The Mounds View City Council was called to order by 1. Call to Order
Mayor Linke at 7:35 PM on July 22, 1985.
The Pledge of Allegiance was said. 2. Pledge of

MEMBERS PRESENT: Councilmembers Hankner, Blanchard, 3. Roll Call
Haake and Mayor Linke.
It was noted that Councilmember Quick was absent.
ALSO PRESENT: City Attorney Meyers, Clerk/Admini-
strator Pauley and Public Works/Community Develop-
ment Director Thatcher.
Motion/Second: Hankner/Haake to approve the July 4. Approval of
8, 1985 minutes as presented. Minutes:

Ken Sjodin, 2841 Bronson Drive, stated he was 5. Residents Re

addition, and the bids on that project had come
in higher than anticipated, and they would like
to have the bids thrown out and have the City
act as the general contractor.
Mayor Linke explained that the Council had dis-
cussed the matter at the last agenda session, but
Mr. Sjodin had not been present, and they will
continue discussion at the August 5th agenda
session.

Director Thatcher introduced Bob Wuornos and Zack
Johnson, from Wdornos and Associates, the firm that
has been retained to do the review of Districts 6
and 12 of the Comp Plan.
Mr. Wuornos outlined the areas they have been asked
to study and explained the procedure they are follow-
ing and what their findings have been to date. He
also read into the minutes petitions that had been
received regarding the review and suggestions for
the area.
Mayor Linke explained the Council is not anticipating
doing any rezoning at this time. They are working
to bring the Comp Plan and zoning map into compliance,
and they are gathering information at this point.
James Trimbo, 7880 Groveland, stated he had bought
his home 16 years ago, and a request was submitted to
the City at that time to zone some of the property
commercial, and it was turned down and multiple family
dwellings built. He stated he has had nothing but
trouble with the multiple dwellings and would rather
see commercial.
Linda Bankston, 8025 Groveland Road, stated she would .'
like to see the area stay quiet and would like to see
low density residential and not large apartment
buildings.
Jim Gable, 7934 Fairchild, stated he was not opposed
to R-2, but they must leave a buffer between the
residential and commercial areas, and would favor
having that area as R-2.
Jon Thomas, 8040 Groveland, asked for a clarification
of what a special use is.
Director Thatcher explained what permitted uses are
for B-3 zoning, and what would be allowed under it.
Attorney Meyers pointed out that the K-Gas was zoned
B-3 before the City became incorporated in 1953.
Jerry Blanchard, 8005 Groveland, stated he finds it
hard to believe the City can move backwards, and
they should stay away from strip zoning. He stated
he objects to the fact that a meeting was held
specifically for the businesses and did not include
the residents.

Duane McCarty, 8060 Long Lake Road, stated they must
remember the consequences of downzoning and the
potential for lawsuits.
Director Thatcher clarified that there are approximately
eight locations in question.
Don Liao, an attorney representing K-Gas, stated they
did not attend a business meeting. He also explained
that the Comp Plan is not zoning but rather a plan for
zoning. He added he would recommend zoning the
radiator repair shop as commercial, and they could then
perhaps develop it better. He also stated the Comp
Plan could be amended to allow a small B-3 area.
Grace Thomas, 8040 Groveland Road, stated her property
abutts the radiator repair shop and they have had many
problems with the business operation. She stated she
feels the area off Highway 10 should be residential
only.
Councilmember Hankner asked if the residents are will-
ing to pay for litigation that most likely would result
from rezonings, and whether they believe the rest of
the taxpayers in Mounds View should subsidize that
litigation.
Phyllis Blanchard, 8005 Groveland Road, stated she
was speaking as a resident and not a Councilmember,
and stated she is not opposed to change but does not
feel District 6 should change to anything but should
remain residential.
Mr. McCarty stated he feels that as a community, the
people will stay together, and the Council should
consider compensating the people who may have their
zoning changed.
Mr. Trimbo stated he was opposed to spending any money
on this.
Bill Frits, 8072 Long Lake Road, stated they must look
at the overall picture, and they must quit decreasing
lot size and filling up the City and overworking the
services.
Steve Dahlke, 8030 Groveland Road, stated he lives
directly behind the radiator repair shop and he has
had considerable problems with that operation and
specifically the dogs there.
Councilmember Hankner stated the Council would like to
hear from as many residents as possible, and they
were welcome to call or write any of the Councilmembers
if they did not wish to speak publicly.

