RBSOLUTION APPROVING A CONDITIONAL USE PERMIT FOR -
WILLARD AND MARVIS HARD, 7545 PLEASANT VIEW DRIVE,
MOUNDS VIEW PLANNING CASE NO. 218-8^.

WHEREAS, Willard and Marvis Haro, 7545 Pleasant View Drive
have requested a conditional use permit to allow the construction
of a 400 square foot storage building; and
WHEREAS, Mounds View Municipal Code, Chapter 40.10,
Subdivision C, (2), c. pre^ides the maximum size of an accessory
building in an R-1 district shall be 216 square feet unless a
Conditional Use Permit is awarded by the City; and
WHEREAS, Mounds View Municipal Code, Chapter 40.10; Subdi-
vison D, (F!, (a) throagh (a) provides that an acceusory building
may be permitted up to 400 square feet once said building is a
permanent structure and is designed and maintained to provide a
uniform appearance with the principle dwelling unit; and
WHEREAS, the Mounds View Planning Commission recommends
approval of the request.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Mounds View approves a conditional use permit for the
construction of a 400 square foot accessory building on the
property identified as 7545 Pleasant View Drive conditioned upon
the following:
1. The use of the building shall be limited to storage
of domestic cupply and non-commercial and recreational
equipment as provided in Municipal Code Chapter 40.10,
Lt
Subdivision C,
2. No improved driving surface or apron shall be installed
to the building.
3. Any vehicle stored in the building must be licensed with
the Minnesota Department of Transportation as a collector
or vintage vehicle.
4. The building must be a permanent structure designed and
maintained to provide uniform appearance with the
dwelling unit.
5. The conditional use permit, if issued, be filed with
Ramsey County for recording on the title of the subject
property.

RESOLUTION APPROVING USED AUTO'SALES LICENSE TO
KEVIN MULLINS, DBA MID-AMERICAN AUTO
WHEREAS, Mr. Kevin Mullins has entered into an earnest money
agreement with Mr. Joseph Cox, current owner of Mid -American Auto
located at 2975 Trunk Highway 10 to purchase this "acility and
operate a used auto sales lots and
WHEREAS, Mr. Mullins has applied for the transfer of the
used auto sales license currently in the possession of
Mr. Joseph Cox; and
WHEREAS, the City of Mounds View has reviewed the proposal
submitted by Mr. Mullins including a site plan; and
WHEREAS, the Mounds View City Council has determined that
Mr. Mullins' proposal is consistent with the provisions of
Chapter 109 of the Municipal Code relating to Used Auto Sales
with restrictions as outlined below.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Mounds View approves the issuance of a Used Auto Sales
license to Mr. Kevin Mullins to conduct business at 2975 Trunk
Highway 10 conditioned up,)n the following.
1. The entire lot where customer and used vehicle parking
is located must be paved and the customer parking area
must be striped to provide the number of spaces required.
2. A minimum of eighL customer parking spaces shall be
provided and a maximum of 38 autos for sale shall be
located on the lot at any one time in the pattern
identified on the site pian date6 August 18, 1987
currently in the possession of the City of Mounds View.
3. No outside storage of parts, supplies, equipment, or any
,.ther items other than autos for sale snall occur.
9. Vehicle maintenance and repair shall be li.a:ced to minor
repairs on vehicles to be sold on the lot with said
repairs limited to minor body and fender work, minor
painting and upholstering service, replacement of parts
and engine service to passenger vehicles and trucks not
exceeding a one ton chassis design.

The Mounds View City Council was called to order by
Mayor Linke at 7:02 PM on Monday, August 24, 1987.
The Pledge of Allegiance was said.
MEMBERS PRESENT: CourcUmembers Blanchard, Wuori,
Quick, Hankner and Mayor Linke.
ALSO PRESENT: City Attorney Meyers and Clerk/
Adninistrator Pauley.
Motion/Secc:nd: Hankner/Quick to approve the August 10,
1987 minutes as presented.

Alice Frits, 8072 Long Lake Road, asked for an update
on the airport construction, pipeline and cars for sale
being parked on Long Lake Road.
Mayor Linke replied the pipeline is berg lowered in
front of Irondale High School, as construction is
beginning on Long Lake Road, and he believes they will
be putting in a new pipeline.
Clerk/Administrator Pauley reported on the progress of
the extension of the north/south runway and removal of
the exieting runway. He stated the paved surface is to
be done yet this year. He adeed that activity on the
south end of the airport is due to construction of
Highway 610.
Mrs. Frits complained about an individual who was park-
ing cars with for sale signs along the boulevard on
Long Lake Road, about 3 houses to the south of her.
She stated she understands he has been ticketed by the
Police, but he continues to park vehicles there.
Mayor Linke replied he would cheek with the Police
Department and get back to her.

Mayor Links closed the regular meeting and opened the
first public hearing at 7:06 PM.
Mr. Phil Carlson, representing the developer, reviewed
the procedure they have followed to date. He stated
the final EIS has been prepared and it is now up to
the Council to -determine if it is adequate. He added
he feels everything is adequate with the exception of
one item which is still being addressed by the Feu
Council regarding storm water runoff into the system.
He stated he hopes they could have a final decision
from the Council at the next meeting, as the final
input from the Met Council should be received by then.
Vicki Varkuss, 7749 Woodlawn, asked what would be
better about this office park than ones in Roseville,
Fridley and other cities.
Mr. Carlson stated they have estimated 1,800 jobs will
be involved with the companies who locate there, not
just construction -related jobs, and the development
will provide a tax base and greater employment within
the City. He added Everest Development is committed
to a quality project, and they have faith in it's
success.
Clerk/Administrator Pauley stated the MeL Council has
sent a letter regarding their concern over the loading
into the system, and Staff would recommend this item
be tabled until September 8, 1987 to provide adequate
time to resolve any questions.
Bill Frank, the developer, stated he had spoken with
the Met C•-uncil and they are waiting for information
from Lhe ?CA, and once that i.nfor:r._, is received,
they can have their recommendation out within two days.

