In the case of 1985 this is a 4 percent increase. Attached for your review is a copy of the 1985 Salary Structure which we would ask that you adopt at your February 11 meeting. RECOMMENDATION: Council adopt Salary Structures for office, supervisory, administrative and management positions for the City's non -Union employees dated February 1985. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Mounds View opposes the permanent establish- ment of IRS regulations establishing a separate Safe Harbor Rule for commuting vehicles under the control of state and local units of government. FROM: CLERK-ADMINISTRAT' DATE: JANUARY 29, 1985 U SUBJECT: IRS REGULATIONS REGARDING TAKE HOME VEHICLES The Internal Revenue Service has recently promulgated temporary regulations on how to calculate income tax liability on certain fringe bwwtits such as the personal use of municipal vehicles including police cruisers and other types of autos. Staff is presenting this issue to you for two reasons. The first is that at the current time Police Chief Ramacher takes home the unmarked investigators car for two reasons. The first being we currently do not have enough garage space for safe storage of our police vehicles and secondly, Chief Ramacher finds himself on an extremely frequent basis having to respond to incidents which, if he did not have a vehicle at his immediate disposal, would require that he come to the City offices and obtain a car prior to appearing at the scene which would delay his response to incidents significantly. The second reason for presenting this issue to you is the simple fact that Staff, particularly the Police officers in the City of Mounds View, feel that these new regulations will have a significant negative impact upon the ability of various law enforcement agencies within the State of Minnesota and the Nation as a whole on their ability to provide adequate law enforcement services to the public. The reason we are saying this is that the new regulations would provide that wherever a Police Officer is entitled to take home a car, but are not permitted to use it for personal reasons, and if the situation occurs at least 15 days each year then a benefit of $4.00 per day to the employee is imputed by the IRS. Various members of the City Staff are currently aware of the fact that• there are several smaller law enforcement agencies in smaller outstate cities having minimal storage facilities or such a small staff that each officer is on duty on an around -the -clock basis. This regulation would impair these cities' ability to provide adequate law enforcement. Also, as some of you may know the State Patrol allows their officers to take their patrol vehicles home rather than having them commute back and forth to central garage facilities which would inhibit their being able to provide a full eight• hour shift and cost the State sianificantly in having to provide additional facilities. As you may note from the attachments to this memorandum, several organizations including the National League of Cities, Governmunt Finance Officers Association, and International City Management Association are examining these new regulations with the intent of taking an official position with regard to these regulations. TWO Staff feels strongly enough about this issue that they would suggest that the City Council authorize the preparation of a Resolution for submission to the Internal Revenue Service and our Federal Legislators indicating to them our strongest objections regarding these regulations on the basis that it would inhibit the abilty of various governmental agencies to provide adequate law enforcement services in their jurisdictions. CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION AUTHORIZING THE CITY TO MAKE APPLICATION FOR CONVEYANCE OF SAID TAX FORFEITED LAND FOR ROAD AND UTILITY PURPOSES (CODE NUMBER 59-00600-100-30) WHEREAS, the Board of County Commissioners of Ramsey County by Resolution dated October 10, 1975, classified as non -conservation land, certain land lying within the limits of the City of Mounds View; and WHEREAS, a copy of the classifiction together with a list of the land classified has been submited for approval of the classification in accordance with Minnesota Statutes Annotated, Section 282.01, Subd. 1; and WHEREAS, the following land is tax forfeited land: East 25 feet of the West 2112 feet of the North 202-5/10 feet of the South 1012-5/10 feet of the Northeast 1/4, subject to road, in Section 6, Township 30, Range 23 (Code No. 59-00600-100-30); and WHEREAS, the City of Mounds View has determined that said land is required for road and utility purposes; NOW, THERFORE, BE IT RESOLVED that said classification of land shown on said list as non -conservation land is hereby approved; BE IT FURTHER RESOLVED that the proper City officials are hereby authorized to make applicationfor conveyance of said tax forfeited land for road and utility purposes; BE IT FINALLY RESOLVED that the City Clerk -Administrator is hereby authorized to file a certified copy of this resolution and application for conveyance of said tax forfeited land in the Office of th9 Land Commissioner. FROM: CLERK -ADMINISTRATOR, DATE: FEBRUARY 7, 1985 SUBJECT: LABOR AGREEMENT WITH LOCAL No. 49 The City has been advised by the Metropolitan Area Manage- ment Association that a settlement has been reached with I.U.O.E. Local No. 49 for a Master Labor