Attorney Karney stated that if the police are advised of certain times when it is worst, they can be in the area and cite for speeding or misdemenour careless idents could also get the license driving. She added the property owner at 8100 Groveland has requested to subdivide his property Jy and build a home on the lot, which necessitates action on the part of the City, and a decision on which direction to proceed in. Planner Herman reviewed the alternatives the City could take in purchasing the property. She explained the City has no plans at this time to extend Knoll - wood, and the issue at hand is whether or not to -.f. purchase this property. The Council could choose to do nothing, purchase 8100 Groveland, or purchase 8100 Groveland and property along Spring Lake Road. She added the Planning Commission has passed a resolution recommending the City purchase the y property and hold it in the event that Knollwood-, is extended in the future, and she explained there are methods of funding available that would re-1--bur-se the costs of the purchase of the property to the City. Donald Gross, 8060 Groveland Road, asked who would pay the assessments if the road is extended, and he -_ stated he would be against the extension if the -_ neighbors would be assessed, as it would present a severe hardship on some. Planner Herman explained only those who are benefitted ;. are assessed, and then only at the time of the benefit. Mr. Gross recommended the road be put through when commercial development comes in, and tie it into their property. Councilmember Hankner noted that if the Council makes the decision to purchase the property, they are not necessarily the Council that will be making the decision I� on what to do with it. 1,® ■ .:Y Mounds View City Council I March 14, 1988 Regular Meeting g Re , r U Page Three - 41 i! - Pat Rickaby, 8343 Groveland Road, stated she is opposed to the purchase of the property for a future street, as the storm sewer system in that area is already at capacity, which was determined in 1978 with the study done by the task force. She added that futher develop- ment in that area would only add to the problems. She also pointed out that at an informational meeting in 1986, it was brought out that there are a number of homes in the area who have had problems with basements caving in because the drain tile system was pulling sand in. Mayor Linke explained those problems were construction related, as the lines were not put in properly. Ms. Rickaby stated she felt the best solution would be prevention. =4 Mayor Linke stated that if 100 percent of the people along Rnollwood want the extension put in, the City `4' would be hard-pressed to deny it. Mr. Gross questioned whether the property was wide enough to place a house. Mayor Linke replied it was, with 75 feet being required by code. Planner Herman added that there is no reason F*.� to not approve a building permit for that lot. Greg Holly, 8192 Groveland, stated he is against the purchase of the property by the City, as the Citv would be holding property in reserve for future - development. He added he was at the Planning Commission meeting and was told there was no resolution on the City's books which requires 100 percent of the owners to sign the petition. Clerk/Administrator Pauley reviewed portions of Chapter 26, concerning requests for improvements, and what the criteria would be. Mayor Linke closed the public hearing and reopened the regular meeting at 7:32 PM. Clerk/Administrator Pauley stated the City Attorney has advised the City cannot delay the issuance of a building permit any longer, and it should either be issued or an offer made to purchase the property, to avoid being taken to court by the property owner. Councilmember Hankner stated she was hesitant to take any action this evening as other than the public hear- ing notice, people were not aware that action might be taken at this time. She stated she would like to table it until the next Council meeting, to allow time for input from people. [✓ - �------------ Councilmember Blanchard stated she felt they werele` getting a good deal of negative comments from people in the area, and she questioned whether the City should buy property with the idea that maybe someday they might change their minds. Councilmember Quick stated he knows that someday there will be development in that area, and if the City does not buy the lot, it would be like slamming the door shut. He noted there is a 12 inch water main under Groveland and they could set up a loop system for services. He added he agrees any action should be postponed to a time certain, and he also feels that in consideration of good planning principles, the City must buy the lot. Councilmember wuori stated she also believes in good planning practices but questioned whether the Council should gamble on whether it would be developed in the future. Mr. Gross noted that if the property is purchased, it will have a value at any given date in the future, and could be sold again, most likely for a profit. They will start by doing a pre -test of the survey in the next week, and then, if there are no problems, they would proceed with the full survey. Motion Carried 5 ayes 0 nays Park and Rec Director Saarion asked the Council for 21 direction on the Silver View Pond pathway, stating that two petitions have been received by the City, one in favor and the other against the path. She stated they are in the process of planning the summer work schedule for the park and recworkers, is approved, would like to coordinate work on the path, with the plantings