Finance Director Brager reviewed the proposed 1967
long term financial plan. He explained it had been
prep -red in compliance with Section 7.05 of the Home
Rule Charter for the City, and is des.anec to provide
a five year plan to meet the service level and capital
improvement needs of the City.

L. 'FinanceDirector Brager stated the plan is available

in the New Brighton Balletin.
There were no questions from anyone present, Mayor
Linke closed the public hearing and reopened the
regular meeting at 7:19 PM.

Clerk/Admi.istrator Pauley reviewed the request of
Willard, and Marvis Haru for a conditional use
permit for an oversized accessory building at their
home at 7545 Pleasant View Drive. He stated the
Planning Commission has recommended approval, with
restictions, and he reviewed those restrictions.
There were no questions from anyone present. Mayor
Linke closed the public hearing and reopened the
regular meeting at 7:21 PM.

-' Clerk/Administrator 9auley reported that Harstad
Company has proposed a preliminary plat for Green-
field Estates, but when Staff reviewed the public
hearing notices that had been sent out, they
discovered an error had been made and approximately
20 homes were not provided with adequate notice, so
he recommended rescheduling the public hearing and
conducting an informational meeting at this time.
Mayor Linke closed the public hearing at 7:22 PM
and rebpened the regular meeting, stating that it
would be an informational meeting on this item.
Jim Senden, of Senden and Associates, representing
the Harstad Company, presented copies of the pre-
liminary plat, and introduced Steve Thatcher, of
Merrill and Associates, and Roger Blomquist, of
Braun Engineering, who would be making the presentation
with him.
Mr. Senden explained Mr. Harstad had purchased the
property in 1969 with the intention of developing
it into a single family home neighborhood, and he
has paid taxes and the sewer and water assessment
on the property, and while plans had been presented
before, they were caught up in the wetland ordinance,
aria building moritorium and were not allowed to build.

Mr. Senden reviewed the plian for 18 single family
home lots, explaining the City has required that
approximately 8 acres of wetlands be deeded to the
City. He stated they are proposing to alter a small
portion of the wetlands, and in exchange would be
constructing three small ponds within the wWand
a --a, which would attract wildlife. He reviewed the
proposed ponding and water drainage as it currently
is, and explained they are proposing to restore the
wetland area to it's previous state by digging 2 feet
deeper than the area is presently, which will increase
the storage capacity for run-off.
Dr. Blomquist explained the methods of classifying
wetlandn, and he stated their staff had gone out and
physically studied and determined the amount of
wetland in the area to be 7.9 acres.
Mr. Thatcher reviewed the contours of the land and
the soil conditions in the area. He stated the
project has been approved by the Ramsey County
Watershed District, Minnesota DNR, and the U S. Army
Corp of Engineering, with some stipulations by the
Corp of Engineering. He also reviewed the storm
water analysis of the site.
Kathy Ayaz, 7751 Bona Road, stated her property abutts (..
the proposed development, and they have a neighborhood
group which is present to voice their concern about
the development, and to ask for a delay in any approval
by the Council.
Sabri Ayaz, 7751 Bona Road, stated he is a professional
civil engineer and asked if there was a disclaimer at
the end of Dr. Blomquist's report.
Dr. Blomquist replied there was no disclaimer.
Mr. Ayaz stated he had asked for information many times
regarding this development and had not been given it. _
He asked if the lateral and vertical movement of the
water been considered both during and after construction.
He stated he feels the people involved in proposing this
project are not experts who are qualified to make
judgements on these issues, as this is a highly
specialized. field.
Mr. Senden replied there has been an extensive amount
of analysis by very qualified engineers, and Braun
Engineering was hired to do specific areas of the project.
He added that Merrill and Associates is also a very
qualified firm.

names to the Council.
Counclimember Hankner suggested checking out the
qualifications of the consultants a^d perhaps looking
into the considtants Mr. Ayaz knows.
K;.y Weseman, 7807 Bona Road, stated she has major
concerns with the development and made a lengthy
statement against development of the property. She
questioned whether the developer had met the require-
ments for altering a wetland, and statea she does not
feel an examination of the land was done at the right
time, and she also stated the City should look into
the question of emin•int domain. She also questioned
whether the study done was of a hundred year storm.
Mr. Thatcher replied it was and he reviewed the data
compiled.
Dr. Blomquist reviewed how the observations were made
and the fact that they were done in July and August
of 1986, for 5 days total.
Jim Sandidge, 7817 Bona Road, stated he would like
the consultants to provide a financial guarantee, an9
asked the Council to consider an irrevocable letter of
credit. He stated he presently has a water problem
any time there is a heavy rain, and he felt this
development would add to his problems.
Mayor Linke stated the development agreement would
cover the concerns expressed.
Mr. Sandidge asked if unusual weathe'_conditions been
taken into consideration in the studies that have been
done this past year.
Mr. Senden explained the data has been compiled over the
pa-z two years, with Braun Engineering doing the testing
last year and the Corp of Engineers doing the tAgting
this year.
Doug Weseman, 7807 Bona Road, stated he would like the
environmental concerns expressed documented by the
developer.
Mr. Senden replied that many of the items that have been
brought up are addressed in the City's ordinances.
Mr. Weseman read ? portion of a statement from the DNR
regarding encroachment of the wetlands and possible
consequences.

