The Mounds View City Council was called to order by 1. Call to Order

Tom Snoffer, of JLN Development:, updated the Council on
the status of their proposed development in Mounds View.
He reviewed the three major concerns the Planning
Commission had expressed, access onto County Road H2,
parking and water retentii)n, and how they are addressing
them. He stated they hope cc meet with the Council at
the September. 15 agenda session to review the traffic
report, engincerin•,t report and get an update on the
tax increment finai:cing. He added they will also be
meeting with the Planning Commission on September 17,
when the Planning Commission is holding an informational
hearing on the development.

Councilmember Hankner clarified that the judges being
appointed in Item H were for the primary election
only, and judges will be appointed again for the
general election.
Alice Frits, 8072 Long Lake Road, stated she would like
to see each election judge sign an affidavit stating
which political party they belong to.
Councilmember Hankner stated she had checked into
State statutes and determined that the Council can
establish additional qualifications for election
judges, and suggested they take it under consideration
for the general election.

additional qualifications for election judges on the
next agenda.

Mayor Linke closed the regular meeting at 7:12 PM and
opened the public heating for the 1987 general fund,
forestry fund, water and sewer fund budgets.
Clerk/Administrator Pauley reviewed the budget process
to date. He explained the budget before the Council
is the third draft, and it is balanced.
Finance Director Brager reviewed the proposed 1987
budget for the general fund, forestry fund, and sewer
and water fund. lie explained that the City's portion
of the overall property taxes is 14%.

Councilmember Hankner stated she had not had much time to

;everal questions, and she asked for additional information
on estimates for the contingency fund, the expenses
associated with the Festival in the Park and the Staff/
Council picnic, Clean -Up Day, grants and subsidies, with
the North Suburban Youth Service Bureau in particular,
funding for the Comp Plan, what salary proposals might
be, legal fees, moving training, conferences and publica-
tions over to the administrative section, and use of vehicles
by which departments.
Clerk/Administrator Pauley reviewed the areas of concern
briefly, and stated he would put these items on the
agenda for next week, for a budget discussion. He
clarified that the comparable worth study has not been
finalized, which is what will dictate what tce salaries
will be.
Mayor Linke asked why the market analysis for the compara-
ble worth study was not done while the study was being
worked on.
Clerk/Administrator Pauley replied it iE being worked on
presently, and the information is very difficult to
obtain from the private sector.

Mayor Linke closed the public hearing and reopened the
regular meeting at 7:59 PM.
Finance Director Brager reported they had had a difficult
time recruiting water meter readers, and have just
finalized the list and asked for Council approval, so
they could get started next week.

Mr. Frits asked when the oak trees that have been marked
for removal will be cut.
Mayor Linke replied he had spoken with the Forester, and
the best time to take care of oak wilt is in the fall,
and they will be done soon.

Director Thatcher explained there is a house on the site, 12. Consideration

approve the development agreement and instruct Staff
to negotiate with the developer whether they would
agree to remove the house, and by what specific date.
There was discussion as to whether the Council could
actually require the developer to remove the house,
as it meets all code requirements.

Motion/Second: Hankner/Haake to approve Development
Agreement 86-77 and waive the reading, and direct Staff
to negotiate for the removal and a specific time, for
the rybak house, with the Rybak's. The agreement is to
be inserted into the development agreement upon comple-
tion of the discussion.

Planning Commission Chairman Mountin asked whether the
site plan had the 5' easements shown on all side.

Mayor Linke opened the discussion with the Planning 13.
Commission on the Wuornos report by explaining to the
audience that the report was a planning study dealing
mainly with the highway frontage along Highway 10, and
he briefly reviewed the findings of the report and
the recommendations given,
Chairman Mountin stated the Planning Commission felt
B3 might be too intense a use for that area, and they
would have to downzone to 82, which is not workable.
She stated they would like to discuss with the Council
just how much commercial area the City is going to
live with, and discuss the criteria for it.
Councilmember Hankner stated it was her understanding
that -the Council was going to be getting a presentation
from the Planning Commission on their findings and
their reactions to it.
Chairman Mountin stated the Wuornos study was prepared
at the request of the Council. The Planning Commission
received it, studied it, wrote their findings and
forwarded it to the Council in June, and Staff has
critiqued the Planning Commission's recommendations.
She stated they discussed the goals and plans for the
City, and the philosophy of planning for the City,
and the Council must now make a determination of what
they want done. She added it would require a 4/5 vote
on the Council's part to make any changes, and the
Planning Commission would then act, based on direction
from the Council. She added the Planning Commission
does not feel they have the background and expertise
to go after large development.
Councilmember Hankner stated the residents of the City
need to know how the Planning Commission feels, and
how they addressed the study, and she asked if they
had informed the public as they were working on the
tudy.

