RE: Joint Property Tax Project
After two months of intense discussion and r-gotiation, a broad
partnership of Minnesota cities has decided to undertake an
important joint property tax research project. A 20-mamber
Property Tax Coordinating Committee has been organized by the
League for the purposes of researching property tax issues and
developing a joint, unified property tax proposal to be recommended
to the legislature during the 1989 legislative session. I hope we
can count on all cities to support this policy development process.
Groups representing cities are undertaking this joint project in an
attempt to overcome past policy differences and thereby make a
anified contribution to next year's property tax debate. Although
major changes in the state's property tax laws were enacted earlier
this year, we anticipate that further ni.gnificant changes will be
needed next year. It is extremely important that cities work
together to shape those changes and insure that they are in the
bL,st interests of all cities a.nd property taxpayers.
The League Coordinating Committee is composed of representatives of
city constituency groups from both the metropolitan and Greater
Minnesota areas. Represented on the Property Tax Coordinating
Committee are: the City of Minneapolis, thr. City of Saint Paul, the
Minnesota Association of Small Cities (representing over 300 small
cities), the Coalition of Greater Minnesota Cities (representing 45
cities outside the metro area), the Association of Metronnli<_an
Municipalities (representing 66 metro cities), and the Municipal
Legislative Commission (representing 15 suburban metro cities).
The League and each city constituency group will be making a
41 significant financial contribution to this project. The law firm
of Briggs and Morgan has been retained to provide the Coordinating
Committee with research and computer services. Additional research
and administrative support will be provided by League staff.
The Coordinating Committee will meet regularly on this project
during the next three months and expects to complete work on its
proposals by early January. We will be providing you with periodic
updates on the progress of our deliberations and will provide
individual cities information about details of any proposals tie
develop. If you would like further information about the project
or have recommendati-ns about policy changes, plepse contact any
member of the Coordinating Committee (list attached) or Laurie

SUBJECT: CELEBRATE MN PROJECT SELECTION PUBLIC NEARING
A public hearing mist be given for the approval cf the selection of a
Celebrate MN project choice for the grant application process. This is a
requirement for the grant application.
RECOMMENDATION: Approval to set a public hearing for Monday, December 12 for
final selection of the Celebrate MN project for the grant application process.

GRANT PROGRAM REQUIREMENTS
Each project component must support me of the three goals (i.e. cleanup,
beautification and/or community improvement projects) of the grant program and be
coordinated with a planned, locally sponsored celebration to be held in 1990.
Applicants must provide for public comments on the proposed Celebrate 1990project.
For cities and towns, public comment must consist of an official public hearing. The
public hearing must: l) be advertised in the official newspaper two weeks in advance
of the hearing; 2) be conducted in the evening hours and in a convenient location; and,
3) describe the proposed project and solicit citizen comments.
For Indian tubes, local community improvement or development organizations, public
comment must consist of a ;public meeting that also must::) be advertised in the local
newspaper two weeks in ad1mrice of the meeting; 2) be c3nduct:d in the eve.» ng hours
in a convenient location; and, 31 describe the proposed project and solicit citizen
comments. A copy of the public hearing or public meeting advertisemznt and minutes
must be submitted with the application.
In the formative stages of the project, the applicant should designate an individual as
the primary contact person for the project.'Iiris person would then be responsible for
overall project coordination prior to the submission of the application and the
:implementation of the project after the grant is awarded.
The grant program requires that a community provide three dollars for every one
dollar of grant funds requested. These local match dollars cannot include other state
o� program funds. Local match dollars could include federal, local and private funds or
fa in -kind services such as volunteer labor, donation of equipment time, and materials

CHARGES
In the past the Mounds View City Council adopted resolutions
including Nos. .1462 and 1633 establishing Lees and charges
for the provision of Agenda Session Packets and Agendas to
interested parties excluding members of the news media and
other governmental agencies.
The clerical staff of, the City recent'.y noted that previous
resolutions provided for the provision of Agenda Session and
Council Meeting packets and minutes but did not provide a
fee for the pruvision of Agendas cnly. Therefore; Staff is
proposing an addition to previous resolutions that would
allow for the provision of Agendas to interested parties dt
a charge of $15.00 per year. We feel this charge will be a
wash with the actual costs experienced by the City for
mailing out agendas.
RECOMMENDATION: Staff recommends Council adopt Resolution

RESOLUTION AMENDING RESOLUTION NO. 1633
ESTABLISHING VARIOUS FEES AND CHARGES
WHEREAS, Resolution No. 1633 adopted on July 25, 1988
amended Resolution No. 1462 which established various fees
and charges as provided for in the Municipal Code; and
WHEREAS, it is the desire of the City of Mounds View
to charge for the provision of agendas and minutes to
individuals and organizations other than those listed below:

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Mounds View that the following annual charge be
amended for the expense of providing copies of City Council
agendas and/or minutes:

to CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION REPEALING ASSESSMENTS
WHEREAS, in 1973 assessments in the amount of
$1U,1�)6.94 were levied against parcel number
06-30-23-24-0042-4 as deferred assessments for utilities and
street improvements, due to its ownership by a public
utility; and
WHEREAS, in 1986 this parcel was combined with other
vacant parcels of land and subdivided as the Stanlev Fisher
Adaition; and
WHEREAS once the subdivision was approved outstanding
assessments on the parcels that were included in the
subdivision were reapportioned except for the aforementioned
assessment; and
j WHEREAS, when made aware of this oversight, the City
determined that the bonds which paid for the public
improvements have since been defeased and no additional
monies are necessary to retire the bonds; and
WHEREAS, it is not the desire of the City to place a
burden on the single-family homeowners now residing in the
subdivision by reapportioning these assessments after the
fact.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the '"ity of Mounds View repeals all outstanding
assessments on Parcel No. 06-30-23-24-0042-4.