Mr. Senden restated that they have propos3P.moving the
wetland somewhat but will not decrease the area at all.
Mr. Thatcher read the letter from the DNR which M

Weseman had referred to. Mr. Senden also read portions
of a letter from the Army Corps of Engineers.
There was a lengthy discussior of the definition of
contours and how it affects this particular area, and
Mayor Linke clarified that the flood plain is by
elevation, whereas the wetland is by vegetation.
Mr. Weseman read a petition signed by residents of the
area opposed to the development of this area, and
presented it to the Council.. A
Mr. Senden stated he felt a good deal of misinformation
was read in the opening statement of the petition
presented by Mr. Weseman.
Andrzej Kulisz, 2367 Pinewood Circle, asked how the
pond proposed for the southeast section would affect his
property and the water table.

Mr. Kulisz stated his trees are presently dying from
lack of water, as the water table has gotten so low,
and he stated that while he is not against this
development, he would like to protect what he has put
his money into.
Clerk/Administrator Pauley stated that with Mr. Kulisz's
permission, he would 'like the City Forester to take a
look at the trees, as the City is having a problem with
oak wilt.
Lindsay Little, 5539 St. Michael, stated he has had a
problem with water on his lot for many years, and he has'
one of the highest houses on his street, and he is

Mr. Senden replied the water ought to flow from Mr.
Little's property down to the pond. Mr. Thatcher added
that the pond would regulate the water table in the area.
Leo onstad, 7730 Bona Road, stated that last year he had
water problems from April 25 through .'ruly, and he has
had problems again this year. He stated he feels they

Charles Mechtel, 5533 St. Michael Street as'Ked'

a high area now, rather than in the middle.
Mr. Senden replied they must trade upland for wetland
area, so have placed the ponds accordingly.
Mr. Mechtel stated he does not want a pond in his
back yard.
Mr. Senden pointed out that water problems presently
being experienced cannot be coming from the proposed
area, as it is nearly 12 feet lower in elevation than
that of the property owners who have stated they have
problems now.
Jeff Williams, 2375 Pinewood Circle, stated he has a
drainage pond is his back yard already and questioned
how this development would affect his property.
Mr. Thatcher reviewed the projections again.
Mike Winkel, 7701 Bona Road, asked how three holding
ponds all showing a depth of 2 feet each would help
with the water problems in the area.
Mr. Sender. replied that between percolation and evapo-
ration, as well as water moving through the area, there
will be enough movement to keep the ponds clean and
(� serve thel- purpose for the development. He added that
with a long dry spell, the ponds would be expected to
dry up.
Mayor Linke explained that City ordinance stated that
no more water can leave a development than currently
does, or at a faster rate.
Reed Krogh, 7827 Bona Road, stated he was concerned
that when Edgewood Road was put through, it would serve
as a dike and stop the ground water from moving.
Dan Boxrud, of Short -Elliott -Hendrickson, explained that
water can go throug:+ sand 100 times faster than it can
through peat, and he felt the proposal was more than
adequate in that respect, and that it would be equal
or better than existing conditions.
Mr. Ayaz stated that that ur. Biomquist's signature does
not appear at the bottom of the study he has presented,
and he questioned what Mr. Senden's qualifications were.
Mr. Senden reviewed his background, and•he also stated
that he resents the professional slurs that have peen
made against both himself and the individuals working
with him.

Councilmember Hankner once again asked the residents
to provide the Council with a list of people they

would like to see the City use to check the
statistics out, as well as their concerns.
Mr. Boxrud stated that in the interest of speed,
he feels the a6veloper would be best to hire Braun

Engineering to do the required testing.
Councilmember Hankner asked the neighborhood residents
to look at the request in a professional, objective
-
manner, and stated it had become an emotional issue.
Mrs. Weseman stated she was concerned with the safety
issue of the ponds, is far as keeping children out
of than.
Mr. Senden explained the slopes will be gentle, and
they would also replant and reseed the areas around
the ponds.
Mrs. Weseman asked who would be responsible for main-
taining the ponds.
Mayor Linke replied that it took approximately 30 years
-
for the ditch in the area to require cleaning, and the
City would be responsible for their maintenance, and
would use funds from the SWM account, which is funded
by developers.
Mrs. Weseman stated she had been told by the City
Engineer, either Steve Rose or Steve Thatcher, that
funds were not available for that and it would have
to be charged back to the residents. She added that
she was asked by the same individual whether she would
be willing to write a letter to the City stating that
she would be willing to pay for it.
Mayor Linke clarified that Steve Rose was not the City
Engineer, and that Steve Thatcher had been the Engineer
at the time in question, and that that was misinformation,
as the City does not ask residents to pay for that them-
selves.
Ali Sabur, 7837 Bona Road, stated he was also.concerned
with the safety of the ponds, and also asked which map
was correct, the aerial map or the map that was being
presented at this th.e.
Mr. Senden explained why the differences in the maps
occurred.
Mayor Linke stated the maps being used by Mr. Senden LJ
are correct and have been verified by both the County
and the Corps of Engineers.

Rodney Melbow, 5601 St. Michael Street, asked what
jwould be done with the oak trees in the area that
is planned to become the pond for the southeast
section.

