26 4. COUNCIL BUSINESS
27 A. Resolution 10069, Memorandum of Understanding with MN Roots.

29 City Administrator Zikmund requested the Council consider a Memorandum of Understanding
30 with MN Roots. He discussed how the application period was now open. He explained the fee for
31 an application with the State was $2,500.

33 Buck McCalpa, MN Roots, stated on February 18, 2025 the Office of Cannabis Management
34 (OCM) offered guidance for municipal applications. He explained there were three types of
35 cannabis licenses and those included municipal, open market and tribal government licenses. He
36 reported he would be working with the City to submit a municipal cannabis retail license. Once
37 this license was approved, a rules process would be held by the State and a licensure phase would
38 undergo between MN Roots and the City of Mounds View. He indicated the City's application
39 had to be submitted by March 14, 2025. He noted he has found a site for the proposed municipal
40 cannabis retail shop, but stated he could not disclose the location at this time.

42 City Administrator Zikmund reviewed the terms within the memorandum of understanding in
43 further detail with the City Council and asked for comments or questions.

45 Mayor Lindstrom asked what amendments could be made to the MOU. Counselor Libby reported
46 the MOU could become more detailed. She commented on how she did not want get too far ahead

1 of the State, given their lack of guidance at this time.

3 Mayor Lindstrom stated he was aware there were other competitors out there trying to work with
4 municipalities. Ms. Libby reported this was the case,noting she was not aware of any city that was
5 trying to pursue a municipal license on their own.

7 Mayor Lindstrom opened the meeting for public comment.
8
9 Brian Amundsen, 3048 Woodale Drive, questioned how much due diligence the City has done
10 with respect to municipal cannabis. He understood the Council viewed this partnership as a
1 1 revenue source. He discussed how the City opted not to pursue a municipal liquor store in the past
12 and he hoped this was out of a moral obligation. He was of the opinion it was not morally right for
13 the City to be getting into the cannabis business. He stated Great White's LLC was established in
14 July of 2022, but in March of 2024, its license status was terminated. He questioned why the City
15 was choosing to partner with this company given that they could not properly file for an active
16 status with the State. He reported if the OCM didn't have proper guidance available, perhaps the
17 Council should wait to take action on this item.

19 Mayor Lindstrom closed the meeting for public comment.

21 Ms. Libby explained if you do not renew your business license every year the State now dissolves
22 businesses. She indicated she was uncertain what happened with Great White,but they were caught
23 and now the business was on a schedule to have their license renewed. She reported now was the
24 time to take action because there will be no extensions or window openings in 2025 or 2026. She
25 commented no new applicants will be brought in until the OCM feels comfortable. She discussed
26 how community crime and drug use was going down in State's that legalize cannabis because
27 people were using products that were regulated.

29 Mayor Lindstrom stated he believed cannabis is a net positive being legal and potentially would
30 take away from other treatment opportunities. He explained he trusted the City Attorney to work
31 out the minute details going forward. He reported cannabis would be sold in Mounds View one
32 way or another going forward. From a financial standpoint, he explained the City had not spent
33 any money to date. He commented further on how the municipal cannabis would provide a new
34 revenue street for the City, which would be beneficial in this tight economy. He stated he would
35 support going forward with the municipal cannabis license.

37 City Administrator Zikmund explained staff met with Joni,along with MN Roots and also explored
38 the Red Pine Group. He added that these are the three major players in the Twin City that they are
39 aware of at this time. He stated the agreement with MN Roots had a 60/40 revenue split while the
40 Red Pine Group was proposing a 75/25 revenue split. He noted Joni had not provided a revenue
41 split option for the City. He reported each vendor had ensured there would be no cash outlaid on
42 the City's behalf up front.

44 Council Member Gunn asked if a store could be up and running in 18 months. Ms. Libby reported
45 she could have a shop up and running quite quickly once the State's had regulations in place. Mr.
46 McCalpa commented on the timeline that was followed for his medical marijuana establishment.

2 Council Member Gunn questioned how many employees would be working at the municipal
3 cannabis shop. Mr. McCalpa anticipated there would be 10 employees at the shop in Mounds
4 View.

6 MOTION/SECOND: Gunn/Clark. To Waive the Reading and Adopt Resolution 10069,
7 Approving a Memorandum of Understanding with MN Roots regarding operation of a municipal
8 cannabis retail store, authorizing the City Administrator to submit the cannabis business
9 application and authorizing payment of the $2,500 application fee.

15 B. Resolution 10071, Approving a Professional Service Agreement with ARVIG
16 to Install Network Fiber in the Community Center for the Mounds View
17 School District.

19 Public Works/Parks and Recreation Director Peterson requested the Council approve a
20 professional service agreement with ARVIG to install network fiber in the Community Center for
21 the Mounds View School District. He explained the Mounds View School District was currently
22 renting the Community Center for PSAT and advanced placement testing. He noted all testing
23 must now be done online, which has led the City to pursue a fiber network at the Community
24 Center with ARVIG. Staff commented further on the proposed installation and recommended
25 approval.

27 Council Member Meehlhause asked how much the school district would be investing in the fiber
28 installation. Public Works/Parks and Recreation Director Peterson explained he was uncertain,but
29 estimated the cost would be over $25,000. He commented on how testing could be expanded at
30 the Community Center once the fiber network was in place.

32 Council Member Meehlhause questioned who would be responsible for monitoring the fiber
33 network. Public Works/Parks and Recreation Director Peterson stated the school district would be
34 monitoring the system. He commented the City would still have its own internet system in place.

42 5. PUBLIC COMMENT

44 Brian Amundsen, 3048 Woodale Drive, spoke to the Council regarding budgets. He reported last
45 fall he met with the City Administrator,Mayor and Finance Director.He commented on how 1.5%
46 of the 4%of the franchise fees was to be designated to streets in order to fund street improvements.

1 He explained the strategic plan calls for $360,000 to be collected in franchise fees which meant
2 $130,000 should be going to street improvements. He recommended as managers of the City that
3 the Council follow up on this. He stated there is no ordinance in place that says a street levy is
4 allowed. He suggested if a street levy is going to remain going forward, that an ordinance be put
5 in place to make this permissible.

7 Council Member Meehlhause reported 50% of the franchise fees goes to the street fund.
8
9 Mayor Lindstrom commented on how it was cheaper for the city to levy for dollars than to do a
to bond.

12 Sharon Kirsher, 8406 Red Oak Drive, thanked the City for allowing Project Ardan to hold their
13 event on Saturday. She discussed how the City's plow drivers were salt safe. She recommended
14 those individuals who salt the front sidewalk take the same training as the plow drivers in order to
15 reduce the use of salt.

17 Robert Beligensky, 8198 Groveland Road, discussed his grant application for $500 for a new
18 applicant. He felt the program was run poorly and led to confusion. He feared the City had done
19 some things that were not legal when it comes to data practices. He explained the program was
20 first advertised in Mounds View Matters and residents were encouraged to apply noting there
21 would be a lottery. He noted there were no eligibility requirements. He commented there was no
22 protection against a landlord swooping in and having his tenants take a bunch of these grants. He
23 noted he owns a bunch of property in other communities to see if he could apply for similar grants.
24 He reported he had his third kid around the same time the grant was due, but he did get his
25 application in on time. He indicated he sent in two applications, one for himself and one for his
26 wife, asking if a household could receive two grants. He stated the grants were awarded in
27 December and he was notified his wife's grant was awarded. He indicated this program was
28 advertised so poorly that the City only received 69 applications for free money. He reported he
29 submitted a data request to see who won and if a landlord had swept in to receive a number of
30 grants. Through the data request process, more problems popped up with the City. He explained
31 he received bad information from the City Administrator when Mr. Zikmund stated 72 of the 72
32 grants were approved.He commented this was suspicious to him that the City had received exactly
33 enough applications for the amount of grant funding. In addition, he questioned why the City was
34 handing out 72 grants when the Mounds View Matters said there would be 74. He stated the fact
35 was the City received 69 grants, with three additional grants that were for duplicate households.
36 He reported he asked for a list of grant winners and the three properties that had been thrown out.
37 He stated he asked for 10 days to see the list of properties that were thrown out and this information
38 was being withheld from him. He understood he was one of them, but wanted to see who else had
39 been eliminated. He commented he made a second data request on January 17 regarding the
40 instructions the City received from the Met Council to administer this grant program and this
41 request has not yet been filled. He believed this was illegal, noting he believed the City had 10
42 days to respond. He stated he was disappointed with how poorly this grant program was written
43 and administered. He did not believe it was fair his grant application was denied especially when
44 there was only 69 of the 74 grants administered. He feared something shady was going on with the
45 City.

1 Angelique Workman, 8414 Sunnyside,reported nowhere in the grant information does it state only
2 one grant would be awarded per household. She noted her husband's grant application got tossed
3 out and she did not believe this was fair.

5 Mr. Beligensky requested the Council make a motion to award the two grants to the households
6 that applied for two grants. He encouraged the City Council to look into their data practices and
7 recommended punishments be considered for not fulfilling a data practice request well after 10
8 business days.

10 Mayor Lindstrom reported the City Council would be discussing the water efficiency grants at the
1 1 worksession meeting.

13 Council Member Smith stated she would like to see the Mounds View Matters flyer before making
14 a decision on this matter.

16 Mayor Lindstrom clarified the Mounds View Matters article did not specify whether more than
17 one person from a household could apply for a grant. He indicated the Council had discussed this
18 matter with staff but language was not included in the article.

20 City Administrator Zikmund reported he was not going to get into the data practices request. He
21 explained the Met Council gave the City total authority on managing the program and there was
22 no guidance from the program. He stated he does not have any of the money, rather the City pays
23 out for the grants and puts in for a reimbursement with the Met Council. He indicated he has had
24 a phone call and correspondence with Mr. Beligensky. He reported there were no tenants or
25 landlords that applied for the grants. He commented on the discussions the Council had regarding
26 the implementation of the grants noting staff allowed for applications to be sent in for one week.
27 He noted the City Council was in charge of this program and could decide how to administer the
28 grant funding.

30 Mayor Lindstrom asked if the other 69 grants had been fulfilled. City Administrator Zikmund
31 explained all but 22 have been claimed.

33 Mayor Lindstrom questioned if these two duplicates were granted, would the City still have
34 additional funding. City Administrator Zikmund reported this was the case.

36 Ms. Workman discussed how she was frustrated by the fact her grant application was tossed
37 without consideration.

39 Mayor Lindstrom questioned if a second grant were awarded to Ms. Workman would she purchase
40 a washing machine, since the first grant was for a dishwasher.

42 Ms. Workman stated this very well could be done.

44 Council Member Clark spoke to the fact the grant program was established to assist residents with
45 replacing old appliances with new water efficient appliances. She commented if there was an error
46 on the City's part in not stating only one grant would be awarded per household, the City should

1 award two grants to these households so long as these households have proof that two appliances
2 have been replaced.