Chairman Mountin explained the public was invited to

meetings during the Wuornos process. She added they
have nothing to present to the public, and that what
they are presenting to the Council is their findings
of their review of the wuornos study. She added the
residents were not in favor of intensified development.
Councilmember Hankner stated she was concerned with
the Planning Commission'- findings and whether they
represented the thoughts of the rest of the community.
Chairman Mountin stated the Planning Commission is
not happy with having a strip, but they are stuck
with it and must find a workable solution for the
area. She stated she feels the best way is to
educate the community through the newsletter and
perhaps fliers, and proposing a planning referendum.
Mayor. Linke stated they must look at redevelopment
and planning for the future, and that is what the
C(..^p Plan is all about.
Chairman Mountin stated they need to establish

input from the Council, and some direction.
Mayor Linke stated he would like the Council to
make a decision.
Councilmember Haake suggested they start out with
goals and policies first, and work from there. She
stated she would like a hearing set, and notify the
residents through the newsletter and so forth, and
invite them to come in and voice their opinions.
She stated she would like to get their input before
making any changes.
Mayor Linke stated they need to have more definite
plans to present to the residents, not generalities.

and Council get together in a workshop setting and
discuss where the City is going five, ten and fifteen
years from now.

Clerk/Administrator Pauley advised they need to focus
r� the fact that the problem with Chapters 6 and 12 is
problem across the board, and the City is in the
process of change. fie stated Staff has had a good deal
of discussion, and they would recommend the City Council
and Planning Commission program the Comp Plan review and
update, establish deadlines, budget funds, and hire a
consultant, who would be needed to do strategic planning
for the City. He added they must remember the moritorium
ends in January, and Staff anticipates many requests for
many developments at that time, and they need to get
the stragetic planning process going and establish goals
that can be agreed on.
Chairman Mountin stated she agrees with Cleric /Admiris tra-
tor Pauley, and she would like to see a joint meeting
with the Council and Planning Commission, and have a
facilitator determine the goals of the City. She added
they can begin the Chapter 40 review on specific areas
and do housekeeping matters.
Councilmember Haake pointed out Mounds View has a
majority of R-1 development, and they are only dealing
with a small percentage of land in the City for
commercial consideration.
,—Clerk /Administrator Paulev recommended recruiting a
Jraduate student to work for the City on this. He
stated they generally do vrry good work and are not
that expensive to hire.
There was a general discus -ion about the moritorium and
what could happen once it ,s lifted and whether anything
could be built beforehand.
John Bannigan, an attorney representing Kunz Oil, stated
they hope to get their project started soon, as winter
is coming. He stated they feel their development would
improve the area, and they would like permission to
start. He added that they first came before the Council
in December of 1984.
There was discussion among the Council of what was
required for Kunz oil to proceed. Attorney Meyers
advised they must keep implementation in mind, and many
different uses could create problems in implementation.
He also advised they keep the overall area in mind.
Mayor Linke suggested discussion the resolution for Kunz
oil at the next agenda session, and place on the agenda
for the September 22 meeting.

Councilmember Blanchard reported she had attended
the waste energy proposal meeting at Ramsey County
on September 2, and the Planning Commission meeting
on September 3.
Councilmember Quick had no report.
Councilmember Hankner had no report.
Mayor Linke reported he had been contacted by the
Commission on the Bi-Centennial of the U.S. Consti-
tution, asking the City to set up a Commission to
help in this observation and celebration. He s ated
he would give the letter to Clerk/Administrator
Pauley to copy for the Council.
Mayor Linke asked how far the branch #5 cleaning is
going with the Rice Creek Watershed District, and
whether $15,000 would be enough.

be held at Mounds View City gall on September 17, and
they will discuss the Mounds View pipeline disaster. He
also advised the JLN Development informational hearing
will take place at the same time, at Edgewood Community
Center.
Mayor Linke reported he will be attending a Court
Consolidation Committee meeting on September 10.

Mayor Linke advised that John Miller is trying to get

of the holdup in Blaine.

