The Mounds View City Council was called to order 1. Call to Order
by Mayor Linke at 7:00 PM on Monday, May 11, 1987.
The Pledge of Allegiance was said. 2. Pledge of

MEMBERS PRESENT: Councilmembers Quick, Blanchard,
Wuori and Mayor Linke.
It was noted Councilmember flankner was absent.
ALSO PRESENT: City Attorney Meyers and Clerk/
Administrator Pauley.

Clerk/Administrator Pauley reviewed the items on 6. Approval of
the proposed consent agenda. fie also reported he had Consent Agenda
received a call from JLN, stating that the draft EIS
is not complete, and they anticipate it will be
available for the May 26, 1987 meeting.
Mayor Linke asked that the address on Item A be
corrected to read 2800 T.H. 10.
Councilmember Quick asked that Item D be removed
from the consent agenda.

Mayor Linke closed the regular meeting and opened the 7. Public Hearing:
public hearing at 7:05 PM. Location of
Portable
Park and Recreation Director Saarion presented handouts Classroom
to the Council and reviewed both the advantages and Building in a
disadvantages of locating the portable classroom to City Park
the different park sites in the City. She explained
the Council has accepted an offer to purchase the
building for $1 from the school district, and the
purpose of the public hearing this evening is to decide
on which park to locate the facility at. She stated
the Park and Rec Commission recommends it be placed at
Random Park.
Director Saarion reviewed criteria the Council should
use in making their decision, to consider the design
and use of the park, consider the recreational use
proposed for the facility to see if it matches the
park, consider the overall scheme of the City park
system and consider the philosophy of park development
in the City.
After reviewing the advantages and disadvantages of
the various City parks, and the present facilities
at each, Director Saarion stated she would recommend
the building be placed at Random Park.
Tom Foster, 2516 Ridge Lane, stated he had not received any
notice on the previous hearing by the Parks and Recreation Commission.
He stated he feels Random Park is passive and he feels it is too
small to add a parking lot and building. fie added that it lacks
both water and a toilet facility, and he does not want to see a
satellite placed there, and vadalism is not a problem there 1-ecause
there is nothing there to vandalise. Mr. Foster stated he feels
a high intensity park .is a disadvantage to young children playing,
and he also recommended putting the building where vandalism is
going on, to give the people of that area something to be
proud of.
Charles Crooke, 5231 Stevens Drive, stated he agrees with
Mr. Foster's comments. He added that they had originally
asked for a fence around the park and got a berm instead,
and he does not want the building placed there.

Councilmember Quick noted the Council had received a
rgreat deal of information tonight, and he would like
to hold over any action until the next meeting, giving
the Council an opportunity to research and discuss this
at the next agenda session.
Mayor Linke noted the building must be moved on May 12.
Councilmember Quick suggested moving the building to a
central location and then moving it to the permanent
location once it has been agreed upon.
Councilmember Blanchard stated she does not appreciate
having everything brought to the Council at the last
minute, and the information should have been included
in the Council packet last week. She added they only
heard comments from citizens against locating the
building at Random Park, and she is not sure that that
is the place to put it.
Councilmember Wuori stated she agreed with Councilmember
Blanchard, and she needs time to consider the various
options.
Mayor Linke stated he is opposed to Random Park, for
reasons he has stated before, and he would prefer
Woodcrest Park, as a parking lot is already in, or City
Hall by the well house, which does not have a parking
lot there, but one could be installed.
Mr. Foster asked if any of the organizations mentioned
that would be using it had actually stated they would
like to use it.
Councilmember Quick replied there is a problem right
now with scheduling with the school district, and the
City gets bounced out very frequently.
Mayor Link, stated there is a definite need for this
building, and the problem is in deciding where to locate
it.
Richard Eimer, 5225 Skiba Drive, stated he works for the Columbia
Heights School District and, like the District, the City does not
maintain equipment or property, once they install it.
Mike Berry, 5237 Skiba Drive, stated he lives by Random
Park and he does not want any more people in the park.
Mayor Linke pointed out the area was always a park, and
home owners knew that when they moved to the area. lie
added a park is for the use of the people of the
community.
Mayor Linke closed the public hearing and reopened the
regular meeting at 7:50 PM.

Motion/Second: Linke/Blanchard to have the portable
building moved to the well house location on the north
side of City Hall, with a final decision to be made in
two weeks, on May 26, 1987.

