The Mounds View City Council was called to order by
Mayor Links at 7:00 PM on Tuesday, May 26, 1987.
The Pledge of Allegiance was said.
MEMBERS PRESENT: Councilmembers Hankner, Quick,
Blanchard, wuori and Mayor Links.
ALSO PRESENT: City Attorney Meyers and Clerk/
Administrator Pauley.
Motion/Second: Blanchard/Quick to approve the May 11,
1987 minutes as presented.
4 ayes 0 nays 1 abstention
Councilmember Hankner stated she did not vote on the
minutes as she had not been present at the May 11
meeting.
Motion/Second: Hankner/Quick to approve the minutes
of the May 18, 1987 special meeting as presented.

John Deppa, 5072 Brighton Lane, stated he had received
a $5 penalty from the City for not turning in his
water meter reading card. He explained they have been
having problems on his block with the mail being stolen,
and he has spoken to people at City Hall, with the
Police Department, and the Post Office, and he feels he
has gotten nowhere. He added his wife had called Mayor
Linke over 90 days ago to discuss the problem, and
they have not heard back from his since then. Mr. Deppa
stated he is upset because the City does not believe
them, that the mail was stolen, and he has received no
response either from the Post Office. He added the
issue is not so much the $5 penalty but the ongoing
problem.

Mayor Linke stated that when he first became aware of
the problem, he checked with the Finance Director to
see what the City's policy is, and the City will
forgive one late payment or reading, but Mr. Deppa
has already had one forgiven. He added that as far
as mail being taken from the mail box, it is a federal
matter for the Post Office to handle.
Councilmember Blanchard suggested Mr. Deppa speak to
the postal inspector but she warned that it can take
a long time before they look into the matter.
Councilmember Hankner stated she can understand Mr.
Deppa's request and she does not feel it is unreason-
able. She added that the matter should be taken care
of with either the Police Department or Post Office,
and if there is a problem with the response from the
Post Office, they could contact Congressman Vento.
Motion/Second: Hankner/Quick to send a letter to
Congressman vento explaining a constituant from the
area is having a problem with the Post Office and
their lack of response to his situation.

John Winiecki, 7575 Groveland Road, stated he and
his neighbors have contacted the City regarding the
wetlands behind them and the ditch which is not being
maintained. He stated that in the past when it has
been wet, they have had problems with the water in
their back yards and not being able to mow certain
areas, and they would like the ditch to be maintained.
Mayor Linke asked that the discussion be continued
when the Dailey Knolls public hearing comes on the
agenda.
Mayor Linke closed the regular meeting and opened
the first public hearing at 7:13 PM.
Clerk/Administrator Pauley explained Amoco Oil is
requesting a conditional use permit to operate
a self-service gas station with a conveniende store
and car wash, and the proposal has received approval
from the Planning Commission.
Jim Filippi, of North Star Engineering, reviewed the
proposed site plan.
Councilmember Blanchard stated she was concerned with
possible problems with cars going back out onto
Highway 10, and the possibility of accidents.

Mr. Filippi stated that MnDOT has approved the plan
and issued the necessary permits, and the traffic
engineers did not find any problems when they
reviewed the plan. He added there is plenty of
stacking room and a good sight line out onto
Highway 10.
Mayor Linke stated they already have a stacking problem
on Silver Lake Road and he is concerned that this will
add to it, and he would prefer to see a sign or median
prohibiting a left turn out onto Silver Lake Road,
Mr. Filippi explained the site was designed for the
flow of traffic, and they did look at a right turn in,
right turn out only and determined that it wasn't
necessary. He added they estimate approximately 50
cars per hour on the site, and the majority of those
will be going back onto Highway 10, and they do not
anticipate a problem with those turning left onto
Silver Lake Road.
Councilmember Blanchard asked if the Council approves
the conditional use permit and then stacking becomes
a problem, if the City would have any recourse.
Attorney Meyers replied they could put a time limit
on the conditional use permit, with a reviewal
scheduled for one year, and the recourse would be
to not renew the conditional use permit. He added
that if stacking is a concern, they should address
it more thoroughly in the permit at this time.
George Winiecki, 2732 Highway 10, stated he is located
across Silver Lake Road from the proposed development
and he already has a problem with people cutting
through his parking lot at high speeds, if they have
missed their turn. He also asked what the zoning of
the property is.
Mayor Linke replied it is zoned B3, which is proper
for this proposal.
Mr. Winiecki asked if the property could be pulled
from the tax increment financing district. Mayor Linke
replied it could not.
Mayor Linke closed the public hearing and reopened
the regular meeting at 7:28 PM.
Councilmember Hankner pointed out the proposed gas 7. Consideration

this site, as there is the potential of another gas
explosion, and she feels the Super America station