4 Ms. Workman stated there was no date restriction within the grant language, she asked why there
5 would be a restriction on which appliance was awarded the grant for.

7 Council Member Gunn expressed concern with the fact Ms.Workman received$500 from the City
8 and did not purchase a new dishwasher.
9
10 Ms. Workman explained she received$500 for the dishwasher she purchased in October.
11
12 Council Member Gunn stated that was not how the grant program worked.
13
14 Ms. Workman commented there were no requirements within the newsletter or the application.
15
16 Council Member Meehlhause believed Ms. Workman should be happy that she received$500 for
17 her dishwasher that she purchased before the grant program was even put in place.
18
19 Ms.Workman stated that was fine,but she was going to argue for the gentleman whose application
20 was thrown out when he had purchased a washer and dishwasher.

22 Mr. Beligensky commented neither in the Mounds View Matters or the grant application did it
23 specify what had to be replaced,rather it was a bait and switch with instructions that followed once
24 the grant application was approved.

26 Mayor Lindstrom stated Ms. Workman should be good because she was issued a grant for the
27 dishwasher that she purchased. He explained the issue at hand was Mr. Beligensky as he applied
28 for two grants for two separate appliances.

30 Council Member Clark recommended that if the grant were to go back out that more specifications
31 be included with dates and that only one grant be allowed per household.

33 Mayor Lindstrom asked if the Council wanted to fulfill two grants for one household for Mr.
34 Beligensky.

36 Council Member Smith questioned how many grants the City had remaining at this time. City
37 Administrator Zikmund reported the City had 72 applications and 74 grants in total could be
38 awarded.

40 Council Member Smith stated she supported grants being awarded for separate appliances in the
41 same household.

4 Brian Merchant, 2126 Hillview Road, explained he applied for a grant as well and noted there was
5 confusion. He encouraged the City to be cautious from providing too much detail in the Mounds
6 View Matters noting the grant funding was meant to serve under privileged communities.

41 Council Member Meehlhause read a Resolution of Appreciation for the Mounds View Economic
42 Development Commissioners in full for the record and thanked the EDC Commissioners for their
43 dedicated service to the City of Mounds View.

1 City Administrator Zikmund explained an appreciation luncheon was held for the EDC members
2 last Wednesday and noted Council Member Meehlhause was in attendance as he has served as the
3 long-time liaison for this group.

5 MOTION/SECOND: Clark/Meehlhause. To Waive the Reading and Adopt Resolution 10061,
6 Appreciation of Mounds View Economic Development Commissioners.

8 Council Member Meehlhause indicated he had the privilege of serving on the EDC and noted he
9 had a hand in recruiting three members on the EDC. He explained he was very proud of the great
10 work that was done by this Commission.

12 Mayor Lindstrom thanked the EDC members for their service to the City.

16 B. Presentation from Congresswoman Betty McCollum's Representative.
17
18 Charlie Hammond, representative from Congresswoman Betty McCollum's office, introduced
19 himself to the City Council and discussed community project funding that was available for local
20 projects. He explained this funding was available for cities through local legislators for projects
21 that were shovel ready, one-year projects and have community support.
22
23 Council Member Meehlhause invited Congresswoman Betty McCollum to attend the Tribute Park
24 grand opening, which will be held on Saturday, September 13, 2025.
25
26 7. PUBLIC COMMENT

28 Mayor Lindstrom encouraged the public to speak with kindness and respect when addressing the
29 City Council during Public Comment.
30
31 Vince Meyer, 8380 Spring Lake Road,requested the City address the design of Spring Lake Road
32 roadway because the road was made too narrow. He recommended the City speak with the
33 engineering firm that designed this roadway.He asked that he be allowed to clear the trail,because
34 the City was not doing a good enough job for snow removal.

36 Russell Zach, 8431 Pleasant View Drive,stated he received a letter in the mail from the City noting
37 the Rainbow Tree Service has no record of taking his tree down, but the arborist put a notice on
38 his door. He expressed concern with the lack of notice he was given before the tree was removed.
39 He reported the City was required to give 30 to 60 days notice and this was not done for the tree
40 on his property and now the City was trying to collect$500 from him for the tree that was removed.
41 He indicated the tree that was removed was not in the boulevard and was not a $1,000 tree. He
42 stated he would not be paying the City$500 and if he continued to receive letters from the City he
43 would be taking the next step. He reported the City was taking illegal action against him and
44 reiterated that he would not be paying the $500 bill.

1 Mr. Meyer commented on the mountain of dirt that had been created at Ardan Pond. He expressed
2 concern with the work that was being done noting the project area currently looks terrible.

4 8. COUNCIL BUSINESS
5 A. PUBLIC HEARING: Resolution 10068, Approving a Chicken-Keeping
6 License for Shelly Rosene, 2809 County Road H2.

8 City Administrator Zikmund requested the City Council approve a chicken-keeping license for
9 Shelly Rosene at 2809 County Road H2. He reported all necessary paperwork and fees have been
10 submitted to the City and staff recommends approval.
11
12 Mayor Lindstrom opened the public hearing at 6:22 p.m.
13
14 Shelly Rosene,2809 County Road H2,thanked the City for considering her request. She explained
15 she would like to have eight hens on her property.
16
17 Hearing no further public input, Mayor Lindstrom closed the public hearing at 6:23 p.m.

35 ordinances, noting the Council heard the first reading at the February 24, 2025 City Council

6 Public Works/Parks and Recreation Director Peterson requested the Council accept the completed
7 plans and specifications for the 2025 Street Project and authorizing bidding of the Project. He
8 reviewed the roadways that were included in the project area and noted he was working with the
9 City Attorney to expand the City's right of way in some areas. He commented the plan was to put
10 this project out for bid on March 14 with a bid opening held on April 4. The Council would then
1 1 accept the bids and award the contract on April 14.

t t Council Member Gunn stated the Mounds View Police Foundation was selling little Grizz dolls
12 for $20 to raise funds for the police foundation. She indicated Coffee with a Cop would be held
13 next on Saturday, March 29.

15 Mayor Lindstrom asked if the City Council would be meeting with Ramsey County on March 17.
16 City Administrator Zikmund reported the Council would be meeting with Ramsey County on April

19 Mayor Lindstrom reported he attended a Regional Council of Mayors meeting earlier in the day
20 where the group received an update from ICE and the BCA.

22 Mayor Lindstrom stated he attended a nine-hour clemency meeting last Friday.

36 pipe service lines, but noted testing was still required for 15 houses built from 1983 and 1985.

2 improvement project. He explained the City could not do anything until the project was closed out.
3 He reported both J Con and Schifsky went out of business. He noted once the project was closed
4 out the warranty work on the concrete could be addressed.

6 City Administrator Zikmund reviewed a list of grants the City could pursue and stated he would
7 like the Council to further review this list at the strategic planning meeting on Monday,March 17.

9 City Administrator Zikmund reported he along with Council members Gunn and Meehlhause
10 attended City on the Hill and had a meeting with Representative Moller where missing middle
11 housing was discussed.

13 City Administrator Zikmund indicated he had two resident families reach out to him regarding the
14 I-35W Bridge Collapse. He stated he invited these families to participate in the grand opening for
15 the Tribute Park.

The attached resolution adopts a calendar for preparation of the 2026 Budget. There are
several requirements in the City Charter and State Statutes that need to be met. The
calendar lists many staff work start and due dates. Items in bold type are City Council

The resolution only lists City Council meeting dates or other dates of significance to the City
Council. Staff will publish a copy of the calendar in the Mounds View Matters and on our

COUNTY OF RAMSEY
STATE OF MINNESOTA
ADOPTING A CALENDAR FOR THE PREPARATION OF THE 2026 BUDGET
WHEREAS, the City's Charter and Code as well as State Statutes set forth various
requirements for considering and adopting components of the City's budget; and
WHEREAS, Section 7.04 of the City Charter requires the City Administrator to submit to the
City Council a budget calendar to be established by resolution, and
WHEREAS, the calendar is an approximate schedule of when these actions will take place
but is not an absolute timeline.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds View that
the following budget calendar is hereby adopted:
April - May City Council discusses budget priorities at a work session.
June Summary of General Fund operating budget requests delivered to City
Council.
June -Aug City Council reviews General Fund budget at work session(s).
Aug. 25, 2025 City Council adopts preliminary 2026 property tax levy or defers to
September 8t" meeting and sets date for the Truth in Taxation Public
Hearing.
Sept- Nov City Council reviews other funds and utility rate study at work session(s).
November City Council considers utility rates for 2026.
Dec. 1, 2025 Truth in Taxation Public Hearing.

Introduction:
The State of Minnesota Joint Powers Agreements with the City of Mounds View on
behalf of its city attorney needs to be renewed.
Discussion:
The City of Mounds View on behalf of its Prosecuting Attorney desires to enter into
Joint Powers Agreements with the State of Minnesota, Department of Public Safety,
Bureau of Criminal Apprehension to use systems and tools available over the State's
criminal justice data communications network for which the City is eligible. The Joint
Powers Agreements further provide the City with the ability to add, modify and delete
connectivity, systems and tools over the five-year life of the agreement and obligates
the City to pay the costs for the network connection.
The City Prosecutor- Katrina Joseph, or her successor, is designated the Authorized
Representative for the Prosecuting Attorney. The Authorized Representative is also
authorized to sign any subsequent amendment or agreement that may be required by
the State of Minnesota to maintain the City's connection to the systems and tools
offered by the State.
Recommendation:
Staff recommends authorizing State of Minnesota Joint Powers Agreements with the
City of Mounds View on behalf of its city attorney.

Minnesota acting through its Department of Public Safety, Bureau of Criminal
Apprehension and the City of Mounds View on behalf of its Prosecuting Attorney, are
hereby approved.
2. That the City Prosecutor- Katrina Joseph, or her successor, is designated the
Authorized Representative for the Prosecuting Attorney. The Authorized
Representative is also authorized to sign any subsequent amendment or agreement
that may be required by the State of Minnesota to maintain the City's connection to the
systems and tools offered by the State.
3. That Zach Lindstrom, the Mayor for the City of Mounds View, and Nyle Zikmund, the
City Administrator, are authorized to sign the State of Minnesota Joint Powers
Agreements.

