Public Hearing - Rezoning of Red Oak Estates No. Mounds View City Courcil n ' ul 9, 1984 Regular Meeting U�i' �• .'age Three -------------------------------------------------------------------- r"- Mike Berner, 2600 Clearview, stated he is in agree- ment with the Planning Commission's recommendation to leave the zoning as is. He stated his property is across the street from the property in question, and he did not receive a notice of the hearing, and many of his neighbors did not receive one either. He explained he has lived in his home since 1976, and purchased it because it was in a single family area, with very light traffic. Mr. Barner stated there are a substantial number of children in the neighborhood now, and he would not want to see an increase in traffic. He also questioned how the 6 plex was allowed in the first place. Mayor McCarty explained the existing 6 plex was built in 1974, on the basis that no further permits would be issued until the drainage issue was taken care of. Attorney Meyers explained the history of the property, and how the City had been taken to court, and the court's decision on the property. He stated that the proposal this evening is to bring the zoning into conformance with the comprehensive plan, and if the Council does not rezone the property, they should amend the comprehensive plan to go back to low density. Elaine Shephard, 2658 County Road H2, stated she `Lives in one of the townhouse units, and questioned if the zoning were approved, if she would then become an R-3. She added she does not want to be R-3, and has had many problems since she purchased her townhome. Mayor McCarty explained the comprehensive plan for that area for District 9 is low density, which would be R-1 or R-2. Mayor McCarty also explained a memo from Staff from February 1984 had laid out the criteria that would be used in rezoning property and bringing it into con- formance with the comprehensive plan. He added that he agrees with the Planning Commission's recommendation. Ken Briggs stated he was a representative of Mr. Harstad and Mr. Todd, and asked why they were never notified in advance that the property was being discussed for rezoning. lie stated they have not had time to prepare themselves to address the Council or residents about the proposed re- zoning, and asked that it be referred back to the Planning Commission so they would have a chance to meet with them and discuss it. Clerk/Administrator Pauley explained that notice was published in the New Brighton Bulletin, and they followed the letter of the law in providing notification. Attorney Meyers advised that under R-3, a conditional use permit could allow townhouses up to 6 units, which is the issue the Planning Cotmsission is addressing. He also explained that for a comprehensive rezoning, official notification is by the newspaper. Councilmember Hankner asked that Staff research the problem of notices not being received by everyone for hearings such as this, as the problem has occurred before. Mayor McCarty stated the Council is sensitive to the issue now, and will address it further. Ms. Snoke presented the Council with a petition of 153 signatures, requesting the property not be rezoned. Mayor McCarty closed the ppublic hearing and reopened the regular meeting at 8:19 PM. Motion/Second: Doty/Linke to deny the rezoning of e a states No. 3, from R-1 to R-3. 5 ayes 0 nays Motion Carried Councilmember Doty stated that considering all the information that has been received from the residents, Mounds View City Councils �� = =� July 9, 1984 Regular Meeting Page Five -------------------------------------------------------------------- and the past circumstances involing the development of the property, and feeling that the street is a sufficient buffer for that area, it is more suitable for R-1 or R-2. Attorney Meyers noted the residents had relied on the fact that the development was R-1 to the north of them, and there could be a depreciation in the value of their homes if the property was rezoned, and health, safety and welfare must be considered, along with the drainage concerns. Steve Miller stated he had spoken with two realtors, and was told he could expect a 10-15% loss in the value of his home if the land was rezoned. Dave Thisle stated there is a water problem already, which R-3 development would compound. Gary Cox stated he was concerned with the appearance of the neighborhood, as he lives directly next to the existing townhouse units, and he did not want to be sandwiched in between multiple units. Park Director Anderson reported he will be presenting an in-depth report on th4 aquatics program within the next few weeks, and he stated it is going very well. He also reported the healthy people program is going very well, and they have had two health fairs, attended by approximately 800 people, Park Director Anderson reported they have submitted a preliminary grant for Greenfield Park, and he will keep the Council up to date on that progress. He reported the new tot lot equipment has arrived and will be installed within the next two weeks. Park Director Anderson reported they have had juris- diction over the park maintenance people for the past ten weeks, and have gone to double shifts, which has worked well. The winter injury has claimed about 160 trees in just the past three weeks, Park Director Anderson also reported they have been talking with the School Board regarding the Red Oak School property, and will keep the Council advised. Police Chief Ramacher reviewed the training sessions he and the officers have attended, and reviewed the illness problems they have experienced in the past few months. He reported the Community Services Officer is out on a leave of absense until the first of the year. Police Chief Ramacher reported the system of rotating investigators is nearly complete. In comparing the first six months of 1984 to 1983, the crime rate has dropped slightly, and 20% more traffic citations have been issued, and 30% more arrests have been made, with a 10% increase in calls, while having one less officer than last year. Councilmember Hankner commented she liked