STATE OF MINNESOTA
RESOLUTION APPOINTING 1989 WATER METER READERS
WHEREAS, all water meters in the City of Mounds View are
read annually to ensure accurate billings;
NOW, THEREFORE BE IT RESOLVED by the Council of the City
Of Mounds View that the following persons be appointed water
meter reader for the 1989 readings:

BE IT FURTHER RESOLVED, that the rate of pay be $0.75
per meter and $0.75 for each callback; with a limit of two
callbacks.
BE IT FINALLY RESOLVED, that the Mounds View City
Council authorizes Finance Director -Treasurer, Don Brager, to
appoint water meter readers as necessary to fill vacancies.

AN ORDINANCE AMENDING CHAPTER 42 OF THE MOUNDS
VIEW MUNICIPAL CODE ENTITLED, "SUBDIVISION REGULATIONS"
The City Council of the City of Mounds View does hereby
ordain:
SECTION I. Chapter 42.13 PARKS AND PLAYGROUNDS DEDICA-
TION, Subdivision 1. Dedication Required. is hereby amended
to read as follows:
(1) Pursuant to Minnesota Statutes 462.358, in all
subdivisions to be developed for residential, commercial,
industrial or other uses, or as a planned developed
which includes residential, commercial and industrial
uses, or any combination thereof, a reasonable portion of
each proposed subdivision shall be dedicated to the
public for public use as parks, playgrounds, public open
space, wetlands, or storm water holding areas or ponds,
or, at the option of the Municipality, at its sole
discretion, that the subdivider contribute an equivalent
amount in cash baeed on the fair market value of the
undeveloped land.
SECTION II. This ordinance shall take effect thirty (30)
days after the date of its publication.

I have completed the Performance Review of Audrey
Almendinger, the City's Receptionist, after consulting with
members of the clerical staff. The review has determined
that Ms. Almendinger's performance is satisfactory for an
individual with only 90 days experience within the
organization. Therefore, I would recommend that pursuant to
the employment agreement with Ms. Almendinger the Council
authorize -a $.20 per hour increase in wages retroactive to
September 1, 1989.

SUBJECT: SILVER VIEW PARK MASTER PLAN PHONE SURVEY
Pursuant to your direction at the September 5, 1989 Agenda
Session, I contacted Dr. William Morris of Decision
Resources regarding the performance of a short phone survey
as part of the update of the Silver View Park Master Plan.
Dr. Morris indicated that, if the survey could be started by
October 1st, he would be able to submit a final report to
the City during the third week of October. Dr. Morris
indicated that the survey would need to be a minimum of
approximately 20 questions in order to allow for the
development of background data from the individuals
questioned such as demographics and recreational habits.
Dr. Morris is forwarding to my office a copy of a similar
survey he has recently performed for your review. This
should be available on Monday evening. Dr. Morris further
indicated that a survey of 20 questions for approximately
450 housing units would be approximately $2,000. Your
direction in this matter is requested.

The Mounds View City Council, Mr. Dorn, has instructed me to
communicate to you that they feel they have extended the City to
the maximum on tax increment zssisted projects and are not
inclined at this time to provide any additional tax increment
assistance to your client or anyone else. As you may know, we
currently have outstanding $8 million worth of tax increment
bonds related to two projects which have been issued over the
last 2 1/2 year period and are currently in negotiations on a
third project for an additional $2 million worth of assistance.
The Council feels that $10 million worth of tax increment debt is
more than enough for the City to be undertaking at any one time.
Therefore, they have instructed me to advise any future
developers that they are not inclined to provide any additional
tax increment assistance until such time as the current level of
our debt is reduced substantially.
Should Mr. Jones be able to find other financing for this
project, I am sure that the Planning Commission and City Council
would be greatly interested in reviewing the proposal and
discussing with Mr. Jones his need for alteration of the wetlands

