Councilmember Hankner questioned the payment to John
Johnson under item F, stating that she had understood
the contract was completed some time ago. She also
questioned other items for payment on the print-out
and stated it would be helpful if the Council could
get a breakdown of the accounts receiveable.

Clerk/AdministratoT Pauley stated he would have to
check into the specifics of the payment to John
Johnson but it was most likely, the MSA 1985 storm
sewer study or the Pinecrest development that Mr,
Johnson had worked on, He added that Mr. Johnson
would now be on an hourly basis for any further
work. He also explained the payment to Short -
El l.iott-Hendrickson was being made after being
reimbursed by the developer, and the City was
merely forwarding payment on. He added the
Mermaid payment was most likely in conjunction with
the winter carnival events that had taken place
there, but he would check for specific details,

size, they are having problems with planning the
1985 Festival in the Park. She explained that
due to lack of people to help, they were not planning
on having the church service this year, and due to
problems in not being able to get back information
from former commission members on past years
activities, they were not able to organize a
parade. She requested that the City intervene and
send a letter to the former Festivities Commission
members, asking them to return the paperwork and
information they have.

Mayor Linke asked Council approval in appointing
Judy Rowley and Robyn Zollner to fill the vacancies
on the Planning C^mmission.
Motion/Second: Linke/Blanchard to appoint Judy
Rowley and Robyn Zollner to the Planning Commission
immediately.

Mayor Linke reported the Ramsey County League of
Local Governments would be sponsoring a meeting for
newly elected officials at the Roseville Holiday Inn
at 8:30 AM on Saturday, March 16. lie stated he
planned on attending and would contact the winner of
the March 12 special election to invite them also.
Mayor Linke reported the entire Council had attended
the airport hearing in Blaine last week, and reviewed
what occurred. He stated it was the concensus of
those present that the EIS and scoping documents were
inadequate.
Clerk/Administrator Pauley reported he had spoken
with Sandra Gardebring of the Met Council and she
had reviewed the documents available on the airport
He added the PCA will also be submitting comments,
and they will be doing new noise level readings in
Mounds View in the spring and summer.
Clerk/Administrator Pauley updated the Council on
plans for the special election and asked that they
be present to witness the counting of the ballots.
He explained that if the State approves the use of
the machine which counts the ballots, it would be
presented for purchase in the 1986 budget, at a cost
of $13,000.00.
Clerk/Administrator Pauley reported they will meet
at 9:30 PM on March 12 to certify the election, and
if the results are not contested, the newly elected
member will be sworn in on March 25. He also advised
that the March 25 meeting will be broadcast live over
cable.

has approached the cities of Mounds View and Spring Lake
Park in an attempt to realign and place traffic control
lights at the intersection of Pleasant View Drive and
Highway 10. Before undertaking this project the Minnesota
Department of Transportation would like to receive the
approval of both cities. The City of Spring Lake Park
forwarded its approval in the Spring of 1984, however, the
City of Mounds View has not taken any action on this item.

SUBJECT: NORTH SUBURBAN CABLE COMMISSION REQUEST FOR 1985
BUDGET CONTRIBUTIONS
Attached please find a memorandum from North Suburban Cable
Commission Chairperson Steve Schmidt and Legal Counsel Tom
Creighton outlining a request from the North Suburban Cable
Commission for a contribution from the City of Mounds View
in the amount of $13,941.90 to fund a portion of the
Commission's 1985 operations until such time as the
Franchise Amendment Agreement No. 1 is entered into by all
cities and the $150,000 indemnification from Group W Cable
is paid to the Commission. At that time the contribution
being requested would be repaid to the City of Mounds View
in full.
Should you have any requests on this item, please contact
me.
RECOMMENDATION: NDATION: Staff would recommend Council authorization
of an advance to the North Suburban Cable Commission in the
amount of $13,941.90 per their memorandum dated March 8,
1985.

