DFP/m1s CUNSENT AGENDA NOVEMBER 25, 1985 The Consent Agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire agenda may be adopted by the Council in one motion. The motion for adoption is non - debatable and must receive unanimous approval. Houle, Inc. - Renewal RESOLUTION No. 1955 PITY OF MOONUS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION AUTHORIZING THE RELEASE OF THE LETTER OF CREDIT FOR OEVF,LOPMENT AGREEMENT NO. 76-2 WHEREAS, the Developer (HrPntwood Development Company) of White Oak Estates Third Addition submitted a Letter of Credit as required by Development Agreement No. 76-2 for the development of the White Oak Estates Third Addition properties; and WHEREAS, Development Agreement Ne. 76-2 was signed on April 26, 1976; and WHEREAS, the Developer has developed all eighteen platted lots; and WHEREAS, the Developer has requested the release of the Letter of credit; and WHEREAS, the Developer's Letter of Credit was reduced to $1,000 on March 24, 1980 (Resolution No. 1092); and WHEREAS, the Developer has completed the requirements of Development Agreement No. 76-2; NOW, THEREFORE, BE IT RESOLVED that the City C.)uncil of the City of Mounds View au'hor,zes the release of the letter of credit for Development Ay.eement Nn. 76-2. OF MOUNDS VIEW BY AMENDING CHAPTER 100 ENTITLED, "INTOXICA'rING LIQUORS" AND CHAPTER 101 ENTITLED, "NON -INTOXICATING LIQUOR" The Council of the City of Mounds View does hereby ordain: SECTION I. Chapter 100.03, Subdivision 2 (a) is amended to read as follows: (a) A certificate that there is in effect an insurance policy or pool providing coverage of at least: (1) 6i99,999 $50,000 because of bodily injury to any one person in any one occurrence and subject to the limit of one person, in the amount of 6399.980 S100,000 because of hodily injury to two or more persons in any one occurrence, and in the amount of$10,000 because of injury to or destruction of property of others in any one occurrence. SECTION 11. COMPANY SEWER SERVICE Last month, the City Council approved Electric Equipment Service Cotspany's (EESC) request to construct a IU,000 square font office/warenouse buildiny at 4751 Mustang Drive. Since that time, their construction hide came in high and they had to revise their drawings (Attachment 01). You will note on the attachment that the site plan meets all City Code requirements. However, because they moved their proposed building mouth on the site, and hence, further away from their proposed connection to the sewer and water mains. A review of how the building should be serviced for water and sewer is necessary. Ron Fagerstrom, Fire Chief, requires that a hydrant be placed at the location indicated on the attachment. EESC is willing to install an 8 inch water main in the City right-of-way to the hydrant at no cost to the City. The most cost effective way for EESC to provide sanitary sewer service to their building is to install a service line diagonally across their property (appruximate length equals 220 feet). An alternative sewer service is to ,r.;tall a sanitary sewer parallel to the water main in the City rtyht-of-way (see Attachment 01). The advantages and disadvantages of each alternative is listed below: Install service line diagonally acress property. Advantages a) Cost effective solution. b) EESC is responsible for cleaning/maintenance of the majority of the length of the service line. Disadlantages: a) No future expansion capability. b) Bad design because t,itee clean -outs are needed on the service line and one clean -out will probaoly need to he located in the parking lot (8U feet maximum between clean -outs), 2. Install 8 inch sanitary sewer line down City right-of-way. Advantages a) Good for future expansion. b) No :lean -outs are needed. Disadvantages a) City cleans/maintains more sewer line. b) More expansive solution. The added cost is approximately $1,40C (7u feet x S20.O0/foot). Clerk -Administrator and City Council Page Two of Two November 21, 1985 If EESC had their building on a southern portion of the lot as they indicated in Attachment 41 at the beginning of the review process, I would have indicated to them that they would have to put the sanitary sewer down the right-of-way because it's a bad design to have the service line run diagonally across this property. T,:e question now becomes, should EESC pay the esttmatej additional cost of $1,400.00 to instal: the sanitary sewer line in the street? Or, should someone else pick up the additional tab? EESC has indicated to me that the additional cost is not that big of a problem because the City's SWM and WA17 charges were not as much as tney eaL,a.atcd. In additinn, thev have already started some earth moving work on the site, so that indicates to me that they will abide by whatever decision we make on the alignment of the sanitary sewer service. V., No. 20 FIRE DEPARTMENT CONTRACT The three cities recentTy received a response from the Fire uepartmer to : r pr;f:^ .d new contratt for the ratiud 1986 through 1990. It would appear from that response that, except for one issue, we will be able to agree on new language with minimal difficulty. The exception is that the cities had proposed the removal of a clause in the contract known as Duty of Care which essentially provides that the department would be protected from all liability except where negligence was involved on their part. The Chios proposed this article be replaced with a provision requiring indemnification by the department as we presently require of all private contractors. The department's attorney has taken the position that the department is an agent of the three cities and we contend that they are a contractor as if they were an agent we would have control over their operations and since we currently do not they are more of a contractor then an agent. It would seem that this diclute will end uD needing to be resolved between the attorneys which could drag the process out, however, I am comfortable that we will be able to resolve our differences quickly and amicably. A meeting of the three City Administrators has been scheduled for the morning of November 22 to prepare our counter -response to their proposals. COMPUTER DEMONSTRATIONS As previously indicated, the department head team has invited three firms to give us demonstrations of the computer equipment they proposed in response to our request fur oroposals. These demonstrations have been scheduled for the week of December 2 with the schedule being as follows. December 3, 1985 8:30 a.m. Data Management Design December 1, 1985 8:30 a.m. NCR December 5, 198S 9:30 a.m. Computoservice All of these demonstrations will require a good share of the day for the department head team, however, the Computoservice demonstration will be held at their corporate headquarters in Mankato and the department head team anticipates that it would be gone for the entire day of December 6. Once these demonstrations are completed the Ceam will again meet to determine whether additional demonstrations are necessary or a logical winner has resulted tram the process. TWO SPECIAL COHNTY ELECTION As you know, a special county election has been scheduled for Tuesday, January 21, 1986 to select the replacement for County Commissioner Robert orth. Should more than two candidates file for this position a Apecial primary election will be held on Tuesday, January 7, 1986. The City of Mounds View will be conducting these elections at the request of the County and Staff is presently beginning the process of notifying our election judges of our need for them and preparing the appropriate forms and equipment for this election. Although, this will be a simple election in the sense that there will be only one issuo on the ballot and we will not be having a need for a large number of voting machines or election judges, toe prepatory work for the election will be as extensive as that for any other election and Statf will be committing a significant amount of time to these elections. HIGHWAY CONSTRUCTION PROJECTS At a meeting of the Shoreview, Arden Hills, North Oaks, and Mounds View Chapter of the North Suburban Chamber of Commerce, Bob Benke of the Minnesota Department of Transportation gave a presentation on hignway projects proposed in our area during the next five year period. Of particular note to the City of Mounds View was the proposed resurfacing of Highway 10 in 1987 and the construction of Phase I of new Highway 610 in the same year. In private conversation with Mr. Benke, after his presentation, we discussed the need to schedule these projects in different years in order to avoid any traffic conflicts that could result when traffic currently using Highway ib will have no other reasonable alternate route. It was also agreed that it would be appropriate for representatives of the City, Ramsey County, and MnDOT tc meet in the near future to discuss those programs and projects proposed during the next five year period i:i order to appropriately schedule our individual projects so that they do not conflict with those of other jurisdictions.
