STATE OF MINNESOTA
AMENDING THE MUNICIPAL CODE OF MOUNDS VIEW BY AMENDING
CHAPTER 40 ENTITLED, "ZONING"
The Council of the City of Mounds View does hereb"
ordain!
SECTION I. Chapter 40.07, Joint Facilities,
Subdivision J(21, shall be amended as follows!
ter (f) Conditions required for joint use:
1. The building or use for which application is
being made to utilize the off-street parking
fac;'.ities provided by another building or use
sha.. be located within three hundred (300) s
feet of such parking facilities and not
separated by a public way.

2. The applicant shall show that there is no
substantial conflict in the principal
operating hours of the two (2) buildings or
uses for which joint use of off-street parking
facilities is proposed.
3. F properly drawn legal instrument, executed by
the parties concerned for joint use of
off-street parking facilities, July approved
as to form and manner of execution by the City
Attorney, shall be filed with the City
Clerk -Administrator and recorded with the
Registrar of Deed, Ramsey County.
SECTION III. This ordinance shall take effect thirty
(30) days after the date of its publication.

Motion by:
WHEREAS, pursuant to Resolution of the City Council of
Mounds View, adopted Resolution No. 2351 , the Special
Assessments for the Construction of Auditor's No. 04S1 , were
levied against the attached list of described properties, said
list made a part herein:
And WHEREAS, the above mentioned properties have been
conveyed or replatted and are described according to the attached
iist, and said list made a part herein:
NOW, THEREFORE; BE IT RESOLVED BY THE CITY COUNCIL of
Mounds View, that the assessments for Auditor's No. 0431
against 'he heretofore mentioned properties be correctly
certified to the Auditor of Ramsey County for further collection
in the amount stated on the attached list, said list made a part
herein.

The City Council of the City of Mounds View does
hereby ordain:
SECTION I. The Wetland Zoning District Map as n
established in 48.15, Subdivision 1, of the Municipal Code,
is hereby amended by redeltneating the wetland boundary for
Wetland I.D. No. 1-21 as per the attached exhibit.

AMENDING CHAPTER 40 ENTIT.LED, "ZONING"
The Council of the City of Hounds View does hereby ordain:
SECTION I. 40.10, Subd. C, shall be amended as follows:
f21 (1)Accessory buildings such as garages or tool houses,
sheds and similar buildings for storage of domestic
supply and noncommercial recreational equipment.
{}+ a, Private garages, parking spaces and carports as
regulated by Section 40.07 (Off -Street Parking) of
this Code. Private garages are inte.,ded solely f -
storage of the private passenger vehicles of the
residents of the premises. Such spaces can be
rented to nonresidents of the property for private
passenger vehicles and/or non-commercial vehicles,
trailers, or equipment if sufficient off-street
parking is in full compliance with this Code is
provided elsewhere on the property.

more than one (1) private garage for each dwelling.

It was noted Councilmember Blanchard was absent.
ALSO PRESENT: City Attorney Meyers, Clerk/Admini-
strator Pauley and City Planner Herman.
CC Gerry Nelson, project director with "Celebrate 90" 4. Presentation :-`
/ gave a slide presentation and introduced the audience of "Celebration

Mary Bradley thanked the Council and City and School
District for their very good support.
After recessing, the Council reconvened at 7:31, at which
time Public Works Director Minetor was present.
Senator Novak reviewed tax changes which were occuring 5. Presentation

Representative Knuth updated the Council on the land
transfer which had taken place at County Road H and
Highway 10, which will allow realignment of Old Highway
8 for a smoother flow in traffic and to assist with
conjestion in that area. He also updated the Council
on pipeline legislation, as well as reporting there is
no further study or action planned for the airport.
Representative Voss reported he had been closely
involved with the tax bill, and not only will City
government do well, but the residents will also,
with nearly $1.8 million in credit ppproved for the
next biennium. He also reported he has not received
a noise complaint for the airport in the past year,
as a result of the successful movement of the runways
one-half mile further from the City, and with the
limitation of the airport as a minor airport. He
reported the Highway 10 relocation should be completed
this fall, which should relieve congestion for residents
in the area.
Councilmember Hankner informed the Senator and Represen-
tatives that the Council will be meeting with the school
district superintendent and business manager the evening
of Cune 30, to get a better understanding of their
budgeting process. She invited them to join the meeting,
and stated other Cities had been invited also. �1
Mayor Linke and the Council thanked Senator Novak and
Representatives Knuth and Voss for their time with the
Council.

would be placed in the area, that it would be filled,
leveled and sodded, with picnic tables, horseshoe pits
and such established.
Councilmpmber Hankner asked if the City had given itself
a wetland alteration permit before.
Clerk/ldministrator Pauley replied they hadn't, but they
have given them to residents.

grant is, and that the City is asking for a biking or
hiking trail to loop around at Silver View Park. She
explained where the funding would come from, and that
it would be an 8' bituminous pathway, which would be
compatible for both walking and biking.

