CITY OF SAINT ANTHONY <br />STATE OF MINNESOTA <br />RESOLUTION 14 -088 <br />A RESOLUTION APPROVING THE CONSENT ORDER IN THE FEDERAL COURT <br />MATTER CAPTIONED UNITED STATES OF AMERICA v. CITY OF SAINT <br />ANTHONY VILLAGE, MINNESOTA AND THE CONTINGENT SETTLEMENT <br />AGREEMENT IN THE FEDERAL AND STATE COURT MATTERS CAPTIONED <br />ABU - HURAIRA ISLAMIC CENTER AND MUXAMEDRASHID ALI v. CITY OF ST. <br />ANTHONY <br />WHEREAS, the United States of America ( "United States ") filed a complaint against the City <br />under the Religious Land Use and Institutionalized Persons Act of 2000 in <br />Federal District Court. <br />WHEREAS, the Abu - Huraira Islamic Center and Muxamedrashid Ali (together, "AHIC ") <br />initiated related actions in Federal and State District Courts. <br />WHEREAS, representatives of the United States, AHIC and the City participated in a <br />settlement conference on December 11, 2014, before Federal Magistrate Judge <br />Jeffrey J. Keyes and agreed, in principle, to a settlement of all matters contained <br />in the above referenced matters, subject to (i) approval of the settlement by the <br />City Council and (ii) required subsequent procedures required under the City's <br />zoning ordinances. <br />WHEREAS, the terms of that settlement are recited in the Consent Decree and Contingent <br />Settlement Agreement that are attached as Exhibit A to this Resolution. <br />NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Saint Anthony <br />does hereby approve the following: <br />1. Consent Decree; and <br />2. Contingent Settlement Agreement. <br />BE IT FURTHER RESOLVED, that the Mayor and City Manager are authorized to execute the <br />same on behalf of the City. <br />Adopted this 23`d day of December, 2014. <br />Jerome O.