the repert the Council had received earlier from Police Chief Ramacher. She also asked that Staff look into publishing police calls in the newspaper. Councilmember Doty asked that Long Lake Road and County Road J be checked for speeders. Police Chief Ramacher replied Long Lake Road has always been a problem, and he feels the solution is a 4-way stop sign, and radar would not solve the problem. Section (C), Prior Agreements, is amended to read as follows: 48.07, Exceptions; Permit. C. Agreements. Notwithstanding any other provision of this Code to the contrary, the City and an owner/ applicant of lands abutting lands owned by the City, may by written contract permit the development of wetlands as part of an integrated plan, involving a total of 40 acres or more, wherein the City would participate in the development, and where the development would reasonably conserve and preserve and would enhance the environment by providing facilities that would protect the public health, safety and welfare. Chapter 100.01, Definitions, is amended by adding the following: Subdivision 7. Food. Food, as the term is used here, shalu mean a menu consistin of not less than three separate and distinct entrees, complete with vegetable, salad, rolls or bread, and a selection of beverages. SECTION II. Chapter 100.02, Subdivision 1, License Required, is amended as follows: Subdivision 1. License Required. No person, except wholesalers or manufacturers to the extent authorized under State license shall directly or indirectly deal in, sell, or keep for sale any intoxicating liquor without first having received a license to do so as provided in this Chapter. Licenses shall be of gog five kinds: "on -sale", "off -sale", "club", "Sunday sale", and "on -sale wine" licenses. SECTION III. Chapter 100.02, Subdivision 4, Sunday sales, is amended as follows: Subdivision 4. Sunday sales. At the March 26, 1984 Council meeting a budget transfer of $10,000 from contingency was authorized for evaluation of a possible lawsuit regarding the Anoka County airport. As of June 30, 1984 a balance of $208.88 remains in that account. Expenses have been as follows: Richard Meyers $2,216.25 Transplan Inc. 3,026.08 Coffman Associates 4,548.79 Total Expenses $9,791.12 The balance of $208.88 could be applied to Mr. Merritt's billings. This leaves $16,326.44 to be funded from other sources. As of June 30, 1984 the contingency account has a balance of $10,697. That could be used to pay part of the billings. In so doing the contingency account would be exhausted and there would be no contingency available should unforseen events cause an over- age in operating expenses during the remainder of 1984. The Legislature appropriated $9,257 in supplemental local government aids for 1994. Staff is recommending that those monies be appropri- ated for maintenance of the lower level of City Hall. A savings of approximately $8,000 is expected to be realized in Police personnel costs during 1984, however, staff's i985 budget proposal recommends reappropriating that amount for 1985 in order to meet budget policy guidelines calling for no more than a 5% property tax increase in 1985. At the present time no other revenue overages or expenditure savings are anticipated. I recommend the following regarding payment of Grant Merritt's bill- ing. Upon resolution of the amount to be paid to Mr. Merritt, the check be charged to the account that the other consultants bills were paid from. In November staff would review the status of the General Fund budget and determine if, at that time, any budgeted accounts have sufficient unexpended balances or revenue overages to transfer to cover the payment of the Merritt bill. MAYOR AND CITY COUNCIL I FROM: CLERK -ADMINISTRATOR DATE: JULY 18, 1984 SUBJECT: LOWER LEVEL CARPETING AND PAINTING FUNDS Pursuant to Council direction at the July 16 Agenda Session I discussed with Finance Director Brager the availability of funds to accomplish the painting and carpeting of City Hall lower level as well as the painting of the stairways, restrooms and foyer area. Staff has made a rough estimate that this work could cost approximately $9,000 based on the fact that the painting would have to be accomplished by a professional painter using spray equipment and epoxy paint and the carpeting would have to be of an industrial strength nature which would be able to withstand the heavy traffic and dirt levels experienced in that area. Mr. Brager has advised me that as a result of action taken by the 1984 Legislature the City of Mounds View will be receiving $9,257 in reinstated local government aids during 1984. This money is not included within the 1984 budget and, therefore, can be considered to be an unexpected revenue. Therefore, these monies would be available to fund this work effort. After the July 16 Agenda Session I requested Public Works/ Community Development Director Steve Thatcher to investigate the water problems we are currently experiencing in the lower level area and requested a report from him within two weeks suggesting any necessary corrective action or repairs. Once these corrective actions or repairs are accomplished Staff will obtain proposals from professional painting firms to accomplish the painting of the lower level and carpeting firms to carpet the lower level and put rubber treads on stairwells. Council will be approving the bids for these items as well as the color schemes being proposed by Staff. Should you have any questions regarding this matter or require any additional informa- tion, lease contact me. ,, . 