ORDINANCE 1054 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />AN ORDINANCE AMENDMENT TO THE ZONING CODE REGARDING MAXIMUM HEIGHT <br />REQUIREMENTS; MOUNDS VIEW PLANNING CASE SP-241-26 <br />WHEREAS, the City Council has directed staff to prepare an amendment to the city's zoning <br />ordinance regarding height requirements, and can initiate a request to amend the zoning code per <br />Section 160.451(A); and, <br />WHEREAS, the Mounds View Planning Commission held a duly noticed public hearing and <br />reviewed the proposed amendment to the zoning code; and <br />NOW, THEREFORE, BE IT RESOLVED, that the Mounds View City Council hereby approves <br />of the proposed amendment to the city's zoning code, as presented in Exhibit A, based on the <br />following findings of fact: <br />Findings of Fact for Approval <br />1. The 2040 Plan has guided areas of the city as 'mixed -use', allowing for a variety of uses to <br />occupy a single parcel or site. Allowing an increase in the height of buildings within the County <br />Road 10 Overlay zone would encompass most of the parcels guided as mixed -use within the <br />Future Land Use Plan, as well as the 'redevelopment areas' identified in the Plan as spots for <br />future development over the next 20 years. The proposed change would support the goal in the <br />Plan to "Enhance the appearance of properties along Mounds View Boulevard and establish a <br />physical focal center for the city." <br />2. The proposed changes are limited to the County Road 10 Overlay zone, which is the primary <br />commercial corridor of the city. Incentivizing further development in the corridor would support <br />the long-term viability and success of this part of the city. <br />3. New or redevelopment of parcels within the County Road 10 Overlay zone as a result of the <br />proposed amendment would appear to result in an increase in property values, which would <br />not depreciate the land within the overlay zone. <br />4. The County Road 10 Overlay zone is the primary gateway for the city, with varying heights and <br />densities. The proposed amendment would allow for increased development potential, as <br />projects that were previously not permitted could become viable options. It would appear to be <br />consistent with the Comprehensive Plan to incentivize and guide for further development along <br />the corridor. <br />5.