Clerk/Administrator Pauley reviewed'the request for
a minor subdivision from Ted and Pamela Lautzenheiser,
8121 Long Lake Road, and the request of Marvin Kelly,
2521 Sherwood Road, for a minor subdivision in connec-
tion with the Lautzenheiser's subdivision. Re explained
the importance of approving both requests at the same
time, to insure the City does not create a land -locked
lot. Ile added the Planning Commission has reviewed
the requests and recommends approval.
Motion/Second: Quick/Wuori to approve Resolution
No. 2197, approving the minor subdivision of Ted and
Pamela Lautzenheiser, 8121 Long Lake Road, and Marvin
Kelly, 2521 Sherwood Road.

Clerk/Administrator Pauley reported Staff is
working with the property owners along County Road I.
He stated that if a property owner should refuse to
provide the City with the needed right-of-way, it
could place the City in a difficult position due to
time constraints, and he asked the Council to authorize
the City Attorney to file for condemnation, if necessary.
Motion/Second: Quick/Blanchard to authorize the City
Attorney to file for condemnation of the needed
right-of-way for the reconstruction of County Road I,
should the City be unsuccessful in negotiating
acquisition of said right-of-way prior to June 1, 1987.

Attorney Meyers advised that condemnation proceedings
would require the hiring of an appraiser. The Council
clarified that that would be within the authority of
the motion they had just passed.
Attorney Meyers reported that at the time of the
explosion last year, the City came into possession
of the pipeline, and Williams Pipeline Company
would like to have it moved to Naperville,
Illinois, for further research. Williams Pipeline
has brought forth a motion, which will be heard on
June 5 by Judge Diana Murphy regarding the moving
of the pipe, and the City will have a counter -

motion against the moving of the pipe. He added he
has notified the Court the City is ready to proceed
on the other issues.
Councilmember Quick asked that the Council be given
information for the next agenda session on the
advantages and disadvantages of placing the portable
building at Hillview Park, as that had not been
covered earlier in the evening.
Councilmember Blanchard had no report.
Councilmember Wuori had no report-.
Mayor Linke stated there had been problems over the
weekend with flower vendors who had set up along
Highway 10, and he asked Staff to check into it to
avoid future problems with vendors, specifically
flower and painting vendors.
Attorney Meyers stated the City could possibly require
a public hearing before a permit is issued, and he will
check further into the ordinance.

(^ Clerk/Administrator Pauley updated the Council on the
status of the pipeline safety act and the voting on 12. Report of
the bill. He added that NTSB has given the impression Clerk/
they might be revising their report to reflect new Administrator
information provided to them by the City. Ile also reported
four sections of pipeline are being exposed in the City now,
and if no problems are found, they will rewrap the pipe and
rebury it. Then, another close -interval survey will be performed.
Clerk/Administrator Pauley reported commercial fire
inspections have begun, and notices have been filed
against all the businesses that have been inspected.
He added they are negotiating with the Fire Department
to do the multi -family inspections for the summer,
until the new building inspector is up to speed.
Clerk/Administrator Pauley reported a notice had been
issued to Mid -America Auto 30 days ago to bring their operation
into compliance with the City Codes and their Conditional Ilse
Permit and they have not responded as yet, and another notice
will go out now to remind them they have 30 days left to do the
work.

Clerk/Administrator Pauley reported the City of New /—
Brighton had problems keeping up with water demand
over the weekend, and hooked into Mounds View's
system and used approximately 5 million gallons. He
added that Mounds View did not have problems keeping
up, and well $1 should be back in operation by next
weekend.
Clark/Administrator Pauley reported'he had received
a phone call from Dave Shupe, 2186 Lambert, who
would like to have a live band play in his yard for
a wedding reception later in the summer, from 4 to
8 PM, and wanting to know if it was alright.
It was the concensus of. the Council that unless a
nuisance occurs, it was alright, and they do
appreciate him contacting the City in advance.
Clerk/Administrator Pauley reported the reconstruction
of Long Lake Road has been on the county's list of
improvements for a long time, and it is now scheduled
as a priority B for 1988-89, and they would like
Williams Pipeline to replace the pipe before
construction begins.
Clerk/Administrator Pauley reviewed the memo from
Public Works Foreman Rose regarding necessary repair (�
work to the air conditioning system at City Hall, l
and reviewed the two bids received to do the work.
Motion/Second: Linke/Quick to approve the proposal
from Schwab-Vollhaber, Inc. to make the necessary
repairs to the air conditioning system, at a cost
not to exceed $2,950.00, with the funds to come
from the City Hall repair account.