RE: 1985 Budget Contributions of Each City
The Chair of the North Suburban Cable Commission has
requested that I communicate with each of you regarding
the 1985 city contributions to the Commission budget. As
you recall, the 1985 budget for the North Suburban Cable
Communications Commission was submitted to you in the fall
of 1984. In that transmittal the procedures of the Joint
Powers Agreement were explained that if a city did not
withdraw from the Cable Commission by the end of 1984,
the budget would be deemed to be approved. Some cities
affirmatively approved the budget, others chose to proceed
undar the Joint Powers Agreement's passive approval prc-
cess. At any rate the budget has been approved by all ten
cities.
The budget of the Commission has been funded in the
past by contributions from each city based on their number
of votes on the Cable Commission. After the city money
has been transmitted to the Cable Commission, it in
recovered from Group W as an advance on the franchise
J

fees. However., as a result of the pending Amendment Agree-
ment No. 1 with Group W Cable, the Cable Commission had
decided up to this point not to request contributions from
each member city. Amendment Agreement No. 1 includes a
$150,000 indemnification payment from Group W Cable which
would not be an advance on franchise fees and which would
more than fund the Commission for 1985. However, the City
of Mounds View has encountered, through no fault of its
own, a problem with its Charter in its adoption of Amend-
ment Agreement No. 1. That problem has been resolved and
Mounds View is expected to proceed now with the adoption
of Amendment Agreement No. 1.
Although the Commission has no reason to believe that
Group W will not sign Amendment Agreement No. 1, or that
Mounds View will not adopt it, cash flow concerns of the
Commission have resulted in the need for them to request
funds from their member cities. The Cities' contributions
will then be repaid from the $150,000 to be received from
Group W. If for some reason the $150,000 is not forthcoming,
the Commission will proceed to request of Group W, as has
been the procedure in the past, an advance on the franchise
fees. In either event, the member cities will be repaid
either as an advance on franchise fees or from the $150,000
indemnification payment.

Each city's contribution appears on the Attachment
to this memorandum. The North Suburban Cable Commission
would request that the City appropriate the amount indi-
cated for your city on the attachment and submit your
check to the North Suburban Cable Commission. Please
submit your check, along with documentation indicating
your expenditure of such funds (such as requisition
requests, invoices, etc.) so that said documentation
will be available for the Commission to request advance
on franchise fees from Group W if such procedures would
become necessary.
Checks and supporting documentation should be mailed
to the North Suburban Cable Commission, Attention: Gale
Linebarger, Treasurer, City of Falcon Heights, 2077 West
Larpenteur Avenue, Falcon Heights, Minnesota 55113.

Credit could be returned.

I have just been informed by my customer, Brentwood
Development Company, that all of the lots in White

RE: Showmobile Rental
As you are aware, the Ramsey County Showmobile will not be avail-
able for the "Festival in the Park" scheduled for July 14, 1985.
Staff has made contact with the City of Edina who has a similar
showmobile and it would be available for the July 14 festival.
The cost to rent the unit is $500.00 per day which would be made
payable to the City of Edina, which would include not only the
use of the vehicle on the 14th but also insurance on the equip-
ment. Staff has contacted a number of municipal and county
agencies to secure a showmobile, and at this time, the City of
Edina is the only community that would have one available for the
July 14 weekend.
r The other option to renting a showmobile from the City of Edina
would be to have staff do a make -shift bandstand out of existing
City supplies. Staff does not feel this is feasible as the bands
are a very integral part of the "Festival in the Park" celebra-
Lion.
RECOMMENDATION: To authorize staff to enter into an agreement
with the City of Edina to rent Wenger Model 6432 Showmobile for
July 14, 1985 at the rate of $500.00 per day.