Carol Golden, 7417 Parkview Drive, asked why an
entrance was necessary off Mounds View Drive.
Bob Hartmann, of Super America, explained that a
driveway there would enhance the property, as well
as benefit the entire neighborhood. He added that
the Super America station would be a greater
convenience for the people of the area rather than
other areas.
Bob Holmbeck, 2596 Mounds View Drive, stated he does
not want to see the zoning change.
Lance Raygor, 2584 Mounds View Drive, presented a
petition to the Council, against the rezoning of
the property, from neighborhood residents.
Joe Masanz, 2626 Lake Court Drive, stated he felt
this was only the beginning and if it were approved,
there would be more business generated, with a lot
more traffic. He added that he bought with the
knowledge that the zoning was B-2.
Marcella Raygor stated she does not mind driving
to other Super Americas or gas stations in the area
and she reviewed the stations in the area and how
far a drive they were for her. She added she
feels that a rezoning would downgrade their property
values.
Arden Wahlberg, 2642 Lake Court Drive, stated he
checked the zoning before signing a purchase agreement
on his home, and he does not want to see the zoning
changed.
Jeff Pinotti, 2644 Lake Court Drive, stated he had
also purchased his home based on the current zoning
and he would like it to remain that way.
Bob Wagner, 2590 Mounds View Drive, stated he would
like to see the zoning remain as it is.
Mrs. Raygor stated that she does not feel a right
turn lane onto Highway 10 would be of any benefit
as the traffic is too heavy during rush hour to be
able to get on.
Dale Kremerst a representative of Kraus -Anderson,
explained they have had many requests from other
buyers for the property, that would be allowable
under B-2, but Kraus -Anderson has turned them down
i so far because they would be a much higher usage
and busier. He added that an office building was
never proposed by Kraus -Anderson for that lot. He
also invited any interested resident to come down

received, so they can realize what could be put
there without any rezoning.
Clerk/Administrator Pauley reviewed what would be
allowed under both B-2 and B-1 zoning.
Mayor Linke clarified that the hours of operation
could be limited by the City.
Attorney Meyers pointed out that Super America
has agreed that if the project is approved, they
will remove the structure at any time that it is
no longer used for that purpose, which would
eliminate the problem of abandoned gas stations
which has happened before.
Mr. McCarty stated they must look at the project
from a PUD standpoint.
Mayor Linke closed the public hearing and reopened

and would be proposing changes.
Attorney Meyers advised the Council may be hearing
from a developer on the issue of park dedications
in the near future. He stated that it is a
negotiable item.
Attorney Meyers reported the respondent in the
Highway 10 Radiator Repair Shop has until the
end of the month to respond, and he will keep
the Council appraised of the progress and court
dates.

Councilmember Blanchard had no report.
Councilmember Haake asked that the Police Department
check into a semi that was parked on the south shore
of Spring Lake, on the water main. She stated she
had received complaints from neighbors, who observed
the man camping out there and building fires.
Mayor Linke reported he had received several
applications for the position open on the Park
Board, and he will be passing them on to the Chairman
of the Park and Rec Commission for their recommen-
dations.
Mayor Linke read a letter received from Jan Quick,
thanking several individuals for their help with
the Festival in the Park.
Clerk/Administrator Pauley stated that the employees
mentioned would receive a copy of the letter, as
well as have one put in their personnel file.
Clerk/Administrator Pauley reported he also had
concerns with the language in the community
development block grant program, which he was
working on.
Clerk/Administrator Pauley reviewed the informa-
tion he had received in checking out complaints of
a plane in the area on July 10.

One of these intersections, Spring Lake Road and Ardan Avenue
currently has traffic stopping at Ardan Avenue, a city street,
prior to entering Spring Lake Road. Spring Lake Road, however,
does not have traffic controls between Trunk Highway 10 and
County Road J. It is felt that the current level of traffic on
Spring Lake Road justifies the need for additional traffic
controls at this intersection to help control the speed of
traffice at the intersection, allow for a safe entrance onto
Spring Lake Road by traffic from Ardan Avenue, and to discourage
non -local traffic from using streets primarily residential in
nature as a "shortcut".
For these reasons, the City of Mounds View would request that
Ramsey County place stop signs on the northbound and southbound
lanes of Spring Lake Road at its

The Planning Commission recommends approval of this project per
Resolution No. 137-85.
City Code requires d hearing for the minor subdivision and the
conditional use permit. A courtesy mailing will also be made
property owners in the area. The hearing notice could be
published in the paper on August 14, 1985, with the hearing held
on August 26, 1985.
RECOMMENDATION:
I recommend scheduling a public hearing for the minor subdivision
and conditional use permit for August 26, 1985.