Mr. Senden replied that area is a mixture of many
trees, and they would be removed.
Phyllis Melbow, 5601 St. Michael Street, asked if
there would be an odor created by the ponds, or. _
additional mosquitos.
Mr. Senden replied the area is being seeded right now
with briquettes for mosquito control. He added that
any stagnant water can create an odor, but they do
not anticipate that problem, as the ponds should be
flushed out naturally.i
Councilmember Blanchard stated that in order to $
expedite the proceedings, she would like to have the
developer, City Staff, Mr. Boxrud and the residents-r
get together and work the queations out more
thoroughly, once the developer has had an opportun!.ty
to get the -.quested information together.
Mayor Links asked that the residents submit any other
questions in writing to Staff that they would like
the developer to cover.
Don Peterson, 2341 Oakwood Drive, asked what a
baffled wehr is. Mr. Thatcher explained what it is
and it's purpose.
Duane McCarty, 8060 Long Lake Road, asked how was the
volume, elevation and rate and direction of flow
of the ground water determined for the area, and
whether it would have a minimal displacement effect.
He also asked where the ground water monitoring wells
were placed, and stated he would like to see the
developer use the checklist that was put together
many years ago for developments of this type.
Mr. Senden replied hi had been told by the City that
the checklist was not required, and other developers
have not been required to use it in the past. He
added that he would be willing to use it, but he
believes everything is covered by ordinance that is
contained in the checklist.
Mr. Thatcher stated the ground water is not required
to be determined, but the direction of flow is, and
they installed 27 monitoring wells for that purpose.

Mayor Linke closed the regular meeting and opened the
next public hearing at 10:13 PM.
Clerk/Administrator Pauley reported Mr. Povlitzki
has provided both an exterior plan and interior
floor plan. He stated that electrical, plumbing,
building, fire and health inspections have been done,
and while not all the reports are back, they must
make sure Mr. Povlitzki is aware of what work is
necessary to bring the building up to node. He
added that Mr. Povlitzki has provided the certificate
of insurance and the bond that is required by the
State Insurance Commissioner, and the Police Depart-
ment hac providcd a report, as is required by Code.
Mr. Povlitzki stated he had met with the various
inspectors earlier in the day and is award of the
work that has to be done.
Councilmember Hankner reviewed some of the informa'.:ion
listed in the Police report.
Mr. Povlitzki stated that Bob Waste will be coming
into the business with him as a partner, and he will
be coming in soon to make the application.
Mr. Povlitzki reviewed the plans he presented to the
Council, showing where he plans 4 to 6 foot high berming
and where the parking will be.
Mayor Linke asked whether the berming or plantings
could be continued along County Road 112 to control the
cars that try to drive out across there.
Councilmember Wuori stated she was concerned with the
street opening onto County Road H2, since it is so
close to Greenfield Avenue and could present problems,
and she asked whether'it could be more centrally located
along County Road H2.
Mr. Povlitzki replied the road is quit. a bit higher
than the parking lot, and the cars would have to come
out very fast to be able to make it. He also pointed
out that it would be expensive to move the opening,
acid Donatelle's is allowed to have their entire parking
lot open into CouuLy Road H2.

Councilmember Hankner asked how much seating is planned
nfor the dining area, as well as in the bar.
Mr. Povlitzki replied there would be 25 to 30 tables for
4 in the dining room, and he is not sure how much seating
is available in the bar compared to the dining room. He
added the original fire capacity was listed as 887 people,
and he plans for the new design to provide for 250 to
300 people.
Councilmember Hankner stetdd she was hesitant to take
any action yet, until all the reports are in.
Mr. Povlitzki stated he would appreciate no longer delay
than necessary. He added he will be meeting the require-
ments given him by all the inspectors.
Clerk/Administrator Pauley stated the Council could
issue a license contingent upon having a certificate
of occupancy issued.
Mr. Povlitzki stated they would be. having a full menu
for the dining room, to include steak, chicken, shrimp
and ribs.
Mayor Links explained a full. menu is required before
the City will issue a liquor license.
Bill Buckingham, :220 Greenfield, criticized the Council
for how they have handled this matter. He stated he
did not get a notice of the scheduledbonntheaftng agendantil two

and did not start until 10:15 PM. He also stated there
should be adequate seating and speakers in the hallway
so everyone can hear.
Mayor Linke explained the public hearings are scheduled
for a specific time to start but the Council will not cut
people off, and they cannot predict how long each hearing
n'ill last. He added that the Council chamber has
adequate seating for most discussions, and they have looked
into purchasing speakers, but it would be very expensive.
Councilmember Hankner added the timing of the hearings is
very difficult, as it is hard to judge how many people
will be coming on an issue.
Mr. Buckingham asked what Mr. Povlitzki's prior businesses
in Mounds View were, and wht her there were any Police
calls on those businesses.
Mr. Povlitzki stated he has been involved in Loose Ends
and the Anchor Inn, and that the Police were called at
various times.

Mayor Linke read portions of the Police report
regarding the types of calls they have had over the

past 'three years on Mr. Povlitzki's businesses.

Clerk/Administrator Parley explained it is the policy
of the Police Department that they want calls from
tte liquor establishments, before a situation has a
chance to become a real. problem.
Mr. Buckingham asked if it was possible to have trees
planted along Greenfield Avenue.
Mr. Povlitzki replied that area would be used for
parking, if necessary, so he would not be planting

trees there.
Ron Donsetts, 2449 Clearview, asked if there would be
any change in noise levels, as he has been able to
hear the music in his bedroom for the last two operations
that were in there.
Mr. Povlitzki replied he will not be running that type

of entertainment, and will not be having hard rock.
He added he will maintain the property as necessary, as

far as mowing, picking up litter, and so forth.
Bill Zwieg, 5309 Greenfield, stated he is concerned with
people walking out across the berm and into the residents
yards, and he would like to see a fence.
Mayor Linke replied a berm is more esthetically pleasing,
and Mr. Povlitzki has stated he would like to have a

Mr. Donsetts stated he has walked past the property many
times and found people out in back drinking and using

drugs, and sweating and so forth, and he would like to
see a fence, as well as improved lighting.
Robert Weinert, 2426 Clearview, stated he has lived in
his home for 10 years and has had many problems with
the establishments in that building. He stated he does
not feel the City has enough information to grant a
liquor 'license now, and he would like the Council to
investigate this further. He added the applicant should
be required to meet all the code requirements and
inspections.
Counciimember Hankner stated the City will also have to
check into the background of the partner Mr. Povlitzki
is proposing. She asked Attorney Meyers if any cdnditions
could be put on the liquor license, such as hours of
operation of the restaurant, and so forth.

