2City Council Regular Meeting Minutes <br />August 12, 2014 <br />Page 2 <br />1 Prohibited Signs (St. Anthony Mobil, 2801 Kenzie Terrace) Tabled at the July 8 2014 <br />2 City Council meeting. Mark Casey City Manager, presenting. <br />4 City Manager Casey explained that this matter was tabled at the July 8, 2014, City Council <br />5 meeting and the 120 -day deadline for making a decision on this item is September 24, 2014. <br />6 <br />7 Mr. Thomas Archambault, St. Anthony Mobil, approached the City Council and asked that the <br />8 City Council and Planning Commission move forward in a productive manner and asked that the <br />9 Planning Commission consider limiting the size and height of the requested sign to a maximum <br />10 height of 18" and limiting the message to only fuel prices with only one fuel price rather than <br />11 three fuel prices as recommended by the Planning Commission. He advised they presented <br />12 information to City Planner Johnson from the sign manufacturer about sign brightness and what <br />13 is acceptable in other municipalities, adding that the manufacturer recommends that signs be no <br />14 brighter than 3,000 nits during the day and 500-1,000 nits during nighttime hours. He suggested <br />15 that the City Council and Planning Commission consider setting off hours for signs, e.g., <br />16 midnight to 4:00 a.m., as a way to improve safety and enhance the appearance of the City. <br />17 <br />18 Councilmember Stille explained that the City Council heard two requests at its July 8d' meeting, <br />19 one request from St. Charles Borromeo to allow electronic signs for all public and private <br />20 schools and the other request from St. Anthony Mobil to allow signs advertising gas prices on all <br />21 gas stations throughout the community, and the request from St. Charles Borromeo was denied <br />22 and the request from St. Anthony Mobil was tabled. He stated that the statute requires the City <br />23 Council to act on any request within 120 days or the request is considered approved and the City <br />24 Council felt it was appropriate to bring back the request of St. Anthony Mobil and deny the <br />25 request in order to allow the City Council and Planning Commission to address this issue as <br />26 expeditiously as possible and to make sure it is done right the first time. <br />27 <br />28 Motion by Councilmember Stille, seconded by Mayor Faust, to deny the applicant's request for a <br />29 Zoning Ordinance text amendment to allow gasoline stations to use electronic message signs to <br />30 display gas prices only. <br />31 <br />32 Councilmember Gray stated he wanted to be clear that he would vote for the denial with the <br />33 understanding that the City Council and Planning Commission will be considering this issue <br />34 again in order to come up with a workable solution for the gas station and church as well as the <br />35 entire community. <br />36 <br />37 Motion carried 3-0. <br />38 <br />39 Councilmember Jenson arrived at 8:12 p.m. <br />40 <br />41 B. Ordinance 2014-03 (or 02)• an Ordinance Amending Chapter & 111.045 through & 111.057 <br />42 Pertaining to Tobacco (first reading). Mark Casey City Manager, presenting. <br />43 <br />44 City Manager Casey stated the City Council previously imposed a moratorium on the creation, <br />45 establishment, or operation of businesses that sell electronic cigarettes or on the sampling of <br />46 electronic cigarettes and related products and the moratorium was established to provide an <br />47 opportunity to research regulations of electronic cigarettes and related devices. He stated if the <br />48 Ordinance is adopted, electronic cigarettes would be regulated under the Minnesota Clean Air <br />