Over the past few years, Staff has been having discussions
on and off with Mr. Dale Jones regarding the development of
an office park on the triangular portion of property bound
by Highway 10, Silver Lake Road and the St. Paul Water-
works right-of-way. This land has also been identified
previously as the County Road I triangle. Mr. Jones has
been able to acquire a large portion of the 12 acre site
excluding the property owned by George Winiecki and TJB
Builders which total 5 lots.
As you may recall, several years ago this site was
designated as a tax increment district although no formal
project has ever been submitted to the City Council for your
consideration. On May 8th I received correspondence from
Mr. Jones' attorney, Mr. Wilbur F. Dorn, Jr., providing the
City with proposed site plans for the project and a request
that the City Council give an indication as to your desire
to provide tax increment assistance for this project.
I have not had our consultants review the project due to the
fact that minimal financial information is available at this
time. My review and past experience with tax increment in
Mounds View, including the Mounds View Business Park South
project, would lead me to believe that Mr. Dorn's
conclusions that the project would support a $1 million
dollar tax increment issue over a fifteen year period is
tenuous at best. The Mounds View Business Park South
project producing a market value of better than double the
proposed market value for this project is unable to produce
$2 million for an 11 year period.
Rather than getting into any great detail regarding the
financial viability of the project, it would be my thought
that the Council should simply discuss whether or not you
are interested in funding another tax increment project at
this time and whether or not this is the type of project you
wish to support with tax increment funds. Extenuating
circumstances that you need to be aware of regarding this
project site are that a large wetland would be involved on
the project requiring a wetland alteration permit to allow
for relocation of portions of the wetland and construction
within the 100 foot buffer zone. Also, the r:oject site is
within the current moratorium district along Highway 10.
The Council does have the authority to waiver the require-
ments of the moratorium district should you find a project
to be of a nature that you feel would be of significant
benefit to the community and is consistent with the proposed
Comprehensive Land Use Plan which is currently in the

drafting stage. Although I do not expect that you would
indicate to the developer that permits would be issued for
the alteration of wetlands or waiver of the moratorium
ordinance, it would seem reasonable that if you are not
inclined to consider those two items that you should advise
the developer at this time as any indication of interest in
tax increment assistance would simply require expenditure of
additional dollars for a project that would not receive
other necessary approvals.
I will be happy to discuss the request of Mr. Jones'
attorney at your June 5th agenda session and would request
your direction as to a response to Mr. Dorn at that time.

Pursuant to our recent telephone conversation, I enclose herewith
several drawings, including a building elevation, site plan,
landscaping plan and perimeter diagram, for a project to be known
as Marsh Park Professional Offices. The following narrative
describes the proposal, and it is hoped that you could bring this
to the attention of the Moundsview City Council to ascertain
whether or not municipal assistance in the form of tax increment
financing might be available.
THE PROJECT
The project consists of two 25,000 square foot office
buildings, to be built in two phases. The site is located
on the south side of Trunk Highway No. 10 near Silver Lake
Road. The land area comprises approximately eight acres,
and we are presently contemplating a commercial planned
unit development designed to phase construction of the two
buildings, creating a four- acre wetland preserve. The
site is somewhat difficult and substantial soils
corrections would be needed. We believe, however, that
the site does lend itself well to a tax increment
project, and is the type of land which will not, in fact,
develop at all if some form of cost write -down is not
available. We therefor believe that it is ideally suited
for tax increment financing.
II. COSTS AND DEVELOPMENT SCHEDULE
We anticipate that the project, when completed, would,
combining land and buildings, produce a fair market value

of approximately $3.0 million. Annual real estate taxes
generated from the parcels, are estimated at approximately
$157 „ 000.00 which is a tremendous increase over the present
taxation. Our preliminary estimates indicate that soils
corrections costs, cost of land write -down, and public
utility and service connections would be somewhere in the
range of $1.0 million.
We do believe that the tax increment which could be captured
for retirement of tax increment bonds could, in a 15-year
project, easily handle a total write -down in excess of $1.0
million.
III. THE DEVELOPER
The Developer would D. W. Jones Construction, Inc., or a
development corporation to be formed by Dale W. Jones. Mr.
Jones is an experienced real estate developer who has
completed numerous land development projects in Anoka
County, Minnesota; Walker, Minnesota; Grand Rapids,
Minnesota; and South Texas.
I realize that the present legislative session may produce
significant changes in the law relative to tax increment
financing. Consequently, we would not make any formal
application to the City until this legislative session is
completed. In the interim, however, it would be helpful to know
what the City's attitude towards this project might be, assuming
that these types of programs are still available when the
legislative session is complete.
I would appreciate hearing from you as to your Council's
reaction.