13 MEMO TO: MAYOR AND CITY COJNCIL FROM: CLERK -ADMINISTRATOR DATE: JULY 19, 1984 SUBJECT: ROOFING PROPOSALS Pursuant to Council direction Staff solicited proposals from roofing companies for the repair of the Police roof and the roof over the City Council Chambers and City Hall. The Request for Proposal called for the replacement of wet or deteriorated insulation over the police Do artmentflashing and total replacement of the existing roof, repair addition of two additional scupphe ers and downspouts.is comprised The repair of the roof over the Council Chambers and City Hall of the repair of existing flashing and installation of counter - flashing. In response to the Request for Proposals the City received eight proposals ranging in price from $5,933.22 to $15,364.00. While reviewing these proposals with Building Inspector Rose to confirm their compliance with the specifications, he advised that should replacement of more than a small amount of the police Department's insulation be necessary the Uniform Building Code would require that the new insulation comply with current code. While discussing this with the two lowest bidders it was determined that the City Hall Roof could be entirely reinsulated at a very small amount thus providing for a more energy efficient roof than presently exists which is one-half inch of hardboard insulation. Therefore, Staff requested that the two lowest bidders provide a price for the installation of three inches of polystyrene insulation along with replacement of the one-half inch of hardboard insulation and additional flashing. Once these numbers were obtained it was determined that All Seasons Roofing, Inc. would be the low bidder in the amount of $8,892.00. This is in comparison to the $11,000.00 which is included in the 1984 budget for this work. RECOMMENDATION: Staff would recommend Icouncil nc. of Minneapapproval liofithe - from All Seasons Roofing Company, amount of $8,892.00 for the totn the al reconstruction and reinsulation of the Police Department Roof and repair of the Council Chamber and City Hall Roofs per their revised proposal dated July 91 1984. Staff is recommending the total reinsulation of the Police Department roof as the cost for this is $1,920 which it is felt can be recovered by the City in reduced energy costs over a very short period of time. ADMINISTRATIVE NEWSLETTER July 23, 1984 City of Mounds View VOL. IV, NO. 13 TELECOMMUNICATIONS DEVICE Staff recently became aware of a requirement of Chapter 471, Minnesota Laws of 1984, which was adopted by the 1984 Legislature requiring that cities of the first, second and third class have at least one telecommunications device available for the deaf for voter registra- tion information. Such a device, commonly known as a TTY/TDD, is being investigated with the assistance of several private organiza- tions for the hearing impaired with the goal that a purchase of this equipment be made prior to September 1, 1984. Present information on this type of equipment indicates that it will cost the City between $175 and $300 depending upon the make and model. As this item is not currently contained within the elections portion of the 1984 budget Staff will be attempting to control other election expenditures in order that it might be funded with budgeted monies rather than requiring a transfer from the City's contingency account. LOCAL GOVERNMENT AID STUDY COMMISSION As you know the 1984 Legislature established a commission made up of an equal number of members from both sides of the House and Senate to study local government aid during the interim between the 1984 and 1985 session. This commission had their first meeting on July 9 at which time they received a report from the chairman of a previous committee that studied the local government aid issue and the commission outlined in very rough form how they would like to proceed from this point forward. It was obvious from the conversations among the members of the commission that they are not all fully knowledgeable of the history of local government aid in the State of Minnesota and particularly the impacts that recent changes in the formula had upon a select number of Minnesota cities. It was heartening to hear, however, that members of the commission wanted to receive reports from interested local government organizations such as the League of Minnesota Cities and Municipal Legislative Commission to hear our side of the story. This will perhaps give us the opportunity to accurately present that information which has often been misrepre- sented in the past. Staff will continue to monitor the activities of this commission and keep Council apprised. COMMUNITY SERVICE OFFICER As you know from Police Chief Ramacher's last quarterly report, the City's CSO Officer Jill Stevens has requested an unpaid leave of absence due to health problems which prohibit her from under- taking the responsibilities of the CSO Officer until the Spring of 1985. During his quarterly report Chief Ramacher indicated ADMINISTRATIVE NEWSLETTER PAGE TWO COMMUNITY SERVICE OFFICER (continued) that he would be finding a temporary replacement for this position. Chief Ramacher has secured the services of Mick Flood, a student intern currently working with the City's Parks, Recreation and Forestry Department to act as the CSO Officer for the remainder of 1984. Mr. Flood has been on the job for approximately two weeks and appears to be doing an excellent job at this time. We hope that Ms. Stevens will be back at work in the Spring of 1985 as her skills are being sorrilymissed. (Materialrtoobeld supplied Monday.) i Oko'ifEMO TO: MAYOR AND CITY COU I' FROM: CLERK-ADMINISTRATO DATE: JULY 26, 1984 SUBJECT: METROPOLITAN TRANSIT COMMISSION PROPERTY TAX LEVY FEATHERING As you may recall Legislation adopted by the 1984 Legislature providing for the creation of a regional transit board and re- organization of the MTC included a provision establishing three levels of service provided by the MTC, defining those levels, and requiring that the levies on those cities receiving less than the full range of service be reduced by one-half to three quarters of a mil depending upon the level of service they are receiving. In my Administrative Newsletter dated June 25, 1984 I indicated that the MTC had determined which cities would be receiving property tax reductions and the City of Mounds View was obviously absent from that list. This information had been obtained by the lobbyists for the Municipal Legislative Commission prior to its being made public by the Metropolitan Transit Commission. :n response to that determination I sent a letter to Louis Olson, Chief Adminsitrator for the Metropolitan Transit Commission