The 1985 budget reflects a $3,000 line item for trimming of City
boulevard trees. The City has had no consistant trimming of pub-
lic and boulevard trees for the past seven years, to my know-
ledge, other than some light trimming that has been accomplished
in house. Staff proposes that we would allocate $1,000 Highway

RE: Greenfield Park
The Mounds View Parks and Recreation Commission held a special
meeting on Thursday, March 14, 1985 to review the Greenfield Park
design specifications and final concept plans. As you are aware,
the City has received a grant for $175,000 for the Phase I devel-
opment of Greenfield Park, and staff has, for the past three
months, been immersed in the planning and development of the bid
specifications.
Attached you will find a copy of the current construction cost
estimate which projects the total project to be $147,510. This
figure does not include the $18,000 for engineering and consul-
tant fees which would bring the project cost up to $165,000. In
addition, the one other item that is not included in the prelim-
inary cost estimates is the materials for the construction of two
pole bridges to cross judicial ditch number one once the trail
development is completed, which are estimated to be $3,500-
$4,000 each. Final figures show a preliminary cost estimate of
approximately $170,000, which based on a 5 percent contingency,
will place us very close to the final $175,000 grant figure.
The Park and Recreation Commission voted unanimously to recommend
that the City Council establish a bid opening date of April 17,
1985 with formal bids to be awarded by the City Council on April
22, 1985. Based on this time line, we are envisioning an eight
week construction time frame, or a mid -summer project completion.
Staff will be making a brief presentation of the final concept
plans for Greenfield Park as well as reviewing the bid specifica-
tions at Monday evenings council meeting. Should you have any
questions prior to the evening's council meeting, feel free to
contact me directly at ext. #20.
RECOMMENDATION: To approve advertising for a 10:30 a.m., April
17, 1985 bid opening for Phase I construction of Greenfield Park
consisting of approximately 41230 feet of bituminous and lime-
stone trail construction, a baseball field, a bituminous entrance
road and parking lot, twin tennis courts, storm sewer extension,
culvert installation, and tennis court lighting.

City Attorney Richard Meyers has requested that I submit tc
you the language for a motion which he has requested that
you adopt at the March 25, 1985 Council Meeting to comply
with the Order of Ramsey County District Court Judge Harold
Schutlz on the referenced issue. The motion would read as
follows:
Councilmember moves, subject
to the City's rights of appeal, to comply with the
order for judgement of the Ramsey County District
Court relative to Court File No. 464143 Granting
Gregory A. Johnson's Application for a Rezoning of
His Property at 2865 Highway 10 from R1 Single
Family to B3 Commercial Highway Use With Conditional
Use Permit for Highway Auto Repair and which Conditional
Use Permit for Highway Auto Repair shall contain the
following restrictions: The erection and maintenance
of a privacy fence is required by the Municipal ordi-
nance, the maintnenace of the property in reasonably
clean condition, the maintenance of reasonable busi•-
ness hours for conducting his business, and a restricted
use of lighting so as not to disrupt the enjoyment of
property by residential property owners.
RECOMMENDATION: Staff would recommend that Council adopt
the above motion at the March 25, 1985 Council Meeting to
comply with the Court Order and the indication to
Mark Karney by Judge Flynn that this order supercedes the
City's Charter and Ordinances. Staff would request Council
direction as to whether or not this item should be placed on
the Consent Agenda or the Regular Agenda.