down the highway is a better location. She added that
this site is part of the District 6 and 12 study.
Clerk/Administrator Pauley stated the recommendation
from the Planning Commission calls for a public hearing
one year after operation to consider whether or not to
continue 24 hours of operation, and they could also
address the traffic issues at that time.
Mr. Filippi stated Amoco Oil is very willing to work
with the City, but he pointed out that since this would
be a sizeable investment, Amoco would be very concerned
about having the conditional use permit revoked after
the first year, so they would do their best to solve
any problems as they would occur.
Councilmember Hankner read a list of eight criteria
from Chapter 40 that the Council must feel has been mat
before granting a conditional use permit, and she would
like more time to study the proposal, as she feels this
is an unsafe situation.
Motion/Second: Hankner/Blanchard to table this item
until June 22, 1987.

Mayor Linke voted against the motion, stating the request
has been before the Council for some time and he feels
ample time has been taken on it already.

Dailey Knolls

Howard Thorson, of Dailey Homes stated they are

requesting to subdivide four lots into 3, to develop
twin homes. He added the plan is the same one that
was approved by the Council three years ago, and they
are ready to go ahead with it now.
Mayor Linke asked the status of the drainage ditch,
which had been brought up earlier in the meeting.
Clerk/Administrator Pauley replied he is not familiar
with it, and he could look into it with the engineer.
Mr. Winiecki stated his concern is that the ditch is
not being maintained.
Councilmember Hankner asked who has jurisdiction over
the ditch, the County or City?

Clerk/Administrator Pauley replied lie wasn't sure, but
if it is a County ditch, he would encourage the residents
to contact the County Commissioner, Duane McCarty, as
well as having the City contact him. He stated he would
get back to Mr. Winiecki once he determines whose
responsibility it is.
Mayor Linke closed the public hearing and reopened the
regular meeting at 7:49 PM.
Clerk/Administrator Pauley asked that R. J. Riches be
added under Item R for a restaurant license, as the
property as been sold, and the new owners have filled
all the requirements.
Clerk/Administrator Pauley reviewed the items on the
consent agenda.
Motion/Second: Hankner/Blanchard to approve the
consent agenda as presented, and waive the reading of
the resolutions.

Tom Casey, 2816 Ardan Avenue, stated he was told by 12• Discussion wit
the Council on April 20 that the drainage pond he and Tom Casey,
his neighbors had filled in was going to be put back 2816 Ardan Ave
in, and that part of the work has been done but he is
not happy with it, and he asked when the rest would be
done.
Mayor Linke explained the ditch was to be reconstructed
that was filled in by the home owners, and that once
the rework was started, it was determined that no work
was required in Mr. Casey's back yard, and resodding
was only to be done where the rework was done.

Mr. Casey stated the drainage does not seem to run
smoothly through the area now.
Mayor Links explained it was determined no excavation
work was needed in Mr. Casey's ,yard, and they will
have someone from the Public Works department go over
with a rake and smooth out the area where the equipment
may have gone.

Councilmember Hankner stated that in reading over the
minutes of the meetings she hadn't attended, she felt
there was opposition from the people living in the
immediate area of Random Park, and she would like a
survey done over the next few weeks, to find out the
best use of the facility is and what the needs are.
She added that she would be willing to personally take
care of the survey, and knock on doors and get the
residents opinions.
Mayor Linke stated this item has been postponed many C
times already, and the Council has discussed it
thoroughly, and while he understands that Councilmember
Hankner's schedule did not allow her to participate
in those discussions, he feels it is time for a
decision to be made tonight.
Councilmember Quick stated he feels there is room to
do a study and identify what the needs are.
Director Saarion explained she does not have a list of
groups ready who would be using the building and when,
but she does know who has a need for it.
Motion/Second: Quick/Hankner to table discussion on
this item until June 8, 1987.

Councilmember Blanchard and Mayor Linke voted against
the motion.
Councilmember Quick stated he was comfortable with
tabling the discussion as it would give Councilmember
Hankner enough time to answer her questions.

Mayor Links reported he had received an invitation Mayor Linke
from the City of New Brighton to attend an open house
of their new City Hall building on June 91 and he
could not attend, so he asked Councilmember Blanchard
to attend in his place. He added that any other
Councilmembers are welcome to attend.
Mayor Linke reported he had received an invitation
'from the Citizen's League regarding their anniverary
celebration on June 11, if any Councilmembers are
interested in attending.

The Consent
Agenda is a technique designed to expedite
handling of
routine and miscellaneous official business of
the City Council. The entire agenda may be adopted by the
Council In one motion. The motion for adoption is non -
debatable and must receive unanimous approval. By request
of any individual Councilmember, an item can be removed from
the Consent
Agenda and placed upon the Regular Agenda for
debate.