RESOLUTION APPROVING CONDITIONAL USE PERMIT TO ALLOW
FOR OUTSIDE DISPLAY AND SALES FOR STEVE'S APPLIANCE,
2841 HIGHWAY 10, PLANNING CASE NO. 251-88
WHEREAS, Steve's Appliance, 2841 highway 10, has requested
a conditional use permit to allow for outside display and sales
of items on his property; and
WHEREAS, the Mounds View Municipal Code, Chapter 40,18,
Subd. D(5), provides for open or outdoor sales as a principal or
accessory use by conditional use permit; and
WHEREAS, the Mounds View Planning Commission has reviewed
the applicant's request for a conditional use permit and
determines that it is in conformance with the Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Mounds View approves a conditional use permit to
allow for outdoor display and sales at Steve's Appliance, 2841
Highway 10, legally know as:
Auditor's Subdivision No. 89
Subject to Road, Part Northeasterly
of Highway of Lot 62
contingent upon the following:
1. Outside services, sales and equipment rental connected
with the principal use is limited to thirty (30) percent
of the gross floor area of the principal use.
2 Outside sales areas are fenced or screened from view of
neighboring residential uses or an abutting "R" district
in compliance with Section 40.04, Subd. H of this Code.
3. All lighting shall be hooded and so directed that the
light source shall not be visible from the public right-
of-way or from neighboring residences and shall be in
compliance with Section 40.04, Subd. I, of this Code.

Public Works Director Minetor explained the snow
and ice control policy must be adopted by ordinance
in order to be legally enforceable. H^ reviewed
the route map and the snow and ice control policy.
He explained stakes would be available for resi-
dents to pick up at City Hall and put in place in
their yards.
Public Works Foreman Ulrich reported there had been
no problems witn the snow plowing done this past
weekend, which had taken 8 hours.
If Foreman Ulrich is not available to make the deci-
sion on whether to plow or stop, the standty person
will be contacted, or Public Works Director Minetor,
who will then make the decision.

SUBJECT: VARIANCE DENIAL APPEAL FOR PUBLIC STORAGE, INC.,
LOT 1, BLOCK 9 AND A PORTION OF LOT 1, BLOCK 10,
SILVER LAKE WOODS, PLANNING CASE NO. 254-88
Attached is a letter from Donald Jensen of PSI and Tore Wistrom
of Kraus -Anderson requesting an appeal from the Planning
Commission variance denial. At this time, the Council
discussions and subsequent action should focus only on the
variance request for the PUD minimum size requirement.
PSI with Kraus -Anderson has requested the following:
1) A variance from the PUD minimum lot size requirement; the
site is 4.1 acres including proposed street vacated
right-of-way; the requirement is 5 acres.
2) A rezoning of the property from a B-2 to PUD; the issue is
whether a mini -storage facility should be a permitted or
conditional use in a B-2 zone; it currently is not.
3) A subdivision of the property; in order to accommodate the
mini -storage and office building proposed, the lots must
be re -subdivided.
4) Site plan approval; the developer requests approval of the
project and vacation of Mounds View Drive, north of County
Road I
Staff has felt, as did the Planning Commission, that the project
did not meet the conditions of Chapter 40.26, Subd. D, for
granting a variance.
The proposal letter submitted by PSI dated :-tober 11, 1988,
gives five reasons for granting the variance. .,,ey are as
follows:
1) Prior to Burger King Acquisition, this parcel was 5.1
acres, including Mounds View Drive, which is proposed to
be vacated.
2) The busin-ss of self storage is not specifically listed in
the current zoning book.
3) The business of Public Storage, Inc. and proposed office
uses meet the "purpose" definition of the mixed use PUD.
4) The shape of this remaining 4.1 acres creates more
development opportunities via PUD zoning than straight B-2
zoning.

Chapter 40.26 states the criteria for granting a variance:
1) Exceptional or extraordinary circumstances apply to the
properties which do not apply generally to other
properties in the same zone or vicinity and result from
lot size or shape, topography or other circumstances over
which the owners of the property, since enactment of th'-
Code, have had no control.
It is unclear that these properties have any exceptional
or extraordinary circumstances which apply to them and do
not generally to other properties within the same zone or
vicinity.
2) The literal interpretation of the provisions of this Code
would deprive the applicant of rights commonly enjoyed by
other properties in the.same district under the terms of
this Code.
All PUD rezonings approved in Mounds View have been over
the minimum size requirement.
3) That the special conditions or circumstances do not result
from the actions of the applicant.
While the special conditions (insufficient land) did not
occur as a result of the actual applicant, it is the
actions of M & E Realty (the landowner) which has caused
this situation. If M & E Realty had not sold the Burger
K'_ng site to Burger King Corporation or included it :n
this PUD, there would have been anough available land as
shown in reason #1 of Public Storage memo dated October
11, 1988.
4! That granting the variance requested will not confer on
the applicant any special privilege that is denied by this
Code to owners of other lands, structures of buildings in
the same district.
The granting of this variance would confer a special
privilege which is denied to other landowners within thiu
district.
5) That the variance requested is the minimum variance which
^^ld allnyiarp rhp hardship. Economic conditions alone
shall not be considered a hardship.
The requested variance is the minimum needed to alle,iate
the hardship. Although the applicant may be able to
obtain additional land negating the need for a variance.

