Chair Farmer explained the statement on Page 4 under Item C regarding the transportation
conference was made by Commission Larson and not Commissioner Nelson.
Commissioner Nelson requested a change to his comment under Item 7A, noting Abiding Savior
Church should be changed to ___________ Church.

7. Planning Cases
A. Resolution 1183-25 Recommending Approval of an Ordinance Amending the
Zoning Code Relating to Public Hearing Process in Mounds View Code
Phil Carlson, Stantec, stated the City Council has directed staff to prepare amendments to the
City Code so that public hearings for zoning and subdivision requests are heard in front of the
Planning Commission vs. the City Council. It was noted the City Attorney has prepared the
proposed ordinance to accomplish this, amending several individual sections of the zoning code.
He commented further on the proposed ordinance amendment and recommended the Planning
Commission approve the Resolution as presented.
Commissioner Stevenson stated he had a concern regarding Section 151. He did not believe the
Planning Commission should hear the public hearing for displaced residents. He recommended
the City Council should oversee this matter and hold the public hearing. Mr. Carlson indicated he
could delete this section of the draft ordinance to allow this matter to be reviewed by the City
Council.
The Commission supported this recommendation.
Council Member Gunn stated the City Council has yet to review this ordinance.
Commissioner Stevenson supported action on this item being tabled in order to allow the City
Council to review this ordinance. Mr. Carlson stated this would be an appropriate action.

Resolution 1183-25 to allow the City Council to review the ordinance amendments.

B. Resolution 1184-25 Recommending Approval of an Ordinance Amending the
Zoning Code Relating to Off-Street Requirements
Phil Carlson, Stantec, stated the City Council has asked that the Planning Commission review the
parking regulations in the Zoning Code for commercial uses. These issues were reviewed at the
May 7 Planning Commission meeting where the Commission directed staff to prepare Zoning
Code amendments to accomplish the changes in various standards. The parking ratios are in a
table in the Zoning Code in § 160.342 SCHEDULE OF OFF-STREET PARKING
REQUIREMENTS. That table is recommended to be revised as in the proposed draft ordinance
with strikeout and underlined text. Staff commented further on the request and recommended
the Planning Commission approve the Resolution as presented.
Chair Farmer appreciated how this ordinance amendment would bring the City in alignment with
other communities when it comes to parking.
Commissioner Stevenson stated he supported the proposed changes.
MOTION/SECOND: Commissioner Stevenson/Commissioner Urlacher. To approve
Resolution 1184-25, A Resolution Recommending Approval of an Ordinance Amending the
Zoning Code Relating to Off-Street Requirements.

C. Land Use Table Discussion
Phil Carlson, Stantec, stated one of the key features of the Zoning Code is the list of permitted,
conditional and accessory uses in each zoning district. In the Mounds View code these are listed
as text in the sections on each zoning district. For example, the lists of uses in the R-1 district are
in Sections 160.086, 160.087, and 160.088; for the R-2 district they are in Sections 160.102,
160.103, and 160.104. Many cities summarize the uses in a table, either instead of the text or in
addition to the text – it is a much easier and more convenient way to find the various uses. There
has been discussion in Mounds View about including such a table in the Zoning Code. This
memo introduces that idea for the Planning Commission.
Mr. Carlson explained transferring the various uses in the Mounds View Zoning Code text to a
table may seem like a simple exercise, but it quickly became complicated. The reason is that
many of the uses have descriptions or standards listed under them. Including all this extra
information in the table would be cumbersome. For example, the list of permitted uses in the R-1
district is included on the next page – most of the uses have some kind of explanation or standard
associated with the use. The same is true for many of the other districts. If the standards are listed
within each cell of the table, the table would be very long, perhaps 20 pages. If the standards are
referenced in footnotes at the bottom of the table, that list too would be very long.

