The Mounds View City Council was called I. Call to order

special consideration for Council approval
of documents necessary to allow for the sale

Park. Mr. Franke reviewed the documents,
namely, a First Supplement to the Contract for
Private Redevelopment, Subordination Agreement,
and Estoppel Certificate. Clerk -Administrator
Pauley reviewed the timeline in which the City
has had the opportunity to evaluate the documents
and outlined the fact that the legal counsel
advising the City on tax increment items,

process.

STATE OF MINNESOTA
AN ORDINANCE AMENDING THE MUNICIPAL CODE OF MOUNDS VIEW BY
AMENDING CHAPTER 41 ENTITLED, "SPECIFIC REZONINGS"
The Council of the City of Mounds View does hereby ordain:
SECTION I. The Mounds View City Council has taken into
consideration the following items:
1. Relationship to Municipal Comprehensive Plan.
2. The Geographical area involved.
3. Whether such use will tend to or actually
depreciate the area in which it is proposed.
4. The character of the surrounding area.
5. The demonstrated need for such use.
SECTION II. Pursuant to Chapter 41.23, the Official Mounds
View Zoning Map is hereby amended to reflect the following
rezoning:
A portion of Mounds View Square Shopping Center property is
hereby rezoned from B-4, Regional Business, to B-3, Highway
Commercial.
Parcel A, the west 170 feet of the east 917 feet of the
north 143 feet, that part of the northeast quarter of
Section 7, Township 30, Range 23 west, Ramsey County,
Minnesota, lying northeasterly of STH 10 and subject to
County Road I.
SECTION III. This ordinance shall take effect thirty days
after the date of its publication.
Read by the City Council of the City of Mounds View on the
day of , 1989.
Read and passed by the City Council of the City of Mounds
View on this day of 1989.

RESOLUTION NO. 2554

COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION RECOMMENDING APPROVAL/DENIAL OF MOUNDS VIEW SQUARE
DEVELOPMENT STAGE AND FINAL STAGE PLAN REVIEW OF A
CONDITIONAL USE PERMIT/PLANNED UNIT DEVELOPMENT FOR A
HARDEES CONVENIENCE FOOD RESTAURANT, PLANNING CASE NO. 276-89
WHEREAS, the Planning Commission has reviewed the
requested partial rezoning from B-4 to B-3, concept, development
and final stage plans for the conditional use permit/planned unit
development to allow more than one principal building on the site
and a conditional use permit for the convenience food restaurant
to be located at the Mounds View Square Shopping Center site (PIN
07-30-23-11-0001); and
WHEREAS, the Planning Commission has recommended to the
City Council approval of the request as described above per
Resolution No. 265-89 approved on September 20, 1989, and
Resolution No. 267-89 approved on October 4, 1989; and
WHEREAS, the City Council reviewed and approved a first
I reading of Ordinance No. 479 to rezone a portion of the Mounds
View Square Shopping Center from B-4 to B-3 on October 9, 1989;
and
WHEREAS, the City Council reviewed and approved a concept
stage CUP/PUD plan to allow more than one (1) principal building
on the site and a conditional use permit to allow a convenience
food restaurant with drive -through facilities per Resolution No.
2544 adopted on October 9, 1989; and
WHEREAS, the City Council has reviewed the development and
final stage plans; and
WHEREAS, the City Council has determined that the
development stage and final stage plans are/are not in
conformance with the concept plan already approved; and
WHEREAS, the City Council has reviewed the revised
landscaping plan submitted October 9, 1989; and
WHEREAS, the City Council has reviewed City Forester
Wriskey's memo regarding the revised landscaping plan dated
October 10, 1989, and determined that it is/is not acceptable.

NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Mounds View approves/denies the development stage and
final stage plan review for the conditional use permit/planned
unit development to allow more than one principal building on the
site contingent upon:

Nos. 265-89 and 267-89 are complied with.
2. All requirements per City Council Resolution No. 2544
are compliled with.
3. The landscaping on the north side of the property is
reviewed in one year in order to determine its
adequacy.
4. The City continue to pursue alternatives to the
drainage ponds with all governing agencies.
5. The developer enter into and sign a development
agreement with the City.

RESOLUTION AUTHORIZING THE CLERK -ADMINISTRATOR
AND MAYOR TO EXECUTE DEVELOPMENT AGREEMENT NO. 89-93
WITH PASTER ENTERPRISES AND HARDEES CORPORATION,
MOUNDS VIEW SQUARE SHOPPING CENTER
WHEREAS, Mounds View Code, Chapter 40, requires a
conditional use permit/planned unit development to allow more
than one principal building on a site and a conditional use
permit for a convenience food restaurant with drive -through
facilities; and
WHEREAS, the Mounds View Planning Commission has reviewed
the proposal and recommended approval in Resolution No. 267-89;
and
WHEREAS, the City Council has also reviewed the proposal
and the recommendation action of the Planning Commission; and
WHEREAS, the City Council has stipulated requirements in
Development Agreement No. 89-93.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Mounds View authorizes its Clerk -Administrator and
Mayor to execute Development Agreement No. 89-93 pursuant to
direction found above.