SUBJECT: RELEASE OF SUPER AMERICA DEVELOPMENT SECURITIES
AND ISSUANCE OF OCCUPANCY CERTIFICATE
Attached to this memorandum please find a memo from Building
Official Jim Tobias Indicating that the Super America
Building has been completed and is fit for occupancy and
that all exterior site development work hao been completed
pursuant to the Development Agreement.
Also, attached to this memorandum is Resolution No. 2204
Releasing Development Securities and Authorizing Issuance of
Occupancy Certificate. Staff would recommend adoption of
this resolution.

This memo is to inform you that the Superamerica gasoline
station/convenience snore located at 2640 County Road I has
received my approval for final occupancy. I have checked with
State Electrical Inspector Bob Clausen and Fire Chief Ron
Fagerstrom, and they both indicated that Superamerica has
received their approval for final occupancy.

CITY OF HOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
RESOLUTION AUTHORIZING RELEASE OF DEVELOPMENT_ SECURITIES AND
AUTHORIZING ISSUANCE OF OCCUPANCY CERTIFICATE
WHEREAS, Super America has constructed a self-service gas
station and convenience store at the intersection of County Road
I and Trunk Highway 10 pursuant to approvals by the City,
including Development Agreement No. 85-72; and
WHEREAS, the City's Building Official has determined that the
structure has been completed in conformance with the requirementa
of the Development Agreement and appropriate Building Codes; and
WHEREAS, the City's Building Official has recommended
issuance of a permanent Occupancy Certificate; and
WHEREAS, Development Agreement No. 85-72 provided for
$37,000 in securities to guarantee performancy by the Developer
of all terms and conditions of the contract.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Hounds View that:
1. the Building Official is authorized to issue a
permanent Occupancy Certificate for Super America,
2640 County Road I, and
2. securities provided by Super America in the amount
of $37,000.00 in conformance with the requirements of
Development Agreement No. 85-72 are hereby released.
Adopted this 8th day of June, 1987.

Wildwood Manor Home has 44 senior citizen residents.- Wildwood Manor
Home is approximately 1/2 mile or 2-1/2 blocks from Random Park.
Random Park is midway between Wildwood Manor Home and Edgewood
Community Center.
Scotland Green Apartments have at least 35 apartments rented Lo
senior citizens. Scotland Green Apartments is approximately 1/5
mile or 1-1/2 blocks from Random Park. Random Park is midway
between Scotland Green Apartments and Edgewood Community
Center.
School District 1621 offered a projection for 1987-88 of more than
99 pre-schoolers in the Sunnyside School area, the same area serving
Random Park. This projection was based on pre-school testing as of
April 15. Since all pre-schoolers are not tested, the number is
probably greater than 99.
There are 36 senior citizens which are members of either the Sunrise
Seniors Club or the Messiah Seniors Club that reside on the south
side of Highway 10 and east of Silver Lake Road.
There are 19 senior citizens which are members of either the Sunrise
Senior Club or Messiah Senior Club that reside on the south side of
Highway 10 and west of Silver Lake Road.
Here is an example of some community groups that may wish to use the
building for meetings:

The Mounds View City Council was called to order by
Mayor Linke at 7:00 PM on Monday, June 8, 1987.
The Pledge of Allegiance was said.
MEMBERS PRESENT: Councilmembers Quick, Blanchard,
Wuori, Hankner and Mayor Linke.
ALSO PRESENT: City Attorney Meyers ana.Clerk/
Administrator Pauley.

Motion Carried
Alice Frits, 8072 Long Lake Road reported that the May 5. Residents
!,.. 7 issue of the Minneapolis.Star and Tribune had listed Requests and
%' in tile Ramsey County real estate section that the Comments from
property at 2211 NE Highway 10, belonging to Jack the Floor
Johnson, had been purchased by the City of Mounds View,
and she questioned why the City purchased his property.
Mayor Linke explained the property is along side of
McDonald's on Highway 10, and the City is playing
middle man between the developer, JLN, and the property
owner. He stated the City will be reimbursed by the
other buyers, JLN. He further explained there had been
a breakdown in communication between Mr. Johnson and
JLN, and it worked out better for the City to help out
with the purchase.
Mr. Frits asked why the City had to get involved, and
where the money came from, and if interest would be
paid to the City.
Clerk/Administrator Pauley explained that there will be
a title transfer on July 1, and the City will be paid
back by JLN. He added that there will be no interest
paid tm'the City, and the funds came from the cash
reserves. He added JLN will be responsible for the