Mr. Carlson suggested therefore that the table not try to include all this information in the table
itself, but rather list the basic uses in the cells of the table and have a column on the right side of
the table that indicates there are standards in the Zoning Code text that should be consulted. The
table would be a convenient tool, but not a substitute for the full text of the ordinance. We have
also grouped the uses by general category, such as Residential, Loding, Commercial and Retail,
etc. There are two places, highlighted in yellow in the table, where there is more to do to clearly
understand and convey the information – this is a work in progress. This is a discussion item
only, and we welcome the Commission’s comments and suggestions. If there is consensus on
how to handle such a table we will come back with an ordinance amending the Zoning Code to
include the table for the Commission’s consideration and ultimate adoption by the City Council.
Staff commented further on the Land Use Table and requested feedback from the Planning
Commission.
Commissioner Nelson stated his only concern with the table was the last column on the right
because the answer for every line was yes. Mr. Carlson explained this column was not in final
form just yet.
Commissioner Nelson thanked staff for all of their efforts on this table. He encouraged staff to
double and triple check the information on this table before coming to the Commission and City
Council for approval. Mr. Carlson indicated he would review the information, along with staff
and the City Attorney.
Further discussion ensued regarding what would happen if the table had a misrepresentation of
City Code.
Chair Farmer stated he supported the City having a table of convenience rather than an adopted
table. Mr. Carlson indicated this would mean an ordinance would not be required and staff could
create the table as a tool for staff.
The Commission supported moving in this direction having the Land Use Table serve as a tool.

Assistant City Administrator Beeman reported the City Council would be discussing detached
ADU’s at their Monday, June 2 worksession meeting and the Planning Commission was invited
to attend this meeting.
B. Reports of Council
Council Member Gunn provided the Planning Commission with an update from the City
Council. She explained the Council approved three new chicken-keeping licenses. She reported
the Council received an update from the Police Chief on Quarter 1 and noted the Flock cameras

were doing great things in the community. She was pleased to report the police department was
back on Facebook. She indicated the splash pad should be opening on Friday, May 23. She
explained a Juneteenth community picnic and celebration would be held at Silver View Park on
Friday, June 20 from 5:00 p.m. to 8:00 p.m. She reported the city-wide garage sales would be
held June 5 through June 8. She noted Movies in the Park at City Hall Park would be held in
August and an ice cream social would be held in July.

attend Planning Commission meetings due to his health and has resigned his position.

Code Relating to Public Hearing Process in Mounds View Code
MOTION/SECOND: Commissioner Munson/Commissioner Nelson. To remove this item from
the table.

Evan Monson, Stantec, stated the City Council directed staff to prepare amendments to the City
Code so that public hearings for zoning and subdivision requests are heard in front of the
Planning Commission instead of with the City Council. The City Attorney prepared a draft
ordinance to accomplish this, amending several individual sections of the zoning code. The
Planning Commission initially reviewed this at the May 21st Planning Commission meeting and
tabled it for further review. The Planning Commission and City Council reviewed the item at a
joint workshop held during the Council’s June 2nd work session meeting. The consensus was
that the Council shall continue to hold public hearings for manufactured home park closures,
while other requests as outlined in the initial draft ordinance would have a public hearing at the
Planning Commission meetings. Staff commented further on the request and recommended the
Planning Commission recommend approval of the Ordinance amending the Zoning Code related
to the Public Hearing Process.
MOTION/SECOND: Commissioner Nelson/Commissioner Munson. To recommend the City
Council approve an Ordinance amending the Zoning Code relating to the Public Hearing Process
in Mounds View City Code.

Assistant City Administrator Beeman discussed upcoming planning cases with the Commission,
noting there would be a Planning Commission meeting on July 2. He reviewed the process that
would be followed in order to fill the vacant Planning Commission seat and noted staff had three
applicants to interview for this position.
B. Reports of Council
Council Member Gunn provided the Planning Commission with an update from the City
Council. She discussed how the zipline would be moved from Hodges Park to Silver View Park.
She reported the City Council adopted an ADU ordinance and approved the electrical/concrete
work for the Tribute Park. She was pleased to report Gary Rundle has been chosen as Citizen of
the Year. She than read in full for the record a Resolution of Appreciation that would be
presented to Commissioner Gary Rundle at the next City Council meeting.