COURT DATA SERVICES SUBSCRIBER AMENDMENT TO
CJDN SUBSCRIBER AGREEMENT
This Court Data Services Subscriber Amendment ("Subscriber Amendment") is entered into by the
State of Minnesota, acting through its Department of Public Safety, Bureau of Criminal
Apprehension, ("BCA") and the City of Mounds View on behalf of its Prosecuting Attorney
("Agency"), and by and for the benefit of the State of Minnesota acting through its State Court
Administrator's Office ("Court") who shall be entitled to enforce any provisions hereof through any
legal action against any party.
Recitals
This Subscriber Amendment modifies and supplements the Agreement between the BCA and
Agency, SWIFT Contract number 264316, of even or prior date, for Agency use of BCA systems
and tools (referred to herein as "the CJDN Subscriber Agreement"). Certain BCA systems and
tools that include access to and/or submission of Court Records may only be utilized by the Agency
if the Agency completes this Subscriber Amendment. The Agency desires to use one or more BCA
systems and tools to access and/or submit Court Records to assist the Agency in the efficient
performance of its duties as required or authorized by law or court rule. Court desires to permit
such access and/or submission. This Subscriber Amendment is intended to add Court as a party to
the CJDN Subscriber Agreement and to create obligations by the Agency to the Court that can be
enforced by the Court. It is also understood that, pursuant to the Master Joint Powers Agreement for
Delivery of Court Data Services to CJDN Subscribers ("Master Authorization Agreement")
between the Court and the BCA, the BCA is authorized to sign this Subscriber Amendment on
behalf of Court. Upon execution the Subscriber Amendment will be incorporated into the CJDN
Subscriber Agreement by reference. The BCA, the Agency and the Court desire to amend the
CJDN Subscriber Agreement as stated below.
The CJDN Subscriber Agreement is amended by the addition of the following provisions:
1. TERM; TERMINATION; ONGOING OBLIGATIONS. This Subscriber
Amendment shall be effective on the date finally executed by all parties and shall remain in effect
until expiration or termination of the CJDN Subscriber Agreement unless terminated earlier as
provided in this Subscriber Amendment. Any party may terminate this Subscriber Amendment
with or without cause by giving written notice to all other parties. The effective date of the
termination shall be thirty days after the other party's receipt of the notice of termination, unless a
later date is specified in the notice. The provisions of sections 5 through 9, 12.b., 12.c., and 15
through 24 shall survive any termination of this Subscriber Amendment as shall any other
provisions which by their nature are intended or expected to survive such termination. Upon
termination, the Subscriber shall perform the responsibilities set forth in paragraph 7(f) hereof.
2. Definitions. Unless otherwise specifically defined, each term used herein shall have
the meaning assigned to such term in the CJDN Subscriber Agreement.

a. "Authorized Court Data Services" means Court Data Services that have
been authorized for delivery to CJDN Subscribers via BCA systems and tools pursuant to an
Authorization Amendment to the Joint Powers Agreement for Delivery of Court Data
Services to CJDN Subscribers ("Master Authorization Agreement") between the Court and
the BCA.
b. "Court Data Services" means one or more of the services set forth on the
Justice Agency Resource webpage of the Minnesota Judicial Branch website (for which the
current address is www.courts.state.mn.us) or other location designated by the Court, as the
same may be amended from time to time by the Court.
C. "Court Records" means all information in any form made available by the
Court to Subscriber through the BCA for the purposes of carrying out this Subscriber
Amendment, including:
i. "Court Case Information" means any information in the Court Records
that conveys information about a particular case or controversy, including
without limitation Court Confidential Case Information, as defined
herein.
ii. "Court Confidential Case Information" means any information in the
Court Records that is inaccessible to the public pursuant to the Rules of
Public Access and that conveys information about a particular case or
controversy.
iii. "Court Confidential Security and Activation Information" means any
information in the Court Records that is inaccessible to the public
pursuant to the Rules of Public Access and that explains how to use or
gain access to Court Data Services, including but not limited to login
account names, passwords, TCP/IP addresses, Court Data Services user
manuals, Court Data Services Programs, Court Data Services Databases,
and other technical information.
iv. "Court Confidential Information" means any information in the Court
Records that is inaccessible to the public pursuant to the Rules of Public
Access, including without limitation both i) Court Confidential Case
Information; and ii) Court Confidential Security and Activation
Information.
d. "DCA" shall mean the district courts of the state of Minnesota and their
respective staff.
e. "Policies & Notices" means the policies and notices published by the Court
in connection with each of its Court Data Services, on a website or other location designated
by the Court, as the same may be amended from time to time by the Court. Policies &
Notices for each Authorized Court Data Service identified in an approved request form
under section 3, below, are hereby made part of this Subscriber Amendment by this
reference and provide additional terms and conditions that govern Subscriber's use of Court
Records accessed through such services, including but not limited to provisions on access
and use limitations.

f. "Rules of Public Access" means the Rules of Public Access to Records of
the Judicial Branch promulgated by the Minnesota Supreme Court, as the same may be
amended from time to time, including without limitation lists or tables published from time
to time by the Court entitled Limits on Public Access to Case Records or Limits on Public
Access to Administrative Records, all of which by this reference are made a part of this
Subscriber Amendment. It is the obligation of Subscriber to check from time to time for
updated rules, lists, and tables and be familiar with the contents thereof. It is contemplated
that such rules, lists, and tables will be posted on the Minnesota Judicial Branch website, for
which the current address is www.courts.state.mn.us.
g. "Court" shall mean the State of Minnesota, State Court Administrator's
Office.
h. "Subscriber" shall mean the Agency.
i. "Subscriber Records" means any information in any form made available
by the Subscriber to the Court for the purposes of carrying out this Subscriber Amendment.
3. REQUESTS FOR AUTHORIZED COURT DATA SERVICES. Following
execution of this Subscriber Amendment by all parties, Subscriber may submit to the BCA one or
more separate requests for Authorized Court Data Services. The BCA is authorized in the Master
Authorization Agreement to process, credential and approve such requests on behalf of Court and
all such requests approved by the BCA are adopted and incorporated herein by this reference the
same as if set forth verbatim herein.
a. Activation. Activation of the requested Authorized Court Data Service(s)
shall occur promptly following approval.
b. Rejection. Requests may be rejected for any reason, at the discretion of the
BCA and/or the Court.
C. Requests for Termination of One or More Authorized Court Data
Services. The Subscriber may request the termination of an Authorized Court Data Services
previously requested by submitting a notice to Court with a copy to the BCA. Promptly
upon receipt of a request for termination of an Authorized Court Data Service, the BCA will
deactivate the service requested. The termination of one or more Authorized Court Data
Services does not terminate this Subscriber Amendment. Provisions for termination of this
Subscriber Amendment are set forth in section 1. Upon termination of Authorized Court
Data Services, the Subscriber shall perform the responsibilities set forth in paragraph 7(f)
hereof.
4. SCOPE OF ACCESS TO COURT RECORDS LIMITED. Subscriber's access to
and/or submission of the Court Records shall be limited to Authorized Court Data Services
identified in an approved request form under section 3, above, and other Court Records necessary
for Subscriber to use Authorized Court Data Services. Authorized Court Data Services shall only be
used according to the instructions provided in corresponding Policies & Notices or other materials
and only as necessary to assist Subscriber in the efficient performance of Subscriber's duties

required or authorized by law or court rule in connection with any civil, criminal, administrative, or
arbitral proceeding in any Federal, State, or local court or agency or before any self-regulatory
body. Subscriber's access to the Court Records for personal or non-official use is prohibited.
Subscriber will not use or attempt to use Authorized Court Data Services in any manner not set
forth in this Subscriber Amendment, Policies & Notices, or other Authorized Court Data Services
documentation, and upon any such unauthorized use or attempted use the Court may immediately
terminate this Subscriber Amendment without prior notice to Subscriber.
5. GUARANTEES OF CONFIDENTIALITY. Subscriber agrees:
a. To not disclose Court Confidential Information to any third party except
where necessary to carry out the Subscriber's duties as required or authorized by law or
court rule in connection with any civil, criminal, administrative, or arbitral proceeding in
any Federal, State, or local court or agency or before any self-regulatory body.
b. To take all appropriate action, whether by instruction, agreement, or
otherwise, to insure the protection, confidentiality and security of Court Confidential
Information and to satisfy Subscriber's obligations under this Subscriber Amendment.
C. To limit the use of and access to Court Confidential Information to
Subscriber's bona fide personnel whose use or access is necessary to effect the purposes of
this Subscriber Amendment, and to advise each individual who is permitted use of and/or
access to any Court Confidential Information of the restrictions upon disclosure and use
contained in this Subscriber Amendment, requiring each individual who is permitted use of
and/or access to Court Confidential Information to acknowledge in writing that the
individual has read and understands such restrictions. Subscriber shall keep such
acknowledgements on file for one year following termination of the Subscriber Amendment
and/or CJDN Subscriber Agreement, whichever is longer, and shall provide the Court with
access to, and copies of, such acknowledgements upon request. For purposes of this
Subscriber Amendment, Subscriber's bona fide personnel shall mean individuals who are
employees of Subscriber or provide services to Subscriber either on a voluntary basis or as
independent contractors with Subscriber.
d. That, without limiting section 1 of this Subscriber Amendment, the
obligations of Subscriber and its bona fide personnel with respect to the confidentiality and
security of Court Confidential Information shall survive the termination of this Subscriber
Amendment and the CJDN Subscriber Agreement and the termination of their relationship
with Subscriber.
e. That, notwithstanding any federal or state law applicable to the nondisclosure
obligations of Subscriber and Subscriber's bona fide personnel under this Subscriber
Amendment, such obligations of Subscriber and Subscriber's bona fide personnel are
founded independently on the provisions of this Subscriber Amendment.
6. APPLICABILITY TO PREVIOUSLY DISCLOSED COURT RECORDS.
Subscriber acknowledges and agrees that all Authorized Court Data Services and related Court
Records disclosed to Subscriber prior to the effective date of this Subscriber Amendment shall be
subject to the provisions of this Subscriber Amendment.