RESOLUTION NO. 2556
STATE OF MINNESOTA
COUNTY OF RAMSEY
CITY OF MOUNDS VIEW
RESOLUTION FOR ACCFSS THROUGH THE TWIN CITIES ARMS PLANT
FOR THE DEVELOPMENT OF THE
THE RICE CREEK REGIONAL TRAIL CORRIDOR
WHEREAS, the City of Mounds View lies within Ramsey County; and
WHEREAS, a portion of Rice Creek Flows through the City of Mounds View; and
WHEREAS, the City of Mounds View residents would benefit from the development
of the Rice Creek Regional Trail Corridor; and
WHEREAS, it is in the best interest of the community that Ramsey County,
neighboring cities and United States Army work together for the benefit of the people; and
WHEREAS, the Rice Creek Regional Trail Corridor has been identified as pan of the
Regional Recreation Open Space System for multiuse land trails, and a canoe route; and
WHEREAS, all of the trail corridor segments within Ramsey County have been
acquired, except for a one mile segment which passes through the Twin Cities Arms Plant,
owned by the U.S. Department of Defense; and
WHEREAS, access through the Twin City Arms Plant along Rice Creek, is essential
in order to provide a continuous water route for canoeing and other boating activities; and
WHEREAS, efforts to negotiate With the U.S. Department of Defense for access
through the Arms Plant along Rice Creek have been unsuccessful.
NOW, THEREFORE, BE IT RESOLVED that the City of Mounds View, on behalf of
the Ramsey County Board of Commissioners, reaffirms its interest in acquiring the Rice Creek
Trail Corridor segment through the Twin City Arms Plant, and requests the transfer or long
term lease, from the U. S. Department of Defense to Ramsey County for trail corridor purposes,
provided the County does not assume liability associated with potential hazardous wastes on
the site; and
BE IT FURTHER RESOLVED that Ramsey County, in cooperation with the City of
Mounds View and other northwest Ramsey County municipalities, request the assistance of the
Minnesota Congressional Delegation in this effort.

RESOLUTION REQUESTING THE METROPOLITAN COUNCIL HRA TO APPLY
FOR AND IMPLEMENT A DEFERRED LOAN PROGRAM WITHN THE
CITY OF MOUNDS VIEW
WHEREAS, the City of Mounds View desires to assist low income
homeowners in making repairs to their homes for the purpose of
correcting defects affecting directly the safety, habitability,
energy conservation or accessibility of the property; and
WHEREAS, the Minnesota Housing Finance Agency has funds to be
used for such purposes, and will accept applications from housing
and redevelopment authorities desiring to administer these
Deferred Loan Program funds; and
WHEREAS, the Metropolitan Council has been duly organized
pursuant to Minnesota Statutes 1976, Section 473.123, and has all
of the powers and duties of a housing and redevelopment authority
pursuant to Minnesota Statutes 1976, 473.193, under the
provisions of the Municipal Housing and Redevelopment Act,
Minnesota Statutes 1976, Sections 462.411 and 462.711;
NOW, THEREFORE, BE IT RESOLVED that the Metropolitan Council
is hereby requested to include the City of Mounds view in an
D ferred Loan Program funds, and that the

Subject :TH to Signal Upgrades
Resolution for Payment from MSA Funds
The City entered into an agreement with Mn/DOT for upgrading
signals on TH 10 in December of 1988. The agreement called for
sharing the costs of the signal upgrades based on the number of
entering legs,, (each street entering an intersection is
considered 1 leg). Of the 6 signals included in this project, the
City has partial jurisdiction at 2 of the intersections, Red oak
Drive and county Road H-2. The total cost of our share of this
work is $41,829.26 and is eligible for Municipal State Aid
reimbursement.
The City needs to adopt the attached resolution in order to
receive reimbursement for this work. I recommend adoption of
Resolution Number 2557.

SUBJECT: HILLVIEW PARK °LEASURE RINK EXPANSION
Staff proposes the expansion o! Hillview Park pleasure skating rink as shown in the
site plan below. This expansion measures appro)dmately 65 feet by 40 feet. The
northwest light pole will have a 6 foot high pad attached to it to help minimize injury
in case someone accidentally falls into it. The pole would be on the edge of the ice
but would not be surrounded by skating ice. The dimension of this proposal differs
from the original proposal in that the rink will be flooded between the two northerly
light poles rather than around the northwest pole. Ice would be too difficult to
establish around the pole because of the sloping drainage area.
Staff requests Council's approval of this expansion area for the Hillview Park pleasure
skating rink.

