55 <br />CITY OF SAINT ANTHONY VILLAGE <br />STATE OF MINNESOTA <br />ORDINANCE NO. 2014-02 <br />AN ORDINANCE AMENDING CHAPTER § 111.045 THROUGH § 111.057 <br />PERTAINING TO TOBACCO <br />The City Council of the City of Saint Anthony Village ordains as follows: <br />Section One. Amendment to the City of Saint Anthony Village City Code Section § 111.045 through <br />§ 111.057 of the City Code of the City of Saint Anthony Village are hereby amended as follows. The <br />deleted language is represented by s'•'�saugh text. The additional language is represented by <br />underlined text. <br />§ 111.045 PURPOSE. <br />The city recognizes that many persons under the age of 18 years purchase or otherwise obtain, <br />possess, and use tobacco, tobacco products, tobacco related devices, and electronic delivery devices, the <br />sale, possession, and use of which are violations of both state and federal laws. The city further <br />recognizes the public health hazards of exposure of individuals to secondhand smoke. This subchapter <br />is intended to regulate the sale, possession, and use of tobacco, tobacco products, tobacco related <br />devices, and electronic delivery devices for the purpose of enforcing and furthering existing laws, to <br />protect minors against the serious effects associated with the illegal use of tobacco, tobacco products, <br />tobacco related devices, and electronic delivery devices, to protect individuals from the hazards of <br />secondhand smoke, and to further the official public policy of the State of Minnesota as stated in M.S. § <br />144.391 and M.S. § 144.412, as they may be amended from time to time. (1993 Code, § 510.01) (Am. <br />Ord. 2011-01, passed 4-26-2011) <br />§ 111.046 DEFINITIONS. <br />For the purpose of this subchapter, the following definitions shall apply unless the context clearly <br />indicates or requires a different meaning. <br />COMPLL4NCE CHECKS. The process the city uses to investigate and ensure that those authorized to <br />sell tobacco, tobacco products, or tobacco related devices are complying with the requirements of this <br />subchapter. COMPLL4NCE CHECKS shall involve minors who are authorized by this subchapter, <br />state and federal regulations and who attempt to purchase tobacco, tobacco products, or tobacco related <br />devices for educational, research, and training purposes, and for the enforcement of the aforementioned <br />city, state, and federal regulations pertaining to tobacco, tobacco products, and tobacco related devices. <br />ELECTRONIC DELIVERY DEVICE. Any product containing or delivering nicotine, lobelia, or any <br />other substance intended for human consumption that can be used by a person to simulate smoking in the <br />delivery of nicotine or any other substance through inhalation of vapor from the product.