Mayor Linke asked that they also look at the heating
system and overall capacity of the air conditioning
system, as no many problems have been experienced.
Clerk/Administrator Pauley reported he had received
an application from Super America too late for place-
ment on the consent agenda, but they would like
approval of a license for gas sales and non -intoxi-
cating off -sale liquor. Ile added they have supplied
all the necessary information and bonds.

CITY OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION ESTABLISHING SEATBELT POLICY FOR EMPLOYEES WHILE
ON CITY BUSINESS
WHEREAS, Minnesota Statutes 169.686 requires the driver of a
passenger vehicle and a passenger riding in the front seat of a
passenger vehicle to wear a properly adjusted and fastened seat -
belt while said vehicle is in operation; and
WHEREAS, the adoption of this policy was based on the deter-
mination that it is compatible with support for Federal Safety
Standards requiring automatic crash protection; and
WHEREAS, it is the desire of the City Council of the City of
Mounds View to abide by all requirements of State Law, particu-
larly, those determined to be in the best interest of the
residents and employees of the City of Mounds View; and
WHEREAS, the requirement of the use of seatbelts by all City
employees while operating motor vehicles when on City business is
determined to be in the best interests of the health, safety and
welfare of City employees.
NOW, THEREFORE, HE IT RESOLVED that the City Council of the
City of Mounds View requires that all Mounds View municipal
employees be required to wear properly adjusted and fastened
seatbelts while operating motor vehicles when on City business.
BE IT FURTHER RESOLVED, that the Clerk -Administrator is
authorized to undertake and/or recommend, appropriate disci-
plinary action when an employee has been determined to be in
violation of this reijuirement.

Please consider the approval of hiring Dan Otterson as a temporary
park maintenance worker. Dan has worked for the City during the
summer for the past two years. Money has been budgeted for two
temporary summer park maintenance workers in the park fund under
temporary employees.

RESOLUTION APPROVING PRELIMINARY PLAT FOR DAILEY KNOLLS
ADDITION
WHEREAS, Dailey Homes Incorporated has submitted a
preliminary plat for Dailey Knolls; and
WHEREAS, said plat has been reviewed and recommended for
approval by the Mounds View Planning Commission by adoption of
Resolution No. 183-87 dated May 6, 1987; and
WHEREAS, the Mounds View City Council finds the preliminary
plat to he consistent with the requirements of Municipal Code.
NOW, THEREFORE, 13E IT RESOLVED that the Mounds View City

RESOLUTION APPROVING MINOR SUBDIVISION, CONDITIONAL USE PERMIT,
AND DEVELOPMENT AGREEMENT FOR AMOCO OIL COMPANY, 2800 TRUNK
HIGHWAY 10
WHEREAS, Amoco Oil Company has requested City approval to
construct a gas station/convenience store/self-service car wash
in the City of Mounds View at 2900 Trunk Highway 10; and
WHEREAS, the development as proposed requires a Conditional
Use Permit, minor subdivision, and development approval; and
WHEREAS, the Mounds View Planning Commission recommended
approval of the proposal with conditions as outlined in Planning
Commission Resolution No. 181-87 dated May 6, 1987; and
WHEREAS, the Mounds View City Council now finds that the
project is acceptable pursuant to the requirements of Municipal
Code, specifically Chapters 40, 42, 49 and 49A and state
statutes.
NOW, 'CHEREFORE, HE IT RESOLVED that the Mounds View City
Council approves the minor subdivision as proposed and depicted
in the boundary and topographic survey dated February 3, 1987.
BE IT FURTHER RESOLVED, that the Mounds View City Council
approves the Conditional Use Permit with the following
conditions:
1. The facility must at all times be in compliance with
State Laws and Minnesota Pollution Control Agency
Standards for air quality and noise.
2. The hours of operation shall be 24 hours. After one year
of operation, the City Council shall hold a Public
Hearing to solicit input on the hours of operation. If
there are any negative comments, the hours of operation
may be reduced.
3, Outside loud speakers shall be utilized for clearing
pumps only.
4. Outside merchandising shall be limited to the concerete
entrance slabs to the building. Outside merchandise
stacking shall not exceed four feet.
5. The single pedestal sign shall be located as shown on
the site plan dated February 6, 1987. All of the signage
shall he in conformance with Chapter 39 of the Municipal
Code.