RESOLUTION APPROVING A WETLAND ALTERATION PERMIT FOR
KHOSROW DAIVARI, 7028 WOODLAWN DRIVE, PLANNING CASE NO. 283-89
WHEREAS, the City Council has reviewed the request of
Khosrow Daivari, 7028 Knollwood Drive, for a wetland alteration
permit to construct an additior onto his home; and
WHEREAS, the property is legally known as Knollwood Park,
Lot 84; and
WHEREAS, the property in question, 7028 Knollwood Drive,
currently shares a driveway with 7044 Knollwood Drive; and
WHEREAS, Section 40.07, Subd. K(1), of the Zoning Code
allows for shared driveways contingent upon:

I have completed the specified six month performance review
for City Planner Michelle Hren and found her performance to
be fully satisfactory at the end of her probationary
period. The employment agreement with Ms. Hren provided
that she receive $1,000 per year increases at 3, 6 and 12
months assuming acceptable performance. Since I have
determined that Ms. Hren's performance has been acceptable
for the first six months of her employment with the City I
would recommend that the Council approve the $1,000 per year
increase to her current base wage of $29,000 retroactive to
October 1, 1989.
Also, attached for your consideration is Resolution. No. 2559
confirming the appointment of Michelle Hren as a permanent
full time employee.

SUBJECT: Purchase of fall protection for water towers
This budget year we allocated monies for fall protection
for our water towers. We viewed demos and visited surrounding
communities to get an idea of what worked for these people and
what was out there tG work with. This type of protection is new
to many of us and is being required by new OSHA regulations. The
system recommended by the public works employees was the Miller
Suretrack Climbing and Fall Protection System. Two venders have
provided us with bids. They are as follows:

SUBJECT: Rebuilding of Grove_and Lift Station
Groveland lift station hay been in existence an excess of
approximately twenty years and has provided the City with an
exceptionally effecient and inexpensive operation. To date this
equipment has experienced the least amount of breakdown due to
proper maintenance and application. Even though effective
preventative maintenance can reduce breakdown maintenance, it
cannot prevent normal wear. This year we have had to replace
bearings, and continually retorque shafts and pump heads due to
the wearing of these parts. The need for rebuilding has been
reviewed by our staff and outside experts in the field.
We have solicitated the only two venders that provide this
service in the metro area for bids. They are Waldor Pump and
Techni Flow. Waldor Pump is a dealer for the current equipment we
have in use and has provided us with a quote. Techni Flow does
not handle this equipment , thus having to purchase it from
Waldor. 1 have talked to a representative from Techni Flow
numerous times to work with them on comperably specified
equipment, but he has declined to submit a proposal. Since our
current equipment has performed so well for so long we recommend
that we replace it with the same updated pumps. For that reason
we have only one bid to submit. Waldor Pump is a reputable firm
and has performed work for us in the past. Their bid accompanies
this memo for your review but is as follows:

We have E29,000.00 budgeted for sewer inspection and
repair, and lift station pump and motor repair. At this time we
have completed all the inspection for the year thus having

The following are the changes to the proposed 1990 budget that
were the result of the special meeting held on October 30,1989
and the November 6, 1989 Agenda Session:
1) Add $750 to 100-4110-363 Commissions, Training, for a total
budget of $1,000.
2) Add V o n for report generator software to 100-4150-703

3) Add $2,000 to 100-4180-303 Community Development, Professional
Services for part-time help when the Building Inspector is on
vacation.
4) Add $1,200 to 100-4190-703 City Hall, Equipment for a fax machine.
5) Add back $1,000 for national conference for the Police Chief
which had been previously cut to 100-4200-362 Police,
Conferences.
6) Add $3,000 to 100-4200-703 Police, Equipment for the purchase
of a fax machine for the Department.
7) Add $4,272 to the Parks Department budget to provide for a
supervisor of seasonal summer workers. The following personnel

lTo comply- with Truth In Taxation legislation the City's proposed
1990 budget and property tax levy must be certified to Ramsey
County at the November 13,1989 Council meeting. A resolution
certifying the budget and proposed property tax levy has been
prepared for your consideration and is attached. Please note

that the overall budget will increase 3.66% and the General Fund
budget will increase 2.40%. Due to the shift in state aid from
cities to school districts the property tax levy will increase
25.56%. Pursuant to Truth In Taxation legislation once the
budget and levy is certified to the County neither may be
increased; however, they are permitted to be lowered. A public
hearing on the 1990 budget has previously been set for
November 27 with a reconvene date of December 11 if necessary.
Truth In Taxation legislation states that the budget and

Subject :Letters of Commendation for
Public Works Foreman Mike Ulrich and
Maintenance Worker Gary Kardell
Mike I?lrich and Gary Kardell attended the Western States Snow and
Ice Conference held in Denver, Colorado in September of this
year. In addition to a number of seminar session dealing with
issues of regard to snow plowing and ice control operations, they
competed as a team in the snow plow competition and competed
individually in the loader competition.
Considering the limited experience (we have only been plowing all
City streets for the past year) and the level of competition
(certain competitors had over 20 years experienced and are
allowed to practice for this competition during work hours), I
believe our employees had exemplary performance. As a team they
placed 13th out of 37 competitors in the snow plow competition.
There were 50 competitors in the loader competition; Gary placed
28th and Mike placed 15th.
I recommend the attached letters of commendation be approved by
the Council for their exemplary performance and copies of these
letters be placed in their personnel files.
