PUBLIC HEARING: Second Reading of Ordinance 1053,Amending the 2026 3 City of Mounds View Fee Schedule Regarding Residential and Commercial 4 Plumbing Permit Fees ROLL CALL VOTE. 5 6 City Administrator Zikmund requested the Council approve an Ordinance amending the 2026 fee 7 schedule regarding residential and commercial plumbing permit fees. 8 9 Mayor Lindstrom opened the public hearing at 6:02 p.m. 10 11 Sharon Kirscher, 8406 Red Oak Drive, asked if the proposed changes were making the City's fee 12 schedule consistent with the State. City Administrator Zikmund reported this was the case. 13 14 Hearing no further public input, Mayor Lindstrom closed the public hearing at 6:03 p.m. 15 16 MOTION/SECOND: Meehlhause/Smith. To Waive the Second Reading and Adopt Ordinance 17 1053, Amending the 2026 City of Mounds View Fee Schedule Regarding Residential and 18 Commercial Plumbing Permit Fees directing staff to publish an Ordinance summary. 19 20 ROLL CALL: Clark/Gunn/Meehlhause/Smith/Lindstrom. 21 22 Ayes 5 Nays—0 Motion carried. 23 24 B. Second Reading and Approval of Ordinance 1054,Amending the Zoning Code 25 Regarding Maximum Height Requirements ROLL CALL VOTE. 26 27 Kribashini Moorthy, Stantec, requested the Council adopt an Ordinance amending the Zoning 28 Code regarding maximum height requirements. She reviewed the proposed building heights for 29 the County Road 10/Mounds View Boulevard overlay zone and recommended approval of 30 Ordinance 1054. 31 32 Council Member Gunn asked if staff could review a map of the overlay district. Ms. Moorthy 33 reviewed a map of the Mounds View Boulevard overlay district noting the areas in red would 34 allow for the new maximum building heights. 35 36 MOTION/SECOND: Meehlhause/Clark. To Waive the Second Reading and Adopt Ordinance 37 1054, Amending the Zoning Code Regarding Maximum Height Requirements directing staff to 38 publish an Ordinance summary. 39 40 Mayor Lindstrom stated he believed this Ordinance was a movement in the right direction for the 41 Mounds View Boulevard overlay district. 42 43 ROLL CALL: Clark/Gunn/Meehlhause/Smith/Lindstrom. 44 45 Ayes—5 Nays—0 Motion carried. 46 Mounds View City Council January 26, 2026 Regular Meeting Page 3 1 C. Resolution 10201, Authorizing repairs to the Sediment Collection Trench in 2 the Public Works Facility. 3 4 Public Works/Parks and Recreation Director Peterson requested the Council authorize repairs to 5 the sediment collection trench in the Public Works Facility. He explained that the Public Works 6 Facility was constructed in 2016 which included a sediment collection trench. He indicated this 7 trench was within 50 feet of Well No. 2. Staff discussed the problems that were occurring within 8 the trench and recommended the proposed repairs move forward. 9 to MOTION/SECOND: Clark/Meehlhause. To Waive the Reading and Adopt Resolution 10201, 11 Authorizing repairs to the Sediment Collection Trench in the Public Works Facility. 12 13 Ayes—5 Nays—0 Motion carried. 14 15 D. Resolution 10202, Authorization to Replace the Boilers and Water Heater for 16 the City Hall building. 17 18 Public Works/Parks and Recreation Director Peterson requested the Council authorize the 19 replacement of the boilers and water heater for the City Hall building. He explained the boilers at 20 City Hall were used for heating and cooling at City Hall and were originally installed in 2000. He 21 indicated the boilers have had several failures and repairs cost $5,000 to $6,000 per year. Staff 22 commented further on the project and recommended the Council approve the replacement of the 23 boilers and water heater at City Hall. 24 25 Mayor Lindstrom asked how long the new boiler system would last. Public Works/Parks and 26 Recreation Director Peterson anticipated the new system would last the City 30 years and 27 explained the new system would be much more efficient than the existing system. 28 29 Council Member Clark indicated the City would be going from three boilers to one boiler in the 30 new system. She commented this was possible due to the new technology that was available.Public 31 Works/Parks and Recreation Director Peterson reported this was the case. 32 33 Vince Meyer, 8380 Spring Lake Road, questioned why the City only received one bid for this job. 34 35 Dennis Romson, 7840 Bona Road, cautioned the City from moving forward with only one boiler 36 noting the City would no longer have a backup boiler. 37 38 Public Works/Parks and Recreation Director Peterson stated this project was on the Omni contract 39 and did not require the City to go out to bid. He explained the project was already bid through the 40 Omni Group. City Attorney Riggs reported this type of service has already been bid and going 41 through the State contract saved the City money in the long run. 42 43 Public Works/Parks and Recreation Director Peterson reported the City has purchased playground 44 equipment and other Public Works items through the State contract.He commented further on how 45 the State bidding process simplifies the bidding process for the City. He explained he would reach 46 out to Trane to see what they have to say about having only one boiler instead of three and to Mounds View City Council January 26, 2026 Regular Meeting Page 4 1 receive information on what would happen if the one boiler were to go down. 2 3 Mr. Romson questioned what the backup contingency plan would be if the boiler were to go down 4 at City Hall. 5 6 Mr. Meyer asked what the City's rebate would be for this project. 7 8 Public Works/Parks and Recreation Director Peterson stated City Hall served as the emergency 9 operations center in the event of an emergency and noted the City does have a backup generator. 10 He reported he would reach out to Trane to better understand what would happen if the boiler were 11 to go out. City Administrator Zikmund explained in the past 10 years, the A/C unit has gone out, 12 but the City kept working. 13 14 Public Works/Parks and Recreation Director Peterson indicated he could reach out to Xcel Energy 15 to see if the proposed boiler meets there rebate requirements. 16 17 MOTION/SECOND: Meehlhause/Gunn. To Waive the Reading and Adopt Resolution 10202, 18 Authorization to Replace the Boilers and Water Heater for the City Hall building. 19 20 Council Member Meehlhause reported the City recently purchased another piece of equipment 21 through the Omni Group. Public Works/Parks and Recreation Director Peterson reported this was 22 the case. 23 24 Ayes 5 Nays—0 Motion carried. 25 26 E. Resolution 10203, Authorization to Repair the Skylights at the Mounds View 27 Community Center. 28 29 Public Works/Parks and Recreation Director Peterson requested the Council authorize the repair 30 of the skylights at the Mounds View Community Center. He explained the roof at the Community 31 Center was replaced in 2011 and the skylights were not replaced. He indicated the skylights have 32 since begun to leak and replacement of the skylights was necessary at this time. 33 34 Council Member Smith asked if the skylights would be repaired or replaced. Public Works/Parks 35 and Recreation Director Peterson explained the skylights would be replaced. 36 37 Mayor Lindstrom asked what the benefits were of the new skylights. Public Works/Parks and 38 Recreation Director Peterson reviewed the design of the new skylights, noting the new skylights 39 would better hold snow loads in the winter months. 40 41 Vince Meyer, 8380 Spring Lake Road, stated it was his experience that skylights fail, and he does 42 not install them in new construction, especially given the climate in Minnesota. He questioned if 43 the skylights could be removed, so the City did not have to replace them again in the future. 