Park and Rec Director Saarion reviewed the history 15. Consider^n
of the proposed completion of the pathway at Silver of Propps to
View Park, and the meetings that have been held and Complete

Councilmember Hankner reported Staff had met with
a group of residents on May 27 to.discuss the exten-
sion of the pathway, and based on'that discussion,
she was ready to make a mution to direct Staff to
proceed with the work.
Mayor Linke stated he was concerned at this time with
the cost and replacement factors of using ag lime, as
was being recommended, over wood chips, and he would
prefer to stay with wood chips.
Councilmember Hankner replied the majority of the
residents are concerned with the use of wood chips, as
they blow and make more of a mess, whereas ag lime would
offer the asthetic value the residents would like to
hava. She also stated they must consider the water flow
in the area, and she feels this would be a good compro-
mise for all involved.
There was discussion on the merits of ag lime versus
wood chips and where it fits into the ;jroject.
Councilmember Wuori expressed concern with ag lime
washing into the lake and possible contamination pro -
:,lens. She also expressed concern with the park getting
hodge-podge for th= trail system.
Dave Radamacher, 7421 Parkview Drive, stated the Park
Board would be meeting next week to discuss the lake,
and he would rather see ag lime used as it is less
threatening than wood chips, and he suggested considering
ag lime for the remainder of the park.
Motion/Second: Hankner/Linke to direct Staff to begin
the EPleIaentation of the continuation of the development
of the path around Silver View Pond, according to the
planning discussion with the residents and Staff on
May 27, st

detailed plans to the residents and City Council prior

Councilmember Blanchard asked for an update on the

recycling program.
City Planner Herman reviewed the statistics from
the first pick-up, with 11.4 tons being picked up
from 322 households, which represents 7 percent of
the City. She stated the majority of what was picked
up was newspapers, and they hope for better participa-
tion next week.
Councilmember Hankner asked if there was another way,
cther than a brochure, to remind people how to sort,
and she suggested an insert in the water billing, which
people could post on their refrigerator door.
City Planner Herman stated they hope to send out a
flyer within the next few months, perhaps using the --
Boy Scouts to deliver it. She added it would not be
possible to send it with the water billings, as those
are postcards, and the postage cost would increase if
they changed the format.

® Councilmember Blanchard reminded everyone of the 30th
�P Anniversary kick-off, with the free dance at the Bel
Rea Ballroom, with the purchase of a button, where
Staff and the Council will be the waiters and waitresses.
Councilmember Hankner asked if dates of the next
School Board meetings were available.
Clerk/Administrator Pauley replied the dates of July
26, 27 and 28, and August 2, 3 and 4 have been pro-
posed by the School -jard, and the Council is to
choose two or three, then the Board will select the
final date. The Council agreed on July 28 or August
2. Clerk/Administrator Pauley will get back to them
with those dates.
Councilmember Hankner asked for a clarification of
the resolution the Council had passed on June 27
regarding the County Road J access. Clerk/Admini-
strator Pauley explained the resolution gives
recommendations but leaves the final decision up to
MnDOT.
Councilmember Hankner reported five of the nine
Positions on the Environmental Quality Task Force
rr have been filled, and she would like Public Works
j� Director Minetor to set up the first meeting and get
them started, and have them get their organizational
details established. She added she has received one
further application, which she has with her tonight,
and has two others that are not with her.
It was the Council's determination to wait and look
at all the applications at the next meeting.
Councilmember Wuori apologized on behalf of the Mounds
View Community Theater Board for the misprint in the
City newsletter regarding ticket prices. The correct
prices are $5 for students and senior citizens, and
$6 for adults.
Councilmember Wuori stated she feels it would be
appropriate to have the Environmental Quality Task
Force begin work on the drought situatio,,, by investi-
gating it and looking into conservation methods and
what other cities are doing. She stated this informa-
tion needs to get.back to the citizens so everyone can
work toward improving the situation.
It was the recommendation of the Council that the
Environmental Quality Task Force look into the drought
situation and come up with recommendations on what the
citizens of Mounds View can do.

