SPECIAL ORDER OF BUSINESS 37 A. LB Carlson 2025 Audit Presentation—Aaron Nielsen, Principal. 38 39 Aaron Nielsen, Principal with LB Carlson, presented the 2025 audit to the City Council. He 40 provided further comment on the financial statement, special purpose report and management 41 report. He explained the City was meeting its fund balance policy even with the rise in costs over 42 the past year. He commented further on the summary changes in net position within the enterprise 43 funds and commended the City for receiving a clean or unmodified opinion for the 2025 audit. 44 45 Mayor Lindstrom thanked Mr. Nielsen for his detailed presentation on the 2025 audit. 46 Mounds View City Council May 11, 2026 Regular Meeting Page 2 1 MOTION/SECOND: Meehlhause/Gunn. To Accept the 2025 Financial Reports and Audit 2 Results. 3 4 Ayes—5 Nays—0 Motion carried. 5 6 B. National Public Works Week Proclamation (to be read aloud). 7 8 Mayor Lindstrom read a proclamation in full for the record declaring May 17 through May 23, 9 2026 to be National Public Works Week in the City of Mounds View. 10 11 C. 2026 MVPD Quarter 1 Report- Police Chief Zender. 12 13 Police Chief Zender presented the Council with the first quarter report from the Mounds View 14 Police Department. He reported this week was National Police Week and he thanked his officers 15 for serving the community with integrity,professionalism,dedication and bravery on a daily basis. 16 He remembered and honored those who have given their lives in the line of duty. He provided 17 further information on the events that occurred in Quarter 1 and thanked all who participated in 18 the Daddy Daughter Dance and Polar Plunge. He reported he currently had 18 officers and two 19 CSO's. He commented on the recent interviews held for the two open positions. He discussed the 20 life saving awards that were presented to Officer Boscardin, Officer Garcia and Investigator Solz, 21 noting that these individuals were also recognized at the Minnesota Chiefs of Police Executive 22 Training Institute. He commented on the missing person case for Hailey Amar that began in 23 December 2015 and was closed in March of 2025. He presented the calls for service noting his 24 officers remain active when it comes to traffic and TZD calls. He thanked the City Council for 25 their investment in the Flock cameras, noting these cameras are proving to be a valuable tool for 26 the Mounds View Police Department and stated he appreciated the Council's continued support. 27 28 7. PUBLIC COMMENT 29 30 Mayor Lindstrom encouraged the public to speak with kindness and respect when addressing the 31 City Council during Public Comment. 32 33 Vince Meyer, 8380 Spring Lake Road, suggested the City Council consider discussing address 34 markings on buildings in the community for safety purposes. 35 36 Tony Preciado, 8217 Long Lake Road, reported last Saturday he visited El Novillo Alegre and 37 explained there were so many people at this restaurant that the restrooms could not support the 38 users. He suggested the City look into this concern because there were too many people at this 39 restaurant on the weekends. He noted he was not given the correct change back for his bill and 40 stated he had concerns with the fact the restaurant misrepresented who would be paying the credit 41 card fees. 42 43 Connie Harness, 5511 Quincy Street, expressed concern with her high gas and electric bills from 44 this past winter. She reported her bills ranged from $700 to $1,100 per month over the past four 45 months. She asked that the City Council provide comments regarding utility rates at 46 utilityreform.now. Mounds View City Council May 11, 2026 Regular Meeting Page 3 2 Luke Edmond, 8407 Spring Lake Road, indicated he read Xcel was changing their billing which 3 meant the March bill was double because bills were not sent out in February. He questioned if the 4 number of incidents with school buses was down from last year. 5 6 Rebecca Scholl, 2467 Hillview Road, discussed the public utilities and energy bills. She reported 7 for those residents that are in need,there was assistance available from the public utility providers. 8 9 City Administrator Zikmund noted CEE completes home energy audits for residents. He 10 encouraged Ms. Harness to reach out to the City for further information on these audits. 11 12 8. COUNCIL BUSINESS 13 A. Resolution 10251, Approving the Final Plat and Wetland Buffer Permit for a 14 Subdivision of 7687 Long Lake Road. 15 16 Evan Monson, Stantec, requested the Council approve the final plat and wetland buffer permit for 17 a subdivision at 7687 Long Lake Road. He discussed the process that has been followed and noted 18 the applicant was proposing to construct Suite Living Mounds Views which would consist of 32 19 senior living suites. He commented further on the proposed request and recommended approval 20 with conditions. 21 22 MOTION/SECOND: Meehlhause/Smith. To Waive the Reading and Adopt Resolution 10251, 23 Approving the Final Plat and Wetland Buffer Permit for a Subdivision of 7687 Long Lake Road. 24 25 Ayes—5 Nays—0 Motion carried. 