Balk/Spano benefit dance to be held September 24 at
the Bel Rae Ballroom.

to continue Deanna Mortenson for another. 80 hours, to
provide clerical. assistance.

of Deanna Mortenson for a period of 80 hours at a rate
of $5.00 per hour, commencing September 3, 1986.

the areas designated on the City ,a wetland mnp were larger than
tile. actonl wetland ores. A map indicating the proposed wetland
and prnnnggd wetland buffer wren in attachment 02 of the Planning
commiasion resolution.
The Planning Commission has reviewed thin request and recommends
approval.
RF.COMIIENDATION: Stnff recommends approval of this request. A
public hearing is required prior to approval of this wetland
redelineation. The earliest a public hearing can be scheduled is
September 22, 1986, nt 7:05 p.m. The public hearing notice
should then be published in the New Brighton Bulletin and a
notice mailed to all property owners within 350 feet of the
property by September 4, 1986.

In northern Mounds View. During our meeting, of January 9, 1986,
you stated that the City would, upon a letter of request from the
developer, direct Tom Peterson of the Ramsey Soil and Water
Conservation District to perform this delineation.
In our January meeting, you also stated that the City staff recom-
mends that the developers be present when Mr. Peterson "stakes out"
the property. We appreciate and accept this recommendation.

RECOMMENDATION TO THE CITY COUNCIL REGARDING PLANNING CASE
NO. 195-86, REDELINRATION OF WETLAND I.D. NO. I-23
WHEREAS, Watson -Forsberg has requested City approval of
the redelineation of Wetland I.D. No. I-23; and
WHEREAS, Tom Peterson of Ramsey Sail and Water
Conservation District (RSWCD) and Steve Thatcher, Director of
Public Works/Community Development, located the wetland on the
subdivision on May 21, 1986; and
WHEREAS, the wetland located by RSWCD is smaller than the
wetland zoning district map in the City Code; and
WIIEREAS, th- Dite.tor of Public Works/Community
Development prepared a report dated July 24, 1906 (Attachment 41)
recommending approval; and
WHEREAS, City Code Chapter 48.02 allows the wetland zoning
district map to be amended by four -fifths affirmative vote of the
City Council; and
WHEREAS, City Code Chapter 48.02, Subd. 5(c) states that
all structures shall be set back at least 100 feet from the
wetland;
NOW, THEREFORE, BE IT RESOLVED that the Mounds View
Planning Commission recommends amending the wetland zoning
district map per. .Attachment 62;
BE IT FINALLY RESOLVED that the Mounds View Planning
Commission directs sLal.f to forward this resolution to the
City Council prior to approval of the minutes.

RESOLUTION REGARDING CITY PROJECT NO. 86-6, REPAIR OF
JUDICIAL DITCH NO. 1, BRANCH NO. 5
WHEREAS, a letter dated September 2, 1986, from Rice Creek
Watershed District indicated that they will contribute up to
$15,000 for the repair of Branch No. 5, Judicial Ditch No. 1
provided that certain conditions are met; and
WHEREAS, this ditch needs to be repaired to its original
cross-section and grade; and
WHEREAS, other funding sources are not available for this I
repair; and
WHEREAS, the estimated cost of repairing this ditch is
$60,000.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City
C uncil spend up o $45,000 from the Storm Water Management Fund
for the repair of this ditch.
BE IT FURTHER RESOLVED that the Mounds View City Council

MEMO TO: Mounds View City Council

Parks, Recreation and Forestry

RE: City Puppet Wagon
As you are aware, the City has purchased a new puppet wagon in
1986 to replace the 1969 International truck that was purchased
seven years ago. The old puppet wagon truck is in extremely poor
condition and currently is not road worthy due to a broken wind
shield, poor body and mechanical condition. As can be noted in
the enclosed flyer, staff has attempted to sell the vehicle
through the state recreation assocation, and we had only one
interested taker, that being the narks and Recreation Director in
the City of Arden Hills who has made an offer of $50.00 for the
vehicle.
Staff would recommend that the vehicle be declared City surplus
and that we sell it to John P..ckley in Arden {tills for the amount
of $50.00. Not only will this save the City money from an insur-
ance standpoint, but it will also remove an eyesore from the
City's public works garage area.

