Mr. Menkveld reviewed the-eguest for the proposeJ
major subdivision of 2 .ots into d and the need for
a conditional use pe:rt,iz for the 900 sq. ft. accessory
building at 8085 Woodlawn Drive,
Don Schmolke, 8070 Edgewuod, questioned where the house
would be on parcel 22. Mr. Menkveld showed where it
would be toward the front of the lot.
Mayor Linke explained that per the -uilding code,
homes a.e required to be lined ❑p close to the road.
Mayor Linke closed the public hearing and reopened the
regular meeting at 7:20 PM.
Motion/Second: Haake/Hankner to approve Resolution
No. 1932, for a major subdivision and conditional use
permit for a 400 sq. ft. accessory building at 8085
Woodlawn Drive, and waive the reading.

of the Metropolitan Agencies Committee.
Councilmember Quick reported the cost of the first
annual Staff and Council picnic was $287.03.

.ouucilmember Haake expressed a special thank you to every-
one who worked so hard on the picnic. She stated it had
been very enjoyable. She also noted that the Festivities
Commission needs members.
Mayor Lirke reported he had attended the Ramsey County
League meeting last week. tie also reported he had
attended the Public Works/Recreation Open Space Committee
meeting with Clerk/Administrator Pauley, wnere they
discussed turning back Red Oak Drive to Mounds View. He
reported the County has come up with an estimate of
close to $4,000 to repair the road, and the Committee
passed a resolution to turn back Red Oak Drive to Mounds
View, without the improvements. He added they will be
going to the full board next week, and will be writing
letters to all the Commissioners, giving the City's
stance and asking for the road to be repaired.
Clark/Administrator Pauley reminded the Council there
would be no meeting text week, which is the fifth Monday
Clerk/Administrator Pauley advised that Mr. Donut is
planning on reopening this Friday, and they have passed
ie necessary inspections from the Health Department,
_nd they have filed their application and paid the
fees, and still require a permit from the City.

Clerk/Administrator Pauley updated the Council on the
status of the F.re Department bi,dg_t and requests. He
stated they have asked for an actuarial update, and wiii
be bringing that to the Council.
Mayor Linke closed the regular meeting and opened the
next public hearing at 7:42 PM.
Finance Director Brager reviewed the proposed 1986
City operating budgets, and reviewed the proposLd
expenditures and revenues. He also reviewed the
utility fund and the proposed increases for sewer
and water rates.
Mayor Linke thanked Staff for the cooperation between
iem and the Council in working together as a team or.

Mayor Linke closed the public hearing and reopened
the regular meeting at e:08 PM.

Rod Kirtr, 2008 Arden, stated he would like to obtain a
building permit for 8100 Croveland, but was told there was
a moratorium on building in that area. He passed out a
packet of information to the Council, and pointed out a
permit was issued on August let for a home in the same area.
Director ?hatcher rep Iled that there was miscommunication
&manic Staff, and the permit was Issued in error, after the
mcratoriu■ vent Into effect. He added that Staff is con-
ducting a study of access to the area and they hope to
have it done within the next two weeks.
Mayor Link* stated they need more Information on access
roads before they approve any other permits.
Ken Siodin stated that he had requested a building permit
for that area In 1979 but had been denied then because
the City wanted to study where to put the road. He added
these are buildable lots, with the assessments paid.
Mayor Links stated the Council must consider the health,
safety and welfare of the area, the sewer and water
connections, and so forth. It was agreed it would be
fur:`..: .: .i,e next agenda session.
Aevor Links reported the Mounds View Lions Club is looking
at beeeming involved In the Festival in the Park, and
will be reporting back on It.

