ORDINANCE 1064 <br />CITY OF MOUNDS VIEW <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE REGARDING HEIGHT OF <br />ATTACHED ACCESSORY STRUCTURES <br />The City of Mounds View Ordains: <br />Section 1. Background; authority. <br />1.01. The City of Mounds View ("City") has adopted a zoning ordinance pursuant to the authority <br />granted by the Municipal Planning Act. M.S. §§ 462.351 to 462.365, inclusive, as they may <br />be amended from time to time. <br />1.02. Sections 160.450 and 160.451 of the Mounds View Zoning Ordinance detail the process <br />and requirements for amending the zoning ordinance. <br />1.03. Section 160.028(A) of the code currently states that: "An accessory building shall be <br />considered an integral part of the principal building if it is connected to the principal <br />building by a covered passageway." <br />1.04. Section 160.056(C)(6) states that "The height of any accessory building or structure shall <br />not exceed 18 feet or that of the principal structure, whichever is less." Section <br />160.087(A)(2) states that "Accessory buildings shall not exceed 18 feet or that of the <br />principal structure, whichever is less, in height"; <br />Section 2. Amendment Request. <br />2.01. The property owner of 8150 Eastwood Road, Heidi Schroeder, has submitted an j <br />application to the city requesting an amendment to the city's zoning code to allow <br />accessory structures that are attached to be taller in height than currently allowed. <br />2.02. The proposed request would amend Section 160.056(C)(6) to add the underlined: <br />"The height of any accessory building or structure shall not exceed 18 feet or that of the <br />principal structure, whichever is less; unless otherwise allowed under this ordinance." <br />2.03 The proposed request would amend Section 160.087(A)(2) to add the underlined and <br />removed the striketh Fo ugh: <br />"Accessory structures that are attached to the principal structure shall be limited to a <br />height of 12 feet taller than the principal structure, not to exceed two stories, provided that <br />the attached accessory structure adheres to the minimum setback requirements applicable <br />to the principal structure, and the height of the attached accessory structure does not <br />exceed the maximum allowed in the underlying zoning district. Detached accessory <br />structures shall be limited to a maximum height of 18 feet or the height of the principal <br />structure, whichever is less.