requesting that they advise the City of the definitions they had established for the three levels of service, a description of the exact level of service presently provided to the City of Mounds View and a statement of their reasons as to why the City of Mounds View was determined to be a full service city thus not receiving a property tax reduction. I am pleased to advise you that the City received a letter from Mr. Olson dated July 23, 1984 indicating that an error had been made in their original evaluations and that the City of Mounds View was not a full service city but rather a "full peak and limited off peak" service city which results in a reduction of the MTC property tax levy from 2 to 1.5 mils for 1985. The impact of this decision on the tax payers of the City of Mounds View will be an approximate net reduction In the amount of tax levied on City property by the MTC of $48,600.00. MEMO TO: MAYOR AND CITY COUNC FROM: CLERK -ADMINISTRATOR DATE: JULY 19, 1984 SUBJECT: SUBURBAN RATE AUTHORITY MEMBERSHIP You will note in the proposed 1985 budget that Staff recommends that the City not continue its membership in the Suburban Rate Authority beyond 1984. This recommendation is being submitted to you on the basis that membership in this organization has proved to be less than beneficial to the City of Mounds View. The basic purpose for this organization is to oversee the rate making procedures of the various utility companies within the Metropolitan Area and the Public Utilities Commission. Since joining this organization in 1982 a large number of petitions for rate changes were submitted to the Suburban Rate Authority by various utility companies, however, the participation cf the Suburban Rate Authority in the rate making process and its impact upon the results of the rate making process were less than that of other organizations active in this process due to the Suburban Rate Authority's budgetary restrictions and apparent loss of aggressiveness. An examDle of this is the last Northwestern Bell Rate Petition which was thwarted by the actions of the'Minnesota Public Interest Research Group. Staff feels that the interest of the residents of the City of Mounds View with respect to utility rates are protected by other existing private and public organizations established for purposes which allow them to intercede in utility rate cases and continuing membership in the Suburban Rate Authority would cause for the expenditure of funds which could be put to better purposes in other areas of the City's activities. RECOMMENDATION: Staff. reccinmends Council authorize the submission of a letter to the Suburban Rate Authority indicating that it is our intention to discontinue our membership with the organization at the end of calendar year 1984. A scoping document must be distributed by MAC to state agencies and interested governmental units which will include the City of Mounds View with a 30 day comment. period. This scoping document will indicate the parameters of the EIS as proposed by MAC and allows for input from interested governmental units which may include the request for the additional areas of analysis. 2) Once the analysis of all of the parameters of the EIS is completed a draft EIS will be prepared by MAC and mailed out for a 30 day review period with a public meeting held at the end of that period. 3) The final EIS is prepared after the draft EIS public meeting is held and changes and/or results of the public meeting are included with the final EIS document. Ms. Pyle has assured me that anyone can comment on the scoping of the EIS but MAC will be the final agency as the responsible governmental unit to determine the final scope of the EIS document. At this time she has indicated that discussions with MAC have resulted in the establishment of general parameters but no final scope has been established for the review and comment. It would be my suggestion that the City Council review the draft EAW submitted by MAC to the EQB which more than likely lists tho3e areas that MAC feels will be analyzed as part of the EIS. Should it be the desire of the Council to request the addition of other areas as part of our comments on the scoping document we should be preparing our request for submission to MAC vith copies to the Pollution Control Agency and EQB. This item:has been scheduled for prelinary discussions at your August 6 Agenda Session. •r • ■ MEMO TO: MAYOR AND CITY COUNCIL 1 � FROM: CLERK-ADMINISTRATO DATE: AUGUST 1, 1984 SUBJECT: STATE GAMBLING LEGISLATION Article XII of the Omnibus Tax Bill adopted by the 1984 Legislature provided for the creation of a State-wide charitable Gambling Control Board to regulate bingo, paddle wheels,tip boards, raffles and pull tabs. In short, this new Gambling Control Board will regulate all legalized forms of gambling in the State of Minnesota. Cities still retain the authority to adopt more stringent regulations on any form of legal gambling within its jurisdiction including the authority to prohibit any form of gambling. However, if an organization has a State license, it need not comply with local license or permit requirements. Cities may also disapprove the granting of State licenses by passing a resolution and giving notice to the State Board of their desire to do so. The only exemptions from State licensing requirements that would apply to the City of Mounds view are for bingo events at a civic celebration if not for more than 12 consecutive days in a calendar year or by an organization which conducts four or fewer bingo occasions in a calendar year; or raffles if the value of all raffle prizes the organization awards in a calendar year does not exceed $750; or raffles an organization conducts which, directly or under contract to the State or political subdivision, delivers health or social services and is a non-profit organization but only if the prizes are not real or personal property that an individual, firm, or other organization donates. All other gambling activity must receive a State license. The Legislation further provides that all local licenses will expire on February 28, 1985 with the Gambling