He reported the City had met with Mr- Thomas of the U,S. Departmrnt of Transportation last Friday and verbally discussed retesting and restarting procedures. He added he had spoken with an attorney for the DOT Win Washington, and wes told that as a courtesy, they ould send the City a copy of the order regarding illiams Pipeline, but the copy had not yet been received. 1. Motion Second: Hankner/Quick to approve Resolution No. regarding Williams pipeline Company and the United States Department of Transportation, Office of Pipeline Safety- 5 ayes 0 nays Councilmember Ilaake asked for a friendly amendment to the preceeding motion, requesting that another statement be added to the end of the resolution, to read "Be it further resolved, if any defects are found as a result of the above testing procedures, the City will request the pipeline be replaced. It was accepted as a friendly amendment to Resolution No. 2028. Attorney Meyers recommended the resoluton, as amended, be presented to the DOT as soon as possible Bill Frits, 8072 Long Lake Road, reported a problem of cars being parked on a vacant piece of land at Long Lake Road and County Road J, and advertised for sale. Mayor Linke asked the Clerk/Administrator to notify the Chief of Police to look into the matter and issue any necessary citations. Mrs. Gerald Blanski reported there is the same problem on Knollwood Drive, between County Road H and H2, although these cswere not leftnecessarily for sale, but had been parked on the boulevard. Attorney Meyers clarified that the stipulation and order relates only to Phases IA and 18, and if the stipulation is agreed to by the City, it would be submitted to the District Court for approval. Attorney Meyers read the stipulation. He asked that if the Council approves it, they authorize him to execute it on behalf of the City of Mounds View. Attorney Meyers clarified the 2,58o feet would be removed first, then the additional 2,580 feet on the north would be added. Motion/Second: Hankner/Quick to accept the stipula- .ion and authorize the rity Attorney to execute it on behalf of the City of Mounds View. 5 ayes 0 nays Councilmember Hankner stated she feels Motion Carried MAC is sincere in following through with what has been laid out in the stipulation, and while it has been a real problem for residents on the north side of the City, the moving of the runway should help considerably. Mr. Frits stated he does not feel MAC will follow through, as they have made promises before, but not kept them. Attorney Meyers replied it standards. applies to present kwar. McCarty urged the Council to turn the stipulation down, and he stated he was concerned with the weight stipulations. Discussion the Council regarding the costs and options available walkway and on the Gale/Yost property. Fencing on Go / Yost Property Motion/Second: Quick/Hankner to approve construction o a ituminous pathway in the area of the Gale/Yost property, a chain link fence, concrete weed barrier and night activity light. 3 ayes 2 nays Motion Carried Councilmembers Haake and Blanchard voted against the motion. Councilmember Blanchard stated she was against these improvements as the money was not in the budget and she did not feel it should be taken from the contingency fund, especially in light of the problems that orr•lrrred in the City last week. She added she would like to give the property back to the owners. Councilmember Haake stated she agreed with Councilmember Blanchard's statements. Councilmember Quick stated he had been contacted by the residents of the area, who have had numerous problems with youths in the area and dirt bikes and motorized vehicles. He stated the residents are afraid they will be retaliated against if they call the Police. He added he feels it is time for the City to do what they said they were going to do, and take care of the problem. Councilmember Hankner stated that if the City provides an asphalt walkway with a fence and light, it will help to protect the residents. She added that presently there is no way of patroling the area. Councilmember Blanchard stated her main concern was where the funds would come from. Clerk/Administrator Pauley explained that last year, as a result of the budget crunch, the Council put a freeze on many items, of which this was one. At that time, $15,000 was placed into the contingency account that had been budgeted for this work. Mayor. Links stated he is a firm believer in the Mounds View Park trail_-7--tc-m. Councilmember Haake stated she feels the kids will continue to do what they have always done, and this is not going to solve the problem. She added there are many areas in which the money could be better spent. Report cf Public 10:30 am on July 15, at City Hall, with the Minnesota Works/Community PCA and Williams Pipeline regarding the ground water Development monitoring of the area. Director Director Thatcher clarified that the delay on repairs to County Road H2 was not due to Staff, but rather a delay on the contractor's part. Attorney Meyers reported the question has been raised 11. Motion/Second: Linke/Blanchard to have the first rea ng o Ordinance No. 410, an ordinance amending the Municipal Code of Mounds View by amending Chapter 59.03, entitled "Building Permits and Fees". 