44 45 Public Works/Parks and Recreation Director Peterson explained the City was trying to get natural 46 sunlight into the building.He reported staff had investigated covering the skylights,but the roofing Mounds View City Council January 26, 2026 Regular Meeting Page 5 1 contractor indicated this would cost the City more and the natural daylight would be lost. 2 3 Mayor Lindstrom commented there was value in having natural daylight in the Community Center 4 building. 5 6 Dennis Romson, 7840 Bona Road, reported the cost to replace the skylights was quite high. He 7 suggested the skylights be covered and encouraged the City to pursue LED lighting throughout the 8 Community Center that mimics daylight for this space. 9 10 Public Works/Parks and Recreation Director Peterson stated the roofers indicated to him it would 11 cost more to cover the skylights than to replace them. 12 13 Mr. Meyer stated he could provide the City with a bid to cover the skylights noting he could prove 14 that it would be more efficient and lower cost to cover the skylights than to replace them. 15 16 Council Member Clark reported she supported the skylights being replaced. 17 18 MOTION/SECOND: Clark/Meehlhause. To Waive the Reading and Adopt Resolution 10203, 19 Authorization to Replace the Skylights at the Mounds View Community Center. 20 21 Council Member Meehlhause stated this project was long overdue. 22 23 Ayes—5 Nays—0 Motion carried. 24 25 9. REPORTS 26 A. Reports of Mayor and Council. 27 28 Mayor Lindstrom explained it has been the position of the Council to not have a quorum of the 29 City Council present at non-profit organization meetings. He stated he would recommend Council 30 Member Smith serve as the City Council liaison for the Festival in the Park Committee because 31 she was the president of the committee. 32 33 Council Member Smith noted in the past the City has not had a liaison to the Festival in the Park 34 Committee, but rather the liaison was staff member Public Works/Parks and Recreation Director 35 Peterson. 36 37 Council Member Gunn indicated the Council has had liaisons in the past. 38 39 Mayor Lindstrom commented that the City has had liaisons in the past and he would like to move 40 away from this practice. 41 42 Council Member Clark stated she supported Mayor Lindstrom's recommendation and suggested 43 Public Works/Parks and Recreation Director Peterson be named the staff liaison. 44 45 MOTION/SECOND: Clark/Meehlhause. To recommend Council Member Kathryn Smith serve 46 as the liaison and that Public Works/Parks and Recreation Director Don Peterson serve as the staff Mounds View City Council January 26, 2026 Regular Meeting Page 6 1 liaison to the Festival in the Park Committee. 2 3 Mayor Lindstrom thanked Council Member Gunn for being willing to serve on the Festival in the 4 Park Committee but noted he wanted to move forward with Council Member Smith as the liaison 5 for this committee. 6 7 Ayes—4 Nays—0 Abstain— 1 (Smith) Motion carried. 8 9 Council Member Clark indicated she attended the Mounds View Police Foundation meeting and 10 noted the Daddy Daughter Dance would be held on Saturday, January 31 at the Mounds View 11 Community Center from 5:30 p.m. to 8:00 p.m. She noted tickets for the event could be purchased 12 through Eventbrite or at the door. 13 14 Council Member Clark explained the Parks, Recreation and Forestry Commission met last week. 15 She noted this group was taking applications for one vacant position. She was happy to report that 16 the skating rinks in the community were open for use. 17 18 Council Member Clark stated the next Mounds View Matters would be coming out in early 19 February. 20 21 Council Member reported the City was still holding the food distribution events on Sunday at the 22 Community Center from 3:00 p.m.to 4:00 p.m. She noted that over 400 families were being served 23 weekly. She thanked the Manna Market and all the volunteers who were making these events 24 possible. 25 26 Council Member Smith stated the Mounds View Festival in the Park was looking for donations of 27 Easter egg candy and these donations could be dropped off at the Community Center. 28 29 Council Member Smith indicated she attended an Airport Commission meeting two weeks ago 30 and noted this group was looking for volunteers to assist with organizing an aviation day's festival. 31 32 Council Member Smith reported she would be attending a Cable Commission meeting on 33 Thursday, January 29. 34 35 Council Member Smith read a statement from the Ramsey County League of Local Government 36 noting she understood her neighbors were carrying a heavy emotional burden at this time. She 37 stated it was important to honor the shared experience everyone was going through. She discussed 38 how local leaders were serving on the front lines of community well building through public safety 39 and the trust that was built during times of trauma. She noted that the Ramsey County League of 40 Local Government was built on community, collaboration and shared growth. She discussed how 41 this organization was striving to create a culture of connection as they navigate what comes next. 42 She indicated Ramsey County League of Local Government would be meeting on Friday, January 43 30 at 8:00 a.m. and would be discussing mental health and crisis support, community engagement 44 and civic resources,public safety and officer support, along with legal rights and information. 45 Mounds View City Council January 26, 2026 Regular Meeting Page 7 1 Council Member Smith explained she spoke with the police chief earlier today and then reviewed 2 a press release from the Law Enforcement Labor Services that called for federal and state 3 emergency summit on immigration enforcement in Minnesota. She then reviewed a statement from 4 Executive Director Jim Mortenson noting he believed the lack of clarity, cooperation, 5 communication and coordination between federal, state and local government was unsustainable. 6 She commented on the need for clarity and coordination going forward to get everyone on the 7 same page and to begin rebuilding trust. 8 9 Council Member Meehlhause reported the City Administrator and himself attended the Charter 10 Commission meeting last week where the group discussed Council vacancies and compensation. 11 12 Council Member Meehlhause explained City Administrator Zikmund, Police Chief Zender, 13 Council Member Gunn and himself attended a celebration at Fire Station 3 in Blaine last week. He 14 stated this event was held to celebrate the Centennial Fire Department becoming part of the SBM 15 Fire Department. 16 17 Council Member Gunn stated she was part of the 50,000 people that were in downtown 18 Minneapolis. She explained this was an amazing event to be a part of. She indicated this made her 19 proud to be a Minnesotan and she was proud of the people who were willing to gather and protect 20 what she believed was important to the community. She reported she did not believe ICE or DHS 21 were law enforcement. Rather, she saw the Mounds View Police Department as law enforcement 22 because they were not hidden and wore badges. 23 24 Mayor Lindstrom indicated he would be attending the Daddy Daughter Dance this Saturday with 25 his daughter. 26 27 Mayor Lindstrom explained he would be attending a joint school board meeting on Thursday, 28 February 5. 29 30 Mayor Lindstrom stated he would be conducting clemency work on Friday, February 6. He noted 31 on Tuesday, January 20 he attended a Board of Pardons meeting. 32 33 Mayor Lindstrom reported the Community Engagement Committee met and discussed events that 34 would be hosted in 2026. 35 36 Mayor Lindstrom explained on Thursday, January 22 he celebrated eight years of sobriety. He 37 commented if it wasn't for the first responders in the community, he would not be alive. He 38 thanked the first responders for serving the community well and for doing their work with dignity 39 and integrity. 