CONDITIONAL USE PERMIT REQUIREMENTS
1. The architectural appearance and tunctional plan of the building
and site will be similar to the existing buildings in the area
and not cause impairment in property values or constitute a
blighting influence.
2. Magazining or stacking space meets City requirements.
3. At the boundaries of the residential district, a strip of not
® less than 10 feet should be landscaped and screened in compliance
with Section 40.04, Subd. H, of the Municipal Code. My question
is, does the 6 foot wide strip of sod between the proposed
building and the R-4 zoned property to the west meet this
requirement?
4. There are no lighting standards proposed for the parking lot in
the area.
5. Parking or car magazining storage space shall be screened from
view of abutting residential districts in compliance with Section
40.04, Subd. H, of the City Code. My impression is that the
developer should provide additional buffering space between his
proposed car wash and the R-4 residential property.
6. The site will be blacktopped and sodded.
7. The City Engineer will review the drainage calculations once
Mn/UUT has approved the access to Highway 10.

RECOMMENDATION TO THE CITY COUNCIL REGARDING MOUNDS VIEW
PLANNING CASE NO. 174-85, RONALD L. RICHARDSON
WHEREAS, Ronald L. Richardson has requested City approval to
construct a self -serve car wash near the southwest corner of County
Road H-2 and Highway 10 (2320 Highway 10) in the City of Mounds
View; and
WHEREAS, construction of this building, as requested,
requires approval of the development, minor subdivision and
conditional use permit; and
WHEREAS, the Planning Commission has reviewed the staff
report and reviewed information submitted by the applicant which
includes the follows:
1. Development Plan
2. Site Survey
3. Evidence of Site Control; and
WHEREAS, the Planning Commission has also reviewed this
proposal and it is in conformance with all chapters of the Municipal
Code, specifically Chapter 40, 42, 49, and 49A and State Statutes;
and
WHEREAS, this development does not need to be reviewed by the
Rice Creek Watershed District; and
WHEREAS, the Storm Water Control will be approved by the City

WHEREAS, the Minnesota Department of Transportation verbally
stated that they cannot deny the request for a curb cut; and
WHEREAS, Glen Van Wormer of Short -Elliott -Hendrickson, and
the City Engineer have reviewed the proposed curb cut with respect
to whether or not the curb cut should also provide access to the
vacant lot to the south; and
WHEREAS, the distance between this proposed curb cut and the
future curb cut on the vacant lot is recommended to be a minimum of
180 feet; and
WHEREAS, the traffic using the self-service car wash will be
relatively low and an access to the vacant lot to the south can be a
minimum of 180 feet from the curb cut; and

NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission recommends approval of the request by Ronald L.
Richardson and amend the Comprehensive Land Use Plan to reflect this
use;
BE IT FURTHER RESOLVED that a development agreement be
entered into between the City and the developer which includes the

4. Lighting shall be hooded and shall be a maximum of 10
feet high.
5. An attendant shall be on duty during the hours of
operation.
6. Sign shall be flush mounted on the north side of the
building.
7. if the business closes and is not reopened within one
year, the conditional use permit is null and void.
BE IT FINALLY RESOLVED that the Mounds View Planning
Commission directs staff to forward this resolution to the City
Council prior to approval of the minutes.

The Planning Commission recommends approval of the conditional
use permit as well as the development. The Planning Commission
also recommends that a study be conducted of the traffic for the
Bonanza/Super America joint access to County Road I. There are
some parking and traffic conjestion problems that need to be
corrected prior to City Council approval.
RECOMMENDATION: Since this development requires a conditional
use permit, I recommend placing a notice in the paper on August
14, 1985, with the public hearing held on August 26, 1985. A
courtesy mailing will be sent to residents in the area.

installed. I understand the power transformers for these lights
have already been installed.