7. LICENSE AND PROTECTION OF PROPRIETARY RIGHTS. During the
term of this Subscriber Amendment, subject to the terms and conditions hereof, the Court hereby
grants to Subscriber a nonexclusive, nontransferable, limited license to use Court Data Services
Programs and Court Data Services Databases to access or receive the Authorized Court Data
Services identified in an approved request form under section 3, above, and related Court Records.
Court reserves the right to make modifications to the Authorized Court Data Services, Court Data
Services Programs, and Court Data Services Databases, and related materials without notice to
Subscriber. These modifications shall be treated in all respects as their previous counterparts.
a. Court Data Services Programs. Court is the copyright owner and licensor
of the Court Data Services Programs. The combination of ideas, procedures, processes,
systems, logic, coherence and methods of operation embodied within the Court Data
Services Programs, and all information contained in documentation pertaining to the Court
Data Services Programs, including but not limited to manuals, user documentation, and
passwords, are trade secret information of Court and its licensors.
b. Court Data Services Databases. Court is the copyright owner and licensor
of the Court Data Services Databases and of all copyrightable aspects and components
thereof. All specifications and information pertaining to the Court Data Services Databases
and their structure, sequence and organization, including without limitation data schemas
such as the Court XML Schema, are trade secret information of Court and its licensors.
C. Marks. Subscriber shall neither have nor claim any right, title, or interest in
or use of any trademark used in connection with Authorized Court Data Services, including
but not limited to the marks "MNCIS" and"Odyssey."
d. Restrictions on Duplication,Disclosure, and Use. Trade secret information
of Court and its licensors will be treated by Subscriber in the same manner as Court
Confidential Information. In addition, Subscriber will not copy any part of the Court Data
Services Programs or Court Data Services Databases, or reverse engineer or otherwise
attempt to discern the source code of the Court Data Services Programs or Court Data
Services Databases, or use any trademark of Court or its licensors, in any way or for any
purpose not specifically and expressly authorized by this Subscriber Amendment. As used
herein, "trade secret information of Court and its licensors" means any information
possessed by Court which derives independent economic value from not being generally
known to, and not being readily ascertainable by proper means by, other persons who can
obtain economic value from its disclosure or use. "Trade secret information of Court and its
licensors" does not, however, include information which was known to Subscriber prior to
Subscriber's receipt thereof, either directly or indirectly, from Court or its licensors,
information which is independently developed by Subscriber without reference to or use of
information received from Court or its licensors, or information which would not qualify as
a trade secret under Minnesota law. It will not be a violation of this section 7, sub-section d,
for Subscriber to make up to one copy of training materials and configuration
documentation, if any, for each individual authorized to access, use, or configure Authorized
Court Data Services, solely for its own use in connection with this Subscriber Amendment.
Subscriber will take all steps reasonably necessary to protect the copyright, trade secret, and
trademark rights of Court and its licensors and Subscriber will advise its bona fide personnel
who are permitted access to any of the Court Data Services Programs and Court Data
Services Databases, and trade secret information of Court and its licensors, of the
restrictions upon duplication, disclosure and use contained in this Subscriber Amendment.

e. Proprietary Notices. Subscriber will not remove any copyright or
proprietary notices included in and/or on the Court Data Services Programs or Court Data
Services Databases, related documentation, or trade secret information of Court and its
licensors, or any part thereof, made available by Court directly or through the BCA, if any,
and Subscriber will include in and/or on any copy of the Court Data Services Programs or
Court Data Services Databases, or trade secret information of Court and its licensors and any
documents pertaining thereto, the same copyright and other proprietary notices as appear on
the copies made available to Subscriber by Court directly or through the BCA, except that
copyright notices shall be updated and other proprietary notices added as may be
appropriate.
f. Title; Return. The Court Data Services Programs and Court Data Services
Databases, and related documentation, including but not limited to training and
configuration material, if any, and logon account information and passwords, if any, made
available by the Court to Subscriber directly or through the BCA and all copies, including
partial copies, thereof are and remain the property of the respective licensor. Except as
expressly provided in section 12.b., within ten days of the effective date of termination of
this Subscriber Amendment or the CJDN Subscriber Agreement or within ten days of a
request for termination of Authorized Court Data Service as described in section 4,
Subscriber shall either: (i) uninstall and return any and all copies of the applicable Court
Data Services Programs and Court Data Services Databases, and related documentation,
including but not limited to training and configuration materials, if any, and logon account
information, if any; or (2) destroy the same and certify in writing to the Court that the same
have been destroyed.
8. INJUNCTIVE RELIEF. Subscriber acknowledges that the Court, Court's
licensors, and DCA will be irreparably harmed if Subscriber's obligations under this Subscriber
Amendment are not specifically enforced and that the Court, Court's licensors, and DCA would not
have an adequate remedy at law in the event of an actual or threatened violation by Subscriber of its
obligations. Therefore, Subscriber agrees that the Court, Court's licensors, and DCA shall be
entitled to an injunction or any appropriate decree of specific performance for any actual or
threatened violations or breaches by Subscriber or its bona fide personnel without the necessity of
the Court, Court's licensors, or DCA showing actual damages or that monetary damages would not
afford an adequate remedy. Unless Subscriber is an office, officer, agency, department, division, or
bureau of the state of Minnesota, Subscriber shall be liable to the Court, Court's licensors, and DCA
for reasonable attorneys fees incurred by the Court, Court's licensors, and DCA in obtaining any
relief pursuant to this Subscriber Amendment.
9. LIABILITY. Subscriber and the Court agree that, except as otherwise expressly
provided herein, each party will be responsible for its own acts and the results thereof to the extent
authorized by law and shall not be responsible for the acts of any others and the results thereof.
Liability shall be governed by applicable law. Without limiting the foregoing, liability of the Court
and any Subscriber that is an office, officer, agency, department, division, or bureau of the state of
Minnesota shall be governed by the provisions of the Minnesota Tort Claims Act, Minnesota
Statutes, section 3.376, and other applicable law. Without limiting the foregoing, if Subscriber is a
political subdivision of the state of Minnesota, liability of the Subscriber shall be governed by the
provisions of Minn. Stat. Ch. 466 (Tort Liability, Political Subdivisions) or other applicable law.
Subscriber and Court further acknowledge that the liability, if any, of the BCA is governed by a
separate agreement between the Court and the BCA dated December 13, 2010 with DPS-M -0958.

10. AVAILABILITY. Specific terms of availability shall be established by the Court
and communicated to Subscriber by the Court and/or the BCA. The Court reserves the right to
terminate this Subscriber Amendment immediately and/or temporarily suspend Subscriber's
Authorized Court Data Services in the event the capacity of any host computer system or legislative
appropriation of funds is determined solely by the Court to be insufficient to meet the computer
needs of the courts served by the host computer system.

12. ADDITIONAL USER OBLIGATIONS. The obligations of the Subscriber set
forth in this section are in addition to the other obligations of the Subscriber set forth elsewhere in
this Subscriber Amendment.
a. Judicial Policy Statement. Subscriber agrees to comply with all policies
identified in Policies & Notices applicable to Court Records accessed by Subscriber using
Authorized Court Data Services. Upon failure of the Subscriber to comply with such
policies, the Court shall have the option of immediately suspending the Subscriber's
Authorized Court Data Services on a temporary basis and/or immediately terminating this
Subscriber Amendment.
b. Access and Use; Log. Subscriber shall be responsible for all access to and
use of Authorized Court Data Services and Court Records by Subscriber's bona fide
personnel or by means of Subscriber's equipment or passwords, whether or not Subscriber
has knowledge of or authorizes such access and use. Subscriber shall also maintain a log
identifying all persons to whom Subscriber has disclosed its Court Confidential Security and
Activation Information, such as user ID(s) and password(s), including the date of such
disclosure. Subscriber shall maintain such logs for a minimum period of six years from the
date of disclosure, and shall provide the Court with access to, and copies of, such logs upon
request. The Court may conduct audits of Subscriber's logs and use of Authorized Court
Data Services and Court Records from time to time. Upon Subscriber's failure to maintain
such logs, to maintain accurate logs, or to promptly provide access by the Court to such logs,
the Court may terminate this Subscriber Amendment without prior notice to Subscriber.
C. Personnel. Subscriber agrees to investigate, at the request of the Court
and/or the BCA, allegations of misconduct pertaining to Subscriber's bona fide personnel
having access to or use of Authorized Court Data Services, Court Confidential Information,
or trade secret information of the Court and its licensors where such persons are alleged to
have violated the provisions of this Subscriber Amendment, Policies & Notices, Judicial
Branch policies, or other security requirements or laws regulating access to the Court
Records.
d. Minnesota Data Practices Act Applicability. If Subscriber is a Minnesota
Government entity that is subject to the Minnesota Government Data Practices Act, Minn.
Stat. Ch. 13, Subscriber acknowledges and agrees that: (1) the Court is not subject to Minn.
Stat. Ch. 13 (see section 13.90) but is subject to the Rules of Public Access and other rules
promulgated by the Minnesota Supreme Court; (2) Minn. Stat. section 13.03, subdivision
4(e) requires that Subscriber comply with the Rules of Public Access and other rules
promulgated by the Minnesota Supreme Court for access to Court Records provided via the

BCA systems and tools under this Subscriber Amendment; (3) the use of and access to Court
Records may be restricted by rules promulgated by the Minnesota Supreme Court,
applicable state statute or federal law; and (4) these applicable restrictions must be followed
in the appropriate circumstances.
13. FEES; INVOICES. Unless the Subscriber is an office, officer, department,
division, agency, or bureau of the state of Minnesota, Subscriber shall pay the fees, if any, set forth
in applicable Policies & Notices, together with applicable sales, use or other taxes. Applicable
monthly fees commence ten(10) days after notice of approval of the request pursuant to section 3 of
this Subscriber Amendment or upon the initial Subscriber transaction as defined in the Policies &
Notices, whichever occurs earlier. When fees apply, the Court shall invoice Subscriber on a
monthly basis for charges incurred in the preceding month and applicable taxes, if any, and payment
of all amounts shall be due upon receipt of invoice. If all amounts are not paid within 30 days of
the date of the invoice, the Court may immediately cancel this Subscriber Amendment without
notice to Subscriber and pursue all available legal remedies. Subscriber certifies that funds have
been appropriated for the payment of charges under this Subscriber Amendment for the current
fiscal year, if applicable.
14. MODIFICATION OF FEES. Court may modify the fees by amending the Policies
& Notices as provided herein, and the modified fees shall be effective on the date specified in the
Policies & Notices, which shall not be less than thirty days from the publication of the Policies &
Notices. Subscriber shall have the option of accepting such changes or terminating this Subscriber
Amendment as provided in section 1 hereof.
15. WARRANTY DISCLAIMERS.
a. WARRANTY EXCLUSIONS. EXCEPT AS SPECIFICALLY AND
EXPRESSLY PROVIDED HEREIN, COURT, COURT'S LICENSORS, AND DCA
MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, INCLUDING
BUT NOT LIMITED TO THE WARRANTIES OF FITNESS FOR A PARTICULAR
PURPOSE OR MERCHANTABILITY, NOR ARE ANY WARRANTIES TO BE
IMPLIED, WITH RESPECT TO THE INFORMATION, SERVICES OR COMPUTER
PROGRAMS MADE AVAILABLE UNDER THIS AGREEMENT.
b. ACCURACY AND COMPLETENESS OF INFORMATION.
WITHOUT LIMITING THE GENERALITY OF THE PRECEDING PARAGRAPH,
COURT, COURT'S LICENSORS, AND DCA MAKE NO WARRANTIES AS TO THE
ACCURACY OR COMPLETENESS OF THE INFORMATION CONTAINED IN THE
COURT RECORDS.
16. RELATIONSHIP OF THE PARTIES. Subscriber is an independent contractor
and shall not be deemed for any purpose to be an employee, partner, agent or franchisee of the
Court, Court's licensors, or DCA. Neither Subscriber nor the Court, Court's licensors, or DCA
shall have the right nor the authority to assume, create or incur any liability or obligation of any
kind, express or implied, against or in the name of or on behalf of the other.
17. NOTICE. Except as provided in section 2 regarding notices of or modifications to
Authorized Court Data Services and Policies & Notices, any notice to Court or Subscriber