40 41 Mayor Lindstrom stated the community saw a person get killed this past weekend in a very reckless 42 manner. He did not imagine there was a need to have eight people on top of one person and then 43 for this person to be shot. He stated this was not okay. He reported his dad used to work at the VA 44 and his father knew him. He indicated he has a series of ordinances he would like to see passed. 45 He did not believe it was unreasonable for federal law enforcement agents to let the City of Mounds 46 View know when they will be in the community. He also did not believe it was unreasonable to Mounds View City Council January 26, 2026 Regular Meeting Page 8 1 ask federal agents to wear a body camera. He explained this was a matter of transparency as was 2 having name tags on federal agents. He reported he was married to an immigrant that does not 3 look like him. He noted his wife came to this country when she was 13 and will no longer leave 4 the house to get groceries,but rather has the groceries delivered.He stated this was not the America 5 that he knows. He explained he wanted things to be better in this community. He stated he wanted 6 the senseless violence to end. He was of the opinion the Council had an opportunity to say certain 7 activities would not be allowed in Mounds View.He discussed how he loved and trusted the police 8 department and indicated he did not want this to go away. He reported the community was hurting 9 and he wanted to see the City Council doing everything in its power to ensure full transparency 10 was occurring when federal agents were in the community. 11 12 Council Member Gunn stated she heard whistles and horns coming from the apartments in her 13 building and noted this was very concerning to her. 14 15 Mayor Lindstrom explained he was getting calls almost every day from people who are concerned 16 about ICE being in Mounds View. He indicated he has received a lot of messages from residents 17 who are afraid to leave their house. He stated this was happening every day and emotions were 18 running very high at this time. He understood that everyone processes this in their own way. He 19 encouraged residents with other opinions to consider how their neighbors are being impacted. 20 21 B. Reports of Staff. 22 23 Public Works/Parks and Recreation Director Peterson discussed the $170,000 grant the City was 24 awarded from Federal Highway Transportation for safe streets for all. He indicated this grant 25 would require the City to provide a $40,000 match. He requested the Council authorize staff to 26 work with the City Attorney on an agreement. 27 28 MOTION/SECOND: Gunn/Clark. To direct staff to work with the City Attorney to draft an 29 agreement with the Federal Highway Transportation. 30 31 Ayes—5 Nays—0 Motion carried. 32 33 Public Works/Parks and Recreation Director Peterson reported the City was awarded $146,200 34 through the DNR for employees to be certified as arborists to assist with creating a forestry plan. 35 He indicated this grant would also help with education materials and planting of Judicial Ditch 1 36 Branch 5 up in Greenfield.He discussed how the trail in this area was in need of better maintenance 37 in the winter months. He requested the Council authorize staff to work with the City Attorney to 38 have the property surrounding the trail transferred to the City of Mounds View. 39 40 Mayor Lindstrom asked if it was best to get the State out of the equation when it came to the land 41 surrounding the trail. Public Works/Parks and Recreation Director Peterson stated this would be 42 his recommendation and why he was recommending he work with the City Attorney to have this 43 land transferred to the City. 44 45 Mayor Lindstrom inquired what direction the Park Commission provided regarding this matter. 46 Public Works/Parks and Recreation Director Peterson explained the Park Commission supported Mounds View City Council January 26, 2026 Regular Meeting Page 9 1 the trail being better maintained going forward, which meant better maintenance and building the 2 trail back up. He noted he met with the Rice Creek Watershed District, and he understood they 3 would like to remove the bridge, which would make maintaining the trail easier. 4 5 Mayor Lindstrom questioned if the trail would be plowed in the coming weeks. Public 6 Works/Parks and Recreation Director Peterson indicated the trail would not be maintained until 7 the land was transferred to the City. He stated he had the City Attorney review the snowplow 8 policy and he was advising the snowplow policy be amended to state this trail will be plowed once 9 the land was transferred. 10 11 Mayor Lindstrom explained he understood this trail had been a topic of conversation for some time 12 and he was pleased to see the wheels being set in motion. 13 14 MOTION/SECOND: Meehlhause/Gunn. To direct staff to work with the City Attorney to have 15 the State of Minnesota property surrounding the Greenfield trail transferred to the City of Mounds 16 View. 17 18 Ayes—5 Nays—0 Motion carried. 19 20 City Administrator Zikmund discussed how the Lexington Fire Department was interested in SBM 21 Fire Department providing fire protection services on a contract basis. He noted conversations 22 were being held and he anticipated a contract would be coming forward later this year. 23 24 City Administrator Zikmund stated he has had many conversations with the City Council in the 25 past two weeks surrounding immigration enforcement and the challenges this was imposing on the 26 local police department. He explained he has been communicating with the Police Chief and City 27 Attorney regarding these concerns and ordinances that have been drafted for the Council's 28 consideration. He noted these ordinances could be considered and reviewed by the Council at this 29 meeting with approval taking place on Monday, February 2. He provided the Council with a copy 30 of a recent court case for the Council to also review and consider. 31 32 Police Chief Zender discussed the challenges the police department was facing when it comes to 33 immigration enforcement officers being in the community. He explained he has been on phone 34 calls and Zoom calls with the Minnesota Chiefs of Police, Department of Public Safety, the 35 Ramsey County Attorney's Office and with various elected officials.He noted the National Chief s 36 of Police were also getting involved. He thanked the Council for their continued support as he 37 works to navigate this issue. He discussed how scene security was very challenging, as has been 38 seen in Minneapolis.He reported these were unprecedented times and explained he would continue 39 to do his best to navigate this situation. He thanked the residents of Mounds View for knowing he 40 was in a tough spot. He indicated he did not want to be pitched against federal law enforcement 41 officers. He commented this issue was taking a great deal of his time and it was his hope he would 42 begin making positive progress. He stated in the two events that occurred over the weekend, his 43 officers were on scene with their body cameras rolling. He reported at the end of the day, his 44 officers would continue to be on scene to ensure people remained safe. 45 Mounds View City Council January 26, 2026 Regular Meeting Page 10 1 City Attorney Riggs reviewed a memo of options available to the City Council, which included 2 draft ordinances. He stated the last three weeks have been unprecedented times. He indicated his 3 office represents 75 different cities and his firm was trying to address this issue. He commented 4 on the memo he provided to the Council when it came to what they can and cannot do. He reported 5 he put together an ordinance that had a very broad spectrum that would require anyone operating 6 as law enforcement in Mounds View has to operate like the local police officers. He indicated 7 these provisions may be challenged by the federal government. He stated the goal of this ordinance 8 was to provide transparency. He commented further on what local staff members can do. He 9 discussed how people are trying to work through this issue and there have been communications 10 between the governor and the president, which was a positive thing. However, the reality is, the 11 City Council controls how law enforcement is conducted in the City of Mounds View and the 12 proposed ordinance would assist with setting regulations for all law enforcement activities in the 13 community. 