Vin%ae <br />thony <br />i CJ <br />MEMORANDUM <br />To: Honorable Mayor and City Council Members <br />Mark Casey, City Manager <br />From: Kelsey Johnson, AICP, City Planner <br />Date: January 14, 2015 <br />City Council Regular Meeting for February 10, 2015 <br />WSB Project No. 02170-090 <br />Request: Request for a Conditional Use Permit (CUP) to Allow a Restaurant to be <br />Located Less than 250 Feet from a Residentially Zoned District and a <br />Variance from the Minimum Required Parking Stalls on the Property <br />Located at 2510 Kenzie Terrace <br />BACKGROUND <br />The Applicant submitted a request for a conditional use permit (CUP) to allow a restaurant ('Busters") to <br />be located less than 250 feet from a residentially zoned district and a variance from the minimum <br />required parking stalls on the Property located at 2510 Kenzie on October 14, 2014. The Planning <br />Commission held a public hearing on the request at their regular meeting on November 24, 2014 and <br />recommended approval of the CUP and Variance with a vote of 5-0. <br />At the regular meeting of the City Council held on December 9, 2014, the Council tabled the request and <br />sent the item back to the Planning Commission for further review and comment on the following items: <br />• Restriction on hours of operation; <br />• Additional screening along the south property boundary. <br />At the January 26, 2015 regular meeting of the Planning Commission, the Commission recommended <br />approval of the Conditional Use Permit and Variances with modified conditions as outlined in Exhibit D <br />with a vote of 7-0. <br />GENERAL INFORMATION <br />Applicant: <br />Joel Janssen <br />Owners: <br />R.J.