Mayor Links closed the regular meeting and opened the

Grace Zwieg, 5309 Greenfield Avenue, stated that on
the morning of April 26, when she went into her
attached garage to leave for church, she found a very
drunk man in the back seat of her car. She stated he
had spent the previous evening at Muldoon's and had
been served way too much liquor. She added that she
did not call the police over that incident, but she
has had many problems with the operation of Muldoons.
She stated that at least once a year she gets a damaged
mailbox, and the fence between her property and
Muldoon Is is always in need of repair, and she presented
pictures to the Council of the fence. She also stated
the owner had promised last year to paint the fence and
had not done so.
Mayor Linke asked if the fence was listed in the letter
of understanding from last year.
Clerk/Administrator Pauley replied he would have to check
the letter.
Ron Michna, 5287 Edgewood Drive, asked what a public
nuisance is, according to the City Attorney, Clerk/
Administrator and each Councilmember, and he also asked
which specific license is issued for Muldoon's to operate.
Mayor Linke replied a liquor license is issued, under
Chapter 100.02, under both City code and State law.

Mr. Michna asked what the capacity of Muldoon's is
under the fire code.
Mayor Linke replied he was not certain of the capacity
but that a fire inspection had been done and the
capacity posted in the building.
Attorney Meyers read the definition of a public nuisance
according to law.
Mr. Michna referred to parts of the definition and stated
he felt Muldoon's was in violation of many areas. He also
pointed out that he attended the public hearing last year
and voiced many of the same concerns and he had asked the
Council to call a special meeting between the owner and
the City and the area residents to address the problems,
but the Council never did that.
Mayor Linke explained that was the purpose of the meeting
tonight, and this is an opportunity for the,people to
address any problems.
Mr. Michna stated he had presented a petition to the Council
last year of signatures of people in the area, stating the
' numerous problems they had been having with Muldoon's, and
things were no better this year.
Councilmember Hankner explained the City needs evidence if
they are going to be able to prosecute, and just as they
asked the residents last year, they are asking again that they
put complaints in writing and file a police report.
Attorney Meyers explained there are two types of complaints,
citizen and criminal citations, and he explained the
difference between the two, and he reviewed the criteria
to be used to revoke a liquor license. He added that it
may not be under City control but under State control
with a mediator. He stated that if there is a serious
problem, at the time of renewal discretion is broader as
far as restricting or taking away a license, and now is
the time for the Council to address the problems. He
further explained that there is criteria to be followed
on the Sunday liquor license issue.
Councilmember Hankner stated that as a result of the input
from the citizens, they set up the public hearings before
the renewal of each liquor license in the City.

Mr. Michna stated the Council is aware of two establish-
ments who are not meeting the criteria of the Sunday
food operation and stated they should have beer, shut
down a year ago and wanted to know why the Council
does not handle the situation. He also stated he is
concerned about the outdoor entertainment that goes on
and how disturbing it is to the neighborhood.
Mayor Linke stated the City was approached by Loose
Ends about an outdoor concert and the City told them no.
Mr. Michna stated he still has a problem with the band
instruments being moved out in the middle of the night,
after closing, and he had complained about that a year
ago, and he did send a letter to the City complaining
about that. He also pointed out a problem with no
curbing along County Road H2, as people drive in and
out wherever they please.
David Carlstrom, 5297 Edgewood Drive, stated he agrees
with everything Mr. Michna has stated, and he asked
whose responsibility is it to enforce the ordinances,
and asked who he should sue for non -enforcement, the
police department, city attorney, clerk/administrator
or the council. He added they have had complaints
against that establishment for the past three years and
nothing has been done about it.
Mayor Linke stated the complaints must be filed with
the City if they are going to be able to use them.
Mr.. Carlstrom stated the law is not being enforced and
he asked if it was unreasonable for a citizen to expect
that City to control the businesses and enforce the
law. He asked what his next recourse would be, and if
he should go to the attorney general next.
Attorney Meyers explained criminal actions must go
through the police department, and they investigate
all complaints. He added that if a citizen has a
complaint, they should file it.
Mr. Michna stated the fence between Muldoon's and the
neighborhood was only recently repaired because of the
public hearing which was scheduled.
Mr. Conroy, owner of Muldoon's, replied that when the
fence goes down, they repair it, and they know what
the laws are and they abide by them. tie added that
each year there is a new bunch of charges against them,
and as they take care of those, new ones come up. He
stated they are operating as a restaurant, and they
open at 4 PM or later on Sunday, and one person handles
the cooking, as well as tending bar and other duties.
He added they have never had a food business there, and

they take maybe three orders for food on a Sunday.
Mayor Linke explained that liquor is to be served in
conjunction with food, but it appears that Muldoon's
is doing it backwards. Ile stated the intent of the
law is to allow restaurants to also serve liquor with
their meals on Sunday.
Mr. Conroy replied their business does not pick up until
9 or 10 PM now, with daylight hours, and no one is in
there eating then.
Councilmember Hankner asked what type of food is served
and she questioned why they are even open on Sunday if
business is that slow.
Mr. Conroy stated they serve sandwiches and french fries,
and he added they are open because some business is better
than no business.
Mayor Linke stated he does not feel that a sandwich
meets the requirements of a complete entree, which must
include a salad, vegetable, bread or rolls, and beverage.
He added that he does not feel that lettuce and tomatoe
served on a burger count as a vegetable.

