The Mounds View City Council was called to order by

Mayor Linke at 7:30 PM on May 28, 1985.
The Pledge of Allegiance was said.
MEMBERS PRESENT: Councilmembers Blanchard, Haake,
Han ner, qUICK and Mayor Linke.
ALSO PRESENT: City Attorney Meyers, Clerk/Admini-
strator Pauley and Public Works/Community Development
Director Thatcher.
?lotion/Second: Haake/Blanchard to approve the May
13, 19 5 minutes as amended.
4 ayes 0 nays 1 abstention
Councilmember Hankner abstained as she had been absent.
Milan Illig, 2809 County Road H, questioned the status
of removal of the accessory buildings on his neighbor's
property, as a new accessory building is being built.
Mayor Linke replied the Council had spoken with the
property owner and the existing buildings are used to
house equipment which will go into the new buildin-
when it is far enough along, and the three existin
buildings will then be torn down.
Director Thatcher added that the property owner has
agreed to take the buildings down within the next
45 days. He pointed out, however, that the property
owner has one year under City code to complete the
accessory building, and his year will not be up
until October 1985.
Duane McCarty asked the status of the airport lawsuit
and expressed concern with proceeding in a timely
manner.

Attorney Meyers replied the City has received the bulk
of the report from Mr. Perez, but he has not yet finished
the monitoring. The City has been in contact with him
regarding this, and no court date has yet been set.

scoping document from MAC.
Mayor Linke reported he and Clerk/Administrator had
attended a Met Council meeting, and the full Council
had agreed that MAC must study all the items presented
before proceeding.
Mayor Linke closed the regular meeting at 7:51 PM and
opened the public hearing for the Cross of Glory
Lutheran Church.
Don Fairborn, 5511 Erickson Road and Helen Moore, 5503
Erickson Road, asked if there were plans for a privacy
fence alongside the parking lot, and what the lighting
plans were.
Jack Holmes, a representative of the contractor, stated
they would consider moving the trees to the east side of
the property adjacent to the new addition. He added
the lights would be on a photocell, on short light poles
and the light would be concentrated down.
A representative of the church stated they would consider
doing an earth berm, along with landscaping, to separate
the parking lot from the residential area behind.
Mr. Holmes pointed out there will be excess fill with
which they can build the berm, and put plantings on top.

reopened the regular meeting.

r'Clerk/Administrator Pauley explained that the funds
involved in Item A had been put into the contingency
fund when the budget was approved, as they did not know
at that time what the exact figures would be, and they
were transferring the funds now.

curriculum grant and the $18,207 community resource
workers grant, for the Mounds View School District,
and authorize the Clerk/Administrator to sign the
grant application on behalf of the City.

Clerk/Administrator Pauley reviewed the history of
the request of employees to use the garage after
hours. He reviewed the information received from
Attorney Meyers and the insurance consultant, regard-

Councilmember Haake stated that while she had earlier
been in favor of allowing the use, she has now changed
her mind after receiving additional information.
Councilmember Blanchard stated she was against the
idea altogether.

hours.

received an application from the Mounds View Food
Shop for a non -intoxicating malt liquor license.
He added that due to their good record and past

ceived from the administrative council of Sunrise Adoption of
United Methodist Church, speaking against the Ordn. No. 3111
ordinance.
Mayor Linke reported he had spoken with the Police
Chief, who said he had no problem with the proposed
ordinance. He reviewed the results of a survey he
had asked the Park Director to do, stating which
communities allow consumption of alcoholic beverages
in their parks.
Councilmember Blanchard stated she was against the
ordinance and reviewed the list of Cities that do
not allow drinking in their parks.
Duane McIlarty questioned some of the terminology
in the proposed ordinance. He stated he feels the
parks are for the children and families and drinking
should be kept out.
Attorney Meyers clarified some of the terminology
in the ordinance.
Councilmember Hankner expressed some concerns with
the ordinance. She stated she did not disagree with
the intent but would recommend postponing action to
clean up the language and discuss further with
Attorney Meyers.
Alice Frits stated she felt the parks are for the
children and read excerpts from an article regarding
the proposed ordinance, as printed in the Minneapolis
Star and Tribune.
Motion/Second: Hankner/Quick to table this item,

Councilmembers Blanchard and Haake voted against the
motion.
Clerk/Administrator Pauley reported he would place the
item on the June 3rd agenda.
Mr. McCarty asked that the Council consider notifying
the residents who live near the parks of further
discussions on the matter.

recommend Council authorize Staff to enter into
discussions with Robert wuornos to negotiate a
contract for the Council's consideration.

into negotiations with them as to the cost and
study parameters.

