Call to Order The meeting was called to order by Chair Farmer at 6:12 p.m. for April 17, 2024. ______________________________________________________________________________ 2. Resolution 1169-24, Amending the Planning and Zoning Commission Bylaws Assistant City Administrator Beeman stated the Mounds View Planning and Zoning Commission Bylaws require the Commission to review its Bylaws at its first regular meeting in February annually. The Commission reviewed its Bylaws at its 02-07-24 regular meeting and determined that an amendment is necessary in order to clarify and make consistent throughout the Bylaws the phrase, “Community Development Director” and his or her designee, to the “City Administrator” and his or her designee. The Planning Commission Bylaws were last amended January 18, 2023. The Planning Commission has determined that a change is necessary in order to clarify and ensure consistency throughout the Bylaws. Resolution 1169-24 and the proposed tracked changes to the Bylaws. Staff commented on the bylaws further and recommended the Commission approve the amended Planning and Zoning Commission Bylaws as amended. MOTION/SECOND: Commissioner Stevenson/Commissioner Nelson. To approve Resolution 1169-24, a Resolution Amending the Planning and Zoning Commission Bylaws. Ayes – 7 Nays – 0 Motion carried. B. Resolution 1170-24, Amending the Conditional Use Permit for 2375 Mounds View Boulevard Phil Carlson, Stantec, stated the Bear Lot at 2375 Mounds View Blvd was originally a Saturn dealership with a CUP approved in 1992 by Resolution 4195. The CUP was amended in 1994, 1996, and 2010, allowing among things, added parking stalls; expansion of the building; adding a car wash, landscaping, signage, and lighting; and finally in 2010 removing the requirement for a new car license on the property. A condition of the 1996 amendment remains in effect: “[V]ehicle repair, servicing and maintenance are permitted on this site, excluding body work and painting.” Mr. Carlson explained the owners want to remove that condition so that a full complement of repair work can be done on site, including body work and painting. In the background material Mounds View Planning Commission April 17, 2024 Regular Meeting Page 3 ________________________________________________________________________ for this request is my opinion via email to the applicant that “auto repair” in the Mounds View Zoning Code does not distinguish between various kinds of auto repair and auto body work – body work is part of “auto repair”. If body work is done, it follows logically that auto painting is part of that work and should be allowed as well, since that body work usually needs to be repainted. There is no detailed background on why the previous condition imposed by the City Council prevented auto body work and painting. But the condition may be reasonable, given the differences in potential impacts between minor repair work and major body work and painting, notable noise and odors. If these can be addressed, amending the CUP to remove that condition as requested may be reasonable. There are no exterior changes to the site or building with this CUP amendment request at this time. If there are significant changes to the site or building, those will be reviewed with another CUP amendment. Very minor changes can be approved administratively by staff. Staff commented on the request further and recommended approval of the Amended Conditional Use Permit. Commissioner Curtis asked if the new company would need to follow the existing CUP signage guidelines. Mr. Carlson reported the CUP would remain with the property, meaning the new company would have to follow the regulations within the existing CUP. In that case, the new company would have to follow the new sign ordinance. The Commission decided they would address the sign issue when and if the new company brings an issue forward to the City. To approve Resolution 1170-24, A Resolution Recommending Approval of an Amendment to the Conditional Use Permit for the Property at 2375 Mounds View Boulevard to Allow Auto Body Work and Auto Painting. They want to subdivide the property into two lots and are applying for a subdivision to be called Voyager Subdivision. Background: The existing lot is about 136’ X 231’, or 31,363 sq ft in size. There is an existing house on the east side of the lot which would remain and an existing garage in the middle of the lot which would be taken down. The proposed plat would divide the parcel into two lots: Lot 1 would be about 108’ X 136’, or 14,587 sq ft; Lot 2, a corner lot with the existing home, would be about 123’ X 136’, or 16,776 sq ft. The minimum dimensions for single family lots in the R-1 district are 75 ft wide and 11,000 sq ft for interior lots, and 100 ft wide and 12,500 sq ft for corner lots. In addition, the required side setback is 10 ft. The location of the new common lot line between Lot 1 and Lot 2 would leave more than enough side setback from the existing home. The proposed lots meet all zoning requirements. Water and sewer service to new Lot 1 would be from Hillview Road. Grading for the new home on Lot 1 would create swales on the west and north sides of the lot to direct drainage around the new home and keep it from neighboring properties. Drainage and utility easements are proposed around the perimeter of both lots. The preliminary and final plat, with notes, are illustrated on the next page overlaid on an aerial photo. The deadline for final action by the City Council per State statute 462.358 Subd. 3(b) is August 17, 2024 (a preliminary plat has a 120-day deadline; the final plat has a separate 60-day timeline).