In order for this project to be constructed, the property must be

SETBACKS
Proposed structures, paving and curbing all meet minimum setback
requirements.
ACCESS
Applicant proposes two access points, one from County Road I and one
from Mounds View Drive. Any joint access must meet the requirements
of City Code, Chapter 40.07, Subd. K.
DRAINAGE
;he site does not need to be reviewed by Rice Creek Watershed
District due to its small size (less than 2.5 acres). The applicant
satisfies the City's Ordinance No. 49 requirements for drainage on
the site.
PARKING
City Code requires 124 spaces. Applicant proposes 109 regular spaces
and 2 handicapped spaces. The total number of spaces does not seem
adequate for the use being proposed. Please note that 2.5 feet of
many of the parking spaces overhangs grass. This was done to provid'
additional green space.
There is a conflict in the Code that I have discussed with the
Planning Commission in the past. The conflict is that City Code
Section 40.05, Subd. C(d), states that vehicle parking or loading
docks shall not be located within the minimum required setback.
While on the other hand, City Code Section 40.07, Subd. F (3), states
that accessory off-street parking shall be not less than 5 feet from
any lot line. In the past, we have interpreted this to mean that
accessory off-street parking shall not be less than 5 feet from any
lot line.
Note: B-6-18 curbing will be required for the paved portion of the
access parking.
CONDITIONAL USE PERMIT REQUIREMENTS
City Code does not require a conditional use permit.
LIGHTING (City Code 40.07, Subd. D, Paragraph (B)L).
1. Is lighting reflected away from adjoining property, abutting
residential uses and public right-of-way?

RECOMMENDATION TO THE CITY COUNCIL REGARDING MOUNDS VIEW
PLANNING CASE NO. 176-65, BONANZA RESTAURANT
WHEREAS, Raymond Voit has requested City approval to
construct a Bonanza Restaurant in the City of Mounds View; and
WHEREAS, construction of this building, as requested,
requires approval of the development and rezoning from B-2 to B-3;
and
WHEREAS, the Planning Commission has reviewed the staff
report and reviewed information submitted by the applicant which
includes the follows:
1. Development Plan
2. Site Survey
3. Evidence of Site Control; and
WHEREAS, the Planning Commission has also reviewed this
proposal and it is in conformance with all chapters of the Municipal
Code, specifically Chapter 40, 42, 49, and 49A and State Statutes;
and
WHEREAS, this development does not need to be reviewed by the
Rice Creek Watershed District; and
WHEREAS, the Storm Water Control has been approved by the
City Engineer; and
WHEREAS, the City Engineer recommends that a traffic study
be conducted for the joint curb cut with Super America at County
Road I;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission recommends approval of the development and rezoning per
the request by Raymond Voit;
BE IT FURTHER RESOLVED that the Mounds View Planning
Commission recommends that a development agreement be entered into
between the City and the developer which includes the following:
1. Exhibits:
a) Site, Grading, Lighting, and Utility Plan
b) Development Plan
c) Site Survey
d) Legal Description
e) Ordinance No. 49A 7-Year Performance Bond
of $1,000
f) Building Plans and Specifications

property line. This short distance to the property line was
probably caused by the wide right-of-way for Sherwood Road. The

WHEREAS, Kraus -Anderson has proposed a major subdivision
on the southwest corner of Highway 10 and County Road I (1 lot

RE: Code Modification
Staff would propose that Chapter 50, Parks and Playgrounds out-
lining the Lakeside Park Agreement, be eliminated from the City
Code. The Lakeside Park Commission has not functioned as a Com-
mission for the past four years and we currently operate the
facility under a joint powers agreement with the City of Spring
Lake Park whereby the City of Mounds View manages the day-to-day
operations of the beach and the City of Spring Lake Park provides
the maintenance. I have been in contact with City Attorney
Karney regarding how this item should be addressed, and he has
not returned my call to date. I would envision that we would
have to formally eliminate this item at a future Council meeting.
Chapter 51 relates to the Director of Parks and Recreation De-
partment's position and the only modification that I would recom-
mend is under subdivision 2, number 1; that the two years experi-
ence be increased to three to five years for minimum experience
at a community park and/or recreation program in a supervisory
capacity.
Chapter 52. This item would be modified under Chapter 52.05 mod-
ifying the curfew to read, "between the hours of 10:00 p.m. and
6:00 a.m.
Under 92.03 sub -section 3, have the term "red oak tree" as we are
currently only tagging red oaks, as they are the only trees that
can cause a problem over land and that is currently all we are
marking on public property.
Under sub -section 92.05, eliminate the word "certified", as we
currently save approximately $80 - $100 each year by not using
"certified" and we have not had a problem in the past years using
regular first class mail.