Councilmember Quick asked where the electrical would
come in.
Clerk/Administrator Pauley stated it would come from
a transformer located by Burger King, and the sewer
and water stubs are in already. lie added Staff would
recommend the first choice for location due to the
electrical, sewer and water needs and their availa-
bility. He added he will be discussing this request
with Attorney Meyers but he feels a development
agreement would cover the City's interest.
Attorney Meyers explained that Section 43.03 covers
the use of mobile homes for a temporary office, for
a 90 day period. He stated they could require the
posting of a bond, and he does need more time to
research the matter.
Councilmember Blanchard stated she could sympathize
with Mr. Edwards but she has a problem with letting
someone come in and do this, as they could possibly
end up with a whole row of trailers. She recommended
not taking any action tonight.
Councilmember Hankner stated she would like to see
if there is any way to work this out, as Wonder Video
has been a good business customer in the City, and
she would like to be able to help them out if at all L
possible.

up the necessary paperwork and look into the legal
aspects of this request, for lot 1, block 10, south-
west corner.

Clerk/Administrator Pauley reported that Willard Haro
had paid the fees for sewer and water services to
build at 7545 Pleasantview Drive, on May 12, but they
have since discovered the services will have to come
from Fridley, and he requested approval to .issue a
refund from the City for the $846 Mr. Haro paid. �.

REQUEST FOR REZONING AND CONDITIONAL USE PERMIT
FOR THE SALE OF GASOLINE SITE PLAN
Pump anal Meter Service, -Inc. has submitted a revised site plan,
copy attached, purportedly responding to concerns voiced at the
City Council at your June 1st Agenda Session. Staff has reviewed
this plan in great detail and wishes to raise the following
issues as it relates to this plan.
I. Chapter 40.07, Subdivision D, (8), j. requires that
all parking and driveway areas are to be surfaced
with bituminous material. The plans do not show this
as being the fact.
2. No plans for lighting, including lighting fixture plans
are shown to ensure compliance with Municipal Code
regarding adequate lighting and intrusion of that
lighting upon adjoining properties.
3. The plans do not show the current or future location of
the Tom Thumb sign which Staff would assume would include
a proposal to include gas price signage.
4. Municipal Code Chapter 40.07, Subdivision D, (8), n.
requires that, ..all open off street parking shall
have a permanent curb area around the entire parking
lot, said curb barrier not closer than five feet to
any lot line. Grass plantings or surfacing materials
shall be provided in all areas bordering the parking
area." The plans obviously do not provide for
conformance with this requirement, particularly as it
relates to the six parallel parking spaces proposed
on the south side of the lot behind the store and
adjacent to a single family residence.
5. Chapter 40.07, Subdivision D, (8), o, requires, "All
open, non-residential, off street parking areas of
five or more spaces shall be screened and landscaped
from abutting or surrounding residential districts
in compliance with Section 40.04, Subdivision I of
this code." The plans do not call for conformance with
this requirement.
6. Chapter 40.07, Subdivision F, (3) requires that all
accessory off street parking be not less than five
feet from any lot line. The plans do not call for
conformance with this requirement, particularly as
it relates to the parking proposed on the north and
south ends of the site.

7. Staff computes that parking required for this site
would be 52 spaces plus one per each employee where
the developer proposes 28 spaces.
Staff would also again point out that the Comprehensive Land Use
Plan of the City of Mounds View calls for this area to be
neighborhood commercial which is clearly not in conformance
with the rezoning request to B-3, Highway Commercial.
A copy of this memorandum is being provided to the developer in
advance of the June 22 Public Hearing in order that they might be
fully informed of the Staff comments with respect to the project.
RECOMMENDATION:
Staff recommends denial of the rezoning and Conditional Use
Permit application on the basis that said application is not in
conformance with the City's Comprehensive Land Use Plan.

