Chapter 400 of the Municipal Code Entitled, "Administrative offenses" is established as follows: 400.01 Definition. An administrative offense is a violation of a section, subdivision, paragraph or provision of this code when one Mr -forms an act prohibited, or fails to act wh such failure is thereby prohibited, and is subject to the penalty set forth in Chapter 1.11, Subd. 2.01 of this code, and the schedul 411 U2 Notice and Payment. Subd. 1, Notice. Any member of the City Police Department, and or any other person employed by the city with authority to enforce this code shall upun determining that there has been a violation notify the violator, or person responsible for the violation, or in the case of a vehicular violation by attaching to said vehicle notice of the violation, said notice setting forth the nature, date, time of the violation, the name of rha official issuinq the notice, and the amount 11 ORDINANCE NO. 393 PAGN 'rwo 4UO.U3 Hearing officer. The Clerk -Administrator shall be the hearing officer, and he or his designee is authorized to hear or determine a cause or controversy relative to this chapter. The hearim3 officer is not a judicial ofticer and is a public officer as defined by Minnesota Statute 6U9.415 and subject to Minnesota Statutes relating to public officers. 400.04 Hearing. Any person aggrieved by this chapter _ may request within seven (7) days of the time of issuance of the notice to be heard by the heariny officer who shall hear and determine the grievance. The hearing officer shall have the authority to dismiss the violation for cause, reduce or waive the penalty upon such terms and conditions as can be agreed upon by the parties, however, reasons for such dispositions shall be stated in writing by said hearing officer. IE the violation is sustained by the hearing officer the violator shall pay satisfaction of the penalty or shall sign an agreement to pay upon such terms and conditions as set forth by the hearing , officer. 400.05 Failure to Pay. IE a violator fails to pay the penalty imposed the Clerk -Administrator may order the issuance of an ordinance complaint as authorized by law and the violation shall be processed as a crime by the Ramsey County Municipal Court as provided for in Minnesota Statutes 488A.18, Subd. 7(2). 400.06 Disposition of Penalties. Chapter 63.06 is hereby amended by adding Subdivision 4 as follows: Subdivision 4. Fire Inspector: The City shall appoint a fire inspector to handle routine inspections and fire prevention buildings industrial buildings, ano mulcipie dwelling occupancies The appointed fire inspector shall be responsible for the enforcement of these routine inspection matters. The City is attempting to solve the problem of high iron content and high manganese content in weLL number 3 drinking water. The first two pilot studies Or treatment processes were not as successful as we would like. Theretore, Toltz, King, Duvall and Anderson (TKDA) and I recommend conducting pilot plant studies for treating well number 3 water with ozone. A copy of TKDA's letter is attached for your review. Mr. Tom Kirk of TKDA has indicated to me that the larger ozone equipment supplying companies charge approximately $30U-$400 per day just to rent their equipment. Therefore, a thirty -day pilot study would cost approximately $12,000. Therefore, I have located a supplier of ozone equipment who will conduct the pilot study for a more reasonable cost. Tile company is Waterco, Inc., 251 - 5th Street NW, New Brighton, Minnesota 55112 (636-3067). Attached please find a copy of his quotation and exhibits. The cost of the pilot study is as follows: Waterco, Inc. $4,825.00 Serco Labs (Manganese Tests) $ 500.00 Contingency $ 475.O0 Report (By City Staff) $ - 0 = TOTAL ESTIMATED COST $5,800.00 This work is scheduled under the long term maintenance and repair. program. The money for this pilot study is in the 1985 budget under line item 700-122-4123. Manganese residual concentrations approaching those recommended for trouble -free municipal water quality Just were not achievable. Therefore, the City has three (3) remaining options with regard to Well No. 3 as we view It: 1) Conduct pilot plant studies to determine if ozonation will yield a suitable treated drinking water 2) Consider lime softening to remove the Iron and manganese with the other mineral constituents 3) Abandon Well No. 3 as a source of water for the City Although we belleve that ozonatlon will likely reduce the Iron and her or not tmaanese levels he tt continued use No. 3,he desired and the atreatment necessary tions, we question wt trender Its water suitable, Is Justified. Well No. 3 Is a relatively shallow well, thus more vulnerable to contamination. Under the circumstances, we recommend the following course of action for tho City: 1) Conduct pilot plant studies for treating Well No. 3 water with l ozone. 2) Conduct similar tests on the water from Well No. 4.
