the City Council. The entire agenda may be adopted by the
Council in one motion. The motion for adoption is non -
debatable and must receive unanimous approval. By request
of any individual rouncilmember, an item can be removed trom
the Consent Agenda and placed upon the Regular Agenda for

COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION APPROVING SECURITIES FURNISHED BY THE FIRST
STATE BANK OF NEW BRIGHTON
WHEREAS, the City Council of the City of Mounds View has
designated the First State Bank of New Brighton as a
depository of City funds; and
WHEREAS, Minnesota Statutes 118.01 require that a
municipal depository provide securities for collateral; and
WHEREAS, the First State Bank of New Brighton has
proposed deletion of the following security from being pledged
as collateral; and

WHEREAS, the First State Bank of New Brighton pledges
the following additional securities;

NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Mounds View authorizes its Clerk -Administrator to
approve and accept the securities provided by the First State
Bank of New .Brighton in the amount of $2,700,000 as listed on
the attached documents labeled Exhibit A.

3. Copy of the Interest and Assessment Guarantee Bond

The improvements for this project have been installed, accepted
by the City and all assessments payable in the years 1983, 1904
and 1985 have been paid.
The City will continue to hold the Performance Bond for
Development Agreement No. 82-52 in the amount of $90,000.
' RECOMMENDATION:. Staff recommends release of Bond #400 GD 7567.

RESOLUTION AUTHORIZING RELEASE OF INTEREST AND ASSESSMENT
GUARANTEE BOND FOR DEVELOPMENT AGREEMENT NO. 82-52 WITH
KRAUS-ANDERSON DEVELOPMENT CORPORATION AND M & E REALTY COMPANY
WHEREAS, the Developer, Kraus -Anderson Development
Corporation and M & E Realty Company, were required'in
Development Agreement No. 82-52 to post securities in the amount
of $470,250 to assure payment of taxes and assessments due and
payable in 1963, 1984 and 1985 and to guarantee payment of costs
incurred by the City in the event the public improvements for the
project were not constructed; and
WHEREAS, the improvements were installed and accepted and
all assessments noted above have been paid; and
Po'HEREAS, the City of Mounds View will continue to hold the
Performan:e Bond in the amount of $90,000 submitted by the
Developer to assure completion of all requirements of Development
Agreement No. 82-52; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Mounds View that satisfactory completion of public
improvements and payment of taxes and assessments due and payable
in 1983, 1984 and 1985 for Development Agreement•.No. 82-52 is
hereby acknowledged and release of -the $470,250 bond is hereby
authorized.

Interest and Assessment Guarantee Bond
KNOW ALL MEN BY THESE PRESENTS, that we M & E Realty Company, a
Minnesota Corporation, and Kraus -Anderson, Inc., as Principals,
and the St. Paul Fire & Marine Insurance Company. as Surety,
are held and firmly bound unto the City of Moundsview, Minnesota,
as Obligee, in the sum of $470,250.00, for the payment whereof,
Principals and Surety bind themselves, their heirs, executors,
administrators, successors and assigns, jointly and severally,
firmly by these presents.
WHEREAS, the Principals have entered into an agreement with Lhe
Obligee, and whereby the Principals have guaranteed to pay the
Obligee the interest and assessments due in 1983, 1984, and 1985
for certain Public improvements: or, in the event the Public
improvements are not constructed, the direct cost of the Obligee.
NOW, THEREFORE, the condition of this obligation is such that,
if the Principals shall pay, or cause to be paid, all payments
as specified above, then this obligation shall be void; otherwise
it shall remain in full force and effect.
PROVIDED, HOWEVER, that the Obligee shall notify the Surety, in
writing, of any payments which shall have been past due for 60 days,
such notice to be mailed to the Surety at 385 Washington Street,
St. Paul, Minnesota, and received by the Surety within 105 days from
the date on which such payment was due. Failure to provide such
notification shall operate to terminate this bond at the expiration
of such 105 day period and Surety shall have no obligation for any
liability arising after that date.