SUBJECT: SILVER VIEW PARK PLANTINGS
On Thursday, August 24, the Parks and Recreation Commission met. Also present
were Mayor Hankner, Councilmembers Quick and Wuori, and visitors Rademacher,
Jones and Golden. As you may recall, one of the agenda topics was Silver View Park
pathway. After discussion, Mayor Hankner proposed that the pathway be postponed
until after a master plan for Silver View Park has been developed.
Discussion continued regarding the problem of designating the area abutting
residential properties at the area of the proposed pathway. Several suggestions were
discussed. Finally, with input from those visitors present; Mr. Rademacher, Mrs. Jones
and Mrs. Golden; the decision was made to recommend to the City Council the
installation of bushes at the property comers designating public versus private
property. This option was chosen by the residents to be the least obtrusive way of
delineating parldand for users.
It was decided that Forester Wriskey be given the authority to choose the species,
spacing and placement of the bushes. Furthermore, this project was to be completed
as soon as possible depending upon the availability of stock. Likewise, a letter was to
be sent to those eight residents informing them of the plant installation. (See
attached).
This recommendation was forwarded to the City Council. On Monday, August 28, the
City Council directed staff to have Forester Wriskey put plantings in, in accordance
with the August 25, 1989 memo from Park and Recreation Director Saarion. (See
attached).
After City Council approval on Tuesday evening, September S, the letter, which was
approved and reviewed by the City Council, was mailed on Wednesday morning,
September 6 by certified mail.
Stock was purchased for both the Hillview Park building landscaping project and the
Silver View Park planting project. Staff planted the Hillview Park project on Monday,
September 11 and upon completion in the later afternoon, continued to the Silver
View Park planting project in an effort to get the plants in the ground rather than
leaving them on the truck risking potential stress damage to the plants.
The installation of the 3 foot Amur maple takes staff approximately 30 seconds to dig
the hole and one minute to plant the bush and cover the base. The time commitment
is minimal. To relocate or reposition the plant takes minimal time.

Staff understood that requests for changes may occur from residents after plant
placement. In fact, it would be very difficult for residents to visualize the placement r^%
until the bush is seen in its setting. Relocation can easily occur after planting has
taken place.
Staff also understood that the indicator bushes were requested as temporary plantings
for the purpose of indicating public versus private property for park users until which
tine the Silver View Park master plan is developed and further decisions on the use of
that particular area of parkland is made.

The City will be planting "indicator" shrubs to mark the vicinity of the comer stakes of
your south property adjacent to the park.
In keeping with the framework of the eventual planting, the shrub selection will be

meeting that Forester Wriskey be directed to plant bushes at the corners of residential
and park property located on the southwestern side of Silver View Park pond. These
plantings are expected to help designate public versus private property.
It was recommended that Forester Wriskey use his own discretion as to the selection
of species and spacing of the plantings. The plantings should be platted this fall of
1989.

Environmental Specialties has concluded their year -long study of Silver View Park
pond. They are now prepared to present their findings and propose their
recommendations to the City.
Staff recommends that Environmental Specialties be given the opportunity to present
their study results and recommendations at the regular council meeting on Monday,
October 23, 1989.
Staff recommends that community -wide publicity regarding this be initiated so that
residents who are interested can attend this meeting or tune into the cable TV
telecast.

Staff was directed to pursue the possibility of acquiring permission from Gaughan
Companies to pursue continuation of the Silver View Park pathway on their Scotland
Court Apartment properties.
Because my prior efforts with Scotland Green management was met without reply, I
was referred to the Gaughan Companies. I met with RoxAnn Hazelton, Director of
Property Management. After touring the site, she was very excited about the pathway
possibility. She presented the idea to the Board of Directors and they were affirmative
as relayed in the attached letter.
Staff realizes that development at Silver View Park is on hold until a master plan is
developed. This memo is for your information only. Staff awaits any direction
council may give regarding this matter.