6) The variance would not be materially detrimental to the
purpose of this Code, or to other property in the same
zone.
If granted, the variance may be materially detrimental to
the Code as it weakens the enforceability of the PUD
provision in the future.
7) The proposed variance will not impair an edequate supply
of light and air to adjacent property, or substantially
increase the congestion of the public streets, or increase
the danger of fire or endanger the public safety, or
substantially diminish or impair property values within
the neighborhood. The Board of Adjustment ind Appeals may
impose such restrictions and conditions upon the premises
benefited by a variance as may be necessary to comply with
the standards established by this Code, or to reduce or
minimize the effect of such variance upon other properties
in the neighborhood, and to better carry out the intent of
the variance.
Enclosed is a map of the site, Planning Commission minutes
(unapproved) and resolution of denial and a letter to Planning
Commission Chairperson Peg Mountin dated October 31, 1988. I
hope this information will be of use to you in dealing with this
appeal.

Dear Mr. Pauley:
Last evening, the Planning Conmission denied our application for PUD zoning
overlay of the B2 zone, which M & E Realty owns represented by Kraus -Anderson.
This denial was based on our request for a variance to the minimum size for a
PUD. This site is 4.1 acres, compared to the 5 acres minimum in the zoning
code.
We request an appeal of the Planning Commission decision to be heard by City
Council as soon as possible.
We plan to seek additional direction from you on how to solve this technicality
of minimum size for a PUD. Our business is operated, marketed and looks like
many B2 permitted uses. We know that our project will have minimal impact to
City services and will increase your tax base. We plan on providing an
irrigated, strong landscape design on our major frontage, County Road I, and
our small window of visibility on Highway #10. We are well aware of the
importance of curb appeal for the City as well as our prospective clients.
Our major hardship is the inference that our site design of many buildings will
have to he on individual lots. This is possible only by creating two buildings
which do nothing for the City in attempting to get away from the industrial look,
or Public Storage in providing a mix of accessible, safe, storage.

Donald Jensen, Development Coordinator for Public
Storage, Inc., showed the location of their proposed
development on an aerial map, and reviewed the
zoning map for that area of the City. He stated
they believe their use meets the B-2 zoning, and
they were directed to petition for a PUD. He reviewed
the marketirg goal of Public Storage, Inc., and how
they feel their proposal fits into the requirements
of the ,Code.
Mr. Jensen presented artists renderings of the pro-
posed development, noting they were still early in
the planning process and could stall make changes
in design or layout that may be required by the
Planning Commission.
Chairman Mountin explained the issue before the
Planning Commission is the variance issue, and they
must look to see if the need for a variance is caused
by some previous action on the property, r.nd look
further to see if there is a uniqueness of the property
that would result in a hardship. They must also look
for reasonable alternative: to using the site, and if
they are present, they would invalidate the hardship
issue. She also stated that in granting a variance,
it weakens the City's ability to enforce the Code.
Chairman Mountin explained 3 acres is required for
a PUD, and this proposal has 4.1 acres available after
the right of ways. Without a PUD, they would only be
ablo to have one building per lot.
Michael Bla-A, of. James R. Hill, Inc., asked the
Planning Commission to keep in mind the process of
how they got there originally, tLat this industry is
growing and changing and the ordinance does not
really address it. Public Storage, Inc. - has done
marketing studies which greatly slur thei' in the area of the City they are requesting, and he
feels the hardship issue is very technical, and he
asked that they consider the use, which he does not
feel is out of character for the neighborhood, and
is a good use for the property and the zoning.
Black noted that if this development is not approved,
no PUD would be approve,1 for that site, and he asked
that they consider the character of the neighborhood

currently written, is causing difficulties in certain
areas and they have lost some good developments

advantageous approach to development, and the City
has had fairly good success in using PUD's.
Mr. Black stated he did not want to lose focus on
the land issue, because there is not enough property
for a PUD, which would cause it to be denied. He
stated he feels there is some suppor, by the Planning
Commission, and he would like to be able to go to the
Council .with that.
Mr. Black added they could approach the property owner
to the north and attempt to purchase .9 acres, which
would involve the water works easement. He pointed
out, however, the development layouL would not change
as they could not build on the easement, so they would
(.—,not be adding anything.
Chairman Mountin pointed out the planned use is not
covered by the Code, and she polled the Commissioners
on their thoughts.
Commissioner Burgers stated he had recently observed
many storage facilities in the east and found them to
be primarily in industrial areas. Fie added that he
does not have much of a problem with the proposal if
they obtained the additional acreage needed.

Commissioner Zollner stated she cculd not favor
granting the variance as there is no hardship. She
also stated she does not agree with putting it in B-2
zoning, as while this proposal may be attractive looking,
they could also get unappealing ones and it would be
difficult to deny those on the basis of their looks. it
Commissioner Alman stated in going through the Code,
she feels the industrial zuning is best suited for this
use, but this is low impact and does look nice, so
Qho uould not have a _problem if the 5 acres was
available.
Commissiner Dian stated the design is attractive,

The review period for the Environmental Assessment Worksheet
(EAW) for SYSCO Development ended November 3Oth. During
this period the City recei•red three letters - one from the
Minnesota Pollution Control Agency, cue from the Minnesota
Department of Transportation and one from the Metropolitan
Council.
The Minnesota Pollution Control Agency raises the issue of
planned parking spaces. Since the writing of the CAW the
anticipated parking spaces has increased to 526 spaces.
Therefore, Ryan Construction/SYSCO Corporation will need to
obtain an Indirect Source Permit before building the 2nd
phase of the project.
The next step in the process would be for the Council to
approve the EAW.