Control Board beginning licensing March 1 of 1985. police Chief Ramacher and I have discussed the new gambling law in great detail and would recommend that it would be advisable for the City Council to repeal Municipal Code Chapter 107 entitled, "Bingo, Raffles, and Gambling Devices" effective February 28, 1985 and allow the State to regulate legal forms of gambling within the City of Mounds view. This recommendation is being offered on the basis that it would remove the City of Mounds View from an issue which has become both political and controveroial in nature and is extremely difficult for Staff to enforce without placing ourselves in a position of conflict with charitable organizations in the community. MAYOR AND CITY COUNCIL PAGE TWO V Article III of the Supplemental Appropriations Bill also adopted by the 1984 Legislature provides for the licensing of video gambling devices by the State Department of Public Safety. Chapter 114 of the City's Municipal Code entitled, "Mechanical Amusement Devices and Amusement Centers" allows "... devices, machines, or games which may be played solely for amusement and not as a gambling device...." thus, the City of Mounds View prohibits the operation of video gambling devices within the City which is clearly within our legal authority and should it be the desire of the City Council to continue to do so no modification to Chapter 114 would be necessary. RECOMMENDATION: Staff would recommend Council adopt an Ordinance rescinding Chapter 107 of the Municipal C-)de effective February 28, 1985 and not revise Chapter 114 of the Municipal Code as it currently prohibits video gambling devices within the City. 1 I MEMO TO: Clerk -Administrator and City Council 1 1�(�((�(� FROM: Director of Public Works/Community Development ,yf�.� DATE: July 30, 1984~ SUBJECT: PINECREST PROPERTIES DEVELOPMENT The City has received two letters on the subject project. Enclosed please find a copy of the Minnesota Department of Transportation letter dated July 18, 1984, a letter from Short -Elliott -Hendrickson, Inc. dated July 19, 1984, a proposed resolution and my letters to Bob Waste and Ervin Herbst, Sr. dated June 11, 1984. Staff has held meetings with the Minnesota Department of Transportation and has carefully reviewed the July 18, 1984 MnDOT letter. We recommend that the City adopt this resolution and submit a copy to the Minnesota Department of Transportation. The second item is a letter from Beim Construction Company. Enclosed please find a letter from Beim Construction Company dated July 24, 1984. staff has numbered the issues in the letter / from one to five. I will present staff's comments on each issue. 1. Staff agrees with this proposal provided the contractor seeds the berm and provides proper erosion controls and agrees to cleaning the culvert between County Road H-2 and Lambert Park just east of Jackson Drive if the culvert is sediment laden in the spring. 2. Staff recommends denying this request because City Resolution No. 1765 states that the security in the amount of five years payment of assessments on the entire project should be received prior to ordering and awarding the project for construction. 3. Staff recommends denial of this request. If no park dedication fee was previously paid, they are obligated tc, current code and not past agreements that they did not fulfill. Any lot splits shall be delt with on a case by case basis. 4. Staff concurs with this item. 5. The berm was proposed by your people in conjunction with the City and is necessary for the project. RECOMMENDATIONS: Staff recommends that the City take the above positions on the subject project. This highway presently carries high volumes of traffic with a mix of through traffic and local alignment in Blaine between Interstate 35-W and T.H. 47. Existing T.H. 10 in Mounds View will still carry a high volume of traffic, but the composition will be primarily local traffic; and WHEREAS, the City has reviewed traffic impacts of development and redevelopment of property along existing T.H. 10. Recognizing that even when through traffic is relocated to new T.H. 10, old T.H. 10 access should be controlled to provide for safe and efficient operation of vehicles along the roadway; and WHEREAS, the City has recently approved rezoning and a concept design for Pinscrest Properties and has limited their access to two locations; NOW, THEREFORE, BE IT RESOLVED that the developer will be required to deed access control at all but these two locations to the City. In cooperation with Mn/DOT, the City, through the Developer, will have a full median cross -over installed on T.H. 10 at Woodale Drive and a right -in and right -out driveway arrangement at Raymond Avenue; BE IT FURTHER RESOLVED that the City wishes to continue to restrict access to T.H. 10 wherever practicable. Tom Granroth, 8415 Greenwood Drive, stated his neighbor has a bug zapper in his yard which he feels is as loud as a plane flyingoverhead. The neighbor has offered to sell it for 200, but Mr. Granroth stated he does not wish to buy it, and asked if the City could control the use. Attorney Meyers advised that in reviewing the City ordinance and State statutues regarding public nuisances, he feels it would be difficult to surpress this as a public nuisance, unless there was some clear definition of bug zappers. He stated the Council could set time guidelines in an ordinance, and regulate noise levels. Mayor McCarty stated that the bug season would be long over in the time it would take to proceed with any action. He suggested Mr. Granroth may want to take civil action. He also suggested Staff could research the matter. Mayor McCarty stated he personally would want to publish any ordinance change in the paper and get feedback from the residents before acting on the ordinance. John Winiecki, 7575 Groveland, advised the southwest corner of Groveland and County Road I is overgrown with lilac bushes and presents a hazard with cars trying to pull out into the intersection. Margaret Ihde stated she did not feel the gate would stop theft, and two exits are needed for emergencies, and would even out the