AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF
MOUNDS VIEW BY REPEP.LING CHAPTER 91, ENTITLED, "ANIMALS" AND
ADOPTING A NEW CHAPTER 91, ENTITLED, "ANIMALS"
The City Council of the City of Mounds View does
hereby ordain:
SECTION I. Chapter 91, Entitled, "Animals" is
hereby repealed.
SECTION II. The new Chapter 91, "Animals" is
hereby adopted as attached.
SECTIO14 III. This ordinance shall take effect

Subdivision 4. Receipts and Tags. Upon payment of the
license fee, the Clerk -Administrator shall execute a receipt in
duplicate. He shall deliver the original receipt to the person
who paid the fee, retaining the duplicate. He shall give an
appropriate tag to the owner. The tags shall be metallic and
shall be of a different size and design each license period,

tag to be affixed by a permanent metal fastener to the collar of
the dog so licensed in such manner that the tag may be easily
seen. The owner shall see that the tag is constantly worn by
said dog.

91.02 Domestic Animals.
Subdivision 1. Definitions.
(1) "Owner" means any person, firm or corporation owning,
harboring or keeping a domestic animal.

"Domestic animal" means any cattle, horses, mules,
sheet, swine or goats.

Subdivision 1. Definitions.
(1) "Raising" The maintaining and breeding as a hobby
or as a commercial enterprise any animal defined herein.
(2) "Keeping" Providing food, water, and shelter for
any animal defined herein.
(3) "Animal." Any mammal of the rodent family, including
but not necessarily limited to, rabbits, hares, and hamsters, and
any fowl including but not necessarily limited to chickens,
pigeons, ducks or geese.
(4) "Private property" All premises owned by private
individuals, including all structures located thereon, front
yards, side yards, and back yards.

Subdivision 2. Permitted. It shall be lawfu'_ to keep or
raise not more than two animalr., as herein defined, on the
private property of the owner of said animals except where such
animals shall constitute a public nuisance.
Subdivision 3. romnlaints. Tt shall be the duty of the
Police Department to investigate all complaints submitted to the
Council and if after investigation there appears to be a
violation of this chapter the investigating officer shall sign a
complaint.
Subidivision 4. Penalty. Any person, firm, partnership
or corporation violating any provision of this chapter shall be
guilty of a misdemeanor. (157)
91.04 Wild Animals.
Subidivision 1. Definitions.
(1) "Owner" means any person, firm or corporation owning,
harboring or keeping a wild animal.
(2) "At large" means off the premises of the owner.
(3) "Wild animal" means any animal or reptile which, in
its uncaptured wild or undomesticated state, has the physical
capacity to be dangerous to the safety and welfare of any person.

RESOLUTION ESTABLISHING MUNICIPAL STATE AID STREET
WHEREAS, it appears to the City Council of the City of Mounds
view that the street hereinafter described should be
designated a Municipal State Aid Street under the provisions
of Minnesota Laws Chapter 162:
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of

STATE OF MINNESOTA
RESOLUTION REQUESTING THE LEND-LEASE OF A PORTABLE BREATH
TESTER (P.B.T.) FROM THE STATE OF MINNESOTA, DEPARTMENT OF
PUBLIC SAFETY
WHEREAS, the State of Minnesota, Department of Public
Safety has available a portable breath testing instrument
for lend-lease to municipalities for use within their law
enforcement agencies; and
WHEREAS, the lend-lease prog=am provides for the
loaning of this equipment at no expense to the City of
Mounds View; and
WHEREAS, the availability of this equipment to the
City of Mounds View Police Department will increase the
ability of the department to enforce the State's D.W.I.
Laws.
m NOW, THEREFORE, BE IT RESOLVED that the City Council
? of the city of Mounds View approves the entering into an
agreement with the State of Minnesota, Department of Public
Safety for the following purpose: to receive from the State
of Minnesota, Department of Public Safety a portable breath
testing instrument on a loan basis. The instrument is to be
used by law enforcement officers to assist them in the
detection of mutorists who may be in violation of Minnesota
Statute 169.121, or other Minnesota Laws or Local Ordinances
or ether law enforcement purposes.
BE IT FURTHER RESOLVED that the Mayor and Clerk -
Administrator are hereby authorized to execute such an
agreement.