The staff of the Minnesota Pollutirn Control Agency (MPCA.) has completed its
review of the above -referenced document. Relative to those areas for which the
MPCA has jurisdiction, the staff does not believe the project has the potential
for significant environmental impacts, and therefore does not recommend the
preparation of an Environmental impact State ^t tEIS) on the project.
We have discussed the project with Susanna Spitzer, of the Section of Program
Development and Air Analysis cf our Division of Air Quality. She informs us
that, as long as the maximum number of parking spaces constructed for the
facility does not exceed the planned 428 spaces indicated in the EAW, an
Indirect Source Permit will not be required for the facility.

Mr. John Flora of the City of Fridley. This letter indicated the
Commission was terminating a Joint Use Sewer Rental Agreement with the
City of Fridley. The agreement dllows the ccnveyance of wastewater
originating in the City of Mounds View through a trunk sewer owned by
the City of Fridley. The Commission paid the City of Fridley an
annual rental fee of $2,972.00.

undertaken a project for upgrading the traffic signal system
along Trunk Highway 10 between Silver Lake Road ani County Road

WHEREAS, the Minnesota Department of Transportation,
Ramsey County, and the City of Mounds View have joint
responsibility for this traffic signal system.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Mounds View enter into an agreement with the State of
Minnesota, Department of Transportation for the following
purposes, to wit:
To remove the existing traffic control signal and install
a new traffic control signal with street lights and
signing on Trunk Highway 10 at County State Aid Highway
No. 44 (Silver Lake Road) - County Road 12G (Red Oak
Drive); revise the existing traffic control signals with
street lights and signing on Trunk Highway 10 at County
Road 82 (County Road I) - County State Aid Highway No. 3
(County Road I), Count- State Aid Highway No. 45 (Long
Lake Road), County State Aid Highway No. 5 (County Road
H-2) - County Road H-2, and at County State Aid Highway
No. 77 (County [wad H) - County Road H; install
interconnect on Trunk Highway No. 10 from County State Aid

THIS AGREEMENT made and entered into by and between the
State of Minnesota, Department Of Transportation, hereinafter
referred to as the "State," and the County of Ramsey, hereinafter
referred to as the "County', and the City of Mounds View,
hereinafter referred to as the "C.ty", WITNESSE'iTH:
WHEREAS, the State has determined that there is
justification and it is in t:.-: public's best interest to remove
the existing traffic control signal and install a new traffic
control signal with street lights and signing on Trunk Highway
No. 10 at County State Aid Highway No. 44 (Silver Lake Road) -
County Road 126 (Redoak Drive); revise the existing traffic
control signals with street lights and signing on Trunk Highway
No. 10 at County Road 82 (County Road I) - County State Aid ;
Highway No. 3 (County Road I), County State Aid Highway No. 45 �✓
(Long Lake Road), County State Aid Highway No. 5 (County Road
H-2) - County Road H-2, and at County State Aid Highway No. 77
(County Road H) - County Road H; install interconnect on Trunk
Highway No. 10 from County State Aid Highway No. 44 (Silver Lake
Road) - County Road 126 (Redoak Drive) to County State Aid
Highway No. 77 (County Road H) - County Roed H; and
WHEREAS, it is considered in the public's best interest
for the State to provide two (2) pedestal shafts and hases, and
one (1) master controller and cabinet, and five (5) new cabinets
and control equipment to operate said traffic nnntrol cign.,as;

WHEREAS, the County, City and State will participate in
the cost, maintenance and operation of the interconnect and the
nea and revised traffic control signals with street lights and
signing as hereafter set forth;
NOW, THEREFORE, IT IS ACREEO AS FOLLOWS:
1. The State stall prepare the necessary plan,
specifications and proposal and shall perform the engineering and
inspection required to complete the items of work hereinafter set
forth. Such work as described immediately above shall constitute
"Engineering and Inspection" and 'shall be ao referred to
hereinafter.
2. The contract cost of the work, or if the work is
01 not contracted, the cost of all labor, materials, and equipment
rental required to ccmple:e the work, except the cost of
providing the power supply to the service pole or pad, shall
constitute the actual "Construction Cost" and shall be so
referred to hereinafter.
3. The State with its own forces and equipment or by
contract shall perform the traffic control signal work provided
for under the State Project No. 6204-42 and State Aid Project
No.`s 62-603-07, '62-605-03, 62-644-14, 62-645-09, 6"-677-14,
146-228-04 and 146-234-03 with the Construction Costs shared as
follows:

4, The State shall install :r c_use the installation
of overhead signing and ahall maint<:in said silninc; all at no
cost to %e County or City.
5. Upon execution of this agreement and a request in
writing by the State, the County and the City shall each advance
to the State an anount equal to their portion of the project
costs. The County's and th? City's total portion shall consist
of the tan, of the following:
a. The County's and City's respective share (as
specified in Paragraph 3) based on the actual
bid prices and the estimated Stata furnished
materials costs.
b. Six (6) percent of each respective share
[Item (a) above] for the cost of Engineering
and Inspection.
6. Upon completion and final acceptance of the
project, the County's and City's final share shall ceisist of the
sum of the following:

State furnished materials costs.
b. Six (6) percent of each respective final
share (Item (a) above) for the cost of
Engineering and Inspection.
The amount of the funds advanced by the County and City
in excess of the County•s and Cit,y's final suare will be returned
to the County and City without interest and the County and City
agrees to pay to the State that amount of its final share which
is in excess of the amount of the funds advanced by the County
and City.
7. The County and the City shall jointly be
") responsible for the installation of an adequate electrical power

supply to the service pad or pole for System "A". The City shall
receive the bill for the installation of the electrical power
supply, and invoice the County for 50 percent of the cost. The
City shall provide necessary electric power for the operation of
the new traffic control signal installation, at the cost and
expense of the C?:y. The County shall provide necessary electric
power for the operation of the street lights, at the cost and
expense of the County.
S. Upon completion of the work contemplated in
Paragraph 3a (System "A") hereof, it shall be the County's
responsibility, at its cost and expense, to: (1) maintain the
luminairies; (2) relamp the new traffic control signal and street

lights; (3) clean and paint the new traffic control signal,
cabinet and luminaire mast arm extensions. It shall be the
State's responsibility, at its cost and expense, to perform all
other new traffic control signal and street light maintenance.
9. The County shall provide an adequate electrical
power supply to the service pads or poles, and upon completion of
said revised traffic ccr.trol signals with street lights
installations (System "9", "C' and "F") shall provide necessary
electrical power for their operation at the cost and expense of
the County.
10. Upon completion of the work contemplated in
Pargraph 3b, 3c and 3e (Systems "B", "C", and "i") hereof, it
shall be the County's responsibility, at its cost and expense, L
to: (1) mainain the luminaires; (2) relamp the revised traffic
control signals and street lights; and (3) clean and paint the
revised traffic control signals, cabinets and luminaire mast arm
extensions. It shall be the Stzte's responsiblity, at its cost
and expense, to perform all other revised traffic control signal
and straec light maintenance.
11. The City shall provide an adequate electrical
power supply to the service pad or pole, and upon completior of
said revised traffic control signal with street lights
installation (System "D") shall provide necessary electrical
power for its operaticn at the cost and expense of the City.
12. Upon completion of the work contemplated in

Paragraph 3d (System "D") hereof, it shall be the County's
responsibility, at its cost and expense, to relamp the revised
traffic control signal and clean and paint the revised traffic
control signal, cabinet and luminaire mast arm extensions. It
shall be the City's responsibility, at its cost and expense, to
maintain the luminaires and relamp the street lights. It shall
be the State's responsibility, at its cost and expense, to
perform all other revised traffic control signal and street light
maintenance.
13. Upon completion of the work Contemplated in
Paragraph 3f hereof, it shall be the State's responsibility, at '[

( 14. Any and 311 persons engaged in the aforesaid work
to be performed by the State shall not be considered employees of
the County or City and any and all clai;is that may or might arisa
under the Worker13 Compensation Act of this State on behalf of
said employees while so engaged, and any all claims made by any
fourth party as a consequence of any act or omission on the part
of sa'_d employees while so engaged on any of the work
contemplated herein shall not be the obligation and
responsibility of the County or City. The State shall not be
responsible under the Worker's Compensation Act for any employees
of the County or City.
15. Timing of the traffic control signals provided for
herein shall be determines by the State, through its Commissioner

of Transportation, and no changes shall be made therein except

with the approval of the State.
16. Upon execution by the County, the City and the
State and completion of the construction work provided for
herein, this agreement shall supersede and terminate Agreement
No. 57839 dated Juni 26, 1975 between the County, the City and
the State. The intersections covered by the above mentioned
agreement are on Trunk Highway No. 10 at County State Aid Highway
No. 44 (Silver Lake Road) - County Road 126 (Redcak Drive),
County Road 82 (County Road I) - Co!inty State Aid Highway No. 3
(County Road I), and at County State P.id Highway No. 5 (County
Road H-2) - County Road H-2.
17. Upon execution by the County, the City and the,
State and completion of the construction work provided for
herein, this agreement shall supersede and terminate Agreement
No. 58567 dated August 11, 1977, between the County and the
State. The intersection covered by the above mentioned agreement
is on Trunk Highway No. 10 at County State Aid Highway No. 77
(County Road H) - County Road H.
18, Upon execution by the County, the City and the
State and completion of the construction work provided for
herein, this agreement shall supersede and terminate anr<ome .
Vo. 61389 dated May 27, 1.983, between the County and the State.
The intersection covered by the above mentioned agreement is on
Trunk Highway No. 10 at County State Aid Highway No. 45 (Long
Lake Road).

Attached is a ':opy of Ramsey county's request regarding this
project. They are asking for concurrence that the project, if
feasible, proceed to completion; that the recomi,ianded consultant
be retained for design of the project; and that the Ci'-y of
Mounds View will reimburse Ramsey County the appropriate share of
the consultant fees. This project was previously listed in Ramsey
County's Capital. Improvement. Program as an non -programmed
project. The county is now desiring to construct this project in
1990. The intent of the project has not changed; that bei,iq the
realignment of County Road J slightly northerly in anticipation
of the construction of a grade separation for new T. H. 10.
I would recommend concurrence as the county request,)d with the
understanding that the City of Mounds View's share come from
Municipal State Aid funds.

As you may recall, I previously communicated to you the fact
that the 1988 Legislature and the Minnesota Commissioner cf
Human Rights took action to require that cities in the State
of Minnesota implement affirmative action plans in
conformance with the Minnesota Human Rights Act.
As a result of this finding and legislative declaration,
staff developed an affirmative action plan in conformance
with the guidelines of the Minnesota Department of Human
Rights and presented it to representatives of the Department
in draft form for their review and comment. Comments
received by the Minnesota Department of. Human Rights were
included in the draft currently before you for your
consideration ena hopeful adoption. Also attached is
Resol.ution No. 2419 adop-:ing the City's Affirmative Action
Plan.

