To Waive the Reading and Adopt Resolution 10138, 8 Approving the Promotion of Asa Overton to the Position of Police Officer. 9 10 Ayes – 5 Nays – 0 Motion carried. 11 12 6.SPECIAL ORDER OF BUSINESS 13 14 None. 15 16 7.PUBLIC COMMENT 17 18 Mayor Lindstrom encouraged the public to speak with kindness and respect when addressing the 19 City Council during Public Comment. 20 21 Murwo Mohamed, 2657 Mounds View Boulevard, requested the City Council consider upgrading 22 the exercise equipment at the Community Center. She explained she has spoken to the City Council 23 about this matter on a number of occasions and asked that action be taken in order to purchase a 24 leg press and a Smith machine. 25 26 City Administrator Zikmund explained a Smith machine has been ordered. 27 28 8.COUNCIL BUSINESS 29 A.PUBLIC HEARING: Second Reading and Approval of Ordinance 1043,30 Amending the Zoning Code Relating to Public Hearing Processes ROLL31 CALL VOTE.32 33 Evan Monson, Stantec, requested the Council hold the second hearing and approve Ordinance 34 1043 relating to the public hearing process. He explained public hearings would now be held by 35 the Planning Commission for variances, CUP’s and plats. 36 37 City Administrator Zikmund reported staff has not received any comments or concerns regarding 38 this ordinance. 39 40 Mayor Lindstrom opened the public hearing at 6:06 p.m. 41 42 Hearing no public input, Mayor Lindstrom closed the public hearing at 6:06 p.m. 43 44 MOTION/SECOND: Meehlhause/Clark. PUBLIC HEARING: Second Reading and Approval of Ordinance 1045, 6 Amending Mounds View City Code 160.088 related to Accessory Dwelling 7 Units ROLL CALL VOTE. 8 9 Evan Monson, Stantec, requested the Council hold the second hearing and approve Ordinance 10 1045 relating to accessory dwellings. He explained the Council reviewed this matter at a 11 worksession meeting and the Planning Commission reviewed this matter at their meeting on July 12 2. He summarized the proposed changes noting he had spoken to public works about shared 13 water/sewer connections being privately maintained. He stated if the Council supported the shared 14 water/sewer connection language, he would recommend the Council table action on this item to 15 allow staff to revise the language further. 16 17 Council Member Smith reviewed the definition of a short-term rental and asked if the City would 18 allow an ADU to be rented for two months. Mr. Monson reported this would be allowed. He stated 19 the Council could further review the short-term rental language within City Code. 20 21 Mayor Lindstrom explained the 30-day requirement was put in place to curb weekend or week-22 long rentals. He stated he did not believe rentals more than 31 days were a concern in the City. He 23 understood that snowbirds rented out their homes during the winter months and this was allowed 24 per City Code. He questioned if the City has identified a specific type of housing that was not 25 allowed in specific locations, would this open the City up for liability. City Attorney Riggs advised 26 this was a distinct and unique use from an overall use in the community. He indicated the City 27 Council could talk about putting a robust rental licensing program in place. 28 29 City Administrator Zikmund reported the recommendation from staff was to table action on this 30 item and staff could bring back a short-term rental definition for further discussion. 31 32 City Attorney Riggs recommended the Council open and continue the public hearing for this item. 33 34 Council Member Clark inquired if a rental license would be required if a family member was living 35 in the ADU. City Administrator Zikmund suggested the City Council discuss this topic further at 36 an upcoming worksession meeting. 37 38 Mayor Lindstrom opened the public hearing at 6:16 p.m. 39 40 Rebecca Scholl, 2467 Hillview Road, asked if a snowbird would be allowed to build an ADU and 41 could then rent both units during the winter months. She inquired if sewer lines would have to be 42 updated at the time an ADU was constructed. She reported she used to manage rentals in Mounds 43 View. She indicated she did not support one-month rentals, because this was not a long enough 44 commitment. Resolution 10136, Approving the Purchase of One Ford Police SUV Vehicle 11 and One Dodge Police SUV Vehicle Along with Additional Equipment and 12 Setup Costs. 13 14 Police Chief Zender requested the Council approve the Purchase of One Ford Police SUV Vehicle 15 and One Dodge Police SUV Vehicle Along with Additional Equipment and Setup Costs. He 16 explained these vehicles would replace a 2016 K-9 squad and a 2019 SUV squad. He reviewed the 17 cost to replace these vehicles and recommended approval. 18 19 Council Member Meehlhause asked why the City would be purchasing one Ford and one Dodge 20 squad car. Police Chief Zender reported the Ford would be the new K-9 squad and the Dodge was 21 a little cheaper SUV option. He noted both vehicles would be purchased from the State bid. 22 23 MOTION/SECOND: Clark/Smith. First Reading and Introduction of Ordinance 1046, Amending Chapter 92, 30 section 92.007 of the Municipal Code to Specifically Prohibit Nudity. 