26 27 B. Introduction and First Reading of Ordinance 1064, Amending the Zoning 28 Ordinance Regarding Height of Attached Accessory Structures. 29 30 Evan Monson, Stantec,requested the Council introduce an ordinance that would amend the zoning 31 ordinance regarding height of attached accessory structures. He commented on the discussion that 32 was held at the Planning Commission meeting, reviewed the proposed language within the 33 ordinance and noted the Planning Commission recommended approval of the proposed ordinance. 34 35 Council Member Gunn asked how the proposed room above the garage would be accessed. 36 37 Heidi Schroder, 8150 Eastwood Road, explained the space would be accessed through the garage. 38 She indicated the space would be used by the family as a bonus room. 39 40 Council Member Meehlhause requested further comment on why the applicant was requesting an 41 ordinance amendment versus a variance. Mr. Monson reported that variance requests were 42 reviewed by the Planning Commission and were not guaranteed to be approved. He stated the 43 ordinance amendment would allow for the height of the proposed accessory structure to move 44 forward without requiring a variance. 45 46 MOTION/SECOND: Clark/Meehlhause. REPORTS 7 A. Reports of Mayor and Council. 8 9 Council Member Smith stated last week she attended an international boating and safety 10 conference. She noted she also attended the Ramsey County League of Local Government meeting 11 where the group discussed the elections process. 12 13 Council Member Smith commented on Saturday she witnessed veterans,including her dad,receive 14 a quilt of valor at the Blaine Veterans Memorial. 15 16 Council Member Smith reported she toured the cannabis shop in Mounds View earlier today where 17 she learned a great deal about the safety measures that were in place. 18 19 Council Member Smith explained the Festival in the Park Committee would meet next on Tuesday, 20 May 19. 21 22 Council Member Smith indicated she would be participating in Ramsey County water rescue drills 23 with fire departments next week. 24 25 Council Member Smith stated she felt really bad the City did not recognize the announcement of 26 April 25 through May 3 as being National Firefighter Week. She thanked the SBM Fire 27 Department for serving the City of Mounds View well. 28 29 Council Member Smith reported this week was National Police Week and she thanked Police Chief 30 Zender and all the police officers for serving the community with professionalism and dedication. 31 She explained the State's Peace Officers Memorial Ceremony would be held on Friday, May 15 32 in St. Paul. 33 34 Council Member Clark stated the Mounds View Police Foundation would be meeting on Tuesday, 35 May 12 at 5:30 p.m. 36 37 Council Member Clark commented she participated in the fourth cleanup event at the abatement 38 property. She thanked all the volunteers who helped at this event. 39 40 Council Member Gunn stated she attended the Northeast Youth and Family Services fundraiser 41 luncheon last week. 42 43 Council Member Gunn indicated she and Council Member Meehlhause attended the Irondale High 44 School scholarship night on behalf of the Mound View Lions. 45 Mounds View City Council May 11, 2026 Regular Meeting Page 5 1 Council Member Gunn commented on the Tibet Fest that was held at Long Lake Park on Sunday, 2 May 10. 3 4 Council Member Gunn stated the Mounds View Police Foundation would be holding a fundraiser 5 at the Red Robin on Lexington Avenue on Monday, May 18 from 11:00 a.m. to close. 6 7 Council Member Meehlhause reported the Mounds View Lions would be holding their annual 8 garage sale at Hillview Park on Wednesday, May 13 through Friday, May 15. 9 10 Council Member Meehlhause stated the Ramsey County Suburban Law Enforcement Ceremony 11 would be held on Thursday, May 14. 12 13 Council Member Meehlhause commented on Wednesday, May 20 he would be attending a NYFS 14 Finance Committee meeting. 15 16 Council Member Meehlhause explained two weeks ago he and Coon Rapids Mayor Jerry Koch 17 had to visit Village Bank to open a new account for the convention bureau after a check was 18 fraudulently cashed for this organization. 19 20 Council Member Clark stated she attended the fiesta at El Novilla Alegre on Saturday, May 9. 21 22 Mayor Lindstrom thanked everyone who volunteered at the cleanup event over the weekend. 23 24 Mayor Lindstrom reported he had to attend an emergency clemency hearing last week and noted 25 he attended another hearing today. 26 27 B. Reports of Staff. 28 29 Finance Director Bauman explained the Council approved conduit debt issuance was still moving 30 forward. 31 32 Assistant City Administrator Beeman stated Community Development was working on a FOG 33 (fats, oils and grease) system. He reported that staff was also working on the vacant property 34 ordinance and registry system. He indicated Dunkin Donuts completed their lease agreement and 35 staff was waiting for permits to come forward. He stated it was his understanding Culver's was 36 still moving forward. He commented the ownership for AmericInn changed, as did the ownership 37 for American National Bank, which changed to Associated Bank of Green Bay, Wisconsin. He 38 stated preliminary meetings are being held for the 2050 Comprehensive Plan and stated staff would 39 be pursuing grants for this project. 