RESOLUTION REVISING NEW WATER CONNECTION CONTRIBUTION
WHEREAS, Chapter 70.01 of the Municipal Code calls
for the establishment of a trunk, source and storage
contribution for new water connections by resolution of the
City Council;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Mounds View that whenever a new water connection
is constructed, the wner shall pay to the Municipality a
trunk, source and storage contribution detailed as follows:
Property zoned R-1, R-2, R-3, R-4 and R-5 shall pay a
contribution of $200 per dwelling unit.
In the case of other than residentially zoned property, the
contribution shall be the larger of the following:

2) $200 per 36,000 gallons of water used per quarter
The property owner shall provide a water usage
estimate for approval by the City Engineer. If the
gallons of water used during any quarter of the first
two (2) years of water usage exceeds the estimate
approved by the City Engineer, the fee will be
adjusted upward. The City shall not lower the fee if
the water usage is less than the estimate.

Duane McCarty, 8060 Long Lake Road, presented news 5. Residents

that he feels the lawsuit should be pushed forward
at this time, within the next few months.
Mayor Linke replied that one of the prime issues in
the lawsuit is the noise problem, and the City has
a commitment from Al Perez to get the noise monitoring
done. He explained that it has been a difficult
problem to get the monitoring done by Mr. Perez and
the Council recently called him in and made it very
clear the work had to be done immediately, and Mr.
Perez has agreed to it, and has estimated it will
take three months to gather the data and analyze it
and report on it.
Mr. McCarty stated he agrees the noise study is
important but they need to proceed now to attack the
Master Plan and cannot delay any longer.

Councilmember Hankner stated the Council has been •
working very deligently to compile all the informa-
tion requested by the attornies to present the case,
and all bases must be covered, so the noise data is
needed. She added they have been pushing Mr..Perez
to get the monitoring done.
Attorney Meyers reported he had received the scoping
review from ;PAC's consultant, and that Mr. Merritt
feels it advocates segmentation. He is notifying
MAC that the City is still opposing the way the EIS
is being proposed. He added the noise issue is
very important and the results should be back from
Mr. Perez within the next few months. He asked
that people register their complaints with Mr.
Perez or City Hall, if they have not done so
already. He added that once Mr. Perez had presented
an analysis to the City, the lawsuit will be able
to proceed.
Bill Doty, 3049 Bronson Drive, stated the problem
of low flying aircraft over the City should be
looked into, and they should monitor altitudes
and add it to the lawsuit.
Mayor Linke explained the difficulties in obtaining
accurate readings. 0
Sandy McCarty, 8280 Greenwood Drive, stated she felt
traffic has increased immensely over the past three
months, and she has pictures of low flying aircraft,
as well as a log of the calls she has placed to the
Noise Abatement Council, which she will make available
to the City.
In response to questioning, Attorney Meyers stated
that the report from Mr. Perez will be released at
a later date, after it is evaluated, and once they
have proceeded with the lawsuit, as it would be
harmful to the City's case to publicize how they
plan to approach the lawsuit.
Julie Young, 8116 Eastwood, asked if all locations
had been selected for the monitoring and offered
her yard.
Mayor Linke replied the City has supplied Mr. Perez
with the information and he will make the selection
on the locations.
Mr. McCarty stated the contract was entered into
in the Fall of 1984, with an expected completion
in December 1984, and the report came in in the
Spring of 1985.