5 ayes 0 nays Motion Carried Mr. Frits asked if he were to have a problem with the gas service going to his house, would he be required to wait two weeks also' Attorney Meyers explained the ordinance does not include service lines, as they ate covered in other chapters of the code. Quick Mayor Line reported the Ramsey County League meeting Mayor Linke would be held at the Falcon Heights city hall on July 16. Clerk/Administrator Pauley stated that on behalf of 13. Report of City Staff, he would like to thank all who helped Clerk/ the City last week. He added he feels Staff did an Administrator excellent job during the difficult time, and he will see to it that they are each thanked. Clerk/Administrator Pauley reminded everyone the American Red Cross will bt conducting a session on dealing with stress at the Edgewood Community Center on July 16, from 7 to 8:30 PM. Clerk/Administrator Pauley asked authorization to temporarily hire back Rita Docken to assist at City Hall, while some personnel is on vacation, and to get caught up. Motion/Second: Quick/Blanchard to authorize the hiring �) o Rita Docken for up to 40 hours, at $8.34 an hour, to be charged to the Community Development department. 5 ayes 0 nays Motion Carried Clerk/Administrator Pauley asked that the Council give Staff direction on press releases, to coordinate the efforts of everyone involved. It was the concensus of the Council that press releases should go through the Clerk/Administrator's office, and they should be run past Attorney Meyers before they are released. ALSO PRESENT: City Attorney Meyers, Clerk/ Administrator Pauley and Public Works/Community Development Director Thatcher. rMotion/Second: Haake/Blanchard to approve the June 9, 1986 minutes as corrected. 5 ayes 0 nays Alice Frits, 9072 Long Lake Road, asked if the City screens people who go dout to door soliciting funds. Clerk/Administrator Pauley replied there is a City ordinance governing this, and solicitors must register with the City, and they are given an I.D. card, and if they cannot produce that card, they are not licensed in Mounds View and the Police Department should be called. He added that a background check is done on the individual through the police computer, before the I.D. card is given. Mre. Mr. Reinertson replied he had, but he wants something done now. Councilmember Haake explained that at the meeting, a presentation was made of the cost of the work that would need to be done, possible solutions, and how it miyht be financed. She added that it is antici- pated the cost for just the Ardan Avenue area would be. about $500,000, which the City does not have. Mr. Reinertson repeated that he didn't care, someone else could have the problem now. de stated that the water gets 4-5' deep in his back yard, and he could float a boat back there. He stated they have been flooded in their basement many times, and had just • replaced all the carpet before being flooded this past weekend. Director Thatcher explained what Mr. Reinertson has is a 5 to 6' reinforced concrete pipe that is out of the ground for a catch basin. He stated he does net know why it was installed or the purpose for it there. He added the problem in that area is the storm sewers downstream are undersized and there is not enough of a holding area. He stated there is no funding source for the $500,000 improvement, of which the figure comes from the John Johnson study. Clerk/Administrator Pauley stated he believed the sleeve sPut in nresult f a recom- mendationofa taskforce, comprisedofocitizens. Director Thatcher stated that removing the sleeve • would not solve the problem, and the only way to handle the problem is to find a funding source. Reinertson stated that at a meeting 3 or 4 ears ago it was decided that no more building would be allowed in that area until the problem was solved. Cierk/Administrator Pauley explained that was the wetlands moritorium, and how that came about. Councilmember Hankner explained that once the wetlands and flood plain ordinances were adopted, the moritorium was lifted. Attorney Meyers suggested the City could create a special tax district and tax the residents of that area. He stated 300 acres could be split out. Director Thatcher stated that a 20,000 square foot lot would be assessed less than $100 per year for 15 years. Clerk/Administrator Pauley stated he has given the information on how to petition for improvements to the residents who asked for it. Mr. Reinertson stated he was told second-handedly that the City was going to install check valves. r`.lerk/Administrator Pauley replied that that is not the City's plan. He added that the holding pond by Groveland will remain, and some of the lots there will not be allowed to be developed. Mr. Reinertson stated he feels it is the City's fault that he has