RESOLUTION OF SUPPORT FOR ATHLETIC COMPLEX ON TWIN
CITY ARESE14AL PROPERTY
WHEREAS, it has been determined by the City Council
of bounds Vied that there is a growing need for an athletic
complex for the youth and adults of this community; and
WHEREAS, an area of land c ignated as Area A,
located on the Twin City Arsenal property in Arden Hills may
be available for such an athletic complex; and
WHEREAS, a proposal for a joint athletic complex has
been submitted for our approval; and
WHEREAS, the City Council of the City of Mounds View
unanimously approves of the proposal for an athletic
complex.
NOW, THEREFORE, BE IT HFREBY RESOLVED, that the City
Council of Mounds View hereby gives its support for the
proposed athletic complex, the cost of which will be shared
by the governing agencies involved in this joint venture.

RESOLUTION NO._2AIL
BEING A RESOLUTION AUTHORIZING AND AWARDING THE
SALE OF, AND PROVIDING THE FORMS, TERMS,
COVENANTS AND DIRECTIONS FOR $1,760,000
TAXABLE GENERAL OBLIGATION TAX INCREMENT BONDS,
SERIES 1989A, AND PLEDGING FOR THE SECURITY THEREOF
TAX INCREMENT FROM TAX INCREMENT FINANCING DISTRICT NO. 3
BE IT RESOLVED BY THE CITY COUNCIL (THE "COUNCIL") OF THE
CITY OF MOUNDS VIEW, MINNESOTA (THE "ISSUER") AS FOLLOWS:
Section 1. Recitals.
1.01 The Council has heretofore adopted and created Tax Increment
Financing District No. 3 (the "District") pursuant to lliinnesote Statutes, Sections
469.174 to 469.179, within Deveiopment District Number 3 created by the Issuer
Pursuant to Minnesota Statutes, Sections 469.124 to 469.134.
1.02 The Issuer has heretofore adopted a Tax Increment Financing Plan for
its Tax oncrement Financing District No. 3 and the County Auditor of Ramsey
County has certified the Adjusted Original Assessed Value of all taxable property
in the Tax Increment Financing District.
i 1.03 Bas,d upon present and anticipated tax capacity rates for ad valorem
taxes to be levied on taxable property in Tax Increment Financing District No. 3,
the Council hereby determines that the total annual tax increment to be derived
from the District will be approximately $253,697 for 1991 and approximately
$251,633 for 1992 and beyond.
Section 2. Award of Sale: Terms of Bonds.
2.01. Affidavits showing publication of notice of call for bids for the sole
of the Issuer's $1,760,000 Taxable General Obligation Tax Increment Bonds, Series
1989A (the "Bonds") in the official newspaper of the Issuer and in Northwestern
Financial have been examined and have been approved and ordered placed on file.
The following bids for the sale of the Bonds were received:

2.02. After considering the bids received, the Issuer hereby awards the sale
of the Bonds to (the "Purchaser") as the bidder
offering the lowest net interest cost by its bid to purchase the Bonds at a pric< of
$ plus accrued interest to the date of delivery, the Bonds to bear
interest at the rates per annum set forth below.
The City Clerk -Administrator of the Issuer is directed to retain the good faith
check of the Purchaser pending delivery of and payment for the Bonds, and to
return the checks of the unsuccessful bidders.
2.03. The Issuer shall issue the Bonds in the aggregate principal amount of
$1,760,000, dated April 1, 1989 as fully registered bonds without coupons. The r+
Bonds shall be in denominations of $5,000 or any integral multiple thereof not
exceeding the principal amount of a single maturity, shall be numbered from R-1
upwards in order of issuance, and shall bear interest at the rates set forth below,
payable semiannually on each Februar 1 and August 1, commencing February 1,
1990, and shall mature on February 1 in the years and amounts as follows:

2.04. All Bonds maturing on or after February 1, 1999, shall be subject to
redemption and prior payment in whole or in part in inverse order of maturity and
by lot within maturity at the option of the City on February 1, 1998, and any
interest payment date thereafter at a price of par plus accrued interest. Thirty
days' prior notice of redemption shall be given by first-class mail to the Registrar
and to the registered owners of the Bonds, and notice of redemption will be
published in the manner provided by Chapter 475, Minnesota Statutes. Upon notice
having been so given, the Bonds or portions of Bonds therein specified shall be due
and payable at the stated redemption date and price with accrued interest to the
rede.:.ption date, and upon funds for such payment being held by or on behalf of the
Registrar for such payment on the specified redemption date, interest thereon shall
cease to accrue after such redemption date. No defect in the mailed notice of
redemption shall affect the validity of the call for redemption of any Bond.
2.05. Tne Bonds shall be payable as to principal upon presentation at the
main office of (the
"Registrar'), or at the office of such other successor registrar as the Issuer may
hereafter designate upon 60 days mailed notice to the registered owners. Interest
ci each Bond shall be payable by check or draft of the Registrar mailed the last
buuiness day prior to thr, interest payment date to the registered holder thereof at
his or her address as it appears on the bond register at the close of business on the
15th day (whether or not a business day) of :he calendar month next preceding the
interest payment date.
Section 3. Form and Execution of the Bonds.
3.01. The Bonds shall be in substantially the following form, with the

maturity date specified above, upon the presentation and surrender hereof, and to
pay to the registered owner hereof interest on such principal sum at the interest
rate specified above from April 1, 1989, or tt•e most recent interest payment date

Increment Bonds Series 1989A issueJ in the aggregate principal amount of One
Million Seven Hundred Sixty Thousand Dollars ($1,760,000) of like date and tenor
except for number, interest rate, denomination, date of maturity and redemption
privilege, and is issued for the purpose of providing funds to finance or otherwise
�,==' pay pursuant to Minnesota Statutes, Sections 469.124 to 469.134 certain costs of
the City's Development District Number 3 established pursuant to Minnesota
Statutes, Sections 469.124 to 469.134, and pursuant to an authorizing resolution 7
(the "Resolution') adopted by the City Council of the City on Febuary 27, 1989, and
pursuant to and in full conformity with the Constitution and laws of the State of
Minnesota, including Minnesota Statutes, Chapter 475 and Sections 469.174 to
469.179.
The Bonds of this series are payable from the Taxable General Obligation
Tax Increment Bonds, Series 1989A Fund of the City (the "Bond Fund') to which has
been pledged certain tax increment generated from the City's 'fax Increment
Financing District No. 3. All taxable property within the City is also subject to the
levy of direct general ad valorem taxes required by law to be levied and extended
if ,seeded for this purpose, without limitation as to rate oe amount. The issuance of
this bond does not cause the indebtedness of the City to exceed any constitutional
or statutory limitation thereon.
As provided in the Resolution„ and subject to certain limitations set forth
therein, thls Bond is transferable upon the books of the City leapt for that purpose

by such owner's attorney duly authorized in writing, upon surrender of this Bond
together with a written instrument of transfer setisfaetory to the Registrar, duly

3.02. As long as any of the Bonds issued 'hereunder shalt remain
outstanding, the Issuer shall cause to be kept at the prineipall office of the.
Registrar the Register in which, subject to such reasonable regulations as the
Registrar may prescribe, the Registrar shall provide for the regi_,rotion of Bonds
and the registration of transfers of Bonds.

Upon surrender for transfer of any Bond with a written instrument of
transfer satisfactory to the Registrar, duly executed by the registered owner or his

and the Registrar shall authenticate and deliver, in the name of the designated
transferee or transferees, one or more fully registered Bonds of any authorized i4

to make any such excbenge or transfer of Bonds during the fifteen (15) days next

3.03. Interest on any Bond which is payable, and Is punctually paid or duly
provided for, on any interest payment date shall be paid to the person in whose
name that Bond (or one or more Bonds for which such bond wFs exchanged) is