40 41 City Administrator Zikmund stated the City received another registration for a cannabis retail shop. 42 He reported that the City's attorneys were speaking to the Minnesota Roots attorneys to get the 43 lease finalized within Mounds View Square. 44 45 City Administrator Zikmund explained interviews would be held for the Finance Director position 46 on Tuesday, May 19. The code establishes different requirements based on zones, as well as whether a structure is the main or primary building on a lot (referred to as the principal structure) or if it is an accessory structure. Requirements for an accessory structure and a principal structure can vary. Note that staff will use the terms `building' and `structure' interchangeably in this report. The city's current code requirements establish height limitations for principal structures located in the R-1, R-2, R-3, and R-5 zones of "...two and one-half stories or 45 feet."per Section 160.056(C)(1). Accessory structures are limited to a height of 18 feet or that of the principal structure, whichever is less. This is listed in Sections 160.056(C)(6) and 160.087(A)(2) of the code. Section 160.087(A)(2), which covers requirements of accessory uses in the R-1 zoning district, more specifically states that "Accessory buildings shall not exceed 18 feet or that of the principal structure, whichever is less, in height...". The applicant owns the property at 8150 Eastwood Road. They are working on an expansion of the existing garage that is attached to their single story house. The project would expand the one stall garage into two stalls, and would add living space above the parking space. The garage would be a height of approximately 26 feet. Upon submittal of plans for a building permit for their project, staff notified the applicant that their project would result in an accessory structure that is exceeding the height requirements of the R-1 zone, as the existing house is only 18 feet tall. The applicant had the option to request a variance, or to request an amendment to the code requirements. Given the standards for granting a variance, and issues staff has found with the current code language as-is, the applicant is requesting an amendment to the Zoning Code, to allow attached accessory structures to be treated to the same height requirements appliable to a principal structure. A request to amend the text of the code is considered a `legislative request', as the city is reviewing and setting the regulatory standards by which development will have to adhere to. Sections 160.450 and 160.451 outlines the process to review an amendment to the city's Zoning Code. Such a request is reviewed by the Planning Commission, and approved or denied by the City Council. Ordinances require two readings before the City Council. The Council held the first reading at the 5/11/2026 City Council meeting. Evaluation: Comprehensive Plan The city's 2040 Comprehensive Plan serves as a high-level guide for future development in the community. Since a comprehensive plan is a `high-level' look at development, a comprehensive plan typically does not delve into the specifics of accessory structures. That being said, a community's plan can provide support or guidance on how new development or redevelopment impacts the community. The Implementation Chapter (Chapter 7 of the city's 2040 Plan) includes the goals and policies the city is working to implement in both the short term and long term. Some of the goals and policies that would support the applicant's proposed change to the height requirements for attached accessory structures are: • Housing Policy Goal #2: Maintain the residential character of Mounds View o Housing Policy Goal #2, Policy#1: Preserve single-family neighborhoods. • Housing Policy Goal #3: Support a mix of housing types reflective of the needs and desires of the community. Zoning Code The zoning code establishes development standards, including height limits for accessory buildings. Communities typically regulate accessory structures differently depending on whether they are attached or detached from the principal structure, or they may apply the same standards to both. In residential areas, this affects garages, sheds, and similar structures. These requirements are intended to manage neighborhood built form and reflect that accessory structures are incidental or subordinate to the principal use. Some communities treat attached accessory structures as part of the principal building, applying the same height and setback standards as the house. Because attached garages (and living or storage spaces above them) are now common for single-family housing, applying separate standards can be unnecessarily complex. As a result, it may no longer be necessary to limit the height of attached garages in the same manner as sheds, greenhouses, and detached garages. For Mounds View, requirements for accessory buildings apply to garages, carports, tool houses, and sheds. The same requirements currently apply whether the building is attached