hereunder shall be deemed to have been received when personally delivered in writing or seventy-
two (72) hours after it has been deposited in the United States mail, first class, proper postage
prepaid, addressed to the party to whom it is intended at the address set forth on page one of this
Agreement or at such other address of which notice has been given in accordance herewith.
18. NON-WAIVER. The failure by any party at any time to enforce any of the
provisions of this Subscriber Amendment or any right or remedy available hereunder or at law or in
equity, or to exercise any option herein provided, shall not constitute a waiver of such provision,
remedy or option or in any way affect the validity of this Subscriber Amendment. The waiver of
any default by either Party shall not be deemed a continuing waiver, but shall apply solely to the
instance to which such waiver is directed.
19. FORCE MAJEURE. Neither Subscriber nor Court shall be responsible for failure
or delay in the performance of their respective obligations hereunder caused by acts beyond their
reasonable control.
20. SEVERABILITY. Every provision of this Subscriber Amendment shall be
construed, to the extent possible, so as to be valid and enforceable. If any provision of this
Subscriber Amendment so construed is held by a court of competent jurisdiction to be invalid,
illegal or otherwise unenforceable, such provision shall be deemed severed from this Subscriber
Amendment, and all other provisions shall remain in full force and effect.
21. ASSIGNMENT AND BINDING EFFECT. Except as otherwise expressly
permitted herein, neither Subscriber nor Court may assign, delegate and/or otherwise transfer this
Subscriber Amendment or any of its rights or obligations hereunder without the prior written
consent of the other. This Subscriber Amendment shall be binding upon and inure to the benefit of
the Parties hereto and their respective successors and assigns, including any other legal entity into,
by or with which Subscriber may be merged, acquired or consolidated.
22. GOVERNING LAW. This Subscriber Amendment shall in all respects be
governed by and interpreted, construed and enforced in accordance with the laws of the United
States and of the State of Minnesota.
23. VENUE AND JURISDICTION. Any action arising out of or relating to this
Subscriber Amendment, its performance, enforcement or breach will be venued in a state or federal
court situated within the State of Minnesota. Subscriber hereby irrevocably consents and submits
itself to the personal jurisdiction of said courts for that purpose.
24. INTEGRATION. This Subscriber Amendment contains all negotiations and
agreements between the parties. No other understanding regarding this Subscriber Amendment,
whether written or oral, may be used to bind either party, provided that all terms and conditions of
the CJDN Subscriber Agreement and all previous amendments remain in full force and effect
except as supplemented or modified by this Subscriber Amendment.

Joint Powers Agreement
MINNeSOTA
This Agreement is between the State of Minnesota, acting through its Department of Public Safety on behalf of the
Bureau of Criminal Apprehension ("BCA"), and the City of Mounds View on behalf of its Prosecuting Attorney
("Governmental Unit").The BCA and the Governmental Unit may be referred to jointly as "Parties."
Recitals
Under Minn. Stat. §471.59,the BCA and the Governmental Unit are empowered to engage in agreements that are
necessary to exercise their powers. Under Minn. Stat. § 299C.46,the BCA must provide a criminal justice data
communications network to benefit political subdivisions as defined under Minn. Stat. § 299C.46, subd. 2 and subd. 2(a).
The Governmental Unit is authorized by law to utilize the criminal justice data communications network pursuant to the
terms set out in this Agreement. In addition, BCA either maintains repositories of data or has access to repositories of
data that benefit authorized political subdivisions in performing their duties. The Governmental Unit wants to access
data in support of its official duties.
The purpose of this Agreement is to create a method by which the Governmental Unit has access to those systems and
tools for which it has eligibility, and to memorialize the requirements to obtain access and the limitations on the access.
Agreement
1 Term of Agreement
1.1 Effective Date.This Agreement is effective on the date the BCA obtains all required signatures under Minn.
Stat. § 16C.05, subdivision 2.
1.2 Expiration Date.This Agreement expires five years from the date it is effective.
2 Agreement Between the Parties
2.1 General Access. BCA agrees to provide Governmental Unit with access to the Minnesota Criminal Justice
Data Communications Network(CJDN) and those systems and tools which the Governmental Unit is
authorized by law to access via the CJDN for the purposes outlined in Minn. Stat. § 299C.46.
2.2 Methods of Access.
The BCA offers three (3) methods of access to its systems and tools. The methods of access are:
A. Direct access occurs when individual users at the Governmental Unit use the Governmental Unit's
equipment to access the BCA's systems and tools. This is generally accomplished by an individual user
entering a query into one of BCA's systems or tools.
B. Indirect Access occurs when individual users at the Governmental Unit go to another Governmental
Unit to obtain data and information from BCA's systems and tools. This method of access generally
results in the Governmental Unit with indirect access obtaining the needed data and information in a
physical format like a paper report.
C. Computer-to-Computer System Interface occurs when the Governmental Unit's computer exchanges
data and information with BCA's computer systems and tools using an interface. Without limitation,
interface types include: state message switch,web services, enterprise service bus and message
queuing.
For purposes of this Agreement, Governmental Unit employees or contractors may use any of these
methods to use BCA's systems and tools as described in this Agreement. Governmental Unit will select a

method of access and can change the methodology following the process in Clause 2.10.
2.3 Federal Systems Access. In addition, pursuant to 28 CFR §20.30-38 and Minn. Stat. §299C.58, BCA may
provide Governmental Unit with access to the Federal Bureau of Investigation (FBI) National Crime
Information Center.
2.4 Governmental Unit Policies. Both the BCA and the FBI's Criminal Justice Information Systems (FBI-CJIS) have
policies, regulations and laws on access, use, audit, dissemination, hit confirmation, logging, quality
assurance, screening(pre-employment), security,timeliness, training, use of the system, and validation.
Governmental Unit has created its own policies to ensure that Governmental Unit's employees and
contractors comply with all applicable requirements. Governmental Unit ensures this compliance through
appropriate enforcement.These BCA and FBI-CJIS policies and regulations, as amended and updated from
time to time, are incorporated into this Agreement by reference. The policies are available at

2.5 Governmental Unit Resources.To assist Governmental Unit in complying with the federal and state
requirements on access to and use of the various systems and tools, information is available at
https://sps.x.state.mn.us/sites/bcaservicecatalog/default.aspx. Additional information on appropriate use is
found in the Minnesota Bureau of Criminal Apprehension Policy on Appropriate Use of Systems and Data
available at https://bcanextest.x.state.mn.us/launchpad/coisdocs/docs.cgi?cmd=FS&ID=795&TYPE=DOCS.
2.6 Access Granted.
A. Governmental Unit is granted permission to use all current and future BCA systems and tools for
which Governmental Unit is eligible. Eligibility is dependent on Governmental Unit (i) satisfying all
applicable federal or state statutory requirements; (ii) complying with the terms of this Agreement;
and (iii) acceptance by BCA of Governmental Unit's written request for use of a specific system or tool.
B. To facilitate changes in systems and tools, Governmental Unit grants its Authorized Representative
authority to make written requests for those systems and tools provided by BCA that the
Governmental Unit needs to meet its criminal justice obligations and for which Governmental Unit is
eligible.
2.7 Future Access. On written request from the Governmental Unit, BCA also may provide Governmental Unit
with access to those systems or tools which may become available after the signing of this Agreement,to
the extent that the access is authorized by applicable state and federal law. Governmental Unit agrees to be
bound by the terms and conditions contained in this Agreement that when utilizing new systems or tools
provided under this Agreement.
2.8 Limitations on Access. BCA agrees that it will comply with applicable state and federal laws when making
information accessible. Governmental Unit agrees that it will comply with applicable state and federal laws
when accessing, entering, using, disseminating, and storing data. Each party is responsible for its own
compliance with the most current applicable state and federal laws.
2.9 Supersedes Prior Agreements.This Agreement supersedes any and all prior agreements between the BCA
and the Governmental Unit regarding access to and use of systems and tools provided by BCA.
2.10 Requirement to Update Information.The parties agree that if there is a change to any of the information
whether required by law or this Agreement, the party will send the new information to the other party in
writing within 30 days of the change.This clause does not apply to changes in systems or tools provided
under this Agreement.
This requirement to give notice additionally applies to changes in the individual or organization serving the
Governmental Unit as its prosecutor.Any change in performance of the prosecutorial function must be
provided to the BCA in writing by giving notice to the Service Desk, BCA.ServiceDesk@state.mn.us.
2.11 Transaction Record.The BCA creates and maintains a transaction record for each exchange of data utilizing
its systems and tools. In order to meet FBI-CJIS requirements and to perform the audits described in Clause
7, there must be a method of identifying which individual users at the Governmental Unit conducted a

particular transaction.
If Governmental Unit uses either direct access as described in Clause 2.2A or indirect access as described in
Clause 2.213, BCA's transaction record meets FBI-CJIS requirements.
When Governmental Unit's method of access is a computer-to-computer interface as described in Clause
2.2C,the Governmental Unit must keep a transaction record sufficient to satisfy FBI-CJIS requirements and
permit the audits described in Clause 7 to occur.
If a Governmental Unit accesses data from the Driver and Vehicle Services Division in the Minnesota
Department of Public Safety and keeps a copy of the data, Governmental Unit must have a transaction
record of all subsequent access to the data that are kept by the Governmental Unit. The transaction record
must include the individual user who requested access, and the date,time and content of the request. The
transaction record must also include the date,time and content of the response along with the destination
to which the data were sent. The transaction record must be maintained for a minimum of six(6)years
from the date the transaction occurred and must be made available to the BCA within one (1) business day
of the BCA's request.
2.12 Court Information Access. Certain BCA systems and tools that include access to and/or submission of Court
Records may only be utilized by the Governmental Unit if the Governmental Unit completes the Court Data
Services Subscriber Amendment, which upon execution will be incorporated into this Agreement by
reference.These BCA systems and tools are identified in the written request made by the Governmental
Unit under Clause 2.6 above.The Court Data Services Subscriber Amendment provides important additional
terms, including but not limited to privacy (see Clause 8.2, below),fees (see Clause 3 below), and transaction
records or logs,that govern Governmental Unit's access to and/or submission of the Court Records
delivered through the BCA systems and tools.
2.13 Vendor Personnel Screening.The BCA will conduct all vendor personnel screening on behalf of
Governmental Unit as is required by the FBI CAS Security Policy.The BCA will maintain records of the
federal, fingerprint-based background check on each vendor employee as well as records of the completion
of the security awareness training that may be relied on by the Governmental Unit.
3 Payment
The Governmental Unit currently accesses the criminal justice data communications network described in Minn.
Stat. §299C.46. At the time this Agreement is signed, BCA understands that a third party will be responsible for
the cost of access.
The Governmental Unit will identify the third party and provide the BCA with the contact information and its
contact person for billing purposes so that billing can be established. The Governmental Unit will provide updated
information to BCA's Authorized Representative within ten business days when this information changes.
If Governmental Unit chooses to execute the Court Data Services Subscriber Amendment referred to in Clause
2.12 in order to access and/or submit Court Records via BCA's systems, additional fees, if any, are addressed in
that amendment.