ENERGY WORKSHOP AGREEMENT

THIS AGREEMENT, effective as of the / day of
J�augQT__, 198_S, between Northern States Power
Company ("NSP"), a Minnesota corporation, and the City of
Mounds view (the "City"), a municipal corporation.
WITNESSETH:
WHEREAS, the Minnesota Public Utilities Commission
("MPUC") ordered NSP to implement a conservation investment
program which included providing assistance to conduct energy
conservation workshops and other energy conservation programs,
and
WHEREAS, the City has established a Community Energy
Council (CEC) whose responsibilities include conducting energy
conservation workshops and implementing other energy
conservation programs.
NOW THEREFORE, in consideration of the terms and
conditions stated herein, the parties agree as follows:
1. weatherization Materials. NSP shall provide the
City at the City's option either weatherization materials in
bulk or kit form at a cost to NSP of approximately $20 for
each Eligible Participant or reimburse the City up to $20 for
weatherization materials for each Eligible Participant. An
Eligible Participant shall be defined as a household in each
neighborhood of approximately 50-100 households which attains
40% household participation in a workshop, or if there is no
readily identifiable neighborhood, any 25 households who
attend a workshop. The weatherization materials shall consist
of: 2 tubes of caulk, 1 caulking gun, 1 entry door sweep, 1
packet of electrical outlet covers, 1 window insulation kit,
and 1 V seal door weatherstrip, or any other combination of
weatherization materials mutually agreed to by the City and
NSP. Prior to each workshop the City shall notify NSP the
proposed number of attendees, whether the weatherization
materials will be furnished by NSP or purchased by the City,
and whether NSP shall arrange the delivery of the materials to
the City at NSP expense. If the City elects to purchase the
materials, it shall be reimbursed pursuant to Section 9. At
the termination of this Agreement the City shall return any
unused weatherization materials to NSP.
2. Demonstration Materials. NSP shall reimburse
the City for the costs not to exceed a total of $500 to
develop or purchase any scale models, posters and other
demonstration materials which could be used repeatedly at
workshops and which NSP approved prior to the development or
purchase.
3. Educational Materials. NSP shall loan the City
the educational materials, audio -visuals, scale mcdels, and
other demonstration equipment which NSP has developed for use
at workshops. The City agrees to return these materials to
NSP after the last workshop or at the termination of this
Agreement, whichever occurs first.

' 4. Auditor Training. NSP shall pay the tuition
for the local training for up to two auditors, not to exceed
a total of $600, who will perform audits for a City -sponsored
energy conservation program.
5. Audits. NSP shall pay the City $60 for each
approved residential energy audit completed by a City auditor
which was signed up by the City at a workshop. An approved
audit is either a Minnesota Energy Conservation Service (MECS)
audit or an alternative audit approved by the Energy Division
of the Minnesota Department of Energy and Economic
Development.
6. Volunteer Training. NSP shall reimburse the
City for the costs not to exceed $900 to train volunteers to
` assist elderly and physically impaired residents to install
the weatherization materials which they receive at the
workshop.
7. Workshops. The City shall develop a program
to stimulate interest in and publicize the availability of
workshops. During a workshop, the City shall discuss the
benefits of energy conservation, attempt to sign up households
for audits, to distribute the weatherization materials
specified in Section 1, to identify and demonstrate the
installation or implementation of energy conservation
measures and materials, to advise the participants concerning
the eligibility requirements and application procedures for
energy conservation financial assistance programs, to answer

participants' questions, and to attempt to provide special
assistance to senior citizens, handicapped persons, low income
individuals, and renters. If the City elects to perform the
audits with its own auditors, then they shall commence as soon
as practicable after the workshop. If the City decides not
to use its auditors, then the City shall immediately provide
NSP with a list of the names and addresses of the persons who
signed up for audits at the workshop so the audit can be sche-
duled.
g. Reporting Requirements. The City shall provide

NSP each month with a report which shall include a d
of the neighborhoods and their boundaries involved in the
workshops, the number of households in the neighborhoods, a
list of the names and addresses of households participating in
workshops, a list of the names and addresses of households
signing up for an audit, a list of the names and addresses of
audit cancellations, a list of the names and addresses of
audits finally completed, and a summary of the neighborhood
workshop program for the neighborhoods and any information
required by the MPUC.
City elects to perform the
In addition, if the
audits with personnel employed by the City, the City shall
adhere to NSP audit recordkeeping and procedures.
The City shall grant NSP reasonable access to any
books and records concerning the CEC and any of the funds and
activities specified herein. The City shall cooperate with