31 32 Public Works/Parks and Recreation Director Peterson requested the Council introduce an 33 Ordinance that would amend Chapter 92 of City Code prohibit nudity in the City of Mounds View. 34 He reported this ordinance was being brought forward after the recent Minnesota Supreme Court 35 Case where the court addressed how lude conduct is defined. He explained the City would be 36 clarifying that nudity would be prohibited. 37 38 MOTION/SECOND: Meehlhause/Clark. To Waive the First Reading and Introduce Ordinance 39 1046, Amending Chapter 92, section 92.007 of the Municipal Code to Specifically Prohibit Nudity. 40 41 Ayes – 5 Nays – 0 Motion carried. 42 43 9. Reports of Mayor and Council. 45 46 Mounds View City Council July 28, 2025 Regular Meeting Page 5 Mayor Lindstrom reported he would be attending another pardon hearing on Friday, August 1. 1 2 Mayor Lindstrom encouraged the public to consider hosting and/or attending a Night to Unite 3 block party on Tuesday, August 5. 4 5 Mayor Lindstrom excused himself from the meeting at 6:30 p.m. 6 7 Council Member Clark stated the first movie in the park would be held on Friday, August 1 at City 8 Hall Park. 9 10 Council Member Clark encouraged the public to attend Festival in the Park on Friday, August 15 11 and Saturday, August 16. 12 13 B. Reports of Staff. 14 15 Finance Director Bauman reported she hoped to have Liliya Loginova on staff by the end of 16 August. 17 18 Police Chief Zender reviewed the items the police department would be collecting on Night to 19 Unite. He noted the City had 21 block parties registered with the police department. He then 20 commended his officers for being proactive in the community, when it comes to policing. He 21 discussed the number of successes the department has had due to the newly installed Flock 22 cameras. 23 24 Public Works/Parks and Recreation Director Peterson stated summer programs were starting to 25 wind down and fall registrations were now taking place. He reviewed the artwork that was being 26 proposed for the fitness court. He indicated the street contractor would be putting concrete in place 27 on Wednesday and the entire project would be completed by August 15. 28 29 Vince Meyer, 8380 Spring Lake Road, asked that the City take a look at the trees that were 30 overhanging the trail along Spring Lake Road. He stated he wanted this path to be safe for those 31 using the trail. 32 33 City Administrator Zikmund stated staff was looking into this. 34 35 City Administrator Zikmund commented Dunkin Donuts met with staff today and explained the 36 EDA lot the City has owned for 35 years was in play for this project. 37 38 City Administrator Zikmund reported Saturday, September 20 was the scheduled date of return for 39 the Mermaid. 40 41 C. Under the existing code, ADUs are permitted only when they are attached to an existing single- family residence. The city code refers to these as and ADU (addition) or an ADU (internal), see the figures from § 160.087 and 160.088 of the city code below. Figure 2: An example of an ‘external’ ADU, referred to in code as an ADU (addition). An ADU (internal) is a permitted accessory use, while an ADU (addition) is a conditional use under the current code. Detached ADUs are currently not permitted, though the city previously reviewed allowing detached ADUs in both 2016 and 2023. In 2023, the Planning Commission recommended amending the City Code to allow detached ADUs as a conditional use. Due to a vacancy on the Council at that time, further consideration was tabled. The Council recently expressed renewed interest in revisiting whether detached ADUs should be permitted within the city. Past Meetings: The City of Mounds View convened a work session on June 2, 2025, that included participation from City staff, the Planning Commission, and the City Council. There was extensive dialogue regarding the potential allowance of detached accessory dwelling units (ADUs), including a review of practices in peer and neighboring municipalities, as well as the broader implications of permitting or prohibiting such units. Following this discussion, there was consensus in favor of Figure 1: An example of an ADU (internal). A draft ordinance was presented to the Planning Commission on July 2, 2025. The Planning Commission reviewed the design standards and had considerable discussion regarding the setbacks, req uired license for the detached ADU, shared water and sewer connection and parking spaces. The Planning Commission recommended approval with changes to the language surrounding parking spaces. The first reading of this ordinance was presented to the City Council on July 14, 2025. During this meeting, the Council reviewed the proposed design standards and engaged in substantive discussion regarding various components of the ordinance, including language pertaining to short-term rentals, additional provisions for owner responsibilities, water and sewer service connections, maintenance of supplementary mailboxes, and foundation requirements. Of note was the extensive deliberation surrounding water and sewer connections for detached Accessory Dwelling Units (ADUs). Building Department staff recommended allowing shared water and sewer connections between the primary residence and the detached ADU, as duplexes and townhomes have historically operated with shared