6. If, for any reason, the gasoline sales portion of
this business closes for a one year period, the
Conditional Use Permit shall be null and void and the
underground tanks shall be filled with sand or removed.
7. The car wash facilities shall include a blower system

vehicle before it is allowed to exit the facility. This
equipment shall operate as a customer option from
April 16 to October 14 and as a mandatory service from
October 15 through April 15.
8. Entrance to the car wash facility shall be achieved from
the southwest and vehicles shall exit to the northwest.
BE IT FINALLY RESOLVED, that the Mounds View City Council
approves Development Agreement No. 86-79.

Commissioner Ourgers asked jr. Lhe issue had been addressed
of run-off of water from the cars as they leavo the
facility and go onto Highway 10, and the problems that
water could pose.
Mr. Filippi. presented the Commissioners with the data
available on the lighting tiny are proposing, and showed
the location of the lights. Ile also stated the facility
would have the capacity to accomodate a dryer for the
cars. lie explained the design of the car wash is such
that water will not be able to splash out, and their
drainage and discharge will be directed toward Silver
Lake Road, and not Highway 10.
Chairman MounLin pointed out: there is already a serious
traffic problem at that. intersection, and she would like
to see it reviewed by a traffic consultant`. She
advised, however, that the Planning Commission would have
to make a decision if they think they will. go with the
plan, before asking the developer to pay for Elie cost of
' such a study.
It was the concensus or the Commissioners that they were
concerned with the traffic situation at this site, and
the additional traffic the development would generate,
and they asked that a traffic consultant be ret.ained to
address the issue.
Mr. Filippi. explained they plan on having two entrances
onto the site, one on llighway 10 and one on Silver Lake
Road, which would allow for good flow -through of the
cars.
Commissioner Zol.lner seated she was concerned with the
entrance Onto Ili.yhway .10 being so close to the inter-
section, and if there Is anything that can be done to
make the intersection Netter, it should be planned for
now. She added that Elie existing problem is not the
fault of this developer, but this clevdlopment would just
add to it.
Commissioner Saunders stated he also was concerned with
the intersection, especially during rush hour, and the
bank is a large source of the traffic for that area.

The Planning Commission asked that the Council try to
retain the firm of Barton-Ashmann to do the traffic

study, and address the following .issues: oo-site
stacking for rars leaving the site; ingress/egress
onto Silver Lake Road - right in, right out; what
type of median would be needed to control access;
the stacking of: cars waiting to get into thp. tsar wash;
and the issue of a joint shared access.
Chairman Mounti.n asked if the two property owners
would consider sharing one access onto Highway 10
between thein two properties, as it is a goal to
reduce the number of curb cuts onto Highway lo.
Jim llensen,.of Wagner Corporation, stated they are
willing to work with the Planning Commission with
the traffic: study, and they would .like to stay on
schedule and not have I.o wait for the results of
tire traffic: study to be presented before moving
ahead with anything else.
Chairman MounLin explained it should only bi a matter
of two or I.hree weeks before the study results are
in, assuming they can (let Barton-Ashmann right away.
Commi.ssionor Burgers asked what the plan is for the
adjacent property. c
Mr. Hansen replied they have no tenant for. Lhe
remainder of the property at this time, and if. Amoco
is approved and goes in, they will develop the
adjacent property as quickly as possible. Ile added
they are both flexible and negotiable as to what
goes on that parcel and they will keep Elie hest
interests of the City in mind when seeking a tenant.
Chairman Mountin stated they should check with MOOT
on the curb cut .issue, as now would be the Lime to go
with a single cut, while development is occuring.
Mr. Filippi staled he will make the necessary applica-
tions to MnUOT, as appropriate.
The Planning Commission agreed to ask the Council for
the traffic study, and continue discussion on the
development at the next agenda session if there is any
additional .information, and place it on the April 1,
1987 agenda, for the nrxt regular business meeting.
Carl Kr.isti,phcc, of. Amoco Corporation, slaked he could

THIS AGREEMENT made and entered into this day of
19_, by and between the CITY OF MOUNDS VIEW, County of
Ramsey, State of Minnesota, party of the first part, hereinafter
called the "City", and Amoco Oil Co., Southgate Office Plaza,
Suite 890, 5001 West 80th Street, Minneapolis, Minnesota, 55437
party of the second part, hereinafter called the "Developer",
WITNESSETH:
WHEREAS, the Developer, in consideration of site
develooment for a self-service easoline station with convenience
store and automated car wash
and the issuance of permits thereof, hereby agrees with the City
to perform all of the acts required herein and to conform to all
of the conditions set forth as follows:
1. Wherever the word "City" appears herein, it shall mean
and include the City of Mounds View and also said City's agents
and employees; and wherever the word "Developer" appears herein,
it shall mean the developer, and any of its agents and
employees. Wherever the words "development site" appear herein,
it shall mean the premises described in the following exhibits:
Exhibit 1. (boundary and topography survey including
legal description)
Exhibit 2. (site, landscape, grading/drainage, baffle
wier, building elevation and lighting fixture
detail plans)
Exhibit 3. (building plans and specifications)
Exhibit 4. (Resolution No. approving the project

