The Mounds View City Council was called to order by
Mayor Linke at 7:00 PM on September 9, 1985.
The Pled,e of Allegiance was said.

Councilmember flankner explained she had been the one
who m,ide thv n,etion to table action onthe ordinances
as she did not feel they were acceptable as written,
and that tabling action im�ans the Council is liorking
on it. She added that she did not discuss the
ordinances at the last agenda session, and she still
reels they need a goud deal of work done on them.
Councilmeniber Haake pointed out the agenda sessions
are public meetinys. She added the ordinances are
not ready to be brought from the table at this time,
and they will notify tho residents when they will be
brought before the Council.
Mayor Linke pointed out the agenda session is open to
the public, and all items on the agerxie are given to
the pros: f-,r puhlic,ition.

Mayor linke closed the regular muctinq and opened
the first public hearing at 7:15 PM.
Dire_tor 'Thatcher presented the Council with a letter
reccivud from Tore Wistrom of Kraus/Anderson,
indicating that the proposed develupment of a Bonanza
Restaurant at the intersection of County Ruad I ana
Mounds View Drive has been terminated by Bonanza
Restaurants. lie added this would hove no effect on
the Super America driveway, as it will be completely
on Super America's property.
Mayor l.inku closed the public hearing and reopened
the regular mcuting at 7:16 PM.

Wayne Brunn, representing Ronald Richardson, the
applicant, reviewed the proposed plan for a self-
service car wash at 2320 'lighway 10.
Director Thatcher reported the proposed pidu me,:ts
City code requirements for stacking, with 16 spaces
required, and 22 being provided. He added the
Planning Cummission has reviewed the proposal and
they recommend approval. He explained they did not
hold a public hearing, ds one was not required by
City code.
Director Thatcher reviewed the I,ruposed development
agreement and conditional use permit. He also reviewed
the datd compiled when the water department visited

water pressure not being adequate. Ile reported that it
met acceptable levels, and the problems appear to be
from inside the homes.
Stan serwa, 5279 O'Connell Drive, stated he did not like
the way the testing was done as he did not feel it was
done at the right time of day, when uae was heaviest.
lie also stated he was concerned whether the owner would
keop the car wash neat.
Councilmember Hankner explained those are all conditions
that will go with the property, and if it is sold, those
conditions will carry over.
Attorney Meyers advised that the CUP could be recorded
with the County, to become a permanent record ou the
property. He also suggested the Council consider adding
to the development agreement that if the business is
vacant for one year, the building be torn down.
Mr. Baxley, 5250 Jef:rey Drive, stated he felt the
attendent would to a problem, and would encourage youths
to hang out at the car wash. lie also said he was concerned
with the sand and water going into the sewer system and
possibly plugging it up. He stated the City of Minneapolis
requires two holding tanks for a building that size.
Mr. Brunn replied they have planned for 8 sand trap
settling tan':s, one :or each bay, which exceeds what the
City of Minneapolis requires. He reviewed the process
by which the sand traps work, and drew a diagram to
illustrate them :le added they will be pumped out as
often as needed. He also explained the attendent would
be there to handle problems, nri create them.
Councilmember Hankner stated she has some areas of
concern regarding this development, and it would be
difficult fur her to vote at this time.
Mike Rich, who stated he was working for Mr. Richardson,
stated they have beer before the Planning Commission,
met with staff, reviewed the requirements of the City,
and the Planning Commission has reviewed the proposal
and recomsended approval. He explained frustration at
any further delay in acting on the proposal, pointing
out that the property i3 properly zoned, and the
questions that are being raised now are related to
management and operation, and they will abide by the
City rules and follow the building code.
Councilmember Hankner stated she was concerned with
the holdinq tanks and would like an opportunity to
check into it and find out the impact of the waste
on the sewer system.

Mr. Rich pointed out the building code requires the /y
developer to meet all the rerquiremunts of the City,
r_nd the Council must be able to rely on City Staff and
they can monitor prulxrrly. He added that Staff and
the Planning Commission have no problems with the
proposal.
Barb Serwa, 5279 O'Connell Drive, stated she felt
Mounds View alhould follow thu Minneapolis etude.
Theresa Wxa, 5229 Jeffrey Drive read a prepared
statement in opposition to the car wash facility.
Dennis Richardson identified himself as Ronald
Richardson':: son, and stated they are planning on
constructing a $3U0,000 building and they will not
let it go to waste. lie gave examples of many well -run
self-service car washes in the area and also pointed
out that the dreinage system and storage tanks they
will be having is over and above what Minneapolis
requiresi.
Barb Carlson, 5239 Jeffrey Drive, stated that testing
was not done of the water pressure with the car wash
in operation.
Mr. Richardson pointed out the property owners knew
the land was zoned B-3 when they purchased their
homes.
Councilmember Haake explained there is a very extensive
list of uses that are allowable in a B-3 zoning, with
not zll of them being as attractive as what the
neighbors might like.
Mayor Linke explained the use in question is allowable
and a corxlitional use. permit is requited to put
restrictions on the property.
Jim Hass, 5240 Jeffrey Drive, stated he did not want
to live next to a car wash.
In response to a question from Stan Serwa, Clerk -Administrator
Pauley explained that as a result of recent legislative action,
the Zoning Code rules in all cases. If the use is compatible
with the 'Zoning it is permitted even if it is in conflict
with the Comprehensive Plan.
Attorney Meyers reviewed tl:.: aection of the code that
is applicable to this request. He stated that if the
property is properly zoned anu the developer agrees to
meet the conditions set forth, the City cannot deny him.