SUBJECT: PURCHASE OF RESIDENTIAL WATER METERS
The 1985 capital outlay budqet, lint, it.-m 70U-!21-4703, indicates
the purchase of 50 residential water meters. These water meters
are needed at the present time. I have received two quotations
on the subject water meters. The quotations are as follows:
I. Water Products Company - $45/ea x 5U = $2,250.UU
2. Davies Water Equipment Co. - $51/ea x 50 - $2,550.0U
The budget for rhis p ,-pia is 52,5UU.
The quote from each company includes a residential water meter
with remote outside reader without meter couplings. We do not
need the couplings because we have an adequate supply of them.
RECOMMENDATION: I recommend pu!chasing SU residential water
meters with remote readers from Water Products Compaiy far
$2,250.00. The money will come from the 1985 budget (capital
Outlay Account 4700-121-4703).

It has been brought to our attention by the League of
Minresota Cities that the F.nvlronment.al Protection Agency is
proposing to regulate, through the issuance of e. permit
similar to the NPDES permits currently require3 for waste
water treatment plant discharge points, th-: discharge of
storm water .nto wa_ers of the United States under the
authority given them by the Clean Water Act of 1972.
The idea Oat any agency can adequat_ly undertake a program
to regulate the numerous storm water discharge points in
this country and tnen open the door for the possible
requirement of treatment of storm water discharge is totally
infeasible. To exp-ct financially strapped cities elready
overburdened by State and Federal mandates to undertake such
an immeasurably complex and costly pruject is a diservice to
the yoal of the Clean Water Act.
This significant and necessary legislation was designed to
address the major pollut.on problems in our country, which
include municipal sewage systems and waste water generated
by industrial processes. Given the already livtited
resources available for the cleaning up and elimination of

water pollution and the enormity of the task required to

of requiring permit applications and issuing permit require-
ments for storm water discharges threatens to bring about
permanent damage to the viability of the Clean Water Act
itself.
As a member of the Conference Committee developing revisions
to the Clean Water Act, we would urge you to suspend the
proposed permit requirements for separate storm sewer
discharge points unti. such time that the need can be
justified, the task clarified, and methodology for
accomplishing the goal established.

LONG-TERM FINANCIAL PLAN
The Council of the City of Mounds View does hereby ordain:
SECTION I. The 1985 Long-rerm Financial Plan as
presented on September 9, 1985 and on
file in the Clerk -Administrator's Office for
public review is hereby adopted.
SECTION II. This ordinance shall take effect thirty (30)
days from and after the date of its
publication.

RESOLUTION DISAPPROVING AN INCREASE IN BASIC CABLE
,ELEV'GION SERVICE RATES By GROUP W CABLE OF !nt NUNTH
SUBURBS, INC.
WHEREAS, pursuant to City Ordinance No. 319 Group W
Cable of the North Suburus, Inc. ('Group W") has been
granted a non-exclusive revocable franchise to operate,
construct, and maintain a cable television system within
the City; and
WHEREAS, the franchise agreement in effect provides
for the regulation of basic cable service rates by the City;
and
WHEREAS, the franchise agreement provides for a
passive rate review procedure to increase Basic Service
Rates wherein Group W must give written notice of a proposed
increase to the City and the North Suburban Cable Commission
("Commission") 90 days prior to the effective aate of the
increase and each proposed rite increase is automatically
approved by the City unless expressly disapproved within 90
days by resolution of the Council; and
WHEREAS, Group W has given written notice on
August 22, 1985 to the Commission of a proposed increase in
Basic Service Rare! from $7.95 to $9.95 per month; and
WHEREAS, Group W further reques,ed authorization to
implement the proposed rate increase immediately rather than
in 90 days; and
WHEREAS, the Commission recommer.dE to the City that
no action be taken to disapprove the increase in Bas.c
Service Rates and that Group W be permitted to implement the
proposed rate increase immediately; and
WHE.CEAS, the City has reviewed information provided
uy Group W and the Commission regarding the proposed rate
increase and current Federal Law relating to tLq regulation
of Cable television- and
WHER-AS, the City is not convinced of the fact that a
rate increase is necessary at this time in view of the
admitted lack of success in Group W's current marketing
program as evidenced by a penetration rate in the City of
Mounds View of less than 20 percent; and

by undertaking a more aggressive marketing program rather