Superamerica has purchased the chain of 7-11 Stores and is in the
process of converting the facade of the store to the Superamerica
logo. The subject 7-11 Store in Mounds View is located at 7295
Silver Lake Road. The applicant requests a wetland alteration
permit to remove and replace the mansard on the building, remove
and replace the face of the free-standing sign, upgrade the
parking area, and upgrade the landscaping. The property is not
located within a wetland, however, it is located within the 100
foot buffer zone of the wetland and, therefore, requires a
wetland alteration permit.
The Planning Commission reviewed this request at their meeting on
September 6, 1989, and recommended to the City Council approval
of the wetland alteration permit for the work listed above to be
performed in the wetland buffer area. To date, the Planning
Commission has not received plans for the upgraded parking and
landscaping area, however, it was their feeling that any
upgrading would be an improvement to the site and that the City
Forester would have the opportunity to review the plans and make
revisions if needed. The parking area needed some repair and
that would also be done.
Please find attached Resolution No. 264-89 that the Mounds View
Planning Commission approved regarding Superamerica's request.
This same resolution has been revised in City Council form for
your consideration.

AN ORDINANCE AMENDING THE MUNICIPAL CODE OF MOUNDS VIEW
BY AMENDING CHAPTER 100, ENTITLED, "INTOXICATING
LIQUOR"
The City Council of the City of Mounds View does
hereby ordain:
SECTION I. Chapter 100.09, Subdivision 1 is amended
to read as follows:
Subdivision 1. Hours and Days of Sale. No
"on -sale" shall be made between the hours of 1 o'clock a.m.
and 8 o'clock a.m. on any weekday. No "off -sale" shall be
made before 8 o'clock a.m. or after 8 o'clock p.m. on any
day except Friday and Saturday, on which days "off -sale" may
be made until 10 o'clock p.m. No "off -sale" shall be made

Thanksgiving Day; or Christmas Day, December 25; but on the
evenings preceeding such days, if the sale of liquor is not

The City Council of the City of Mounds View does
hereby ordain:
SECTION I. Chapter 101.04, License Fees, (3) is
amended by adding the following:
SECTION II. This ordinance shall take effect
thirty days after the date of its publication.

COMMISSIOINS AND COMMITTEES
REGARDING
APPOINTMENT OF
COMMITTEES
WHEREAS, the Mounds View City Council has determined
that the appointment of students to City Commissions and
Committees would be in the best interest of the community as
it would help prepare our youth to become contributing
members of the community; and
WHEREAS, the Mounds View City Council, after
consulting with members of the City 's Commissions and
Committees has determined that the best role for students
would be as ad -hoc members having an advisory vote and not
considered a member for purposes of determining quorum; and
WHEREAS, the Mounds View City Council has determined
that at times commissions or committees might exist where
student members might not be appropriate due to the
confidentiality of the subject matter,
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Mounds View establishes the following Policy
regarding student membership on commissions and committees
of the City.
1. Student membership of no more than 2 is solicited
and is encouraged on all standing commissions and
committees, except when the City Council
determines that the commission or committee is
dealing with subject matter of a confidential
nature such as the Police Civil Service
Commission. In such cases, no student shall be
appointed to those commissions or committees.
2. Student members shall be ad -hoc members having an
advisory vote and not considered members for
purposes of determining quorum.
3. A full member of a commission or committee shall
be appointed to serve as a member for each
student appointed to the commission or
committee. The mentor shall assist the student
in understanding the activities and
responsibilities of the commission or committee
and the role if plays in relationship to the
activities of the City as a whole.