The Minnesota Department of Transportation is proposing a project
to revise and upgrade the signals on T. H. 10 at the above
referenced locations. These revisions include additional overhead
signal heads and improved coordination. The coordination scheme
will also include the signal at Woodale Drive. The City is
involved in 2 of these intersections, Red Oak Drive and County
Road H-2. These are both MSA routes and the City may designate
MSA funds to cover our costs.
The City's portion of the costs at each of these 2 intersections
is 25% of the overall cost. The participation is based on the
number of 'legs, under jurisdiction of the city. The overall cost
of the project at Silver Lake Road / Red Oak Drive is $90,000 and
the overall cost at County Road H-2 is $45,000. The city's
portion of these costs is a total of $33,750. In addition to the
cost of this construction, the city will also be responsible for
the cost of electricity to operate these signals. Ramsey County
will be responsible for the maintenance of these signals. This is
not a change in the electrical and maintenance responsibilities.
Staff recommends use of MSA funds for the City's share of the
construction costs for this project and suggests the Mayor and
Clerk -Administrator be authorized to execute any necessary
agreements for this project.

As the law deals with four basic areas affecting

credit, local government aid, and levy limits, we will divide
this memo up into these four sections and an analysis of the
anticipated impacts on Mounds View.
Property Taxes
The 1988 omnibus Tax Law retained the property classifications
and their tiers set up in 1987, but replaced the classification
ratios for them with a new set of tax capacity percentages.
Under the old system (ore 1989), the estimated market value of a
piece of property was multiplied by the ratio set up £or
property's classification. Under the new system, the estimated

Homestead Credit
Homestead Credit will be retained for taxes payable 1989 with an
increase in the maximum allowance from $700 to $725 per
homestead. Beginning in 1990 homestead credit will be replaced
by "transition aid" which will roughly equal what was received by
the local unit as homestead credit in 1989 minus 38. For 1991
and beyond, transition aid will continue to be paid to local
units, but frozen at its 1990 level.
Homestead credit will continue to be shown on property tax
statements, even though it is eliminated beginning in 1990.
Local Government Aid (LGA)
The LGA formula for 1989 and beyond has been drastically changed
from the past formula and has, in the opinion these authors,
become more complicated. Suffice it to say that there are now
three steps used in determining the amount of LGA to be received
by a city.
The basic LGA formula determines the level of aid as being equal
to $160 plus the product of $150 multiplied by the base 10
logarithm of the city's most recent household estimate with the
logarithm. reduced by 1. The law provides for a minimum increase
of 28 of the 1988 LGA and a maximum of 99 of the combined 1988
levy and LGA or the lesser of 20% of the 1988 levy or initial aid
amount.
For cities over 2,500 in population and generally having a below
average tax capacity ($1,900 per household is average), an
alternative LGA Formula is used. The formula used in determining
the amount of alternative LGA and amount of funds distributed
state-wide is shown on Exhibit D. As shown on Exhibit E, the
City of Mounds View will receive a $229,541 or 40.33% increase in
LGA using the Alternative Formula ($71,883 more than with the
basic formula) for a total 1989 LGA allocation of $798,687.
The third LGA formula is an add -on to the base LGA a city
receives as a result of one of the first two formulas. This is
called Disparity Reduction Aid and is provided mainly to areas
where total mill rates exceed 128 mills excluding mills due to

school debt and school referenda. This special aid is the basis
for the Municipal Legislative Commission's legal challenge to the
1988 Omnibus Tax Law.
Anticipated Impacts on Mounds View
It is not too difficult for us to compute the amount of our 1989
levy given that we have all of the information necessary and we
know what our 1989 LGA will be. The only assumption necessary is
for population or household growth which we estimate to be 2%.
Exhibit F illustrates the computations necessary to determine our
1989 levy. If our assumption on growth is correct, the City
should have a levy limit of $1,054,250 which is $123,339 less
than the 1988 levy limit while having a $36,332 increase in
property tax and LGA revenues. This decrease in levy and
increase in revenues results from two factors. The first is that
the $135,000 increase in the 1988 levy authorized by the
Commissioner of Revenue is a permanent part of our base. The
second is the $229,541 increase in LGA. The LGA increase offets
the $135,000 increase in levy and the adjustments for inflation
and growth with money left over.
It is likely based upon the above information and the increase in
homestead credit benefits that the City's portion of the 1989
property tax bill will decrease. This assumption does not allow
for any increased valuations in existing structures or new
valuations due to new construction.
We hope that the above information adequately responds to any
questions you might have. We will be present at the July 18th
Agenda Session to discuss this with you in detail if you so
desire.