14 15 Prosecuting Attorney Katrina Joseph introduced herself to the City Council. She discussed the 16 federal court lawsuit that was heard today in Minnesota by Judge Hernandez. She reported on 17 January 12 the State of Minnesota, city of Minneapolis and the city of St. Paul filed a lawsuit 18 against the Department of Homeland Security as to how it was carrying out operation Metro Surge. 19 She indicated there was a request for a temporary restraining order. She explained on Friday the 20 city of Golden Valley received some communication from the Attorney General's office asking 21 for suburban law enforcement agencies to file an amicus brief. She stated she heard from the 22 Golden Valley prosecutor around 4:30 p.m. on Friday and on Saturday morning after the ICE 23 shooting in South Minneapolis there was an emergency meeting of the Hennepin County City 24 Managers and at this meeting the City Administrators indicated they would like her office to file 25 supporting briefs. She inquired if the City Council would like to also file an amicus brief on behalf 26 of the City of Mounds View. She reviewed the five items addressed within the amicus brief noting 27 it was limited in scope. 28 29 Prosecuting Attorney Joseph commented on a current case that was being heard against a US 30 citizen who has a wife with valid status. The wife has indicated to the advocates at Tubman that if 31 she cooperates with prosecution, he will divorce her and turn her over to ICE. She indicated she 32 takes her job very seriously and discussed how impossible it was to prosecute a domestic violence 33 case without a victim present in court. She stated if victims are worried about being picked up by 34 ICE in court,they will not come forward. She commented further on how the jury pools were being 35 impacted by what was happening in the community. 36 37 Prosecuting Attorney Joseph reported there was a lot of anger and fear in the community with how 38 local law enforcement was not keeping people safe. She requested the City Council vote to join 39 the amicus brief 40 41 Mayor Lindstrom stated he was concerned with the fact the BCA was not allowed to participate in 42 the investigations. He indicated there was no accountability for the federal agents,which was very 43 alarming. He explained he supported the proposed ordinance moving forward with the City of 44 Mounds View joining the amicus brief. 45 Mounds View City Council January 26, 2026 Regular Meeting Page 11 1 Council Member Smith asked if Mounds View was already a part of the amicus brief, without the 2 City Council's knowledge. Prosecuting Attorney Joseph reported in speaking with the prosecutor 3 from the city of Golden Valley she learned there was miscommunication and she apologized for 4 this. She indicated the City could withdraw from the amicus brief if that was the desire of the City 5 Council. 6 7 Council Member Smith expressed concern with the fact the City of Mounds View was added into 8 the amicus brief without the City Council's permission or knowledge. City Attorney Riggs 9 reported the City of Mounds View was not part of the lawsuit, but rather the amicus brief was 10 offering support. 11 12 Council Member Meehlhause asked if the City Attorney had concerns about Mounds View 13 offering support to this lawsuit. City Attorney Riggs indicated there were a few other cities that 14 were considering joining the amicus brief. 15 16 Council Member Smith questioned if the City could potentially lose federal funding by supporting 17 the amicus brief. City Attorney Riggs reported there was language in place that could apply to any 18 funding from the federal government. 19 20 Mayor Lindstrom indicated the funding that was being cut was being cut from the entire State and 21 not just the City of Mounds View. 22 23 Council Member Smith inquired if the City Council had to decide on this matter at this meeting, 24 or could action be delayed to Monday, February 2. She indicated she would like to read through 25 all the documentation that was provided to the City Council prior to deciding. City Attorney Riggs 26 reported the Council could wait to act. He noted the City was on the amicus brief at this time and 27 the Council would have to let the Prosecuting Attorney know if this status should change sooner 28 rather than later. 29 30 Council Member Meehlhause stated he could decide on this matter at this meeting. 31 32 Mayor Lindstrom, Council Member Clark and Council Member Gunn concurred. 33 34 MOTION/SECOND: Gunn/Meehlhause. To direct staff to work with the City Attorney to file an 35 amicus brief on behalf of the City of Mounds View. 36 37 Ayes—4 Nay— I (Smith) Motion carried. 38 39 City Attorney Riggs reviewed the proposed ordinance that would require ICE agents to be 40 identified for transparency purposes. He explained the premise behind the ordinance would ensure 41 that residents of Mounds View were being treated in the same manner as they would be treated by 42 Mounds View Police Officers. He commented further on the provisions within the ordinance and 43 asked for comments or questions regarding the ordinance language. He reiterated that this 44 ordinance was a tool and starting point for the City Council. 45 Mounds View City Council January 26, 2026 Regular Meeting Page 12 1 Mayor Lindstrom recommended the body cameras not have SD cards that could be removed. 2 Rather he wanted to see the body cameras having the videos stored in a system that was in the 3 cloud. 4 5 Council Member Gunn inquired what kind of identification federal ICE agents had to provide to 6 Mounds View law enforcement officers if asked for identification. Police Chief Zender stated this 7 was very difficult to determine at this time. 8 9 Mayor Lindstrom stated the only recourse the City has was to pass an ordinance. City Attorney 10 Riggs reported this was the case noting there were discussions about how local municipalities need 11 to start charging federal officers. He anticipated this would be a difficult road to go down and 12 noted the proposed ordinance would assist the City with addressing this topic. 13 14 Police Chief Zender indicated the enforceability of the ordinance was a concern for him. He stated 15 there were a lot of cities discussing this topic at this time and he was uncertain if the proposed 16 ordinance would be enforceable. He explained he did not want to tie up resources chasing ICE 17 agents in the community. 18 19 Mayor Lindstrom stated he understood these were unprecedented times, but it was his hope the 20 ordinance would provide the City with a backdrop on the behavior that was expected in this 21 community. 22 23 Council Member Gunn agreed, noting the ordinance would provide the police department with a 24 tool. 25 26 Council Member Meehlhause stated even if the ordinance was not enforceable, he supported the 27 City Council approving the proposed ordinance which would set expectations for behavior in this 28 community. 29 30 Further discussion ensued regarding how valuable body cameras were for confirming the actions 31 and behaviors of Mounds View police officers. 32 33 Council Member Smith indicated she was concerned with how some residents may come back to 34 the City expressing concern with the fact the Council passed an ordinance that was not being 35 enforced by the Mounds View Police Department. Police Chief Zender stated this was a concern 36 for him as well. 37 38 Council Member Clark supported the City adopting the ordinance as it would give the police 39 department some level of authority. 