ONE EXPERIENCED PUPPET WAGON
The City of Mounds View regretfully announces the retirement
(with honor) of our highly motivated and experienced puppet
wagon. Although the body is not quite as willing, her spirit is
excellent which should carry her on through 1990. Her vital
statistics include: 1967 International Van, 69,000 uns and drives
with
all equipment in fair condition, it actually
well, (no audio equipment included). With a new paint job and
some tender loving care, she could once again be the pride of the

RESOLUTION DENYING VARIANCE FOR DYNAMIC DESIGNERS PROPOSAL,
PLANNING CASE NO. 138-03
WHEREAS, Mr. Jim Cepress, of Dynamic Designers has
requested approval to construct a 7-unit condominium at
7656 Woodlawn Drive; and
WHEREAS, construction of this ccndominium requires
approval of certain variances; and
WHEREAS, the Planning Commission reviewed the proposed
development and the variance request on September 3, 1986; and
WHEREAS, the Planning Commission denied Mounds View
Planning Commission Resolution No. 170-86; and
WHEREAS, the major reason for denying the resolution was
because there was no hardship statement justifying why the usable
open space requirement should be waived; and
WHEREAS, Dynamic Designers has appealed the variance
denial to the City Council in a letter dated September 8, 1986;

WHEREAS, the Mounds View City Council discussed this
variance request with the Developer on September 15, 1986.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View City
Council denies Dynamic Designers request for a variance on the
open usable space requirements of the City Code.

Dear Mr. Boyles:
The Mounds View City Council has carefully reviewed your letter of
June 17, 1986. We understand the following:
1. You have requested a 4.51 variance on the rear lot line
setback for an accessory building.
2. The Mounds View Planning Commission denied your request for
a variance on August 7, 1985 (Resolution No. 140-85).
3. The Mounds View City Council, prior to your June 17, 1986,
letter denied your appeal for relief from Mounds View
Planning Commission Resolution No. 140-85.
4. You constructed an accessory building 6 inches from the
rear property line.
Since June 17, 1986, the City of Mounds View surveyed other cities
in the area to determine their setback requirements for accessory
buildings on corner lots. The survey determined that our setback
requirement is similar to other cities.
The Mounds View City Council at their September 22, 1986, meeting
directed me to send this letter to you stating that your accessory
building location is violating the City Code, and if it is not
moved to a location that meets City Code requirements within
thirty (30) days of receipt of this letter, staff is directed to
turn this matter over to the City Attorney for legal action.

I would like to express my extreme disappointment in the decision
of the Council against the variance for our shed.
In defense of our building the shed where we dial was due to Lhe
size of our back yard only. .lie had discussed the plans with our
neighbors as well as thetieity of Mounds view prior to any building
that occurred. The claim of the Council was that we had
constructed the shed there to test the authority of the Council.
This simply is not true. Another claim was that we were asking
for a variance now after the building was constructed. Again,
this is not true. We had about 11 months ago, requested
a variance.
We, for the last 9 months, have achieved privacy at last. Our
entire living area is exposed without the shed. If our shed were
an eye sore, I could, to a degree, understand the decision of the
Council.
Personally, I cannot help but feel somewhat harassed. I find
myself wondering why, when we went through the appropriate
channels 11 months ago, were denied and when we were given the
citation, why the other residents on the two block area did not
receive any that are also in violation.
Again, I must say that due to size of our back yard, feel that
your decision was not the best that could have been made..
We will be anxiously awaiting the next election.

SUBJECT: JUDICIAL DITCH 81 MAINTENANCE PROJECT
As you may recall, since July of this year Staff and Council
have been dealing with the repair of Judicial Ditch 91,
Branch 5 located in the City of Mounds View from Bona Road -
to where Branch 5 intersects with Judicial Ditch 41 in
Greenfield Park. In response, to n request from the City of
Mounds View, the Rice Creek Watershed District has agreed to
contribute $15,000 in support of a project which is
estimated by City Engineer Thatcher to cost $60,000. The
aunstion before the City Council at thin time is, "What
funds are to be used to finance the City's portion of this
project?"
During the discussions undertaken at the September 15 Agenda
Session essentially two sources of funding were identified.
First would be to special levy thahe costs under recently
approved legislation for public works maintenance and repair
or finance the project using interest earned In 1987 as well

as principle from the Storm Water Management Fund.
r After evaluating the two options before the Council at this
time, Staff would recommend that the first not be used in
that a very brief period of time is available before all
levies must be certified to the County and any levy that
might be undertaken would simply be on the basis of a one
year response to this project. Staff would recommend that
the Council, instead, direct the City Engineer to prepare a
plan for a ten year program of repair and maintenance to the
City's storm drainage system including the identification of
fund sources and a cashflow analysis to provide for an even
flow of special levies using the previously referenced
authority.
For the project in question, Staff would recommend that the
Council authorize the expenditure of $45,000 from the City's
Storm Water Management Fund comprised of $30,000 in interest
earned during 1987 and $15,000 in principle. Such action
would not have a significant impact upon the current balance
within the storm water management fund which is listed as
being $278,000 in the 1935 financial statements. Staff in
aware of an additional $25,000 in revenues being received
since the beginning of this year which would, assuming no
expenditures have been made, provide for the fund to have a
balance in excess of $300,000.