registered at the close of business on the preceding January 15 and July 15, as the
rase may be. Any interest on any Bond which is payable, but is not punctually paid
or "duly provided for, on any Interest payment date shall forthwith cease to be
payable to the registered holder on the relevant regular record date solely by
virtue of such holder having been such holder, and such defaulted interest may be
paid by the Issuer to the person is whose name such Bond is registered at the close
of business on a special record date established by the Registrar for the payment of
such defaulted interest. Subject to the foregoing provisions of this paragraph, each
Bond delivered under this Resolution upon transfer of or in exchange for or in lieu
of any other Band shall carry all the rights to interest accrued and unpaid, and to
accrue, which were carried by such other Bond and each such Bond slisli bear

transfer, exchange or substitutiou.
3.04. As to any Bond, the Issuer and the Registrar and their respective
successors, each In its discretion, may deem an,: treat the person in whose name
the same for the time being shall be registered as the absolute owner ihereof for
all purposes and neither the Issuer nor the Registrar nor their respective successors
shall be affected by any notice to the contrary. Payment of or on account of the
principal of any such Bond shall be made only to or upon the order of the rer-u,ered
owner thereof, but such registration may be changed as above provided. AN such
payments shall be valid and effectual to satisfy and discharge the liability upon
such Bond to the extent of the sum or sums so paid.
3.05. if (1) any mutilated Bond is surrendered to the Registrar, and the
Issuer and the Registrar receive evidence to their satisfaction of the destruction,
loss, or theft of any Bond, and OQ there Is delivered to the Issuer and the Registrar
such security or indemnity as may be required by them to save each of them
harmless, then, in the nbcpnrP of notice to the Issuer or the Registrar that such
Bond has been acquired by a bona fide purchaser, the Issuer shall e:;ecute, and upon
its request the Registrar shall authenticate and deliver, In exchange for or in lieu
of any such mutilated, destroyed, lost, or stolen Bond, a new Bond of like tenor and
principal amount, bearing a number not contemporaneously outstanding. In case

Attached please find a copy of an agreement between the
cities of Mounds View and Blaine for the purpose of allowing
the SYSCO property to connect to the Blaine Municipal Water
System for fire protection services. This agreement was
developed by the City of Blaine in response to a proposal
submitted by the City of Mounds View which you received
copies of late last year. The agreement has expanded
significantly from the initial proposal from the City of
Mounds View. The proposed Blaine agreement has been
reviewed by Public Works Director Ric Minetor and City
Attorney Mark Karney and the minor changes that were
requested by them have been agreed to by the City of
Blaine. The agreement was ultimately approved by the Blaine
City Council at their February 16th meeting and is before
you for -your consideration and approval at this time.

NOW, THEREFORE,

scribed in attached Exhibit "A" (the "Property") located in the
City of Mounds View, County of Ramsey and State of Minnesota
shall be permitted to connect to the municipal water system of
the City of Blaine for fire protection services cnly, upon the
terms and conditions contained in this Agreement.
2. Connection To Blaine Service. The Property shall be
serviced by an eight inch (8") water main connected by a wet
tap device to the existing twelve inch (12") water main owned
and operated by the City of Blaine on the north side of County
Road J and west of Xylite Avenue. The connection shall be con-
trolled by a valve regulated by a diesel fire pump. In the
event a fire is detected in the proposed facility on the Proper-
ty, the daily water supply source from the City of Mounds View
will be shut off, the valve on the connection with the City of
Blaine water main opened, and the water from the City of Blaine
pressurized to a level of 80 psi at a flow of 2,000 gpm in
order to be used for fire protection services. A flow meter
approved by the City of Blaine will be installed at the connec-
tion with the twelve inch (12") water main owned by the City of
L
Blaine to measure all water used when the valve is Opened.
3. nditions Precedent to Connection. Prior to connec-
tion to the twelve inch (12") water main owned by the City of
Blaine, the owner of the Property shall apply to the City of
Blaine for all required permits to connect, and shall pay, in
advance, all required fees and charges related to the connec-
tion. Since this is an emergency connection for fire protec-
tion services only, a Water Access Charge will not apply nor
will a special assessment be levied, but if the City of Blaine
liter approved a different use of this connection, such charges
shall apply. The application for a permit to the City of
Blaine shall include an original survey describing the Property
and location of the connection. An as -built survey shall be

