Customer Relations Task Force entitled, "Recommendations for

to make these modifications to the entry to provide a more
comfortable waiting area for customers and residents, 1

funds to purchase more suitable furniture for these two
waiting areas to replace

INTRODUCTION AND BACKGROUND
This report is the outcome of the of the City of Mounds View s Customer Relations
Committee. This group consisted of employee representatives from all departments
and was assisted by an outside consultant.
The Committee met from November, comtrittee 1988, through March, 1989, discussing
members perceptions of customer service levels in the City. Generally, the
Committee determined that employees of the City of Mounds View are
doing a good
job serving their cusromers. The recommendadons offered are intended to help make
customer service even more effective, building on a foundation that already appears to
be quite firm,
RECOMMENDATIONS

The City receives many telephone calls each day. The receptionist may not be
able to answer all the incoming calls within three rings. All employees are
trll encouraged to answer the incoming telephone tails when the receptionist is
unable to auwer.

4. IT IS RECOMMENDED THAT: Incomin¢ Police Department telephone callers
should be asked if it is an emergency. If so, they should be asked to can 911

The Police Department has recommended that emergency calls be referred to
911 because of a faster response time.
5. 1T IS RECOMMENDED THAT: A large current area map of the City of Mounds
View and ntrrounding areas be displayed in a location convenient to both
customers and staff.
Provision of this trap will allow staff members to give directions to customers.
6. IT IS RECOMMENDED THAT: A largreusable calendar be displayed to
inform staff of daily gc -A es in the Cin+.

infonration to customers regarding upcoming City activities such as committee
and council meetings, recycling days and special city events.
IT IS RECOMMENDED THAT: New employees be assigned an
interdepartmental representative to familiarize them with the operation of the
City of Mounds View by intrgducirrm them to other staff members. touring the
facilities, and going-over the general policies and procedures.
New employees will benefit from the exerience of the other employee and the
customers tvill benefit front having a well-informed new employee assisting
them.

Customers should be provided with a comfortable area with chairs and tables to
wait for appointments with City staff members. individuals waiting to meet
with members of the Police Departrtrent must also be provided with privacy due
to the nature of many of appointments. It should be noted that these
modifications to the City Hall entryway are in compliance with City building
codes and provide adequate exiting areas. (See Appendix A).

Everest Development has requested a modification of the center
median on, Woodaic at the riviti Tech site. They are requesting
median opening for left turning vehicles into Multi T h'sin
entrance. The cost for this modifiratien should be borne by the
developer.
I have reviewed the proposal and see no problem with allowing the
change at Everest's expense.

RE: Proposed Median Cut - Woodale Drive west
of Quincy Street - Mounds View Business Park
Dear Ric:
Enclosed is an as -built showing the Multi -Tech facility and
adjacent public streets, with a proposed additional median
cut "red -lined" adjacent to the center driveway entrance.
Multi -Tech Systems, Inc. has requested our assistance in
obtaining the suggested median cut. Multi -Tech desires this
median cut to facilitate more direct access for employee and
visitor '.traffic entering their site.
The primary use of this median cut would be for traffic
entering the site in the morning from Highway 10. During
this morning time frame there should be very little traffic
exiting Woodale to Highway 10, and thus, very little chance
of traffic conflict from an extra turn movement across
Woodale.
As developer of Mounds View Business Park, we support Multi-
Tech's request for this additional median cut. Please
review the enlosed plan and contact me at your convenience
with your comments. Thank you for your consideration in
this matter.

Subject :Joint Powers Agreement wit New Brighton
for Water and sewer Utility Services
Attached is a copy of the draft joint powers agreement with New
Brighton. The need was precipitated by development of a lot in
New Brighton which fronts County Road N. New Brighton can not
provide water service at this time and requested that we provide
service to this lot. In reviewing our files, we found that we had
no agreement covering uratcr.. -lthcugh wo have previous
agreement for sewer service. We drafted an agreement for water
service, but New Brighton responded with an agreement for both
water and sewer which would supercede the previous agreement.
I have reviewed the draft agreement and find no problems. I
recommend approval and execution of this agreement when New
Brighton forwards a signed copy.