by Mr. Perez did not include the noise study, which
was part of the original request, and was noted in
the minutes.
Mr. McCarty also asked the Council to removed revised
Ordinance No. 391 from the table and deny it at this
time.
Mayor Linke replied it is scheduled for the next
agenda session for further discussion.
Mayor Linke closed the regular meeting and opened
the public hearing for the M. H. Anderson property
at Silver Lake Road and County Road H2 at 8:12 PM.
Director Thatcher explained that M. H. Anderson is
proposing to amend their existing PUD on the
subject property, and he reviewed their request to
rezone the property from R-2 to R-1, and subdivide
the lots from 8 R-2 to 11 R-1.
Jessie Barnes, 7350 Silver Lake Road, stated he was
in favor of single family homes rather than double
dwellings. He also asked if the dirt along the
edges of Silver Lake Road and County Road H2 would
be moved or who would maintain it.
Director Thatcher replied that the dirt berm will
be left as a noise barrier, and it will be the respon-
sibility of the home owners to car for it. He added
that M. H. Anderson will be cutting it later this
week.
Dan Growe, no address given, stated he had recently
bought a home in the Anderson development and had
not been told that duplexes were proposed for that
area, and he was definitely against allowing
duplexes, and was concerned about his property
value. He also asked what price homes would be
put there if it is approved for single homes.
Director Thatcher replied they will be in the
$115,000 to $130,000 price range.
Alan Wetherhold, 2751 Hodges Lane, stated he
also wants to see single family homes.
Carol Holmgren, 7417 Parkview Drive, stated she
also wants to see single family homes.

Director Thatcher reviewed the request of Kraus vision at
Anderson for a major subdivision of the property Highway 10 and
at Highway 10 and County Road I. He stated he County Road I
has two proposals on his desk now, from Super
America and Bonanza Steak House, to develop if
the property is subdivided.
Marcella Ragger, 8584 Mounds View Drive, stated
she had just spoken to many people in her
neighborhood who were against the projects and
had not received notice of the hearing. She
stated she was against the subdivision and
rezoning as it would increase traffic in
front of her home and decrease her property value.
Joel Mesanze, 2626 Lake Court Drive, stated he was
told the area would be developed with office buildings
and a medical clinic when he purchased his property
which he didn't mind, but he is opposed to having
Super America there.
Verna Melius, 2582 Mounds View Drive, stated she
was opposed to the rezoning and subdivision
and she did not see a notice published in the paper.
Clerk/Administrator Pauley presented the notice of
legal publication, showing that it was officially
printed in the paper.
Kathy Tacte, 7430 Park View Terrace, stated she has
lived there three months and just now received her
information packet and learned that the New Brighton
Bulletin was the official newspaper.
Mr. Mesanze stated that if Super America has their
exits on County Road I instead of Highway 10, all
the traffic will go down through the residential
section.
Jan Mesanze, 2626 Lake Court Drivestated too much
traffic would go into the residential area if Super
America is approved, and she is against the proposal.
Jessie Barnes stated that he has a problem with
litter around his area, from the 7-11 that serves

food, and he felt it would only increase for the
rest of the neighborhood if Super America was
allowed.
Mike Holt, representing Super America, made a
presentation of the proposed plan. He stated
they would be servicing the area and would not
be bringing people from other areas in. He also
presented site lines, showing what would be
visible of the operation from the second story
balcony of the homes in the area.
Councilmember Haake pointed out that Mounds View
Drive is a ring road concept and was planned so
that businesses on Highway 10 could have access
to their buildings. She questioned the need for
an entrance/exit on Mounds View Drive.
Mayor Linke suggested tabling the discussion
to allow the residents to get together and allow
Staff time to get the names of the new residents
to notify them.
Bob Hartmann, representing Super America, stated
that they are more than willing to listen to the
r concerns of the residents and they try to be a
good neighbor.

traffic generation, and noise.
Attorney Meyers reported the Appelette Court
approved the filing of an amecus brief by the
League of Cities in the Greg Johnson case,
He also reported he had received a call from the
respondent attorney, asking what was going to be
rezoned in that area.
Councilmember Hankner reminded everyone of the 16, Reports of
Festival in the Park on July 14. Councilmembers
Councilmember Qutck had no report.
Councilmember Blanchard reported she had received
complaints from neighbors about the Highway 10
Radiator Repair Shop, including that the fence
has not been put up, excessive noise late at
night, and dead trees on the lot.
Clerk/Administrator Pauley replied he will have
the forester inspect the trees.
Councilmember Haake reported she had attended
the Festivities Commission meeting and she feels
the afternoon should be an enjoyable one.
Mayor Linke read a letter he had received from
Senator Dave Durenburger in response to the
City's interest in having a post office built
in the City,
Mayor Linke reviewed a letter received regarding
the Community Block Grant Meeting, scheduled for
July 10 at 7 PM at the Roseville City Hall,
Mayor Linke reviewed a request he had received
from the North Suburban Crime Fund, asking for
his signature on a letter which will be sent to
businesses, asking for their support of the program.
He explained no money was involved on the part of
the City, and with Council approval, he would be
signing it.

