AN ORDINANCE REZONING THE PROPERTY AT 2716 HILLVIEW ROAD
FROM R-1 (SINGLE FAMILY RESIDENTIAL) TO R-4 (MULTI FAMILY RESIDENTIAL)
The City of Mounds View Ordains:
Section 1. Background; authority.
1.01.The City of Mounds View ("City") has adopted a zoning ordinance pursuant to the authority
granted by the Municipal Planning Act. M.S. §§ 462.351 to 462.365, inclusive, as they may
be amended from time to time.
1.02. Sections 160.450 and 160.451 of the Mounds View Zoning Ordinance detail the process and
requirements for amending the zoning map.
Section 2. Request to rezone.
2.01. The City of Mounds View Economic Development Authority (the "EDA") owns the property
at 2716 Hillview Road, Parcel ID 063023430030, legally described as:
LOT 112, SPRING LAKE PARK HILL VIEW
2.02. The EDA previously authorized Sinan Music of SMC Construction, Inc. (the "applicant") to
apply on behalf of the EDA for a Comprehensive Plan Amendment to amend the Future
Land Use Map designation of the property, and to rezone the property.
Section 3. Notice, decision, and findings.
3.01. Having received the request from the applicant to rezone the Property described in Section
2, the City published notice of the rezoning request in the official newspaper on Oct 22,
2025, and mailed notice of a public hearing to surrounding property owners within 500 feet.
3.02. A public hearing was held on November 5, 2025, by the Mounds View Planning Commission,
and all persons desiring to be heard with reference to the rezoning were heard at said public
hearing.
3.03. The Mounds View City Council finds and determines that it is in the best interests of the City
to rezone the property at 2716 Hillview Road from R-1 to R-4.
3.04. The Mounds View Planning Commission, after considering the reports of City staff and
information at the public hearing, voted to rezone the property to R-4 (Multifamily
Residential).

Section 4. In accordance with Section 3.07 of the City Charter, City staff shall have the
following summary printed in the official City newspaper in lieu of the complete
ordinance.
A printed copy of the ordinance is available for inspection during regular business
hours at Mounds View City Hall and is available online at the City's website located
at www.moundsviewmn.org
Section 5. This ordinance shall take effect and be in force 30 days from and after its passage
and publication.

NOTICE IS HEREBY GIVEN that the Mounds View City
Councif will hold a public h@tiring during its regulprly
scheduled meeting an Monday, Novembor 1 M 2025 at
6:00 p.m. to consider Ordinance 1050, an ordinance
amending Chopters 2 and 4 of the City of Mounds View
Charter by estXll'shing a new process for making
appointments to t�e city council in case of a vacancy on
the council, The amendments are as follows:

Section 2.05 Vacancies. A vacancy in the Council,
whether it be in Ke office of mayor or council member,
shall be deemed to exist in case of the failure of any
person elected thereto to qualify, or by reason of the
death, resignation in writing filed with the city
administrator, removal from office, non-residencce in the
city, conviction of a felon of any such person after their
election, or by reason of he failure of any Council
member without good cause to attend Council meetings
for a �eriod of ihree 13) consecutive months. In each such

Section
Chapter 4 of the Mounds View City Charter is hereby
omgnded by remgvine Section 4.05 in its entirety and
replacing it with the fo lowing:
Section 4.05 Vacancy in Municipal Elected Office
Subdivision 1. Vacancy and 365 days or more remora in
the `term. The following process shall be followed when
addressing a vacancy, as defined in Chapter 2, Section
2.05 or other applicable law, in an elected office o the
City that occurs with 365 days or more remaining in the
term of the vacated office:
A) A special election shall be called at the next uniform
election dale specified in Minnesota Statutes section
205.10, subd. 3a, as amended, for which all legal
requirements for special elections can be met by the City.
BI The City Council shall appoint an individual following
the appointment process in )his Section 4.05 to fill the
vacancy until a successor is elected and qualifies.
Subdivision 2. Vacancy and less than 365 days remain
in the term. The following pr cess shall be followed when
addressing a vacancy, as de�ined in Chapter �, Section
2.05 or other applicable law, in on elected office of the
City that occurs with less than 365 days remaining in the
term of the vacated office:
A) The City Council shall appoint on individual fallowing
the appointment process in this Section 4.05 to fill the
vocancy for the remainder of the ungxpired term and
until th, election and qualification of a successor.
Subdivision 3. Appointment
If, pursuant to subdivisions I or 2, the City Council may
appoint on individual to fill a vacancy, the following
process must be used:
A) A majority of the members of she council voting on the
resolution, declares a vacancy via resolution
B) Within thirty (30) days of the date the vacancy is

this Subdivision 3.
C) The City Administrator will provide written notice of
the vacancy to the individuals in the list provided in
Subdivision 3.(D). The written notice shall request a
written response to the question of whether the individual
is willing to be appointed to the vacancy. Individuals on
the list will have a maximum of twenty (20) days to
provide such written response. The City Administrator
may present an individual for appointment prior to the
expirolion of the twenty -day period if: i) the first person
on,
n the list confirms they are Willing to serve and qualifies;
or ii) any person on the list provides on off irmative
response and each person prioritized higher on the list
declines appointment or is not qualified. After the twenty -
day response period, the City Administrotor will present
the listetf person with the highest priority wino has
respondded that they are willing to serve andd qualifies for
appointment, regardless of not receiving responses from
others on the list. If no person accepts or is qualified and
less than 365 days remain in the vacant term, then the
council may m ke an appointment at their discretion far
the reminder a the vacant term.

On November 24, 2025, the City Council adopted Ordinance No. 1051 rezoning the property at 2716 Hillview Road from R-1 (Single Family Residential) to R-4 (Multi-Family Residential).
A printed copy of the ordinance is available for inspection during regular business hours at Mounds View City Hall and is available on line at the City’s web site located at www.moundsviewmn.org.