WHEREAS, Mr. Wally Bauer has requested approval of a minor
subdivision to allow the construction of a zero lot line duplex
at the property located at 2565/67 County Road I; and
WHEREAS, the Planning Commission has reviewed the
applicant's request for a zero lot lire subdivision and
determines that it is in conformance with all applicable chapters
of the City Code.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Mounds View approves the minor subdivision request by
Mr. Bauer contireent upon the following:

PROPOSED REQUEST: Applicant requests a minor subdivision
and ztrro lot line review.
LOCATION OF REQUEST: 2565/67 County Road I
Wally Bauer Construction has submitted a request to the City for
a minor subdivision to allow the construction of a zero lot line
duplex at the property located at 2565/67 County Road I.'
Attached for your information is a copy of the planning
application, City map showing the location of the property,
surveyor's certificate showing the planned subdivision, and the
R-2 section of the City's Zoning Code.
Staff review of the subdivision has revealed that the proposal is
consistent with and exceeds the dimensional requirements for an
9-2 zero lot line lot in the City of Mounds View. The Developer
has been advised of the deed restrictions required Chapter 40.11,
Subdivision C M , of the Zoning Code for zero lot line
developments. I have indicated to the Developer that those
restrictions must be covenance on the deed for these two parcels
should the subdivision be approved.
Also attached for you information is a copy of the plans for the
duplex to be constructed on this site for development review
purposes. Staff has reviewed these plans and found them to be
consistent with the requirements of the City's Zoning Code for
parking and building size.
STAFF RECOMMENDATION: Staff would recommend approval of the
Finer subdivision and development agreement for this project.

RESOLUTION APPROVING A CONDITIONAL USE PERMIT REQUEST
BY GERALD CLORES TO CONSTRUCT AN OVERSIZED GARAGE
AND ACCESSORY BUILDING AT 8044 EDGEWOOD DRIVE,
PLANNING CASE NO. 262-89
WHEREAS, Mr. Carald Clobes, 8044 Fdgewood Drive, has
requested a conditional use permit to allow for the construction
of an oversized garage (884 square feet) and to move nis existing
garage to the rear yard for use as an accessory building (348
square fast); and

WHEREAS, Mounds View Municipal Code, Chapter 40.10,
Subdivision D(6) A through F, provides that the combined square
footages of all accessory buildings may be up to 1,264 square
feet when said buildina(s) is/are designed and maintained to
provide a uniform appearance with the principal dwelling unit,
but if the garage is over 1,000 square feet no other accessory

building will be allowed on the lot; and
WHEREAS, the Mounds View Planning Commission has reviewed
the applicant's request for a conditional use permit and
determines that it is in conformance with the aforementioned
conditions.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Mounds View approves a conditional use permit to
allow for an oversized garage of 884 square feet and an accessory
building of 334 square feet for a total of 1,218 square feet
requested by Gerald Clobes, 8044 Edgewood Drive, legally
described as Woodlawn Terrace, Lot 28, contingent upon the
following conditions:
1. The accessory building must conform with Sections
40.04, Subd. F and 40.10, Subd. C(1) of the Zoning
Code.
2. The combined square footage of all accessory buildings
on one lot cannot exceed one thousand two hundred
sixty-four (1,264) square feet.
3. If the garage square footage is greater than one
thousand (1,000) square feet, no other accessory
building is allowed.

Gerald Clobes is requesting a conditional. use permit to move his
existing garage and construct a new one. The existing garage
which is 348 square feet will be moved to the rear of the Lot and
used as an accessory storage building for lawn equipment. The
new garage will be 26' X 34' (884 square feet).
A provision of Ordinance No. 442 amending Section 40.10 of the
Zoning Code states that the combined square footage of all
accessory buildings on one lot cannot exceed 1,264 square feet.
The ordinance further states that if the garage is more than
1,000 square feet, no other accessory building will be allowed.
In this case, the proposed garage is 884 square feet, and the
accessory storage building is 348 square feet for a total of
1,232 square feet which is within the allowable area under said
ordinance. Mr. Clobes states that he needs the garage to store
two vehicles, A van and a car. He needs the accessory storage
building for garden equipment, lawn equipment and bicycles.
STAFF RECOMMENDATION: Staff recommends approval of the