Mayor Linke explained he reasons for choosing this firm
is they are more willing to talk to the local residents,
and they would be more economical.
Director Thatcher reported Vern Conaway, 5101 Brighton
Lane,has applied for a fill permit, and he reviewed
the request and recommended approval. He explained
this would help alleviate the water problem for both
Mr. Conaway and other area residents.

Attorney Meyers reviewed the implications of Chapter
62 of the 1985 legislative session.
Councilmember Blanchard reported the Firemans Relief
Association would be meeting at 8 PM on May 29, and
she would not be able to attend. She also asked for
a clarification of fire inspection activities on the
part of the City and whether records are kept, as the
fire chief has stated publicly they have not been done
in Mounds View, and she would like to be able to
refute that statement.
Director Thatcher reported the City is in the process
of making fire inspections at this time.
Clerk/Administrator Pauley stated Staff would look
for the reports.
Mr. McCarty stated he was under the impression that
a fireman is forced to retire after suffering a heart
attack, and questioned why the fire chief had not been
forced to resign after his heart attack.

Clerk/Administrator Pauley replied that Staff would look
into the matter.
Councilmember Haake asked if conditional use permits
require that notices be sent to surrounding property
owners. Director Thatcher replied they are not
required to, and that notice is only required to be
published in the New Brighton Bulletin. Clerk/
Administrator Pauley also clarified the administrative
policy which is followed.
Councilmember Hankner reported the Festivities
Commission will be meeting on June 4th and they in need
of more people to help out with the Festival in the Park.
Councilmember Hankner reported she had spoken to Grant
Merritt within the past two weeks and he is in the process
of leaving the firm he was employed with and would like to
be able to settle his bill with the City.
Motion/Second: Hankner/Blanchard to authorize payment
to rant erritt of $2,141.53 per the April 24th letter
from Carol Herbst of the law firm.

to reschedule the clean-up with Pack 68 Cubscouts for
June 22, to include lunch at McDonalds.
Clerk/Administrator Pauley advised the Council of an
article in the New Brighton Bulletin regarding the
competition between Mounds View and Shoreview to
have the new Ramsey County Library built in their
City, and stated he would be going to the schools
in the City and asking the students to write to
the library board, as Shoreview did.

from the Council to hire a Hamline graduate, with a
masters degree, to do a three month internship with
the city to do the research work for the economic
development plan. He explained he had not met this

RESOLUTION AUTHORI%ING DISPATCH AND USE OF CITY EQUIPMENT
AND SERVICES I3Y CLERK -ADMINISTRATOR IN EMERGENCY SITUATIONS
WHEREAS, the Mounds View City Council finds that
instances have occurred in the past and can be anticipated
in the future wherein there is a danger by fire, hazard,
casualty or other similar occurences taking place or
occurring outside the territorial limits of the City of
Mounds View, and
WHEREAS, by the suddenness thereof it would be
impossible or impractical for the City Council to meet and
authorize dispatch and use of City equipment and personnel
to combat such fire, hazard, casualty or similar
circumstances.
NOW, THEREFORE, HE IT RESOLVED by the City Council of
the City of Mounds View that the City Council finds it
desireable and necessary to authorize the Clerk -Administra-
tor or his designee to exercise discretion, considering at
all times, and in each case, the internal needs of the City
of Mounds View and its inhabitants, dispatch City equipment
and personnel as deemed necessary to combat such occurrence
whether it takes place within or without the City limits.
HE IT FURTHER RESOLVED that such dispatch and use as
directed by the Clerk -Administrator or his designee shall be
fully authorized as an act of the City of Mounds View and
all provisions for compensation of personnel, rental of
equipment, liability insurance coverage, workmens compensa-
tion insurance and all other safeguards pertaining to the
City, its equipment and personnel, shall apply in each case,
as if specifically authorized and directed by the City
Council at such time, whether or not the governing body or
authority of the place in which the fire, hazard, casualty
or other similar occurrence exists, has previously requested
and provided for assistance in the use of the City's equip-
ment and personnel under a mutual protection agreement or
other type of protection agreement within the City of Mounds
View.

