Resolution 10-019; Approve the Request for Conditional Use Permit (CUP) to Clearwire <br />Communications, LLC for the Installation of High -Speed Wireless Internet Antenna at <br />4001 Stinson Blvd <br />8 Planning Commission Chair Don Jensen reported on the Conditional Use Permit (CUP) <br />9 application by Clearwire Communications, LLC for the installation of high-speed wireless <br />10 intemet antenna at 40001 Stinson Boulevard. A public hearing was held at the January Planning <br />11 Commission meeting. Mr. Jenson stated that the Planning Commission unanimously <br />12 recommended approval of the CUP and outlined the four conditions of approval. <br />13 <br />14 Councilmember Stille inquired about the stipulation that the antenna be no higher than 30 feet <br />15 above the tallest point on the building. Mr. Jenson explained that the 30 foot height limit was <br />16 derived in the applicant's negotiations with staff and that the Clearwire antennas will not be <br />17 higher than antennas already in place on the roof. <br />18 <br />19 Motion by Councilmember Gray, seconded by Councilmember Stille, to approve Resolution 10- <br />20 019; Approve the Request for Conditional Use Permit (CUP) to Clearwire Communications, <br />21 LLC for the Installation of High -Speed Wireless Internet Antenna at 4001 Stinson Blvd <br />22 <br />23 Motion carried unanimously. <br />24 <br />25 VI. GENERAL BUSINESS OF COUNCIL. <br />26 <br />27 A. Resolution 10-020; Approving Installation of a Telecommunications Facility on the <br />28 City's Water Tank Located at 3109 — 33`d Avenue. Mike Morrison, presenting. <br />29 <br />30 City Manager Morrison explained that Clear Wireless, LLC "Clearwire" desires to install a high <br />31 speed wireless internet facility on the City's water tank located at 3109 — 33`d Avenue. The <br />32 installation of the equipment will provide a source of rental income. City Manager Momson <br />33 stated staff has worked with Clearwire and the City Attorney to negotiate a lease agreement that <br />34 is fair, comparable to other communication leases, and acceptable for both parties. To determine <br />35 the annual cost of the lease, staff contacted the Hennepin County Assessor's Office to review <br />36 financial numbers of other recently negotiated leases. Included in the Council packet is a <br />37 document comparing the current Sprint Lease to the proposed Clearwire Lease. <br />38 <br />39 City Manager Mornson reviewed the proposed resolution approving the installation of a <br />40 telecommunications facility on the City's water tank located at 3109 33`d Avenue. He noted the <br />41 resolution indicates that the City Attorney and City Engineer have reviewed and approved the <br />42 plans and specifications for the telecommunications facility and the lease agreement; however, <br />43 the City Engineer is still conducting this review. It is recommended that the resolution be <br />44 revised to include a statement that approval is contingent on City Engineer approval. <br />45 <br />