4. The term of a student member shall not exceed
that allowed for a full member of the commission
or committee.

SUBJECT: BICYCLE LICENSING AND SAFETY
At the August 28. 1989 Council Meeting Alice Frits asked if the City
could require the licensing of bicycles and become more aggressive in
the enforcement of traffic laws and bicycle safety training.
Chapter 168C of the Minnesota Statutes, copy attached, regulates bicycle
registration in the State. Essentially, the law under 168C.13 states
that a political subdivision may require the registration of bicycles
within their boundaries if the subdivision had such power prior to March
1, 1977. Political subdivisions not having that power may obtain
authority to register bicycles as a State Deputy Registrar, but may not
adopt laws requiring registration.
7 1veral cities in the metro area have bicycle patrols which enforce
state traffic laws relating to bicycle operation through the use of
warning or offense notices. Since these individuals are not sworn
police officers, they are not allowed to issue citations.
Besides enforcing bicycle related traffic laws in their communities by
patrolling the streets and paths on bikes(in Roseville one individual
rides a motorcycle) these individuals also teach bicycle safety.
In the past the City has offered bicycle safety training in the schools
and through the use of bicycle rodeos. Staff would suggest that efforts
be made to offer bicycle safety classes in the two elementary school
serving Mounds View next Spring timed such that it coincides with the
start of the bike riding season. This program could be a Joint effort
of our Police and Parks and Recreation Departments.
Unless the Council deemed it appropriate to begin a Bicycle Patrol in
the City, which would need to be funded with General Fund monies as no
other source of non -municipal funds appears to be available, traffic
code enforcement could be handled through a heightened awareness of the
alleged problem by our police officers.
Staff will await direction from the Council on this matter before taking
any further action.

SUBJECT: 1990 BUDGET AND 1990 BUDGET PUBLIC HEARINGS
Present Truth In Taxation law requires that the City publish a
notice, in a newspaper that is published at least five days a
week and has the greatest circulation within the City, of a
public hearing on the City's 1990 Budget. The newspaper with the
greatest circulation within the City of Mounds View is the Star -
Tribune. Minnesota Department of Revenue (the agency responsible
for monitoring compliance with Truth In Taxation) has specified
that notices be published in the Thursday Community Section. The
notice must be published five business days prior to the public
hearing. Council has previously scheduled the public hearing for
October 9. To comply with Truth In Taxation the notice must
appear in the September 28 Community Section. To appear on that
date, copy must be given to the Star -Tribune on September 25. In
order for staff to provide the copy, we need to know what budget
to present at the hearing. The notice must contain the amount of
the property tax levy. In addition, the notice states that a
copy of the Proposed Budget is available for public inspection.
,1 Staff, therefore, needs Council direction on the amount of the
proposed property tax levy and what budget to make available for
public inspection and to present at the public hearing. Is the
Proposed Budget staff submitted acceptable? Do you wish to make
changes? Please advise. This is the last Agenda Session before
the notice is to be published.

Subject :8386 Pleasant View Drive - Mr. & Mrs. Hetlund
We have been requested by the Hetlund's to relocate a fire
hydrant that is adjacent to their driveway. I informed them that
this hydrant was installed prior to the lot being subdivided and
was apparently alright at that time. I have learned since then
that the City did move this hydrant once before, apparently at
the request of the builder of the house and to a location
approved by the builder. At this time I do not feel we have any
responsibility to again relocate this hydrant.
While I sympathize with Mr. Hetlund's problem, I am not in
agreement with his concern about safety. The hydrant is 1.5 feet
off the driveway and 2 feet off the curb. The distance behind the
curb is no less than numerous other hydrants in Mounds View. Mr.
Hetlund's driveway is 16 feet in width, and the code allows up to
22 feet of width. I believe that since Mr. Hetlund would only
gain 6 feet of width, and since the driveway is in line with the
garage door; that if additional parking area is desired, he could
widen the drive on his lot and taper to the current opening. If
he feels the additional 6 feet is a definite benefit, then he
could arrange to relocate the fire hydrant at his expense.

It is difficult to understand why I have to put up with
this obstacle of a fire hydrant on my driveway, when 1 drive
around the city of Mcundsview and cannot find any of the
other fire hydrants located in the middle of the lots!
I am requesting, pleading with the city to take
whatever steps necessary to move the fire hydrant to the
corner of the property where it belongs. I would appreciate
what ever you can do to help me resolve this problem as soor.