this problem, and he wants the City to take care of it. Attorney Meyers stated that under Chapter 444, they would have to prepare an ordinance and hold public hearings in order to establish a tax improvement district. He added they could declare the whole City a tax district and assess everyone evenly. The Council directed Attorney Meyers to research the possibility of declaring the City a tax district, and the procedures to be followed. Mrs. Reinertson asked why building permits were given out for homes in areas where the water is so high. Mayor Linke replied that if they meet all the Code requirements, the City cannot arbitrarily deny a permit to build. L.:ouncilmember Haake pointed out the water table has risen since many of the homes were built. Mayor Linke directed Director Thatcher to look into removing the sleeves. Clerk/Administrator Pauley reviewed the basic require- ments to be eligible for flood insurance. He stated the Planning Commission 2022 has reviewed this and recommends approval contingent upon approval from the majority of the home owners association. Marlin Grant, of Mary Anderson Homes, stated they had met with the condominium residents last Tuesday, and 16 out of 17 who were present signed the agreement to change the remaining condominium land to townhouses. He stated there were no negative comments what so ever, and the one person who did not sign the agreement chose not to because he did not sign things of this nature in general. Judith Maekel stated it was her husband who did not sign, and while she had not been at the meeting herself, she was concerned with what the ramifications could be. She added she has nothing against what they are planning to do, but she is confused. Councilmember Haake explained that the developer can only construct condominium units or townhouses there, and nothing else. Attorney Meyers advised Mrs. Maekel to have her attorney review the association bylaws if she had any questions, as it is not the City's responsibility or authority to do so. Mrs. Maekel stated she was concerned that there were not as many street lights in place as she felt there should be. He tated the Council could approve the development agreement, subject to the final approval of the letter of credit. Motion/Second: Linke/Quick to approve Development Agreement No. 86-74, subject to the City Attorney's final approval of the letter of credit. 5 ayes 0 nays Motion Carried Mayor Linke explained that all the requirements have been met for this proposal. Clerk/Administrator Pauley read proposed Resolution 9. Consideration No. 2024, commending Rita Docken for her service of Resolution to the City. Report of Public Works/Community Development Dir. Mounds View City Council Regular Meeting ---------------------------- --- - Attorney Meyers has no relnirt. Councilmember Quick asked if the residential office building across from Crown Auto has satisfied it's development agreement with the City, as he had noticed a for sale sign on the property. Director Thatcher replied the City is holding $11,000 security on this, and he will send them a letter, asking them to finish the work. Councilmember Haake had no report. Councilmember Hankner reported she had attended a meeting with MAC earlier in the day to continue negotiations on the lawsuit, and things are going smoothly. She asked that an executive session be set soon, to discuss the matter. It was agreed that an executive session would be held before the next agenda session. Motion/Second: Linke/Quick to set an executive session for discussion on the airport issue and lawsuit for 6 PM on Monday, July 7, 1986. 5 ayes 0 nays Councilmember Blanchard had no report. Mayor Links reported he had attended the League of Minnesota Cities convention in Duluth last week, with Clerk/Administrator pauley, and he planned on putting some of the information together to present to the Council. Clerk/Administrator pauley reported he would be submitting reports to the Council with some of the recommendations he came back with from the League of Minnesota Cities convention. Clerk/Administrator pauley reported that at a June 9 meeting, Ramsay County adopted a resolution authorizing the chairperson to pursue forming a committee to resolve the issue of the Ramsey County suburban court consolidation. Appointment to appoint Ron Fagerstrom and Chief Police to Operations Ramacher to the Response Committee and and Response Steve Thatcher and Richard Kelty to the Committees Operations Committee. 5 ayes 0 nayes Motion Carried Discussion followed by all in attendance regarding the deposition and safe keeping of the portion of pipe that was removed from the site. It was agreed that the pipe would be sent to Twin City Testing and kept under lock and key while testing was being performed. Discussion followed by all to determine official position of the City. Discussion followed by all relating to a neiohbo.hood support group for the residents in the pipeline disaster area. It was decided to look into and organize a group for that purpose.