WHEREAS, a letter dated September 2, 1986, from Rice Creek
Watershed District indicated that they will contribute up to
$15,000 for the repair of Branch No. 5, Judicial Ditch No. 1
Provided that certain conditions are met; and
WHEREAS, this ditch needs to be repaired to its original
cross-section and grade; and
WHEREAS, other funding sources are not available for this
repair; and
WHEREAS, the estimated cost of repairing this ditch is
$60,000.
NOW, THEREFORE, BE IT RESOLVED that the Mounds Vicw Ciry

BE IT FURTHER RESOLVED that the Mounds View City Council

During the Comprehensive City Code review, the City Council took
the position that Chapter No. 70.03 entitled, "Liability for
Repairs" and Chapter No. 71.10 entitled, "Maintenance of Sewer"
should be amended to read as presented in Ordinance Nos. 411 and
412.
The present Code states that the property owner is responsible
for repairs and maintenance of water and sewer lines from his/her
house to his/her property line. The Code, when amended by
passing Ordinance Nos. 411 and 412, will assign the responsi-
bility for maintenance and repair of the water and sewer service
lines from the house to the water or sewer main in the street to
the property owner.
I request that you pass these two ordinances as soon as possible
because we continue to spend valuable staff time excavating and
repairing sewer service lines where the exact location of the
blockage cannot be determined.

The City Council of the City of Mounds View does hereby

SECTION I. chapter 70.03 entitled, "Liability for. Repairs"
is hereby amended to read as follows:
1,0.03 Liability for Repairs. After the initial connection
has been made to th� ain, the applicant, or the
occupant or other user. of such premises shall be liable for
all repairs between the water main and the structure located
on the premises. Mains of the curb stop box shall be that of
the applicant, owner, or occupant or other user of tre
premises and it shall be the responsibility of said party to
maintain the curb stop box at such height as will ensure that
it will remain above the finisyh gtdde of the land or
property. Nothing herein will prevent the municipality from
recovering the cost of repairs from the applicant, owner, or
other occupant or other user of such premises or any other
Party in the event it can established that said parties were
the cause of the damages requiring the repairs.
This ordinance shall take effect thirty days after the date
of its publication.

Mr. 8lasberg constructed a house at 8106 Groveland Road in 1979.
The house was constructed over a 40' wide sewer easement. The
problem was noted in a title opinion conducted in 1986. One
other title opinion conducted on this property did not locate or xA
identify the easement.
City Attorney Meyers and myself have reviewed :;his issue and have
determined that the sewer easement under the house is not needed
by the City. The Planning Commission reviewed this item at their
Agenda Session on September 17, 1986. The Planning Commission
recommends vacating the sewer easement under the subject house.
RECOMMENDATION: City Attorney Meyers and myself recommend
vacating the easement per Resolution No. 2092.

RE: Irrigation
Staff would like to propose that the City consider installing an
underground irrigation system for the front of City Hall. At this
time, I have contacted three firms for quotes and we will be
receiving them on Friday, September 19, 1986. The irrigation sys—
tem can be funded out of the City Forestry account, as we did not
employ a forestry assistant this summer due to the fact that we
were able to utilize summer J.P.T.A. staff to work in replacement
of Odas Newton who underwent knee surgery.
Sto f feels that the irrigation system would be a welcome addition
to the front of City Hall, as it is the showcase for our City
residents who do business at the City and would greatly improve
the quality of the turf as well as the trees, and flowers and City
sign area.
The reason staff is requesting this at such a late date is that we
were waiting for budget printouts to determine if there would be
enough dollars to do such a project. Due to the impending bad
weather, staff would like to have the opportunity to present ver—
bal quotes and respond to any of your questions at Monday even—
ing's Council meeting so that this project could commence as soon
as possible should you feel it's a worthwhile improvement.