NSP to respond to any requests for information or other
relevant orders of the MPUC.
9. Reimbursement Procedure. When the City desires
reimbursement for expenses incurred pursuant to Sections 11 21
41 5 or 6, it shall submit an itemized statement to NSP. If
the expenses satisfy the criteria stated therein, NSP shall
send a check to the City within 15 days after receipt of the
itemized statement.
10. Indemnity. The City shall defend, indemnify,
and hold NSP harmless from and against all claims, damages,
losses and expenses including attorney's fees and other
litigation expenses, arising out of the performance or the
failure to perform under this Agreement, or any claimed defect
in the supplies and materials provided. In no event shall NSP
be liable to the City or any of its employees in contract,
tort, warranty (express or implied), or otherwise, in any
amount in excess o $40,000.00. This section shall survive
the completion of, or termination of this Agreement, or any
breach thereof.
11. Term. This Agreement shall be effective for
one year from the date first stated above unless NSP notifies
the City that it elects to terminate this Agreement earlier
after the occurrence of any one of the following events:
(a) the MPUC specifically orders NSP to terminate this
Agreement, (b) the MPUC rejects NSP's request to recover in
rates any expenses incurred pursuant to this Agreement, or
(c) the City fails to perform any of its obligations specified
herein.

12, Notices. All notices, reports, and requests
for reimbursement from the City to NSP shall be sent by United
States mail, postage thereon prepaid, addressed to:

AN ORDINANCE AMENDING ORDINANCE NUMBER 319 GRANTING A
FRANCHISE TO GROUP W CABLE OF THE NORTH SUBURBS, INC., A
MINNESOTA CORPORATION, TO OPERATE AND MAINTAIN A CABLE
COMMUNICATION SYSTEM IN THE CITY
The Council of the City of Mounds View does hereby ordain:
Article III. DESIGN OF SYSTEM
Section 1. CHANNEL CAPACITY - SUBSCRIBER
NETWORK
Article III, Section 1, Paragraphs A and B
are amended to require a System capable of
providing upon activation at least 59
downstream channels to be constructed pursuant
to the conditions of the proposal of Group W .
The system will be constructed as a dual cab le
system capable of providing 108 downstream
channels but with electronic components
allowing the activation of 59 channels.
Section 3. TWO-WAY CAPACITY
Article III, Se,.tion 3 is amended to require
Group W to initially activate a two-way
capable System on one instead of both cables.
Section 4. FACILITIES
Article III, Section 4 is amended to
require Group W to construct its facilities as
set forth in its proposal to the City.
Section 5. SPECIAL CHANNEL AND ACCESS REQUIRE-
MENTS
Article III, Section 5 is amended to
require the System to carry broadcast
stations, an emergency override channel, an
audio/video emergency override system, and 13
access channels including public (2), educa-
tional, government, leased (1), regional,
religious, senior citizens, library, higher
education, private school access, and public
school access (2). The franchise details
specific access rules which must be developed
by Group W.

Section 3. CONSTRUCTION TIMETABLE
Article V, Section 3, Paragraph B is amended
to require Group W to construct all areas of
the City which contain dwelling units on or
before November 12, 1984.
Article VI. SYSTEM OPERATIONS
Section 4. FRANCHISE FEES, RATES, CHARGES,
CHANGES IN FEES AND PROCEDURES
Article VI, Section 4, Paragraphs A, B, C,
and D are amended to require that throughout
the term of the franchise, Group W shall pay to
City an annual fee of 5% of all gross
revenues. The rates provided in the franchise
shall be guaranteed for one (1) year after
completion of construction of 541 miles of
cable plant in the ten -city North Suburban
initial service area. Basic rates shall be
regulated pursuant to the terms and conditions
of the franchise allowing changes in rates
unless the City specifically disapproves such
changes. Rates for other than basic service
shall be regulated purusant to the terms and
conditions of the franchise. This section
further details the procedures for the
regulation of other than basic service rates in
the event the law should provide for their
regulation.