3. All improvements required herein to be performed by the
Developer shall be constructed and paid for by said Developer
pursunnt to appropriate permits and approval from any governmental
agency, such approval and any environmental assessments or environ-
mental impact statements required to be obtained by and prepared at
the expense of said Developer.
4. All public improvements, Jr any, required to be conslruLc
ted by the Developer pursuant to this Agreement shall be performed
by the Developer with such materials and equipment as required by
the City under the direct supervision of the city and shall be in
conformance with any and all regulations in force at the time of
constt:uction, and the City is hereby granted the right of access to
Elie development site to inspect said ¢nnstruction at such times as
the City may direct.
5. The Developer shall, and hereby does, agree to pay when
due and herore they becomr delinquent, all valid I.axr•s and

6. The City shall not be under any obligation or re.airon-

matter related to this Agreement or Lo nny public improvements
required on said site by Life City, or. I:o act as inspector and
report to said Developer any defect or failure, hazard or inade-
quacy or otherwise relative to acid s.il:e development:; any actual
or implied approval by the City in respecl: to any deve.l.opment shall
not serve either Lo n.lter or extinguish or to otherwise affect the
respouni.bli.ty, obligation or liability of the Developer in this.
7. The Developer shall not unnecessarily damage or obstruct
or cause any interference with drainage ways or drainage works
located within or adjacent to said development site, or permit- its
contractor or other agents to do so-
B. The Developer shall not alter any of the public improve-
ments .located on said site except .if: and as elsewhere herein
provided or as particularly in each .instance authorized in writing
by the City.
9. Surface drainage to be constructed and approved, before
and after construction, by the City inspection Department, and
before an occupancy permit shall be issued for the expansion area.
10. All drainage ensements required by the City shall be
granted by Life Developer., without cost to the City, as required.
11. The Developer agrees to conform to all of the applicable
requiremenl:s of the Mounds View Mun.i.cipal. Code, as amended from
time Lo time, and parLicu.l.nrly Chapters 26, 39, 40, 42, 48, 49, 49A,
59, 6n, 61, 62 and 63.

13. Developer agrees that the City can terminate developmenL
or thodevel.opment site or the construction of any bnilding struc-
tures thereon if .in Idle City Counci.l's opinion the terms of this
DevelopmenL Contract have not been conr.ormed to by the developer
and the said Devel.opnr herein agrees to tense construction and
waives i H right of recourse, claim, suit or action against the
City. In addition, in the event the Developer fails to conform to
the condil:i.ons of this Agreement, the City shall be entitled to
enforce it pursuant to the terms of: this contract and/or the provi-
sions of the Mounds view Ilome Rule Charter, Chapter 26 of the
Municipal Code, or applicable Minnesota Statutes. The Developer �
herein agrees that in the event the City is compelled to enforce
any or the provisions or this contract by court action and judgment
is rendered in favor of the City, Lhat all costs, disbursements
and reasonable attorney's fees will be paid by said Developer, its
heirs, successors and assigns.
1.4. The Developer shai.l furnish to I:he City at I:he Lime of
the execution of this Contract a casli bond, a corporate surety bond,
an irrevocable lel.ter of credit or nny other negotiablo instrument
approved by the City Attorney, which I:he Developer agrees to keep in

performance by the Developer of all or the terms and conditions of

hold the City harmless from all costs and charges and damages that -
may orcur on account of doing of the work specified and for the
enforcing or. the terms or. this Contract• or bond, if action is
brought hereon, including reasonable attorney's fees, in any case
where such action is successfully maintained and for the compliance
with the laws appertaining thereto, whorein the bond shall be void,
but oLlierwi.se slnal.l remain in full force and effect.
15. it is understood and hereby agreed by and between the
parti.rs hereto that any plans or data supplied by the City within
or adjacent to said development site are approximations only and
that the City explicitly does not pretend or guarantee or warrant
any such plans or data to be either complete or correct.
16. The Developer shall not unnrcessaril.y creaLe, cause or
suffer to exist or to continue to exist, any nuisance or hazard
to persons or property within or adjacent to said site by reason
of said public improvements, development of Elie site or other
operal.ions in respect thereof or permit. i.(:s agents, engineers or
contractors to do so.
17. When applicable, three complete sets of plans and spec.i-
f:.icaH ons or directions for any public, improvement to be constructed
on said si1n, each bearing the cerLificate and seal of a professional
enginrpr duly registered .in the State of Minnesota, shall be sub-
nnitterl Lo the City well in advance or the Limp_ proposed for commenc-
ing construrLion Iheroor. The City slinll have a period or not: less