provided and certified by the City Engineer of the City of
Mounds view as being a correct representation of the Property
and the connection.
4. Limited Use of the Connection. The connection of
the Property to the water main owned by the City of Blaine
shall be used only in such situations which are deemed to be an
emergency by the Spring Lake Park/Blaine/Mounds View Fite
Chief. After the emergency situation has ceased to exist, the
connection device shall be returned to its position and no
further water transferred.
5. Term. The term of this Agreement shall be for a
period of one (1) year from the date first written above, and
on that date shall be automatically renewable for the same term

Main. The owner of the Property or its successors or assigns
shall be responsible for all costs incurred by the City of
Blaine for the design, installation, ase, maintenance and in-
spection of the connection device and all related equipment and
structures required to maintain the operational condition of
the connection device. In the event such charges are not time-
ly paid, the City of Blaine shall notify the City of Mounds
View in writing of such charges, which shall be paid by the

City of Mounds View. The owner of the Property, or its su:ces-
sors or assigns shall be responsible `or the design, installa-
tion, use, maintenance and inspection of the eight inch ;8";
water main on the Property.
7. gppJJga j,jty of Or in nces, The owner of the Prop-
erty or its successors or assigns shall be subject to City of
Blaine Ordinances, specif?c;::tons, rules, regulations and in-
spections of the City of Blaine, as they relate to this Agree-
ment or to the connection of the Property to the Blaine water
main. All other applicable rules, regulations and ordinances
governing the Property shall be controlled by the City of
Mounds View.
8. Payment of KAter_fharaes. The owner of the Proper-
ty, or its successors or assigns, shall pay all water charges
f^r --oter used in cervile to the n.n1nr4v _t the S' rmhe that
is charged to similar users in thu City of Blaine. In the
event that such charges are not timely paid, the City of Blaine
shall notify the City of Mounds View in writing of such charges
which shall be paid by the City of Mounds View.
9. MaaBIenance of Ty_elve Inch (12") Water Main. The
City of Blaine shall be responsible for the operation and main-
tenance of its twelve inch (12") water main described in Para-
graph 2, above. The City of Mounds View understands that such
water main may be repaired from time to time, and that'interrup-
tion of service to the Property may he required as a part of
such repair. The City of Blaine will attempt to provide ad-
vance notice to the City of Mounds View and/or the owner of the
Property prior to any planned interruption of service to the
Property.

10. Termination. The City of Blaine shall have the
absolute right to discontinue water service to the Property and
terminate this Agreement after thirty (30) days written notice
to the City of Mounds View upon the occurrence of any of the
following events;
(a) the owner of the Property or its successors or assigns
shall fail to timely pay all appropriate charges for wate: o:
services to the City of Blaine; or
(b) this Agreement or the connection .is deemed in the
reasonable opinion of the City Manager of the City of Blaine to
violate any federal, state or local law, rule, ordinance or
regulation; or
(c) use of the connection by the owner of the Property or
its successors or assigns, substantial) interferes with exist-
ing or proposed service to residents of the City of Blaine,
which determination shall be rrade by the City Manager of the
City of Blaine, and such determination sha'l be in his sole
discretion.
11. lydemnification. The City of Mounds View shall be
responsible for determining that all applicable safety, build-
ing and fire codes for the Property have been met and continue
to be met, and shall assume, protect, indemnify and held the
City of Blaine, its elected officials, officers, employees and
agents, harmless from and against any and all claims, actions,
demands, lia ility, losses or lawsuits of any kind whatsoever,
including reasonable attorney's fees, which arise out of, or

occur in connection with, this Agreement, or the design, instal-
lation, use, maintenance and inspection of the connection and
all related equipment and structures required to maintain the
connection to the City of Blaine water main. This indemnifica-
tion by the City of Mounds View shall be deemed to include and
protect against any act of negligence on the part of the City
of Blaine, but shall :lot cover any deliberate or intentional
