He <br />asked the City Council to approve the request. <br />Mr. Thomas Shayn , 3209 Edward Street , appeared before the C ity Council and stated this <br />building will encounter significant ADA compliance iss ues. He stated the City will have to <br />enforce tighter use around food and the building will need a commercial kitchen. He indicated <br />this building was built as an office building and it will cost money to bring it up to Code and <br />meet ADA requirements and it may cost more than the building is worth. He felt this was not an <br />appropriate use and was hopeful the City wou ld determine this is not an appropriate use within <br />current codes. He added this is not prejudice and he wants everyone to be treated equally, but <br />felt this building was not designed for the proposed use and should remain light commercial. <br />Mr. John Kac zo r, 3404 32 nd Avenue NE, appeared before the Ci ty Co uncil and expressed <br />concern about the traffic and noise. He sta ted he was also conc e rned about safety and possible <br />violence against the Islamic Center. <br />Ms. Aysha Nazwaz, 1946 3'd Street NW, New Brighton , MN 55112, appeared before the Ci ty <br />Co uncil and stated the more we know about people the more we tend to break down barriers . <br />She stated that stereot yped images can create a lot of ten s ion and there is no way to have a multi- <br />cultural place live in peace unless you break down the barrier s by giving people a chance to <br />s peak and get to know one another. <br />Ci ty Attorney Lindgren stated that Minnesota Statutes Section 15 .99 requires the City Council to <br />take action this evening on the CUP application to either approve or deny the request. He <br />advised the City Council ha s the Planning Commission's recommendation and a resolution with <br />the Planning Commission's conditions and the City Council can accept or modify any of those <br />conditions. He s tated the City Council can also consider denial of the CUP request based on the <br />record and if there is a motion for denial , the City Council would advise staff to prepare findings <br />for consideration consistent with the record and brought back at a subsequent meeting, however, <br />given the deadline, the City Council mu st consider tho se finding s tonight. He presented draft <br />findings for the City Council that could le a d the C it y Council to conclude to deny the CUP. He <br />th e n provided a written narrative of the record in this matter and this narrative is part of the <br />official record. He advised that consistent with the study finding s a nd recommendation to <br />approve Option Three, the City Council asked staff to prepare a text amendment to eliminate all <br />assembly use from the Light Industrial district. He s tated the City Council can also appro ve the <br />recommendation of the Planning Commission to approve th e CUP request with detailed <br />conditions and any additional or amended findings remain the right a nd prerogative of the C ity <br />Co uncil. <br />Motion by Councilmember Stille, seconded by Co uncilmember Gray , to approve Resoluti on 12- <br />054, Denying a Conditional Use Permit for Religiou s Assembly at 3055 Old Highway 8.