5 Assignment,Amendments,Waiver, and Agreement Complete
5.1 Assignment. Neither party may assign nor transfer any rights or obligations under this Agreement.
5.2 Amendments.Any amendment to this Agreement, except those described in Clauses 2.6 and 2.7 above
must be in writing and will not be effective until it has been signed and approved by the same parties who
signed and approved the original agreement,their successors in office, or another individual duly
authorized.
5.3 Waiver. If either party fails to enforce any provision of this Agreement,that failure does not waive the
provision or the right to enforce it.
5.4 Agreement Complete.This Agreement contains all negotiations and agreements between the BCA and the
Governmental Unit. No other understanding regarding this Agreement, whether written or oral, may be
used to bind either party.
6 Liability
Each party will be responsible for its own acts and behavior and the results thereof and shall not be responsible or
liable for the other party's actions and consequences of those actions.The Minnesota Torts Claims Act, Minn. Stat.
§ 3.736 and other applicable laws govern the BCA's liability. The Minnesota Municipal Tort Claims Act, Minn. Stat.
Ch. 466 and other applicable laws, governs the Governmental Unit's liability.
7 Audits
7.1 Under Minn. Stat. § 16C.05, subd. 5,the Governmental Unit's books, records, documents, internal policies
and accounting procedures and practices relevant to this Agreement are subject to examination by the BCA,
the State Auditor or Legislative Auditor, as appropriate,for a minimum of six years from the end of this
Agreement.
Under Minn. Stat. §6.551,the State Auditor may examine the books, records, documents, and accounting
procedures and practices of BCA.The examination shall be limited to the books, records, documents, and
accounting procedures and practices that are relevant to this Agreement.
7.2 Under applicable state and federal law,the Governmental Unit's records are subject to examination by the
BCA to ensure compliance with laws, regulations and policies about access, use, and dissemination of data.
7.3 If the Governmental Unit accesses federal databases,the Governmental Unit's records are subject to
examination by the FBI and BCA;the Governmental Unit will cooperate with FBI and BCA auditors and make
any requested data available for review and audit.
7.4 If the Governmental Unit accesses state databases,the Governmental Unit's records are subject to
examination by the BCA:the Governmental Unit will cooperate with the BCA auditors and make any
requested data available for review and audit.

7.5 To facilitate the audits required by state and federal law, Governmental Unit is required to have an
inventory of the equipment used to access the data covered by this Agreement and the physical location of
each.
8 Government Data Practices
8.1 BCA and Governmental Unit.The Governmental Unit and BCA must comply with the Minnesota
Government Data Practices Act, Minn. Stat. Ch. 13, as it applies to all data accessible under this Agreement,
and as it applies to all data created, collected, received, stored, used, maintained, or disseminated by the
Governmental Unit under this Agreement.The remedies of Minn. Stat. §§ 13.08 and 13.09 apply to the
release of the data referred to in this clause by either the Governmental Unit or the BCA.
8.2 Court Records. If Governmental Unit chooses to execute the Court Data Services Subscriber Amendment
referred to in Clause 2.12 in order to access and/or submit Court Records via BCA's systems,the following
provisions regarding data practices also apply. The Court is not subject to Minn.Stat. Ch. 13 but is subject to
the Rules of Public Access to Records of the Judicial Branch promulgated by the Minnesota Supreme Court.
All parties acknowledge and agree that Minn. Stat. § 13.03, subdivision 4(e) requires that the BCA and the
Governmental Unit comply with the Rules of Public Access for those data received from Court under the
Court Data Services Subscriber Amendment. All parties also acknowledge and agree that the use of, access
to or submission of Court Records, as that term is defined in the Court Data Services Subscriber Amendment,
may be restricted by rules promulgated by the Minnesota Supreme Court, applicable state statute or federal
law. All parties acknowledge and agree that these applicable restrictions must be followed in the
appropriate circumstances.
9 Investigation of Alleged Violations; Sanctions
For purposes of this clause, "Individual User" means an employee or contractor of Governmental Unit.
9.1 Investigation.The Governmental Unit and BCA agree to cooperate in the investigation and possible
prosecution of suspected violations of federal and state law referenced in this Agreement. Governmental
Unit and BCA agree to cooperate in the investigation of suspected violations of the policies and procedures
referenced in this Agreement. When BCA becomes aware that a violation may have occurred, BCA will
inform Governmental Unit of the suspected violation, subject to any restrictions in applicable law.When
Governmental Unit becomes aware that a violation has occurred, Governmental Unit will inform BCA
subject to any restrictions in applicable law.
9.2 Sanctions Involving Only BCA Systems and Tools.
The following provisions apply to BCA systems and tools not covered by the Court Data Services Subscriber
Amendment. None of these provisions alter the Governmental Unit internal discipline processes, including
those governed by a collective bargaining agreement.
9.2.1 For BCA systems and tools that are not covered by the Court Data Services Subscriber Amendment,
Governmental Unit must determine if and when an involved Individual User's access to systems or
tools is to be temporarily or permanently eliminated.The decision to suspend or terminate access
may be made as soon as alleged violation is discovered, after notice of an alleged violation is
received, or after an investigation has occurred. Governmental Unit must report the status of the
Individual User's access to BCA without delay. BCA reserves the right to make a different
determination concerning an Individual User's access to systems or tools than that made by
Governmental Unit and BCA's determination controls.
9.2.2 If BCA determines that Governmental Unit has jeopardized the integrity of the systems or tools
covered in this Clause 9.2, BCA may temporarily stop providing some or all the systems or tools
under this Agreement until the failure is remedied to the BCA's satisfaction. If Governmental Unit's
failure is continuing or repeated, Clause 11.1 does not apply and BCA may terminate this Agreement
immediately.

9.3 Sanctions Involving Only Court Data Services
The following provisions apply to those systems and tools covered by the Court Data Services Subscriber
Amendment, if it has been signed by Governmental Unit.As part of the agreement between the Court and
the BCA for the delivery of the systems and tools that are covered by the Court Data Services Subscriber
Amendment, BCA is required to suspend or terminate access to or use of the systems and tools either on its
own initiative or when directed by the Court. The decision to suspend or terminate access may be made as
soon as an alleged violation is discovered, after notice of an alleged violation is received, or after an
investigation has occurred. The decision to suspend or terminate may also be made based on a request
from the Authorized Representative of Governmental Unit. The agreement further provides that only the
Court has the authority to reinstate access and use.
9.3.1 Governmental Unit understands that if it has signed the Court Data Services Subscriber Amendment
and if Governmental Unit's Individual Users violate the provisions of that Amendment, access and
use will be suspended by BCA or Court. Governmental Unit also understands that reinstatement is
only at the direction of the Court.
9.3.2 Governmental Unit further agrees that if Governmental Unit believes that one or more of its
Individual Users have violated the terms of the Amendment, it will notify BCA and Court so that an
investigation as described in Clause 9.1 may occur.
10 Venue
Venue for all legal proceedings involving this Agreement, or its breach, must be in the appropriate state or federal
court with competent jurisdiction in Ramsey County, Minnesota.
11 Termination
11.1 Termination.The BCA or the Governmental Unit may terminate this Agreement at any time,with or without
cause, upon 30 days' written notice to the other party's Authorized Representative.
11.2 Termination for Insufficient Funding. Either party may immediately terminate this Agreement if it does not
obtain funding from the Minnesota Legislature, or other funding source; or if funding cannot be continued
at a level sufficient to allow for the payment of the services covered here.Termination must be by written
notice to the other party's authorized representative.The Governmental Unit is not obligated to pay for any
services that are provided after notice and effective date of termination. However, the BCA will be entitled
to payment, determined on a pro rata basis,for services satisfactorily performed to the extent that funds
are available. Neither party will be assessed any penalty if the agreement is terminated because of the
decision of the Minnesota Legislature, or other funding source, not to appropriate funds. Notice of the lack
of funding must be provided within a reasonable time of the affected party receiving that notice.
12 Continuing Obligations
The following clauses survive the expiration or cancellation of this Agreement: Liability; Audits; Government Data
Practices; 9. Investigation of Alleged Violations; Sanctions; and Venue.

Introduction:
On April 24, 2023, the City Council adopted Resolution 9744 which approved the Police
Referral Policy and Police Tuition Reimbursement Policy. The policy states employees
will receive 50% of tuition prior to the class beginning and 50% when the course is
successfully completed. On June 24, 2024, the City Council adopted Resolution 9943,
authorizing the recruitment of Community Service Officers (CSO) at the City, which is a
way to prepare Law Enforcement students on the job training to become Police Officers
for the City of Mounds View. CSOs are eligible to use the Police Tuition Reimbursement
Policy.
Discussion:
To encourage current and future Community Service Officers to stay with the City of
Mounds View, staff is requesting to go outside the parameters of the Police Tuition
Reimbursement Policy and pay up front for the final required course, SKILLS, to become
a Police Officer in Minnesota for CSO Asa Overton.
CSO Overton has proven to be an asset to the Police Department and is willing to become
a sworn Mounds View Police Officer after completing the SKILLS requirement. Staff and
the HR Committee support the request. The policy will be followed for reimbursement if
requirements for course completion are not met.
Recommendation:
Staff is recommending approval of Resolution 10078, Authorization to Pay in Advance
Complete Tuition for CSO Asa Overton, which is Outside the Police Department Tuition
Reimbursement Policy.

MAYOR HOWARD NEISEN
WHEREAS, the City of Mounds View, Minnesota, mourns the passing of
Howard Neisen, a dedicated public servant and former Mayor of our city; and
WHEREAS, Mayor Neisen served the residents of Mounds View in 1970 and
1971 as Council Member and 1972 through 1974 as Mayor of the City of Mounds
View; and
WHEREAS, Mayor Neisen also served as a Minnesota State Representative from
1975 through 1978; and
WHEREAS, Mayor Neisen served our community with steadfast commitment
and a genuine passion for our community; and
WHEREAS, we remember Mayor Neisen not only for his professional
accomplishments but also for his creativity, warmth, kindness, and dedication not only
to the residents of Mounds View, but to his family and many friends; and
WHEREAS, the City of Mounds View will honor the memory of Mayor Neisen
by donating to the American Parkinson Disease Association, Minnesota Chapter.