Councilmember Hankner stated the residents :an

of holding public hearings fur liquor license renewals
in order to hear any concerns the citizens have.
Ron Michna, 5287 Edgewood Drive, stated Mr. Pc✓iitzki
had owned the property at one time and sold it to
Mr. Conroy, and he now has it back and has brought in
Mr. Waste to mahage it. He stated he would like the
problems nipped in the bud now. IIe pointed out the
City has spent thousands of dollars on the pipeline
issue because two people lost their lives, and he asked
if the City would do the same if two people were killed
in a car accident because of a drunk driver.from this
establishment. Mr. Michna stated Mr. Povlitzki has
not tried to do anything different than a liquor
operation. He also stated he has a problem with the
way the Police Department handles the situation, in
that they observe what is going on but will not do
anything unless a ditizen is willing to sign a complaint.
Sharon Kh '•,, 5241 Greenfield, asked what would be
placed along Greenfield to prevent cars from driving
over the boulevard, and she asked if a left curn only
onto Greenfield could be possible.
Mr. Povlitzki stated there are car stops along the
boulevard now that stop the cars from driving out.
Jeff Moe, 5284 Greenfield, stated he is the m=nager of
the a-artment complex and has been for the past five
years, and they have had problems with the patrons of
the bar parking in the apartment complex lot.
Mr. Povlitzki replied tha apartment residents also park
in his parking let.
Paul Fedor, 2288 Knoll Drive, stated he feels the
residents are trying to crucify Mr. Povlitzki ahead of
time, before he has even had z chance to turn the key
in the door. He added he feels the residents and Council
owe Mr. Povlitzki a chance.
David Carlstrom, 5297 Edgewood Drive, stated Mr. Povlitzki
had been in there for three years and there had been
almost as many problems w`_h his operation as with
Muldoon's, and the same problems cccurred with Mr. Povlitzki
then. He added he would be willing to sign complaints, and
he pointed out in the past some neighbors have been afraid
of signing complaints because of fear of reprisals. He
stated he is against issuance of the liquor license.

during the public hearing and they need to give he and
Mr. Povlitzki an opportunity to prove themselves. He
stated there are laws to be followed, and they will
do so.

Larson, who lives on Long Lake Road and works for
Kraus -Anderson, has recently had a great, deal of
fill put in his yard, which is in a wetland buffer
zone, and he has an opportunity for more dirt and would
like a quick decision from the Council if he can go
ahead.

Pursuant to your direction and authorization I have
requested that the following Individuals aot as temporary
public works foremen in their areas of expertise to assist
the City during the time we are without a full time Public
Works Foreman and Public Works Director.

Tim Pittman - Parks
I have also offered these individuals an increase in their
wages of $1.00 per hour during the time they are acting in
these positions and all have agreed to accept my request.
In case you are wondering why the word foreman is being used
rather than lineman, I used this term on the advice �f Cy
Smythe, our labor consultant, for purposes of clarification
as it relates to our labor contract.
I would also propose that during this interim period Gary
Kardell, Streets, and Dick Schmidlin, Garage be compensated
at the Maintenance III wage, an additional $.50/hour for the
additional duties aad responsibilities they will be taking
on in their areas.
Staff would request formal authorization of the $1.00 per
hour increase in wages for these three gentlemen -retroactive
to August 27, 1987.

I met with the members of the Pudic Works Department and
the architect for the Public Works garage addition on the
morning of August 28th to discuss the deduct items approved
by the City Council for this project to ensure that the crew
felt that they could perform this work within the schedule
for the construction of the building. The only item
previously approved by the Council as a deduct item as a
result of Steve Rose's August 24, 1987 memo, copy attached,
which the crew felt they would be unable to perform was
Alternative A3 which called for the painting of the interior
walls of the break room and two offices as well as the
exterior concrete block. This determination was made an the
basis that we do not have the equipment to perform this type
of work, nor would time be readily available to us during
the spring of 1988 to do the work when the weather would be
most appropriate due to our usually busy schedule preparing
the City's parks for recreational act4vities as well as
other duties that normally occur during the spring.
Staff would request that Council act to reconsider your
action of August 24th and authorize that Alternative A3 be
included in the contract with Cottonwood Construction. Your
direction on this matter would be appreciated.

We are pleased to tell you that we received 8 bids for the above
named project on Friday, August 21, 1987 at 1:00 p.m. 1 have
discussed bids in general with Mr. Pauley and it was mutually
agreed to proceed with a memo of recommendation for your meeting
tonight. Due to the length of the project and forseeable fall
weather, a savings of two week:, is advisable. Attached for ,your
review are the 8 bids received including the deduct alternates
and unit prices.
The lou bidder, both base bid and omitted alternates, is
Cottonwood Construction. Therefure, the bid could rouge between
$290,230 end $229,670. 1 have reviewed the pricing of the deduct
alternates and •could recommend the following be considered:
Alternate A3 - Painting. The deduct price is $4,66U.00. If
done by our Staff the savings expected would be 42,000.00

JJ"" Alternate A4 - "neulatlon and Gypsum Board. The deduct
f price is $5,940.00. TIM savings by this work less material

Altercate A6 - Suspended Acoustical Ceiling. The deduct is

$400.00.
Alternate A7 - Carpet. The deduct price is $840.UO. A

Alternate M1 - Sewer Connection. The deduct p*ice is
%,500. 00. The savings is expected to be $3,500.00.
The contract price recommended without Alternates A3 through A7
and M1 is $270,765.00. The deducts add up to $19,465.00. Less
the materials cost of $8,465.00, the savings to the City would be
$11,000.U0.
Two other alternates could be consider..; for deduct if the need
to cut costs is necessary. All and M2 would be a total cost cut
of $23,100.00. AB is reroofing the existing maintenance building
while M2 is fire sprinkling the existing buildirg. Due to the

$4,600.00 for sprinkling the existing building, Staff would
recommend that they both be included.