SUBJECT: EDGEWOOD DISTRICT DRAINAGE PLAN EXPENSE
Attached please find a letter from Dan Boxrud of Short -
Elliott -Hendrickson, Inc. indicating that the cost for
preparing.the plan for the Edgewood Drainage District
exceeded the not to exceed agreement of $10,000 by $4,908.45
for a total project cost of $14,908.45.
Mr. Boxrud requests the consideration of the City of Mounds
View in paying the additional expenses as they feel they had
to perform additional work in order to develop a plan
consistent with the City's policies regarding the
preservation of wetlands, the City's Wetlands Ordinance, and
state and federal regulations on wetlands.
I am not aware that any extra work was required by the City
for this project, however, I must admit that the quality of
the report that was provided and the work that they proposed
exceeded my expectations and definitely met all of the
previously mentioned considerations regarding wetlands.
Although I am not pleased with the fact that SEH exceeded
the not to exceed price without advising the City, it is my
opinion that the work done is well worth the price
requested. Should Council agree with this conclusion, I
will place the item on your July 25th Agenda for payment,
however, payment will be made to Short -Elliott Hendrickson
with a letter from me advising them of our displeasure with
their exceeding the contract price without first advising us
of that fact and requesting approval.
Your direction in this matter would be greatly appreciated.

Dear Don:
We were authorized to perform the Edgewood District drainage plan
at an hourly rate not to exceed $10,000. Our original estimate
for the work was on the order of $9,000 to $10,000.
( Having reviewed the plan yourself along with the City Council,
you are aware of the extra work we had to perform to make the
drainage system work in this area. Due to this extra work, our
final costs now amount to $14,908.45 as can be seen on the
attached invoice. Although our work was being performed on an
hourly rate with a not to exceed figure of $10,000, we would
appreciate it if the City would consider additional compensation
to cover the extra work. I think you will agree that the product
the City received is worth the fee incurred.
Based on our experience with this project, our proposal for the
work on the Arden Avenue drainage area was purposely made as a
two phase proposal so that the total engineering fee could be
better estimated after initial review and analysis, y
We would appreciate it if the City of Mounds View could consider
reimbursing SEH for the additional fee on this project. We would

SUBJECT: TAKE HOME VEHICLE FOR PUBLIC WORKS FOREMAN
Recently Public Works Foreman Mike Ulrich suggested that it would
be appropriate for him to be authorized to take:his vehicle home
for use in responding to after hours callouts as he is the #2
person on the callout list when the person carrying the beeper
does not respond to a call.
As some of you may recall, when Larry Decheine was Public Works
Superintendent and Gary Kardell was Public Works Foreman, both of
those individuals had take home vehicles. In response to
Mr. Ulrich's request I asked that he conduct a survey of cities
in the area of Mounds View to determine their policies with
respect to take home vehicles. Attached is a copy of the survey
and you will not that where take home vehicles are allowed, the
City Engineer, Public Works Director or Foreman are the
individuals most frequently being provided with a take home
vehicle.
This matter was discussed in great depth with the Department Head
-
Team at the June 28th Department Head Meeting and it was
concluded at the end of this discussion that the provision of a
take home vehicle to Mr. Ulrich would be both reasonable and in
compliance with the current policy on the use of vehicles by City
employees as outlined in Resolution No. 1387, copy attached.

Under Section I., A., the policy states that, "only City
}
employees whose responsibilities, duties, and functions require
their being subject to emergency calls outside of normal working
hours, shall be authorized to use a City vehicle on a 24 hour

basis." As a result of discussions with Mr. Ulrich, City
Engineer Minetor, and the Department Head Team it would be my
recommendation. that Mr. Ulrich be authorized the use of the City
vehicle he is currently assigned during working hours for use on
a 24 hour basis. Obviously, Mr. Ulrich would not be able to use
the vehicle for personal reasons and authorization for 24 hour
use of the vehicle could be rescinded at any time.

RESOLUTION AMENDING RESOLUTION NO. 1119
ESTABLISHING A VEHICLE USE POLICY
FOR ALL CITY OF MOUNDS VIEW VEHICLES
WHEREAS, the City Administrative Code establishes policies
relating to the•use of any vehicle for City business and sets
forth regulations and procedures for both City owned and pri-
vately owned vehicles operated on City business; and
WHEREAS, it is often necessary for City employees to have
City vehicles available to them in order to carry out their
duties and functions; and
WHEREAS, it is the desire of the City Council to limit the
use of privatley owned vehicles for City business to times when
a City vehicle is not available or exceptional circumstances
exist; and
WHEREAS, all City employees operating any vehicle shall do
so in a safe and efficient manner and shall avoid any actions
which may damage or otherwise impair the vehicles operation.
NOW; THEREFORE, Be It Resolved that the following policy
shall be in effect for all City employees while operating City
vehicles,
I. Assignment of City Vehicles
A. Only City employees whose responsibilities, duties, and
functions require their being subject to emergency calls
outside of normal working hours, shall be authorized the
use of a City vehicle on a twenty-four (24) hour basis.
B. The Clerk -Administrator may authorize other employees the
temporary use of City vehicles on a twenty-four (24) hour
iiasis during emergency conditions or at times demanding
unusual hours due to peak maintenance requirements.
C. City pool cars will be assigned to City Departments for
their use, however, such assignment shall not prohibit
the use of the vehicle by other City employees when said
vehicle is not required by the personnel of the assigned
department.