connections without adverse impacts. Public Works has expressed a preference for requiring separate connections to ensure sufficient pipe capacity and long-term infrastructure reliability. City staff recognize that requiring separate water and sanitary sewer connections for detached Accessory Dwelling Units (ADUs) would impose substantial financial burdens on prospective applicants. Considering this concern, staff met internally to explore feasible alternatives. Following this discussion, the Public Works Department and Community Development Department staff recommended that, when a detached ADU is proposed, the water and sewer lines be designated as private. Under this arrangement, a detached ADU would share the existing water and sewer connection of the primary residence, utilizing a Y-fitting at the main line. This approach results in the property owner assuming full ownership and maintenance responsibilities for the private water and sewer lines serving both the primary residence and the detached ADU. This also reduces issues on the city’s end that would result from multiple lines serving one property. This set-up would require changes to the city’s utility requirements located in Chapters 51 and 52 of the city code. Public Works staff are reviewing sections of Chapters 51 and 52 that will need to be amended, and will bring forward these changes to the City Council at a future meeting. City Code: § 160.088 CONDITIONAL USES lists the conditional uses permitted in the Single-Family Residential (R-1) district. The land use classifications in Mounds View follows hierarchical zoning, where all the uses listed in the R-1 district are also allowed uses in the R-2, R-3, and R- 4 districts. If allowing detached ADUs, staff would propose a new subsection with standards specific to detached ADUs. The proposed draft would make these a conditional use in the R-1, R-2, R-3, and R-4 districts. The draft ordinance is based on the current requirements for accessory buildings (160.087(A)) and ADU (internal) (160.087(J)) in the city code, the draft ordinance prepared by city staff in 2023, as well as research by current staff on neighboring communities. A ‘clean’ version is included in the meeting materials for the council to review, as well as a ‘redlined’ version showing changes that have been made since the first reading of the ordinance last month. Options: The City Council has the following options for this item: 1. Approve of the amendment, with or without changes. 2. Deny the proposed amendment, with findings for denial. 3. Background; authority. 1.01. The City of Mounds View (“City”) has adopted a zoning ordinance pursuant to the authority granted by the Municipal Planning Act. M.S. §§ 462.351 to 462.365, inclusive, as they may be amended from time to time. 1.02. Sections 160.450 and 160.451 of the Mounds View Zoning Ordinance detail the process and requirements for amending the zoning code. 1.03. Legislative Findings: The City Council finds that allowing owner-occupied properties to include a detached accessory dwelling unit (ADU) serves the public interest by expanding long-term housing opportunities within established neighborhoods. This policy is intended to support homeowners in providing safe, code-compliant living spaces for others while preserving neighborhood character, minimizing impacts on surrounding properties, and reinforcing the stability and vitality of residential communities. Section 2. The City Council of the City of Mounds View hereby amends Title XV: Land Usage, Section § 160.012 by adding the underlined as follows: § 160.012 DEFINITIONS. DWELLING UNIT, ACCESSORY. A dwelling unit that is a smaller, independent residential dwelling unit located on the same lot as a single-family dwelling to which it is accessory to, and is internal or an addition onto the principal dwelling, or detached from the principal dwelling. ADUs can be converted portions of or additions onto existing homes, new stand-alone accessory structures, or converted portions of existing stand-alone accessory structures. Section 3. The City Council of the City of Mounds View hereby amends Title XV: Land Usage, Section 160.088 by adding the underlined material as follows: (I) Accessory Dwelling Unit (detached) 1) One accessory dwelling unit (detached) may be located on a lot occupied by a single-family home. The lot must comply with minimum dimensional standards. a) An accessory dwelling unit (detached) shall not be permitted on a lot that has an accessory dwelling unit (addition) or accessory dwelling unit (internal). 2) Either the single-family home or the detached accessory dwelling unit shall be occupied by the property owner. The property shall be homesteaded, designating it as the owner’s primary residence. a) Prior to the issuance of the Certificate of Occupancy for the accessory dwelling unit (detached), at least one of the units must be occupied by the owner and a restrictive covenant must be submitted for review by the City Attorney and recorded against the property. 3) An accessory dwelling unit (detached) shall have a minimum gross floor area of 300 square feet and a maximum gross floor area of 50% of the primary residence. a) The footprint of an accessory dwelling unit (detached) shall count towards the maximum area allowed for accessory buildings as specified in §160.087(A)(2). 