40 41 Mayor Lindstrom expressed concern with how ICE was not attempting to notify local agencies 42 when they were entering a community. 43 44 Council Member Gunn supported the Council reviewing the ordinance over the coming days with 45 questions or comments being forwarded to the City Administrator. It was her hope the Council 46 could approve the ordinance at a special City Council meeting on Monday, February 2. She recommended the comments and questions 4 the Council has brought forward be further addressed on February 2 for transparency purposes. 5 6 City Administrator Zikmund reviewed the timeline for reviewing and approving the ordinance. He 7 explained if an ordinance were introduced on February 2, the second reading could be held on 8 February 9, and it would take 60 days before the ordinance could take effect. 9 10 The consensus of Council was to review and hold the first reading of the ordinance at a special 11 City Council meeting on Monday, February 2. 12 13 MOTION/SECOND: Gunn/Meehlhause. He questioned why the City Council was against deporting illegal criminals. 25 26 Council Member Gunn stated she was not against deporting illegal criminals but noted she was 27 concerned with the way these actions were being done. 28 29 Mayor Lindstrom explained he wanted there to be transparency in the community. 30 31 Mr. Sandquist indicated that one of the ICE agents had his finger chewed off. 32 33 Council Member Gunn stated two people were now dead. 34 35 Dennis Romson, 7840 Bona Road, commented he was of the opinion writing tickets would not be 36 effective. He stated he asked the police chief if an ICE agent could remove a local police officers 37 body camera and he was told this could be done. 38 39 Council Member Smith inquired body cameras had to be docked for the information to be 40 transferred. Police Chief Zender reported this was the case.He stated he did not foresee ICE agents 41 taking body cameras off Mounds View police officers. 42 43 Murwo Mohamed,2657 Mounds View Boulevard#203, explained she has lived in the community 44 for almost 16 years now. She stated she loves Mounds View very much. She noted she lifts weights 45 at the Community Center and runs in the community. She reported she was a US citizen, and she 46 appreciated how the Mounds View Police Department and the City Councilmembers recognized Mounds View City Council January 26, 2026 Regular Meeting Page 14 1 her. She indicated she was terrified to visit Minneapolis at this time. She commented she worked 2 in the Minneapolis Public School District as a teacher. She indicated she was paranoid and now 3 has four cameras at her home. She expressed concern with the fact the American president has said 4 an entire community was garbage. She explained that she felt under attack. She described how she 5 saw unmarked cars outside the school she worked at, which was also terrifying for the children in 6 the school,who were not illegal. She explained she came to the United States as a legal refuge and 7 she was a citizen. She stated she did not trust the ICE agents working in the community. She 8 reiterated that she loves living in this community,but she was scared. She questioned if ICE could 9 be driving around the parking lot of her apartment complex. 10 11 Police Chief Zender stated it was his understanding this was a public parking lot and ICE agents 12 could enter this space. 13 14 Mel Brandl, 2259 Knoll Drive, explained he has been a resident of Mounds View for the past 50 15 years. He thanked the Council for all they do on behalf of the community. He then discussed how 16 for four years, an unlimited number of immigrants were flooding into the country, and many were 17 criminals. He stated these individuals were now in the United States and the president has sworn 18 to make America safe again. He indicated he understood there were things that needed to be 19 addressed and it was his hope these concerns would be addressed by ICE agents. He stated it was 20 very good to hear the City Council support the Mounds View Police Department. He reported the 21 Council has sworn to protect the residents of Mounds View and he hopes this is done. He indicated 22 the residents of Mounds View need the belief and confidence that the City Council will continue 23 to protect and serve the public. He commented further on the difference between protest,rally and 24 a riot. 25 26 Mohammad Samor,7285 Hidden Hollow Court,reported his family has lived in Mounds View his 27 entire life. He stated his parents purchased their first home on Bona Road and he attended 28 Pinewood Elementary School. He explained in 1992 his parents moved to Pleasant View Drive 29 where his parents still live. He indicated he has lived all over this country, has served this country 30 in Washington DC and he chose to return to Mounds View. He stated one in three people in 31 Mounds View was a person of color. He discussed how the people of color in this community were 32 being treated at this time. He explained his father came to America from Uganda where all 33 descendants of Asian descent were forced to leave the country. He stated his father came to the 34 United States seeking a new life for his family and a place to raise his children and grandchildren. 35 He reported his father asked him if he should be afraid about getting picked up by ICE because he 36 was dark skinned.He indicated his seven-year-old daughter worries about his brother going to play 37 at the park because of his dark skin. He stated that justice delayed is justice denied. He explained 38 action was needed now because people were afraid to go to the grocery store. He commented on 39 how he stopped going to his office because he doesn't want to be stopped on the street. He was of 40 the opinion this was about political retribution and not immigration enforcement. He stated people 41 of color were being stopped indiscriminately on the streets and those with an accent are being 42 asked for their papers. He reported this happened in Germany in the 1930's and should not be 43 happening in the America in the 21St Century. He asked what kind of country the City Council 44 wants for their children and grandchildren. He stated it was not right for those who look a different 45 way or speak a different way to be stopped on the street. He believed all people should be treated Mounds View City Council January 26, 2026 Regular Meeting Page 15 1 with dignity,humanity and basic respect.He appreciated the fact the City Council would be joining 2 the amicus brief, noting there was strength in numbers. 3 4 Sharon Kirscher, 8406 Red Oak Drive, stated she did not know anybody who was opposed to 5 violent criminals leaving the country. She commented further on how the economy was based on 6 illegal immigrants. She explained her son-in-law came to the United States and before he became 7 a legal citizen,he worked at McDonald's. She noted he was paying taxes, and the same deductions 8 were coming out of his paycheck. She stated there was a reason people come to America; it was 9 to pursue a better life. She commented further on how the community needed immigrants to 10 support the economy, social security and to keep food costs lower. 11 12 Janet Frome, 7844 Bona Road, explained she was terrified for the black and brown people. She 13 reported she has a 15-year-old grandson who was Native American and he walks home from school 14 every day. She feared for his safety because he looks Mexican. She stated her grandson's father 15 was prior military. She supported the police working with the ICE agents to get the bad people out 16 of the community. She thanked the City Council for allowing her to speak and ended her comment 17 by stating she was proud of the Mounds View Police Department. 