II. Permitted Uses of City Vehicles
A. The rules listed below shall be followed by a City
employee operating City vehicles during normal working
hours.
I. City vehicles may be used for City business only.
2. Only City employees are permitted to operate City
vehicles.
3. Only authorized persons are permitted to ride in
City vehicles. Authorized persons are all City
employees and other persons at the time engaged
in business or civic activities important to the
City's interests,
B. The rules listed below shall be followed by all City
employees operating City vehicles outside of normal
working hours.
1. Vehicles shall be operated only on official City
business related to the employees normal job or
for transportation to and from meetings, schools,
conferences, etc., when Pri_'or 'a 'oval has been
obtained from the Clerk -A n�in si s trator.
2. City vehicles are to be driven to an employee's
home for storage only upon ''a 'oval b the Clerk -
Administrator. City vehicles tacen to an emp oyee's
ome or storage in the evening shall not be used
for other than official City business.
III. Use of Private Vehicles for City Business
A. Employees will be reimbursed for the required use of
Private vehicles for City business according to the
following procedure.
1. Use of private vehicles for City business shall
be limited to those times when City vehicles are
not available and the employee is authorized to use
his vehicle by the Department Read or Clerk -Admini-
strator (unless on emergency circumstances).
2. The employee will submit a personal expense claim'
indicating, at a minimum, date of travel, destination,
miles traveled, and reimbursement required to his
Department Head who will verify the claim. Personal
expense claims for mileage will be submitted to the
Clerk -Administrator's office on a regular basis.
3. All City employees will be reimbursed for the afore- C -t
mentioned transportation at a rate to be established '�

annually by the City Council plus other documented
charges for parking, etc. Reimbursement will occur
after Council approval of the claim, which normally
will occur at the Council meeting after the claim
has been submitted.
IV. Disciplinary Action
A. Employees are required to observe traffic laws and safe
practices at all times while operating a City vehicle.
Any abuses of this policy will be cause for disciplinary
action that sh,3.1 be determined by the circumstances of
the abuse.

BUILDING A
The construction of Building A also known as the Clinch -
On building in Mounds View Business Park has been completed
and the developer, Everest Construction Company, has
requested that the City issue an Occupancy Permit.
As a result of this request, I requested that Building
Official Jim Tobias and City Planner Kim Herman inspect the
project and determine whether or not it is in compliance
with the plans and specifications submitted and approved as
part of the Development Agreement. This inspection resulted
in a determination that the building was completed per the
plans and specifications, however, not all trees had been
planted pursuant to these plans and the sodding of the banks
of the storm water retention pond on the east side of the
site had not occurred. Attached please find a memorandum
from Building Official Jim Tobias indicating the current
status of the construction of the building.
��. In response to our determination that the project was not
completed per plans, Mr. Rick Baker of Everest Construction
advised the City by letter, copy attached, that the
boulevard trees had initially been proposed to be planted at
30 feet off center but that the landscaper for the project
felt that the spacing would be too close and the plans were
changed to 40 feet on center resulting in a net shortfall of
11 trees. Mr. Baker proposes that once the entire project is
completed, Everest would be willing to plant additional
trees around the ponds and along Highway 10 to compensate
for these adjustments. Mr. Baker also advises that due to
the current dry weather sodding of the banks of the storm
water retention pond was determined to be inadviseable and
that they will agree to complete the sodding by October 1st
of this year.
In light of this information and the promisory statements
made by Everest Construction regarding the two
inconsistencies, Staff recommends that the Council authorize
the issuance of an Occupancy Certificate for. Building A with
the following contingencies.
1. The sodding of the banks of the storm water
retention pond on the east side of the building be
completed by October 1st of this year.

buffer area. The developer's engineering firm, Merila &
Associates, has supplied a map which illustrates the boundary
change (previously issued to the Council) which was reviewed and
agreed upon by Barr Engineering, Army Corps of Engineers, and
Ramsey Soil and Water Conservation District. This amendment
would change the City's official map to reflect this: boundary
change.