traffic,. Mark Mack, 4068 Glenhaven Lane, slated he lives around the corner from the gate and feels it should be open, as they cannot get school bus service there now. He stated he does not feel the theft situation would change, and requested everyone keep safety in mind. Mounds View City Council July 23, 1984 Regular Meeting Page Six --------------------------------------------------------------------- Deliah Hopp, 4054 Glenhaven, stated that with the gate closed, the children climb the fence and go through her back yard, and she has had problems with the damage they do. Leslie Adams, 4061 Glenhaven Lane, stated she is not on the petition but is in favor of having the gate open, for emergency situations. Jim Herman, 2125 Belie Lane, stated he lives right outside the gate, and is against opening it up. He stated he gets a lot of walking traffic through his yard from the trailer court, and has had a lot of damage to his lawn. If the gate were opened up, there would be a good deal of work that would have to be done. He added that he moved to that particular residential street because it was not busy, and would be safe for his family. He also pointed out the exit does not line up with Belle Lane, and it would be a blind corner, with no street light, or stop sign. Nancy Herman, 2125 Belle Lane, stated she is against the gate being opened, and already has too much traffic going through her yard, and the kids have destroyed her lawn and garden. She pointed out the visibility is not good around the curve, to have an intersection there. Jackie Rolff, 2150 Belle Lane, stated there are 15 houses on her block, and she does not want the 1450 oars per day driving down their street. She added she could agree to a small walk-through for the children. Tom Thomson stated he lives on the corner of Bronson and Raymond, and does not want the extra traffic. He pointed out the street was not designed to be an access area to the trailer court, and he has small children, and feels it would be very dangerous to have the added traffic on their street. He stated he could agree to a walk-thru for the children. Doris Brown, 2139 Belle Lane, stated she was opposed to opening the gate. Reinhardt Johnson, 2142 Belle Lane, stated he had lived in his home for 33 years and was opposed Co opening the gate. Mrs. Cunningham, 2150 Belle Lane, stated she was opposedto opening the gate, as there is too much traffic going too fast already, and there have been problems in the past when the gate was opened. Lyle Elm, 2139 Belle Lane, stated he has lived there since 1951, and it has been a peaceful neighborhood, When the trailer park was installed, the City did not permit access at that time because it was a bad location, and it still is a bad location for an intersection, as it is very dangerous. Delores Peterson, 2133 Belle Lane, stated she was opposed to opening the gate, as there were many problems when it was open last winter, and there is too much traffic which goes too fast. She also pointed out there is vacant land across the street from the main access to the trailer park. Aldon Johnson, owner of the trailer park, stated that when he built the park, he requested the second exit and was turned down by the City, and told where to put the entrance. After the park filled up, there were so many complaints from homeowners regarding children going through their yards, that the gate and fence were put in. Then, after the tornado, the trailer park residents started to complain, he met with the City and was instructed on how to put in the emergency entrance and breakaway gate. He later changed the gate to allow children to get through. He added he feels the access available now through the main entrance is good. Mr. Johnsen stated he has discussed the options avail- able with Director Thatcher, and he feels they cannot satisfy everyone. The most important thing is that emergency vehicles can get through, which they can now. Laura Larson, manager of the park, stated that the Fire Department and Police Department have keys for the gate, Mr. Johnson added he will install whatever the Police and Fire Departments want him to have there. Mayor McCarty replied Staff will check with the Police and Fire Departments to see if they have any problems, Councilmember Hankner asked if anyone has approached the School District to get an access opened at the north end. Mr. Johnson replied that it is private property back there. Mayor McCarty asked what the estimates are to open the Kgate and road. Director Thatcher replied between 000 and $10,000. Mr. Johnson added he has already Put $5,000 into that opening, : Mounds View City Council Regular Meeting ------------------------ Mayor McCarty stated he was not in favor of opening the access up, primarily because of the cost, which would be assessed to the owner, and he has already stated he is against it, and because the residents knew what the situation was when they moved there, and because the engineer has recommended against it. Councilmember Hankner stated she could see both sides. She recommended approaching the School District to see what could be resolved. She also pointed out that in 1981 a great number of budget cuts took place, which is why the bus service may have been eliminated. She stated she is opposed to the entrance at this time because of the location on the curve, the lack of lighting, and so forth. Councilmember Linke stated he concurred with Mayor McCarty, and that while he could sympathize with the park residents, he was not in favor of opening up the access. Councilmember Blanchard stated she concurred with Mayor McCarty also, and she feels that the emergency gate the park presently has is sufficient. Mayor McCarty summarized that at this time the Council has decided against permanently opening the entrance, but they will check on the situation with the children and their route to school. Director Thatcher gave his second quarter report for the Public Works/Community Development departments, bringing the Council up to date on the work they've been doing. Motion/Second: Doty/Blanchard to approve the June 73, 9 minutes as corrected. 