18 19 Brandon Muchler, 8040 Red Oak Drive, commented he believed the City Council allowed a wolf 20 in the community when the FLOCK cameras were installed. He discussed how ICE has used feed 21 from these cameras to track individuals. He questioned if the City understood FLOCK could use 22 the City's data for investigative purposes. He feared the City's data was being sold to outside 23 organizations. 24 25 Ms. Frome indicated data from Ring cameras were also being used by ICE agents. 26 27 Council Member Smith asked how data from the FLOCK cameras could be accessed. Police Chief 28 Zender discussed how the police department utilized the 10 FLOCK cameras that were located in 29 the community.He reported the FLOCK cameras were a great tool in solving crimes. He explained 30 the City has policies in place, noting a data request would have to be made to access data from the 31 FLOCK cameras. He explained no information has been released to any federal agency, nor have 32 there been any data requests. 33 34 City Administrator Zikmund questioned who was putting the data into FLOCK. Police Chief 35 Zender stated this data was being put in by NCIC(National Crime Information Center)for licensed 36 law enforcement. 37 38 City Administrator Zikmund reported the FLOCK cameras provide law enforcement with a tool 39 that makes officers safer. 40 41 Mayor Lindstrom closed the meeting for public comment. 42 43 C. She was of the opinion there would be frustration with Mounds View Police 42 Officers for not carrying out this Ordinance if it were passed. She discussed the many ways 43 Mounds View residents were helping one another and asked that this be the focus at this time. 44 45 Mounds View City Council February 2, 2026 Special Meeting Page 2 1 Tony Preciado, 8217 Long Lake Road, commented on how ICE agents were carrying out federal 2 orders and he did not believe these individuals would comply with this local ordinance. He 3 anticipated residents would become upset with Mounds View police officers because they would 4 not be able to do a single thing about ICE agents in the community even if this ordinance were 5 passed. 6 7 Karen Arciero, 7417 Park View Drive, explained she disagreed with the previous two speakers. 8 She supported the City pursuing this Ordinance as it was written. She commented on how this 9 Ordinance would show what this community stands for. She understood people had been killed 10 and she appreciated what the City was doing to stand up and take action. 11 12 Rebecca Scholl, 2467 Hillview Road, stated she was appalled by what was going on and noted 13 people were afraid. She understood veterans were upset because this was not the country they 14 fought for. She supported Mounds View taking action so residents could tell their children the City 15 was doing all that it could to keep residents safe. She wanted the children in the community to 16 understand Mounds View police officers were the good guys. She supported the City having 17 transparency and encouraged the City to move forward with the ordinance in order to have laws 18 on the books. 19 20 Police Chief Zender reported that he learned today that Homeland Security officers on the ground 21 would be issued body cameras. 22 23 Debra Sorano, 5093 Irondale Road, explained she was of the opinion the City did not need new 24 Ordinances for the police department to enforce. Rather, she believed officers needed to uphold 25 their sworn duty to honor the rule of law. She reported that if a federal officer comes into the 26 community and violates a resident's civil rights they must be arrested. She indicated there was 27 overwhelming evidence that federal agents were acting illegally. She commented on how residents 28 were encouraged to protest peacefully, while the civil rights of others were being violated. She 29 believed the Police Chief cared about the immigrants in the community and asked that no further 30 individuals be dragged out of their homes without a court hearing. She discussed how peaceful 31 protesters were being pushed, shoved, manhandled, pepper sprayed and killed by federal agents. 32 She did not want to stand by and let her civil rights be obliterated. She explained she needed the 33 local cops in place to protect civil rights and to bust through the paradigm that says law 34 enforcement agencies cannot police each other. She asked that the local police officers stand 35 between the protestors and ICE agents to monitor what was going on. She stated the first cop that 36 steps up and arrests a federal agent for violating a resident's civil rights will be a national hero. 37 38 Mr. Preciado reported there were different views on this Ordinance. He suggested this matter be 39 addressed by the City Attorney versus the City Council. He commented further on how the Mounds View City Council February 2, 2026 Special Meeting Page 3 1 directions from the federal government would trump the actions of local government in this 2 situation. 3 4 City Administrator Zikmund explained the City Attorney works for the City Council. He noted he 5 would work with the City Council and City Attorney in order to bring this item back to a meeting 6 where all individuals could be in attendance. 7 8 Rosemary Lansing, 8310 Pleasant View Drive, explained she was concerned with the proposed 9 Ordinance and how police officers would be impacted in the community. 10 11 Acting Mayor Gunn closed the meeting for public comments. 12 13 Acting Mayor Gunn explained the Council would further discuss this Ordinance at a future City 14 Council meeting. 15 16 Council Member Clark commented on the amount of time and feedback she provided to the Mayor 17 and City Administrator regarding this Ordinance. 18 19 Council Member Smith indicated she had spoken to other city mayors regarding this Ordinance 20 and to learn about how other communities were addressing this concern. She noted on Friday 21 morning she attended a discussion at Betty McCullom's office with 49 other elected officials. She 22 reported there were things that she did not like seeing and indicated the Council was working 23 through the best way to proceed. 24 25 Police Chief Zender addressed the comments made by Debra Sorano noting Ms. Sorano reached 26 out to him six to eight months ago and he had a conversation with her. He reported there were 27 things that local police were able to do and things local police could not do. He indicated he did 28 not want it to appear that the Mounds View Police Department did not care. He stated the notion 29 that Mounds View police officers would not stand up for human rights was not true. 30 31 5. In addition, Chapter 111, which includes Restaurants, requires City Council approval for a restaurant license. Discussion: El Novillo Alegre LLC is requesting an on-sale intoxicating liquor license and Class A restaurant license (occupancy load greater than 100, operating less than 16 hours per day) to operate a restaurant and bar at 2535 Mounds View Boulevard, previously occupied by Dos Hermanos, in the Mounds View Square Shopping Center. This request also includes Sunday Sales and an application for outdoor liquor consumption. Staff has reviewed the requirements of Chapter 110, which includes Intoxicating Liquor, and Chapter 111, which includes Restaurants, and this request appears to meet all requirements set forth in both Chapters. Staff would like to point out that Chapter 110.029 states that, "no license shall be issued for premises located within the areas restricted against commercial use by Chapter 160 of this code of ordinances". Chapter 160, the Zoning Code, states that on-sale intoxicating liquor licenses shall not be granted for any premises within 200 feet of any permanently sited church as measured from the front door or outside seating area. The exception would be that the business receives at least 60 percent of its annual gross sales revenue from the sale of food. The proposed site is adjacent to Sunrise Methodist Church; however, it appears that the proposed outdoor patio is approximately 520 feet from the church building, which is well over the required 