WHEREAS, Mr. Larry Pearson, 2925 Trunk Highway 10 has
requested a Conditonal Use Permit to allow construction of a 400
square foot storage building; and
WHEREAS, Mounds View Municipal Code Chapter 40.10, Subdivi-
sion C, 2, (c), provides that the maximum size of an accessory
building in an R1 District shall be 216 square feet unless a
Conditional Use Permit is awarded by the City; and
WHEREAS, Mounds View Municipal Code Chapter 40.10,
Subdivision D, (6), A through E provides an accessory building
may be permitted up to 400 square feet when said building is a
permanent structure and is designed and maintained to provide a
uniform appearance with the principle dwelling unit; and
WHEREAS, the Mounds View Planning Commission has reviewed the
applicant's request for a Conditional Use Permit and determined
that it is in conformance with the aforementioned conditions.
NOW, THEREFORE, BE IT RESOLVED that the Mounds View Planning
Commission recommends approval of a Conditional Use Permit to
allow the construction of a 400 square foot accessory building by
Larry Pearson, 2925 Trunk Highway 10.
BE IT FURTHER RESOLVED that the Mounds View Planning
Commission directs Staff to forward this resolution to the City
Council prior to approval of the minutes.

The applicant has requested a Conditional Use Permit to allow the
construction of a 400 square foot storage building, copy of site
plan attached, in addition to the construction of an 864 square
foot garage, a 448 square foot addition to the residence as well
as a 320 square foot porch to the residence.
Municipal Code 40.10, Subdivision C., 2. (c), provides that the
maximum size of an accessory building in an R1 District shall be
216 square feet unless a Conditional Use Permit is awarded by the
City. As the applicant requests approval for a 400 square foot
accessory building, a Conditional Use Permit will be required.
An analysis of the applicant's request indicates that the lot on
which the building will be constructed exceeds 2 acres in size,
the shed will be 15 feet from the closest sideyard, 26 feet from
the house and at .least 400 feet from the rearyard and no driveway
or other access will be available to the building. Based on
these observations it would appear that no negative impacts would
result from the approval of this Conditional Use Permit on any
adjacent property nor on the principle property itself.
Therefore, Staff would recommend Planning Commission recommend
approval of the Conditional Use Permit to the City Council which
will be required to hold a public hearing prior to taking action
on the Conditional Use Permit request which will require a 4/5's
approval of the full City Council.

reviewed the petition to determine the location of the

Attached to this memorandum please find a copy of a City Map
which shows in lime green the addresses of the petition
eignators. You will note, I am sure, as Staff did that
except for five single family residences, all of the
eignators on property immediately adjacent to the Tom Thumb
site are residents of apartment buildings. This is not to
suggest that apartment dwellerr. concerns should not be
listened to and addressed, but does give a general
indication of where the demand for these facilities exist
and causes one to wonder what the general reaction of the
single family homes south of the Tom Thumb, fronting on
Edgewood and Greenfield Avenue feel about this proposal.
Obviously, that information will become available at the
public hearing on the 22nd of June.

Watson -Forsberg Company has applied for preliminary plat approval
of a major subdivision comprising the 28.63 acre site on the east
side of Judicial Ditch I1 south of County Road J in the extreme
northeast corner of the City of Mounds View, site map attached.
Staff has reviewed the preliminary plat proposal and had
discussions with both the developer and the City of Blaine. The
purpose of these discussions was to determine the feasibility of
the provision of water and sewer service to the site by the City
of Blaine, which currently has water and sewer lines under Coral
Sea Street, which will service these properties. During these
discussions the City of Blaine voiced some concern for providing
water and sewer service as well as street access which includes
street maintenance and snowplowing without accruing the benefits
of having taxable property within their community. As a means to
encourage the cooperation of the City of Blaine, Staff proposed
that the feasibility of abandoning the storm water holding pond
for the Blaine portion of the Northstar Industrial Park be
considered with the redirection of this water to the ponds to be
provided by the developer adjacent to Judicial Ditch il. Should
such abandonment be possible, an additional three lots would be
made available for development within the City of Blaine. The
developer has indicated an interest in this possibility and will
hopefully have additional information regarding this matter at
your May 20th Meeting.
During the past few years the City has begun an effort to secure
title to, or dedication of, property in the area on both sides of
Judicial Ditch 61 and along the north side of the County Road J
spur off of 35W, see attached site map, for the purpose of
developing a municipal golf course. The developer has indicated
a willingness to donate land adjacent to Judicial Ditch 61 that
would accomodate the development of the first hole. This land
would also protect the wetlands identified in this area and
provide the area needed for storm water ponding which could be
accomodated.within the fairway area.
Assuming that agreement can he reached with the City of Blaine on
water and sewer service and storm water storage, the development
is in conformance with current municipal codes. Therefore, Staff
would recommend the Council adopt the attached resolution
recommending approval to the City Council.

