37 <br />CITY OF SAINT ANTHONY VILLAGE <br />STATE OF MINNESOTA <br />ORDINANCE NO. 2015-02 <br />AN INTERIM ORDINANCE PROHIBITING MEDICAL CANNABIS <br />MANUFACTURERS AND CANNABIS FACILITIES <br />THE CITY COUNCIL OF THE CITY OF SAINT ANTHONY VILLAGE ORDAINS AS <br />FOLLOWS: <br />Section One. Definitions. <br />Cannabis Facility shall mean any business or facility operated for the purpose of <br />cultivating, acquiring, manufacturing, possessing, preparing, transferring, <br />transporting, supplying, or dispensing Medical Cannabis or any related supplies. <br />City means the City of St. Anthony Village. <br />Health Care Practitioner shall have the definition given in Minnesota Statute § <br />152.22, Subd. 4. <br />Medical Cannabis shall have the definition given in Minnesota Statute § 152.22, <br />Subd. 6. <br />Medical Cannabis Manufacturer shall have the definition given in Minnesota <br />Statute § 152.22, Subd. 7. <br />Official Controls means the ordinances and regulations which control the <br />physical development of the City, or any part thereof or any detail thereof and <br />implement the general objectives of the comprehensive plan, including the <br />ordinances establishing zoning, subdivision controls, site plan regulations, <br />sanitary codes, building codes and official maps. <br />Patient shall have the definition given in Minnesota Statute § 152.22, Subd. 9. <br />Registered Designated Caregiver shall have the definition given in Minnesota <br />Statute § 152.22, Subd. 11. <br />Section Two. Intent. The 2014 Minnesota Session Laws Chapter 311, §§1-22, codified <br />at Minnesota Statute § 152.22-37, legalized and established regulations for Medical Cannabis <br />and Medical Cannabis Manufacturers. Medical Cannabis Manufacturers and Cannabis Facilities <br />represent new land uses not currently regulated by the Official Controls. It is the intent of this <br />ordinance to allow the City time to complete an in-depth study evaluating the need to revise the <br />Official Controls to regulate Medical Cannabis Manufacturers and Cannabis Facilities and in the <br />interim protect the City's planning process and the health, safety and welfare of its citizens. <br />Section Three. Study Authorization. City Staff are hereby authorized and directed to <br />study the need for revisions to the Official Controls to regulate Medical Cannabis Manufacturers <br />and Cannabis Facilities. The City Staff shall report their findings to the City Council within one <br />year of the effective date of this Interim Ordinance or sooner as circumstances may allow. <br />Section Four. Interim Prohibition. While this Interim Ordinance remains in effect, <br />Medical Cannabis Manufacturers and Cannabis Facilities are prohibited in the City. <br />