RESOLUTION ADOPTING AN AFFIRMATIVE ACTION PUS FOR
THE CITY OF MOUNDS VIEW
WHEREAS, the Mounds View City Council aknowledges
that Equal Opportunity Employment for all persons is a
fundamental human value; and
WHEREAS, the City of Mounds View does promute and
encourage full realization of human rights within City
Employment; and
WHEREAS, the State of Minnesota declares that
artificial barriers to employment pursuant to M.S. 363.03
are unfair and discriminatory practices; and
WHEREAS, under the .Minnesota Human Rights Act,
Section 363.073, Businesses or firms which have (a) more

I. PROJECT DESCRIPTION
Relationship of the City of Mounds View to
the State of Minnesota
The City of Mounds View incorporated as a village in 1958
under the provisions of Minnesota. Statutes in place at the
time. In 1979 the residents of Mounds View approved the
adoption of a Home Rule Charter and on January 1,
1980 the
City became a Home Rule Charter city.
As a City in the State of Minnesota, Mounds View acts as an
agent of the State in the enforcement of statewide standards
and policies as defined in rule and statute. The City

also responsible for complying with and enforcing
and regulations promulgated by State agencies which have
been made applicable to cities by statute.
The City of Mounds View annually receives funds from a
variety of State sources including, but not limited to,
Local Government rid, Emergency Management, Police,
Training, Municipal State Aid, Pr,jice State Ai,

State Aid. Occassional grant funding
is Ramsey County, the Metropolitan Council and the State to
carry out specific programs authorized by City Charter or
State Statute.

III. ASSIGNMENT OF RESPONSIBILITY FOR AFFIRMATIVE PCTION
PROGRAM
The Mounds View City Council authorizes Donald F. Pauley,
the Clerk -Administrator, to administer the Affir,uative
Action Program.on behalf of the City. This accountability
encompasses the following:
1. Develop the City's Equal Employment Opportunity/
Affirmative Action (EEO/AA) Plan/Program consistent
with the City's policies.
2. Dissemination of policy information.
3. Conducts and/or coordinates EEO/AA training and
orientation of City supervisors and managers to
inform them of their responsibilities pursuant to
the Affirmative Action Plan/Program.
4. The establishment of contacts in recruitment for
minorities, handicapped and women.
S. The preparation of all reports that are required and
the design and implementation of audit ar.9 recording
systems to measure the effectiveness of the

A. Internal Dissemination

TION ANALYSES
The City conducted separate in-depth analyses of each job
group for minorities and for women (protected groups). The
purpose of these analyses is to determine if minorities
and/or women are currently being underutilized in one or
more job groups. The results of these analyses then become
the uasis for establishing the objectives detailed in this
document.
I. Workforce Analysis
A workforce analysis is prepared annually if new _
positions are added to the City's wo_kforce and/or \
t'+rnuver has occurred within ttie City's workforce.

VII. GOALS, OBJECTIVES AND TIMETABLES FOR CORRECTIVE
ACTION
The City's Utilization/Underutilization Analysis shows that
for the total workforce, there is no underatilization of
women. The City will need to maintain an awareness of the
need for full utilization of women particularly when filling
vacancies in existing and new positions.
An underutilizatior. of 1 minority was identified in the
total workforce. Taking into consideration expansion and
contraction in the size of the workforce and employee
turnover, the City will m.1ke a good faith effort to hire
qualified minorities. It is' the desire of the City to
eliminate underutilization of minorities by December, 1991
if the opportunity presents itself through the normal
attrition of employees or the addition of new positions.

VIII. PROBLEM AREAS/DEFICIENCY IDENTIFICATION AND ANALYSIS
An evaluation of the City's programs for hiring and
retaining employees reveals that the selection process is
deficient in attracting qualified minorities. The City will
need to undertake greater efforts in advertising vacancies
and recruiting in a manner that will encourage minority
applicants.
No other problems were identified, i.e, applicant flow
composition, transfer and promotion practices, company
facilities and company -sponsor" activities, seniority
practices, company training programs and workforce attitude.

IX. MEASURES TO FACILITATE IMPLEMENTATION
To assure progress towards achievement of Affirmative Action
goals and to guarantee equal employment opportunity to all
persons, the City of Mounds View shall pursue the following
actions.
The City of Mounds View's personnel practices shall adhere
to the principle of Equal Employment Opportunity. The
principles of Equal Employment Opportunity shall be
introduced into all City written personnel policies and
shall be reflected in all negotiations between the City and
labor unions who represent authorized bargaining units of
City employees.

In order to successfully evaluate the implementation of
the City's Affirmative Action Program, the following
data shall be maintained by the City.

Data shall be maintained regarding recruitment and media
sources notified of City job vacancies.
B. Applicant Flow Data
Data shall be maintained that indicates the total number
of appiicantc interviewed for each job vacancy, those
offered po=it.ions, and those hired, in order to
determine the effectiveness of the City's recruitment
process and to assess the City's progress toward equal
employment opportunity.
C. Training
Data shall be maintained indicating the number of City
employees participating in all City -sponsored training
programs.
D. Promotions
Data shall be maintained regarding promotions and those
employees who are promoted.
E. Merit Increases
Data shall be maintained to assure that no disparity
exists regarding merit increases between City employees
belonging to protected classes and other city employees-