James Jackson, 5299 D'Cunnell Drive, questioned where the
surface run-off will go. Mr. Brunn indicated on the map
where it will go and where the holding pond will be
�iLuaLed.
Director Thatcher stated he does not Fee any adverse affect
on the water services or sanitary sewer services for the
area, and this proposal meets the criteria of the Rice Creek
Watershed District for holding ponds.
Mi. Brunn reported a car wash uses 3 gallons of water per
minute per Bay, who n,as a 5/8" garden hose uses 15 gallons
of w.JLer per minuLv.
Russ Rudd, 5289 4'Conncll Drive, asked if the holding pond
would be in::tdr the landsc.iped area, as ho was concerned
with children playing there.
Mr. Brunn replied it would be, with the fence approximately
1 foot from the property line, and Lhu building itself
about 40' from the property line.
Clerk/Administrator Pauley read the allowable uses for
B-1, 8-2 and B-3 zoning.
Mr. Baxley requested the Council continue any action to
allow him time to get an appraiser to appraise the value
of his home, as he feels his home would depreciate.
Clerk/Administrator Pauley reviewed the criteria of
presenting an appraisdi.
Attorney Meyers pointed out the developer can also have
an appraiser come in r.nd most likely the two appraisals
would balance out.
Mr. Rich also poin'_ed out the appraiser would consider
any use of the property that is allowed, not just F.
vacant lot.
Ronald Ricnardson questioned why both a berm and fence
are required.
Mayor Linke replied he would prefer to see the fence,
as it would obstruct the view from the homes better,
F.nd protect the neighbors better.

No. 1919, for a minor subdivision and conditional use
permit for a self-service car wash at 2320 Highway 10,
with the conditional use permit to be recorded with
the Registrar cf Deeds in Itamsey County.

Equipment Service Corporaticn. lie stated the
Planning Commission has recommended approval. He
added that Staff would recommend that grass cover

agree to that.
Brian S)oberg, manager of EESC, explained what is

review with the Civil Service Commission.
Clerk/Administrator Pauley reported the cost on the
preparation of a development district plan would not
exceed $2,000. lie reviewed the requirements for

paration of a development district plan fur potential
tax increment redevelopment district in area bounded
by highway 10, County Road I and Silver Lake k..ad,
by Holmes and Craven at a cost not to exceed $2,000,
with the funds to come from the genural fund admini-
stration account, reserve for future capital
expenditures.

tion No. 1925, supporting federal legislation to
exempt local government from certain requirements

they should appear before the Council, before
taking any action.

Mayor Linke reported he had presented the Ramsey
County Board with letters and petitions, requesting
the new Cuunty library to be located in Mounds View.

The Developer, E. 'r. Hughes Construction, has ronatru.ted a
4-unit residential building located at 7624 Edyewood Drive.
The Developer is now requesting release of the development escrow
in the amount of $600.
City staff has determined that all requirements set forth in
Development Agreement No. 81-43 have )een net.
RECOMMENDATION: I recommend release of the $600 escrow per
Development Agreement No. e1-43.

WHEREAS, the Developer, E. T. Hughes Construction, in
Dvvul„pment Ayreement Nu, 81-41, wuv n„pliir,l lu construct a
4-unit residential building; and
WHEREAS, the developer was required to post secrlties
necessary to assure th3- the improvement was placed and completed
in the amount of $11,100; and
WHEREAS, the improvements were installed and accepted; and
WHEREAS, the imp:ovenients passed the one-year warranty;
and

WHEREAS, during the warranty period the City had no
.naintenance problems; and '
WHEREAS, on January 27, 1982, the City of Mounds View
reduced the escrow for Development Agreement No. 81-43 with
E. T. Hughes Construction from $11,100 to $600; and
WHEREAS, City Staff has certified that all terms of the
Development Agreement have been met and all outstanding
obligations of the developer to the City have been met;
NOW, THEREFORE, BE 1T RESOLVED by the Council of the Cit,,

USE PERMIT FOR 6085 WOODLAWN,
WHEREAS, J. A. Menkveld has applied for a ma)or subdivi-
sion (2 lot into 4 lots) and conditional use permit (for an
accessory building of 4UO square feet); and
WHEREAS, the property owner has ayreed to remove the
garage and shed located on the proposed Lot 2 within ninety days
of the plat filing; and
WIIERFAS, the property owner has agreed ts, remove two feet
from the 20 foot by 22 foot accessory building on proposed Lo. 4
so that it will not exceed tae maximum 400 square feet required
for the bulding to be classified as an accessory building; and
WHEREAS, the property c.r,'r has agreed to make Lot 4
deeper so that the 30 foot backyard setback requirement can be
,net; and
WHEREAS, the major suadlvision request is not in a flood
plain or wetland zone and me..ts all City requirements, specif-