Item Title/Subject: Detached ADU Zoning Amendment
Request: Zoning Code Amendments
Introduction:
The City Council directed staff to review the regulation of accessory dwelling units (ADUs).
Under the existing code, ADUs are permitted only when they are attached to an existing single-
family residence. The city code refers to these as and ADU (addition) or an ADU (internal), see
the figures from § 160.087 and 160.088 of the city code below.

An ADU (internal) is a permitted accessory use, while an ADU (addition) is a conditional use
under the current code. Detached ADUs are currently not permitted, though the city previously
reviewed allowing detached ADUs in both 2016 and 2023. In 2023, the Planning Commission
recommended amending the City Code to allow detached ADUs as a conditional use. Due to a
vacancy on the Council at that time, further consideration was tabled. The Council recently
expressed renewed interest in revisiting whether detached ADUs should be permitted within the
city.
Work Session:
The City of Mounds View convened a work session on June 2, 2025, that included participation
from City staff, the Planning Commission, and the City Council. There was extensive dialogue
regarding the potential allowance of detached accessory dwelling units (ADUs), including a
review of practices in peer and neighboring municipalities, as well as the broader implications of
permitting or prohibiting such units. Following this discussion, there was consensus in favor of
allowing detached ADUs as a conditional use, subject to the review and implementation of
specific standards and conditions.

City Code:
§ 160.088 CONDITIONAL USES lists the conditional uses permitted in the Single-Family
Residential (R-1) district. The land use classifications in Mounds View follows hierarchical
zoning, where all the uses listed in the R-1 district are also allowed uses in the R-2, R-3, and R-
4 districts.

If allowing detached ADUs, staff would propose a new subsection with standards specific to
detached ADUs. The proposed draft would make these a conditional use in the R-1, R-2, R-3,
and R-4 districts.
The draft ordinance is based on the current requirements for accessory buildings (160.087(A))
and ADU (internal) (160.087(J)) in the city code, the draft ordinance prepared by city staff in
2023, as well as research by current staff on neighboring communities. Staff have included
excerpts from the draft ordinance in italics below for the commissioners to further consider, with
staff comments following.
• One detached accessory dwelling unit may be located on a lot occupied by a single-
family home. The lot must comply with minimum dimensional standards.
o Only one accessory dwelling unit, whether as an addition, internal, or detached,
shall be permitted on a lot.
o Does the commission want to allow multiple ADUs on the same lot?
• An accessory dwelling unit (detached) shall have a minimum gross floor area of 300
square feet and a maximum gross floor area of 50% of the primary residence.
o The footprint of an accessory dwelling unit (detached) shall count towards the
maximum area allowed for accessory buildings as specified in §160.087(A)(2).
o What size does the commission think is appropriate? For reference, an ADU
(addition) is limited to 800 SF of gross floor area. Neighboring communities
typically limit the size to a percentage of the primary residence.
• An accessory dwelling unit (detached) shall have a minimum setback from side and rear
lot lines of five (5) feet, and shall not be located within a front yard.
o Staff presume the commission would not want these within the front yard
(between a house and the road).
o Staff would recommend consistent setbacks like other detached accessory
structures (such as garages), this would allow for an applicant to have an ADU
within or above a detached garage.

The Planning Commission has the following options for this item:
1. Recommend the Council approve of the amendment, with or without changes.
2. Recommend the Council deny the proposed amendment, with findings for denial.
3. Table the proposed amendment for further review/study.
Recommendation:
Unless the commissioners have any changes, or want to review the item further, staff
recommend the Planning Commission recommend approval of attached draft ordinance 1045,
amending §160.088 of the city code.