RE: Irrigation System
Encicsed are copies of two bid proposals that I did receive on
Friday afternoon regarding the irrigation for the front of City
Hall. Staff is expecting a third system bid to come in on Monday,
but I wanted to allow you the opportunity to review the two pro-
posals that we have received to date so that you have any idea of
what the total dollar amount will be.
It appears that we have received an extremely favorable bid from
Aqua Engineering, Inc. in the amount of $3,272 based on my discus-
sions with the three other irrigation firms. The two systems that
have been bid are very similar between Aqua City and Aqua Engin-
eering and we will need to wait for the third bid to be submitted
before a final recommendation can be made at Monday evenings meet-
ing.
Staff will be happy to respond to any questions you may have
regarding the three proposals on Monday and look forward to your
comments.

WHEREAS, The City of Mounds View has been requested
by JLN Development, Inc. to provide tax increment assistance
to a commercial/industrial development proposed on a 60 acre
site in the City; and
WHEREAS, the City has reviewed the development
proposal and determined it to be in the best interest of the
City.
BE IT RESOLVED, by the City Council of the City of
Mounds View, Minnesota as follows:
Section 1. Recitals.
1.01 It has been proposed that the City establish
Development District No. 2 and establish Tax Increment
Financing District No. 1 therein and approve and adopt the
proposed Development Program and proposed Tax Increment
Financing Plan with respect thereto, all pursua.it to and it
accordance with Minnesota Statutes, Chapter 972A, as
amended, and Minnesota Statutes, Sections 273.7I t, 273.78,
inclusive, as amended.
1.02 The Council has investigated the facts and
caused to be prepared a proposed Development Program for
Development District No. 2, defining more precisely the
property to be included in Development District No. 2 and
describing the action to be undertaken by the City to aid
the development of Development District No. 2, and has
caused to be prepared a proposed Tax Increment Financing
Plan defining more precisely the property to be included in
Tax Increment Financing District No. 1 and other matters
relating thereto.
1.03 The City has performed all actions requiceu by
law to be performed prior Lo the establishment of
Development District No. 2, the establishment of Tax
Increment Financing District No. 2 and the adoption of the
proposed Development Program and proposed Tax Increment
Financing Plan relating thereto, including, but not limited

2.01 The Council hereby finds that the establishment
of Development District No. 2 is intended and, in the judge-
ment of this Council, its effect will be, to provide an
impetus for commercial and industrial development in the
City, to increase employment, and otherwise promote certain
public purposes and accomplish certain objectives as
specified in the Development Program.
Section 3. Findings for the Establishment of Tax
Increment Financing District No. 1
3.01 The Council hereby finds that in certain
portions of Tax Increment Financing District No. 1, at least
70 percent of the parcels in the district are occupied by
buildings, streets, utilities or other improvements and 20
percent of the buildings are structurally substandard and an
additional 30 percent of the buildings are found to require
substantial renovation or clearance in order to remove such
existing conditions as: inadequate street layout,
imcompatible uses or land use relationships, overcrowding
of buildings on the land, excessive dwelling unit density,
obsolete buildings not suitable for improvement or
conversion, or other identified hazards to the health,
safety and general well being of the community.
3.02 The Council further finds that the proposed
development, in the opinion of the Council, would not occur
solely through private investment within the reasonably
forseeable future and, therefore, the use of tax increment
financing is deemed necessary; that the Tax Increment
Financing Plan conforms to the genera plan for the
development or redevelopment of the City as a whole; and
that the Tax Increment Financing Plan will afford maximuM
opportunity consistent with the sound needs of the City as
whole, for the development of Tax Increment Financing
nictricr_ No. 1 by private enterprise.
3.03 The Council further finds that the establish-
ment of Tax Increment Financing District No. 1 and the
approval and adoption of the Tax Increment Financing Plan
relating thereto is intended and, in the judgement of this
Council, its effect will be, to promote the public purposes
and accomplish the objectives specified in the Tax Increment
Financing Plan.
3.04 The Council determines and declares that
Development District No. 2 is hereby established an' that
Tax Increment Financing District No. 1 located therein is
hereby established.

Section 4. Approval of the Proposed Development
Pro ream and Proposed Tax Increment
Financing Plan
4.01 The Proposed Development Program for
Development District Nu. 2 and the Tax Increment Financina
Flan for Tax Increment Financing District No. 1 are hereby
approved and adopted and shall be placed on file in the
office of the Clerk -Administrator.