SUBJECT: JAMES BOYLES, 2840 OAKWOOD DRIVE - VARIANCE
APPEAL
On June 27, 1985 Mr. James Boyles, 2840 Oakwood Drive, filed
a building permit application for the construction of a 16'
x 20' deck and an 8' x 6' storage building. Mr. Boyles
proposed to construct the storage building 6" off of his
property line, copy of drawing attached, and was advised at
that time that a variance would be necessary in order to
construct the building at this location as City Code Chapter
40.10, Subdivision C (2)b requires that accessory buildings
be at least 5' from a property line.
On that same date Mr. Boyles applied for a variance to
construct the accessory building, copy of variance
application and supplementary drawings attached. On
August 7, 1985 the Mounds View Planning Commission denied
the variance request by adopting Resolution No. 140-85, copy
attached, which essentially states that Mr. Boyles'
situation does not comply with the hardship requirements
provided for in the City Code or those considered to be
acceptable by State Law.
On August 12, 1985 Mr. Boyles submitted the attached note to
me requesting that he be placed on the City Council Agenda
for consideration of an appeal of the Planning Commission's
denial of the variance. To outline the case as I am aware
of it in order for you to have all facts before you at the
time you consider Mr. Boyles' request, I would like to
provide you with the following information.
1. As previously stated Mr. Boyles applied for a
building permit to construct both a deck and
the storage building in question at the same
time and was advised by Staff at that time that
a variance was needed to construct the storage
building and per past history on such cases it
was unlikely that a variance would be issued.
2. Although, being advised of the fact that it was
unlikely that the storage building could be built
where he wished to place it, Mr. Boyles proceeded
to construct his deck per his plan rather than
waiting to determine whether or not the variance
would be granted or modify his plans as necessary so
as to comply with City Code. Had Mr. Boyles modified

his plans, a variety of options would have been
available to him to still accomplish his purpose
These options would have been:
a. Eliminate the concrete slab off of his sliding
glass doors, thus having the deck directly
attached to the house which would have provided
needed distance for the storage building to be
located 5' off the property line.
b. Locate the storage building elsewhere on his
property and plant shrubs or other vegetative
growth that would have provided the necessary
visual obstructions.
c. A "fence" (railing) 6' in height is attached
to his deck and per building inspector Brian
Hoffman's interpretation of the Code this fence
could have been constructed to 8' in height thus
providing the visual barrier Mr.Boyles feels is
necessary to guarantee his privacy.

3. In my conversation with Mr. Boyles on the 12th of
August he indicated that trees had previously been
located where he proposed to construct his storage
building and that he had cut them down even though
they provided the screening from his neighbor's
property, which is why he is requesting to construct
the building at the location indicated, as the trees
required maintenance and sooner or later they would
die and require removal which is an expensive
process.
Attached please find a copy of City Code Chapter 40.26,
Subdivision D which outlines the criteria for granting
variances. This section indicates that a variance may be
granted only in the event that all seven circumstances occur
and in the case of Mr. Boyles, circumstance B1 is most
applicable which states:
"Exceptional or extraordinary circumstances apply to
the properties which do not apply generally to other
properties in the same zone or vicinity and result
from lot size or shape, topography or other
circumstances over which the owners of the property
since enactment of the Code have had no control."
In the case of Mr. Boyles I would submit that he has had
full and complete control of his property and that no
circumstances beyond his control have resulted in his
inability to deal with his privacy problem by means other
than the construction of the requested storage building.

RECOMMENDATION: Staff would recommend that the Council deny
Mr. Boyles' appeal citing the criteria outlined in the
Planning Commission's resolution.