Agreement for calendar years 1985-86. This agreement calls for the following: 1. A two year agreement for 1985 and 1986 with a reopener in the contract in 1986 for wages and insurance contributions only. 2. Wage increases for the three maintenance classifications of, Maintenance Worker I - 4.9 percent, Maintenance Worker II - 5.0 percent, Maintenance Worker III - 4.8 per- cent. ' 3. Increase in the monthly contribution for insurance to $155.00 per month. All of these items are consistent with the City's 1985 budget and Staff would recommend their approval. MEMO TO: MAYOR AND CITY COUNCIL FROM: CLERK -ADMINISTRATOR DATE: FEBRUARY 8, 1985 SUBJECT: STATE GAMBLING LEGISLATION Attached to this memorandum please find a memo I provided to the Mayor and City Council on August 1, 1984 regarding the referenced subject matter indicating that on February 28, 1985 the State Charitable Gambling Control Board will take over the control of the licensing of gambling within the State except when municipalities have adopted more restrictive legislation. Action was not taken on this item at that time due to the concern of the Council regarding the adoption of an ordinance in advance of the effective date of the Law. Staff has reviewed the matter for a second time and determined that we wish to abide by our recommendation contained in the August 1 memo with the addition of the following. It is our understanding the State will be requiring that local jurisdictions sign off on applications indicating their approval of the issuance of a license by the State should the State determine that a license is proper or the local units disapproval of the application which the State will honor. Based on recent correspondence from the League of Cities, copy attached, the Council must adopt a resolution recommending denial of an application. It is Staff's recommendatiun that the Police Chief be given the authority tc review applications and determine whether or not the applicant is acceptable. If the Chief determines that it is his desire that the application be denied, the policy would be that he would submit his recommendation to the City Council at their next meeting for Council concurrence by resolution with this recommendation. RECOMMENDATION: Staff would recommend Council adopt an ordinance rescinding Chapter 107 of the Municipal Code and authorize the Chief of Police to review and comment on applications for State Gambling Licenses with the require- ment that the Chief make recommendation to the City Council for rejection of any applications. The rules require the following actions at the local level: 1. Applicant delivers a copy of the license application to the city clerk. The application includes a notice that the gambling license, if approved by the Board, will become effective within. 30 'days unless disapproved by the city council. 2. The concern that an employee recently transferred to a higher grade within the City might be layed off as a result of the provision that• layoffs are made on the basis of seniority when all other job relevant qualifications are equal is a valid concern, particularly when the employee might be a senior employee within the organization and more senior than other individuals in the grade the employee recently transferred out of. Staff would suggest the inclusion of additional language in this section of the code that would allow a senior employee to "bump" a less senior employee from other positions within the City for which they are qualified. I am aware that this is the policy of many private industries in the Metropolitan Area such as Medtronic, Inc. with which I am familiar due to my wife's employment there. If it is the desire of the Council to include such language I will undertake whatever efforts nece sary to obtain the appropriate language for this section per your direction. Wtih respect to Section 6.13 regarding layoffs I would like to suggest that the following language be used to replace that currently within the code and to clarify that which I originally recommended. The new language would be, After consultation with the Mayor, the Clerk - Administrator may suspend any employee without pay for disciplinary reasons for a period not to exceed five working days. Said suspension must be affirmed by resolution of the City Council no later than seven calendar days after the suspen- sion is ordered. The cumulative total of all suspensions for any one employee shall not exceed thirty working days during any one calendar year. Your direction would be appreciated in this matter. This is an increase of 4.094 mills over the 1984 levy of 95.071 mills. On a percentage basis it is an increase of 4.31%. The levy is detailed below. Schools 50.089 County 29.273 City 13.933 Miscellaneous 5.870 Total Levy 99.165 Ramsey County's 1985 levy of 29.273 mills is an increase of 2.130 mills over its 1984 levy of 27.143 mills. The County's mill rate increased 7.85% in 1985. The Schools levy consists of the levies of Mounds View District 621 and Special Intermediate (Vocational) School District 916. The over- all school levy increased 4.30% over 1984. The Mounds View Schools levy increased 4.06%. The 1985 levy of 48.616 mills is an increase of 1.897 mills over its 1984 levy of 46.719 mills. The City's property tax levy increase of 3.00% is a smaller increase than that of the County (7.85%) or the Mounds View School District (4.308). Our 