I feel that the recommended deducts of A3 through A7 and M1 in
work that the present Public Works crew can undertake and
complete.yet this year. It is, in all cases, work that we cau
put our personal talents into as well as be oroud of the work
being done. The savings of $11,000.00 could then be used on new
furnishings for the break :oom.
The owner of Cottonwond Construction has been in business for 17
years of which the first 14 years were in masonry
subcontracting. The last 3 years have been in general
subcontracting with his son running the masonry subcontracting y`
business. They are presently finishing park shelter building
work with Brooklyn Park and are highly recommended by the Parke
Department. They are also currently doing business with
Superamerica and the City of Maple Grove.
Staff Recommendation:
Authorize Staff to complete a construction contract with
Cottonwood Construction in the amount of $ 70,765.00 ;leas
Alternates A3 through A7, H1 and Unit Prices 7 and 2). Further,
that upon completion of the contract, authorize the ffayor and

construction bond has been submitted.

As you may recall, I indicated after the Management Skills
Analysis had been performed on Steve Rose, that it would be
my desire that such a program be conducted on myself as well
in the near future. I was recently contacted by Don
Salverda, who is a Ramsey County Commissioner and operates a
management consultant firm in Roseville, regarding such a
program he Drovides which, besides conducting a survey of
superiors, peers and subordinates as well as the individual
themselves, also provides specific recommendations for
improving the individual's management effectiveness and a
lenothy program encompassing approxiately nine months of
monthly meetings with a number of professional colleagues
from the metropolitan area who are also participating in "-he
program to develop a peer support group that would assist an
individual in addressing their weaknesses and undertaking
efforts to correct them.
My main interest in this program ie as a result of the
emphasis on establishment of a peer support group to assist
the individual. in addressing their management skills
weaknesses. Also, this program, which is far more extensive
than that conducted by Personnel Decisions, Inc. on Steve
Rose, is at a cost of $600.00 or approximately $200.00 less
than the expense for Steve Rose's program which only
included testing and three meetings between the consultant,
Steve Rose and myself. It would appear that this program
provides a significant amount of service and assistance to
the individual to address their management skills needs and
1 would request that you authorize that I participate in
this program which commences on September 30th of this

This program is uncomplicated, but it is educationally
sophisticated and very practical. It employs numerous
principles of learning and motivation that have proved to be
eriactive in actually changing managerial practices, in
contrast to merely communicating ideas. Most importantly,
the program increases the likelihood that participating
managers will profit from their on-ihe-job experience. It is
not a substitute for seminars and other formal programs of
Cavelopment, but nei!her are those programs a substitute
for supervisor -subordinate relationships that result in growth
and increased motivation to be effective. Only organizations

The Development Needs Inventory / Effective Management
Program is a process designed for managers to identify
Individual management training and development needs.
This is how it works:
Participating managers think about those who know their
management behaviors well. They choose two or more
superiors who are acquainted with their day to day activities,
two or more peers with whom they work regularly, and all
subordinates who report !o them directly. This group of ten to
fifteen persons completes a questionnaire which asks them to
describe a,participg ng manager's maragement functions.
Each participating manager completes the saute questionnaire
on him/herself. In absolute confidentiality, the questionnaires
are computer processed and analyzed.
The analysis became a printout which compares a participating
manager's selftkscription with the cumulative descriptions of
superiors, peen. -nd subordinates, r;.spectively, in a group
setting, the printouts are Interpreted, analyzed, and
parttcipatln� managers gain an indepth, objective view of how
those with whon s/he works perceive their management
behavior.
Individual management strengths surface, overextended
strengths become, visible, and patterns of management style
crystallize. The participating manager can clearly Isolate areas
which, when Improved, lead to more effective, productive
management results. Goal plans define action steps, realistic,
comfortable deadlines are set, and rewards are specified.
DNI/EMP offers a unique feature — a built-in coachin /
counseling strategy_. This enhances an mthe-job approach
by involving a participating manager's superior to provide
feedback and support as needed to realize development
and growth goals. Requiring only moments per day, this
method invites high. motivational levels from participating
managers which directly effect bottom line productivity -

