Adjournment CONSENT AGENDA DECEMBER 8, 1986 The Consent Agenda is a technique designed to expedite handling of routine and miscellaneous official business of the City Council. The entire agenda may be adopted by the Council in one motion. The motion for adoption is non - debatable and must receive unanimous approval. By request of any individual Councilmember, an item can be removed from the Consent Agenda and placed upon the Regular Agenda for debate. ITEM A. Adopt Resolution No. 2140 Approving Just and Correct Claims Against City Funds MEMO TO: Mounds View City Council FROM: Mary saarion, Acting Director Parks, Recreation and Forestry DATE: November 20, 1986 RE: 1987 City Newsletter. Bid opening Bid proposals and specifications were sent to aprpoximately 24 perspective bidders. The bid opening was held Thursday, November 20 at 10:30 a.m. at City Hall. Six companies submitted proposals. The bid proposals ranged from a low bid of $50.50 per page to a high of $82.57 per page. This reflects an annual cost ranging from $8,8e8.00 to $14,532.00. It is recommended that the low bid of $50.50 per page or $8,888.00 be awarded to Advanced Printing. Advanced Printing served as'the newsletter printer for the City of Mounds View in 1985 and 1986. Staff has been very pleased with the quality and promptness of their work. Tile cooperation and service dedication of this company has I� been excellent. Staff feels confident that such a great working l relationsip will continue in 1987. If you have any questions regarding this recommendation, please call me at 784-3055, ext. #20. RECOMMENDATION: To Authorize staff to enter into a formal contract agreement with Advanced Printing at the rate of $50.50 per page or total printing cost of $8,888.00 for the printing of the 1987 Mounds View City Newsletter with funds to come from the City's general fund. NOW, THEREFORE, BE IT RESOLVED that the Mounds View City (� Council hereby publicly commends and thanks Ms. Cindy Linnell for her years of dedicated service to the City of Mounds View Parks and Recreation movement. Steve Johnson, representing Super America, explained they are asking for a conditional use permit, which was approved by the Council last year, but the year has expired, so they are asking for either a continu- ance or reissuance of the conditional use permit. Roman Mueller, of Super America, made a presentation of the site plan, grading plan, planned vegetation, floor plan of the building, and the building elevations, and he compared them to how they had been presented last year, showing what changes had been made. Councilmember Haake stated she frequently turns left from Highway 10, west onto County Road I, and she can forsee problems with cars turning right into Burger King, and left into Super America, and the traffic stacking up that is turning from Highway 10. She stated she is concerned and feels there is a potential for accidents. Director Thatcher explained Super America is dedicating an easement to the County, so the County could widen the road in the future for the right lane from County Road I to Southbound T. H. 10. The Department of Transportation will approve a turn lanerfrom County Road I to go south on Highway 10,.however, they will not approve of it until there is a demonstrated need for it. Councilmember Blanchard asked if the location of the loading dock has been changed. Motion Carried Public Hearing:; Super America G Mounds View City Council Regular Meeting ------------------------ Mr. Mueller showed the location of the loading docks, and he explained the berming is 4-5' between the two locations, with vegetation on top of the berming. Director Thatcher reviewed the plan that had been approved a year ago. He stated they have increased the proposed building size about 900 sf. fie added the Planning Commission has not reviewed this, as they did not have a quorum for their November meeting, but they do plan to meet November 12, and will discuss it then. Councilmember Haake reminded the Council the residents who had attended the hearing last year had many concerns about the proposed development, including having headlights shine in their windows at night. Councilmember Blanchard asked when the delivery trucks will be arriving, as the residents had expressed concern with that issue. A representative from Super America explained the Super America delivery i:ruck'wuuld come in the evening, once a week, and the gas truck would come more frequently, as the need was determined. He explained the majority of deliveries from the various vendors would be during the day, and they could request the Super America truck L: come on Friday evenings, around 5:30 PM, as they have a run in that area at that time. Councilmember Quick stated he was concerned with the planned berming and topography of the property, and whether it would be adequate. Mr. Mueller showed what they have planned, and explained what the various plantings would be. Councilmember Quick, stated he would like to see sight lines from the new drawings, to have a better idea of what will be visable to the residents in the area. Mr. Mueller explained he did not have that drawing available, but he pointed out how much more vegetation was planned now. Councilmember Haake stated she would like to see the berming remain as it was originally approved. She added that she has no problem with the increase in building size. Mary Larson, 2568 Mounds View Drive, asked if the traffic from Super America would be using Mounds View Drive. Mayor Linke replied that a good portion of the traffic could use .Mounds View Drive, and he explained that Mounds View Drive was planned as a service road, and it's purpose is to serve the commercial areas that will be November 10, 1986 Page Three Mounds View City Council Regular Meeting ------------ developed fronting along Highway 10, but will not have access onto Highway 10. Mrs. Larson stated they often have a mess with garbage from Burger King, and they are concerned with problems from Super America. She added she knew it was commercial property that was going to be developed when she purchased her townhouse, but she does not want to see large trucks using Mounds View Drive. Councilmember Haake stated they cannot determine which way the trucks will go, and she also pointed c;t that Mounds View Drive was designed as a service road for the commercial property. Mayor Linke closed the public hearing and reopened the regular meeting at 7:37 PM. Director Thatcher reviewed proposed Ordinance No. 415, and the necessity for it. Motion/Second: Haake/Quick to approve the first reading of Ordinance No. 415, amending the Municipal Code of Mounds View by amending Chapter 40 entitled "Zoning", and waive the reading. 5 ayes 0 nays Councilmember Hankner asked if this would conflict with any of the State statutes. Director Thatcher replied Staff had checked with the Fire Department, and they said it was not a problem. Attorney Meyers explained the City has the right to regulate development of the parks, but they cannot license them, as that is a State requirement. Clerk/Administrator Pauley replied they will not be taking any official action, so they can still discuss it and forward their findings to the Council. Mayor Linke asked Director Thatcher to talk to Super America and have them work with Kraus/Anderson on grading and berming, and so forth, and a shared access with the property next to them. Councilmember Blanchard stated the Council has the authority to readdress the hours of operation in one year to see whether they are working, and asked if the Council could make changes to the berming then, if they felt it was necessary. Clerk/Administrator Pauley stated they could ( rewrite the developmert agreement now, to include that. Mayor Linke pointed out that once the other sites are developed, there will not be any other land available for Super America to use for berming, so they should address the issue now. Director Thatcher reviewed proposed Resolution 13. Consideration No. 2126, relative to JLN Development. He stated of Resolution that per the Environmental Quality Board rules, No. 2126 the Council must make a final decision on the development by November 26, 1986. Attorney Meyers replied that those issues are encompassed in the City's lawsuit, and will not be affected by the repeal of the ordinances. Attorney Meyers reported a hearing is scheduled for 9 AM on November 13 in Federal Court, to discuss the safety of the pipeline, and if the Court does allow operation of the line, it would be regulated to not exceed 900 lbs, of pressure. Attorney Meyers reviewed the City's position on the closure of the line and why it is asking for replacement rather than repair of the line. Attorney Meyers reported he has done a preliminary review of the development agreement for JLN,,Develop- ment. Councilmember Quick welcomed Jerry Skelly and his 16. Councilmember Quick Councilmember Hankner reported the Governor's Councilmember Pipeline Commission will be meeting next Thursday, Hankner November 20 to begin working on the legislative recommendations.