1985 levy of 13.933 mills is an increase of 0.406 mills over our 1984 levy of 13.527 mills. Of each tax dollar paid by Mounds View residents approximately 14 cents is received by the City. The remainder i, paid to other taxing juris- dictions. Each taxing jurisdiction receives the following share of the tax dollar: Schools $0.5051 County 0.2952 City of Mounds View 0.1405 Miscellaneous 0.0592 The 1985 Miscellaneous levy for Mounds View is 5.870 mills; a decrease of 0.505 mills from the 1984 levy of 6.375 mills. Her three month review was completed on February 13, 1985 and the department has been very pleased with her performance. Therefore, I recommend that her hourly wage be increased from its present rate of $5.50 to $5.75 effective February 6, 1985. The position was budgeted at a rate of $6.00 per hour, therefore this increase will keep the position's costs within budgeted amounts. BACKGROUND The 1985 budget includes inspection and repair of the subject well, pump and motor.. Well #4 has not been used since 1979 because of high sand content and odor problems. The odors are probably caused by dying iron and/or sulfer bacteria. This bacteria releases a gas when killed by the injection of chlorine at the well house. The gas remains in the water until released at a water tower or house water faucet. Electrical, control, chlorine and fluoride equipment have been salvaged for use at other wells. Replacement equipment must be installed for the well to operate. In 1979, the water had an iron content of 0.49 milligrams per liter (mg/L) and a manganese content of 0.03 mg/L. The Minnesota Department of Health's recommended limits are 0.3 mg/L and 0.05 mg/L, respectively. (Attachment #1 is the 1979 water quality report.) The well should be bailed to reduce the sand content of the well water. The hailing procedure removes excess sand from the bottom of the well. In the past, The City has not restricted summer lawn sprinkling because water supply has always exceeded water demand. During the dry summer of 1976, the City almost had to restrict lawn sprinkling. Since then, summer water demand has been low due to sufficient rainfall. If a future summer is very dry, the City may need to pump all the wells in order to meet the water demand. Therefore, solving the problems at Well #4 will reduce the probability of water shortages. II. ALTERNATIVES The following alternatives are possible solutions to water supply problems in Mounds view: 1. Do nothing and hope the water supply is adequate in future summers. 2. Correct the problems at Well #4 and if the problems cannot be corrected, construct a water treatment plant at Well #4. Clerk -Administrator and City Council February 14, 1985 Page Two of Three 3. Drill a new well and hope the water quality is better than Well #4. 4. Connect to the City of St. Paul's raw water mains and construct water treatment plant. 5. Restrict summer lawn sprinkling and encourage water. conservation. 6. Connect to neighboring Cities' watermains and purchase their water. Alternative #2 and #5 are the most feasible solutions. This report will discuss Alternate #2 and will not analyze Alternative #5. M. WORK PLAN The following plan is proposed so that Well #4 can be utilized: 1. Replace air release valve, electrical equipment, chlorine equipment, fluoride equipment and control parts. 2. Pump stagnant well water to waste and chlorinate well. 3. Test water for iron and manganese. 4. Conduct maintenance work on water meter. 5. Well, pump and motor maintenance: a) Pull pump and motor and make necessary repairs. b) Televise well. c) Bail sand from well as needed. d) Physically clean iron/sulfer bacteria from well casing (if needed.). e) Televise well to verify quality of physical cleaning if needed. f) Conduct pressure test on well casing (if needed.) g) Install pump and motor. 6. Chlorinate well water and pump to waste. 7. Conduct complete water quality analysis. 8. If water quality, odor and sand content are within acceptable limits, pump well water into distribution system (while chlorinating the well and pumping to waste frequently). ESTIMATED COSTS AND OUOTES 1. Estimated well pump and motor maintenance cost = S16,800 2. Electrical work: a) Estimated control system replacement cost = $ 800 b) Electrical replacement Ouote = $3,225 (Attachment #2 is a copy of the quote from Bacon Electric). 3. Chlorine and fluoride equipment Ouote = $2,060 replacement (Attachment #3 is a quote from Vessco) 4. Estimated water testing costs = $ 600 5. Estimated chlorine (HTH brand) costs = $ 500 6. Estimated flow meter maintenance cost = $ 800 7. Estimated air release valve and piping = S 350 replacement cost 8. Contingency = $2,500 Estimated Well #4 Project Cost $27,635 Use $28,000 A second quote for electrical replacement was received from Gopher Electric in the amount of $4,786.00. (Attachment #4 is a copy of the quote.) A second quote for chlorine and fluoride equipment replacement was received from Water Co., Inc, in the amount of $2,220.00. (Attachment #5 is a copy of the quote.) VI. RECOMMENDATIONS I recommend awarding the electrical replacement work to Bacon Electric for $3,225.00, and awarding the chlorine and fluoride equipment replacement work to Vessco for $2,060.00. I recommend directing staff to advertise for bids on the well pump and motor maintenance work and authorize staff to proceed with the project as outlined in this memo.