analysis
Methodology_ The Development Needs Inventory consists
of 136 statements that describe managerial behavior. A
manager reaoa each statement and indicates on a 1 to 5
scale (5 is the highest possible score) how well that
statement describes himself or herself. Where possible, the
manager is also described, using the same inventory, by
supervisors, peers and subordinates. These data are
computer scored and the manager receives feedback on
17 performance categories. Summary and comparative
data are available to organizations.
Scores Three difference scores on each category —
difference between the descriptions given by one's self and
others — provide a powerful Incentive for a manager to
either change a managerial behavior, change how he or
(l she is perceived by others, or to congrat�, flate himlt -rself
on being in i .cceptional touch with the real world (where
the manager sees self as seen by others). A manager may
not agree with the descriptions others give, but the fact
that others perceive him/her that way is indisputable.
Furthermore, perceptions others have of a manager are
critical contributors to both that manager's effectiveness
and his or her career success. Most managers recognize
th.:i fact.
Validity_ A. The DNI Is not a performance evaluation Instrument.
Although certaln behaviors are obviously better than others, the
person completing the DNI Is asked only to describe. Describing is
a less threatening activity than e•ratuating -- less likely to produce
defensiveness and positively faked responses. A manager can, of
course, be excessively generous in describing him4mrself, but there
Is a strong Incentive for honesty since such a blas Increases the
difference scores (Iran superiors, peers and subordnales) and
makes the manager who fakes positively appear to be Imperceptive.
B. The DNI focuses exclusively on descriptions of
behavior, unlike personality and altitude Inventories. Since
behaVor rather than the varied motives that produce behavior,
determines managerial effectiveness, a clear relalfonship exists
beWeen scores on this Inventory and the behavior c ranges a
manager may make to be more effective.

Jest a short note to ony thank you for presenting the Development . A
Needs Inventory/Effective Management Program at UMC. As you -
know, most folks in an academic setting are quite skeptical and
questioning of most activities. Their reaction to participation
in this program started in that vein and yet they soon realized
the importance of receiving feedback as a manager from their
supervisor, colleagues, and individuals they supervise. The 1 4 1 .
structured program clearly identified areas for each as to
improve upon as managers. We also held weekly discussions for
nearly half a year to better understand various management "fir
techniques. Everyone is much more goal oriented, as well as
sensitive to procedures to follow in terms of implementing their
administrative responsibilities as a result of the programs. s
I would add that the UMC staff had completed the DISC inventory
personality profile a few years ago. The two programs complement
one another. One identifies your leadership style and the other

provides insight as to perceptions of your performance as e
manager. I will recommend this program to others in education.

The League of Minnesota Cities is celebrating its 751h Anniversary
this year. As a part of the celebration, the League is encouraging
cities to participate in 'Cities Week.' The purpose of Cities Week
is to recognize cities, and help citizens understand the role of
cities. We'll ask Governor Perpich to proclaim May I through May
7, 1988 as Cities Week.
Enclosed is a packet of information on some suggested cv>nls for
your review. You can choose to participate in one, some, or all
of the activities. We hope that all cities will release balloons is
(heir cities on Wednesday, May 4, 1988 at I p.m.
Cities Week will be a successful celebration if each community has
a Cities Week committee and contact person. Some city officials
have already volunteered to serve in that role. The designated
contact person will be the liaison with the Cities Week
Subcommittee of the 75th Anniversary Committee. The Cities Week

of Mounds view and Blaine. You will note on the Highway

Department Regulations under Section 5-910.2, A, that the
cost of maintenance shall be negotiated with the municipal-
ities having jurisdiction of the intersecting roadway.
Since the intersecting roadway is a county road under the

jurisdiction of Ramsey County and Anoka County, it would
seem appropriate that those counties also share in the cost
of the maintenance and operation of the signal lights and
streetlights. I have discussed this matter with Richard
Johnson, City Manager for the City of Blaine and he has

agred with this position. Therefore, Staff would recommend

that a letter be Sent to the Minnesota Department of
Transportation advising them that we will accept responsi-
bility for only 25% of the cost of these items with the
other 759 being split equally between the City of Blaine and
Ramsey and Anoka Counties. Your direction on this matter
would be appreciated.

These signal systems will be funded 76.74 percent with Federal Aid Primary - -
Funds from the federal government. The remaining 23.26 percent is proposed

of Blaine, 2.9075 percent City of Hounds View. 2.9075 percent Anoka

the power costs to operate the signal and street light systems. It is also
proposed that the City of Mounds View reimburse the Cip, of Blaine 50 per-

The purpose of this regulation is to prescribe tilt. policies of

SUAJECT: MAN HOLE EXTENSION AT 2741 ARDAN AVENC�
As you recall, the residents at 2741 Ardan Avenue recently
appeared before you at an agenda session regarding the
replacement of a 6 foot high concrete pipe over the manhole
in their rear yard. At that time, these residents
questioned the purpose for which this pipe was placed there
and the serviceability of the pipe.
Attached please find a memo from the City's consulting
engineer, Dan Boxrud, responding to my request that he
review the matter after a field inspection with Public Works
Foreman Rose and myself. Dan makes the comment that the
previous structure adequately restrained the Lack -up of
storm water and this statement will be refuted by the
residents, however, it should be pointed out that the reason
the pine did not hold back water was that the concrete frame
on which it was placed had been broken out by the residents
in order to allow the water, to redrain into the catch basin
after the major storm water flow had subsided within the
underground pipe rystem.
The proposal -at this time is to place a 4 foot manhole
section over the existing catch basin with a small :sole in
the bottom having a modified "check valve" over it to
restrict the flow of the water into the yards through this
hole. It will essentially allow for the water to back up
into the pipe closing the check valve during its upward flow
and prevent water from getting into the yards in this area.
Once the water has subsided the check valve will open and
any water collecting in the yards durinq the storm will be
able to drain into the pipe. Mr. Boxrud indicates, based on
this concept, that he feels the proposed pipe extension will
function as intended. Staff would request direction in this
matter.