than 1.hi.rLy (30) days in which to examine and review the plans and
speeiricaLions submiLLed by Elie Developer and to reply to Lhn
Developer with respect to the adequacy or .inadequacy or the plans
and specifications. Upon final approval of the plan and specifi-
cations and within a reasonable time following completion of the
installation, the Developer Fhall furnish and deliver three sets
Of "as bail.t" plans thereof to the Ci.l.y. .If any public improve-
ments are to be constructed on said site by the City, the necessary
easements and right of ways shall be granl:ed to the Cil:y at Elie ex-
pense of Lhe Developer including the costs of Elie preparation of
the right of way documents and filing. The Developer further
agrees to grant to the CiLy any easements or right of ways required
over, under and across Lhe developmenL site, at no cost• to the
City, ror the maintenance and acceslilbili.ty to any public improve-
ment constructed on Elie development si.Le. The Developer shall
establish permanent reference marks, to the approval of the City, C
in convenient and rendi.l.y accessible .Locations wherever said

18. In the case or a multiple dwelling, commercial or indus-
trial development or any use combining any of the aforesaid uses,
the beveloper agrees on behalf of it -self:, its heirs, successors or
assigns to permanently maintain the si.Ee described herein pursuant
to the terms of this development conl:ract and all agreemenLr
subsequenl:ly entered .into, and said Developer shall nol. permil. Elie
premises to deteriorate or become blighted or to constitute a

create. a pul,.lic nui.sance. Enforcement: or. Lhis provision shall be

and the Municipal Code. In the event of nonconformance by Elie
developer, the City sha.l.l seek mandatbry relief, after written
notice or the alleged violations, pursuant to the terms of this
rontract to enforce this provision and may proceed to abate public
nuisances and to assess the cost of said abatement, including all
costs, di.nlnur.sements, legal fees against the development site, as
provided -for in the Home Rule Charter., Chapter 26 of the Municipal
Code, and such other applicable ordinances and Minnesota Statutes.
19. The development site shall be developed as Indicated
on the atLarhed site plan, referred to ns rxhibiL 2. The site plan
and the development to be constructed thereon may be amended from
time to time by Elie mutual written consent of Elie parties hereto,
in conformance with Elie Municipal Code or the'City.
20. In addition to all of the provisions recited herein -
before, the Developer agrees to the following conditions as more
fully set out in Exhibit 2n attached lueret:o and made a part hereof.
21. The provisions of this contract are severable, and in
the event that any provision of this agreement is found invalid,
Elie remaining provisions shall remain in full force and effect.

EXHIBIT 2A
In addition to the foregoing conditions, the Developer agrees to
the following:
1. Payment of all City administrative expenses above and
beyond amounts previously submitted.
2. The Developer shall have recorded at Ramsey County the
minor subdivision. Evidence of recording shall be
submitted to the City prior to the issuing of any building
permits.
3. The Developer shall have all lot corners installed prior
to the issuance of a building permit.
4. Developer shall secure approval from the State of
Minnesota, Department of Transportation, Ramsey County,
Minnesota Department of Public Safety, Office of State
Fire Marshall, and Rice Creek Watershed District prior to
issuance of a building permit.
5. A $1,000 cash bond, corporate surety bond, irrevocable
letter of credit or other negotiable instrument approved r
by the City Attorney which the Developer agrees to keep in L
full force and effect for a period of 7 years after final
approval of construction to secure operation and
maintenance of ponding area and control structure.

RE: INVESTIGATOR PROMOTION
As a result of Tim Smith's retirement, a vacancy was
created in the Police Department. A police officer was
hired in May to fill that vacancy. The Civil Service
began the selection process in early May for the purpose
of promoting an investigator. The selection process included
a written examination and interviews. Three officers applied
for the position of investigator. Larry Siluk a 12 year
veteran, was selected for the position.
RECOMMENDATION: The City Council authorize the Police
Department to promote Larry Siluk to the
the position of Police Investigator
effective June 1, 1987. Salary will be
determine by the local union contract.
Probationary period will be one year.