or detached from the principal building on the site. As noted previously, Section 160.087(A)(2) states that "Accessory buildings shall not exceed 18 feet or that of the principal structure, whichever is less, in height...". Section 160.028(A) states that: 'An accessory building shall be considered an integral part of the principal building if it is connected to the principal building by a covered passageway."Based on Section 160.028, it would make sense to have an attached accessory structure follow the same requirements (height, setbacks, etc.) as a principal structure. It would also make sense for detached accessory structures to adhere to different standards, as they are not `an integral part'of the principal building. To provide a look at some nearby examples, staff reviewed the requirements of the communities abutting the city (see Table 1). Arden Hills and Blaine have the same requirements applying to accessory structures, whether they are attached or detached. New Brighton differentiates between "minor" accessory structures (a structure with a floor area under 200 square feet in size) and "major" accessory structures. Shoreview and Spring Lake Park have established different requirements based on whether an accessory structure is attached or detached from the principal structure. This type of change would appear to meet the intent of the existing code; as previously noted Section 160.028(A) states that: "An accessory building shall be considered an integral part of the principal building if it is connected to the principal building by a covered passageway."Detached accessory structures would still be limited in height, as they are under today's code. In the case of our applicant, the change would need to allow an attached structure to be taller than the house. An example would be: Accessory structures that are attached to the principal structure shall be limited to a maximum height of 30 feet. The concern from staff under this scenario would be how to treat space above an attached garage that is not garage space. Would this space be considered, for the purposes of this height requirement, part of the accessory structure, and therefore limited in height? If the space above a garage is not accessible from the house (meaning one must be in the garage to access the space) should it be limited in height? Keep code as-is Denying the requested amendment would result in the applicant needing a variance for their proposed project. Variances must meet the criteria in Section 160.466. The threshold for approving a variance can be difficult to meet, especially a variance to exceed height requirements. Criteria: The zoning code lists criteria for the city to consider when reviewing an amendment to the zoning code, per Section 160.450(E). These are listed below in italics, with comments from staff following: (1) Relationship to Municipal Comprehensive Plan; The 2040 Plan does not explicitly discuss accessory structures. The following goals and policies in the Plan would appear to support a change to the requirements or standards for accessory structures: Housing Policy Goal #2: Maintain the residential character of Mounds View. Housing Policy Goal #2, Policy #1: Preserve single-family neighborhoods. Housing Policy Goal#3: Support a mix of housing types reflective of the needs and desires of the community. (2) The geographical area involved; The proposed changes would apply to single-family residential zones of the city. This would include the R-1, R-2, R-3, as well as the R-4 zone. Such a change would give property owners more flexibility in designing additions and changes to their homes, while still limiting built form to the same height requirements of a house. (3) Whether the use will tend to or actually depreciate the area in which it is proposed; There is no evidence on how the proposed amendment would impact property values. (4) The character of the surrounding area; and The city already has instances of tuck-under garages or split level homes, though few examples of an attached garage being taller than the house. The proposed amendment would give property owners more flexibility in designing additions and changes to their homes, while still limiting built form to the same height requirements of a house. The city has received inquiries about development at heights taller than currently allowed, demonstrating a demand for the proposed amendment. The current zoning code already considers attached accessory structures 'integral parts'of the principal structure, therefore supporting the proposed amendment. Comments: The city's Building Official provided the following comments: "The 18' max height (or match of principal) [appears to have been] intended for detached accessory structures.And that an attached garage was not subject to the 18' (or principal structure match) limit since it was `an integral part of the principal building' per ordinance. Basically, meaning as long as it was attached to the house it was only limited to the 45' max height of an R1 structure." "[The space above the garage] would still not be connected to the house (principal structure). Meaning you would still have to exit the home - into the garage first - to access the space. I explained to her that since it is not connected directly to the existing habitable space and `thermal envelope' of the home itself — [the] Building Code still just considers it part of the accessory structure." The Planning Commission held a public hearing and reviewed the request at their 5/6/2026 meeting. The commissioners discussed potential ways to allow attached accessory structures to be taller than the principal structure (house), while ensuring that attached accessory structures heights are not towering over existing residences. The proposed language would limit the height to 12 feet taller than the principal structure, not to exceed two stories in height. In addition, the attached accessory structure would have to adhere to the same setback requirements as the principal structure, and could not exceed the maximum height allowed in the underlying zoning district. This recommendation was reviewed by the Council, along with holding the first reading of said ordinance, at the 5/11/2026 City Council meeting. Review Period: The application was deemed complete on April 16, 2026. The 60-day deadline for final action by the City Council is set to end on June 15, 2026. Options: The City Council has the following options with this request: 1. Approve the request, with findings. a. Ordinance 1064 is included in the meeting packet. 2. Deny the request, with findings for denial. 3. Table the request for further review/study. Detached accessory structures shall be limited to a maximum height of 18 feet or the height of the principal structure, whichever is less. Accessory buildings shall not exceed 18 feet or that of the principal structure, whichever is less, in height, shall be five feet or more from all lots lines of adjoining lots and shall have a pitch or slope of at least 2-12, but no steeper than 12-12. Background; authority. 1.01.The City of Mounds View ("City") has adopted a zoning ordinance pursuant to the authority granted by the Municipal Planning Act. M.S. §§ 462.351 to 462.365, inclusive, as they may be amended from time to time. 1.02.Sections 160.450 and 160.451 of the Mounds View Zoning Ordinance detail the process and requirements for amending the zoning ordinance. 1.03.Section 160.028(A) of the code currently states that: "An accessory building shall be considered an integral part of the principal building if it is connected to the principal building by a covered passageway." 1.04.Section 160.056(C)(6) states that "The height of any accessory building or structure shall not exceed 18 feet or that of the principal structure, whichever is less." Section 160.087(A)(2) states that "Accessory buildings shall not exceed 18 feet or that of the principal structure, whichever is less, in height"; Section 2.Amendment Request. 2.01. The property owner of 8150 Eastwood Road, Heidi Schroeder, has submitted an application to the city requesting an amendment to the city's zoning code to allow accessory structures that are attached to be taller in height than currently allowed. 2.02. Having received the request from the applicant to amend the ordinance as described in Section 2, the City published notice of the amendment request in the official newspaper on April 23, 2026, and mailed notice of a public hearing to surrounding property owners within 500 feet. 3.02. A public hearing was held on May 6, 2026, by the Mounds View Planning Commission, and all persons desiring to be heard with reference to the amendment were heard at said public hearing. The staff report from the City Planner dated 4/28/2026 is hereby incorporated by reference. 3.03. The Mounds View City Council finds and determines that it is in the best interests of the City to amend the ZONING ORDINANCE REGARDING HEIGHT OF ATTACHED ACCESSORY STRUCTURES. 3.04. The Mounds View City Council, after considering the reports of City staff and information at the public hearing, voted to amend the zoning ordinance as shown in Sections 2.02 and 2.03. 3.05. The Mounds View City Council makes the following findings regarding the amendment request: 1. The 2040 Plan does not explicitly discuss accessory structures. The following goals and policies in the Plan would appear to support a change to the requirements or standards for accessory structures: Housing Policy Goal #2: Maintain the residential character of Mounds View. Housing Policy Goal #2, Policy#1: Preserve single-family neighborhoods. Housing Policy Goal #3: Support a mix of housing types reflective of the needs and desires of the community. 2. The proposed changes would apply to single-family residential zones of the city. This would include the R-1, R-2, R-3, as well as the R-4 zone. Such a change would give property owners more flexibility in designing additions and changes to their homes. 3. There is no evidence on how the proposed amendment would impact property values. 4. The city already has instances of tuck-under garages or split level homes, though few examples of an attached garage being taller than the house. The proposed amendment would give property owners more flexibility in designing additions and changes to their homes, while still limiting built form to the same height requirements of a house. 