HomeMy WebLinkAboutResolution 10208 - 2026/02/09RESOLUTION NO. 10208 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA A RESOLUTION DELEGATING ADMINISTRATION OF LOCAL AFFORDABLE HOUSING AID (LAHA) FUNDS TO THE MOUNDS VIEW ECONOMIC DEVELOPMENT AUTHORITY (EDA) WHEREAS, the State of Minnesota provides annual Local Affordable Housing Aid (LAHA) to eligible cities and counties to support the development, preservation, and stabilization of affordable housing; and WHERAS, the City of Mounds View is an eligible recipient of LAHA funds and will receive annual allocations for the purpose of supporting affordable housing activities within the community; and WHEREAS, Minnesota Statutes, Chapters 469.001-469.047 also authorize municipalities to establish an Economic Development Authority (EDA) and to delegate to the EDA the powers necessary to carry out housing and redevelopment activities; and WHEREAS, the EDA is authorized} pursuant to Minnesota Statutes, Sections 469.090 to 469.1081 (the "EDA Act"), to participate in providing certain loan programs, including the administration of LAHA funds; and WHEREAS, the City Council finds that the delegation of administration of the City's LAHA funds to the Mounds View Economic Development Authority (EDA) will promote efficient program management, ensure compliance with state requirements, and support the City's long-term housing goals; and WHEREAS, the EDA has the administrative capacity, program experience, and organizational structure to effectively manage LAHA-funded activities on behalf of the City. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Mounds View, Minnesota, that: 1. Delegation of Authority: The City of Mounds View hereby delegates to the Mounds View Economic Development Authority (EDA) the authority to administer all Local Affordable Housing Aid (LAHA) funds received by the City, including program design, implementation, monitoring, and reporting. Use of Funds: The EDA is authorized to use LAHA funds for any eligible purpose permitted under Minnesota law, including but not limited to development or preservation of affordable housing, rehabilitation or repair programs, gap financing, rental assistance or stabilization programs, and administrative costs as allowed by statute. 3. Reporting and Compliance: The EDA shall prepare all required reports, maintain financial and program records, and provide updates to the City Council as needed to ensure compliance with Minnesota Housing and Department of Revenue requirements. 4. Financial Management and Coordination with City Staff: The EDA shall work collaboratively with City staff to ensure proper financial management, accounting, and oversight of LAHA funds. LAHA funds shall be deposited into a dedicated account within the City's financial system. The EDA is authorized to request disbursements consistent with approved program budgets and City financial policies. 5. Effective Date and Execution: This resolution shall take effect immediately upon its adoption. BE IT FURTHER RESOLVED that the City Council approves the Resolution in substantially the form presented to the City Council subject to any modifications that do not alter the substance of the transaction and that are approved by the City Administrator and the City Attorney. BE IT FINALLY RESOLVED that the Mayor, the City Administrator, and other City and EDA officials, staff, and consultants are authorized to execute the Resolution and to take any and all other steps necessary or convenient to carry out the obligations under the Resolution as well as to fulfill the intent of this Resolution.