5 ayes 0 nays Jim Miller requested the Council grant a 90 day extension for the time limit for submitting the final plat on his property. He explained they have been working continuously on the project, but in meeting with Staff and the Council. on several items, there are still some unresolved issued, such as the wetlands issue. He stated they were given a 90 day extension on April 9, and are requesting this second extension to get everything together. Ile also rioted that Staff has advised him they are looking at proposed revisions to the wetlands ordinance. Mayor McCarty questioned what granting another extension would do to the integrity of the ordinance if they extend the time frame. Attorney Meyers advised it is not so much a legal question as it is a political one. He stated the Council could grant an extension if they feel there is a good reason for one, or if the applicant can prove the delay was caused by circumstances beyond his control. 2. Motion/Second: McCarty/Blanchard to direct Staff to post proposed rezoning notices on City property in the future. 5 ayes 0 nays There was discussion on the motion before the vote was taken. Attorney Meyers advised that the City had done that at one time, many years ago. Councilmember Linke questioned where the funds would come from to pay for the signs. Councilmember Hankner stated she felt the issue should be researched first, and then a motion made, once the cost was known, and the source of the funds. Councilmember Doty stated the funds could come from the contingency fund. Mayor McCarty closed the regular meeting and opened the first public hearing at 7:50 PM. Clerk/Administrator Pauley advised this was a continued hearing from the one that was held in May. He reported the Planning Commission had held an informational meeting with the residents, and has made the recommendation to the Council that the area in question not be rezoned but left as is. He added that Harstad and Todd had appeared at City Hall and applied for a building permit for 6 unit townhouses, but they were advised that building permits would not be issued at this time, as fees could not be calculated, and they must go through a development review with the Planning Commission and City Council, as well as the land in question being involved with the wetland ordinance and floodplain ordinance. Staff also advised Mr. Harstad that he would have to file an application with the City for a conditional use permit, as well as wetlands and floodplain permits. Motion Carried Motion Carried 6A. Public Hearing - Rezoning of Red Oak Estates No. Mounds View City Council July 9, 1984 Regular Meeting Page Three -------------------------------------------------------------------- ` Mike Barner, 2609 Clearview, stated he is in agree- ment with the Planning Commission's recommendation to leave the zoning as is. He stated his property is across the street from the property in question, and he did not receive a notice of the hearing, and many of his neighbors did not receive one either. He explained he has lived in his home since 1976, and purchased it because it was in a single family area, with very light traffic. Mr. Barner stated there are a substantial number of children in the neighborhood now, and he would not want to see an increase in traffic. He also questioned how the 6 plex was allowed in the first place. Mayor McCarty explained the existing 6 plex was built in 1974, on the basis that no further permits would be issued until the drainage issue was taken care of. Attorney Meyers explained the history of the property, and how the City had been taken to court, and the court's decision on the property. He stated that the proposal this evening is to bring the zoning into conformance with the comprehensive plan, and if the Council does not rezone the property, they should amend the comprehensive plan to go back to low density. Elaine Shephard, 2658 County Road H2, stated she lives in one of the townhouse units, and questioned if the zoning were approved, if she would then become an R-3. She added she does not want to be R-3, and has had many problems since she purchased her townhome. Mayor McCarty explained the comprehensive plan for that area for District 9 is low density, which would be R-1 or R-2. Mayor McCarty also explained a memo from Staff from February 1984 had laid out the criteria that would be used in rezoning property and bringing it into con- formance with the comprehensive plan. -' Ken Briggs stated he was a representative of Mr. Harstad and Mr. Todd, and asked why they were never notified in advance that the property was being discussed for rezoning. He stated they have not had time to prepare themselves to address the Council or residents about the proposed re- zoning, and asked that it be referred back to the Planning Commission so they would have a chance to meet with them and discuss it. Clerk/Administrator Pauley explained that notice was published in the New Brighton Bulletin, and they followed the letter of the law in providing notification. Mounds View City Council Regular Fleeting Councilmember Doty stated that the issue of the rezoning appears to be an error on the part of the Planning Commission, in bringing it forward at all, and it should be left R-1. Attorney Meyers advised that under R-3, a conditional use permit could allow townhouses up to 6 units, which is the issue the Planning Commission is addressing. He also explained that for a comprehensive rezoning, official notification is by the newspaper. Councilmember Hankner asked that Staff research the problem of notices not being received by everyone for hearings such as this, as the problem has occurred before. Mayor McCarty stated the Council is sensitive to the issue now, and will address it further. Attorney Meyers noted the residents had relied on the fact that the development was R-1 to the north of them, and there could be a depreciation in the value of their homes if the property was rezoned, and health, safety and welfare must be considered, along with the drainage concerns. Steve Miller stated he had spoken with two realtors, and was told he could expect a 