RESIDENTIAL -OFFICE, MOUNDS VIEW PLANNING CASE 208-87
Prior to discussing the rezoning application currently before the
City, an analysis of the recent history of this property seems
appropriate. The property in question has an extensive history
in that the current property owner has operated a radiator repair
shop in the garage of the single family residence, which the City
has contended is in violation of the Home occupation provisions
of the Zoning Code. Also, the property owner has previously
requested a rezoning from the current R1, Single Family
Residential Zoning to B3, Highway Commercial. The City denied
the rezoning request and the property owner in response to this
denial filed'suit in Ramsey County District Court requesting that
the Court approve the rezoning. In response to this suit, the
City filed a countersuit requesting that the Court determine that
the current use is in violation of the city's Home Occupation
provisions of the Zoning Code and order that the use be
discontinued. The District Court ordered the rezoning to B3 in
response to these suits and the City filed an appeal with the
Minnesota Appellate Court which then overturned the rezoning
order upholding the city's Comprehensive Land Use Plan and
remanded the decision regarding the Home Occupation Use question
to the District Court. No hearing has been held on the remanded
question.
The property owner is now requesting that the property be rezoned
to R0, Residential office, a District established to, "...provide
for high density residential use and for the transition and land
use from residential to low intensity business allowing for the
intermixing of such uses." All principle uses allowed in an R4,
High Density Residential District are permitted in an RO
District. Also, as a conditional permitted use, the following
uses are allowed:
"Medical Offices and Clinics
Dential Offices and Clinics
Professional Offices and Commercial (Leased) Offices
(limited to appraiser, architects, attorneys, certified
public accountants, clergymen, dentists, engineers,
manufacturer's representatives, physicians, real estate
agents, and other similar uses which require no delivery
of goods, have no storage or merchandise, and are service
oriented with no retail sale of goods on the premises,
and funeral homes and mortuaries...)"
The City's Comprehensive Land Use Plan designates this property
as Medium Density Residential, copy of District 6 Plan attached.

Rezoning of the property to an RO District would appear, on its
face, not to be in conformance with the Medium Density
Residential designation for the property listed in the Compre-
hensive Land Use Plan. It should be pointed out, however, that
it is Staff's understanding that the rezoning application is
being submitted to the City Council as an alternative to the
continuing legal dispute regarding the zoning and use of this
property. Should the Planning Commission determine that the
rezoning request is in the best interest of the City, not only
will the rezoning be required, but also Iit would appear that an
amendment to the City's Comprehensive Lard Use Plan to designate
this area as High Density Residential would also be appropriate.
Such action would not seem to be inconsistent with the current
position of the Planning Commission and City Council as it
relates to the future use of the frontage along Trunk Highway 10
which is to be implemented by the update of the Comprehensive
Land Use Plan to be undertaken in the very near future.
Staff would request Planning Commission direction regarding this
matter.

The predominant land use within District 6 is single family housing. Other uses
include a number of isolated commercial uses along Highway 10 and several public
and semipublic uses, including Hillview Park located on the ecstern border of the
District. In keeping with the existing character of the neighborhood, it is recom-
mended that the majority of the remaining undeveloped land in District 6 be
developed as single family housing. Existing commercial uses should be adequately
buffered from abutting residential development and continuation of the strip pattern
of commercial development inhibited through the introduction of medium density
residential development on the remaining open land adjacent to Highway 10. In
order to minimize the conflict with through traffic along Highway 10 access to any
such development should not occur directly off the highway.

The 1987 Budget includes monies for 4 part-time/temporary
maintenance positions. Two in the Parks Department and one each
in the Sewer and Water Departments. Currently we have two under
work agreements with your approval. We have two others that are
ready for your approval. The first is George Pajunen and the
second is Timothy Hetland. George would be starting 6/18/87 at
$5.75 per hour not to exceed 67 days. Timothy Hedland would be
starting 6/19/87 at $4.75 per hour not to exceed 67 days. This
hourly rate and number of hours falls within the budget. Also,
both will be retroactive with your approval due to the timing of
the availability and our need for the help.
Should you have any questions, please contact me.
RECOMMENDATION: Staff recommends the hiring of George Pajunen at
a rate of 5.65 per hour and Timothy Hedland at a rate of $4.75
per hour. Both positions shall not exceed 67 days.

Mayor Linke stated that when he first became aware of
the problem, he checked with the Finance Director to
see what the City's policy is, and the City will
forgive one late payment or reading, but Mr. Deppa
has already had one forgiven. He added that as far
as mail being taken from the mail box, it is a federal
matter for the Post Office to handle.
Councilmember Blanchard suggested Mr. Deppa speak to
the postal inspector but she warned that it can take
a long time before they look into the matter.
Councilmember Hankner stated she can understand Mr.
Deppa's request and she does not feel it is unreason-
able. She added that the matter should be taken care

Post Office, they could contact Congressman Vento.