2345 COUNTY ROAD H, PLANNING CASE NO, 230-87
On February 22, 1987, the Mounds View City Council, upon the
recoalmendatioii of the Planning Commission, approved a conditional
use permit to the MWCC for the construction of a public facility
in an R-1 district at 2345 County Road H. Attached please find a
coav of Resolution No. 2292 approving that conditional use
permit.
On March 3, 1989, the City of Mounds View received a letter from
Mr. A. L. Strane of the. MWCC, copy attached, requesting an
extension on the conditional use permit and advising the City
that changes had been made in the appearance of the building that
was originally proposed in 1987. TLese changes include the
addition of casement windows and doors, a sidewalk and crushed
rock border along the south side of the building, and the
addition of a two foot roof overhang. Upon receipt of this
letter and review of the files, I contacted Mr. Strane and
requested that he provide a copy of the new exterior plans for
the building and indicate whe.her or not the Rice Creek Watershed
District had reapproved their permit issued in 1988. Attached is
Mr. Strane's letter of March 31, 1989, forwarding copies of the
new plans as well as copies of the Rice Creek Watershed District
Permit No. 89-25.
Also attached please find a copy of Chapter 40,25 of the Mounds
Vier: Municipal Code which stares that a conditional use permit
lapses after one year if the work permitted by the permit has not
been completed and the applicant has not requested an extension
in writing at least 30 days prior to the expiration date of the
original permit. Since the original permit was issued on
February 22, 1988, and the original letter requesting extension
was not received until March 3, 1989. The Code would appear to
prohibit allowing an extension to the original permit but would
also appear to allow the City to issue a new permit should you
deem appropriate at this time.
I will be presenting the plans for the building at your April 19
work session along with a resolution identical to that adopted by
the Planning Commission in 1987 which recommended the approval of
the original. conditional use permit.

(4) Reconsideration. Whenever an application for a
condiona use parmit has been considered and denied
by the City Council, a similar application for a
conditional use permit affecting substantially the
same property shall not be considered again by the
Planning Commission or City Council for at least six
(6) months from the date of its denial; and a subse-
quent application affecting substantially the same
property shall likewise not be considered again by
the Planning Commission or City Council for an
additional six (6) months from the date of the sacond
denial unless a decision to reconsider such matter is
made by not less than four -fifths (4/5) vote of the
City Council.
(5) Lapso of Conditional Use Permit by Non -Use. Whenever
within one (1) 'year after granting a conditional use
permit the work as Dermitta�i ty the r rmit shall :ot
have been completed, then such permit shall become
null and void unless a petition for extension of time
in which to complete the work 'has been granted by the
City Council. Such extension shall be requosted in
writing and filed with the City Clerk -Administrator
at least thirty (30) days before the expiration of

no charge for the filing of such petition. The
request for extension shall state facts showing a
good faith attempt to complete the work permitted in

The Planning Commission recommended to the City Council approval
of the prcposed Huhne m.,.or subdivision request.
The proposed lots each met the minimum lot requirements for the
R-1 District.
The City Engineer has reviewed the proposed subdivision and
basically indicated that the proposed subdivision met the minimum
subdivision requirements. The Engineer did, however, note that
some information was missing from the survey.
Finally, the Planning Commission discussed per the City
Encineer's comments, the possibility of putting a street in along
the rear lot lines and determined that the City is not interested
in putting in a street at the rear lot lines, therefore, allowing
the staggered rear lot lines as proposed.
Please find attached a resolution to approve the request as well
as the Planning Commission Staff Report Regarding this matter.

lots in the R-1 District. The vacant lot would front on
Fairchild Avenue and the lot with the existing home would front
on Red Oak Drive. Due to the proposed location of the rear lot
line, an existing shed must be relocated to proposed Tract A in
conformance with the ordinance requirement which states that in
order to allow any accessory building there must be a principal
building existing on the same lot.
Anoth^_r consideration is the location of the proposed lot line in
relation to the surrounding property lot lines, particularly the
rear lines. As shown on the attached section map, the proposed
lot line does not line up with the existing rear lot lines. The
City Engineer has made comments regarding this rear lot line
alignment. The City Engineer's report is attached for reference.
The City Engineer has also indicated that there are a number of
information items missing from the plat that must be added prior
to final approval from the City Council and recording with the
County.

