Tire Pledge of Allegiance was said. MEMBERS PRESENT_: Councilmembers Blanchard, Quick, 4aake, Banker and Mayor l.inke. Presentation of the Tree City USA flag to the Mayor and Council, Tree city USA stating that Mounds View :as again received national Award recognition with this award, and they were one of 35 cities in Minnesota to receive it. There were no residents requests or comments from the floor. Ma -or Linke closed the regular meeting and opened the public hearing at 7:C5 PM. Rita Docken, Energy Coordinator, explained the City is considering changing their open system of garbage hauling to contractual hauling. She reviewed the advantages of organized collection, and explained the solid waste abatement levels the City will be required to reach by 1990, versus where the; are at today. 6. Bill Frits expressed concern with having to pay higher rates, due to recyclables and compostables, And stated feel the average resident of Mounds View was he did not goi:lg to be willing to do all that sorting. Ms. Docken explained the City must meet abatement target levels, and they need the cooperation of the residents. She added they Hope to instill an environmental consciousness in the citizens now, which would be the first step. Attorney Meyers arrived at 7:22 FM. Larry Saba, of Larry's Sanitation, stated he was concerned with how much the charges to haulers would increase once the garbage burning plants are open. Ile added that he believes consolidation is a good idea if it is done fairly, as he is concerned with the large haulers taking over. Mayor Linke suggested the smaller haulers could oul geet e together and form a consortium, to p group bid. Dean Warden, of Ace Solid Waste, stated their rates have been increasirg continuously for bo-h dumping and insurance coverage. Rick Lavka, of the Ramsey County Environmental Health Agency, reviewed their program goals, and he arswered many questions about the financing and benefits to be derived from the garbage burning plants. There was considerable discussion about how to get the residents to use the compost site, as it is very expensive to take that material to the landfill and dump it. Councilmember Rankner stated she would like more detailed informacost eakdown and she twould slike atoafurther rdiscuss how everyone haulers, the everyonecan work _ogether better. CletklAdmini trator pauley pointed out the real issue is a State law that is placing requirements on the City to regulate solid waste and abate it from the landfills. An unidentified resident stated she was willing to stay extra to her hauler to have her garbage piu her garage, rather than taking it to the end of her driveway, and she expressed concern as to whether all haulers would be willing to do things like that. It was agreed the issue would be discussed again in the near future, and 0ey would try to get further comments from the residents and other haulers in the City. It was agreed that the 'public hearing had been well advertised, and letters had been sent to all haulers in the City, but response had been very light. Mayor Linke closed the public hearing and reopened the regular meeting at 8:18 PM. Motion/Second: Hankner/]iaake to approve the consent 8. Councilmember Blanchard explained the process that was used when the Council originally began the interfund loan program, and how the availability of the warming houses occurred. Mayor Linke stated he would like to see the fund kept, with a $10,000 balance. Finance Director stated it would have to be clarified which fend the money should be kept in. There was considerable discussion among the Council of the current policies and intentions on granting the loans and the planned repayment. Finance Director Brager asked if the Council wanted to forgive the loan, and if so, asked what would be done with, the funds that are available to be used to repay p-rt of the loan. He addeded that if it is going to be repaid, the Council should establish the terms at ttiis time. loan on the warming houses and have $10,000viromuthe Recreation Fund put into a fend that would provide for the interest to be used by the Park and Rec Department and the Park and Rec Commission for further improvements to the park system, and from this point on, the Council will set an interfund loan policy stating the interest rate and repayment plans. Motion Carried Councilmembers Blanchard and Haake voted against the motion, with OUtn stating they felt the loan should be repaid. Councilmember Blanchard made reference to the memo to the Council from Finance Director Brager, pointing out the ramifications nt the Praha^ -Rudman act on the City, and she stated she felt very strongly that the 106r- should be repaid. Reports of the May 7, 1986 Fire Department activity report Councilmembers: and questioned the follow-up violation ticket that was issued and questioned who was responsible Councilmember for the inspections. Blanchard Clerk/Administrator Pauley explained the City is aware of this particular problem, that the owner is in the process of changing alarm systems, which necessitates having the old alarm out of commission for a shurL time before the new one is operational. He added that they are meeting with Chief Fagerstrom to resolve the problems. Councilmember Blanchard questioned how the fire inspection and housing inspection program is going. Director Thatcher replied the housing inspections were stopped because the typing could not be done. He stated he has asked Inspector Rose for the report on fire inspections and will ask him for it again, and he assured Councilmember Blanchard she would have the report by the next week's meeting if he had to personnally do it himself. Councilmember Quick reported he had attended the Councilmember Park and Rec Commission meeting on May 22, which Quick was attended by a croup of residents trom the Silver View Park area and they discussed encroachments on the park property. Fe added it was a very lively meetinq, and the Park and Rec Commission is putting together a policy regarding encroachments. Councilmember Blanchard stated she would like earlier notification if such meetings, as she would have been interested iu attending, but did not stop by to pick up from her box until the weekend, after the meeting had already been held. Councilmember Quick requested that the expenses on the Gale/Yost walkway, and the issue of fire hydrants and panel truck fcr flooding the ice rinks, be placed on the next agenda fur discussion. Councilmember Haake reported the Festivities Commission Councilmember has projected expenses of approximately $4,300 for Haake tr.:.. "..A. c e.:..,r vcth anticirated revenues of $850, not including concessions and rides. She added it is anticipated the City will once again help with the funding. He added that they have conducted carnivals in the City before, and they are aware of the proper procedures to follow in applying for a license. He stated they would like their license to run from May 28 through June 1. Bituminous path for the Gale/Yost walkway. 