10-15% loss in the value of his home if the land was rezoned. Dave Thisle stated there is a water problem already, which R-3 development would compound. Gary Cox stated he was concerned with the appearance of the neighborhood, as he lives directly next to the existing townhouse units, and he did not want to be sandwiched in between multiple units. Mayor McCarty noted that if the property were rezoned to R-3, a conditional use permit would be needed for a townhouse development, and this particular develop- ment did not meet all the criteria necessary. He reported all depart- ments are within budget so far for the year, and the expected revenues have been realized. He also report- ed the Finance Department will be assisting in the elections in the Fall. Mounds View City Council July 9, 1984 Regular Meeting Page Eight -------------------------------------------------------------------- Park Director Anderson reported they have experienced the largest summer recreation program in the past six years, as well as the Festival in the Park being very successful, with preliminary indications being that they will come in under budget, as well as generate income. Park Director Anderson reported he will be presenting an in-depth report on the aquatics program within the next few weeks, and he stated it is going very well. He also reported the healthy people program is going very well, and they have had two health fairs, attended by approximately 800 people. Park Director Anderson reported they have submitted a preliminary grant for Greenfield Park, and he will keep the Council up to date on that progress. He reported the new tot lot equipment has arrived and will be installed within the next two weeks. Park Director Anderson reported they have had juris- diction over the park maintenance people for the past ten weeks, and have gone to double shifts, which has worked well. The winter injury has claimed about 160 trees in just the past three weeks. Park Director Anderson also reported they have been talking with the School Board regarding the Red Oak School property, and will keep the Council advised. Police Chief Ramacher reviewed the training sessions he and the officers have attended, and reviewed the illness problems they have experienced in the past few months. He reported the Community Services Officer is out on a leave of absense until the first of the year. Police Chief Ramacher reported the system of rotating investigators is nearly complete. In comparing the first six months of 1984 to 1983, the crime rate has dropped slightly, and 20% more traffic citations have been issued, and 30% more arrests have been made, with a 10% increase in calls, while having one less officer than last year. Councilmember Hankner commented she liked the report the Council had received earlier from Police Chief Ramacher. She also asked that Staff look into publishing police calla in the newspaper. Councilmember Doty asked that Long Lake Road and County Road J be checked for speeders. Police Chief Ramacyer replied Long Lake Road has always been a problem, and he feels the solution is a 4-way stop sign, and radar would not solve the problem. Councilmember Doty asked that the Grant Merritt bill be on the agenda for the next meeting. Councilmember Hankner stated she felt an amendment to the intoxicating liquor ordinance would be very beneficial to the City. Councilmember Hankner reported she had spoken with Jan Quick, and the preliminary figures from the Festival in the Park look like they did make some money. The Commission will be meeting July 10 to review the figures. Councilmember Hanker stated she felt the Festival Commission members should be recognized individually for the hard work they did. Respectfully, THE RESIDENTS OF MOUNDS VIEW MOBILE HOME PARK 4 MAYOR AND CITY COUNCIL: We, the Residents of Mounds View Mobile Home Park ("Residents") hereby petition the City of Mounds View ("City") for the permanent opening of the access road to the Mounds View Mobile Home Park ("Park") at the corner of Belle Lane and Raymond Avenue ("Entrance"). It is our understanding that the complaint which necessitated the closing of the Entrance atoms from an increase in traffic on Belle Lane and Raymond Avenue. We fail to understand why we, as Minnesota taxpayers, would be denied access to a public road. Because the traffic backs up on 35W, would we also be denied aoo6sa to it? Do one or more individuals living on either side of a roadway have any interest in it? We feel part of the problem involved here is the fact that we are mobile home owners -- not real home owners. Possibly some individuals mistakenly believe that we do not pay property taxes. Besides the property taxes we pay on our mobile homes, we also pay a proportionate share of property taxes through our rental of our lot from the Park. Indeed, those individuals living on Belle Lane and Raymond Avenue probably pay less than the combined property taxes of the 153 Residents of the Park. It is our belief that we should not be discriminated against as to the use of Belle Lane and Raymond Avenue. The Residents state the following additional reasons: 1. At present, there is one entrance/exit to the approximately 10 acre Park housing 153 mobile homes. 2. Fire emergencies have a high priority to mobile home owners. The estimat.d 15 minutes in which a mobile home can burn makes access to the mobile home very important. Emergency vehicles often block the one exit which means the other Residents are trapped in the Park. 3. Minnesota summer storms can come up very rapidly. When these storms occur, most Residents leave their homes. In a weather emergency, there is the possibility again that the one exit would be blocked -- either by traffic, an overturned home, debris, etc. 4. Our elementary children are not provided bus service and utilize the Entrance to go to and from school. With backpacks and/or band instruments it is very difficult to squeeze through the Entrance. 5. Also individuals walking to bus stops, attending neighborhood functions, shopping at neighborhood stores, etc. are greatly inconvenienced by the closing of this Entrance.