Minor Subdivision Request
I have briefly reviewed the Surveyor's Certificate submitted for
this minor subdivision. There are a number of items required
undei section 42.07 of the Code which are not on this
certificate. The certificate should be revised to include the
following:
1. The existing legal description of the property to be
divided and the book and page or reception number.
2. The address of the owner.
3. North arrow on the drawing.
4. Existing zoning of the property and adjacent
properties.
5. Total area of plat and of each lot.
6. Dedication of Right of Way on Red Oak Drive and
Fairchild Avenue. Red Oak Drive should be 33 feet from
centerline and Fairchild Should be 30 feet from
centerline. This is consistent with the plat drawing,
but the dedicatory language is missing.
7. Lot lines of adjacent parcels.
In addition, the rear lot lines of the adjacent parcels do not
align with the proposed rear lot line to be created as
recommendad in the code. This may cause future problems with
utilities. It appears that the existing house is situated where
the rear lot line should be. If the existing house is to stay,
the rear lot line must be offset from adjacent lot lines. This
situation needs to be reviewed carefully to determine the
passible impacts of the offset rear lot line.
As there are no present utilities in the rear areas, it may be
appropriate to consider approval conditioned on future
resubdivision if the current structure is damaged beyond repair
or demolished for any reason. At that point in time the rear lot
lines would have to be consistent with adjacent lots. If the
offset line is not considered a problem for future utilities this '
condition would not be necessary.

SUBJECT: MOUNDS VIEW BUSINESS PARK CONSTRUCTION MANAGEMENT
EXPENSES
As you may recall, the City entered into an agreement with
Everest Construction Company for the provision of construc-
tion manager services during the development of the Mounds
View Business Park. This agreement provided that the City
would reimburse Everest Development for certain out-of-
pocket expenses and also pay up to 4% of construction costs
not to exceed $72,000.
Over the last several months I have been dealing with repre-
sentatives of Everest Development regarding a request for
payment of out-of-pocket expenses and basic services.
Essentially, the discussions revolved around the documenta-
tion needed to substantiate their out-of-pocket expenses as
well as agreeing on acceptable out-of-pocket expenses as
defined by the agreement. At a meeting on February 26, 1989
Bill Franke cf Everest. Development and I reached an
agreement on the expenses that are acceptable as well as the
construction cost figures to be used for the 4% basic
services fee.. Essentially, Mr. Franke and I agreed that the
4% fee would be based upon actual expenses paid for by the
City of Mounds View rather than contractual expenses since
some of the contracts have not been completed at this time.
Also, Mr. Franke agreed to the elmination of $10,289 in out-
of-pocket expenses that were clearly related to the develop-
ment of the Privately owned buildings on the project and the
plotting of the project rather than the public improvement
portion of the project. As a result, the fees due and
payable Everest Development based upon these agreements and
the contract are as follows:

to be funded from tha Mounds View Business Park Tax
Increment Fund.

Dear Mr. Connors:
I an in receipt of your letter of April 12, 1989 filing the
third step of the grievance procedure between I•U.C.E. Local
No. 49, representing Wally Mortenson, and the City of Mounds
View.
It is my understanding from discussing this matter with
Public Works Foreman Mike Ulrich and Public Works Director
Ric Minetor that the discipline you are now grieving
resulted from a series of events described as follows -
Mr. Mortenson and all members of the Public Works Department
for the City of Mounds View had been advised by Mr. Ulrich
that heavy equipm�_nt operator wages (Maintenance III) would
not be paid for employees performing general maintenance on
pieces of equipment certified for heavy equipment operator
wages. The employees were advised the heavy equipment
operator wages are paid when the employee is actually
operating the equipment. Mr. Mortenson completed a
timesheet indicating heavy equipment operator work when he
had oniv been performing regular maintenance on the
equipment and Mr. Ulrich iapriWa••ce__ded him verbally for such
action in violation of prior direction.
This most recent discipline results from a second attempt on
the part of Mr. Mortenson to collect heavy equipment
operator wages for performing regular maintenance on the
equipment but not operating said equipment. Mr. Ulrich then
appropriately proceeded to correct Mr. Mortenson's timesheet
and reprimanded Mr. Mortensor. in writing for his violation
of said directive.

Your grievance l-et er asserts that the City of Mounds View
in disciplining Mr. Mortenson in this mattsr violated
Article XIV - Discipline which states, "employer will
discipline employees only for just cause." At no time
during the grievance process have you or Mr. Mortenson given
any reason wny you feel that the City of Mounds View has
violated Article XIV. My review of the City's actions find
that they are appropriate and consistent with the City's
Personnel Code and standard practices for disciplinary
action and since you have given no reason for me to question
I find that his actions were
the actions of Mr. Ulrich,
appropriate.
It is my position, therefore, that the City's actions stand
and your grievance is denied.