STATE OF MINNESOTA
RESOLUTION DENYING THE VARIANCE REQUEST FOR 2840 OAKWOOD DRIVE
WHEREAS, there exists on the southeast intersection of
Oakwood Drive and Knollwood Drive a house which faces Oakwood
Drive; and
WHEREAS, Mr. Boyles, the property owner, requests to
build an accessory building six inches from his property line;
and
WHEREAS, the accessory building is proposed to be 128
square feet; and
WHEREAS, the accessory building occupies less than 25
percent of the rear yard; and
WHEREAS, the accessory building is less than 15 feet in
height; and
WHEREAS, all of the setbacks on the site are satisfied;
and
WHEREAS, there are reasonable alternatives for providing
privacy; and
WHEREAS, there are reasonable alternatives for a location
for the accessory building; and
WHEREAS, the hardship was self-created by Mr. Boyles
by installing a new deck in his back yard; and
WHEREAS, there is a lack of uniqueness for this variance
request;
NOW, THEREFORE, HE IT RESOLVED that the Mounds View
Planning Commission denies a 4.5 foot variance request on the
rear lot line at 2840 Oakwood Drive.

Subd. B Organization, Meeting,, The Board of Adjustment and
Appeals may elect a chairman from among its appointed -
members for a term of one (1) year; and the Board may
create and fill such other offices as it may determine.
The Board shall meet by order of its Chairman, after
notice, whenever an appeal has been properly presented to
it. A two-thirds (2/3) vote of a properly convened Board
meeting shall be required to grant the relief sought in
the appeal.
Subd. C All written reports and recommendations to the Board of
Adjustment and Appeals from the City staff shall be
entered in and made part of the permanent written record
of the Board's meeting.
Subd. D Criteria for Granting Variances. A variance to the
provision of the Zoning Code may be issued by the Board
of Adjustment and Appeals to provide relief to the
landowner in those cases where the Code imposes undue
hardship or practical difficulties to the property owner
in the use of his land. No use variances may be issued.
A variance may be granted only in the event that the
following circumstances exist:
(1) Exceptional or extraordinary circumstances apply to
the properties which do not apply generally to other
properties in the same zone or vicinity and result
from lot size or shape, topography or other circum-
stances over which the owners of the property since
enactment of this Code have had no control.
(2) The literal interpretation of the provisions of this
Code would deprive the applicant of rights commonly
enjoyed by other properties in the same district
under the terms of this Code.
(3) That the special conditions or circumstances do not
result from the actions of the applicant.
(4) That granting the variance requested will not confer
on the applicant any special privilege that is denied
by this Code to owners of other lands, structures or
buildings in the same district.
(5) That the variance requested is the minimum variance
which would alleviate the hardship. Economic
conditions alone shall not be considered a hardship.
(6) The variance would not be materially detrimental to
the purpose of this Code, or to other property in the
same zone.

(7) The proposed variance will not impair an adequate •
supply of light and air to adjacent property, or
substantially increase the congestion of the public
streets, or increase the danger of fire or endanger
the public safety, or substantially diminish or
impair property values within the neighborhood. The
Board of Adjustment and Appeals may impose such
restrictions and conditions upon the premises
benefited by a variance as may be necessary to comply
with the standards established by this Code, or to
reduce or minimize the effect of such variance upon
other properties in the neighborhood, and to better
carry out the intent of the variance.
Subd. E A22ea�ls. If the Board acts in favor of the appellant it
t�eupon shall issue an order to the administrative
official involved setting forth the terms and conditions
adopted. Said order shall be signed by the Chairman and
the City Clerk -Administrator or Secretary of the Board.
If the Board denies the applicant's relief the applicant
within sixty (60) days from the decision of the Board may
appeal to the City Council for the relief sought.
Subd. F Procedures.
(1) Requests for a variance or appeal shall be filed with
the City Clerk -Administrator on an official appli-
cation form. Such application shall be accompanied
by a fee as outlined in Section 40.28. This fee
shall not be refunded. Such application shall also
be accompanied by ten (10) copies of detailed written
and graphic materials necessary for the explanation
of the request.
(2) Upon receiving said application, the City Clerk -
Administrator shall refer the application, along with
all related information, to the Board of Adjustment
and Appeals and City staff.
(3) After receiving the City staff's report and recommen-
dations concerning a request for variance or an
appeal, the Planning Commission serving as the Board
of Adjustment and Appeals may set a date and hold a
hearing on said request. The Board shall hear such
persons as wish to be heard, either in person or by
agent or attorney. Notice of any such hearing shall
be mailed not less than ten (10) days before the date
of hearing to the person or persons who filed the
appeal or request, to all owners of property
according to the City assessment records, within
three hundred fifty (350) feet of the property to
which the variance relates.