This memorandum is in response to our meeking in Lhe rear yards
of the homes on the north side of Arden Avenue west of Red Oak
Orive. The topic you, Steve Rose, and I reviewed war, that of
reinstallation of a manhole section on the storm sewer manhole
which previously had,6' high manhole section on it stove grade.
The purpuse of the manhole section was to restrain the back flow
of, stow. watav from spilling into the backy&rd areas and
potentially flooding homes. The structure had been removed for
various reasons and a new structure is no -a being proposed for (�,
reinstallation. w.�
It is my understanding that the previous structure adequately
restrained the backed up storm water from flooding the backyards
while the small hole in the bottom of the structure allowed the
backyards to drain down after the storm. With this
understanding, I have no problem with reinstalling a structure on
this manhole.
I understand the proposal to be to install a 4' manhole cone on
the existing short manhole section. The existing small hole in
the bottom section will continue to be used for slowly draining
down the area after a storm. The proposal to put a flap gate on
the inside of the manhole over the small hole to `.urther restrict
backflow into the yards as the water heads up in the manhole
seems to be reasonable. This "check valve" concept has been used
elsewhere with some success, most notably in a backyard along
Woodcrest Drive. It will be necessary to monitor the
installation to make cure that sticks and other debris do not
plug the small hole or restrict the operation of the flap gate.

SUBJECT: FINANCING OF PUBLIC WORKS GARAGE ADDITION
Now that bids have been received for the Public Works Garage
Addition a review of the financing previously agreed upon is
in order. Alloction of costs is based upon total estimated
project costs of 5292,000.
1) Closing the Public Improvement Fund and using the
proceeds of $181,190. A proposed ordinance to
close the Fund has been submitted for your consi-
deration.
2) Closing the Water Bond Fund and using the proceeds 1`
of $26,001. The Water Bond Fund is a debt service aj
fund whose bonds have previously been paid in fuli.
The funds remaining in the Fund may be used for any
public purpose. Some of these funds were previously
used for a debt study by Voto, Tautges, Redpath aad
Company, Ltd. which ultimately led to the cash
defeasance of five of our outstanding bond issues.
The fund may be closed by resolution and its monies
transferred to finance the garage addition.
3) The V7aeer and Sewer Funds could each contribute
$41,905 to finance the remaining monies needed for
Garage Addition. The rationale for this is that
equipment and vehicles used in Water and Sewer
operations will be stored in the Garage Addition.
After the Public Improvement Fund is closed by Ordinance
No. 427 several other resolutions should be considered to
complete this financing plan. These are:

1) Resolution 2229 establishes a Gc-age Addition Fund
to account for costs of the construction of the
addition. F
2) Resolution 2230 closes the Water Bond Fund and
transfers all assets of the Fund to the City's
General Fund.
3) Resolution 2231 transfers from the General Fund to
the Garage Addition Fund money equivalent to the
fund balances of both the Public Improvement Fund
and the Water Bond Fund. Since the fund balance of
each fund consisted of cash plus special assessments
receivable, the General Fund is, in effect, buying

those receivables by transferring cash equivalent to
the fund balance of those funds. This is the reason
for transferring assets of the Public Improvement
and Water Bond Funds to the General Fund and then
transferring cash to the Garage Addition Fund.

WHEREAS, the Water Bond Fund was astablished to account
for the collection of taxes and special assessments levied in
connection with the issuance of Water Improvement Bonds of 1960
and to account for the debt service on daid bonds; and
WHEREAS, the final payment of principle and interest on said
bonds was made in 1982;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Mounds View that its obligation to holders of Water
Improvement Bonds of 1960 has been satisfied as a result of
making all payments of principle and interest pursuant to the
bond indenture;
BE IT FURTHER RESOLVED, by the City Council of the City of
Mounds View that the Finance Director is hereby directed to close
the Water bond Fund and to transfer all ass9ts of the Fund to the
City's General Fund.

Mayor Links explained the boulevard is County property.
He added the City has pointed out the problems when
they were in court before.
Attorney Meyers explained Williams is continuously
taking cathatic protection readings and sometimes have
removed secti,dns of the pipeline and sent them out to
Neighborville, IL for testing. He added the pipeline
will also be lowered fc- the County Road I recon-
struction. He further explained there is a court
order that Williams is to keep the City informed on
what they are doing, and their lack of doing so may
come back to haunt them some day.
Bill Frits, 8072 Long Lake Road, asked who ascertains
that the welds being made are safe.
Attorney Meyers replied the office of Pipeline Safety
is responsible, but he does not feel it has been done
properly, and the work has been dovered up at times

without calling :.,or an inspection. He added the City
is still in court regarding the issue of safety of the
pipeline, and they should be back in court sometime
after November, and this issue of removal and recover-
ing of the line will be addressed then. He stated the
City has a court order prohibiting it from interfe.rring
with the work being done on the line.
Steve Legell, no address given, stated he is a;:new
resident to Mounds View and would like to build a
garage that is larger than code permits and asked what
procedure must be followed.

Mayor Links advised him to come into City Hall curing
regular business hours, at which time someone on Staff
will outline for him the procedure to be followed. He
stated it takes approximately 30 days for the process,
and he must go before the Planning Commission with his
variance request.

Al Mayor Links reported he had attend6d the Mounds View Mayor Links
Community Theater production of "blame" and found it
to be an excellent production.
Mayor Links reported the Ramsey County Youth
Corrections Dgpartment has cut funding from their
proposed budget for 198s for the North Suburban Youth
Service Bureau, which is an organization that handles
troubled youth in the community, as well as assists
other youth. He stated he feels this is a very worth-
while program and he would like the residents to send
letters and make phone calls to Ramsey County Commissioner
Duane McCarty, voicing their support for the program.
Chief Ramacher reported they have sent a number of
offenders to the Youth Service Bureau, and he feels it
is a very worthwhile program, and he would hate to
lose it.
Counci.lmember Hankner pointed out that while the
Corrections Bureau has removed funding from their
budget, the Ramsey County Commissioners must approve
the budget and could put it back in.
