1 Councilmembers Marks and Ranallo moved that the Commission <br />recommendation be accepted. <br />3 Councilmember Makowske indicated she would rather see the specific <br />4 number of licenses dropped and Mr. Bonaventura's Conditional Use Permit <br />5 amended to delete any reference to number of licenses allowed this <br />6 location because: <br />7 *the fact that only a total of 106 such licenses are allowed in the <br />8 City by Ordinance would in itself place a certain limitation on the <br />9 number of licenses which would be available to Mr. Bonaventura; <br />10 *the Council would avoid specifying that almost half of the licenses <br />11 which can be issued would go to one business. <br />12 Mayor Sundland agreed that no top number should be imposed on this <br />13 permit, perceiving that the applicant had testified that 45 was the <br />14 optimum number of devices his operation could use anyway. <br />15 Mr. Childs told Councilmember Ranallo the Ordinance restricting the <br />16 number of licenses in the City had been adopted after the Fun Center had <br />17 opened and the licenses that establishment held were not limited by a <br />18 Conditional Use Permit. <br />19 Councilmember Marks indicated he would be willing to amend his motion <br />20 in accordance with Councilmember Makowske's recommendation, perceiving <br />'>1 there had been no such restrictions placed on any other business with <br />amusement devices up to now. <br />23 None of the residents who were present for the meeting indicated an <br />24 interest in the issue or objected to the deletion. <br />25 Council Action <br />26 Motion by Marks, seconded by Ranallo to delete all references to the <br />27 number of licenses for amusement devices contained in Conditional Use <br />28 Permit #88-08 which had been issued to Michael Bonaventura for the malt <br />29 shop at 3800 Silver Lake Road, finding that: <br />30 1. The deletion meets all three conditions which are required to be <br />31 satisfied before a Conditional Use Permit may be authorized. <br />32 2. There was no opposition demonstrated to increasing the number of <br />33 licenses allowed this establishment during the Planning Commission <br />34 hearing September 20th and no opposition to the deletion of license <br />35 limitations was expressed during the Council consideration. <br />36 3. The Council concurs with the Planning Commission perception that the <br />37 malt shop is an asset to the community. <br />IN <br />3 <br />Motion carried unanimously. <br />