demotions and terminations including reasons for such

XI. AFFIRMATIVE ACTION PLAN FOR DISABLED INDIVIDUALS
A. Disabled Individuals Affirmative Action Clause
The City of Mounds View shall not discriminate against
any employee or applicant for employment because of
physical or mental disability in regard to any position
for which the employee or F^-licant for employment is
qualified. The City of "founds View agrees to take
affirmative action to employ, advance in employment, and
otherwise treat qualified disabled individuals without
discrimination based upon their physical or mental
disability in all employment practices such as the
following: employment, promotion, demotion or transfer,
recruitment, advertising, layoff or termination, rates
of pay or other forms of compensation and training.
The City of Mounds View agrees to comply with the rules
and relevant orders of the Minnesota Department of Human
Rights issued pursuant to the Minnesota Human Rights
Act. The City of Mounds View agrees to post in
conspicuous places, available to employees and
applicants for employment, notices in a form to be
prescribed by the Commissioner of the Minnesota
Department of Human Rights. Such notices shall state
the City of Mounds View's obligation under the law to
take affirmative actio,: to employ and advance in
employment qualified disabled employees and applicants
for employment, and the rights of applicants and
.-, employees.
The City of Mounds View shall notify each labor union or
representative of workers with which it has a collective
bergairing agreement or other contract undertanding,
that the City is bound by the terms of the Minnesota
Human Rights Act and is committed to take affirmative
action to employ and advance in employment physically
and mentally disabled individuals.
Schedule for Review
The City of Mounds View will review all physical and
mental job requirements to the extent that these
requirements tend to screen out qualified disabled
individuals. It will be determined whether these
requirements are job related, and consistent with
business necessity and the safe performance of the
job. These requirements will be reviewed when the
position becomes open.
C. Pre -Employment Medical Exams
The City of Mounds View may require a comprehensive
medical exam prior to employment. The results of such
an examination will not be used to screen out qualified
I disabled individuals. Information obtained in response
ks+ to such inquiries or examination shall be kept

confidential except that (a) supervisors and managers
may be informed regarding restrictions on the work or
duties of disabled individuals and regarding
accomodations, (b) first aid and safety personnel may
be informed, where and to the extent appropriate, if the
condition.might require emergency treatment, and (c)
officials, employees, representatives, or agents of the
Minnesota Department of Human Rights or local human
rights agencies investigating compliance with the act or
local human rights ordinances shall be informed if they
request such information.
D. Accomodations to Physical and Mental Limitations of
Employees
The City of Mounds View shall make a reasonable accomo-
dation to the physical and mental limitations of an
employee or applicant unless such an accomouation would
impose an undue hardship on the conduct of City
business.
Compensation
In offering employment or promotions to disabled
individuals, the City of Mounds View shall not reduce
the amount of compensation offered because of any
disability income, pension, or other benefit the
applicant of employee receives from another source.
F. Outreach, Positive Recruitment, and External
Dissemination of Policy
The City of Mounds View shall review employment
practices to determine whether the personnel programs
provide the required affirmative action for employment
and advancement of qualified disabled individuals.
Based upon the findings of such reviews, the City of
Mounds View shall undertake appropriate outreach and
positive recruitment activities, such as those listed
below.

to provide meaningful employment opportunities to
qualified disabled individuals.
5. Establish meaningful contacts with appropriate
social service agencies, 'organizations of and for
disabled individuals, vocational rehabilitation
agencies or facilities, for such purposes as advice,
technical assistance, and referral to potential
employees.

As mentioned previously, the Police Department will use the
present processor to operate their Enfors software packages.
Staff proposes relocating the processor to the Police
Department. This will require a dedicated power line, some
recabling of terminals and moving of a telephone line to the
Police Department. MaSys Corporation has given us a quote of
$1,010 for moving the processor and recabling. We do not have a
quotation from an electrician for installation of a dedicated
power line and we know from past experience that the telephone
company will not give a quotation. our experience with our
present system was that the dedicated porter line cost $375 to
install. A telephone line was $125. Staff proposes thaL
authorization be given to proceed with relocation of the present
processor to the Police Department at a cost not to exceed
$2,000, MaSys Corporation proposes to arrange a trade of our
processor to another police department in exchange for that
department's processor and $5,b00 - $6,000 cash. The reason for
this is that the Police Departmant can meet all their need with a
smaller processor; that the present processor is "too much
horsepower" for their data prosassing needs. Staff proposes that
the cash from the trade be used for costs of relocating the
present processor to the Police Department.
RECOMMENDATION: 1) Authorize the computer system upgrade
proposed by Computoservice Inc. in the
amount of $35,080.
2) Authorize_ staff to contract for relocation

regarding the Comprehensive elan Update. At Monday night's
meeting, Don Wiski of Resolution, Inc. will make a presentation
to the Council regarding the final draft.
It is my desire that the Council make any modifications they feel
necessary at this time. I will be asking the Planning Commission
to make a formal recommendation to the Council after your
suggestions have bren entered in the document. Please let us
know about both the document and the comments on the attached.

1. Update of Commission members on City Policy Makers and Staff.
2. Margins are irregular and messy looking.
3. Some of the charts seem to duplicate information.
4. Page 1-1; question of "significant parcels"; how significant
are they.
5. Page 1-1; question reasoning for update of Comprehensive
Plan. Thought is was required by law to update Comp Plan.
6. Page 1-1; Question the use of the word "infill" when
discussing development of vacant parcels. It is a jargon
term which lay -persons may not be familiar with. People may
take it to mean infilling wetlands.
7. Figure 1; Major highways such as 35W and 35E should be
Labeled. Figure does not show Highway 10.
8. Page 1-1; comment that a number of sites remain undeveloped
as "a result of soil or water table issues". Believe better
stated as undeveloped because of wetland deriignation.
9. Page 1-3; "The Comprehensive Plan does not", this is just an
update of the already adopted plan and as stated later in
this text should be made clear here also.
10. Page ordering is ccafusirg. Both figures and tables should
each be given page numbers.
11. Page 2-1; Percentages of housing stock do not total to 100
percent;

24. Is it possible to screen addresses off of base maps to allow
for greater clarity.
25. Disagree with policy issues found on page 3-14 regarding
residential development along Highway 10. Believe that
Highway 10 should be t:anaformed to commercial uses over

single family development along Highway 10, therefore,
encouraging residential development on Highway 10. Feels
traffic and noise makes residential development along Highway
10 undesirable.
27. Page 4-2; disagree with example of combining park and wetland
resources. Feels discussion of connecting wetland on
Groveland Road and Groveland Park bV removing the street is
misleading, and feels residents may come to believe the City
is going to do this. This suggestion has not been reviewed
from a traffic standpoint and may not be feasible to
accomplish. It does not desagree with policy of utilizing
wetlands and open space, she is just concerned about example
used.