that are going in there. Park and Rec Director Saarion stated Dan Boxrud from Short Elliott Hendrickson had reviewed the area and does not feel there would be problems with water on the pathway, but that certain conditions would have to be met in the construction and upkeep of it. rnuncilmember Quick noted that some residents in that area have a water problem in their back yards and asked if that was addressed by the City Engineer. Park and Rec Director Saarion replied it was not, as that part was in the forest, and Mr. Boxrud was taking into consideration the ponding area only. Councilmember Quick asked that the information be given to Mr. Boxrud for his review. Carol Golden, 7417 Parkview Drive, stated she has had Council members to her home to view the problem she has. She explained they have a constant problem with people going through their yard to get down to the pond, and the way their house is situated, it is very close to the proposed pathway. Councilmember Hankner pointed out the plantings are intended to mark the property line, as well as provide some screening. Discussion on Silver View Pond Pathway Mounds View City CouncilU !Regular Meeting J'�-�' ,,1. ------------------------ W-I -- - UVEa- Mayor Linke c:arified that the path can go right up to the property line, if it is decided on by the Council, and he also pointed out that the yards do not go down to the pond, as there is a City easement all the way around. He added the plantings will be between the path and homes to help mark the property line. He also explained they were not able to demand any additional access paths to be put in by the developer at the time development was going on. He also noted the path would be maintained by the City. Councilmember Hankner stated the plantings should help in keeping people on the park property rather than in the residents yards, and she added that she is con- cerned that it is actually feasible to put the path in. Bob Carpenter, 2650 Lake Court Drive, stated he has a problem with run-off and suggested putting in a plastic pipe, something along the line if drain tile, to let the water run out. Dave Radamacher, 7A21 Parkview, stated the land by him is very low a;... there is a natural drainage area there also, and with any sizeable rain, he has water standing in his yard, so he reit something wu"J :arc /to be engineered to handle that. Councilmember Hankner stated she would like to have the residents come in to talk and work things out, and have the engineer look at the plan and if it is feasible, determine the design. Park and Rec Director Saarion stated Mr. Boxrud has suggested bringing in a bobcat, and lower the areas that need it, and then landscape the area. She added that he had checked the area before the snow came. Councilmcmber Wuori suggestqd a bridge or some other means of aettinc over the wet areas would have to be built. It was noted there is a bridge already in the area in question. He added Short Elliott Hendrickson could probably do an analysis within 30 days. Randy Miller, 7409 Parkview Drive, asked if the engineer was out in 1987, how },e knew where the property lines were. He stated the City had marked the property in 1986 but not in 1987, and he would like to see a survey done this spring with markers nut in. Mayor Linke explained they would have to be done just for the plantings themselves. -" Jim Smith, 7427 Parkview Terrace, stated the west end of the pond did not have a path around it at one time, so there must have been a water problem there. Councilmember Quick stated the City is faced with possibly losing a good deal of space at Edgewood, so it would be beneficial for Staff to look into it. Councilmember Blanchard had no report. Councilmember- Blanchard Co•:ncilrember Hankner reported she had recently Councilmember received a call from a resident who -, .s interested in Hankner establishing an environmental quality review task force, and she stated that if there is a group of residents who are willing to devote their time, the City should utilize them. She added they could be a great benefit to the City. Councilmember Wuori has no report. Councilmember''> Wuori Mayor Linke updated the Council on the progress of the Mayor Linke fund raising for the Pinewood playground, reporting that they have raised $30,000 of their $50,000 goal so far. Motion/Second: Linke/Blanchard to appoint Gordon Fedor to the Police Civil Service Commission, to fill the vacancy through December 31, 1990. The.•e was no vote on the motion, as a tabling motion occurred later during discussion. Councilmember Quick stated he feels a position of this importance should be listed as an item on the agenda, and he stated he has had two people express interest in the position. He added that the Council has not interviewed Mr. Fedor, as is normally done. Councilmember Hankner added that she does not like to bring things up of this nature as a motion either, without them appearing on the agenda. Report of scheduling the rebroadcast of the February 27 work- Clerk/ Administrator shop with the consultant on wetlands for 7 PM on March 22, 23 and 24. He stated it would be listed on Channel 16. Clerk/Administrator Pauley reviewed the memo of March 14, 1988 from Public Works Foreman Ulrich regarding the necessity for replacing the exhaust system for the motor in Well #2. Planner Herman presented an overhead sketch of the area and reviewed the reasoning for designation of the municipal development district plan and the tax increment financing plans. She added the Planning Commission had passed a resolution on February 17, supporting