John Winiecki, 7575 Groveland Road, stated he and
his neighbors have contacted the City regarding the
wetlands behind them and the ditch which is not being
maintained. He stated that in the past when it has
been wet, they have had problems with the water in
their back yards and not being able to mow certain
areas, and they would like the ditch to be maintained.
Mayor Linke asked that the discussion be continued
when the Dailey Knolls public hearing comes on the
agenda.
Mayor Linke closed the regular meeting and opened 6. Public Hearing:

Clerk/Administrator Pauley explained Amoco Oil is Amoco Oil Co.
requesting a conditional use permit to operate
a self-service gas station with a convenience store
and car wash, and the proposal has received approval
from the Planning Commission.
Jim Filippi, of North Star Engineering, reviewed the
proposed site plan.
Councilmember Blanchard stated she was concerned with
possible problems with cars going back out onto
Highway 10, and the possibility of accidents.

�. Mr. Filippi stated that MnDOT has approved the plan
and issued the necessary permits, and the traffic
engineers did not find any problems when they
reviewed the plan. He added there is plenty of
stacking room and a good sight line out onto
Highway 10.
Mayor Linke stated they already have a stacking problem
on Silver Lake Road and he is concerned that this will
add to it, and he would prefer to see a sign or median
prohibiting a left turn out onto Silver Lake Road.
Mr. Filippi explained the site was designed for the
flow of traffic, and they did look at a right turn in,
right turn out only and determined that it wasn't
necessary. He added they estimate approximately 50
cars per hour on the site, and the majority of those
will be going back onto Highway 10, and they do not
anticipate a problem with those turning left onto
Silver Lake Road.
Councilmember. Blanchard asked if the Council approves
the conditional use permit and then stacking becomes
a problem, if the City would have any recourse.
Attorney Meyers replied they could put a time limit
on the conditional use permit, with a reviewal
scheduled for one year, and the recourse would be
to not renew the conditional use permit. He added
that if stacking is a concern, they should address
it more thoroughly in the permit at this time.
George Winiecki, 2732 Highway 10, stated he is located
across Silver Lake Road from the proposed development
and he already has a problem with people cutting
through his parking lot at high speeds, if they have
missed their turn. He also asked what the zoning of
the property is.
Mayor Linke replied it is zoned B3, which is proper
for this proposal.
Mr. Winiecki asked if the property could be pulled
from the tax increment financing district. Mayor Linke
reolied it could not.

Clerk,/Administrator Pauley stated the recommendation
from the Planning Commission calls for a public hearing
one year after operation to consider whether or not to
continue 24 nours of operation, and they could also
address the traffic issues at that time.
Mr. Filippi stated. Amoco Oil is very willing to work
with the City, but he pointed out that since this would
be a sizeable investment, Amoco would be very concerned
about having the conditional use permit revoked after
the first year, so they would do their best to solve
any problems as they would occur.
Councilmember Hankner read a list of eight criteria
from Chapter 40 that the Council must feel has been met
before granting a conditional use permit, and she would
like more -time to study the proposal, as she feels this
is an unsafe situation.

are ready to go ahead with it now.
Mayor Linke asked the status of the drainage ditch,
which had been brought up earlier in the meeting.
Clerk/Administrator Pauley replied he is not familiar
with it, and he could look into it with the engineer.
Mr. Winiecki stated his concern is that the ditch is
not being maintained.
Councilmember Hankner asked who has jurisdiction over
the ditch, the County or City?

Mayor Linke explained it was determined no excavation
work was needed in Mr. Casey's yard, and they will
have someone from the Public Works department go over
with a rake and smooth out the area where the equipment
may have gone.
Park Director Maryi.Saarion explained the portable 13.Continue

first choice that it be placed at Random Park, or Classroom

Councilmember Hankner stated that in reading over the
minutes of the meetings she hadn't attended, she felt
there was opposition from the people living in the
immediate area of Random Park, and she would like a
survey done over the next few weeks, to find out the
best use of the facility is and 'what the needs are.
She added that she would be willing to personally take
care of the survey, and knock on doors and get the
residents opinions.
Mayor Linke stated this item has been postponed many
times already, and the Council has discussed it
thoroughly, and while he understands that Councilmember
Hankner's schedule did not allow her to participate
in those discussions, he feels it is time for a
decision to be made tonight.
Councilmember Quick stated he feels there is room to
do a study and identify what the needs are.
Director Saarion explained she does not have a list of
groups ready who would be using the building and when,
but she does know who has a need for it.

Mayor Linke reported he had received an invitation Mayor Linke
from the City of New Brighton to attend an open house
Of their new City Hall building on June 9, and he
could not attend, so he asked Councilmember Blanchard

Mayor Linke reported he had received an invitation
from the Citizen's League regarding their anniverary
i celebration on June 11, if any Councilmembers are