STATE OF MINNESOTA
RESOLUTION COMMENDING BRUCE ANDERSON FOR OUTSTANDING
SERVICE AS PARKS, RECREATION AND FORESTRY DIRECTOR
WHEREAS, on November 7, 1977 Bruce Anderson commenced
employment as Parks, Recreation and Forestry Director for
the City of Mounds View; and
WHEREAS, during his tenure Bruce has also served as
Acting Clerk-Admin?strator.on two occasions assisting the
City in periods of transition and providing a stabilizing
force; and
WHEREAS, Bruce has assumed all of his duties and
responsibilities with a high level of enthusiasm and energy
and co.,cern for the welfare of the citizens of Mounds View;
and
WHEREAS, Bruce has always left his co-workers,
residents, Commission and City Councilmembers with a light
heart and a sense that all is right with the world and has
always proved to be a delight to work with.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Mounds View on behalf of the residents and
employees of the City of Mounds Vies. commends Bruce Anderson
for his outstanding service as Parks, Recreation and
Forestry Director and offers its heartfelt best wishes for
the future.

MOUNDS VIEW DEVELOPMENT AGREEMENT NO. 86-77
STANLEY FISHER ADDITION
THIS AGREEMENT made and entered into this day of
19 , by and between the CITY OF MOUNDS VIEW,
County of Ramsey, State of Minnesota, party of the first part,
hereinafter called the "City.",
and Marcella Rybak
party of the second part, hereinafter called the "Developer",
W I T N E S S E T H:
WHEREAS, the Developer, in consideration of a major
subdivision (1 lot into 9 lots ar..: 1 outlot)
and the issuance of permits thereof, hereby agrees with the City to
perform all of the acts required herein and to conform to all of
the conditions set forth as follows:
1. Wherever the word "City" appears herein, it shall mean
and include the City of Mounds View and also said City's agents and
employees; and eherever the word "Developer" appears herein, it
shall mean the developer, and any of its agents and employees.
Wherever the words "development site" appear herein, it shall mean
the premises described in the following exhibits:
Exhibit 1 (legal description)
Exhibit 2 (site and grading plan)
Exhibit 3 ( site survey )
Exhibit 4 (Ordinance No. 49A 7-year

the City in the processing, review and evaluation of the proposed
development and in the inspection of all work performed pursuant
to said contract. Such costs shall include but not he limited to
the adwinistrative, legal, and engineering expenses incurred herein,
and such other expenses as authorized by said Chapter.
13. Developer agrees that the City can terminate development
of the development site or the construction of any building struc-
tures thereon if in the City Council's opinion the terms of this
Development Contract have not been conformed to by the developer
and the said Developer herein agrees to cease construction and
waives its right of recourse, claim, suit or action against the
city. In addition, in the event the Developer fails to conform to
the conditions of this Agreement, the City shall be entitled to
enforce it pursuant to the terms of this contract and/or the provi-
sions of the Mounds View Nome Rule Charter, Chapter 26 of the
Municipal Code, or applicable Minnesota Statutes. The Developer
herein agrees that in the event the City is compelled to enforce
any of the provisions of this contract by court action and judgment
is rendered in favor of the City, that all costs, disbursements
and reasonable attorney's fees will be paid by said Developer, its
heirs, successors and assigns.
14. The Developer shall furnish to the City at the time of
the execution of this Contract a cash bond, a corporate surety bond,
an irrevocable letter of credit or any Ether negotiable instrument
approved by the City Attorney, which the Developer agrees to keep in
full force and effect during the term of the obligation created
herein in the amount of 5,000 (five thousand)

EXHIBIT 2A .
In addition to the foregoing conditions, the Developer agrees
to the following:
1. Developer shall submit drainage easements or
title for outlot A per Resolution No. 2004
within 30 days of final plat -approval by Ramsey
County.
2. Remove accessory building (6hed) and garage from
site by December 1, 1986.
3. Adjust baffled weir and inlet structure perCity
Engineer's direction.
4. Install baffled weir and inlet structure by
December 1, 1986.
S. On each lot, a•single family house shall be
constructed. ..
6. No building permits Faall be issued until the final
plat is approved and -ecorded by 'Ramsey County.
7. Furnish a $1,000 sec city for 7 years to guarantee
the ponding area and control. structure.
8.' Developer shall install sewer and water service lines
to the lots without service lines.