4) The exterior design of the accessory dwelling unit shall be consistent with the character of the single- family home. 5) An accessory dwelling unit shall be constructed on permanent foundation made of concrete, concrete block or wood and anchoring system in accordance with the State Building Code. 6) An accessory dwelling unit (detached) shall not exceed 18 feet or that of the principal structure, whichever is less, in height. 7) An accessory dwelling unit (detached) shall have a pitch or slope of at least 2-12, but no steeper than 12-12. Rounded, dome or geodesic dome roofs are not allowed. 8) An accessory dwelling unit (detached) shall have a minimum setback from side and rear lot lines of five (5) feet, and shall not be located closer to the front lot line than the single-family home. 9) A minimum of one off-street parking space shall be provided for the accessory dwelling unit. 10) An accessory dwelling unit (detached) shall be licensed as a rental dwelling, and comply with Ch. 119 of this code of ordinances. a) The license application fee shall be waived if the unit is occupied by the property owner, owner’s children, or owner’s parents, subject to annual submission of the rental license application form. 11) An accessory dwelling unit (detached) shall be served by private sewer and water service lines. The property owner shall be responsible for the private connection in terms of maintenance. a) The accessory dwelling unit (detached) shall utilize the same water and sanitary sewer connection as the primary residence, established at the main line via a Y-fitting. The water line shall be tapped after the water meter is attached to the main dwelling. b) The property owner is required to pay a quarterly insurance fee solely for the water connection. No additional sewer charges are assessed. The insurance covers the water line from the city main to the primary dwelling unit only, and does not cover the accessory dwelling unit (detached). c) The water and sewer line serving the accessory dwelling unit (detached) will be subject to inspection upon the initial installation. The Sanitary Sewer line for the accessory dwelling unit (detached) will not need televising when the property is sold unless excessive I & I is present, as it is classified as a private connection. d) A clean out will be required between the existing primary residence and the accessory dwelling unit (detached). Background; authority. 1.01. The City of Mounds View (“City”) has adopted a zoning ordinance pursuant to the authority granted by the Municipal Planning Act. M.S. §§ 462.351 to 462.365, inclusive, as they may be amended from time to time. 1.02. Sections 160.450 and 160.451 of the Mounds View Zoning Ordinance detail the process and requirements for amending the zoning code. 1.03. Legislative Findings: The City Council finds that allowing owner-occupied properties to include a detached accessory dwelling unit (ADU) serves the public interest by expanding long-term housing opportunities within established neighborhoods. This policy is intended to support homeowners in providing safe, code-compliant living spaces for others while preserving neighborhood character, minimizing impacts on surrounding properties, and reinforcing the stability and vitality of residential communities. Section 2. The City Council of the City of Mounds View hereby amends Title XV: Land Usage, Section § 160.012 by adding the underlined as follows: § 160.012 DEFINITIONS. DWELLING UNIT, ACCESSORY. A dwelling unit that is a smaller, independent residential dwelling unit located on the same lot as a single-family dwelling to which it is accessory to, and is internal or an addition onto the principal dwelling, or detached from the principal dwelling. ADUs can be converted portions of or additions onto existing homes, new stand-alone accessory structures, or converted portions of existing stand-alone accessory structures. Section 3. The City Council of the City of Mounds View hereby amends Title XV: Land Usage, Section 160.088 by adding the underlined material as follows: (I) Accessory Dwelling Unit (detached) 1) One accessory dwelling unit (detached) may be located on a lot occupied by a single-family home. The lot must comply with minimum dimensional standards. a) An accessory dwelling unit (detached) shall not be permitted on a lot that has an accessory dwelling unit (addition) or accessory dwelling unit (internal). 2) Either the single-family home or the detached accessory dwelling unit shall be occupied by the property owner. The property shall be homesteaded, designating it as the owner’s primary residence. a) Prior to the issuance of the Certificate of Occupancy for the accessory dwelling unit (detached), at least one of the units must be occupied by the owner and a restrictive covenant must be submitted for review by the City Attorney and recorded against the property. 3) An accessory dwelling unit (detached) shall have a minimum gross floor area of 300 square feet and a maximum gross floor area of 50% of the primary residence. a) The footprint of an accessory dwelling unit (detached) shall count towards the maximum area allowed for accessory buildings as specified in §160.087(A)(2). 