Introduction:
Three parcels in the City along and near Mounds View Boulevard are ripe for redevelopment and
City staff has discussed rezoning them to B-3 Highway Business to be ready. They are 2833
Mounds View Blvd (owned by the City), 2840 Mounds View Blvd (former Simon's, owned by
Phoenix Realty, LLC), and 7861 Groveland Road (behind Simon's, owned by the City), illustrated
on the next page. The 2833 parcel is currently R-1, the other two are currently B-2. All are being
rezoned to B-3 because that zone allows drive-thru businesses, which are a possibility for the
sites. A fourth commercial parcel at 2848 Mounds View Blvd may redevelop, but it is already
zoned B-3. The City-owned site at 2716 Hillview Road, now zoned R-1, has been discussed for
redevelopment, but is not part of this rezoning action at this time. All of these sites are shown on
the maps on the next page.
The Mounds View Planning and Zoning Commission reviewed the proposed rezonings and
adopted Resolutions 1178-25, 1179-25, and 1180-25 recommending City Council approval.
Recommendation:
Staff recommends conducting the introduction and first reading of Ordinances 1038, 1038, and
1039 by a motion

Introduction:
The Mounds View Zoning Code currently has minimum size and frontage requirements for
planned unit developments (PUDs). City staff has discussed removing these minimums to allow
properties of any size to be processed as a PUD. The attached ordinance would accomplish this
by removing standards in three sections of the ordinance. The size and frontage limits are not
needed, we believe, and hamper reasonable development and redevelopment of smaller parcels.
The pertinent code sections are as follows, with strikeout text noting what is recommended for
deletion. Standards relating to parcel size and required frontage are in three separate sections,
relating to residential, commercial or industrial, and mixed use PUDs. The size limits for these
three types of PUDs are currently 3 acres, 5 acres, and 4 acres, respectively, and 200 feet of
street frontage:
160.317 SPECIAL REQUIREMENTS AND STANDARDS.
(A) Residential planned unit development.
(1) Purpose. It is the intent of this division (A) to establish special requirements for the
granting of a conditional use permit for residential PUD projects which are in compliance
with the permitted and conditional uses allowed in a specific district, including dwellings,
offices and institutional uses of one or more buildings in relation to an overall design and
integrated physical plan and in accordance with the provisions and procedures as
prescribed in this chapter.

Staff keeps a running list of proposed revisions needed to the Mounds View City Code.
We bring before you the remaining three proposed ordinances from our recent code
update.
Discussion:
Here is a brief description of the proposed ordinance changes to the City Code:
Ordinance 1034, Chapter 90 — Remove City dog licensing requirement and change the
number of dogs allowed without a kennel license from two to four.
Ordinance 1035, Chapter 160 — Revise fence diagram and revise Zoning Code noise
control to be consistent with Chapter 91, Nuisances (from 6:00 a.m. to 7:00 a.m.)
Ordinance 1036, Chapter 161 — Revise language regarding non-commercial signs.
City Council has not yet reviewed these three proposed ordinances.

SECTION 2. The City Council of the City of Mounds View hereby amends Title IX,
General Regulations; Chapter 90: Animals and Animal Control, Section 90.003 Dogs, by
inserting the underlined language and removing the skee language as follows:
§ 90.003 DOGS.
(A) Dog at large prohibited. A dog owner violates this section if his or her dog is at large.
(B) Howling and barking. A dog owner violates this section if the dog which, by frequent
and habitual howling, yelping, barking or otherwise, causes annoyance or
disturbance to two or more persons; provided that, the provisions of this section
shall not apply to duly authorized hospitals or clinics conducted for the treatment of
small animals.
(C) Clean up. Any owner or person having the custody or control of any dog shall:
(1) Not permit the dog to be on public property or the property of another without
having in his or her immediate possession a device for the collection and removal of feces
to a proper receptacle;

(2) Remove feces left by a dog to a proper receptacle located on the owner's or
custodian's property; except that, droppings in a park may be placed in an outside park
trash container; and
(3) The provisions of this section shall not apply to a blind person with a guide dog

(D) Damage to property. No dog owner shall permit a dog to damage any lawn, garden
or other property.

(F) Rabies Inoculation/Dog bites.
(1) Rabies inoculation. No owner shall own a dog over six months of age
without obtaining a rabies inoculation certificate from a veterinarian showing that
the dog has been inoculated for rabies and the owner shall keep that certificate
current.
--+l-) Whenever a dog has bitten a human or a domestic or farm animal, the dog
shall be impounded or confined for a period of ten days or more at the expense of the
owner of the dog. Except for the time limit, disposition or redemption shall be in
accordance with provisions of this chapter. The impoundment or confinement may be
waived whenever the dog owner presents to any police officer or a police officer a
certificate of a licensed veterinarian indicating that the dog has been vaccinated for rabies
on a date not less than 24 months prior to the date of the bite.
(� (3) A dog owner will not keep a dog that has been bitten by any animal known to
have been afflicted with rabies. A dog owner who has a dog which has been bitten by an
animal known to have been afflicted with rabies shall, upon demand of any police officer
or any police officer of the city, surrender the dog to the officer for observation and/or
treatment. With the approval of the officer, the dog may be surrendered to a registered
veterinarian or to any approved non-profit corporation organized for the purpose of
sheltering dogs.
{� Impoundment and redemption.
(2) Release. Upon n,irnhase or presentation of a GUrrent liGenso tan and a receipt for
the fees required above, the pound shall release the dog to its GWRer up and adequate
proof of ownership, the pound shall release the dog to its owner.

(7) No person, firm, or corporation shall establish, maintain, conduct, or operate a
kennel without first obtaining a license therefor from the City of Mounds View. A
license shall also be obtained by State of Minnesota Board of Animal Health, which

required by the State, proof of exemption is required.
SECTION 3. The City Council of the City of Mounds View hereby amends Title IX,
General Regulations; Chapter 90: Animals and Animal Control, Section 90.004,
Prohibited Activities, by inserting the underlined language as follows:
§ 90.004 PROHIBITED ACTIVITIES.
(A) Vicious animals. No owner shall keep, or allow on his or her premises, or allow to
run at large any vicious animal. Upon conviction for violation of this section, the court may
in addition to imposition of sentence, direct the animal control officer to take the animal
into custody and forthwith dispose of it in a humane manner.
(B) Cruelty to animals. No person shall inhumanely, unnecessarily, cruelly or wantonly
beat, injure, torment or otherwise abuse an animal or cause or permit an animal fight.
(C) Liability for pets. No owner who is exercising due care by adequately restraining
or confining an animal, shall be held liable under this section for any harm the animal
causes to any other animal if harmed animal is at large and the harmed animal has
entered the area or territory of the animal being legally restrained or confined.
(D) Numbers of dogs. No owner shall own or harbor on their premises more than
four dogs over six months of age. Harboring for the purpose of fostering or dog
sitting is allowed for a period of no more than sixty (60) cumulative days in any 12=
month period.
SECTION 4. The City Council of the City of Mounds View hereby amends Title IX,
General Regulations; Chapter 90: Animals and Animal Control, Section 90.005 Raising,
Keeping Domestic or Farm Animals, by inserting the underlined language and removing
the str+Eken language as follows:
§ 90.005 RAISING, KEEPING DOMESTIC OR FARM ANIMALS.
(A) Nuisance declared.
(2) Restrictions. It is unlawful for a dog owner to keep or raise more than twe four
dogs, except as allowed under § 90.003(H) of this chapter. It is unlawful to keep or raise
a domestic or farm animal if it creates a public nuisance and adversely affects the public
health and welfare.
SECTION 5. In accordance with Section 3.07 of the City Charter, City staff shall have the

REMOVING FURRIERS FROM THE CITY CODE AND CHAPTER 160.338,
RELATED TO DRIVEWAY REPLACEMENT IN CONJUNCTION
WITH A STREET IMPROVEMENT PROJECT
THE CITY OF MOUNDS VIEW ORDAINS:
SECTION 1. The City Council of the City of Mounds View hereby amends Title XV, Land
Usage, Chapter 160: Zoning, Section 160.030 Fencing, Screening and Landscaping, by
inserting the underlined language and adding a diagram as follows:
§ 160.030 FENCING, SCREENING AND LANDSCAPING.
(A) Height. No fence shall exceed eight feet in height, and in the case of grade separation,
such as the division of properties by a retaining wall, the height shall be determined on the
basis of measurement from the average point between the highest and lowest grade.
(B) Intersections. No structures or plantings 30 inches or more in height, or fences shall
be permitted within 30 feet of any corner formed by the intersection of street property lines or
the right-of-way of a railway intersecting a street, except properly constructed chain
link fences. The chain link fences shall not exceed 48 inches in height from the grade level at
the lot line and shall have openings in the wire mesh of not less than one and five-eighths
inches, nor more than two and one-fourth inches. The fences may follow the lot line to the lot
corner. The 30-foot restriction noted above shall consist of the triangle formed by connecting
the two points on intersecting lot lines that are each 30 feet from the lot corner. (See Diagram
A)
(C) Location.
(1) Except as provided in division (B) above, fences not to exceed 48 inches in height
may be located on any part of a lot. Fences not to exceed 96 inches in height may be erected
on any part of a lot behind the front line of the principal building. The City Council may require
or approve fencing up to 96 inches in height in a front yard to satisfy a buffer or screening
condition of a development review or conditional use permit. (See Diagram A)
(2) A fence or retaining wall shall be installed on the applicant's property. The fence or
retaining wall shall not be installed directly over the property line, but shall not otherwise be
subject to a setback requirement, except as provided in division (C)(3) below.
(3) Fences on corner lots whose side yard abuts a roadway may be six feet in height
beginning at the front building line of the principle structure.

(A) All noise shall be muffled so as not to be objectionable due to intermittence, beat

(2) Noises emanating from construction and maintenance activities between 6 GG 7:00
a.m. and 10:00 p.m. on weekdays; and
(3) The noise of safety signals, warning devices and emergency pressure relief valves.
SECTION 3. The City Council of the City of Mounds View hereby amends Title XV: Land
Usage, Chapter 160: Zoning, Section 160.181 Permitted Uses (A) and (B) by inserting the
underlined language and removing the StriGken language, and updating numbering as
follows:

160.181 PERMITTED USES.
The following are permitted uses in a B-2 District:
(A) Service-oriented businesses: service-oriented businesses which serve the city

THE CITY OF MOUNDS VIEW ORDAINS:
SECTION 1. The City Council of the City of Mounds View hereby amends Title XV: Land
Usage, Chapter 161, General Provisions, Section 161.020 Permits Required; Exceptions,
of the Mounds View City Code by adding the underlined material as follows:
161.020 PERMITS REQUIRED; EXCEPTIONS.
(A) Permit required. It is unlawful to install, construct, erect, alter, revise, reconstruct
or relocate any outdoor sign or structure, as defined in § 161.006 of this chapter, in the
city without first obtaining a permit therefor as required by this chapter, except as provided
in division (B) below.
(B) Exceptions. Permits need not be obtained for any sign less than or equal to eight
square feet in area (excluding temporary signs), or for the specific signs addressed below;
provided, all other requirements of this chapter are satisfied:
(11) Non-commercial sign. For all types of property, the city allows sign(s) that
expresses an opinion or a viewpoint of a non-commercial nature. The non-commercial
sign(s) shall not be illuminated or exceed nine square feet combined. For multiple unit
residential properties, the sign(s) must be attached to the dwelling unit or placed in a
location that clearly indicates ownership and does not represent the opinions of other
residents in the area who have not agreed to the sign(s). Notwithstanding any other
provision of this chapter, the non-commercial speech exemption provided by M.S. §
211 B.045, as it may be amended from time to time, is hereby incorporated by reference.
(a) A property owner may place a non-commercial sign(s) in the City's right-
of-way and shall maintain the property around the sign until it is removed.
(b) Non-commercial signs shall not be placed in the right-of-way of publicly
owned property, such as, but not limited to, parks, municipal buildings, or EDA
owned land nor shall they be placed on street signs, traffic signals, traffic islands,
fire hydrants, utility poles or other similar public structures.
(c) Non-commercial signs may be posted in any number beginning 46 days
before the state primary in a state general election year until ten days following the

state general election. In the case of a special local election, the same rule shall
apply as provided for by M.S. § 211 B.45, as it may be amended from time to time.