5. The city has received inquiries for development at heights taller than currently allowed, demonstrating a demand for the proposed amendment. The current zoning code already considers attached accessory structures `integral parts' of the principal structure, therefore supporting the proposed amendment. Section 4. Our existing principal structure, our house, is 18' in height and we are seeking to turn our one car garage into a two-car garage with habitable space above. The total height will be approximately 25'. 1 am proposing the height of an accessory structure, when attached, not be restricted to 18' or the height of the principal structure. Instead, an attached accessory structure should be limited to the same height requirements applicable to a house. Given that City Code 160.028(A) already considers attached accessory buildings as integral parts of the principal structure, this change would be consistent with the intent of the city's zoning code. This amendment would benefit myself and others in the community by not restricting the opportunity to expand habitable space. We take pride in our residence and see this expansion as an opportunity to invest in the property and, by extension, the community. These funds are generated by development and/or redevelopment in Mounds View. The largest contribution came from the development of the Medtronic Campus in which the funds were utilized to upgrade several playgrounds at the various parks, and constructing a new shelter building at Lambert Park. Unfortunately, there isn't developable land, and very little redevelopment in the City which resulted in minimal contributions to the Park Dedication Fund and Council has recognized the need to research other funding options. Progression in 2025: City Council approved Resolution 10129 on July 14, 2025, to adopt the Park System Master Plan. Resolution 10130 was approved to create an Advisory (sub) Committee (GOAL PARKS) for the Parks System Master Plan. The Committee would research funding options for implementing the 2040 Park System Master Plan, to include, but not limited to, a local levy, bonding (General Obligation Bonds), grants, or a local sales tax. Progression in 2026: At the March 26, 2026, Parks, Recreation and Forestry Commission Meeting, the GOAL PARKS Committee provided their recommendations for funding of the Park System Master Plan. On April 23, 2026, there was a joint City Council and Parks, Recreation and Forestry Commission meeting, to discuss the funding recommendations for the Parks System Master Plan. April 27, 2026, Resolution 10247 was approved by the Council, a Professional Service Agreement with WSB for the Park System Master Plan Education Campaign. Community Survey: Currently, Council is reviewing survey questions for the proposed Community Survey to gauge the level of community support for various funding options. Questions are being finalized with a target date for the week of June 1,2026, to have Morris Leatherman to begin the survey. At the March 30, 2026, Work Session, Staff recommended that the City also conduct a Park System Master Plan educational campaign. This campaign would focus on informing the Mounds View property owners with Park histories, past funding information, and options for funding of the Park System Master Plan. Staff proposed that the Council hire WSB for this educational campaign, and to also hire a part-time Marketing Intern to help facilitate the education component which will also include the Community Center remodel. Staff received cost proposals from two Architectural firms familiar with these type of projects. Kodet and Wold Architects and Engineers, cost break down includes the following; Kodet: • Develop a concept plan drawing showing all changes at a cost of$17,500.00 • Develop a phasing drawing to implement plans • Concept plan strategies to meet flexible future needs • Concept plan drawing, site plan drawing, elevations, and perspective renderings (2 interior, 2 exterior) as mutually determined • Concept plan Document • Stakeholder meetings, generally two to four groups, as mutually determined • Two (2) City Council process meetings in addition to the stakeholder meetings as mutually determined • Cost Estimation Services for pre-construction estimate by Kraus-Anderson at a cost of $7,000.00 Total Fee $24,500.00 Wold Architects and Engineers: Step 1: Facility Condition Assessment and Data Collection Step 2: Programming and Conceptual Design Step 3: Feasibility Analysis and Master Planning Proposed Professional Services $13,000.00 Mileage and Travel $ 1,000.00 Printing and miscellaneous cost $ 500.00 Total Fee $15,000.00 Staff met with both firms to review the proposals and their approach to this project. While both firms would bring their own strength and expertise to this project, Staff believes that Wold Architects and Engineers are a better fit. Strategic Plan Strategy/Goal: Maintain and Plan for Infrastructure Improvements. Financial Impact: This is not budgeted in the 2026 Budget and would require Council approval for$38,588.00, from the Special Project Fund, account 480-4360-3030.
