HomeMy WebLinkAboutResolution 10199 - 2026/01/12RESOLUTION 10199 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA RESOLUTION RECOMMENDING THE APPROVAL OF AN AMENDMENT TO THE PLANNED UNIT DEVELOPMENT AGREEMENT FOR THE O'NEIL PROPERTY PUD LOCATED AT 2408 MOUNDS VIEW BLVD. MOUNDS VIEW PLANNING CASE PA2026-0002 WHEREAS, Mounds View Professional Properties LLC owns the property located at 2408 Mounds View Boulevard, Parcel ID 083023230004, zoned PUD Planned Unit Development; and, WHEREAS, Jenna Perez, on behalf of the property owner, has applied to amend the PUD Agreement for the O'Neil Property PUD; and WHEREAS, the property is legally described as: LOTS 1 AND 2, ANTHONY PROPERTIES ADDITION TO THE CITY OF MOUNDS VIEW; and WHEREAS, the proposed Amendment would include adding the following into the Narrative of the agreement for the O'Neil Property PUD: adding "daycare" and "professional services" as uses permitted within the existing building on the property, reducing the setback from Edgewood Drive (referred to as `future road' in the original agreement) from 20 feet to zero (0) feet to allow for a deck to be constructed on the existing office building, allowing for detached accessory structures on the property, adding a new playground on Parcel ID (083023230013), and relocating the existing trash enclosure onto Parcel ID (083023230013); and WHEREAS, the Mounds View Planning Commission held a duly noticed public hearing and reviewed the proposed amendment to the PUD Agreement on January 7, 2026; and NOW, THEREFORE, BE IT RESOLVED, that the Mounds View City Council hereby recommends approval of the amendment to the PUD Agreement for the O'Neil Property PUD, with the following conditions and findings of fact: Condition for Approval 1. The applicant shall adhere to the plans submitted to the city and reviewed with this request. 2. The applicant shall receive permission from the owner of Parcel ID 083023230013 for proposed new trash enclosure, new playground, and new fencing located on said parcel within the PUD. 3. Proof of permission shall be submitted to the city prior to the issuance of building permits by the city. 4. The applicant shall acquire all applicable local, County, State, and Federal permits and approvals for their request. 5. The applicant shall pay all fees and escrows associated with this request. RESOLUTION 10199 PAGE 2 Findings of Fact for Approval 1. The parcel with the address 2408 Mounds View Boulevard (Parcel ID 083023230004) is currently owned by Mounds View Professional Properties LLC. 2. 2408 Mounds View Boulevard is within the O'Neil Property PUD, the agreement for which was approved by the City Council on 5/11/1998. 3. The applicant proposes to amend the PUD Agreement for the O'Neil Property PUD. 4. Based on the Mounds View 2040 Comprehensive Plan, the site is guided as 'Mixed Use'. The proposed changes keep the site commercial in use, and would be consistent with the site's designation in the comprehensive plan. 5. The applicant's property is part of a PUD (O'Neil Property PUD), which allows a variety of uses and development types. Beyond the PUD, a variety of uses surround the site. Allowing commercial uses on the applicant's property would be consistent with previous use of the property, and would be consistent with the development pattern surrounding the site. 6. Based on the plans submitted by the Applicant, the proposed uses would be operating during normal working hours. This would be consistent with previous uses on the property and would not depreciate the surrounding area. 7. Neighboring areas consist of institutional and commercial areas north of Mounds View Boulevard, commercial development to the east, commercial and multifamily development to the west, and single-family development to the south. Continuing to have commercial uses on the applicant's property would be consistent with the previous use of the property and would not negatively impact neighboring properties. 8. The proposed use is unique, and would appear to be the first of its kind in the city. The applicant's proposed project would appear to satisfy an underserved market. Allowing a unique use to operate in the city would appear to meet the intent of the Planned Unit Development district.