4) The exterior design of the accessory dwelling unit shall be consistent with the character of the single- family home. 5) An accessory dwelling unit shall be constructed on permanent foundation made of concrete, concrete block or wood and anchoring system in accordance with the State Building Code. 6) An accessory dwelling unit (detached) shall not exceed 18 feet or that of the principal structure, whichever is less, in height. 7) An accessory dwelling unit (detached) shall have a pitch or slope of at least 2-12, but no steeper than 12-12. Rounded, dome or geodesic dome roofs are not allowed. 8) An accessory dwelling unit (detached) shall have a minimum setback from side and rear lot lines of five (5) feet, and shall not be located closer to the front lot line than the single-family home. 9) A minimum of one off-street parking space shall be provided for the accessory dwelling unit. 10) An accessory dwelling unit (detached) shall be licensed as a rental dwelling, and comply with Ch. 119 of this code of ordinances. a) The license application fee shall be waived if the unit is occupied by the property owner, owner’s children, or owner’s parents, subject to annual submission of the rental license application form. 11) An accessory dwelling unit (detached) shall be served by private sewer and water service lines. The property owner shall be responsible for the private connection in terms of maintenance. a) The accessory dwelling unit (detached) shall utilize the same water and sanitary sewer connection as the primary residence, established at the main line via a Y-fitting. The water line shall be tapped after the water meter is attached to the main dwelling. b) The property owner is required to pay a quarterly insurance fee solely for the water connection. No additional sewer charges are assessed. The insurance covers the water line from the city main to the primary dwelling unit only, and does not cover the accessory dwelling unit (detached). c) The water and sewer line serving the accessory dwelling unit (detached) will be subject to inspection upon the initial installation. (Comcast) Introduction/Discussion The North Suburban Communications (the “NSCC”) is a municipal joint powers commission that negotiates and administers the cable franchises on behalf of its nine- member cities. Following a long and contentious franchise renewal process, the NSCC and Comcast of Minnesota, Inc. (Comcast) agreed upon a renewed cable television franchise in 2017. All of the member cities adopted ordinances approving the cable television franchise and Comcast accepted it. At the time, the 2017 cable television franchise was considered one of the best, if not they best, cable television franchise in the metro area. In 2025, it remains one of the best, if not the best, cable television franchises in the metro and it continues to meet the needs of the member cities as it relates to the provision of cable service. In 2024, Comcast sent a notice to the NSCC that it desired to renew the cable television franchise which had a term through 2027. Shortly after receiving the notice, the NSCC adopted a resolution commencing the renewal process and sent a letter to Comcast in response to Comcast agreeing to pursue the cable television franchise renewal through the informal – contract negotiation – process as contemplated in the federal cable act. In 2025, NSCC counsel and Comcast tentatively agreed on a cable franchise renewal extension that would extend the current terms and conditions of the cable television franchise through 2032. The NSCC recommended adoption of the Franchise Extension Agreement Ordinance by the City of Mounds View and all of its member cities at its meeting in May. Recommendation: Staff recommends conducting the first reading of Ordinance 1047 approving a Franchise Extension Agreement with Comcast of Minnesota, Inc. (Comcast). Section 2, paragraph 4 of the Franchise is hereby amended by extending the term of such Franchise through and including June 30, 2032. This amendment is in response to a recent Minnesota Supreme Court case. Background/Discussion: Earlier this year, a Minnesota Supreme Court decision impacted how “lewd” conduct is defined in criminal law statewide. The decision clarifies that for nudity to be considered a “lewd” act there must be some additional action in addition to being in a state of undress. The City Code relies partially on the statewide criminal definition of lewd conduct to regulate nudity within its parks system and the enclosed amendments to the City Code seek to add language to eliminate any gray area and keep the same standards of conduct throughout the parks system that applied prior to the Supreme Court case. The Director of Parks and Recreation has the ability to adopt rules that apply within the parks system, and has already taken the step to update the Splash Pad rules to explicitly require appropriate swim suits and attire and prohibit nudity. The purpose of this ordinance amendment would similarly be to explicitly prohibit nudity within the park system and make the distinction between “lewd” conduct and being nude. Should the City Council adopt the amendment, the Splash Pad sign will also be updated to cite to the City Code section regarding nudity.