STATE OF MINNESOTA
AN ORDINANCE AMENDING TITLE XV, CHAPTER 160 OF THE MOUNDS VIEW
MUNICIPAL CODE ON STANDARDS RELATING
TO DETACHED ACCESSORY DWELLING UNITS
The City of Mounds View Ordains:
Section 1. Background; authority.
1.01. The city of Mounds View (“City”) has adopted a zoning ordinance pursuant to the
authority granted by the Municipal Planning Act. M.S. §§ 462.351 to 462.365,
inclusive, as they may be amended from time to time.
1.02. Sections 160.450 and 160.451 of the Mounds View Zoning Ordinance detail the
process and requirements for amending the zoning code.
Section 2. The City Council of the City of Mounds View hereby amends Title XV: Land
Usage, Section § 160.012 by adding the underlined as follows:
§ 160.012 DEFINITIONS.
DWELLING UNIT, ACCESSORY. A dwelling unit that is located on the same lot as a
single-family dwelling to which it is accessory, and is internal, an addition onto the
principal dwelling, or detached from the principal dwelling.
Section 3. The City Council of the City of Mounds View hereby amends Title XV: Land
Usage, Section 160.088 by adding the underlined material as follows:
(I) Accessory Dwelling Unit (detached)
1) One accessory dwelling unit (detached) may be located on a lot occupied by a
single-family home. The lot must comply with minimum dimensional standards.
a) An accessory dwelling unit (detached) shall not be permitted on a lot that has an
accessory dwelling unit (addition) or accessory dwelling unit (internal).
2) The single-family home or the detached accessory dwelling unit shall be occupied by
the property owner. The property shall be homesteaded.
3) An accessory dwelling unit (detached) shall have a minimum gross floor area of 300
square feet and a maximum gross floor area of 50% of the primary residence.
a) The footprint of an accessory dwelling unit (detached) shall count towards the
maximum area allowed for accessory buildings as specified in §160.087(A)(2).
4) The exterior design of the accessory dwelling unit shall be consistent with the
character of the single-family home.
5) An accessory dwelling unit (detached) shall not exceed eighteen (18) feet or that of
the principal structure, whichever is less, in height.
6) An accessory dwelling unit (detached) shall have a pitch or slope of at least 2-12,
but no steeper than 12-12. Rounded, dome or geodesic dome roofs are not allowed.
7) An accessory dwelling unit (detached) shall have a minimum setback from side and
rear lot lines of five (5) feet, and shall not be located closer to the front lot line than
the single-family home.
8) A minimum of one off-street parking space shall be provided for the accessory
dwelling unit.
9) Accessory dwelling units shall be licensed as a rental dwelling, and comply with Ch.
119 of this code of ordinances.
10) Accessory dwelling units shall use the same water and sanitary sewer connections,
and water meter as the single-family home.
11) An accessory dwelling unit (detached) shall have a different address than the
primary residence (such as, 2401-A). Addressing shall be compliant with §§ 150.020
through 150.022 of this chapter.
12) If the mailbox post is owned and maintained by the city, then the property owner
shall reimburse the city for any alterations or replacement; and
13) Property owner is responsible for additional quarterly utility fees upon creation of an
accessory dwelling unit, to include the following: sewer service charge; surface
water management utility fee; and street lighting utility fee.
14) An accessory dwelling unit (detached) may be permitted to be within a legally
nonconforming detached accessory structure, provided the accessory dwelling unit
(detached) does not increase the nonconformity of the detached accessory
structure.
Section 4. In accordance with Section 3.07 of the City Charter, City staff shall have the
following summary printed in the official City newspaper in lieu of the complete
ordinance:
On June 16, 2025, the City Council adopted Ordinance 1045 amending the
Mounds View Municipal Code on Standards Relating to Detached Accessory
Dwelling Units
A printed copy of the ordinance is available for inspection during regular business
hours at Mounds View City Hall and is available online at the City’s website
located at www.moundsviewmn.org
Section 5. This ordinance shall take effect and be in force 30 days from and after its
passage and publication.
Introduction and First Reading by the Mounds View City Council on July 14, 2025.
Second Reading and Adoption by the Mounds View City Council on July 28, 2025