County Road J, and the variance for being within the
100' buffer zone, due to the location of the Williams
pipeline on the property. That issue, however, no
longer exists, as the developer is proposing to move
the building closer to the pipeline, which will take
them completely out of the buffer.
Peter Seipp, president of SYSCO/Minnesota, briefly
reviewed their intended use of the building, and he
introduced the other members of the development team
that were present with him.
Scott Kinkaid, of Ryan Construction, reviewed the pro-
posal, showing their location in the City, access to
the property, parking, the location o:` the building
on the 'lot, and the planned construction materials.
He explained a number of revisions have been made to
the site plans due to wetland concerns, and he reviewed
the changes made. He also explained they have been
able to move the building out of the 100' buffer zone.
Peter Sabee, of Barr Enginee-ing, explained they had
reviewed the proposed development at the request of
the City, and in the course of that evaluation looked
at the development with respect to specific criteria
as specified in the ordinance, the Corps of Engineers
wetland delineaticn and Mounds View's wetland delinea-
tion.
Mr. Sabee reviewed the conditions which must be met
for a wetlands alteration permit to be granted. Mr.
Sabee reviewed his written report and their findings
on the permit standards in the wetland ordinance,
specifically concerning filling, dredging, discharges,
storm water run-off, building constraints and removal
of vegetation. He stated that in summary, all the
criteria listed is in compliance with respect to the
development application. and City Ordinance, and he
recommended the Council consider having the work
areas delineated so there is an understanding of
which areas will be impacted.
Mr. Sabee explained tha proposed development dues
not fall within the 100 year flood boundary, so
Chapter 49 does not apply, and he reviewed the
requirements of Chapter 49a.
Mr. Sabee stated in summary that a review of the docu-
ments submitted for the proposed development indicate
compliance with all requirements of Chapters 48, 49
and 49A of the Mounds View Municipal Code, with one
exception, that the roadway access to the development

is located within the wetland buffer zone, which is
a result of the health and safety consideratons and is
located in a manner which has minimized its impact
on the wetland buffer zone,
Mr.Sabee stated a final issue which must be resolved

Clerk/Administrator Pauley updated the Council on the
Progress of the tax increment financing discussions.
He reviewed the issues that have been agreed to in
Principle so far, as well as the two that have not
been agreed to yet. He explained the developer has
requested the tax increment bond issue pay for the
water and sewer availability charges, and they have
also proposed the City not issue the bonds immediately
but rather just prior to occupancy, which would be
in October or November of 1989, with the developer
proposing to front-end the costs of the public
improvements, and then be reimbursed at a later date.
Mr. Rinkaid stated that due to time constraints,
they need to get going before the extremely cold
weather, and it may be necessary to run the grading
operation for extended hours, perhaps 24 hours a day,
for up to a few weeks, and asked if special approval
would be required.
Clerk/Administrator Pauley explained normel hours of
operation are 7 AM to 8 pM, but due to their loca-
tion, Staff did not feel the noise would present a
problem, and they would recommend the Council grant
permission with the understanding that if complaints
are received from property owners in the area, it
$ would be reevaluated.

noise requirements, with a provision that should
the City start receiving excessive complaints, the
Council would have to reconsider at that time.

extremely well so far. He added a few items were
still being worked on for the bonds, but he felt

Police Chief Ramacher reviewed the crime statistics
for the third quarter of 1988, reporting a 4 percent
crop in major crimes year to date 1988 versus 1987,
and a 98 decrease in less serious crimes. He also
reviewed the tentative timetable of the Civil
Service Commission for the hiring of a new police
officer. March 1 is the proposed start date.
Councilmember Hankner asked how monitoring was
going of the corner of Groveland and Arden Avenue.
Police Chief Ramacher explained they have spent
quite a bit of time there, and in monitoring over
500 cars, have issued only one ticket.
Park Director Saarion reviewed the third quarter
activities of the Park, Recreation and Forestry
departments.
Councilmember Hankner asked that the Forester
check behind 5601 and 5607 St. Michael, for oak
wilt.
Councilmember Blanchard asked if many trees were
impacted from the drought this past summer. Park
r W -actor Saarion explained it is too early to

Public Works Director Minetor reviewed activities
of the Public Works and Building Inspectictcs
departments for the third quarter. He reviewed
water consumption statistics and compared them to
the past two years. While revenue was up considera-
bly, the costs also went up with the increased
consumption. He also reviewed fourth quarter
prcjects which are underway.
Councilmember Wuoci reported reaction has been
good so far to the snow plowing, but she noted a
problem area in the sidewalk on Quincy, where
removal was spotty.
Mayor Linke stated he would like to thank the
Department Heads and CityStaff for the work they
have done while he has been the City's Mayor.
Public Works Director Minetor handed out copies
of the proposed snow plowing policy.
Clerk/Administrator Pauley explained it was a
Council decision to adopt the policy by resolution
at this time, and by ordinance later. He explained
the policy would not have the force of law until it
is adopted by ordinance.

cover the City's expenses, but hopefully will ma_e