200 feet. In addition, the floor plan is the same as Dos Hermanos and shows the bar/dining seats is only a small portion of the entire restaurant's square footage. Staff is of the understanding that the main operation of the business will be food sales. The restaurant will be open Monday through Thursday from 10:30 a.m. to 10:00 p.m. and Friday and Saturday from 10:30 a.m. until 2:00 a.m. (need separate 2:00 a.m. license issued before they can stay open that late), and Sunday from 10:30 a.m. until 12:00 a.m. The applicant has provided proof of application for their Ramsey County Food License. Guarantor hereby guarantees to Landlord, its successors and assigns, full and prompt payment of any and all sums and charges payable by Tenant, its successors and assigns, under the Lease, and hereby further guarantees the full and timely performance and observance of all the covenants,terms, provisions,conditions and agreements of the Lease to be performed and observed by Tenant, its successors and assigns; and Guarantor hereby covenants and agrees to and with Landlord, its successors and assigns, that if default will at any time be made by Tenant, its successors or assigns, in the payment of Rent as that term is defined under the Lease (to include, without limitation, Minimum Rent and all Tenant's Proportionate Share of Operating Costs,Real Estate Taxes,and Landlord's Insurance),or if Tenant should default in the performance and observance of any of the covenants, terms, provisions, conditions or agreements contained in the Lease, Guarantor will and will forthwith pay such rent to Landlord, its successors and assigns,and any arrears thereof,and will and will forthwith faithfully perform and fulfill all of such covenants, terms, conditions, provisions and agreements, and will forthwith pay to Landlord all damages that may arise in consequence of any default by Tenant,its successors or assigns,under the Lease, including without limitation all reasonable attorneys' fees and disbursements incurred by Landlord or caused by any such default and/or by the enforcement of the Lease or of this Guaranty. If at any time the term Guarantor will include more than one(1)person or entity,or the obligations herein are guaranteed by more than one(1)person or entity,the obligations of all such persons and/or entities under will be joint and several. This Guaranty will be enforceable against Guarantor, its successors and assigns, without the necessity of any notice of non-payment, non-performance or non- observance or of any notice of acceptance of this Guaranty or of any other notice or demand, which Guarantor hereby expressly waives; and Guarantor hereby expressly agrees that the validity of this Guaranty and the obligations of Guarantor hereunder will in no wise be terminated,affected,diminished or impaired by reason of the assertion or the failure to assert by Landlord against Tenant, or against Tenant's successors or signs,of any of the rights or remedies reserved to Landlord pursuant to the provisions of the Lease. This shall be a continuing guaranty,and the liability of Guarantor hereunder will be deemed to also include all liabilities of Tenant arising out of any assignment, renewal, modification or extension of the Lease. The liability of Guarantor hereunder will in no way be affected, modified or diminished by reason of any assignment, renewal, modification or extension of the Lease or by reason of any modification or waiver of or change in any of the covenants, terms, provisions, conditions, of agreements of the Lease by Landlord and Tenant, or by reason of any extension of time that may be granted by Landlord to Tenant, its successors or assigns, or by reason of any dealings or transactions or matter or thing occurring between Landlord and Tenant, its successors or assign,or by reason of any bankruptcy, insolvency,reorganization, arrangement, assignment for the benefit of creditors,receivership or trusteeship affecting Tenant,whether or not notice thereof is given to Guarantor. 2. If any payment received by Landlord and applied to the obligations described herein is subsequently set aside, recovered,rescinded or required to be returned for any reason(including,without limitation,the bankruptcy, insolvency or reorganization of Tenant or any other obligor),the obligations to which such payment was applied will for the purposes of this Agreement be deemed to have continued in existence,notwithstanding such application,and this Agreement will be enforceable as to such obligations as fully as if such application had never been made. 11. The City of Mounds View is an eligible recipient of LAHA funds and will receive annual allocations for the purpose of supporting affordable housing activities within the community. Minnesota Statutes, Chapters 469.001-469.47 authorizes municipalities to establish an Economic Development Authority (EDA) and to delegate to the EDA the powers necessary to carry out housing and redevelopment activities. The Mounds View Economic Development Authority (EDA) has organizational capacity, expertise, and administrative structure to manage housing programs, financial assistance tools, and development activities consistent with LAHA requirements. The delegation of administration of LAHAfunds to the EDAwill promote efficient program management, ensure compliance with state requirements, and support the City's long-term housing goals. The EDA further delegates the administration of many of its loan programs to the Center for Energy and Environment (CEE). The EDA is still required to pre-screen candidates for the program and deliver a list of candidates to CEE for program processing. In order to officially begin administration of the new LAHA program, City staff propose the City Council and the EDA take the following actions: 1. The City Council must formally delegate authority from the City of Mounds View to the EDA by adopting this Resolution in order to administer all funds. 2. The resolution will take effect immediately upon its adoption. Discussion The City Council should review and discuss delegating authority from the City to the EDA to administer the LAHA program. Sathe, Legal Counsel RE: PUBLIC HEARING: Proposed Amendments to the Mounds View City Charter Regarding Appointments—Introduction and First Reading of Ordinance 1050 The Mounds View Charter Commission recommends that the City Council amend the Mounds View City Charter by ordinance to address the process for making appointments in the case of a mayoral or councilmember vacancy. The amendment includes a set process, timeline, and eligible appointees. Additionally, the amendment provides that a person appointed as mayor would not preside of council meetings or give the state of the City address — these functions could be performed by the councilmember designated as Acting Mayor at the first meeting of the year. This proposal is similar to an amendment presented in the fall of 2024, but which was amended to address legal concerns with the language, and it is identical to the amendment presented in the fall of 2025 but has been presented again for adoption due to a timing error. AMENDMENTS TO CHAPTER 4 The proposed appointment process is slightly different depending on the timing of the vacancy: 365 Days or More Remaining in Unexpired Term—Section 4.05, subd. 1 If there are 365 days or more remaining in an unexpired term: - The City Council may appoint an individual using the new appointment process. - The appointee serves until a successor is elected at a special election. - A special election is called for the next feasible statutorily designated uniform election date (occurring the second Tuesdays in February, April, May, and August and the second Tuesday after the first Monday in November). Less than 365 Days Remaining in Unexpired Term—Section 4.05, subd. 2 MU210\4\1059035.vl Page 2 If there are less than 365 days remaining in an unexpired term,then the City