the lax increment plan for this area. Pat Rickaby, 8343 Groveland Road, stated she is opposed to tax increment financing, and as in the words of one Planning Commissioner, she feels it is corporate welfare on the backs of the residents. She added she is opposed to this proposal based on the wetland that would be destroyed on the property, and she feels there would be a good deal of impact on the environment and wetland in the area. Mayor Linke clarified that there is no development proposed at this point. Planner Herman aLa"=.. there is no development agreement or approval of a project for this property, and that a budget has been proposed only for the purpose of receiving tax increment financing. Sandy Krough, 7827 Bona Road, asked what tax increment financing is. Mayor Linke explained it is a process of using future tax dollars, and the developer pays for it rather than the residents. He added the Council will not approve anything longer than 15 years. 6. Councilmember Hankner clarified that if development does not occur within a given time, it becomes void and the process must be started over again. Clerk/Administrator Pauley explained Mr. Miller owns 77 acres, and he would only be able to develop 33 acres, due to the wetlands. He added there is no DNR wetland designation but rather a municipal designation. Mayor Linke closed the public hearing and reopened the regular meeting at 7:27 PM. She reported that the Planning Commission had met on February 17 and denied a resolution to approve the consistency of the tax increment plan to the Comp Plan, as they felt this was not a good plan for that area, and they did not want a commercial plan there, and they did not feel it was in keeping witi the Comp Plan, with the spirit and intent in particular. Councilmember Wuori added that the Planning Commission had expressed concern with corporate welfare and subsi- dizing businesses, and the possibility of the State reversing itself on tax increment financing. Mayor Linke stated the Planning Commission was to decide if this was a viable project, and not the philosophical aspects of it. Planner Herman explained their denial was based on inconsistency with the Comp Plan on the spirit and intent. Councilmember Hankner stated she is concerned over the ka./business climate in the State and she feels it is very much a local issue, and there are ways municipalities can attract new businesses, with tax increment financing being one. Clerk/Administrator Pauley stated they had discussed the options open to Mr. Waste, but he had told Councilmember Blanchard that rather than withdraw his request, he would like the Council to take action on it and deny it if necessary. At the processing center a forklift, with a specially designed tipping mechanism , is used to transfer materials from the collection vehicle to preprocessing equipment. Above and beyond the normal improvements associated with the development (i.e., sidewalks, landscaping, parking), the Developer was directed cc install an additional parking area on site per the Development Agreement. In reviewing the site the extended parking area meets the plans submitted. Attached is a copy of his resume for your review. The unanimous recommendation of members of the interview panel to me was that Mr. Minetor be offered the position of Public Works Director/City Engineer. I also interviewed Mr. Minetor's current and former City Administrators in Wheatridge, Colorado and both gave me outstanding recommendations and evaluations of his performance. Based on these analyses and recommendations I contacted Mr. Minetor on the morning of March 16 to determine whether or not he would be willing to accept the position and he agreed to my preliminary offer of a starting wage of $40,000 per year with $1,000 per year increases at 3 and 6 months assuming acceptable performance. Also, I advised Mr. Minetor that he would be provided with a City vehicle for use while on City business as well as vacation, sick leave and group health insurance pursuant to the City's current personnel code. Mr. Minetor indicated that he would accept the position on those conditions with a starting date between April 18 and May 1 which would provide him ample opportunity to accomplish his move from Colorado as well as begin the sale of his home. As a side item to the main purpose for this memorandum, Mr. Minetor indicated in his interview that he had prepared the software for a pavement management program and street signage inventory nearly identical to that which the City of Mounds View has been negotiating a contract on with Short- G1110CC—pefW:ll: Rtl V11. Therefore, as a secondary recomen- dation and request I am recommending that the City Council authorize me to advise Short -Elliott -Hendrickson that we will not be entering into a contract with them for the MAYOR AND CITY COUNCIL PAGE TWO MARCH 16, 1988 pavement management study and indicating to them that the City of Mounds View will compensate them for any work they have performed in anticipation of our signing the contract. Also, I will be advising Mr. Boxrud that upon Mr. Minetor's assumption of the position of City Engineer we will no longer be having Short -•Elliott -Hendrickson and Mr. Boxrud continue to serve in that position. One of the most beneficial new features is an interface to the Fund & Budget Accounting System (FBA). This interface generates accounting entries from the Payroll System to the FBA System. Presently these entries are performed manually. The savings in time from this feature alone would pay back the cost, of the system in a short time.