Background:
T.A. Schifsky & Sons Inc. submitted the lowest responsible bid and was awarded
construction for the 2022-2023 Street Rehabilitation Project. T.A. Schifsky & Sons
performed construction for the project during summers of 2022 and 2023 and was
substantially completed on September 30, 2023 —the date that the two-year warranty
period begins.
A punch list was prepared for the remaining minor work and/or repairs; T.A. Schifsky &
Sons completed those items and has met all requirements of the contract documents in a
satisfactory manner.
The following is a summary of the final construction costs:
Original Contract Amount: $3,742,093.95
Change Orders: 116,046.23
Revised Contract Amount: $3,858,140.16
The City Council is being asked to approve the final payment to T.A. Schifsky & Sons in the
amount of$37,420.94 for the completion of the project punch list and other close-out
requirements has been satisfied.
NOTE: Staff has been working with T.A. Schifsky & Sons Inc. since September 30, 2023 to
close out this project. Several factors contributed to the long delay, including the T.A.
Schifsky & Sons subcontractors not submitting all required close out documentation.
Recommendation:
Public Works (and Stantec Consulting Services) recommend that the City Council adopt the
attached Resolution to accept the construction work and final payment of$37,420.94 for the
2022-23 Street Rehabilitation Project. T.A. Schifsky & Sons and their subcontractors have
submitted IC-134 forms (as required for project close-out).

WHEREAS, the City Council approved the 2022-2023 Street Rehabilitation Project

WHEREAS, T.A. Schifsky & Sons Inc. completed all project construction and met all
other contract requirements for the project with the substantial completion date of
September 30, 2023 and a final construction cost of $3,858,140.16; and
WHEREAS, Staff and its engineering consultant, Stantec Consulting Services,
recommend accepting the completed construction work and issuing final payment for
$37,420.94 to T.A. Schifsky & Sons Inc.; and
WHEREAS, T.A. Schifsky & Sons Inc, has submitted the final paperwork and all close
out documentation as required.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mounds
View, Ramsey County, Minnesota as follows:
1. Accepts work completed under the contract between the City and T.A. Schifsky & Sons
Inc, for the 2022-23 Street Rehabilitation project.
2. The Finance Director is authorized to issue final payment for $37,420.94 to T.A. Schifsky
& Sons Inc, for construction completion of the project.
3. The Mayor and City Administrator are hereby authorized and directed to execute all
appropriate documents to effectuate the actions contemplated by this resolution.

Background/Discussion:
The City Council passed Resolution 9984 approving the hire of a part time Storm Water Intern.
Staff continues to witness the value of this position and has conversed with the Council, at
recent Work Sessions, about advancing it to a full time status.
Since hiring the Storm Water Intern, the City of Mounds View was awarded (2)two grants:
Board of Soil and Water Research (BWSR)for a total of$234,300.00
• It includes a budget of$46,100.00 for technical services provided, such as fees for
Stantec, and Staff hours
• Rice Creek Watershed District (RCWD)for$100,000.00
■ This is for the installation of the new BMPs required such as rain gardens, SAFL
baffles (stormwater pretreatment systems) in catch basins, and the iron/sand media
separator in the forebay to the Silver View Pond
Other grants have been applied for to include but not limited to Storm Water:
• Great Lake TCGM, Tier 2 - Edgewood Storm Water Ponds
• Entails design and curriculum development for$187,272.69; $54,800.00 could be
used for Staff time
Tribute Park, Veterans Memorial of$50,000.00
Financial Discussion:
Staff has spoken with the Finance Director, and she indicated that there would be an increase to
the 2025 Storm Water Budget of$40,710.00 as this was not included originally.
Staff is requesting the Council consider using $20,355.00 from the BWSR Grant to help off-set

The Public Works Department has many responsibilities, and one is to efficiently operate and
manage the storm water system. The system was first constructed in the 1970's and as with
other similar core functions, research, innovation, and best management practices have
changed over the years.
The City Council approved Resolution 9783 and 9784 authorizing Stantec to complete the
assessments on the Ardan Park, AA-1.P1 and AA-1-.P2, and the Silver View Park Storm Water
Ponds. The City Council Further approved Resolution 9989, authorizing the plans and
specifications for these projects in addition to accepting a grant from the State of Minnesota
Board of Soil and Water Resources (BWSR) in the amount of$230,300.00 for both projects.
The City Council passed Resolution 9996 awarding a contract to ACM for the Silver Park Storm
Water Pond project.
Staff also applied for a Grant from Rice Creek Watershed District (RCWD)for Best
Management Practices (BMPs) that will be installed with the Silver View Storm Water Pond
Project. These BMPs include new rain gardens, re-establishment of current infiltration basins,
SAFL baffles (stormwater pretreatment systems), and an iron filtration bench in the forebay of
the pond.
The City was awarded $100,000.00 for the BMPs being installed for Silver View Project. The
City's application scored the highest out of all the applicants RCWD received.
Strategic Plan Strategy/Goal: Maintain and Plan for Infrastructure Improvements. Ensure Clean
Water and Maintenance.
Financial Impact: No financial Impact to the 2025 Budget.
Recommendation:

Introduction / Discussion:
In accordance with Minnesota Rules, Chapter 4720, all public water suppliers are mandated to
implement wellhead protection measures through a Wellhead Protection Plan (WHPP). The
Minnesota Department of Health (MDH) oversees enforcing these rules.
WHPP is broken into two general parts. Part 1 includes detailed analysis of each well and
pumping aquifer characteristics, groundwater flow models, delineating WHP areas, vulnerability
assessments, and identifying the types of potential contamination. Part 2 involves inventorying
potential sources of contamination and developing management strategies for addressing the
potential sources of contamination.
MDH rules require an amendment every10 year to the Well Head Protection Plan. An amendment
is an opportunity to:
• Identify and changes to the City water supply system and drinking water source.
• Evaluate progress on protecting the drinking water source.
• Identify changes in land use.
• Develop and improve strategies to reduce risks or threats.
Barr Engineering Company was hired by the City to prepare Parts 1 and 2 of the WHPP and has
been coordinating the work with the City's designated Wellhead Protection Manager, Don Peterson,
and MDH staff.
A kickoff meeting was held on January 17, 2025, with City Staff and MDH Staff. At this meeting the
WHPP plan was reviewed and a scoping meeting for the WHPP amendment was set for March 25,
2025.
Barr Engineering has provided a fee proposal of $28,700.00 of professional consulting services
based on the following scope of work:
1. Attending Scoping Meeting No.1
2. Data Compilation and Re-Delineation Meeting
3. Metro Model 3 Modification and Delineation of WHPAs
4. DWSMA Delineation
5. Well and Aquifer Vulnerability Assessments
6. Report and Project Management Public Information Meeting Assistance

• plugged EGR valve
• severe coolant leak
Astleford estimated the repairs needed to the fuel system, EGR valve, coolant and exhaust
manifold of$11,955.00.
The Vactor is used to clean the sanitary sewer lines and is needed for emergencies when the
sewer main becomes plugged. This unit is scheduled to be replaced in 2026.
Staff received a final repair invoice from Astleford International for$15,488.16.
Repairs are budgeted in the Sanitary Sewer Fund 730-4823-5130, which includes $15,000.00.

Conflict of Interest of a Public Officer—Elected Official or Staff

Introduction
This memo provides information regarding what constitutes a conflict of interest for a public official.
The information is provided to ensure transparency and understanding for both residents and public
officers. Given the complexity and nature of the interactions,the memo serves to provide information
allowing greater understanding with a deliberate focus regarding non-profits and/or JPA(Joint Powers).
Definitions
Minnesota Statute provides the following definition for all cities and provides further clarity for
statutory cities. Mounds View is a Charter City and thus, our charter provision provides
additional clarity.
Minnesota State Statute
A public officer, who has authority to take part in making any sale, lease, or contract in their official
capacity, must not voluntarily have a voluntary, personal, financial interest in that sale, lease, or
contract or benefit from it personally or financially'.The term "public officer" certainly includes mayors,
councilmembers, or other elected officials. It also may include appointed officers and employees who
have influence over the decision-making process.
The attorney general has advised that the conflict of interest law applies to any councilmember
"authorized to take part in any manner" in the making of the contract. Simply abstaining from voting on
the contract is not sufficient.The attorney general reasoned that if the Legislature had only wanted to
prohibit interested officers from voting on the contract, it would not have used the word "authorized."
The existence of an interest determines whether a conflict exists, regardless of any official influence
used to gain the contract.
A literal reading of the statute might suggest that it only applies to city officers who enter into contracts
on behalf of the city3. However,the attorney general has given the statute a broader interpretation,
which could affect more officials than just those directly involved in the decision-making process.As a
result, cities may want to take a conservative approach regarding contracts with any city official.

Garden Fair, which will be at the Community Center—as attendance will be free to
Mounds View residents.
3. Does serving on the Twin City Gateway-or any of these entities detailed result in a conflict
under state law or our city charter?
a. No,the Twin City Gateway Board, NYFS Board, and Nine North are city created entities.
The respective coalitions were formed by like minded and or contiguous cities to more
efficiently provide targeted services and/or functionality to residents.
i. The Twin City Gateway has the highest occupancy rate in our hotels of any in
the five state regions. The hotels pay the tax to fund Twin City Gateway which

iii. Nine North used to go under a different name but when one city dropped out
(Shoreview) the entity rebranded to Nine North (nine cities remaining) and
provides all the public meeting broadcasting.The entity is funded by cable PEG
fees.
Actions the City Takes to Ensure Conflict Does Not Occur:
1. Elected officials and staff both receive training.
2. Policy Manual prohibits conflict
3. City Administrator and Attorney responsible for ensuring policy and Statutory Compliance.
4. Annual Audit includes test and review for conflict.
Summary:
A conflict occurs when a public official benefits from it personally or financially.
Recommended Actions:
1. If a public official has a potential conflict, he or she could resign from the position creating the
conflict or he/she should publicly declare their conflict and refrain from any discussion and
abstain from voting.
Example Ruling:
AG Opinion 90e issued in 1997 determined that the Mayor, who was an incorporator of the local cable
TV(NTF 26) and is the primary employee, receiving an annual salary of$25,000, should be prohibited
from serving as Mayor.AG answered in the negative as long as he "abstains"from participation in the
franchising of the company.
