HomeMy WebLinkAboutOrdinance 1056 - 2026/03/09ORDINANCE NO. 1056 CITY OF MOUNDS VIEW COUNTY OF RAMSEY STATE OF MINNESOTA AN ORDINANCE AMENDING TITLE III OF THE MOUNDS VIEW CITY CODE CONCERNING STEWARDSHIP OF CITY RESOURCES THE CITY COUNCIL OF MOUNDS VIEW ORDAINS: SECTION I. Title III of the City Code of the City of Mounds View, Minnesota, is hereby amended to create a new Chapter 39 as follows: CHAPTER 39 - STEWARDSHIP OF CITY RESOURCES 39.01 PURPOSE AND POLICY The purpose of this Chapter is to ensure that the City is stewarding its resources for the benefit of the public in accordance with state public purpose expenditures law and in a nondiscriminatory fashion compliant with both the Minnesota and the United States Constitution. The City finds that this Chapter serves the public interest by ensuring the equal treatment of all residents and visitors in the provision of City resources and services, preserving the trust of the public in the integrity of the City's stewardship of public resources, and maintaining compliance with applicable local, state, and federal laws. The City's findings in Resolution No. 10218 are hereby incorporated by reference. 39.02 DEFINITIONS The following words and phrases used in this Chapter having the meanings given in this section: City property. Real property owned by the City of Mounds View, including City parks, buildings, parking lots and parking structures, but not including public right-of-way, public streets, and sidewalks. City Property includes property generally open to the public and not generally open to the public, such as City utilities and spaces designated as employee -only or requiring secured access for entry. 39.03 PROHIBITED USE OF CITY RESOURCES (a) No City employee or City public official may direct, permit, facilitate, or authorize the use of City resources, including but not limited to City Property or City personal property, facilities, money, or personnel: Ordinance 1056 Page 2 (1) For the purpose of enforcing federal immigration laws except as authorized by law, a judicial warrant, or other similar lawful authorization; or (2) For the purpose of discriminating against any individual on the basis of a protected class characteristic under the Minnesota or United States Constitution; or (3) For personal benefit or profit. (b) No individual or federal, state, or local agency may use or access City Property for the purposes of staging operations, except where the use of City Property is authorized by a judicial warrant, subpoena or other similar lawful authorization. Federal, state, or local government entities or personnel will not receive special or enhanced access to City Property for operations enforcing federal civil immigration law. 39.04 COMPLIANCE WITH LAW Nothing in this Chapter should be construed to violate state or federal law or to prohibit City employees from providing data or services when required by state or federal law, including 8 U.S.C. 1373 and 1644. 39.05 SEVERABILITY If any section, clause, provision, or portion of this Chapter is adjudged unconstitutional or invalid by a court of competent jurisdiction, that part may be severed and shall not invalidate or effect the enforceability of the remainder of this Chapter. SECTION 2. Summary Publication. In accordance with Section 3.07 of the City Charter and Minnesota Statutes, Section 412.191, the City Council determines the publication of the title, and a summary of the Ordinance would clearly inform the public of its intent and effect, and City staff shall have the following summary printed in the official City newspaper in lieu of the complete ordinance: ORDINANCE NO. 1056 AN ORDINANCE AMENDING TITLE III OF THE MOUNDS VIEW CITY CODE CONCERNING STEWARDSHIP OF CITY RESOURCES On March 9, 2026, the Mounds View City Council adopted Ordinance No. 1056. The purpose of Ordinance No. 1056 is to establish certain requirements for the use of city resources, including city property, and make related reporting requirements of city personnel. The ordinance prohibits the use of city resources, including city property and personnel, for the purpose of enforcing immigration laws, discriminating against a protected class, or for personal benefit. The ordinance requires that city personnel make a report when city resources are used for such purpose or when a request to use city resources for such purpose is denied. A printed copy of the ordinance is Ordinance 1056 Page 3 available for inspection during regular business hours at Mounds View City Hall and is available online at the City's website located at htt-ps://www.moundsviewmn.org. SECTION 3. Effective date. This ordinance shall take effect and be in force 30 days from and after its passage and publication, in accordance with Section 3.09 of the City Charter. Introduction and First Reading by the Mounds View City Council on February 26, 2026. Second Reading and Adoption by the Mounds View City Council on March 9, 2026. Publication Date: March 12, 2026.