RE: Groveland Park Playground Equipment
During the past three months, City staff has been working with
the Groveland Park Foundation to upgrade the existing playground
equipment currently located at Groveland Park. The process was
initiated in March of this year when tours were conducted with
the Groveland Park Board of Directors to a number of local play-
ground sites to observe first hand the variety of playground
equipment that is available. Following the tour of five differ-
ent sites, bid specifications were prepared and forwarded to
seven major playground manufacturing firms located within the
Twin Cities area. Four proposals were submitted and formally
reviewed by the Groveland Foundation Board of Directors at a
special meeting on Wednesday, June 5, 1985.
A schematic of the playground equipment that was selected by the
Groveland Park Foundation is enclosed for your review and avail-
able through GameTime and entitled Durascape+. The equipment is
all aluminum, with redwood decks and, as can be noted, fairly
extensive in nature, with five major slide beds and five large
' deck areas with an additional six climbing or entry points. In
addition to the major structure that is shown, a pre-school
structure has also been proposed, which includes a space net,
slide and deck area. In addition, the equipment will be complet-
ed with three spring animals, two backhoe diggers and a redwood
slat swinging bench.
The total cost of the equipment is $15,000 including tax and
delivery. As you are aware, the Groveland Park Foundation has
been conducting a number of fundraisers during the past three
years, and has been utilizing their funds to develop Groveland
Park with new facilities including sand volleyball court, City
park sign, shrubbery, landscaping and bench areas. The Groveland
Park tot lot project is the first project that is being proposed
under the Neighborhood Park Planning Fund and the Park Foundation
has broached the Park and Recreation Commission in 1984 and 1985
for a $2,500 matching fund. The Park and Recreation Commission
has approved the two Neighborhood Park Planning Fund grants, as
they have met all the criteria outlined in the fund guidelines.
Based on the approved $5,000 Neighborhood Park Planning Fund
grant, and an additional match of $7,500 from the Groveland Park
Foundation funds, the Foundation currently has $12,500 available
for funding the project. Staff presented this issue to the City
Department Beads at their regularly scheduled staff meeting, and
City Administrator Pauley has indicated that the remaining $2,500
could be funded from the proceeds from closing out the MSA bond
fund, as it appears that the Administrative Aide position, which
he had hoped would be approved, was not.

Staff recently met with Honeywell, Inc. who has donated $2,11011 in�
the past for the Neighborhood Park Planning Fund, to request en
additional $50,000 to fund the Neighborhood Park Planning Fund.
Staff teels it is imperative to get a major project "in trn-
ground", to be able to showcase how the Neighborhood Park Plan-
ning Fund can be used to develop other neighborhood parks and
community facilities.
In conclusion, staff feels that the Groveland Park Foundation has
done extensive groundwork in researching and developing fund
raising activities for the purchase of this playground equipment.
Staff would recommend that the equipment be purchased as out-
lined, based on the funding sources as provided.
RECOMMENDATION: Recommend approval of a Durascape+ playground
equipment or Groveland Park in an amount not to exceed $15,000
based on the formal bid proposal received from Minnesota Play-
ground, Inc. with the project to be funded from the following
three sources:

ENTITLED,
"ADMINISTRATIVE OFFENSES" AND AMENDING CHAPTER I
OF THE
MUNICIPAL CODE ENTITLED, GENERAL PROVISIONS
OF THE CODE:

SECTION I.
Chapter 400 of the Municipal Code Entitled,
"Administrative Offenses" is established as
follows:
400.01 Definition. An administrative offense
is a violation of a section, subdivision,
paragraph or provision of this code when one
Performs an act prohibited, or fails to act when
such failure is thereby prohibited, and is
subject to the penalty set forth in Chapter
1.11, Subd. 2.01 of this code, and the schedule
set forth hereafter.
400.02 Notice and Payment. Subd. 1, Notice.
Any member of the City Police Department, and or
any other person employed by the city with
authority to enforce this code shall upon
determining that there has been a violation
notify the violator, or person responsible for
the violation, or in the case of a vehicular
violation by attaching to said vehicle notice of
the violation, said notice setting forth the
nature, date, time of the violation, the name of
the official issuing the notice, and the amount
of the scheduled initial penalty, and where
applicable any changes relating thereto.
Subd. 2, Payment Once such notice is given the
person responsible for the violation shall
within seven (7) days of the time of issuance of
the notice pay Eull satisfaction of the stated
violation schedule to the Treasurer, or his
designee. The penalty may be paid in person or
, mail and payment shall be admission of the
violation. A late charge shall be imposed for

400.04 Heariny. Any person aggrieved by this chapter
may request within seven (7) days of the time of

Council, but such member shall be entitled to a public hearing