Council may: - The City Council may appoint an individual using the new appointment process. - The appointee serves until the term expires. - The successor is elected at the regular election to serve at the beginning of the next term. Appointment Process and List—Section 4.05, subd.3 This new subdivision includes a detailed process the City must follow to make an appointment. Once the Council adopts a resolution declaring a vacancy,the City Administrator will contact the designated list of individuals, who are serving in leadership positions on city boards and commissions. If an individual from the list accepts and is qualified to serve,the Council will appoint that person to fill the vacancy. The only procedural difference between a vacancy with 365 days or more and a vacancy with less than 365 days is that if no person accepts or is qualified and less than 365 days remain, then the Council may appoint anyone to fill the vacancy. If more than 365 remain and no person from the list accepts, then the seat will remain vacant until the special election. DUTIES OF THE MAYOR—SECTION 4.05, SUBD.4 Based on feedback from the joint meeting between the Charter Commission and City Council, the amendment also designates that the City Council member serving as the Acting Mayor (with such designation occurring every January) will preside over meetings of the Council, study the operations of government and recommend changes to the Council,and deliver the state of the City address during the time an appointed person is serving as the mayor. The person appointed to fill a vacancy in the office of the mayor will perform the statutorily designated duties of the mayor such as signing contracts,ordinances,resolutions,being recognized for the purpose of serving civil processes, and may declare a state of emergency. AMENDMENT TO CHAPTER 2 The ordinance includes a simple amendment to Section 2.05 that consists of adding a reference to the new appointment process. STEPS TO AMEND THE CHARTER BY ORDINANCE The enclosed charter amendment is in the form of an ordinance and therefore must be considered by following the steps required for adopting any ordinance and additional steps required under law because the ordinance will amend the charter. In addition to requiring two readings per City Charter, the city must hold a public hearing, and the effective date of the ordinance is 90 days from the date of publication, subject to a petition process that would need to be completed within 60 days of publication. Should a petition be submitted and found sufficient, then the City Council could decide to ask voters to approve the amendment or could withdraw the amendment. Background; findings; authority. 1.01. The city of Mounds View ("City") is governed by a home rule charter(the "City Charter"), adopted pursuant to the Constitution of the State of Minnesota and Minnesota Statutes, chapter 410 (the "Act"). 1.02. The Mounds View Charter Commission has proposed the adoption of an amendment to Chapters 2 and 4 of the City Charter (the "Amendment") and recommended to the City Council that the Amendment be adopted by ordinance in the manner prescribed by section 410.12, subdivision 7 of the Act. 1.03.A public hearing on the Amendment was held on November 24, 2025, by the Mounds View City Council after published notice containing the text of the Amendment, as required by the Act, and all persons desiring to be heard with reference to the Amendment were heard at said public hearing. 1.04. The Mounds View City Council finds and determines that it is in the best interests of the City and its inhabitants that the Amendment be adopted. Section 2. Adoption; effective date; filing. 2.01. Chapter 2 of the Mounds View City Charter is hereby amended by removing , or adding the double-underlined language as follows: Section 2.05 Vacancies.A vacancy in the Council, whether it be in the office of mayor or council member, shall be deemed to exist in case of the failure of any person elected thereto to qualify, or by reason of the death, resignation in writing filed with the city administrator, removal from office, non-residence in the city, conviction of a felony of any such person after their election, or by reason of the failure of any Council member without good cause to attend Council meetings for a period of three (3) consecutive months. In each such case the Council shall by resolution declare the vacancy to exist and follow the appointment process in Chanter 4, Section 4.05. 2.02. Chapter 4 of the Mounds View City Charter is hereby amended by removing Section 4.05 in its entirety and replacing it with the following: Ordinance No. 1050 Page 2 Section 4.05 Vacancy in Municipal Elected Office: Subdivision 1. Vacancy and 365 days or more remain in the term. The following process shall be followed when addressing a vacancy, as defined in Chapter 2, Section 2.05 or other applicable law, in an elected office of the City that occurs with 365 days or more remaining in the term of the vacated office: A) A special election shall be called at the next uniform election date specified in Minnesota Statutes, section 205.10, subd. 3a, as amended, for which all legal requirements for special elections can be met by the City. B) The City Council shall appoint an individual following the appointment process in this Section 4.05 to fill the vacancy until a successor is elected and qualifies. Subdivision 2. Vacancy and less than 365 days remain in the term. The following process shall be followed when addressing a vacancy, as defined in Chapter 2, Section 2.05 or other applicable law, in an elected office of the City that occurs with less than 365 days remaining in the term of the vacated office: A) The City Council shall appoint an individual following the appointment process in this Section 4.05 to fill the vacancy for the remainder of the unexpired term and until the election and qualification of a successor. Subdivision 3.Appointment If, pursuant to subdivisions 1 or 2, the City Council may appoint an individual to fill a vacancy, the following process must be used: A) A majority of the members of the council voting on the resolution declares a vacancy via resolution. B) Within thirty(30) days of the date the vacancy is declared, the city administrator shall present an individual from the list in Subdivision 3.(D) to the City Council for appointment using the process described in this Subdivision 3. A) The City Administrator shall give at least sixty (60) days published prior notice of the date of the special election and such notice shall comply with all notice requirements under Minnesota Statutes, section 205.16, as amended. B) The procedure at such election and assumption of duties of elected officers following such election shall conform as nearly as practicable to that prescribed for other municipal elections under this Charter. They are listed in the attached resolution in the Budget column. Resolution 10205 formally authorizes the listed transfers between funds in the Actual column for 2025. Council can direct staff to make additional changes it desires, as there is a surplus in the General Fund. Discussion: The transfers from the TIF funds have been adjusted based on actual TIF revenue received. The transfer to the Storm Water fund from the Vehicle and Equipment fund has been increased to account for the actual cost of the items net of disposal proceeds. The General Fund has a surplus mainly due to staff vacancies and the rebound of the value of the City's investment portfolio. There is approximately $385,000 of funds available for transfer from the General Fund. Staff would recommend transferring the $385,000 from the General Fund to the Special Projects Fund to assist with future capital projects. Recommendation: Staff is recommending approval of resolution 10205, approving transfers between funds and authorizing the Finance Director to complete any corresponding budget adjustments.