2. Chair, link fence for the Gale/Yost walkway. 3. Fire hydrants and panel truck for flooding ice rinks. 1. bituminous Path for the Gale/Yost Walkway - The cost of an 8' wade bituminous walkway Is U000 (400 lineal ft. y $10/lineal ft.l. The cost could be lower if the work is done by the contractor on the City street project. 2. _Chain Link Fence for the Gala/Yost Walkway - The cost of a chain link fence on thts walkway is $4,800 (800 lineal ft. k $6/lineal ft.). This cost estimate does not include installing a concrete weed control strip under the fence. 3. N drants and Panel Truck for Flooding Ice Rinks - In order to reAure r,e �nqt manta :,i'' ,n,-: nks, a fire hydrant needs to be installed at Woodcrest Park, Lambert Park, Hillview ParK and Greenfield Park. The cost of instilling hydrants, gate valves, 6' diameter ductile iron pipe, and appurtenances for the 4 parks is $10,000. The cost estimate is for materials only and does not include installation or labor costs. A heated panel truck to haul hoses for spraying water on the ice rinks from Federal Surplus is estimated to cost $2,000 to $6,000. The City has an old green van that could be utilized if repairs are made to it. Possible Funding Sources The estimated tots, cost for all of the items is $24,800. The original 1986 Budget included $3,O00 for the Gate/Yost walkway. The money was removed from the 1986 Budget and not replaced. However, the money could he returned to the 1086 Budget. Developer deposits in the amount of $8,000 could be utilized for these prof-cts. The 1986 contingency account could he utilized for the rema:ninq $13,800. The Self -Reliance Center is a nonprofit organization offering a variety of energy related services including audits, training, consultation, and home repair. The Center was established in 1976 and is an integral part of the Minneapolis Neighborhood Energy Workshop Program. This program has been used nationwide as an effective method of residential energy conservation. Due to the fact that the Secretary of State's off ire did not certify the computerized ballot counting equipment that the City of Mounds View was considerioq purchasing from EL Marketing, we have been forced to give consideration to other options for improved ballot counting equipment. As you may recall, the problems the City has been experiencing with our current ballot counting equipment are, (1) the equipment is hand fed which results in a slow-paced ballot counting process, (2) the equipment is being overloaded by the number of ballots cast in the majority of the City's mainr elections which causes frequent equipment hreak-dnwn, and (3) the equipment is not fully computerized which restolts in a minimal print out being provided requiring tran^position of the numbers from the print out rn a summary ch?et prepared by Staff which also adus to the length of the b•,Ilct counting process. In discussing our concerns with Mr. Ed Lellbach of FL Marketing we were advised that a piece of equipment which has been approved by the Secretary of State's Office known as a 'PEPS" system should meet our needs for now and into the foreseeable future. This piece of equipment is fully computerized providing a more detaiied print out of the election results listing the positions, names of candidates, and number of votes cast and a high speed ballot counter can be added to this piece of equipment allowing for the reading of 600 cards per minute. Attached for your information Is a copy of the proposal submitted by Mr. Leiivaci: fut Lnia equipnienL which inciunes the trade-in on our existing ballot counting equipment in the amount of $2,400 for a net cost to the City of $8,270. One item that will be different from our current system will he an annual software support fee of $150 due to the computerization of this equipment. Based on the fact that this is the only approved equipment currently available to the City matching our needs and within the restrictions of the 1996 Budget, Staff would request Council consideration of thi:: proposal. Due to the fact that a ninety day delivery is necessary for this equipment, your earliest consideration would be appreciated in order that the equipment can he madeavailable for the September Primary Election. I and other MTC personnel have reviewed the development agreement you fcrwarded to me for review and execution. It appears that the agreement was otigically intended to he execnted by privatc developea in order tc protect the City from having to assume responsibility for reslurir,g sites it a developer were to go out of business. Before the MTC enteral into such all agreement, we suggest that the agreement be modified somewhat. I., particular, we sugg :st the following: 1` item 5 should be deleted in its entirety. The MTC is exempt from taxes and cannot assume liability fcr taxes. 2) Iter v is unclear to us. Please describe its intent or delete it. 3) Regarding item 10, Mn/DoT will continue to own the lend; therefore, this item should be deleted. 4) 1r. item 12, we cannot agree to the payment of any fees, not kuuwing their extent. 5) Item 14 should be deleted in its entirety. 6) Exhibit 2A, item 4, contains language committing the MTC to the payment of unknown quantities of money. Again, we cannot agree to such a situation. 7) Regarding Exhibit 2A, item 6, I investigated the site personnally after receipt of the develoomect agreement. Just across the street is lo_ated a restaurant which is open during the hours which span the hours of bus operations. Adjacent to the restaurant is a gas station which is open -2- 2C hours a day and which has a telephone available for 1public use at all times. I also contacted the telephone ' company. Currently, a pay phone would cost about $50.00 per month. Additionally, the MTC would have to pay the installation fees. We find the accessibility to telephones in the area to be quite good. We do not see an installation of a telephutke on the park -ride site as being critical to its successful operation; therefore, we recommend that this requirement be deleted. The plans and specifications are currently undergoing FHWA and Mn/DOT review. We would appreciate your prompt response to our request for reconsideration of the items described herein.
